SACHVERHALT
1 Die Klägerin nimmt die Beklagten wegen einer von ihrer behaupteten Verletzung des Streitpatents in Anspruch. Die Klage richtet sich gegen die von den Beklagten in den EPG-Vertragsmitgliedstaaten angebotenen und vertriebenen Chips der „Dimensity“-Serie, wel-che u.a. in Smartphones und Tablets verschiedener Mobilgerätehersteller verbaut sind. Die Chips sind nach dem Vortrag der Klägerin 5G-fähig.
2 Die Klägerin verhandelte vor Klageerhebung mit der Beklagten zu 1) über eine Lizenz an ihrem Portfolio von für die Standards 4G und 5G essenziellen Patenten. Die Verhandlun-gen blieben erfolglos. In der Klageschrift hat die Klägerin zu diesen Verhandlungen vor-getragen und sich vorab zu einem möglichen Kartellrechtseinwand der Beklagten einge-lassen.
3 Die Beklagte zu 2) hat am 24.07.2025 eine Klageerwiderung (Nicht-Technischer Teil) ein-gereicht, in der sie den kartellrechtlichen Zwangslizenzeinwand erhebt. Zugleich hat sie einen Antrag auf Vorlage von Lizenzverträgen gem. Regel. 190 VerfO sowie einen hierauf bezogenen Antrag gemäß Regel 262A VerfO gestellt. Mit Anordnung vom 01.08.2025 ist diesem Antrag auf Schutz vertraulicher Informationen im Wesentlichen entsprochen wor-den soweit er zur Entscheidung anstand.
4 Zum Antrag auf Vorlage von Lizenzverträgen hat die Klägerin mit Schriftsatz vom 15.08.2025 Stellung genommen, wobei sie einen hierauf bezogenen Antrag gem. Regel 262A VerfO gestellt hat. Zur Begründung hat sie sich u.a. auf eine zwischen den Parteien geschlossene Geheimhaltungsvereinbarung berufen.
ANTRÄGE DER PARTEIEN
5 Die Klägerin beantragt,
A. anzuordnen, dass die folgenden Informationen gemäß R. 262.2, R. 262A als geheim-haltungsbedürftig eingestuft werden:
I. die in der Stellungnahme vom 15.08.2025 grau hinterlegten vertrauli-
chen Informationen sowie die hierzu überreichten und mit dem Hinweis
"CONFIDENTIAL" oder "vertraulich" versehenen Anlagen, Abbildungen und Übersichten, die insgesamt tabellarisch wie folgt zusammengefasst sind
II. die in der Stellungnahme vom 15.08.2025 gelb hinterlegten und zusätz-lich mit rotem Fettdruck umrahmten streng vertraulichen Informationen
sowie die hierzu überreichten und mit dem Hinweis "CONFIDEN-TIAL“ oder "streng vertraulich" versehenen Anlagen, Abbildungen und Übersichten, die insgesamt tabellarisch wie folgt zusammengefasst sind
III. Diese Einstufung bezieht sich auf die Informationen als solche, so dass diese auch dann erfasst sind, wenn sie in weiteren Schriftsätzen oder Anlagen erneut offenbart werden.
B. anzuordnen, dass der Zugang zu den in Ziff. I. genannten vertraulichen Informati-
onen auf die Prozessvertreter und sonstigen Vertreter der Beklagten zu 2) sowie auf Seiten der Beklagten zu 2) selbst auf die folgenden 17 Personen zu beschrän-ken ist:

C. anzuordnen, dass der Zugang zu den in Ziff. I. genannten streng vertraulichen In-
formationen auf die Prozessvertreter und sonstigen Vertreter der Beklagten zu 2) sowie auf Seiten der Beklagten zu 2) selbst auf die folgenden zwei Personen zu beschränken ist:
[…]
D. es wird darauf hingewiesen, dass
I. die Parteien, ihre Prozessvertreter, Zeugen, Sachverständige, sonstige Vertreter und alle sonstigen Personen, die an diesem Rechtsstreit beteiligt sind oder die Zugang zu Dokumenten dieses Verfahrens haben, die als geheimhaltungsbedürftig eingestufte Informationen vertraulich behandeln müssen und diese außerhalb des gerichtlichen Verfahrens nicht nutzen oder offenlegen dürfen, es sei denn, dass sie von diesen außerhalb des Verfahrens Kenntnis erlangt haben;
II. dass die Verpflichtung nach Ziff. I auch nach Abschluss dieses Verfahrens fort gilt, wobei dies nicht gilt, wenn das Gericht die Geheimhaltungsbedürf-tigkeit dieser Informationen durch rechtskräftige Entscheidung oder Anord-nung verneint hat oder sobald die streitgegenständlichen Informationen für Personen in den Kreisen, die üblicherweise mit solchen Informationen um-gehen, bekannt oder ohne Weiteres zugänglich werden;
III. das Gericht im Falle schuldhafter Zuwiderhandlung gegen den Verpflichte-ten für jeden Verstoß ein Ordnungsgeld bis zu 100.000 Euro oder Ord-nungshaft bis zu sechs Monaten verhängen und sofort vollstrecken kann.
