Verletzungsklage – Antrag der Beklagten zu 2) auf Prozesskostensicherheit nach Regel 158.1 VerfO
SACHVERHALT
1 Die Klägerin nimmt die Beklagten wegen einer von ihrer behaupteten Verletzung des Streitpatents in Anspruch. Die Zustellung der Klage an die Beklagte zu 1) war bislang nicht erfolgreich. Die Beklagte zu 2), die u.a. eine Verletzung des Streitpatents in Abrede stellt, hat eine Widerklage auf Nichtigerklärung erhoben (CC_33345/2025 UPC_CFI_668/2025).
2 Die Beklagte zu 2) begehrt, der Klägerin die Leistung einer Prozesskostensicherheit aufzugeben.
3 Im Rahmen ihrer Stellungnahme(n) zu dem Antrag der Beklagten zu 2) hat die Klägerin mit Schreiben vom 15.08.2025 rechtsverbindlich zugesichert, dass eine Kostenentscheidung des EPG in dem Verfahren mit der Verfahrensnummer ACT_13761/2025, UPC_CFI_248/2025, an die deutsche Tochtergesellschaft der Klägerin, die Huawei Technologies Deutschland GmbH, Hansaallee 205, 40549 Düsseldorf, zugestellt werden kann. Klarstellend hat sie darauf hingewiesen, dass diese Zusicherung ausschließlich für das vorliegende Verfahren und die Zustellung einer etwaigen Kostenentscheidung in diesem Verfahren gelte. Sie habe darüber hinaus keine bindende Wirkung für die Klägerin.
ANTRÄGE
Die Beklagte zu 2) beantragt,
I. der Klägerin aufzugeben, innerhalb einer festgelegten Frist eine angemessene Sicherheit für die Kosten des Rechtsstreits und die sonstigen der Beklagten zu 2) entstehenden Kosten zu leisten (Art. 69 Abs. 4 EPGÜ, R. 158.1 VerfO),
II. den Erlass einer Versäumnisentscheidung für den Fall, dass die Klägerin innerhalb der festgelegten Frist keine angemessene Sicherheit für die Kosten des Rechtsstreits und die sonstigen Kosten leistet (R. 158.5, 355.1 (a) VerfO).
5 Die Klägerin beantragt,
I. den Antrag der Beklagten zu 2) auf Leistung einer Sicherheit für die Kosten des Rechtsstreits zurückzuweisen,
hilfsweise,
II. der Klägerin aufzugeben, innerhalb einer Frist, die mindestens sechs Wochen beträgt, eine angemessene Sicherheit für die Kosten des Rechtsstreits und die sonstigen Kosten der Beklagten zu 2) zu leisten.
ZUSAMMENFASSUNG DES (STREITIGEN) PARTEIVORTRAGS
6 Die Beklagte zu 2) ist der Ansicht, die Pflicht der Klägerin zur Leistung einer Sicherheit
erwachse aus Art. 69 Abs. 4 EPGÜ i. V. m. Regel 158.1 VerfO.
7 Die Klägerin sei ein Unternehmen aus und mit Sitz in der Volksrepublik China. Im Wege der Anordnung der Sicherheitsleistung müsse dem Umstand Rechnung getragen werden, dass eine Kostenentscheidung des EPG in der Volksrepublik China nicht mit hinreichender Sicherheit erfolgreich durchgesetzt werden könne, und wenn überhaupt, nur auf für die Beklagte zu 2) unangemessen belastende Weise. Sowohl nationale Gerichte in Europa als auch das EPG würden bei der Zustellung von Klageschriften oder anderen Dokumenten in die Volksrepublik China vor erhebliche Schwierigkeiten gestellt, obwohl die Volksrepublik China das Haager Zustellungsübereinkommen ratifiziert habe. Bei einem Land wie der Volksrepublik China, welches seine Verpflichtungen aus dem Haager Zustellungsübereinkommen nicht erfülle, müsse daher davon ausgegangen werden, dass ein Kostenfestsetzungsbeschluss des EPG in diesem Land nicht oder nur mit unverhältnismäßig hohem Aufwand vollstreckbar sei. Ebenso sei der Umstand zu berücksichtigen, dass die Klägerin ihren Sitz in einem NichtEU-/EWR-Staat habe und keine gleichwertige Garantie für eine im Einzelfall effektive Vollstreckung in einem Drittstaat – in casu der Volksrepublik China – existiere.
8 Die Erklärung der Klägerin vom 15.08.2025 ändere nichts. Es bestünden bereits erhebliche Zweifel, ob eine zwar „rechtsverbindliche“, aber jederzeit widerrufliche Erklärung überhaupt geeignet sei, die aufgezeigten tatsächlichen Bedenken auszuräumen. Darüber hinaus verkenne die Klägerin, dass Bedenken hinsichtlich möglicher Vollstreckungshindernisse nicht ausschließlich aus Schwierigkeiten bei der Zustellung der Kostenentscheidung erwachsen können. Vielmehr stelle die Zustellung der Kostenentscheidung zwar einen notwendigen, aber eben auch nur einen ersten Schritt bei der Vollstreckung dar. Die Beitreibung der Gerichtskosten habe jedoch, wovon die Klägerin selbst auch ausgehe, grundsätzlich in der Volksrepublik China stattzufinden. Die Erklärung der Klägerin verhalte sich jedoch nicht zu den erforderlichen nationalen Vollstreckungsverfahren oder zur Beitreibung in der Volksrepublik China. Hierfür entfalte sie keinerlei Wirkung.
9 Dass die Klägerin über Vermögenswerte im Vertragsgebiet des EPG verfügt, in die eine etwaige Zwangsvollstreckung ohne weitere Schwierigkeiten erfolgen könnte, müsse sie, die Beklagte zu 2), mangels Einblickes in die Unternehmens- und Eigentumsverhältnisse der Klägerin mit Nichtwissen bestreiten. Auch die Klägerin trage nichts Konkretes zu derartigen Vermögenswerten vor.
