GEGENSTAND: Art. 60 EPGÜ, R. 194 (d), 196, 197, 199 VerfO – Antrag auf Inspektion und Beweissi-cherung

ZUSAMMENFASSUNG DES SACHVERHALTS:
Am 22. September 2025 hat die Antragstellerin im Vorfeld einer Hauptsacheklage einen Antrag auf Anordnung einer Inspektion und Beweissicherung auf dem Messestand der Antragsgegnerin ge-stellt.
Die Antragstellerin ist alleinige Inhaberin des Europäischen Patents 2 983 864 B1 (Anlage HRM 3; nachfolgend Antragspatent), das am 26. März 2014 unter Inanspruchnahme der Priorität zweier deutscher Patentanmeldungen (DE 102013006010 sowie DE 102013016053) vom 9. April 2013 bzw. vom 27. September 2013 in deutscher Verfahrenssprache angemeldet wurde. Die Veröffent-lichung der Erteilung des Antragspatents erfolgte am 26. April 2017. Das Antragspatent ist aktuell in Österreich, Belgien, der Schweiz und Liechtenstein, der Tschechischen Republik, Deutschland, Spanien, Frankreich, Großbritannien, Irland, Italien, Luxemburg, Polen und der Türkei in Kraft.
Gegen die Erteilung des Antragspatents wurde kein Einspruch eingelegt. In einem von der Antrag-stellerin gegen die Antragsgegnerin geführten Hauptsacheverfahren vor der Lokalkammer Düssel-dorf betreffend eine andere Maschine (UPC_CFI_511/2025; dazu näher unten) hat die Antragsgeg-nerin mit Schriftsatz vom 16. September 2025 eine Widerklage auf Nichtigerklärung des Streitpa-tents erhoben.
Das Antragspatent trägt die Bezeichnung „Verfahren und Vorrichtung zur Oberflächenbehandlung von Werkstücken“. Sein Patentanspruch 1 ist wie folgt formuliert:
„Verfahren zur Oberflächenbearbeitung von Werkstücken, indem das Werkstück relativ zu einer Schüttung aus einem Schleif- und/oder Poliergranulat bewegt wird, wobei das Werk-stück in Bezug auf die Schüttung aus dem Schleif- und/oder Poliergranulat um zumindest eine Achse rotiert (P4) wird, wobei das Werkstück in Bezug auf die Schüttung aus dem Schleif- und/oder Poliergranulat auf verschiedene Rotationsgeschwindigkeiten (R1, R2) be-schleunigt wird, dadurch gekennzeichnet, dass das Werkstück und/oder ein die Schüttung aus dem Schleif- und/oder Poliergranulat aufnehmender Behälter (11) unter fortwährender Beschleunigung mit fortwährend unterschiedlichen Rotationsgeschwindigkeiten rotiert wird bzw. werden.“
Bei der Antragsgegnerin handelt es sich um die Muttergesellschaft der GPAINNOVA-Gruppe. Die GPAINNOVA-Gruppe ist in verschiedenen Technologiebereichen tätig, darunter Oberflächenvere-delung, Meeresrobotik, Hochleistungselektronik und Medizintechnik.
Die Antragsgegnerin bietet Elektropoliermaschinen in verschiedenen Größen für verschiedene An-wendungsbereiche an. Auf ihrer Internetseite https://www.dlyte.com/de/produkte/ bietet die An-tragsgegnerin unter ihrer Marke „DLyte“ Maschinen der PRO500-Serie an, namentlich die PRO 500, die PRO500 Carbide und die PRO500 Hybrid. Diese Maschinen sind nach den Angaben auf der Web-seite für den industriellen Einsatz konzipiert und vielseitig in Branchen wie der Automobilindustrie, der Luft- und Raumfahrt, dem Werkzeugbau und der Medizintechnik einsetzbar. Hinsichtlich der Darstellung der Maschinen auf der Internetseite wird auf die Anlagen HRM 6 und HRM 7 Bezug genommen.
Derzeit ist die Antragsgegnerin auf einem Messestand der EMO Messe Hannover 2025 zugegen, die vom 22. September 2025 bis 26. September 2025 in Hannover stattfindet. Sie stellt dort eine „DLyte PRO500 Automated Cell“ aus.
Die „DLyte PRO500 Automated Cell“ gehört zur „PRO500“-Serie und setzt sich aus mindestens ei-ner „DLyte PRO500“ und einer automatisierten Zelle (automated cell), bestehend aus einer Zelle und einem Roboterarm, zusammen. Während die „DLyte PRO500“ einen Elektropoliturprozess durchführt, sorgt die automatisierte Zelle für eine automatische Be- und Entladung der Maschine. Wegen des Inhalts einer Produktbroschüre zu der „DLyte PRO500“ wird auf die Anlage HRM 20 Bezug genommen. Für die Herstellung, die Vermarktung und den Vertrieb der „DLyte PRO500 Au-tomated Cell“ ist die Antragsgegnerin verantwortlich.
Die Antragstellerin hatte gegen die Antragsgegnerin und eine weitere Partei bereits am 25. März 2025 einen Antrag auf Besichtigung von Elektropoliturmaschinen bei der Lokalkammer Düsseldorf gestellt, nämlich solchen der „DLyte Compact“-Serie. Die Lokalkammer Düsseldorf erließ am 26. März eine Inspektions- und Besichtigungsanordnung. Die daraufhin durchgeführte Besichtigung fand am 26. März 2025 auf der Messe Interdentalschau (IDS) in Köln statt. Der als Sachverständiger ernannte Patentanwalt Stephan Freischem erstellte am 23. April 2025 ein Gutachten, wegen des-sen Inhalt auf die Anlage HRM 26 Bezug genommen wird. Am 12. Juni 2025 reichte die Antragstel-lerin bei der Lokalkammer Düsseldorf eine Hauptsacheklage ein (UPC_CFI_511/2025). Die Besich-tigung einer „PRO500“-Maschine war auf der IDS in Köln nicht möglich, da diese dort nicht ausge-stellt war.
Die Antragstellerin trägt vor, es sei ihr nicht möglich, Zugang zu einer „PRO500“-Maschine zu er-halten. Zum einen liege bereits der Preis für deutlich kleinere Maschinen der Antragsgegnerin zwi-schen 30.000,- EUR und 100.000,- EUR, so dass anzunehmen sei, dass der Preis für die deutlich größere Maschine „PRO500“ deutlich über 100.000,- EUR liege. Ein Testkauf, selbst wenn es die Möglichkeit gäbe, wäre daher unzumutbar. Zum anderen sei ihr, der Antragstellerin, der Erwerb einer solchen Maschine aufgrund der Vertriebswege für derartige hochspezialisierte Industriema-schinen, die als personalisiertes Geschäft über „bekannte“ Vertriebswege, ein exklusives Händler-netz, vertrieben würden, nicht möglich. Pro Land gebe es meist nur einen und in größeren Ländern zwei feste Wiederverkäufer von Maschinen der Antragsgegnerin. Die Wiederverkäufer hätten eine sehr enge Beziehung zum jeweiligen Hersteller der Maschinen, so dass die Antragstellerin nicht beliefert werden würde. Ein anonymer Kauf der in Rede stehenden Maschinen sei auch deshalb nicht möglich, weil die Käufer dieser Maschinen wegen der enormen finanziellen Belastung durch einen Kauf sicherstellen wollten, dass die Maschinen den erwünschten Mehrwert in ihrem Ge-schäft mit sich bringen. Normalerweise finde eine Probebearbeitung in den Räumlichkeiten des Herstellers statt oder die Kunden würden zunächst eine Testmaschine erhalten. Durch die Test-phase erhielten der Testkäufer oder seine exklusiven Wiederverkäufer einen engen Kontakt. Es würde daher auffallen, wenn dieser enge Kontakt im Einzelfall fehlen würde, wenn etwa die An-tragstellerin die Maschine nur zu Testzwecken erwerben wollte. Es würde vermutlich der Verkauf gestoppt werden. Gerade die hier in Rede stehenden großen, für industrielle Zwecke konzipierten Maschinen seien keine Produkte, die anonym erworben werden könnten. So würden beispiels-weise auf der Internetseite von Händlern, die die „PRO500“ vertrieben, nähere Informationen vom Senden einer Anfrage abhängig gemacht. Auch hierdurch werde die persönliche Ebene eines Kaufs deutlich, was einen anonymen Testkauf unmöglich mache.