E. für den Fall der Erörterung dieses Sachvortrages in der mündlichen Verhandlung anzuordnen,
I. die Öffentlichkeit wegen Gefährdung schutzwürdiger Interessen der Par-teien für diesen Teil der Zwischenanhörung und/oder mündlichen Verhand-lung gemäß Art. 45 EPGÜ i.V.m. R. 115 VerfO auszuschließen, soweit ge-heimhaltungsbedürftige Informationen nach Ziff. A erörtert werden;
II. die bei der Zwischenanhörung und/oder mündlichen Verhandlung anwe-senden Personen einschließlich der Parteivertreter, ihrer Prozessbevoll-mächtigten und der zur Mitwirkung an dem Rechtsstreit bestellten Patent-anwälte zu verpflichten, Tatsachen, welche die nach Ziff. A benannten Aus-führungen betreffen und ihnen in der Zwischenanhörung und/oder der mündlichen Verhandlung erstmals zu ihrer Kenntnis gelangen, gegenüber Dritten geheim zu halten und nur zum Zweck der Prozessführung im vor-liegenden Verfahren zu verwenden;
III. die Öffentlichkeit für einen Teil der Verkündung der Urteilsgründe auszu-schließen, soweit geheimhaltungsbedürftige Informationen nach Ziff. A er-örtert werden;
F. die geheimhaltungsbedürftigen Informationen nach Ziff. A von der Aktenein-sicht durch Dritte auszuschließen (Art. 58 EPGÜ i.V.m. R. 262.1 lit. b), 262.2 VerfO);
G. vor der Veröffentlichung der Urteilsgründe oder sonstiger Bekanntmachungen alle darin enthaltenen Informationen, die unter Ziff. A fallen gemäß R. 262.1 lit. a), 262.2, 262A VerfO zu schwärzen.
6 Die Beklagte zu 2) beantragt, den Geheimnisschutz gem. Regel 262A VerfO betreffend den Vortrag der Klägerin vom 15.08.2025 zu dem Vorlageantrag der Beklagten zu 2) anzuordnen, wie von der Klägerin beantragt, wobei die nachfolgend durch rote Streichung hervorgehobenen Anpassungen gegenüber dem Geheimhaltungsantrag der Klägerin vorzunehmen sind:
A. die folgenden Informationen gemäß R. 262.2, R. 262A als geheimhaltungsbe-dürftig eingestuft werden:
I. die in der Stellungnahme vom 15.08.2025 grau hinterlegten vertraulichen In-formationen sowie die hierzu überreichten und mit dem Hinweis "CONFIDEN-TIAL" oder "vertraulich" versehenen Anlagen, Abbildungen und Übersichten, die insgesamt tabellarisch wie folgt zusammengefasst sind
II. die in der Stellungnahme vom 15.08.2025 gelb hinterlegten und zusätzlich mit rotem Fettdruck umrahmten streng vertraulichen Informationen sowie die
hierzu überreichten und mit dem Hinweis "CONFIDENTIAL" oder "streng ver-traulich" versehenen Anlagen, Abbildungen und Übersichten, die insgesamt ta-bellarisch wie folgt zusammengefasst sind
(STREITIGES) VORBRINGEN DER PARTEIEN
7 Die Klägerin trägt vor, ihre Ausführungen in der Stellungnahme vom 15.08.2025 enthielten
streng vertrauliche Textstellen und Dokumente zu den vertraulichen Lizenzverhandlungen zwischen den Parteien sowie zu den von der Klägerin abgeschlossenen Lizenzverträgen mit Dritten. Die Parteien hätten eine Geheimhaltungsvereinbarung betreffend die geheim-haltungsbedürftigen Informationen abgeschlossen und darin festgelegt, dass der Zugang zu den vertraulichen Informationen betreffend die Verhandlungen zwischen den Parteien jeweils auf 17 Personen und zu den streng vertraulichen Informationen z.B. betreffend die Lizenzverträge auf zwei namentlich benannte Personen der Parteien zu beschränken sei. Diese (streng) geheimhaltungsbedürftigen Informationen seien Geschäftsgeheimnisse und bedürften auch im vorliegenden Prozess einer Geheimhaltung durch die Parteien, ihrer Prozessvertreter, Zeugen, Sachverständigen, sonstiger Vertreter und aller sonstigen Personen.
