FAITS ET PROCEDURE
Le 8 avril 2025, la division centrale de Paris a été saisie, par la société Scantrust, d’une demande en nullité du brevet EP 2 364 485, ayant pour titre « Procédé et dispositif d’authentification de codes géométriques », dont la société Advanced Track And Trace (ATT) est titulaire.
La procédure écrite a été clôturée le 8 juillet 2025 et l’audience de plaidoiries a été fixée au 25 septembre 2025.
Les parties s’étant rapprochées en vue d’un règlement amiable du litige, la société Scantrust a sollicité l’homologation du protocole d’accord transactionnel régularisé entre elles le 22 septembre 2025 et la publication d’une version caviardée de cet accord, en application des dispositions de la Règle 365(2) Rdp, par mémoire du 24 septembre 2025.
MOTIFS DE LA DECISION
Conformément à la demande formulée par les parties à l’audience, il y a lieu d’homologuer la transaction signée le 22 septembre 2025 entre les parties, par laquelle elles mettent fin au présent litige, en vertu des dispositions de l’article 79 de l’Accord relatif à une juridiction unifiée du brevet. En conséquence, conformément à Règle 365(1) RdP, la transaction homologuée peut être exécutée en tant que décision au fond de la présente juridiction.
La société Scantrust a communiqué une version caviardée et une version non caviardée du protocole d’accord régularisé entre les parties.
Il y a lieu d’ordonner, à la demande des parties, que certains détails de cette transaction restent confidentiels, en application de la Règle 365(2) RdP.
Chaque partie conserve à sa charge les frais et honoraires de conseils et d’avocats qu’elle a engagés dans le cadre du présent litige devant la Juridiction unifiée du brevet.
DECISION
La Juridiction unifiée du brevet :
HOMOLOGUE le protocole d’accord transactionnel conclu par les parties le 22 septembre 2025, qui est annexé à la présente décision dans une version confidentielle ;
DIT que la version non caviardée de ce protocole demeurera confidentielle et est exclue de l’accès au public;
ORDONNE l’inscription au registre de la présente décision et de son annexe, constituée de la transaction dans sa version confidentielle ;
DIT que chacune des parties conservera la charge de ses propres frais exposés pour la présente instance ;

SUBJECT: Rule 365 RdP – Approval of a settlement by the Court

FACTS AND PROCEDURE
On 8 April 2025, Scantrust filed an application with the Central Division in Paris for the revocation of
patent EP 2 364 485, entitled "Method and device for authenticating geometric codes", held by
Advanced Track And Trace (ATT).
The written proceedings were closed on 8 July 2025 and the hearing was set for 25
September 2025.
As the parties had reached an amicable settlement of the dispute, Scantrust requested approval of
the settlement agreement formalised between them on 22 September 2025 and the publication of a
redacted version of this agreement, in accordance with the provisions of Rule 365(2) Rdp, in a brief
dated 24 September 2025.

REASONS FOR THE DECISION
In accordance with the request made by the parties at the hearing, the settlement agreement signed
on 22 September 2025 between the parties, whereby they terminate the present dispute, should be
approved pursuant to the provisions of Article 79 of the Agreement on a Unified Patent Court.
Consequently, in accordance with Rule 365(1) RdP, the approved settlement may be enforced as a
decision on the merits of this court.
Scantrust has provided a redacted and unredacted version of the
memorandum of understanding agreed between the parties.
It is appropriate to order, at the request of the parties, that certain details of this settlement remain
confidential, pursuant to Rule 365(2) RdP.
Each party shall bear its own costs and fees for legal and other advisers.
in the context of the present dispute before the Unified Patent Court.

DECISION
The Unified Patent Court:
APPROVES the settlement agreement concluded by the parties on 22 September 2025,
which is annexed to this decision in a confidential version;
DECLARES that the unredacted version of this agreement shall remain confidential and shall be
excluded from public access
to the public;
ORDERS the entry in the register of this decision and its annex, consisting of the
confidential version of the settlement;
DECLARES that each party shall bear its own costs incurred in connection with these proceedings;