ANTRÄGE DER ANTRAGSTELLERIN:
I. Der Antragstellerin zu gewähren:
1. Eine sich in einem funktionsfähigen Zustand befindliche DLyte PRO500 Automa-ted Cell vor Ort am Messestand der Antragsgegnerin auf der EMO Messe Hanno-ver 2025, die in Hannover vom 22. September 2025 bis einschließlich 26. Sep-tember 2025 auf dem Messegelände, Hermes Allee, 30521 Hannover, Deutsch-land stattfindet, durch einen Gerichtsvollzieher, einen Sachverständigen und ei-nen rechtsanwaltlichen und einen patentanwaltlichen EPG Vertreter der Antrag-stellerin zu inspizieren, insbesondere:
a. die DLyte PRO500 Automated Cell in Betrieb zu nehmen, wobei der An-tragsgegnerin aufgegeben wird, etwa erforderliche Passwörter einzuge-ben,
b. zum Zwecke und für die Dauer der Messungen des Bewegungsablaufs und der Rotationsgeschwindigkeit des Werkstückhalters der DLyte PRO500 Automated Cell, ein Smartphone am Werkstückhalter zu befestigen,
c. geeignete Einstellungen an der DLyte PRO500 Automated Cell vorzuneh-men, um Verfälschungen des Messergebnisses zu vermeiden, insbeson-dere die Deaktivierung der Vibrationseinheit des Behälters,
d. ein Programm an der DLyte PRO500 Automated Cell auszuwählen und ein-zuschalten, das den Werkstückhalter zum Zwecke der Messung in Bewe-gung setzt,
e. sofern von der DLyte PRO500 Automated Cell vorgesehen, ein Programm selbst zu konfigurieren und einzuschalten, das den Werkstückhalter zum Zwecke der Messung in Bewegung setzt,
f. die Messung während des Betriebs der DLyte PRO500 Automated Cell durchzuführen,
g. den Messvorgang so häufig zu wiederholen, bis eine hinreichende Messung der Rotationsgeschwindigkeit und des Bewegungsablaufs des Werkstück-halters der DLyte PRO500 Automated Cell erfolgte,
2. oder eine vergleichsweise Messmethode anzuwenden.
3. Hilfsweise, im Falle einer Unmöglichkeit von Antrag I.1 und I.2.:
a. eine DLyte PRO500 Automated Cell und alle technischen, werblichen und kommerziellen Unterlagen in jeweils einer Kopie in Bezug auf die DLyte PRO500 Automated Cell während der EMO Messe Hannover 2025, die in Hannover vom 22. September 2025 bis einschließlich 26. September 2025 auf dem Messegelände, Hermes Allee, 30521 Hannover, Deutschland statt-findet, durch einen Gerichtsvollzieher physisch zu beschlagnahmen oder die DLyte PRO500 Automated Cell an jedem anderen Ort in Deutschland physisch zu beschlagnahmen;
4. eine ausführliche Beschreibung der DLyte PRO500 Automated Cell zu erstellen, die eine detaillierte Beschreibung der Merkmale der DLyte PRO500 Automated Cell sowie der relevanten technischen, werblichen und kommerziellen Dokumen-tation über die DLyte PRO500 Automated Cell an allen unter Ziff. I.1. genannten Orten;
II. Herrn Patentanwalt Stephan Freischem, Salierring 47-53, 50677 Köln, als Sachverstän-digen zu benennen und zu bestimmen, dass er durch einen europäischen Patentanwalt ersetzt werden kann, der in derselben Kanzlei wie Stephan Freischem arbeitet;
III. dem Gerichtsvollzieher Herrn […] zu gestatten, dass er bei der Durchführung der Be-weissicherungsmaßnahmen gemäß dem in dieser Sache zu erlassenden Beschluss von dem Sachverständigen unterstützt werden kann, und zu bestimmen, dass er im Fall seiner Nichtverfügbarkeit durch jeden anderen zuständigen Sachverständigen ersetzt werden kann;
IV. dass Herr Rechtsanwalt Joscha Torweihe, EPG Vertreter und in dieser Sache benannter rechtlicher Vertreter der Antragstellerin von der Kanzlei Hoyng ROKH Monegier, Stein-straße 20, 40212 Düsseldorf, bei den nach Ziff. I beantragten Maßnahmen anwesend sein darf, oder ein anderer Rechtsanwalt der Kanzlei Hoyng ROKH Monegier, falls Herr Torweihe nicht verfügbar sein sollte;
V. dass Herr Patentanwalt Steffen Lenz, EPG Vertreter und in dieser Sache mitwirkender Patentanwalt der Patentanwaltskanzlei Lichti, Bergwaldstraße 1, 76227 Karlsruhe, bei den nach Ziff. I beantragten Maßnahmen anwesend sein darf, oder ein anderer Patent-anwalt der Patentanwaltskanzlei Lichti, falls Herr Lenz nicht verfügbar sein sollte;
VI. anzuordnen, dass die Angestellten und Geschäftsführer der Antragsgegnerin nicht bei der Vollstreckung des in dieser Sache zu erteilenden Beschlusses anwesend sein dürfen und dass der Gerichtsvollzieher nicht berechtigt ist, hiervon gemäß dem anwendbaren nationalen Recht eine Ausnahme zu machen;
VII. anzuordnen, dass die an der Durchführung der Maßnahmen zur Beweissicherung ge-mäß der zu erlassenden Anordnung beteiligten Personen, wie der Gerichtsvollzieher, der Sachverständige und/oder der Parteivertreter, der Antragsgegnerin oder Dritten keine Informationen über diese Maßnahmen erteilen dürfen und keine Gelegenheit bieten dürfen, Einblick in die DLyte PRO500 Automated Cell oder den detaillierten Be-richt zu gewähren oder diese zu prüfen, es sei denn, die Antragsgegnerin stimmt zu oder auf der Grundlage einer weiteren Anordnung des EPG;
VIII. die Antragsgegnerin zu verpflichten, bei der Durchführung der Maßnahme zur Inspek-tion und Beweissicherung gemäß dem in dieser Angelegenheit zu erlassenden Be-schluss mitzuwirken und dem Gerichtsvollzieher und dem Sachverständigen auf deren Anforderung hin,
- uneingeschränkten Zugang zur DLyte PRO500 Automated Cell zu gewähren, ein-schließlich der Eingabe von Passwörtern,
- Zugang zu einem Teil der DLyte PRO500 Automated Cell zu gewähren, und/oder
- die DLyte PRO500 Automated Cell in Betrieb zu setzen und in verschiedene Be-triebszustände zu bringen;
IX. die Antragsgegnerin zu verpflichten, ihre Geschäftsführer und Mitarbeiter anzuweisen, den Aufforderungen des Gerichtsvollziehers und/oder des Sachverständigen entspre-chend Ziff. VII. nachzukommen;
X. ein Zwangsgeld in Höhe von 2.500,- EUR pro 15-minütigem Zeitraum, der zwischen der Aufforderung des Gerichtsvollziehers oder des Sachverständigen, Zugang zur Inspek-tion gemäß Ziff. I zu gewähren, und der tatsächlichen Gewährung des angeforderten Zugangs verstreicht, festzusetzen;
XI. anzuordnen, dass der Gerichtsvollzieher der Antragsgegnerin eine Kopie des in dieser Angelegenheit zu erlassenden Beschlusses zusammen mit einer Kopie des Antrags vor-legen muss, zumindest einem Vertreter der Antragsgegnerin, der an dem Ort anwe-send ist, an dem die jeweiligen Maßnahmen durchgeführt werden;
XII. anzuordnen, dass die auf diese Weise zu erlassende Anordnung sofort vollstreckbar ist;
XIII. anzuordnen, dass die Zustellung durch den Gerichtsvollzieher im Zusammenwirken mit Herrn Rechtsanwalt Joscha Torweihe, wie unter Ziff. IV., erfolgt, oder einem anderen Rechtsanwalt der Kanzlei Hoyng ROKH Monegier, falls Herr Torweihe nicht verfügbar sein sollte;
XIV. alle Kostenentscheidungen vorerst auszusetzen.