8 Die Beklagte zu 2) bestätigt, dass die Parteien am 11.07.2025 außergerichtlich eine Eini-
gung darüber erzielt haben, welche Mitarbeiter der Parteien jeweils Zugang zu den ver-traulichen und streng vertraulichen Informationen der Gegenseite erhalten sollen (Con-fidentiality Club). Die Anträge B. und C. der Klägerin in ihrem Geheimhaltungsantrag wür-den den zugangsberechtigten Personenkreis seitens der Beklagten zu 2) zu den vertrau-lichen und streng vertraulichen Informationen zutreffend wiedergeben. Allerdings seien nicht alle Namen der Lizenznehmer der Klägerin streng vertraulich oder vertraulich, da der Abschluss fast aller Verträge öffentlich bekannt sei. Daher sei der Umfang der beantragten Geheimhaltung insoweit zu reduzieren. Die Ausführungen der Klägerin in den Anträgen A.I. und A.II seien zudem unklar und auch insoweit anzupassen. Die Klägerin nehme in den Anträgen A.I. und A.II Bezug auf die von ihr „überreichten und mit dem Hinweis "CON-FIDENTIAL" […] versehenen Anlagen, Abbildungen und Übersichten, [...]“. Der Zusatz „CONFIDENTIAL“ auf Anlagen, Abbildungen und Übersichten solle gemäß Ziffer A.I. „ver-trauliche“ Informationen kennzeichnen und gemäß Ziffer A.II. „streng vertrauliche“ Infor-mationen. Angesichts der gleich lautenden Verwendung des Begriffs bleibe jedoch unklar, in welche Geheimnisschutzkategorie Informationen in den Anlagen, Abbildungen und Übersichten, die mit Zusatz „CONFIDENTIAL“ bezeichnet seien, fallen (bloß vertraulich oder streng vertraulich?). Es obliege der Klägerin für eine klare Zuordenbarkeit zu sorgen. Aus Sicht der Beklagten zu 2) sei der Zusatz „CONFIDENTIAL“ in den Geheimhaltungs-anträgen A.I. und A.II. der Klägerin vom 15.08.2025 daher ersatzlos zu streichen.
9 Da die Anlage K-NT 22 nur mit dem Hinweis „vertraulich“ versehen und unter Ziffer A.I. des Geheimhaltungsantrags der Klägerin als vertrauliche Information eingestuft sei, sei sie nicht auch als streng vertraulich einzustufen. Die Anlage enthalte auch keine gelb hin-terlegten und zusätzlich mit rotem Fettdruck umrahmten streng vertraulichen Informatio-nen.
GRÜNDE DER ANORDNUNG
10 Der Antrag der Klägerin vom 15.08.2025 hat in dem aus der Anordnung ersichtlichen Um-fang Erfolg.
I.
11 Die Anordnung der Vertraulichkeit der Informationen beruht auf Art. 58 EPGÜ i. V. m. Re-gel 262A Abs. 1 VerfO.

12 Gemäß Art. 58 EPGÜ kann das Gericht zum Schutz von Geschäftsgeheimnissen, perso-nenbezogenen Daten oder sonstigen vertraulichen Informationen einer Verfahrenspartei oder eines Dritten oder zur Verhinderung eines Missbrauchs von Beweismitteln anordnen, dass die Erhebung und Verwendung von Beweisen in den von ihm geführten Verfahren eingeschränkt oder für unzulässig erklärt werden oder der Zugang zu solchen Beweismit-teln auf bestimmte Personen beschränkt wird. Nach Regel 262A VerfO kann das Gericht zum Schutz vertraulicher Informationen auf Antrag einer Partei, den Zugriff auf bestimmte in ihren Schriftsätzen enthaltene Informationen oder die Erhebung und Verwendung von Beweisen im Verfahren einschränken oder für unzulässig erklären oder den Zugang zu solchen Informationen oder Beweismitteln auf bestimmte Personen beschränken.
13 Art. 58 EPGÜ i. V. m. Regel 262A VerfO erlauben demnach in Bezug auf Geschäftsge-heimnisse, personenbezogene Daten oder sonstige vertrauliche Informationen die Anord-nung von Verwendungs- und/oder Zugangsbeschränkungen gegenüber einer Partei. Sei-tens des Gerichts kann sowohl die Verwendung der Geschäftsgeheimnisse, der perso-nenbezogenen Daten und der sonstigen vertraulichen Informationen durch die Partei und deren Vertreter als auch der Zugang zu den Informationen auf einen bestimmten Perso-nenkreis beschränkt werden (Berufungsgericht, Anordnung v. 01.08.2025, UPC_CoA_70/2025, UPC_CoA_001/2025 – Strabag/Chainzone). Hinsichtlich der Anord-nung einer Verwendungs- und/oder Zugangsbeschränkung verfügt das Gericht über einen Ermessensspielraum.