10 Ihrer Ansicht nach ist der Klägerin eine Sicherheitsleistung in Höhe von mindestens 239.000,00 € aufzugeben, die innerhalb einer Frist von höchstens sechs Wochen nach Zustellung der Anordnung zu leisten sei.
11 Nach Regel 158.1 VerfO müsse eine angemessene Sicherheit die Kosten abdecken, welche der antragstellenden Partei entstandenen sind und/oder noch entstehen werden und welche die andere Partei möglicherweise zu tragen habe. Insoweit seien die etwaig erstattungsfähigen Kosten der Verletzungsklage als auch der Nichtigkeitswiderklage zu berücksichtigen. In Anbetracht des in der Klageschrift angegebenen Streitwerts der Klage belaufe sich die Obergrenze der erstattungsfähigen (Vertreter)Kosten für die Klage und die Widerklage auf jeweils 112.000,00 €. Bei der Widerklage seien zudem die von der Beklagten zu 2) vorgestreckten Gerichtskosten in Höhe von 15.000,00 € zu berücksichtigen.
12 Die erstattungsfähigen Kosten für das vorliegende Verfahren seien nicht auf die Beklagten zu 1) und 2) aufzuteilen. Unabhängig davon, wie die Beklagte zu 1) und die Beklagte zu 2) im weiteren Prozessverlauf vertreten werden, handele es sich bei den Beklagten um Unternehmen desselben Wirtschaftskonzerns, unter denen es keine Interessenkonflikte hinsichtlich der Aufteilung einer etwaigen Prozesskostensicherheit geben werde. Daher könne auch die Beklagte zu 2) die vollständige Summe fordern. Sollte dennoch eine Aufteilung des durch die Obergrenze in das Ermessen des Gerichts gestellten Betrags für notwendig erachten werden, sei bei der Aufteilung jedenfalls aber die besondere Rolle der Beklagten zu 2) im derzeitigen Verfahrensstadium zu berücksichtigen und dieser ein deutlich höherer Anteil der zuerkannten Summe zuzuweisen, der 75% der zuerkannten Summe nicht unterschreiten solle. Die Beklagte zu 2) sei derzeit alleinige Nichtigkeitswiderklägerin.
13 Nach alldem ist nach Ansicht der Beklagten zu 2) die Festsetzung der Höhe einer Sicherheit unter Ausschöpfung der Obergrenze von insgesamt 200.000,00 € und ohne eine Aufteilung zwischen den beiden Beklagten vorzunehmen. Jedenfalls solle der der Beklagten zu 2) zugewiesene Betrag einen Wert von 150.000,00 € nicht unterschreiten.
14 Die Klägerin vertritt demgegenüber die Ansicht, sie habe schon dem Grunde nach keine
Prozesskostensicherheit zu leisten.
15 Die Beklagte zu 2) habe schon nicht vorgetragen, dass eine Vollstreckung in China überhaupt notwendig sein werde. Zum einen habe sie, die Klägerin, im Falle des Unterliegens in einem der vielen Gerichtsverfahren in Europa stets zuverlässig die ihr auferlegten Kosten gezahlt. Zum anderen könnte die Beklagte zu 2) im Zweifel auf das in Deutschland und Europa belegene, erhebliche Vermögen der Klägerin zurückgreifen. Ferner seien sowohl die Unternehmensgruppe der Beklagten zu 2) als auch die Klägerin an mehreren gerichtlichen Verfahren beteiligt, deren ursprünglicher Schwerpunkt in der Volksrepublik China liege. Die Beitreibung erstattungsfähiger Gerichtskosten dürfte mithin für die Beklagte zu 2) ohne weiteres möglich sein, da ihre Unternehmensgruppe mit dem dortigen Gerichtssystem bestens vertraut sei.
16 Darüber hinaus hätten die Beklagten zu Zwecken der Zustellung in den von ihr angestrengten Klageverfahren (unter anderem vor deutschen Gerichten) auch unter der Adresse der deutschen Tochtergesellschaft an die Klägerin zugestellt. Diese Zustellungen seien von der Klägerin in sämtlichen der zwischen den Parteien anhängigen Verfahren ausnahmslos und unverzüglich akzeptiert worden. Mithin hätten die Beklagten auf jedwede Zustellungsanstrengungen in China verzichten können. Im Hinblick auf das hier in Rede stehende Verfahren habe sie die Erklärung im Schriftsatz vom 15.08.2025 abgegeben.
17 Mit Blick auf die Höhe einer etwaigen Sicherheitsleistung ist die Klägerin der Ansicht, es sei auf die Obergrenze der erstattungsfähigen Kosten der Vertreterkosten abzustellen. Die Obergrenze belaufe sich beim vorliegenden Streitwert auf 200.000,00 €. Die Kosten der Nichtigkeitswiderklage seien für die Bemessung der Sicherheitsleistung als Kosten des Verletzungsverfahrens zu betrachten. Ausgehend von dieser einheitlichen Betrachtungsweise sei von einem einheitlichen Streitwert auszugehen. Eine getrennte Festsetzung und Addition von Sicherheiten sei hingegen nicht vorzunehmen.
18 Die Obergrenze der erstattungsfähigen Kosten gelte ferner einheitlich für das Verfahren, und zwar unabhängig von der Anzahl der beklagten Parteien und der Ansprüche, und sei daher auf die Parteien aufzuteilen. Aufgrund des bisherigen Verfahrensverlaufs und mangels entgegenstehender Anhaltspunkte sei von einer eigenständigen Vertretung der Beklagten zu 1) auszugehen, sodass auf die Beklagte zu 2) allenfalls das hälftige Kosteninteresse der bestehenden Obergrenze entfallen könne.
19 Des Weiteren sei zu berücksichtigen, dass die gesetzlichen Obergrenzen eine Schutzbestimmung gegen eine übermäßige Kostenerstattung darstellten. Die Prozesskostensicherheit solle daher lediglich im Einzelfall den Maximalbetrag erreichen. Zudem seien Kosten für die Vertretung nur dann erstattungsfähig, wenn sie angemessen und verhältnismäßig sind. Die Beklagte zu 2) habe indes nicht dargelegt, in welchem Umfang ihr bislang Kosten für die Vertretung entstanden seien. Daher sei eine Festsetzung einer Sicherheitsleistung entsprechend der Obergrenze nicht erforderlich.