GRÜNDE DER ANORDNUNG:
Der Antrag auf Anordnung einer Inspektion und Beweissicherung (R. 192, 199 VerfO) hat im teno-rierten Umfang Erfolg.
I. Die Lokalkammer Düsseldorf ist gemäß Art. 32 (1) c), 33 (1) b), 60 EPGÜ zuständig. Der Antrag ist gemäß R. 192 VerfO in zulässiger Art und Weise gestellt worden. Insbesondere hat die Antragstel-lerin vorgetragen, dass sie beabsichtigt, gegen die Antragsgegnerin bei der Lokalkammer Düssel-dorf Hauptsacheklage zu erheben.
II. Ferner hat die Antragstellerin glaubhaft dargelegt, dass das Antragspatent durch die Antragsgeg-nerin möglicherweise verletzt wird (Art. 60 (1) EPGÜ).

Angesichts der geschilderten Umstände des Falles ist es möglich, dass das Produkt „DLyte PRO500 Automated Cell“, wie es auf der Messe EMO Hannover ausgestellt ist, von der technischen Lehre des Antragspatents Gebrauch macht.
Die als Inhaberin des Antragspatents aktivlegitimierte Antragstellerin hat anhand einer Produkt-broschüre zu der „DLyte PRO500“ (Anlage HRM 20), einem auf Youtube abrufbaren Produktvideo (Anlage HRM 22) sowie Screenshots hieraus, einer auf der Internetseite der Antragsgegnerin ver-fügbaren technischen Zeichnung nebst einer Produktbeschreibung (Anlage HRM 24) sowie eines Vergleichs der Funktionsweise der „DLyte PRO500“ mit derjenigen der bereits sachverständig un-tersuchten Maschinen „DLyte 1D“ und „DLyte 100D“ (vgl. Gutachten vom 23. April 2025, Anlage HRM 26) nachvollziehbar dargelegt, weshalb sie von einer Verwirklichung sämtlicher Merkmale des Antragspatents bei dem Produkt „DLyte PRO500 Automated Cell“ ausgeht.
Die Antragstellerin war nicht gehalten, zu dem inzwischen mit einer Widerklage auf Nichtigerklä-rung angegriffenen Rechtsbestand des Streitpatents näher vorzutragen. Nachdem es keinen klaren Anhaltspunkt dafür gibt, den Rechtsbestand des Streitpatents in Zweifel zu ziehen, etwa in Folge einer negativen Rechtsbestandsentscheidung, war eine Prüfung des Rechtsbestands für den Erlass der vorliegenden Anordnung nicht erforderlich (vgl. UPC_CoA_327/2025, Anordnung vom 15. Juli 2025, Rn. 43 – Maguin v. Tiru).
III. Die Antragstellerin hat ferner dargelegt, dass der Antrag dringlich ist (R. 194.2 a) VerfO). Zudem hat sie Gründe für den Erlass einer Anordnung ex parte aufgezeigt (R. 194. 2 b), c), 197 VerfO).
1. Die Inspektion bzw. Beweissicherungsmaßnahme ist dringlich.
Dass das auf der EMO Messe Hannover 2025 ausgestellte Produkt „DLyte PRO500 Automated Cell“ möglicherweise von der technischen Lehre von Patentanspruch 1 des Antragspatents Gebrauch macht, hat die Antragstellerin nachvollziehbar dargelegt. Jedoch kann eine hinreichende Substan-tiierung nur über eine Untersuchung des auf der vorgenannten Messe ausgestellten Produktes er-folgen, im Rahmen derer Messungen über Bewegungsabläufe der Maschine und insbesondere zur Rotationsgeschwindigkeit und zum Beschleunigungsverhalten durchgeführt werden. Maschinen wie die „DLyte PRO500 Automated Cell“ sind nach dem Vortrag der Antragstellerin nicht leicht erhältlich und Unternehmen, die solche Maschinen gekauft haben und benutzen, sind im Allge-meinen nicht bereit, „Unternehmensfremden“ (Patentinhabern) Zugang zu ihren Räumlichkeiten oder Maschinen zu gewähren. Die EMO Messe Hannover 2025 bietet der Antragstellerin daher Gelegenheit, Beweise für die durch sie vermutete Verletzung des Antragspatents zu sammeln.
2. Die Anordnung war nach R. 192.3, 197 VerfO ex-parte zu erlassen. Andernfalls bestünde die nach-weisliche Gefahr, dass Beweismittel vernichtet oder aus anderen Gründen nicht mehr verfügbar sein werden (R. 197.1 Alt. 2 VerfO).
Wie die Antragstellerin nachvollziehbar erläutert hat, besteht die ernsthafte Gefahr, dass die „DLyte PRO500 Automated Cell“ kurzfristig vom Ausstellungsgelände entfernt oder mittels eines Software-Updates einzelne, von der Antragsgegnerin vorprogrammierte Polierprozesse deaktiviert werden. Dadurch können Beweise, anhand derer ggf. die Verletzung bestätigt werden könnte, verloren gehen. Für die Antragstellerin wäre es aufgrund der bereits im Einzelnen geschildeten beson-deren Marktverhältnisse nahezu unmöglich, Beweise für die aus ihrer Sicht gegebene Verletzung des Antragspatents durch die vorgenannten Produkte zu beschaffen.
IV. Im Rahmen der Ermessensentscheidung überwiegen die Interessen der Antragstellerin.
Die Antragstellerin hat anhand der ihr bisher zur Verfügung stehenden Informationen nachvoll-ziehbar dargelegt, weshalb sie von einer Verwirklichung sämtlicher Merkmale von Patentanspruch 1 des Antragspatents bei dem auf der EMO Messe Hannover 2025 ausgestellten Produkt ausgeht. Auch hat sie nachvollziehbar erläutert, aus welchen Gründen ihr aufgrund der gegebenen beson-deren Verhältnisse im relevanten Markt keine anderen Möglichkeiten offenstehen, Beweise für die aus ihrer Sicht vorliegende Verletzung des Antragspatents durch das Produkt „DLyte PRO500 Au-tomated Cell“ zu sammeln, weshalb sie zur Beweissicherung auf eine Untersuchung des auf der EMO Messe Hannover 2025 ausgestellten Produkts angewiesen ist.
Vor diesem Hintergrund bedarf es der vorliegenden Anordnung, um den insoweit überwiegenden Interessen der Antragstellerin gerecht zu werden. Die Antragsgegnerin wird durch die angeordne-ten Maßnahmen nicht unzumutbar belastet. Ihren Geheimhaltungsinteressen tragen die in die An-ordnung aufgenommenen Geheimnisschutzanordnungen hinreichend Rechnung.
V. Die Antragstellerin hat die Gerichtsgebühr für den Antrag auf Inspektion/Beweissicherung entrichtet, R. 192.5 VerfO.
VI. Die Anordnung sieht nach R. 196.4, .5 VerfO vor, dass ein Sachverständiger bestellt wird, der die Maßnahmen ausführt. Gegen die Person des Sachverständigen bestehen auch unter Berücksichti-gung der in der Antragsschrift wiedergegebenen Einwände der Antragsgegnerin in dem bereits vor der Lokalkammer Düsseldorf anhängigen und andere Produkte betreffenden Hauptsacheverfahren (UPC_CFI_511/2025) keine Bedenken. Der Sachverständige ist aufgrund der geschilderten Besich-tigung anderer Maschinen der Antragsgegnerin auf der Messe IDS Köln im März dieses Jahres mit der grundsätzlichen Technologie und dem Ablauf bereits vertraut. Seine Unparteilichkeit wird we-der per se durch die Teilnahme an einer gemeinsamen Veranstaltung der American Intellectual Property Law Association (AIPLA) und der GRUR-Praxisgruppe in den Kanzleiräumen der Prozess-vertreter der Antragstellerin noch durch den auch im Gutachten gemäß Anlage HRM 26 (dort An-lage SV1, Seite 5) geschilderten Kontakt zu einem Prozessvertreter der Antragstellerin in Frage ge-stellt.
Zur Unterstützung des Sachverständigen bei der Durchführung der Beweissicherung hat die Kam-mer von der durch R. 196.5 S. 2 VerfO eingeräumten Möglichkeit Gebrauch gemacht, die Unter-stützung durch einen Gerichtsvollzieher anzuordnen. Dessen Hinzuziehung war insbesondere für die hilfsweise beantragte dingliche Beschlagnahme notwendig, die nach dem nationalen Recht in die Zuständigkeit der Gerichtsvollzieher fällt (UPC_CFI_539/2024 (LK Düsseldorf), Anordnung v. 18.10.2024 – Bekaert Binjiang Steel v. Siltronic).
Einem jeweils namentlich benannten Rechts- und Patentanwalt der Antragstellerin war die Teil-nahme an der Besichtigung zu gestatten. Soweit die Antragstellerin in ihrem Antrag darüber hinaus formuliert, dass einem rechts- und einem patentanwaltlichen Vertreter die Inspektion selbst gewährt werden möge, war diesem nicht näher begründeten Begehren hingegen nicht nachzukommen.
Nach R. 196.5 VerfO waren Mitglieder oder Vertreter der Antragstellerin selbst von der Inspektion und Beweissicherung auszuschließen. Im Hinblick auf die Verhältnismäßigkeit und den Schutz ver-traulicher Informationen war auch die Personenanzahl der Prozessbevollmächtigten bei der In-spektion zu beschränken (Art. 60 (1) EPGÜ, R. 196.1 VerfO). Die ferner gegenüber den Prozessbe-vollmächtigten, dem Sachverständigen und dem Gerichtsvollzieher angeordneten Geheimnis-schutzmaßnahmen tragen den Geheimhaltungsinteressen der Antragsgegnerin ebenso wie das ge-schilderte Prozedere nach Erhalt der ausführlichen Beschreibung Rechnung.
Ferner war anzuordnen, dass die durch den Sachverständigen zu erstellende ausführliche Beschrei-bung nur in einem Hauptsacheverfahren gegen die Antragsgegnerin verwendet werden darf (R. 196.2 VerfO).
Die Kosten der durch den Sachverständigen durchzuführenden Inspektion und Beweissicherung einschließlich der durch den Sachverständigen zu erstellenden ausführlichen Beschreibung hat die Antragstellerin jedenfalls bis auf Weiteres zu zahlen, da sie die Inspektion begehrt. Soweit der Sachverständige nicht auf die Zahlung eines Vorschusses für seine Kosten verzichtet, hat die An-tragstellerin an den Sachverständigen vor Beginn der Inspektion eine durch diesen zu bestimmen-den, angemessenen Vorschuss zu zahlen.
Diese Anordnung ist zusammen mit den in Ziffer XV. genannten Schriftstücken durch den Gerichts-vollzieher im Zusammenwirken mit dem gemäß Ziffer VIII.1 an der Inspektion und Beweissicherung anwesenden rechtsanwaltlichen Vertreter der Antragstellerin gemäß R. 197.2 VerfO zuzustellen.
VII.
Die in die Anordnung aufgenommene allgemeine Androhung von Zwangsmitteln gibt der Kammer die notwendige Flexibilität, um auf eventuelle Verstöße gegen diese Anordnung unter Berücksich-tigung der Interessen beider Parteien sowie der Schwere des Verstoßes reagieren zu können.
Im konkreten Fall konnte von der Anordnung einer Sicherheitsleistung abgesehen werden. Die da-für bei einer ex-parte Anordnung notwendigen besonderen Umstände (R. 196.6 VerfO) liegen vor. Anders als bei einer Unterlassungsanordnung droht der Antragsgegnerin durch die Inspektion und Beweissicherung allenfalls ein geringfügiger Schaden. Sie ist auch weiterhin zum Angebot und Ver-trieb der zu untersuchenden Produkte berechtigt (UPC_CFI_260/2025 (LD Düsseldorf), Anordnung v. 26.03.2025, S. 9 f. – OTEC Präzisionsfinish v. STEROS; Abgrenzung zu: UPC_CFI_177/2023 (LK Düsseldorf), Anordnung v. 22.06.2023 – myStromer v. Revolt). Davon ausgehend und unter Be-rücksichtigung der kurzen Dauer der Messe würde die Anordnung einer Sicherheitsleistung die Be-weissicherung und Inspektion unangemessen verzögern, was es rechtfertigt, vorliegend von der Anordnung einer Sicherheitsleistung abzusehen.
VIII.
Soweit die Antragstellerin hilfsweise die Gestattung einer Beschlagnahme des zu untersuchenden Produkts „an jedem anderen Ort in Deutschland“ begehrt hat, konnte dem weder unter Be-stimmtheits- noch unter Verhältnismäßigkeitsgesichtspunkten entsprochen werden. Die Beschrei-bung der zulässigen Maßnahmen in der Anordnung trägt ebenfalls dem Bestimmtheitsgebot Rechnung.