14 Ein Geschäftsgeheimnis liegt vor, wenn die in Rede stehenden Informationen a) weder in ihrer Gesamtheit noch in der genauen Anordnung und Zusammensetzung ihrer Bestand-teile den Personen in den Kreisen, die üblicherweise mit dieser Art von Informationen um-gehen, allgemein bekannt oder ohne weiteres zugänglich sind, b) von kommerziellem Wert sind, weil sie geheim sind und c) Gegenstand von den Umständen entsprechenden ange-messenen Geheimhaltungsmaßnahmen durch Personen sind, die die rechtmäßige Kon-trolle über die Informationen besitzt (vgl. Art. 39 Abs. 2 TRIPS Übereinkommen) (Beru-fungsgericht, UPC_CoA_70/2025, UPC_CoA_001/2025, Anordnung v. 01.08.2025 – Strabag/Chainzone).

15 Wird eine Zugangsbeschränkung beantragt, kann das Gericht gem. Regel 262A.5 VerfO dem Antrag insbesondere dann stattgeben, wenn die vom Antragsteller angeführten Gründe für die Anordnung das Interesse der anderen Partei an einem uneingeschränkten Zugang zu den betreffenden Informationen oder Beweismitteln beträchtlich überwiegen.
16 Hierbei ist zu berücksichtigen, dass die Zahl der Personen, auf die der Zugang beschränkt wird, gemäß Regel 262A.6 VerfO nicht größer sein darf als erforderlich, um das Recht der Verfahrensbeteiligten auf einen wirksamen Rechtsbehelf und ein faires Verfahren zu ge-währleisten. Zudem muss der zugangsberechtigte Personenkreis mindestens eine natür-liche Person der Partei und die jeweiligen Rechtsanwälte oder sonstigen Vertreter der Verfahrensbeteiligten umfassen.
17 Ob einer bestimmten Person (uneingeschränkter) Zugang zu den betroffenen Informatio-nen gewährt wird, ist auf der Grundlage der relevanten Umstände des Falles zu entschei-den, einschließlich der Rolle dieser Person im Verfahren vor diesem Gericht, der Relevanz der vertraulichen Informationen für die Wahrnehmung dieser Rolle und der Vertrauens-würdigkeit der Person hinsichtlich der Wahrung der Vertraulichkeit der Informationen (Be-rufungsgericht, Anordnung v. 12.02.2025, UPC_CoA_621/2024, APL_58177/2024 – Da-edalus/Xiaomi; Anordnung v. 03.07.2025, UPC_CoA_221/2025, APL_12280/2025 – NST/Qualcomm).

18 Ausgehend von diesen Grundsätzen erlässt das Gericht in Ausübung seines Ermessens die untenstehenden Anordnungen.
a)
19 Bei den Informationen, die in der Stellungnahme der Klägerin vom 15.08.2025 in der Ein-leitung, Seite 2, 2. Absatz, auf Seite 3 unter „Begründung“ sowie in den Randnummern 2, 4, 5, 8 bis 10 und 15 grau hinterlegt bzw. gelb hinterlegt und zusätzlich mit rotem Fettdruck umrahmt sind, handelt es sich unstreitig um Geschäftsgeheimnisse im oben genannten Sinne. Das Interesse der Klägerin bzw. der Parteien an einer Geheimhaltung dieser Infor-mationen überwiegt auch das Interesse der Öffentlichkeit an einem uneingeschränkten Zugang zu diesen Informationen beträchtlich.
20 Die im Antrag I. der Stellungnahme der Klägerin vom 15.08.2025 in den einzelnen Punkten sowie in Randnummer 3 gelb hinterlegten und rot umrandeten Informationen sind nur in-soweit Geschäftsgeheimnisse, als sie weitergehende Informationen als die Namen der Lizenznehmer enthalten. Die dort aufgeführten Namen der Lizenznehmer der Klägerin sind der Öffentlichkeit bekannt, wie der Vorlageantrag der Beklagten zu 2) vom 24.07.2025 unter Abschnitt II. 1. b) und II. 1. c) belegt. Die Beklagte zu 2) hat demzufolge auch in ihrem, auf den Vorlageantrag bezogenen Geheimnisschutzantrag gem. R. 262A VerfO hinsichtlich der Namen der Lizenznehmer, die sie auch in ihrem Antrag ohne Schwärzun-gen aufgelistet hat, keinen Schutz begehrt. In der ihr hierzu gewährten Stellungnahme hat die Klägerin dies nicht moniert.
21 Soweit die Anträge A. I. und A. II. den Passus enthalten: „die hierzu überreichten und mit dem Hinweis "CONFIDENTIAL" oder "vertraulich" bzw. „streng vertraulich“ versehenen Anlagen, Abbildungen und Übersichten“, ist anzumerken, dass dem Antrag gem. Regel 262A VerfO zur Stellungnahme der Klägerin vom 15.08.2025 lediglich eine Anlage beige-fügt ist. Dies ist die Anlage K-NT 22. Diese Anlage ist mit „vertraulich“ gekennzeichnet, weshalb sie allein Antrag I. zuzuordnen ist. Zudem kann – auf Basis des hier zu entschei-denden Gesuchs – auch nur hinsichtlich der beigefügten Anlage Geheimnisschutz ge-währt werden.