20 Nach alldem wäre die Bemessung der Höhe einer Sicherheit weit unterhalb der Obergrenze anzusetzen und sollte jedenfalls einen Betrag von 100.000,00 € nicht überschreiten.
GRÜNDE FÜR DIE ANORDNUNG
21 Der Antrag der Beklagten zu 2) auf Anordnung einer Sicherheitsleistung hat in dem aus dem Tenor ersichtlichen Umfang Erfolg.
I.
22 Das Gericht kann gemäß Art. 64 Abs. 4 EPGÜ und Regel 158.1 VerfO auf einen Antrag des Beklagten nach eigenem Ermessen unter Berücksichtigung der von den Parteien vorgebrachten Tatsachen und Argumente eine Sicherheit für die Prozesskosten und sonstigen Kosten der Partei anordnen. Dabei hat es zu prüfen, ob die finanzielle Lage des Klägers Anlass für berechtigte und tatsächliche Bedenken gibt, dass eine mögliche Kostenanordnung nicht realisierbar sein könnte und/oder dass eine mögliche Kostenanordnung des Gerichts nicht oder nur unter unverhältnismäßigen Schwierigkeiten vollstreckbar sein könnte (Berufungsgericht, Anordnung v. 26.08.2024, UPC_CoA_328/2024 – Ballinno/Kinexon; Anordnung v. 17.09.2024, UPC_CoA_217/2024 – NST/Audi; Anordnung v. 29.11.2024, UPC_CoA_548/2024 – Sodastream/Aarke; Anordnung v. 09.07.2025, UPC_CoA_431/2025 – Chint/JingAo).
23 Ob eine Kostenentscheidung zu Gunsten des Beklagten zu erwarten ist oder der Kläger gewillt ist, einen zukünftigen Kostenerstattungsanspruch des Beklagten in der Zukunft zu erfüllen, ist hierbei nicht von Bedeutung (Berufungsgericht, Anordnung vom 29.11.2024, UPC_CoA_548/2024 – SodaStream/Aarke).
24 Die Darlegungs- und Beweislast dafür, dass eine Sicherheitsleistung für die Kosten in einem bestimmten Fall angemessen ist, obliegt dem antragstellenden Beklagten. Steht die Vollstreckbarkeit einer möglichen Kostenentscheidung in Rede, bedarf es aufgrund des zuvor Gesagten nicht der Darlegung und des Beweises, dass die Vollstreckung unmöglich ist. Es reicht aus, wenn der Beklagte dartut, dass die Vollstreckung mit unverhältnismäßigen Schwierigkeiten verbunden ist (Berufungsgericht, Anordnung vom
29.11.2024, UPC_CoA_548/2024 – SodaStream/Aarke; Anordnung v. 09.07.2025, UPC_CoA_431/2025 – Chint/JingAo).
25 Dass das EPG aufgrund seiner erst kürzlich erfolgten Errichtung derzeit noch keine Erfahrungen mit der Vollstreckung von Kostenentscheidungen dieses Gerichts in einem bestimmten Land hat, schließt die Feststellung nicht aus, dass sich die Vollstreckung einer Kostenentscheidung in diesem Land als unmöglich oder unverhältnismäßig aufwendig erweisen könnte. In Ermangelung solcher Erfahrungen muss das Gericht die Wahrscheinlichkeit einer erfolgreichen Vollstreckung auf der Grundlage anderer Tatsachen und Umstände prüfen (Berufungsgericht, Anordnung v. 09.07.2025, UPC_CoA_431/2025 – Chint/JingAo).
II.
26 Entsprechend diesen Grundsätzen übt das Gericht sein ihm zustehendes Ermessen dahingehend aus, eine von der Klägerin zu erbringende angemessene Sicherheit für gegebenenfalls der Beklagten zu 2) erstattende Kosten des Verfahrens und Auslagen anzuordnen.

27 Es besteht eine ausreichende Wahrscheinlichkeit dafür, dass eine mögliche Kostenentscheidung des EPG zugunsten der Beklagten zu 2) nur unter unverhältnismäßigen Schwierigkeiten vollstreckbar sein könnte.
a)
28 Die Klägerin ist ein Unternehmen mit Sitz in der Volksrepublik China, einem Land außerhalb der EU und des Europäischen Wirtschaftsraum. Während das Unionsrecht die Anerkennung und Vollstreckung von Urteilen der Gerichte der Mitgliedstaaten, einschließlich des Gerichts, in anderen Mitgliedstaaten garantiert, gibt es möglicherweise keine vergleichbaren Garantien für die Anerkennung und Vollstreckung in Staaten, die nicht Mitglied der Europäischen Union oder des Europäischen Wirtschaftsraums sind.
b)
29 Die Beklagte zu 2) hat zudem Beispiele verschiedener Lokalkammern des EPG vorgetragen, in denen die Zustellung von Klageschriften, Anträgen und/oder Schriftstücken in der Volksrepublik China nicht oder nur unter erheblichen Schwierigkeiten erfolgt ist, ohne dass der Grund für die jeweiligen Schwierigkeiten erkennbar gewesen ist bzw. erkennbar ist (Lokalkammer Mannheim, Anordnung v. 31.07.2024, UPC_CFI_332/2024 – Panasonic/Xiaomi; Lokalkammer München, Anordnung vom 21.01.2025, UPC_CFI_508/2023 und UPC_CFI_509/2023 – air up/Guangzhou Aiyun Yanwu; Anordnung v. 19.03.2025, UPC_CFI_425/2025 – JingaAo/Chint). Die Beklagte zu 2) hat ferner aus der nationalen (deutschen) Gerichtspraxis Beispiele vorgetragen, denen ebenfalls (ohne ersichtlichen Grund) Zustellprobleme zugrunde lagen. Dass es sich hierbei um Einzelfälle handelt, ist nicht ersichtlich. Die vorgebrachten Beispiele belegen in der Gesamtschau, dass die Zustellung von Klageschriften oder anderen Dokumenten in der Volksrepublik China mit erheblichen Schwierigkeiten verbunden sein kann, obwohl die Volksrepublik China das Haager Zustellübereinkommen ratifiziert hat. Kommt ein Land seinen Verpflichtungen aus dem Haager Zustellübereinkommen nicht nach, besteht eine hohe Wahrscheinlichkeit, dass (auch) eine Kostenentscheidung des EPG in diesem Land nicht oder nur mit unverhältnismäßigem Aufwand vollstreckbar ist (Lokalkammer München, Anordnung v. 19.03.2025, UPC_CFI_425/2025 – JingaAo/Chint).