Gründe für einen Ausschluss von Vertretern und Mitarbeitern der Antragsgegnerin von der Teil-nahme an der Inspektion sind nicht ersichtlich. Einem solchen, durch die Antragstellerin begehrten Ausschluss steht bereits entgegen, dass die Mitarbeiter und Geschäftsführer der Antragsgegnerin, dem Begehren der Antragstellerin folgend, den Aufforderungen des Gerichtsvollziehers und/oder des Sachverständigen zu folgen haben.

ANORDNUNG:
Es wird ohne vorherige Anhörung der Antragsgegnerin folgende Inspektions- und Beweissiche-rungsanordnung erlassen:
I. Der Antragstellerin wird gestattet, eine sich in einem funktionsfähigen Zustand befind-liche „DLyte PRO500 Automated Cell“ am Messestand der Antragsgegnerin auf der EMO Messe Hannover 2025, die vom 22. September 2025 bis 26. September 2025 auf dem Messegelände, Hermes Allee, 30521 Hannover, Deutschland, stattfindet, durch einen Sachverständigen und einen Gerichtsvollzieher zu inspizieren und dabei
1. die „DLyte PRO500 Automated Cell“ in Betrieb zu nehmen, wobei der Antrags-gegnerin aufgegeben wird, etwa erforderliche Passwörter einzugeben;
2. zum Zwecke und für die Dauer der Messungen des Bewegungsablaufs und der Rotationsgeschwindigkeit des Werkstückhalters der „DLyte PRO500 Automated Cell“, ein Smartphone am Werkstückhalter zu befestigen;
3. geeignete Einstellungen an der „DLyte PRO500 Automated Cell“ vorzunehmen, um Verfälschungen des Messergebnisses zu vermeiden, insbesondere die Deak-tivierung der Vibrationseinheit des Behälters;
4. ein Programm an der „DLyte PRO500 Automated Cell“ auszuwählen und einzu-schalten, das den Werkstückhalter zum Zwecke der Messung in Bewegung setzt;
5. sofern von der „DLyte PRO500 Automated Cell“ vorgesehen, ein Programm selbst zu konfigurieren und einzuschalten, das den Werkstückhalter zum Zwecke der Messung in Bewegung setzt;
6. die Messung während des Betriebs der „DLyte PRO500 Automated Cell“ durch-zuführen;
7. den Messvorgang so häufig zu wiederholen, bis eine hinreichende Messung der Rotationsgeschwindigkeit und des Bewegungsablaufs des Werkstückshalters der „DLyte PRO500 Automated Cell“ erfolgte.
II. Sollte eine Inspektion vor Ort gemäß Ziffer I. nicht möglich sein, wird der Antragstelle-rin gestattet, eine „DLyte PRO500 Automated Cell“ und alle technischen, werblichen und kommerziellen Unterlagen in jeweils einer Kopie in Bezug auf die „DLyte PRO500 Automated Cell“ während der EMO Messe Hannover 2025, die vom 22. September 2025 bis einschließlich 26. September 2025 auf dem Messegelände, Hermes Allee, 30521 Hannover, Deutschland, stattfindet, durch einen Gerichtsvollzieher physisch zu beschlagnahmen und sodann durch einen Sachverständigen wie in Ziffer I. beschrieben inspizieren zu lassen.
III. Der Sachverständige soll innerhalb einer Frist von 2 Wochen nach Abschluss der unter Ziffern I. und II. genannten Maßnahmen eine ausführliche Beschreibung der „DLyte PRO500 Automated Cell“ erstellen und der Kammer vorlegen, die eine detaillierte Be-schreibung der für eine Beurteilung einer Verletzung des Antragspatents relevanten Merkmale der „DLyte PRO500 Automated Cell“ enthält.
IV. Die gemäß Ziffer III. gefertigte Beschreibung und alle anderen Ergebnisse der Inspek-tion und Beweissicherung dürfen nur in einem Hauptsacheverfahren gegen die An-tragsgegnerin verwendet werden.
V. Als Person, welche die vorgenannten Maßnahmen ausführt, wird als Sachverständiger ernannt:
Patentanwalt Stephan Freischem, Salierring 47-53, 50677 Köln.
Dieser kann durch einen in derselben Kanzlei arbeitenden europäischen Patentanwalt ersetzt werden.
VI. Zur Unterstützung des Sachverständigen wird als Hilfsperson des Sachverständigen der Gerichtsvollzieher […] bestellt.
Für den Fall, dass dieser bei Durchführung der Inspektion und der Beweissicherungs-maßnahmen verhindert ist, kann er durch einen örtlich zuständigen, durch die Antrag-stellerin zu beauftragenden Gerichtsvollzieher ersetzt werden.
VII. Dem Sachverständigen sowie dem Gerichtsvollzieher wird im Interesse der Wahrung von Geschäftsgeheimnissen der Antragsgegnerin, die bei der Inspektion und Beweissi-cherung zutage treten könnten, aufgegeben, sowohl gegenüber der Antragstellerin persönlich als auch gegenüber Dritten Verschwiegenheit zu wahren.
VIII. Während der Vollziehung der vorliegenden Anordnung ist neben dem Sachverständi-gen und dem Gerichtsvollzieher die Anwesenheit folgender Vertreter der Antragstel-lerin gestattet:
1. Herr Rechtsanwalt Joscha Torweihe, EPG Vertreter und in dieser Sache benann-ter rechtlicher Vertreter der Antragstellerin von der Kanzlei Hoyng ROKH Mone-gier, Steinstraße 20, 40212 Düsseldorf, oder ein anderer Rechtsanwalt der Kanz-lei Hoyng ROKH Monegier, falls Herr Torweihe nicht verfügbar sein sollte;
2. Herr Patentanwalt Steffen Lenz, EPG Vertreter und in dieser Sache mitwirkender Patentanwalt der Patentanwaltskanzlei Lichti, Bergwaldstraße 1, 76227 Karls-ruhe, bei den nach Ziff. I beantragten Maßnahmen anwesend sein darf, oder ein anderer Patentanwalt der Patentanwaltskanzlei Lichti, falls Herr Lenz nicht ver-fügbar sein sollte.