22 Das Gericht geht davon aus, dass die Klägerin in ihrem Antrag durch den genannten Pas-sus bereits Bezug auf Lizenzverträge nehmen will, die gegebenenfalls aufgrund des An-trags auf Vorlage von Lizenzverträgen vorgelegt werden (müssen). Da eine solche Vor-lage derzeit noch nicht erfolgt ist, kann jedoch insoweit noch keine Anordnung erlassen werden. Rein vorsorglich wird darauf hingewiesen, dass das Gericht – ebenso wie die Parteien – davon ausgeht, dass die Lizenzverträge und insbesondere ihr Inhalt Geschäfts-geheimnisse darstellen und insoweit Schutzanordnungen ergehen werden. Der Klägerin obliegt es in diesem Zusammenhang, unmissverständlich anzugeben, welcher etwaig vor-zulegende Lizenzvertrag welche Kategorie von Informationen („vertraulich“ oder „streng vertraulich“) enthält, so dass klar ist, welcher Personenkreis jeweils Zugriff erhalten soll.
b)
23 Die anerkannten Geschäftsgeheimnisse sind, wie von der Klägerin beantragt und mit die-ser Anordnung allen Beteiligten aufgegeben, von jedermann geheim zu halten. Für den weiteren Schutz des Geschäftsgeheimnisses trotz Offenlegung in diesem Verfahren be-darf es einer Geheimhaltung durch die Parteien, ihrer Prozessvertreter, Zeugen, Sachver-ständigen, sonstiger Vertreter oder sonstiger Personen, die an dem Verfahren beteiligt sind.
24 Zum Kreis der zugangsberechtigten Personen gehören vorbehaltlich einer weiteren Zu-gangsbeschränkung (dazu sogleich) auch die mitwirkenden Patentanwälte als Vertreter einer Partei. Weiterhin sind regelmäßig die in den Kanzleien der Rechts- und Patentan-wälte ansässigen Hilfspersonen der Vertreter als zugangsberechtigt anzusehen, weil an-dernfalls eine kanzleigerechte Sachbearbeitung auf Seiten der Vertreter einer Partei kaum zu bewerkstelligen wäre. Allerdings sind die jeweiligen anwaltlichen Vertreter gehalten, die Kanzleimitarbeiter auf ihre Geheimhaltungspflichten hinzuweisen und tragen insofern die arbeitsrechtliche Verantwortlichkeit für Pflichtverletzungen. Schließlich gehören zum Kreis der zugangsberechtigten und zur Geheimhaltung verpflichteten Personen sämtliche Per-sonen, die seitens des Gerichts in den Kontakt mit dem Verfahren gelangen, darunter vom Gericht beauftragte gerichtliche Sachverständige.
25 Im Hinblick auf die weitere Beschränkung des Zugangs zu den in den Tabellen dieser Anordnung genannten Informationen auf jeweils ausgewählte Personen der Beklagten zu 2) folgt das Gericht dem Vorschlag der Klägerin, dem die Beklagte zu 2) nicht entgegen-getreten ist und der unstreitig der zwischen den Parteien geschlossenen Geheimhaltungs-vereinbarung entspricht. Umstände, die gleichwohl gegen die Zugangsberechtigung einer der aufgeführten natürlichen Personen sprechen könnten, sind nicht zu Tage getreten.
26 Die weitergehenden Anordnungen dienen dem effektiven Schutz der Geschäftsgeheim-nisse. Sie entsprechen im Wesentlichen den seitens der Klägerin begehrten Anordnun-gen, denen die Beklagte zu 2) nicht entgegengetreten ist.
II.
1 Eine Entscheidung über die Anträge E und G des Antrags vom 15.08.2025 ergeht derzeit nicht. Ob und in welchem Umfang Geheimnisschutzanordnungen für eine etwaige Zwi-schenanordnung, eine mündliche Verhandlung und/oder eine Urteilsverkündung und/oder Urteilsgründe zu erlassen ist, kann derzeit nicht abschließend beurteilt werden. Eine da-hingehende Anordnung ist im derzeitigen Verfahrensstadium auch noch nicht notwendig. Der Klägerin wird anheimgestellt, ggf. zu gegebener Zeit auf die Anträge zurückzukom-men.
2 Eine Entscheidung über den Antrag F des Antrags vom 15.08.2025 ist in dieser Anordnung ebenfalls nicht angezeigt. Abgesehen davon, dass die Klägerin den Antrag gem. Regel 262.2 VerfO – zu Recht – in einem gesonderten Workflow (App_34961./2025) gestellt hat, wird über einen solchen erst entschieden, wenn ein Mitglied der Öffentlichkeit einen Antrag auf Akteneinsicht gem. R. 262.1 b) VerfO gestellt hat. Dies ist derzeit nicht der Fall.
