GEGENSTAND
Verletzungsklage – Antrag gemäß Regel 303 Abs. 2 VerfO
SACHVERHALT
1.
September 2025 in Betracht.
ANORDNUNG

SUBJECT
Infringement action – Request pursuant to Rule 303(2) of the RoP
FACTS
1 The plaintiff asserts claims against the defendant arising from the patent in suit on the grounds of patent infringement. The defendant has filed a counterclaim against the plaintiff for the revocation of the patent in suit. Due to irregularities in the CMS, there are discrepancies between the dates on which the statement of defence and the counterclaim for revocation were actually uploaded to the CMS, the filing date of these pleadings as indicated in the CMS, the date of completion of the formal checks and the date on which the pleadings were sent by email to the plaintiff's representative. The deadline for the reply to the statement of defence in the infringement proceedings and the deadline for the response to the counterclaim for revocation, including the deadline for a request to amend the patent, will end on 3 September 2025 at the earliest. A date for an interim hearing has been set for 26 January 2026 and for the oral hearing on 26 February 2026.
2 The plaintiff requests that
the deadline for the infringement reply, the response to the counterclaim for revocation, and any request for amendment of the patent be extended by 6 calendar days and set uniformly until 9 September 2025 inclusive.
3 In support of its application, the plaintiff has cited, in addition to a large number of ongoing deadlines in other proceedings, mutual holiday-related absences of the persons involved, which did not allow the pleadings to be prepared in time.
4 The defendant has agreed to the extension of the deadline.
REASONS FOR THE ORDER
5 The application is partially successful.
1.
6 The standing judge's jurisdiction is based on Rules 1.2 (c) and 345.5 of the RoP in conjunction with the internal chamber representation plan ‘Decision on a standing judge scheme for urgent actions’. The matter is also urgent because the application for an extension of the deadline cannot be postponed. Even if a deadline can be extended retrospectively, the party needs certainty by the end of the deadline as to whether an extension can be expected, because it has to make arrangements in this regard. The return of the presiding judge of the chamber one day before the expiry of the deadline for submitting written pleadings is too short notice in this respect.
2.
7 In the present case, an extension of the deadline in accordance with Rule 9.3 of the RoP can only be granted until 5 September 2025. The plaintiff has explained its inability to meet the deadline. The defendant has agreed to the extension of the deadline out of court. However, an extension until 9 September 2025 is not possible because the subsequent deadlines for submitting written pleadings fall on a weekend and would therefore be automatically extended to the following working day, Rule 301.1 RoP. This would extend the deadline for the rejoinder in the infringement proceedings and the reply in the counterclaim proceedings to 10 November 2025 and, in the event of an application to amend the patent, the amendment request to 12 January 2026. In order to avoid a conflict with the preparation of the interim hearing, only an earlier extension of the deadline can therefore be considered. Since the same problem arises with an extension until 6, 7 or 8 September 2025, only 5 September 2025 can be considered.
ORDER
The deadline for the applicant to submit its reply to the infringement claim, its response to the counterclaim for revocation and any request for amendment of the patent is extended until 5 September 2025.