Vertretungsorgane, Angestellte oder sonstige Mitarbeiter der Antragstellerin dürfen bei der Ausführung dieser Anordnung im Hinblick auf die Inspektion und Beweissiche-rung nicht anwesend sein.
IX. Der Antragsgegnerin wird aufgegeben, bei der Durchführung der Maßnahmen zur In-spektion und Beweissicherung gemäß dieser Anordnung mitzuwirken und dem Ge-richtsvollzieher und dem Sachverständigen auf deren Anforderung hin
1. diesen sowie den gemäß Ziffer VIII. anwesenheitsberechtigten Personen zu ge-statten, den Messestand der Antragsgegnerin auf der EMO Messe Hannover 2025, die vom 22. September 2025 bis einschließlich 26. September 2025 auf dem Messegelände, Hermes Allee, 30521 Hannover, Deutschland, stattfindet, zu betreten, um die Inspektion und Beweissicherung gemäß dieser Anordnung durchzuführen;
2. uneingeschränkten Zugang zur „DLyte PRO500 Automated Cell“ zu gewähren, einschließlich der Eingabe von Passwörtern;
3. Zugang zu einem Teil der „DLyte PRO500 Automated Cell“ zu gewähren;
4. die „DLyte PRO500 Automated Cell“ in Betrieb zu setzen und in verschiedene Betriebszustände zu bringen
und ihre Geschäftsführer und Mitarbeiter anzuweisen, den Aufforderungen des Ge-richtsvollziehers oder des Sachverständigen nachzukommen.
X. Die an der Durchführung der Inspektion und der Beweissicherung beteiligten Personen und insbesondere der Gerichtsvollzieher, der Sachverständige und die Parteivertreter der Antragstellerin sind verpflichtet, Tatsachen, die ihnen im Rahmen der Ausführung der gesamten Anordnung zur Kenntnis gelangen, sowohl gegenüber Dritten als auch gegenüber der Antragstellerin geheim zu halten.
Zudem dürfen die vorgenannten Personen bis zu einer Freigabeanordnung des Einheit-lichen Patentgerichts keine Gelegenheit bieten, der Antragstellerin oder Dritten Ein-blick in die „DLyte PRO500 Automated Cell“, die ggf. beschlagnahmten Unterlagen und Produkte sowie die durch den Sachverständigen zu fertigende ausführliche Beschrei-bung zu gewähren.
XI. Die Antragsgegnerin soll aufgefordert werden, sich nach Vorlage der gemäß Ziffer III. zu fertigenden ausführlichen Beschreibung durch den mit der Durchführung dieser An-ordnung beauftragten Sachverständigen zu ihren etwaigen Geheimhaltungsinteressen zu äußern. Die oben genannten Vertreter der Antragstellerin, die bei der Inspektion und Beweissicherung anwesend sein durften, sind zu hören. Erst danach entscheidet das Gericht, ob und inwieweit die ausführliche Beschreibung der Antragstellerin per-sönlich zur Kenntnis gebracht werden und ob die Schweigepflicht für die Vertreter der Antragstellerin aufgehoben wird.
XII. Die Antragstellerin ist verpflichtet, die Kosten der Inspektion und Beweissicherung ein-schließlich der Fertigung der ausführlichen Beschreibung zu tragen. Der Antragstellerin wird aufgegeben, vor Beginn der Inspektion dem Sachverständigen einen angemesse-nen, von diesem zu bestimmenden Kostenvorschuss zu zahlen, soweit dieser nicht auf einen solchen Kostenvorschuss verzichtet.
XIII. Bei schuldhafter Zuwiderhandlung gegen diese Anordnung kann das Gericht für jeden Verstoß jeder Partei ein Zwangsgeld festsetzen, dessen Höhe das Gericht unter Berück-sichtigung der Umstände des Einzelfalls bestimmen kann.
XIV. Die Maßnahmen zur Inspektion und zur Beweissicherung werden auf Antrag der An-tragsgegnerin aufgehoben oder treten anderweitig außer Kraft, wenn die Antragstel-lerin nicht innerhalb einer Frist von höchstens 31 Kalendertagen oder 20 Arbeitstagen, je nachdem, welcher Zeitraum länger ist, nachdem die nach Ziffer III. zu fertigende schriftliche Beschreibung der Antragstellerin offengelegt wurde oder das Gericht durch eine endgültige Entscheidung entschieden hat, keinen Zugang zu dieser Beschreibung zu gewähren, eine Klage gegen die Antragsgegnerin erhoben hat.
XV. Diese Anordnung soll persönlich von einem der unter Ziffer VIII. genannten Vertreter der Antragstellerin zusammen mit einer Kopie des Antrags auf Erlass dieser Anordnung einschließlich der Beweisstücke und sonstigen Unterlagen, auf die sich der Antrag vor oder bei der Vollziehung dieser Anordnung stützt, sowie der Mitteilung über vorläufige Maßnahmen und Anweisungen für den Zugang zum Verfahren unverzüglich im Zeit-punkt der Vollziehung der Maßnahmen zugestellt werden.
Die Zustellung dieser erfolgt durch den Gerichtsvollzieher im Zusammenwirken mit dem gemäß Ziffer VIII.1. an der Inspektion und Beweissicherung anwesenden rechts-anwaltlichen Vertreter der Antragstellerin.
XVI. Im Übrigen wird der Antrag auf Inspektion und Beweissicherung zurückgewiesen.

INFORMATIONEN ZUR ÜBERPRÜFUNG UND BERUFUNG:
Die Antragsgegnerin kann innerhalb von 30 Tagen nach der Vollziehung der Maßnahmen eine Überprüfung der vorliegenden Anordnung beantragen (Art. 60 (6) EPGÜ, R. 197.3 VerfO).
Die nachteilig betroffene Partei kann gegen diese Anordnung innerhalb von 15 Tagen nach ihrer Zustellung Berufung einlegen (Art. 73 (2) a) EPGÜ, R. 220.1 c) VerfO).

SUMMARY OF THE FACTS:
On 22 September 2025, the applicant filed an application for an order for inspection and preservation of evidence at the respondent's exhibition stand in advance of a main action.