ANORDNUNG
I. Die folgenden Informationen werden als geheimhaltungsbedürftig eingestuft:
1. die in der Stellungnahme vom 15.08.2025 grau hinterlegten „vertraulichen“ In-formationen zu den Lizenzverträgen und den Lizenzverhandlungen zwischen den Parteien
− in der Einleitung auf Seite 2, 2. Absatz sowie auf Seite 3 unter „Begrün-dung“ und
− in den Randnummern 5, 8 – 10, 15;
2. die Anlage K-NT 22;
3. die in der Stellungnahme vom 15.08.2025 gelb hinterlegten und zusätzlich mit rotem Fettdruck umrahmten „streng vertraulichen“ Informationen zu den Li-zenzverträgen und Lizenznehmern
− in den Randnummern 2 und 4,
− in der Randnummer 3, mit Ausnahme der Namen der Lizenznehmer,
− in Antrag I., mit Ausnahme der Namen der Lizenznehmer.
4. Diese Einstufung bezieht sich auf die Informationen als solche, so dass diese auch dann erfasst sind, wenn sie in weiteren Schriftsätzen oder Anlagen erneut offenbart werden.
II. Die unter Ziffer I. genannten Informationen sind von jedem, der aufgrund seiner Beteiligung an dem vorliegenden Verfahren (als Partei, Vertreter, Zeuge, Sachver-ständiger, Gerichtsbediensteter oder in sonstiger Weise) davon Kenntnis erlangt, vertraulich zu behandeln und dürfen nicht außerhalb dieses Gerichtsverfahrens verwendet oder offengelegt werden, es sei denn, er hat außerhalb des Verfahrens davon Kenntnis erlangt. Diese Verpflichtungen besteht auch nach Abschluss die-ses gerichtlichen Verfahrens fort. Sie endet, wenn das Gericht die Geheimhal-tungsbedürftigkeit dieser Informationen durch rechtskräftige Entscheidung oder Anordnung verneint hat, oder sobald die streitgegenständlichen Informationen für Personen in den Kreisen, die üblicherweise mit solchen Informationen umgehen, bekannt oder ohne Weiteres zugänglich werden.

FACTS
1 The plaintiff is suing the defendants for alleged infringement of the patent in suit. The action is directed against the chips of the ‘Dimensity’ series offered and distributed by the defendants in the UPC Treaty Member States, which are installed in smartphones and tablets from various mobile device manufacturers, among other things. According to the plaintiff, the chips are 5G-capable.
2 Prior to filing the action, the plaintiff negotiated with the first defendant regarding a licence for its portfolio of patents essential for the 4G and 5G standards. The negotiations were unsuccessful. In the statement of claim, the plaintiff referred to these negotiations and commented in advance on a possible antitrust objection by the defendants.
3 On 24 July 2025, the second defendant filed a statement of defence (non-technical part) in which it raised the antitrust compulsory licence objection. At the same time, it filed an application for the submission of licence agreements pursuant to Rule 190 VerfO and a related request pursuant to Rule 262A VerfO. 190 RoP and a related request pursuant to Rule 262A RoP. By order of 1 August 2025, this request for protection of confidential information was essentially granted insofar as it was pending for decision.
4 The plaintiff commented on the application for the submission of licence agreements in its written statement of 15 August 2025, in which it filed a related request pursuant to Rule 262A RoP. In support of its request, it referred, inter alia, to a confidentiality agreement concluded between the parties.
REQUESTS OF THE PARTIES
5 The plaintiff requests that
A. order that the following information be classified as confidential pursuant to R. 262.2, R. 262A:
I. the confidential information highlighted in grey in the statement of 15 August 2025,
as well as the annexes, illustrations and overviews submitted in this regard and marked with the note

6 The second defendant requests that an order be granted pursuant to Rule 262A of the RoP with regard to the plaintiff's submission of 15 August 2025 on the second defendant's request for a preliminary ruling, as requested by the plaintiff, with the following adjustments to the plaintiff's request for confidentiality, highlighted in red:

(CONTROVERSIAL) ARGUMENTS OF THE PARTIES
7 The plaintiff argues that its statements in the statement of 15 August 2025 contained
strictly confidential passages and documents relating to the confidential licence negotiations between the parties and to the licence agreements concluded by the plaintiff with third parties. The parties had concluded a confidentiality agreement regarding the information subject to confidentiality and stipulated therein that access to the confidential information relating to the negotiations between the parties was to be restricted to 17 persons and access to the strictly confidential information, e.g. relating to the licence agreements, to two named persons of the parties. This (strictly) confidential information was trade secrets and must also be kept confidential in the present proceedings by the parties, their legal representatives, witnesses, experts, other representatives and all other persons.