30 Die Klägerin ist dem Vortrag der Beklagten zu 2) insoweit nicht entgegengetreten. Die vorgebrachten Beispiele hat sie unkommentiert gelassen. Insbesondere die bestehenden Schwierigkeiten bei der Zustellung von Klageschriften und Dokumenten seitens des EPG in der Volksrepublik China sind folglich unstreitig.
c)
31 Soweit die Klägerin bemängelt, die Beklagte zu 2) habe nicht vorgetragen, dass eine Vollstreckung in der Volksrepublik China überhaupt notwendig sein werde, dringt sie mit diesem Vorbringen nicht durch.
32 Die Klägerin hat ihren Sitz in der Volksrepublik China, weshalb eine Vollstreckung einer Kostenentscheidung des EPG auch dort nach den in der Volksrepublik China gültigen Regelungen zur Vollstreckung „ausländischer“ Entscheidungen vorzunehmen ist. Dass dem im vorliegenden Fall ausnahmsweise nicht so sein sollte, ist weder vorgetragen noch sonst wie ersichtlich. Die Klägerin selbst scheint vielmehr davon auszugehen, dass die Beibringung von Gerichtskosten in der Volksrepublik China vonnöten ist. Ob die Beklagte zu 2) insoweit über Erfahrungen verfügt, ist unerheblich. Es ist nicht ersichtlich, dass aufgrund der (vermeintlichen) Erfahrungen die hier in Rede stehenden Schwierigkeiten beseitigt würden.
33 Angesichts der erforderlichen Vollstreckung in der Volksrepublik China ist das Vorbringen der Klägerin zu ihren Vermögenswerten in Deutschland oder Europa, welche die Beklagte zu 2) zulässigerweise mit Nichtwissen bestreiten, ohne Bedeutung. Selbst wenn die Klägerin über diese verfügt, ist nicht dargetan oder ersichtlich, dass diese eine Vollstreckung in der Volksrepublik China erübrigen würden und die Beklagte zu 2) hierauf verwiesen werden könnte.
34 Die rechtsverbindliche Erklärung der Klägerin vom 15.08.2025 ist letztlich nicht geeignet, die ausreichende Wahrscheinlichkeit von unverhältnismäßigen Schwierigkeiten betreffend die Vollstreckung einer Kostenentscheidung des EPG zugunsten der Beklagten zu 2) in der Volksrepublik China zu entkräften. Die Beklagte zu 2) weist zutreffend darauf hin, dass die Zustellung der Kostenentscheidung nur der erste Schritt einer Vollstreckung der Entscheidung ist. Selbst wenn aufgrund der Erklärung der Klägerin eine etwaige Kostenentscheidung an ihre deutsche Tochtergesellschaft erfolgen könnte, blieben die weiteren Unwägbarkeiten und erheblichen Schwierigkeiten bestehen.
35 Ob die Klägerin gewillt ist, etwaige zukünftige Kostenerstattungsansprüche der Beklagten zu 2) zu erfüllen, ist aus Rechtsgründen nicht entscheidend.

36 Das Gericht hält eine Sicherheitsleistung von 150.000,00 € zu Gunsten der Beklagten zu 2) für angemessen.
a)
37 Bei der Bestimmung der Höhe der zu leistenden Sicherheit hat sich das Gericht davon leiten lassen, dass sich die im Unterliegensfall zu erstattenden Vertretungskosten an den Obergrenzen für die erstattungsfähigen Kosten orientieren. Gemäß Art. 1 Abs. 2 u. 3 der Tabelle der sich aus dem Streitwert ergebenden Obergrenzen für erstattungsfähige Kosten vom 24.04.2023 (nachfolgend: Tabelle) gelten die Obergrenzen für erstattungsfähige Kosten für die Vertretungskosten und finden in jeder Instanz des Gerichtsverfahrens Anwendung, ungeachtet der Anzahl der Parteien und der betroffenen Ansprüche.
38 Die Vertretungskosten, die den Beklagten zu 2) anlässlich der Widerklage auf Nichtigerklärung entstehen, sind einzubeziehen (Lokalkammer Düsseldorf, Anordnung v. 27.12.2024, UPC_CFI_100/2024 – Ona Patents/Google; Anordnung v. 14.04.2025, UPC_CFI_335/2024 – Maxeon Solar/Aiko Energy; Lokalkammer München, Anordnung v. 25.08.2025, UPC_CFI_149/2024).
39 Die Obergrenze der zu erstattenden Kosten beträgt gemäß der Tabelle 200.000,00 €. Sie ergibt sich aus den Streitwerten für das Verletzungsverfahren und die Widerklage auf Nichtigerklärung. Die Streitwerte von Verletzungsverfahren und Widerklage sind gemäß Ziffer II. 2. b) (4) der Richtlinien für die Bestimmung der Gerichtsgebühren und die Obergrenze für erstattungsfähige Kosten vom 24.04.2023 (nachfolgend: Richtlinien) für die Zwecke der Festsetzung der Höhe der erstattungsfähigen Kosten und damit auch für die Bestimmung ihrer Obergrenze zu addieren. Der Streitwert für die Verletzungsklage ist von der Klägerin mit 1.000.000,00 € angegeben. Gleiches gilt für die Widerklagen auf Nichtigerklärung.