The applicant is the sole owner of European patent 2 983 864 B1 (Annex HRM 3; hereinafter referred to as the patent in suit), which was granted on 26 March 2014, claiming the priority of two German patent applications (DE 102013006010 and DE 102013016053) dated 9 April 2013 and 27 September 2013, respectively, in German as the language of the proceedings. The grant of the patent applied for was published on 26 April 2017. The patent application is currently in force in Austria, Belgium, Switzerland, Liechtenstein, the Czech Republic, Germany, Spain, France, Great Britain, Ireland, Italy, Luxembourg, Poland and Turkey.
No opposition was filed against the grant of the patent application. In main proceedings brought by the applicant against the respondent before the Düsseldorf Local Division concerning another machine (UPC_CFI_511/2025; see below for more details), the respondent filed a counterclaim for annulment of the disputed patent in a written submission dated 16 September 2025.

The patent application is entitled ‘Method and apparatus for surface treatment of workpieces’. Its patent claim 1 is worded as follows:

"Method for surface treatment of workpieces by moving the workpiece relative to a bulk material consisting of abrasive and/or polishing granulate, wherein the workpiece is rotated (P4) about at least one axis relative to the bulk material consisting of abrasive and/or polishing granulate, wherein the workpiece is accelerated relative to the bulk material consisting of abrasive and/ or polishing granulate, characterised in that the workpiece and/or a container (11) holding the bulk material of the grinding and/or polishing granulate is/are rotated at continuously different rotational speeds with continuous acceleration."

The respondent is the parent company of the GPAINNOVA Group. The GPAINNOVA Group is active in various areas of technology, including surface finishing, marine robotics, high-performance electronics and medical technology.

The respondent offers electropolishing machines in various sizes for different areas of application. On its website https://www.dlyte.com/de/produkte/, the respondent offers machines from the PRO500 series under its ‘DLyte’ brand, namely the PRO 500, the PRO500 Carbide and the PRO500 Hybrid. According to the information on the website, these machines are designed for industrial use and can be used in a variety of industries such as the automotive industry, aerospace, toolmaking and medical technology. With regard to the presentation of the machines on the website, reference is made to Annexes HRM 6 and HRM 7.

The respondent is currently exhibiting at the EMO Hannover 2025 trade fair, which is taking place in Hannover from 22 September 2025 to 26 September 2025. It is exhibiting a ‘DLyte PRO500 Automated Cell’ there.

The ‘DLyte PRO500 Automated Cell’ belongs to the “PRO500” series and consists of at least one ‘DLyte PRO500’ and an automated cell, comprising a cell and a robot arm. While the ‘DLyte PRO500’ performs an electropolishing process, the automated cell ensures automatic loading and unloading of the machine. Reference is made to Annex HRM 20 for the contents of a product brochure on the ‘DLyte PRO500’. The respondent is responsible for the manufacture, marketing and distribution of the ‘DLyte PRO500 Automated Cell’.
The applicant had already filed an application with the Düsseldorf Local Division on 25 March 2025 against the respondent and another party for an inspection of electropolishing machines, namely those of the ‘DLyte Compact’ series. The Düsseldorf Local Division issued an inspection and viewing order on 26 March. The subsequent viewing took place on 26 March 2025 at the Interdentalschau (IDS) trade fair in Cologne. The patent attorney Stephan Freischem, who was appointed as an expert, prepared an expert opinion on 23 April 2025, the content of which is referred to in Annex HRM 26. On 12 June 2025, the applicant filed a main action with the Local Division in Düsseldorf (UPC_CFI_511/2025). It was not possible to inspect a ‘PRO500’ machine at the IDS in Cologne because it was not on display there.

The applicant argues that it is not possible for her to gain access to a ‘PRO500’ machine. On the one hand, the price for significantly smaller machines from the respondent is already between EUR 30,000 and EUR 100,000, so it can be assumed that the price for the significantly larger ‘PRO500’ machine is well over EUR 100,000. A test purchase, even if it were possible, would therefore be unreasonable. Secondly, it was not possible for the applicant to purchase such a machine due to the distribution channels for such highly specialised industrial machines, which were sold as a personalised business via ‘well-known’ distribution channels, an exclusive dealer network. In most countries, there is only one fixed reseller of the respondent's machines, and in larger countries there are two. The resellers have a very close relationship with the respective manufacturer of the machines, so that the applicant would not be supplied. An anonymous purchase of the machines in question is also not possible because, due to the enormous financial burden of such a purchase, the buyers of these machines want to ensure that the machines will bring the desired added value to their business. Normally, a trial run would take place on the manufacturer's premises or the customers would first receive a test machine. The test phase would allow the test buyer or its exclusive resellers to establish close contact. It would therefore be noticeable if this close contact were to be lacking in individual cases, for example if the applicant only wanted to purchase the machine for testing purposes. The sale would probably be stopped. The large machines designed for industrial purposes at issue here are not products that can be purchased anonymously. For example , more detailed information on the websites of dealers selling the ‘PRO500’ was only available upon request. This also highlights the personal nature of a purchase, which makes an anonymous test purchase impossible.

Requests BY THE APPLICANT:

I. To grant the applicant:

1. A DLyte PRO500 Automated Cell in working condition on site at the respondent's exhibition stand at the EMO trade fair in Hanover in 2025, which will take place in Hanover from 22 September 2025 to 26 September 2025 inclusive at the exhibition grounds, Hermes Allee, 30521 Hanover, Germany, by a bailiff, an expert and a solicitor and a patent attorney representing the applicant, in particular:

a. to put the DLyte PRO500 Automated Cell into operation, whereby the respondent is instructed to enter any necessary passwords,
b. for the purpose and duration of measuring the movement sequence and rotational speed of the DLyte PRO500 Automated Cell workpiece holder, to attach a smartphone to the workpiece holder,

c. to make suitable settings on the DLyte PRO500 Automated Cell in order to avoid falsification of the measurement results, in particular deactivating the vibration unit of the container,

d. select and activate a programme on the DLyte PRO500 Automated Cell that sets the workpiece holder in motion for the purpose of measurement,
e. if provided by the DLyte PRO500 Automated Cell, configure and activate a programme that sets the workpiece holder in motion for the purpose of measurement,
f. to carry out the measurement while the DLyte PRO500 Automated Cell is in operation,
g. to repeat the measurement process until a sufficient measurement of the rotational speed and movement sequence of the workpiece holder of the DLyte PRO500 Automated Cell has been obtained,
2. or to use a comparative measurement method.

3. Alternatively, in the event that claims I.1 and I.2 are impossible:

a. to physically seize, by a bailiff, one copy of each technical, advertising and commercial document relating to the DLyte PRO500 Automated Cell during the EMO Hannover 2025 trade fair, which will take place in Hannover from 22 September 2025 to 26 September 2025 inclusive at the exhibition grounds, Hermes Allee, 30521 Hanover, Germany, or to physically seize the DLyte PRO500 Automated Cell at any other location in Germany;

4. to prepare a detailed description of the DLyte PRO500 Automated Cell, including a detailed description of the features of the DLyte PRO500 Automated Cell and the relevant technical, promotional and commercial documentation relating to the DLyte PRO500 Automated Cell at all locations specified in Section I.1;

II. to appoint patent attorney Stephan Freischem, Salierring 47-53, 50677 Cologne, as an expert and to determine that he may be replaced by a European patent attorney working in the same law firm as Stephan Freischem;

III. to allow the bailiff Mr [...] to be assisted by the expert in carrying out the measures to secure evidence in accordance with the order to be issued in this matter, and to determine that he may be replaced by any other competent expert in the event of his unavailability;
IV. that Mr Joscha Torweihe, UPC representative and legal representative of the applicant in this matter from the law firm Hoyng ROKH Monegier, Steinstraße 20, 40212 Düsseldorf, may be present during the measures requested under point I, or another solicitor from the law firm Hoyng ROKH Monegier if Mr Torweihe is unavailable;

V. that Mr Steffen Lenz, patent attorney, UPC representative and patent attorney involved in this matter at the patent law firm Lichti, Bergwaldstraße 1, 76227 Karlsruhe, may be present during the measures requested under point I, or another patent attorney from the patent law firm Lichti if Mr Lenz is unavailable;

VI. to order that the employees and managing directors of the respondent may not be present during the enforcement of the order to be issued in this matter and that the bailiff is not entitled to make an exception to this in accordance with the applicable national law;

VII. order that the persons involved in the implementation of the measures to preserve evidence in accordance with the order to be issued, such as the bailiff, the expert and/or the party representative, are not permitted to disclose any information about these measures to the respondent or third parties and are not permitted to provide any opportunity to inspect or examine the DLyte PRO500 Automated Cell or the detailed report, unless the respondent agrees or on the basis of a further order by the UPC;