8 The second defendant confirms that on 11 July 2025, the parties reached an out-of-court agreement
regarding which employees of the parties should have access to the confidential and strictly confidential information of the other party (Confidentiality Club). The plaintiff's requests B. and C. in its application for confidentiality accurately reflect the group of persons authorised by the second defendant to access the confidential and strictly confidential information. However, not all of the names of the plaintiff's licensees are strictly confidential or confidential, as the conclusion of almost all contracts is public knowledge. Therefore, the scope of the requested confidentiality should be reduced in this respect. The plaintiff's statements in requests A.I. and A.II are also unclear and must be amended in this respect. In requests A.I. and A.II, the plaintiff refers to the ‘attachments, illustrations and overviews submitted by it and marked “CONFIDENTIAL” [...]’. The addition of ‘CONFIDENTIAL’ on annexes, illustrations and overviews is intended to designate “confidential” information in accordance with section A.I. and ‘strictly confidential’ information in accordance with section A.II. However, given the identical use of the term, it remains unclear which category of confidentiality protection applies to information in the annexes, illustrations and overviews marked with the addition ‘CONFIDENTIAL’ (merely confidential or strictly confidential?). It is incumbent on the plaintiff to ensure clear assignability. In the view of the second defendant, the addition ‘CONFIDENTIAL’ in the plaintiff's confidentiality requests A.I. and A.II. dated 15 August 2025 should therefore be deleted without replacement.
9 Since Annex K-NT 22 is only marked ‘confidential’ and classified as confidential information under point A.I. of the plaintiff's confidentiality request, it should not also be classified as strictly confidential. The annex also does not contain any strictly confidential information highlighted in yellow and additionally framed in red bold type.
REASONS FOR THE ORDER
10 The plaintiff's application dated 15 August 2025 is successful to the extent apparent from the order.
I.
11 The order of confidentiality of the information is based on Art. 58 UPCA in conjunction with Rule 262A(1) RoP.

12 Pursuant to Art. 58 EPGÜ, the court may, in order to protect business secrets, personal data or other confidential information of a party to the proceedings or of a third party, or to prevent the misuse of evidence, order that the taking and use of evidence in the proceedings before it be restricted or declared inadmissible, or that access to such evidence be restricted to certain persons. Under Rule 262A of the RoP, the court may, at the request of a party, restrict or declare inadmissible access to certain information contained in its written pleadings or the taking and use of evidence in the proceedings, or restrict access to such information or evidence to certain persons.
13 Art. 58 UPCA in conjunction with Rule 262A RoP therefore allow restrictions on use and/or access to be imposed on a party in relation to trade secrets, personal data or other confidential information. The court may restrict both the use of trade secrets, personal data and other confidential information by the party and its representatives and access to the information to a specific group of persons (Court of Appeal, order of 1 August 2025, UPC_CoA_70/2025, UPC_CoA_001/2025 – Strabag/Chainzone). The court has discretion to order restrictions on use and/or access.

14 A trade secret exists if the information in question a) is not generally known or readily accessible to persons within the circles that normally deal with this type of information, either in its entirety or in the precise order and composition of its components, (b) has commercial value because it is secret, and (c) is subject to reasonable steps to keep it secret by persons lawfully in control of the information (see Article 39(2) of the TRIPS Agreement). (Court of Appeal, UPC_CoA_70/2025, UPC_CoA_001/2025, order of 1 August 2025 – Strabag/Chainzone).

15 If a restriction on access is requested, the court may, pursuant to Rule 262A.5 of the RoP, grant the request in particular if the reasons given by the applicant for the order significantly outweigh the other party's interest in unrestricted access to the information or evidence in question.
16 In this context, it must be taken into account that the number of persons to whom access is restricted must not exceed what is necessary to ensure the right of the parties to an effective remedy and a fair trial in accordance with Rule 262A.6 RoP. In addition, the group of persons entitled to access must include at least one natural person of the party and the respective lawyers or other representatives of the parties to the proceedings.
17 Whether a specific person is granted (unrestricted) access to the information concerned shall be decided on the basis of the relevant circumstances of the case, including the role of that person in the proceedings before that court, the relevance of the confidential information to the performance of that role and the trustworthiness of the person in terms of preserving the confidentiality of the information (Court of Appeal, order of 12 February 2025, UPC_CoA_621/2024, APL_58177/2024 – Daedalus/Xiaomi; order of 3 July 2025, UPC_CoA_221/2025, APL_12280/2025 – NST/Qualcomm).

18 Based on these principles, the Court, exercising its discretion, issues the following orders.
a)
19 The information contained in the applicant's statement of 15 August 2025 in the introduction, page 2, second paragraph, on page 3 under “Reasons” and in paragraphs 2, 4, 5, 8 to 10 and 15, which are highlighted in grey or yellow and additionally framed in red bold type, are undisputedly trade secrets within the meaning of the above. The interest of the applicant and the parties in keeping this information confidential also significantly outweighs the public interest in unrestricted access to this information.