b)
40 Da die Obergrenze einheitlich für das Verfahren unabhängig von der Anzahl der Parteien und Ansprüche gilt (s.o.), bedarf es einer Aufteilung der Obergrenze auf die Parteien. In diesem Zusammenhang weist die Beklagte zu 2) zwar zutreffend darauf hin, dass eine gemeinsame Vertretung die Vermutung begründet, dass die Parteien sich wirtschaftlich nahestehen oder derselben Wirtschaftsgruppe angehören und/oder keine Interessenskonflikte bestehen (Lokalkammer München, Anordnung v. 03.07.2025, UPC_CFI_149/2024), weshalb eine gemeinsame Betrachtung angezeigt sein kann. Gleichwohl verfängt ihr Hinweis auf die Zugehörigkeit der Beklagten zum selben Wirtschaftskonzern und das Vorbringen, es werde keine Interessenkonflikte hinsichtlich der Aufteilung einer etwaigen Prozesskostensicherheit zwischen den Beklagten geben, nicht. Die Überlegungen zu einer (etwaigen) gemeinsamen Vertretung und den daraus erwachsenen Folgen stellt sich erst, wenn die Klage an beide Parteien zugestellt werden konnte und infolgedessen eine Anhörung der Beklagten zu 1) (auch) zu dieser Frage möglich ist. Dies ist vorliegend bisher nicht der Fall. Aufgrund dessen bleibt es bei einer getrennten Betrachtung der Beklagten, die in anderem Zusammenhang auch von der Beklagten zu 2) befürwortet wird.
41 Bei der Aufteilung der Obergrenze ist allerdings zu bedenken, dass nur die Beklagte zu 2) (bisher) die Widerklage auf Nichtigerklärung des Streitpatents erhoben hat. Insoweit trägt nur sie (bisher) die Kostenlast.
c)
42 Des Weiteren ist bei der Festsetzung der Höhe der Sicherheit zu berücksichtigen, dass die bislang genannten Beträge eine Obergrenze und somit eine Schutzbestimmung gegen eine übermäßige Kostenerstattung darstellen, die vom Gericht als letztes angewendet wird

(siehe Erwägungsgrund 1 der Richtlinien). Was die Kosten für die Vertretung angeht, so sind diese gemäß Art. 69 Abs. 1 EPGÜ und Regel 152 VerfO nur erstattungsfähig, wenn sie angemessen und verhältnismäßig sind.
43 Schließlich hat das Gericht bei der Ausübung seines Ermessens zu berücksichtigen, dass eine Sicherheitsleistung je nach den Umständen das Recht des Klägers auf einen wirksamen Rechtsbehelf und auf ein faires Verfahren, wie es durch das Unionsrecht, einschließlich Art. 47 der Durchsetzungsrichtlinie, garantiert ist, einschränken kann (Lokalkammer Düsseldorf, Anordnung v. 14.04.2025, UPC_CFI_335/2024 – Maxeon Solar/Aiko Energy). Daher muss stets zwischen dem Interesse der Beklagten an einer Sicherheitsleistung einerseits und dem Interesse des Klägers an der wirksamen Durchsetzung seiner Patentrechte andererseits abgewogen werden.
d)
44 All dies berücksichtigend übt das Gericht sein Ermessen dahingehend aus, dass die Klägerin verpflichtet ist, der Beklagten zu 2) eine Sicherheit in Höhe 150.000,00 € zu leisten. Bei diesem Betrag handelt sich um 75 % der oben angegebenen anteiligen Obergrenze. Da die Beklagte zu 2) nicht dargelegt hat, in welchem Umfang ihr bislang Kosten für die Vertretung entstanden sind, ist die Festsetzung einer höheren Sicherheitsleistung nicht möglich. Umgekehrt ist nicht ersichtlich, dass die Auferlegung einer solchen Sicherheit die Klägerin in der Durchsetzung ihres Patents unangemessen behindern würde.
e)
45 Die Sicherheit kann in Form der Hinterlegung des Betrages auf das für Hinterlegungen bestimmte UPC-Konto (UPC account for a deposit of security for costs) oder durch eine Bankbürgschaft einer in der Europäischen Union zugelassenen Bank geleistet werden. Die Klägerin kann wählen, welche Form der Sicherheit sie bevorzugt.
46 Als Frist für die Beibringung der Sicherheit im Sinne von Regel 158.1 S. 1 VerfO hält das Gericht einen Zeitraum von sechs Wochen ab Zustellung der Anordnung für angemessen. Die Information der Klägerin über die Folgen einer verspäteten Sicherheitsleistung folgt aus Regel 158.4 VerfO.
47 Da es sich um eine Anordnung der Berichterstatterin handelt, ist eine Zulassung der Berufung gem. Art. 73 EPÜG i. V. m. Regel 220.2 VerfO entsprechend Regel 158.3 VerfO nicht möglich. Die Anordnung kann gem. Regel 333 VerfO überprüft werden (Berufungsgericht, Anordnung v. 14.01.2025, UPC_CoA_651/2024 – Total Semiconductors / Texas Instruments).
ANORDNUNG
1. Der Klägerin wird aufgegeben, der Beklagten zu 2) Sicherheit in Höhe von 150.000,00 € für die Kosten des Rechtsstreits und sonstigen, den Beklagten zu 2) entstandenen und/oder noch entstehenden Kosten zu leisten.
2. Die Sicherheit kann nach Wahl der Klägerin durch Hinterlegung auf das für Hinterlegungen von Sicherheitsleistungen bestimmte Konto des EPG oder durch Bankbürgschaft einer in der Europäischen Union zugelassenen Bank geleistet werden.
3. Die Sicherheit ist innerhalb einer Frist von sechs Wochen, beginnend mit der Zustellung dieser Anordnung, zu leisten.

FACTS
1 The plaintiff is suing the defendants for alleged infringement of the contested patent. Service of the action on the first defendant has not yet been successful. The second defendant, which, among other things, denies infringement of the patent in dispute, has filed a counterclaim for annulment (CC_33345/2025 UPC_CFI_668/2025).
