GEGENSTAND: R. 9.2 VerfO, R. 336 VerfO, R. 9.3 VerfO

ANORDNUNG:

KURZE DARSTELLUNG DES SACHVERHALTS:
Widerbeklagten vom 25. August 2025 bleiben gemäß R. 9.2 VerfO unberücksichtigt:
- Abschnitt B zur Aufgabenstellung und zur Auslegung des Streitpatents in seiner erteilten Fassung, Randnummern 5 bis 27;

PATENT IN SUIT:
European Patent No. EP 2 624 031 B1

DECISION-MAKING BODY/CHAMBER:
Decision-making body of the Local Division Düsseldorf

JUDGES INVOLVED:
This order was issued by Presiding Judge Thomas, legally qualified Judge Dr Schumacher as rapporteur, legally qualified Judge Agergaard and technically qualified Judge Dr Hansson.

LANGUAGE OF THE PROCEEDINGS: German

SUBJECT: R. 9.2 RoP, R. 336 RoP, R. 9.3 RoP

ORDER:

BRIEF DESCRIPTION OF THE FACTS:
1. Infringement proceedings are pending between the parties before the Local Division in Düsseldorf, in which the defendant has filed a counterclaim for revocation and the plaintiff has filed an alternative request for amendment of the patent.

2. Within the time limit for submitting the rejoinder in the proceedings for revocation and for submitting the reply in the proceedings for amendment of the patent, the plaintiff uploaded a written statement in both workflows on 25 August 2025 with the following heading:

‘Reply to the response to the counterclaim for revocation (R. 29 lit. (e) RoP) Reply to the response to the (alternative) request for amendment of the patent (R. 29 lit. (e), 32.3 RoP)’
3. In a written submission dated 1 September 2025, the defendant requested:
1. The following sections in the written submission of the plaintiff or counter-defendant dated 25 August 2025 shall be disregarded in accordance with R. 9.2 RoP:

- Section B on the task at hand and the interpretation of the patent in suit in its granted form, paragraphs 5 to 27;
- Section C on the (lack of) legal validity in the granted form, paragraphs 28 to 109; and
- Section F on the waiver of claims, paragraphs 196 to 200.

2. In the alternative, if and to the extent that the court does not rule in accordance with point 1 above:
a) The defendant and counterclaimant is permitted, in accordance with Rule 336 of the RoP, to respond to the sections referred to in point 1 above in the rejoinder in accordance with Rule 32.3 of the RoP.

b) The period for the rejoinder of one month pursuant to Rule 32.3 of the RoP is extended by two weeks pursuant to Rule 336 of the RoP.

4. In support of its case, the defendant argued that, pursuant to Rule 32.3 of the RoP, the plaintiff was only entitled to comment on the application for amendment of the patent, but no longer on the patent in suit as granted. The submission on the contested patent in its granted form and on the (lack of) legal validity of the contested patent in its granted form was late and unreasonably impeded the defendant in its conduct of the proceedings. The submission on the waiver of claims does not specifically concern the request for amendment of the patent. In the alternative, the defendant should be allowed to respond to the relevant sections in its rejoinder pursuant to Rule 32.3 RoP and be granted an extension of two weeks for this purpose.

In its statement of 8 September 2025, the plaintiff emphasised that, together with the reply in the proceedings for amendment of the patent (R. 32.3 RoP), it was entitled to submit a rejoinder in the proceedings for revocation (R. 29 lit. (e) RoP). Such a rejoinder necessarily dealt with the patent in suit in its granted form if, as in this case, that form was being defended. The statements in the rejoinder were a direct response to the statements in the defendant's reply, as evidenced by the numerous explicit references.

6. In a written submission dated 8 September 2025, the plaintiff requested that its statements in paragraphs 196–200 of the written submission dated 25 August 2025 be admitted in the infringement proceedings in accordance with Rule 36 of the RoP. The statements in question concerned the defendant's alleged waiver of claims and thus the infringement proceedings. They were a direct response to the new statements on the interpretation of the agreement according to Annex PS 2 in the defendant's written submission of 23 July 2025. Since the waiver had been asserted by the defendant for the first time in its statement of defence, the plaintiff must be able to respond once again to the defendant's statements in accordance with the principles underlying the Rules of Procedure.

REASONS FOR THE ORDER:
Defendant's application for dismissal of submissions pursuant to R. 9.2 RoP
7. According to R. 9.2 RoP, the court may disregard procedural steps, facts, evidence or arguments that have not been submitted or provided by a party within the time limit set by the court or provided for in these Rules of Procedure. Rule 36 of the RoP also states that any pleading that goes beyond the pleadings provided for in the RoP requires the approval of the court. It follows that the court, in exercising its discretion, may disregard not only unsolicited pleadings submitted in addition to those provided for in the Rules of Procedure. Furthermore, it may also disregard the content of the pleadings referred to in the Rules of Procedure if this content exceeds the content permitted under the Rules of Procedure (see UPC_CFI_521/2025 (LK Mannheim), order of 27 August 2025, p. 3 – Decathlon v. OWIM).