20 The information highlighted in yellow and framed in red in the individual points of request I of the plaintiff's statement of 15 August 2025 and in margin number 3 is only trade secrets insofar as it contains information beyond the names of the licensees. The names of the plaintiff's licensees listed there are known to the public, as evidenced by the order for reference made by the second defendant on 24 July 2025 in sections II. 1. b) and II. 1. c). Consequently, the second defendant did not seek protection in its request for protection of confidential information pursuant to Rule 262A RoP in relation to the names of the licensees, which it also listed in its request without redactions. The plaintiff did not object to this in its statement granted to it on this point.
21 Insofar as the requests A. I. and A. II. contain the passage: "the annexes submitted for this purpose and marked “CONFIDENTIAL” or “vertraulich” or “streng vertraulich” (strictly confidential), illustrations and overviews‘, it should be noted that, in accordance with Rule 262A RoP, only one annex was attached to the request for the plaintiff's comments dated 15 August 2025. This is Annex K-NT 22. This annex is marked ’confidential", which is why it can only be assigned to Request I. Furthermore, on the basis of the application to be decided here, confidentiality can only be granted with regard to the attached annex.
22 The court assumes that, in its request, the plaintiff already intends to refer to licence agreements which may have to be submitted on the basis of the request for the production of licence agreements. However, as such a submission has not yet been made, no order can be issued in this respect. As a purely precautionary measure, it is pointed out that the court – like the parties – assumes that the licence agreements and, in particular, their content constitute trade secrets and that protective orders will be issued in this respect. In this context, it is incumbent on the plaintiff to indicate unambiguously which category of information (‘confidential’ or ‘strictly confidential’) any licence agreement to be submitted contains, so that it is clear which group of persons is to be granted access in each case.
b)
23 The recognised trade secrets must be kept secret by everyone, as requested by the plaintiff and ordered by this order to all parties involved. For the further protection of the trade secret despite disclosure in these proceedings, confidentiality is required on the part of the parties, their legal representatives, witnesses, experts, other representatives or other persons involved in the proceedings.
24 Subject to further access restrictions (see below), the group of persons authorised to access the information also includes the patent attorneys acting as representatives of a party. Furthermore, the assistants of the representatives employed in the law firms of the legal and patent attorneys are regularly to be regarded as authorised persons, because otherwise it would be virtually impossible for the representatives of a party to handle the case in accordance with the rules of the law firm. However, the respective legal representatives are required to inform the law firm employees of their confidentiality obligations and are therefore responsible under labour law for any breaches of duty. Finally, the group of persons authorised to access the information and bound to secrecy includes all persons who come into contact with the proceedings on behalf of the court, including court-appointed experts.
25 With regard to the further restriction of access to the information listed in the tables of this order to selected persons of the second defendant, the court follows the plaintiff's proposal, to which the second defendant has not objectedand which undisputedly corresponds to the confidentiality agreement concluded between the parties. No circumstances have come to light that could nevertheless preclude one of the natural persons listed from being authorised to access the information.
26 The further orders serve to effectively protect trade secrets. They essentially correspond to the orders sought by the plaintiff, which the second defendant did not oppose.
II.
1 No decision is currently being made on requests E and G of the request dated 15 August 2025. Whether and to what extent orders for the protection of secrets are to be issued for any interim order, oral hearing and/or judgment and/or grounds for judgment cannot be conclusively assessed at this stage. An order to that effect is also not yet necessary at the current stage of the proceedings. The plaintiff is free to return to the requests at the appropriate time.
2 A decision on request F of the request dated 15 August 2025 is also not appropriate in this order. Apart from the fact that the plaintiff has – correctly – submitted the request in a separate workflow pursuant to Rule 262.2 RoP (App_34961./2025), a decision on such a request will only be made once a member of the public has submitted a request for access to the files pursuant to Rule 262.1 b) RoP. This is not currently the case.
ORDER
I. The following information is classified as confidential:
1. the ‘confidential’ information highlighted in grey in the statement of 15 August 2025 regarding the licence agreements and the licence negotiations between the parties

The information referred to in section I must be treated as confidential by anyone who becomes aware of it as a result of their involvement in the present proceedings (as a party, representative, witness, expert, court official or in any other capacity) and may not be used or disclosed outside these court proceedings, unless they have become aware of it outside the proceedings. These obligations shall continue to apply even after the conclusion of these court proceedings. They shall end when the court has denied the confidentiality of this information by means of a final decision or order, or as soon as the information in dispute becomes known or readily accessible to persons within the circles that normally deal with such information.
III. Access to the information classified as confidential in sections I. 1. and 2. shall be restricted on the part of the second defendant to