2 The second defendant seeks to require the plaintiff to provide security for the costs of the proceedings.
3 In its statement(s) on the second defendant's application, the plaintiff gave a legally binding assurance in a letter dated 15 August 2025 that a decision on costs by the EPG in the proceedings with the case number ACT_13761/2025, UPC_CFI_248/2025, can be served on the plaintiff's German subsidiary, Huawei Technologies Deutschland GmbH, Hansaallee 205, 40549 Düsseldorf. For the sake of clarity, it pointed out that this assurance applies exclusively to the present proceedings and to the service of any decision on costs in these proceedings. Furthermore, it has no binding effect on the plaintiff.
MOTIONS
The second defendant requests that
I. the plaintiff be ordered to provide adequate security for the costs of the legal dispute and other costs incurred by the second defendant within a specified period (Art. 69(4) EPGÜ, Rule 158.1 of the Rules of Procedure),
II. that a default judgment be issued in the event that the applicant fails to provide adequate security for the costs of the proceedings and other costs within the specified period (Rules 158.5 and 355.1(a) of the Rules of Procedure).
5 The applicant requests that
I. the request of the second defendant for security for the costs of the proceedings be rejected,
alternatively,
II. the applicant be ordered to provide adequate security for the costs of the proceedings and the other costs of the second defendant within a period of at least six weeks.
SUMMARY OF THE (CONTROVERSIAL) PARTY'S ARGUMENT
6 The second defendant is of the opinion that the plaintiff's obligation to provide security
arises from Art. 69(4) EPGÜ in conjunction with Rule 158.1 VerfO.
7 The plaintiff is a company from and based in the People's Republic of China. In ordering the security deposit, account must be taken of the fact that a decision on costs by the EPO cannot be enforced with sufficient certainty in the People's Republic of China, and if at all, only in a manner that is unreasonably burdensome for the second defendant. Both national courts in Europe and the EPG would face considerable difficulties in serving statements of claim or other documents in the People's Republic of China, even though the People's Republic of China had ratified the Hague Service Convention. In the case of a country such as the People's Republic of China, which does not fulfil its obligations under the Hague Service Convention, it must therefore be assumed that a decision on costs by the EPG would not be enforceable in that country, or only with disproportionate effort. Likewise, it must be taken into account that the plaintiff is based in a non-EU/EEA country and that there is no equivalent guarantee of effective enforcement in a third country – in this case the People's Republic of China – in individual cases.
8 The plaintiff's statement of 15 August 2025 does not alter this. There are already considerable doubts as to whether a declaration that is ‘legally binding’ but revocable at any time is at all suitable for dispelling the actual concerns that have been raised. Furthermore, the plaintiff fails to recognise that concerns regarding possible obstacles to enforcement cannot arise exclusively from difficulties in serving the decision on costs. Rather, the service of the cost decision is a necessary but only a first step in enforcement. However, as the plaintiff itself assumes, the recovery of court costs must in principle take place in the People's Republic of China. The plaintiff's statement does not, however, refer to the necessary national enforcement procedures or to recovery in the People's Republic of China. It has no effect in this regard.
9 The fact that the plaintiff has assets in the EPG's contract territory, where enforcement could take place without further difficulties, must be disputed by the second defendant, who has no knowledge of the plaintiff's corporate and ownership structure. Nor does the plaintiff provide any concrete evidence of such assets.
10 In its opinion, the plaintiff must be required to provide security in the amount of at least €239,000.00, which must be provided within a period of no more than six weeks after service of the order.
11 According to Rule 158.1 VerfO, adequate security must cover the costs incurred and/or to be incurred by the applicant and which the other party may have to bear. In this respect, the potentially recoverable costs of the infringement action and the counterclaim for annulment must be taken into account. In view of the amount in dispute stated in the statement of claim, the upper limit of the recoverable (representative)costs for the action and the counterclaim is €112,000.00 in each case. In the case of the counterclaim, the court costs of €15,000.00 advanced by the second defendant must also be taken into account.
12 The reimbursable costs for the present proceedings are not to be apportioned between the first and second defendants. Regardless of how the first defendant and the second defendant are represented in the further course of the proceedings, the defendants are companies belonging to the same economic group, between which there will be no conflicts of interest with regard to the apportionment of any security for legal costs. Therefore, the second defendant can also claim the full amount. Should it nevertheless be deemed necessary to apportion the amount subject to the upper limit at the discretion of the court, the special role of the second defendant at the current stage of the proceedings must be taken into account in the apportionment and the second defendant must be allocated a significantly higher share of the amount awarded, which should not be less than 75% of the amount awarded. The second defendant is currently the sole counterclaimant for annulment.
13 In view of the above, the second defendant is of the opinion that the amount of security should be set at the maximum limit of €200,000.00 in total and without any division between the two defendants. In any case, the amount allocated to the second defendant should not be less than €150,000.00.
14 The plaintiff, on the other hand, is of the opinion that it does not have to provide security for the costs of the proceedings on the merits of the case.
15 The second defendant has not argued that enforcement in China will be necessary at all. On the one hand, the plaintiff has always reliably paid the costs imposed on it in the event of losing one of the many court proceedings in Europe. On the other hand, in case of doubt, the second defendant could fall back on the plaintiff's considerable assets located in Germany and Europe. Furthermore, both the group of companies of the second defendant and the plaintiff are involved in several court proceedings, the original focus of which is in the People's Republic of China. The recovery of reimbursable court costs should therefore be readily possible for the second defendant, as its group of companies is very familiar with the court system there.
16 In addition, for the purposes of service in the legal proceedings initiated by it (including before German courts), the defendants also served the plaintiff at the address of its German subsidiary. These services were accepted by the plaintiff without exception and without delay in all of the proceedings pending between the parties. Consequently, the defendants could have dispensed with any attempts at service in China. With regard to the proceedings at issue here, it had made the statement in its written submission of 15 August 2025.
