GEGENSTAND: R. 104, R. 110 Abs. 1 VerfO – Abschluss des Zwischenverfahrens

ANORDNUNG:
I. Nach vorläufiger Auffassung dürfte es sich bei der relevanten Fachperson um einen Diplom-Ingenieur oder Master der Verpackungstechnik mit einem Abschluss an einer Fachhochschule oder Hochschule für angewandte Wissenschaften und mit mehrjähri-ger Berufserfahrung in der Entwicklung und Konstruktion in der Verpackungstechnolo-gie mit besonderen Kenntnissen auf dem Gebiet von pulpebasierten Faserformverpa-ckungen.
Sollten die Parteien dem nicht beitreten, haben sie in der mündlichen Verhandlung Gelegenheit, ihr abweichendes Verständnis darzulegen.
II. Die Lokalkammer wird in der mündlichen Verhandlung folgende Merkmalsgliederun-gen verwenden:
1. Patentanspruch 1 (englisch):
0. A display and distribution package (2) for eggs.
1. The package is formed of a fibrous material.
2. The package comprises a bottom part (4).
2.1. The bottom part (4) comprises a plurality of egg-receiving compartments (8).
2.1.1. The egg-receiving compartments (8) have non-planar side surfaces so as to match at least partially the outer contours of an egg.
2.1.2. The plurality of compartments (8) are arranged in at least two pa-rallel rows.
2.2. The bottom part (4) comprises a back side (22), a front side (24), two end sides, and at least one upwardly extending retainment projection (26) ex-tending from the front side (24) to the bottom part.
2.2.1. The upwardly extending retainment projection (26) has a down-wardly and outwardly extending nose (28) for locking engage-ment with one or more co-operating apertures (30) in the front surface (12) of the cover part (6).
3. The package comprises a cover part (6).
3.1. The cover part comprises a top surface (10), a front surface (12), a back surface (14), and two substantially planar end surfaces (18).
3.2. The cover part (6) is permanently connected to the bottom part (4) by a hinge (16) between the back surface (14) of the cover part (6) and the bot-tom part (4) so as to allow the cover part (6) to move between an open position and a closed position.
3.3. The cover part (6) comprises partial ovoid portions (20) extending out-wardly from the two substantially planar end surfaces (18),
3.3.1. wherein each of the two substantially planar end surfaces (18) apart from the ovoid portions (20) completely spans the entire end surfaces of the cover part (6).
4. The nose (28) does not extend beyond the front surface (12) of the cover part (6) when the cover part (6) is in its closed position.
5. The cover part (6) is provided with a label (42) covering the top surface (10) and a substantial part of the front surface (12) of the cover part (6).
2. Patentanspruch 1 (deutsche Übersetzung):
0. Sicht- und Lieferverpackung für Eier.
1. Die Verpackung ist aus einem Fasermaterial hergestellt.
2. Die Verpackung umfasst einen Bodenteil (4).
2.1. Der Bodenteil (4) umfasst eine Vielzahl eieraufnehmender Abteile (8).
2.1.1. Die eieraufnehmenden Abteile (8) weisen nicht planare Seitenflä-chen auf, um mindestens teilweise den äußeren Konturen des Eis zu entsprechen.
2.1.2. Die Vielzahl der Abteile (8) ist mindestens in zwei parallelen Rei-hen angeordnet.
2.2. Der Bodenteil (4) umfasst eine Rückseite (22), eine Vorderseite (24), zwei Endseiten und mindestens einen sich nach oben erstreckenden Haltevor-sprung (26), der sich von der Vorderseite (24) des Bodenteils (4) erstreckt.
2.2.1. Der sich nach oben erstreckende Haltevorsprung (26) weist eine sich nach unten und nach außen erstreckende Nase (28) zum Ver-riegelungseingriff mit einer oder mehreren zusammenwirkenden Öffnungen (30) in der Vorderfläche (12) des Abdeckteils (6) auf.
3. Die Verpackung umfasst einen Abdeckteil (6).
3.1. Der Abdeckteil (6) umfasst eine Deckenfläche (10), eine Vorderfläche (12), eine Rückenfläche (14) und zwei im Wesentlichen planare Endflä-chen (18).
3.2. Der Abdeckteil (6) ist mit einem Scharnier (16) zwischen der Rückfläche (14) des Abdeckteils (6) und dem Bodenteil (4) dauerhaft verbunden, um es dem Abdeckteil (6) zu erlauben, sich zwischen einer offenen Stellung und einer geschlossenen Stellung zu bewegen.
3.3. Der Abdeckteil (6) umfasst teilweise eiförmige Abschnitte (20), die sich von den beiden im Wesentlichen planaren Endflächen (18) nach außen erstrecken,
3.3.1. wobei jede der beiden im Wesentlichen planaren Endflächen (18) abgesehen von den eifömigen Abschnitten (20) die ge-samte Oberfläche des Abdeckteils (6) völlig überspannt.
4. Die Nase (28) erstreckt sich nicht über die Vorderfläche (12) des Abdeckteils (6) hinaus, wenn sich der Abdeckteil (6) in seiner geschlossenen Stellung befindet.
5. Der Abdeckteil (6) ist mit einem Etikett (42) versehen, das die Deckenfläche (10) und einen wesentlichen Teil der Vorderfläche (12) des Abdeckteils (6) (be-)deckt.
3. Patentanspruch 6 (englisch):
0. A method of manufacturing an egg package (2) by suction moulding of a fibrous material.
1. The package (2) comprises a bottom part (4).
1.1. The bottom part (4) comprises a plurality of egg receiving compartments (8).
1.1.1. The egg receiving compartments (8) have non-planar side surfaces so as to match at least partially the outer contours of an egg.
1.1.2. The plurality of compartments (8) is formed in at least two parallel rows.
1.2. The bottom part (4) comprises a back side (22), a front side (24), two end sides, and an upwardly extending retainment projection (26) extending from the front side (24) of the bottom part (4).
1.2.1. The upwardly extending retainment projection (26) has a down-wardly and outwardly extending nose (28) for locking engage-ment with a co-operating aperture (30) in the front surface (12) of the cover part (6).
1.2.2. The nose (28) does not extend beyond the front surface (12) of the cover part (6) when the cover part (6) is in its closed position.
2. The package (2) comprises a cover part (6).
2.1. The cover part (6) comprises a top surface (10), a front surface (12), a back surface (14), and two end surfaces (18).
2.2. The cover part (6) is permanently connected to the bottom part (4) by a hinge (6) between the back surface (14) of the cover part (6) and the bot-tom part (4) so as to allow the cover part (6) to move between an open position and a closed position.