8. The plaintiff's written submission of 25 August 2025 is the rejoinder to the reply to the counterclaim provided for in Rule 29(e) of the RoP and, at the same time, the reply to the response to the request to amend the patent in accordance with Rule 32 of the RoP. This is readily apparent both from the heading of the written submission itself and from its content. The written submission was also uploaded in both workflows, where it was designated as ‘Reply – proceedings for amendment of the patent’ in the CMS workflow for the amendment request and as ‘Duplicate – counterclaim for revocation’ in the workflow for the counterclaim for revocation.

9. Insofar as the written submission (also) constitutes the rejoinder in the nullity proceedings, Rule 29(e) sentence 2 of the RoP must be taken into account, according to which it must be limited to the arguments contained in the reply. In addition, it must always be taken into account that the parties are required to present their arguments in full as early as possible in the proceedings (cf. Preamble to the RoP, No. 7).

10. The court exercises its discretion to take into account the plaintiff's submissions in sections B (task and interpretation of the patent in suit as granted) and C (legal status of the patent in suit as granted). The statements on the task and interpretation of the patent in suit are relevant not only to the infringement action but also to the counterclaim for revocation. The statements on the legal status of the patent in suit even relate exclusively to the counterclaim for revocation. Furthermore, as is clear from several explicit references, the plaintiff's submissions are a response to the defendant's submissions in the reply to the counterclaim for revocation within the meaning of Rule 29(e) sentence 2 of the RoP. Against this background, no violation of the principle that the parties are required to present their arguments in full as early as possible in the proceedings can be found. The defendant's differing argument is clearly influenced by its assumption that, pursuant to Rule 32.3 of the RoP, the plaintiff was only entitled to comment on the request for amendment of the patent.

11. However, as far as the plaintiff's submission in section F (waiver of claims) is concerned, this must be disregarded in accordance with Rule 9.2 of the RoP. This submission is not related to the counterclaim for revocation or to the request for amendment of the patent, but concerns solely the infringement proceedings. In the latter, the pleadings provided for in the Rules of Procedure had already been exchanged, which is why the submission would have required prior authorisation (see below).
Request by the applicant for authorisation to make submissions pursuant to Rule 36 of the RoP

12. The applicant's submission concerning the waiver of claims is also not admissible under Rule 36 of the RoP.

13. According to Rule 36 of the RoP, the rapporteur may, upon a reasoned request by a party submitted before the date on which the rapporteur intends to close the written procedure, allow the exchange of further written pleadings within a period to be determined. In exercising the discretion granted under this provision, particular consideration must be given to whether the admission of a further pleading appears necessary for reasons of fairness, equity and efficiency, as well as the right to a fair hearing (see CoA_520/2024, order of 1 November 2024 – Scandit v. Hand Held).
14. The plaintiff did not initially file a motion for admission, but instead integrated the submission directly into the rejoinder to the counterclaim for revocation and the reply to the amendment. It was only after the defendant's submissions in connection with its requests to dismiss arguments pursuant to Rule 9.2 of the RoP that the plaintiff submitted the corresponding motion. Even though a request for the admission of further pleadings pursuant to Rule 36 of the RoP may be filed until the conclusion of the written proceedings, the court may take into account the timing of such a request in the written proceedings (Düsseldorf), Order of 4 March 2025, p. 3 – Hartmann Packaging v. Omni-Pac).
15. Apart from that, the plaintiff's application does not indicate that the admission of a further written submission by the plaintiff to waive claims is required for reasons of fairness, equity and efficiency, as well as the right to a fair hearing. It is true that, in view of the defendant's objection raised for the first time in its statement of defence to the infringement action, the plaintiff only had one opportunity to comment on this in writing, namely in its reply. However, this circumstance does not automatically require the admission of a further written statement. The plaintiff does not explain which specific arguments of the defendant, in its view, necessitated a further written statement. Nor does its application indicate that the response to the defendant's arguments in the rejoinder in the infringement proceedings could not also be made in the oral hearing. Finally, the waiver of claims discussed by the parties is not a particularly complex issue, so that a written statement may be necessary for this reason (unlike the FRAND objection: UPC_CFI_135/2024 (LK Düsseldorf), order of 14 August 2025 – Dolby v. Beko).

16. Since the plaintiff's application is to be dismissed, a prior hearing of the defendant was not necessary.
In the alternative: Defendant's application for leave to submit further arguments

17. There is no reason to allow the defendant to respond in its rejoinder to the amendment to the plaintiff's submissions in sections B and C of the written statement of 25 August 2025. As explained above, these were made within the time limits provided for in the Rules of Procedure and relate to the action for annulment. The required written submissions have now been exchanged.
In the alternative: Defendant's request for an extension of time

18. Since there is therefore no reason for the defendant to make any further comments on the plaintiff's objections, there is also no need to extend the deadline for the defendant's pending rejoinder to the amendment request.

ORDER:
1. The plaintiff's submission concerning the waiver of claims in its written statement of 25 August 2025 (section F, paras. 196–200) remains disregarded pursuant to R. 9.2 RoP.

2. In all other respects, the defendant's requests in its written submission of 1 September 2025 (App_35917/2025 and App_35920/2025) are rejected.

3. The plaintiff's application of 8 September 2025 for the admission of a written statement pursuant to R. 36 RoP (App_36336/2025) is rejected.