VIII. to oblige the respondent to cooperate in the implementation of the measure for inspection and preservation of evidence in accordance with the order to be issued in this matter and, at the request of the bailiff and the expert,

- grant unrestricted access to the DLyte PRO500 Automated Cell, including the entry of passwords,
- grant access to part of the DLyte PRO500 Automated Cell, and/or
- put the DLyte PRO500 Automated Cell into operation and into various operating states;

IX. to oblige the respondent to instruct its managing directors and employees to comply with the requests of the bailiff and/or the expert in accordance with clause VII.;

X. to impose a penalty payment of EUR 2,500 for each 15-minute period that elapses between the bailiff's or expert's request to grant access for inspection in accordance with Section I and the actual granting of the requested access;

XI. order that the bailiff must present a copy of the order to be issued in this matter, together with a copy of the application, to at least one representative of the respondent who is present at the location where the respective measures are being carried out;

XII. order that the order to be issued in this manner be immediately enforceable;
XIII. order that service be effected by the bailiff in cooperation with Mr Joscha Torweihe, as set out in point IV, or by another solicitor from the law firm Hoyng ROKH Monegier if Mr Torweihe is unavailable;

XIV. to suspend all decisions on costs for the time being.

REASONS FOR THE ORDER:
The application for an order for inspection and preservation of evidence (R. 192, 199 RoP) is successful to the extent stated.

I. The Düsseldorf Local Division has jurisdiction pursuant to Art. 32 (1) c), 33 (1) b) and 60 UPCA. The application has been filed in an admissible manner pursuant to R. 192 RoP. In particular, the applicant has stated that it intends to bring an action against the respondent before the Düsseldorf Local Division.
II. Furthermore, the applicant has credibly demonstrated that the patent in suit may be infringed by the respondent (Art. 60 (1) UPCA).


In view of the circumstances of the case as described, it is possible that the product ‘DLyte PRO500 Automated Cell’, as exhibited at the EMO Hannover trade fair, makes use of the technical teaching of the patent in suit.

The applicant, who is entitled to bring the action as the owner of the patent in suit, has provided evidence in the form of a product brochure for the ‘DLyte PRO500’ (Exhibit HRM 20), a product video available on YouTube (Exhibit HRM 22) and screenshots thereof, a technical drawing available on the respondent's website together with a product description (Exhibit HRM 24) and a comparison of the functionality of the ‘DLyte PRO500’ with that of the ‘DLyte 1D’ and ‘DLyte 100D’ machines, which have already been examined by experts (see expert opinion of 23 April 2025, Annex HRM 26), which is why it assumes that all the features of the patent application are realised in the ‘DLyte PRO500 Automated Cell’ product.

The applicant was not required to provide further details on the legal validity of the patent in suit, which has since been challenged by a counterclaim for annulment. Since there is no clear indication to cast doubt on the legal validity of the patent in suit, for example as a result of a negative decision on legal validity, an examination of legal validity was not necessary for the issuance of the present order (see UPC_CoA_327/2025, order of 15 July 2025, para. 43 – Maguin v. Tiru).
III. The applicant has also demonstrated that the application is urgent (R. 194.2 a) RoP). In addition, it has demonstrated grounds for issuing an ex parte order (R. 194. 2 b), c), 197 RoP).

1. The inspection or preservation of evidence is urgent.

The applicant has plausibly demonstrated that the product ‘DLyte PRO500 Automated Cell’ exhibited at the EMO trade fair in Hanover in 2025 may make use of the technical teaching of claim 1 of the patent in suit. However, sufficient substantiation can only be provided by examining the product exhibited at the aforementioned trade fair , in which measurements are taken of the machine's movement sequences and, in particular, its rotational speed and acceleration behaviour. According to the applicant's submission, machines such as the ‘DLyte PRO500 Automated Cell’ are not readily available, and companies that have purchased and use such machines are generally not willing to grant ‘outsiders’ (patent holders) access to their premises or machines. The EMO Hannover 2025 trade fair therefore offers the applicant the opportunity to gather evidence of the alleged infringement of the patent in question.

2. The order was to be issued ex parte pursuant to R. 192.3, 197 RoP. Otherwise, there would be a demonstrable risk that evidence would be destroyed or no longer available for other reasons (R. 197.1 Alt. 2 RoP).

As the applicant has plausibly explained, there is a serious risk that the ‘DLyte PRO500 Automated Cell’ will be removed from the exhibition grounds at short notice or that individual polishing processes pre-programmed by the respondent will be deactivated by means of a software update. This could result in the loss of evidence that could be used to confirm the infringement. Due to the specific market conditions already described in detail, it would be virtually impossible for the applicant to obtain evidence of what it considers to be an infringement of the patent in suit by the aforementioned products.
IV. In the context of the discretionary decision, the interests of the applicant prevail.

Based on the information available to it so far, the applicant has explained in a comprehensible manner why it assumes that all the features of patent claim 1 of the patent in suit are realised in the product exhibited at the EMO trade fair in Hanover in 2025. It has also explained in a comprehensible manner why, due to the given special circumstances in the relevant market, it has no other options for gathering evidence of what it considers to be an infringement of the patent in suit by the product ‘DLyte PRO500 Automated Cell’. circumstances in the relevant market, she has no other options for gathering evidence of what she considers to be an infringement of the patent application by the product ‘DLyte PRO500 Automated Cell’, which is why she is dependent on an examination of the product exhibited at the EMO Hannover 2025 trade fair in order to preserve evidence.

Against this background, the present order is necessary in order to satisfy the applicant's overriding interests in this respect. The measures ordered do not place an unreasonable burden on the respondent. The confidentiality orders included in the order take sufficient account of the respondent's interests in confidentiality.
V. The applicant has paid the court fee for the application for inspection/preservation of evidence, R. 192.5 RoP.

VI. The order provides, in accordance with R. 196.4, .5 RoP, that an expert shall be appointed to carry out the measures. Even taking into account the objections raised by the respondent in the application, in the main proceedings already pending before the Düsseldorf Local Division and concerning other products (UPC_CFI_511/2025) concerning the respondent's objections set out in the application. The expert is already familiar with the basic technology and process due to the inspection of other machines belonging to the respondent at the IDS Cologne trade fair in March of this year. His impartiality is not called into question either by his participation in a joint event organised by the American Intellectual Property Law Association (AIPLA) and the GRUR practice group at the offices of the applicant's legal representatives, or by the contact with a legal representative of the applicant described in the expert opinion in Annex HRM 26 (there Annex SV1, page 5).
To assist the expert in securing evidence, the Chamber made use of the possibility granted by R. 196.5 S. 2 RoP ordered the assistance of a bailiff. The bailiff's involvement was particularly necessary for the alternative request for seizure in rem, which, under national law, falls within the jurisdiction of bailiffs (UPC_CFI_539/2024 (LK Düsseldorf), order of 18 October 2024 – Bekaert Binjiang Steel v. Siltronic)

A named lawyer and patent attorney of the applicant was to be allowed to participate in the inspection. However, the applicant's further request that a lawyer and patent attorney representative be allowed to conduct the inspection itself was not granted, as it was not substantiated in detail.

According to Rule 196.5 of the RoP, members or representatives of the applicant itself were to be excluded from the inspection and preservation of evidence. In view of proportionality and the protection of confidential information, the number of legal representatives present during the inspection was also to be limited (Art. 60 (1) UPCA, R. 196.1 RoP). The confidentiality measures ordered with regard to the legal representatives, the expert and the bailiff also take into account the respondent's interests in confidentiality, as does the procedure described above after receipt of the detailed description.

Furthermore, it was to be ordered that the detailed description to be prepared by the expert may only be used in main proceedings against the respondent (R. 196.2 RoP).

The costs of the inspection and preservation of evidence to be carried out by the expert, including the detailed description to be prepared by the expert, are to be paid by the applicant until further notice, insofar as the expert does not waive the payment of an advance for his costs, the applicant shall pay the expert an appropriate advance, to be determined by the expert, before the inspection begins.

This order, together with the documents referred to in section XV, shall be served by the bailiff in cooperation with the applicant's legal representative present at the inspection and preservation of evidence in accordance with section VIII.1, pursuant to R. 197.2 RoP.