2.3. The cover part (6) is provided with a label (42) covering the top surface (10) and a substantial part of the front surface (12) of the cover part (6).
3. Placing said retainment projection (26) and co-operating aperture (30) relative to each other during moulding of the egg package (2) in a moulding form, such that deformations in the cover part (6) during manufacture are compensated for.
4. Removing the egg package (2) from the form.
5. Drying said egg package (2) in an oven.
4. Patentanspruch 6 (deutsche Übersetzung):
0. Verfahren zur Herstellung einer Eierverpackung (2) durch Saugformen des Faser-materials.
1. Die Verpackung umfasst einen Bodenteil (4).
1.1. Der Bodenteil (4) umfasst eine Vielzahl eieraufnehmender Abteile (8).
1.1.1. Die eieraufnehmenden Abteile (8) weisen nicht planare Seitenflä-chen auf, um mindestens teilweise den äußeren Konturen des Eis zu entsprechen.
1.1.2. Die Vielzahl der Abteile (8) ist mindestens in zwei parallelen Rei-hen angeordnet.
1.2. Der Bodenteil (4) umfasst eine Rückseite (22), eine Vorderseite (24), zwei Endseiten und mindestens einen sich nach oben erstreckenden Haltevor-sprung (26), der sich von der Vorderseite des Bodenteils erstreckt.
1.2.1. Der sich nach oben erstreckende Haltevorsprung (26) weist eine sich nach unten und nach außen erstreckende Nase (28) zum Ver-riegelungseingriff mit einer oder mehreren zusammenwirkenden Öffnungen (30) in der Vorderfläche (12) des Abdeckteils auf.
1.2.2. Die Nase (28) erstreckt sich nicht über die Vorderfläche (12) des Abdeckteils (6) hinaus, wenn sich der Abdeckteil (6) in seiner ge-schlossenen Stellung befindet.
2. Die Verpackung umfasst einen Abdeckteil (6).
2.1. Der Abdeckteil (6) umfasst eine Deckenfläche (10), eine Vorderfläche (12), eine Rückfläche (14) und zwei im wesentlichen planare Endflächen (18).
2.2. Der Abdeckteil (6) ist dauerhaft mit dem Bodenteil (4) durch ein Scharnier (16) zwischen der Rückfläche (14) des Abdeckteils (6) und dem Bodenteil (4) verbunden, um es dem Abdeckteil (6) zu erlauben, sich zwischen einer offenen Stellung und einer geschlossenen Stellung zu bewegen.
2.3. Der Abdeckteil (6) ist mit einem Etikett (42) versehen, das die Deckenfläche (10) und einen wesentlichen Teil der Vorderfläche (12) des Abdeckteils (6) bedeckt.
3. Platzieren des Haltevorsprungs (26) und der zusammenwirkenden Öffnung (30) relativ zueinander während des Formens der Eierverpackung (2) in einer Gießform derart, dass Verformungen in dem Abdeckteil (6) während der Herstellung ausge-glichen werden.
4. Entfernen der Eierverpackung (2) aus der Form.
5. Trocknen der Eierverpackung (2) in einem Ofen.
III. Zur Vorbereitung der mündlichen Verhandlung ergehen folgende Hinweise und Aufla-gen:
1. Der durch die Klägerin unter Ziff. II.3. ihrer Anträge formulierte Rückrufantrag dürfte unbestimmt sein.
2. Ihre Forderung nach einem vorläufigen Schadenersatz in Höhe von 11.000,- EUR hat die Klägerin damit begründet, die Höhe des Betrages solle zumindest die vo-raussichtlichen Kosten für das Schadenersatzverfahren abdecken. Es steht zu vermuten, dass sie damit eine Festgebühr nach R. 132 VerfO i.V.m. Abschnitt I. der Gebührentabelle geltend machen will.
Vor diesem Hintergrund wird darauf hingewiesen, dass die Gebührentabelle für ein solches Schadenersatzverfahren lediglich eine Festgebühr in Höhe von 3.000,- EUR vorsieht (vgl. UPC_CFI_16/2024 (LK Düsseldorf), Entscheidung v. 14.01.2025, S. 44 – Ortovox v. Mammut).
3. Merkmal 3. der vorstehend eingeblendeten Merkmalsgliederung verlangt ein „Platzieren des Haltevorsprungs (26) und der zusammenwirkenden Öffnung (30) relativ zueinander während des Formens der Eierverpackung (2) in einer Gieß-form derart, dass Verformungen in dem Abdeckteil (6) während der Herstellung ausgeglichen werden.“
Vor diesem Hintergrund soll sich die Klägerin darauf vorbereiten, in der mündli-chen Verhandlung ausgehend von ihrem Verständnis der durch das Streitpatent unter Schutz gestellten technischen Lehre zu erläutern,
a) wie sie das geforderte „Platzieren des Haltevorsprungs und der zu-sammenwirkenden Öffnung relativ zueinander in einer Gießform derart, dass Verformungen in dem Abdeckteil während der Herstel-lung ausgeglichen werden“, versteht
und
b) woran sich aus ihrer Sicht feststellen lässt, dass bei einem zur Her-stellung von Eierverpackungen eingesetzten Verfahren ein solches Platzieren im vorgenannten Sinne erfolgt.
4. Den Parteien wird aufgeben, etwaige Skizzen oder Unterlagen, auf die sie sich in der mündlichen Verhandlung gegebenenfalls zur Erläuterung beziehen möchten, die aber bisher noch nicht zur Akte gereicht worden sind, im CMS hochzuladen.
5. Für die Erfüllung der Auflagen wird den Parteien eine Frist bis zum 28. August 2025 gesetzt.
Der Upload ist unter Nutzung der mit dieser Verfahrensanordnung eröffneten Uploadmöglichkeit vorzunehmen. Im Interesse einer effektiven Verfahrensfüh-rung wird auf Beklagtenseite lediglich der Beklagten zu 1) eine Uploadmöglich-keit eingeräumt. Dort ist bei Bedarf eine Stellungnahme für beide Beklagten hochzuladen.
Soweit von der Möglichkeit des Uploads kein Gebrauch gemacht werden soll, wird den Parteien aufgegeben, dies im CMS durch die Auswahl der entsprechen-den Option anzuzeigen.
IV. Von der Durchführung einer Zwischenverhandlung wird abgesehen.
V. Mit Ablauf der unter Ziff. III. 5. genannten Frist ist das Zwischenverfahren abgeschlos-sen.
Mit dem Einstellen dieser Anordnung in das CMS erfolgt die Mitteilung des Abschlusses des Zwischenverfahrens an die Parteien. Zugleich wird das Verfahren nunmehr durch den bisherigen Berichterstatter in seiner Funktion als Vorsitzender betreut (R. 110 VerfO).
VI. Der Vorsitzende wird zu Beginn der mündlichen Verhandlung in den Sach- und Streit-stand einführen. Sodann werden die Parteien Gelegenheit erhalten, ihre Plädoyers auf dieser Grundlage in einer Sitzungsunterbrechung vorzubereiten.
Von der Festsetzung zeitlicher Begrenzungen (R. 113.1 S. 2 VerfO) wird zunächst abge-sehen. Auf R. 113.3 VerfO wird hingewiesen.