17 With regard to the amount of any security deposit, the plaintiff is of the opinion that the upper limit of the reimbursable costs of representation should be taken as a basis. The upper limit for the present amount in dispute is €200,000.00. The costs of the counterclaim for annulment should be regarded as costs of the infringement proceedings for the purpose of assessing the security. Based on this uniform approach, a uniform amount in dispute should be assumed. However, separate determination and addition of securities should not be carried out.
18 The upper limit of the reimbursable costs also applies uniformly to the proceedings, regardless of the number of defendants and claims, and must therefore be divided between the parties. Based on the course of the proceedings to date and in the absence of any indications to the contrary, it can be assumed that the first defendant is represented independently, so that the second defendant can at most be allocated half of the costs up to the existing upper limit.
19 Furthermore, it should be taken into account that the statutory upper limits constitute a protective provision against excessive reimbursement of costs. The security for legal costs should therefore only reach the maximum amount in individual cases. In addition, costs for representation are only reimbursable if they are reasonable and proportionate. However, the second defendant has not explained the extent to which it has incurred costs for representation to date. Therefore, it is not necessary to set a security deposit in accordance with the upper limit.
20 In view of the above, the amount of security should be set well below the upper limit and should in any case not exceed €100,000.00.
REASONS FOR THE ORDER
21 The application by the second defendant for an order to provide security is successful to the extent apparent from the operative part of the order.
I.
22 Pursuant to Article 64(4) EPGÜ and Rule 158.1 VerfO, the court may, at its discretion, order security for the legal costs and other costs of the party upon application by the defendant, taking into account the facts and arguments presented by the parties. In doing so, it must examine whether the financial situation of the claimant gives rise to justified and actual concerns that a possible order for costs might not be enforceable and/or that a possible order for costs by the court might not be enforceable or might only be enforceable with disproportionate difficulty (Court of Appeal, order of 26 August 2024, UPC_CoA_328/2024 – Ballinno/Kinexon; order of 17 September 2024, UPC_CoA_217/2024 – NST/Audi; Order of 29 November 2024, UPC_CoA_548/2024 – Sodastream/Aarke; Order of 9 July 2025, UPC_CoA_431/2025 – Chint/JingAo).
23 Whether a decision on costs in favour of the defendant is to be expected or whether the claimant is willing to satisfy a future claim for reimbursement of costs by the defendant is irrelevant in this context (Court of Appeal, order of 29 November 2024, UPC_CoA_548/2024 – SodaStream/Aarke).
24 The burden of proof that a security deposit for costs is appropriate in a particular case lies with the defendant making the application. If the enforceability of a possible decision on costs is in question, the above means that it is not necessary to demonstrate and prove that enforcement is impossible. It is sufficient for the defendant to demonstrate that enforcement would involve disproportionate difficulties (Court of Appeal, order of
29 November 2024, UPC_CoA_548/2024 – SodaStream/Aarke; Order of 9 July 2025, UPC_CoA_431/2025 – Chint/JingAo).
25 The fact that the UPC, having only recently been established, does not yet have any experience with the enforcement of its own cost decisions in a particular country does not preclude the finding that enforcement of a cost decision in that country could prove impossible or disproportionately difficult. In the absence of such experience, the court must assess the likelihood of successful enforcement on the basis of other facts and circumstances (Court of Appeal, order of 9 July 2025, UPC_CoA_431/2025 – Chint/JingAo).
II.
26 In accordance with these principles, the court exercises its discretion to order the claimant to provide adequate security for any costs and expenses to be reimbursed to the second defendant.

27 There is a sufficient likelihood that a possible decision on costs by the EPG in favour of the second defendant could only be enforced with disproportionate difficulty.
a)
28 The plaintiff is a company based in the People's Republic of China, a country outside the EU and the European Economic Area. While EU law guarantees the recognition and enforcement of judgments of the courts of the Member States, including the Court, in other Member States, there may be no comparable guarantees for recognition and enforcement in countries that are not members of the European Union or the European Economic Area.
b)
29 The second defendant also cited examples from various local chambers of the EPG in which the service of statements of claim, applications and/or documents in the People's Republic of China was not possible or was only possible with considerable difficulty, without the reason for the respective difficulties being apparent or recognisable (Local Chamber Mannheim, order of 31 July 2024, UPC_CFI_332/2024 – Panasonic/Xiaomi; Local Chamber Munich, order of 21 January 2025, UPC_CFI_508/2023 and UPC_CFI_509/2023 – air up/Guangzhou Aiyun Yanwu; order of 19 March 2025, UPC_CFI_425/2025 – JingaAo/Chint). The second defendant also cited examples from national (German) court practice which were also based on service problems (without any apparent reason). It is not apparent that these are isolated cases. Taken together, the examples cited demonstrate that the service of writs of summons or other documents in the People's Republic of China can be associated with considerable difficulties, even though the People's Republic of China has ratified the Hague Service Convention. If a country fails to fulfil its obligations under the Hague Service Convention, there is a high probability that (also) a decision on costs by the EPG in that country will not be enforceable or will only be enforceable with disproportionate effort (Local Chamber Munich, order of 19 March 2025, UPC_CFI_425/2025 – JingaAo/Chint).
30 The plaintiff did not contest the arguments put forward by the second defendant in this regard. It did not comment on the examples given. In particular, the existing difficulties in serving statements of claim and documents on behalf of the EPG in the People's Republic of China are therefore undisputed.
c)
31 Insofar as the plaintiff complains that the second defendant did not argue that enforcement in the People's Republic of China would be necessary at all, it does not succeed with this argument.
32 The plaintiff is based in the People's Republic of China, which is why enforcement of a decision on costs by the EPG must also be carried out there in accordance with the regulations applicable in the People's Republic of China for the enforcement of ‘foreign’ decisions. There is no argument or other indication that this should not be the case in the present case. Rather, the applicant itself seems to assume that the payment of court costs in the People's Republic of China is necessary. Whether the second defendant has experience in this regard is irrelevant. It is not apparent that the difficulties at issue here would be eliminated on the basis of (supposed) experience.