VII.
The general threat of coercive measures included in the order gives the Chamber the necessary flexibility to respond to any violations of this order, taking into account the interests of both parties and the severity of the violation.
In this specific case, it was possible to refrain from ordering the provision of security. The special circumstances required for an ex parte order (R. 196.6 RoP) are present. Unlike in the case of a cease-and-desist order, the respondent faces only minor damage at most as a result of the inspection and preservation of evidence. It is still entitled to offer and distribute the products under investigation (UPC_CFI_260/2025 (LD Düsseldorf), order of 26 March 2025, p. 9 f. – OTEC Präzisionsfinish v. STEROS; distinction from: UPC_CFI_177/2023 (LK Düsseldorf), order of 22 June 2023 – myStromer v. Revolt). On this basis, and taking into account the short duration of the trade fair, ordering the provision of security would unreasonably delay the preservation of evidence and inspection, which justifies refraining from ordering the provision of security in the present case.

VIII.
Insofar as the applicant has, in the alternative, requested permission to seize the product to be examined ‘at any other location in Germany’, this could not be granted on grounds of either specificity or proportionality. The description of the permissible measures in the order also takes into account the requirement of specificity.

There are no apparent reasons for excluding representatives and employees of the respondent from participating in the inspection. Such an exclusion sought by the applicant is already precluded by the fact that the employees and managing directors of the respondent, in accordance with the applicant's request, must comply with the requests of the bailiff and/or the expert.


ORDER:
The following inspection and evidence preservation order is issued without prior hearing of the respondent:

I. The applicant is permitted to inspect a functional ‘DLyte PRO500 Automated Cell’ at the respondent's stand at the EMO trade fair in Hanover in 2025, which will take place from 22 September 2025 to 26 September 2025 at the exhibition grounds, Hermes Allee, 30521 Hanover, Germany, by an expert and a bailiff, and in doing so
1. to put the ‘DLyte PRO500 Automated Cell’ into operation, whereby the respondent is instructed to enter any necessary passwords;

2. attaching a smartphone to the workpiece holder for the purpose and duration of measuring the movement sequence and rotational speed of the workpiece holder of the ‘DLyte PRO500 Automated Cell’;
3. to make appropriate settings on the ‘DLyte PRO500 Automated Cell’ in order to avoid falsification of the measurement results, in particular deactivating the vibration unit of the container;
4. to select and activate a programme on the ‘DLyte PRO500 Automated Cell’ that sets the workpiece holder in motion for the purpose of measurement;

5. if provided by the ‘DLyte PRO500 Automated Cell’, configure and activate a programme yourself that sets the workpiece holder in motion for the purpose of measurement;
6. carry out the measurement while the ‘DLyte PRO500 Automated Cell’ is in operation;
7. Repeat the measurement process until a sufficient measurement of the rotational speed and movement sequence of the workpiece holder of the ‘DLyte PRO500 Automated Cell’ has been obtained.
II. If an on-site inspection in accordance with Section I is not possible, the applicant shall be permitted to use a ‘DLyte PRO500 Automated Cell’ and all technical, advertising and commercial documents relating to the ‘DLyte PRO500 Automated Cell’ during the EMO trade fair in Hanover in 2025, which will take place from 22 September 2025 to 26 September 2025 inclusive at the exhibition grounds, Hermes Allee, 30521 Hanover, Germany, and then have it inspected by an expert as described in section I.

III. Within two weeks of completing the measures specified in sections I and II, the expert shall prepare a detailed description of the ‘DLyte PRO500 Automated Cell’ and submit it to the Chamber, which shall contain a detailed description of the features of the ‘DLyte PRO500 Automated Cell’ relevant for assessing an infringement of the patent in suit.

IV. The description prepared in accordance with section III and all other results of the inspection and preservation of evidence may only be used in main proceedings against the respondent.
V. The following person is appointed as the expert to carry out the aforementioned measures:
Patent attorney Stephan Freischem, Salierring 47-53, 50677 Cologne.

He may be replaced by a European patent attorney working in the same law firm.
VI. The bailiff [...] is appointed as an assistant to the expert to support him.

In the event that the bailiff is unable to carry out the inspection and evidence preservation measures, he may be replaced by a locally competent bailiff to be appointed by the applicant.
VII.
In the interests of protecting the respondent's business secrets, which may come to light during the inspection and preservation of evidence, the expert and the bailiff are instructed to maintain confidentiality both towards the applicant personally and towards third parties.

VIII. During the execution of this order, the following representatives of the applicant are permitted to be present in addition to the expert and the bailiff:
1. Mr Joscha Torweihe, UPC representative and legal representative of the applicant in this matter from the law firm Hoyng ROKH Monegier, Steinstraße 20, 40212 Düsseldorf, or another solicitor from the law firm Hoyng ROKH Monegier if Mr Torweihe is unavailable;

2. Patent attorney Steffen Lenz, UPC representative and patent attorney involved in this matter from the patent law firm Lichti, Bergwaldstraße 1, 76227 Karlsruhe, may be present during the measures requested in section I, or another patent attorney from the patent law firm Lichti if Mr Lenz is unavailable.

Representatives, employees or other staff of the applicant may not be present during the execution of this order with regard to the inspection and preservation of evidence.

IX. The respondent is ordered to cooperate in the implementation of the measures for inspection and preservation of evidence in accordance with this order and, at the request of the bailiff and the expert, to allow
1. to allow them and the persons authorised to be present in accordance with Section VIII to enter the respondent's exhibition stand at the EMO Hannover 2025 trade fair, which will take place from 22 September 2025 to 26 September 2025 inclusive at the exhibition grounds, Hermes Allee, 30521 Hannover, Germany, in order to carry out the inspection and preservation of evidence in accordance with this order;
2. to grant unrestricted access to the ‘DLyte PRO500 Automated Cell’, including the entry of passwords;

3. to grant access to part of the ‘DLyte PRO500 Automated Cell’;
4. to put the ‘DLyte PRO500 Automated Cell’ into operation and to bring it into various operating states
and to instruct its managing directors and employees to comply with the requests of the bailiff or the expert.

X. The persons involved in carrying out the inspection and securing evidence, in particular the bailiff, the expert and the applicant's representatives, are obliged to keep confidential any facts that come to their knowledge in the course of executing the entire order, both vis-à-vis third parties and vis-à-vis the applicant.

In addition, the aforementioned persons may not, until a release order has been issued by the Unified Patent Court, provide the applicant or third parties with access to the ‘DLyte PRO500 Automated Cell’, any seized documents and products, or the detailed description to be prepared by the expert.

XI. The respondent shall be requested to comment on any confidentiality interests it may have after the detailed description to be prepared in accordance with Section III has been submitted by the expert appointed to carry out this order. The above-mentioned representatives of the applicant who were allowed to be present during the inspection and preservation of evidence shall be heard. Only then shall the court decide whether and to what extent the detailed description shall be brought to the attention of the applicant in person and whether the duty of confidentiality shall be lifted for the applicant's representatives.
XII. The applicant shall be obliged to bear the costs of the inspection and preservation of evidence, including the preparation of the detailed description. The applicant is ordered to pay the expert an appropriate advance on costs, to be determined by the expert, before the inspection begins, unless the expert waives such an advance on costs.
XIII. In the event of a culpable violation of this order, the court may impose a penalty payment for each violation by each party, the amount of which may be determined by the court taking into account the circumstances of the individual case.

XIV. The measures for inspection and preservation of evidence shall be lifted at the request of the respondent or shall otherwise cease to have effect if the applicant fails, within a period of no more than 31 calendar days or 20 working days, whichever is longer, after the written description of the applicant to be prepared in accordance with Section III has been disclosed or the court has made a final decision, to grant access to this description.

XV. This order shall be served personally by one of the applicant's representatives named in Section VIII, together with a copy of the application for this order, including the evidence and other documents on which the application is based prior to or upon execution of this order, as well as the notice of provisional measures and instructions for access to the proceedings, immediately upon execution of the measures.

This shall be served by the bailiff in cooperation with the applicant's legal representative present at the inspection and preservation of evidence in accordance with Section VIII.1.
XVI. In all other respects, the application for inspection and preservation of evidence is rejected.

INFORMATION ON REVIEW AND APPEAL:
The respondent may request a review of this order within 30 days of the measures being carried out (Art. 60 (6) UPCA, R. 197.3 RoP).

The party adversely affected may appeal against this order within 15 days of its service (Art. 73(2)(a) UPCA, R. 220.1(c) RoP).