33 In view of the necessary enforcement in the People's Republic of China, the plaintiff's submission regarding its assets in Germany or Europe, which the second defendant permissibly disputes on the grounds of lack of knowledge, is irrelevant. Even if the plaintiff does have such assets, it has not been demonstrated or is not apparent that these would render enforcement in the People's Republic of China unnecessary and that the second defendant could be referred to them.
34 The plaintiff's legally binding declaration of 15 August 2025 is ultimately not sufficient to refute the sufficient likelihood of disproportionate difficulties concerning the enforcement of a decision on costs by the EPG in favour of the second defendant in the People's Republic of China. The second defendant correctly points out that the service of the decision on costs is only the first step in the enforcement of the decision. Even if, based on the plaintiff's statement, any decision on costs could be made to its German subsidiary, the other uncertainties and considerable difficulties would remain.
35 Whether the plaintiff is willing to satisfy any future claims for reimbursement of costs by the second defendant is not decisive for legal reasons.

36 The court considers a security deposit of €150,000.00 in favour of the second defendant to be appropriate.
a)
37 In determining the amount of the security to be provided, the court was guided by the fact that the representation costs to be reimbursed in the event of an unsuccessful outcome are based on the upper limits for reimbursable costs. According to Art. 1 (2) and (3) of the table of upper limits for reimbursable costs based on the value in dispute dated 24 April 2023 (hereinafter: table), the upper limits for reimbursable costs apply to representation costs and are applicable in every instance of the court proceedings, regardless of the number of parties and the claims involved.
38 The representation costs incurred by the second defendant in connection with the counterclaim for annulment must be included (Local Chamber Düsseldorf, order of 27 December 2024, UPC_CFI_100/2024 – Ona Patents/Google; Order of 14 April 2025, UPC_CFI_335/2024 – Maxeon Solar v Aiko Energy; Munich Local Chamber, Order of 25 August 2025, UPC_CFI_149/2024).
39 The upper limit of the costs to be reimbursed is €200,000.00 according to the table. This is based on the amounts in dispute for the infringement proceedings and the counterclaim for annulment. The amounts in dispute for infringement proceedings and counterclaims are determined in accordance with Section II. 2. b) (4) of the Guidelines for Determining Court Fees and the Upper Limit for Reimbursable Costs of 24 April 2023 (hereinafter: Guidelines) for the purposes of determining the amount of reimbursable costs and thus also for determining their upper limit. The value in dispute for the infringement action is stated by the plaintiff as €1,000,000.00. The same applies to the counterclaims for annulment.
b)
40 Since the upper limit applies uniformly to the proceedings regardless of the number of parties and claims (see above), the upper limit must be divided among the parties. In this context, the second defendant correctly points out that joint representation gives rise to the presumption that the parties are economically close or belong to the same economic group and/or that there are no conflicts of interest (Munich Local Chamber, order of 3 July 2025, UPC_CFI_149/2024), which is why a joint consideration may be appropriate. Nevertheless, its reference to the defendants' membership of the same economic group and its argument that there would be no conflicts of interest with regard to the distribution of any security for costs between the defendants is not valid. Considerations regarding (possible) joint representation and the consequences arising therefrom will only arise once the action has been served on both parties and, as a result, it is possible to hear the first defendant (also) on this issue. This is not yet the case in the present instance. For this reason, the defendants will continue to be considered separately, which is also advocated by the second defendant in another context.
41 When allocating the upper limit, however, it must be borne in mind that only the second defendant has (so far) filed a counterclaim for the annulment of the disputed patent. In this respect, only she bears the cost burden (so far).
c)
42 Furthermore, when determining the amount of the security, it must be taken into account that the amounts mentioned so far represent an upper limit and thus a protective provision against excessive reimbursement of costs, which is applied by the court as a last resort

(see recital 1 of the Guidelines). As regards the costs of representation, these are only recoverable under Article 69(1) EPC and Rule 152 RPC if they are reasonable and proportionate.
43 Finally, in exercising its discretion, the court must take into account that, depending on the circumstances, the provision of security may restrict the applicant's right to an effective remedy and to a fair trial as guaranteed by EU law, including Article 47 of the Enforcement Directive (Local Chamber Düsseldorf, order of 14 April 2025, UPC_CFI_335/2024 – Maxeon Solar v Aiko Energy). Therefore, the defendant's interest in a security deposit must always be weighed against the claimant's interest in the effective enforcement of its patent rights.

44 Taking all this into account, the court exercises its discretion to the effect that the plaintiff is obliged to provide the second defendant with security in the amount of €150,000.00. This amount represents 75% of the above-mentioned proportional upper limit. Since the second defendant has not disclosed the extent of its legal representation costs to date, it is not possible to set a higher security deposit. Conversely, it is not apparent that the imposition of such security would unreasonably hinder the plaintiff in enforcing its patent.

45 The security may be provided in the form of a deposit of the amount into the UPC account designated for deposits of security for costs or by means of a bank guarantee from a bank authorised in the European Union. The claimant may choose which form of security it prefers.
46 The Court considers a period of six weeks from the date of service of the order to be reasonable for the provision of security within the meaning of Rule 158.1(1) of the Rules of Procedure. The information provided to the applicant regarding the consequences of late security is based on Rule 158.4 of the Rules of Procedure.
47 As this is an order issued by the rapporteur, an appeal cannot be admitted pursuant to Art. 73 EPC in conjunction with Rule 220.2 of the Rules of Procedure in accordance with Rule 158.3 of the Rules of Procedure. The order may be reviewed in accordance with Rule 333 RPC (Court of Appeal, order of 14 January 2025, UPC_CoA_651/2024 – Total Semiconductors v Texas Instruments).
ORDER
1. The plaintiff is ordered to provide the second defendant with security in the amount of €150,000.00 for the costs of the legal dispute and other costs incurred and/or still to be incurred by the second defendant.
2. The security may be provided, at the plaintiff's discretion, by deposit into the EPG's account designated for the deposit of security or by bank guarantee from a bank authorised in the European Union.
3. The security must be provided within a period of six weeks from the date of service of this order.
4. The applicant is advised that a default judgment may be entered in accordance with Rule 355 of the Rules of Procedure if the security is not provided within the specified period.