3. Positioning the retaining projection (26) and the cooperating opening (30) relative to each other during the moulding of the egg packaging (2) in a mould in such a way that deformations in the cover part (6) are compensated for during manufacture.

4. Removing the egg packaging (2) from the mould.
5. Drying the egg packaging (2) in an oven.
III. The following instructions and requirements are issued in preparation for the oral hearing:
1. The request for recall formulated by the plaintiff in point II.3. of its claims is likely to be vague.

2. The plaintiff has justified its claim for provisional damages in the amount of EUR 11,000 on the grounds that the amount should at least cover the anticipated costs of the damages proceedings. It can be assumed that it intends to claim a fixed fee in accordance with Rule 132 VerfO in conjunction with Section I of the schedule of fees.

Against this background, it should be noted that the fee table for such damages proceedings only provides for a fixed fee of EUR 3,000 (see UPC_CFI_16/2024 (LK Düsseldorf), decision of 14 January 2025, p. 44 – Ortovox v. Mammut).

3. Feature 3 of the feature breakdown shown above requires ‘the placing of the retaining projection (26) and the cooperating opening (30) relative to each other during the forming of the egg package (2) in a mould in such a way that deformations in the cover part (6) are compensated for during manufacture.’

Against this background, the plaintiff should prepare to explain in the oral hearing, based on its understanding of the technical teaching protected by the contested patent,

a) how it understands the required ‘placement of the retaining projection and the cooperating opening relative to each other in a mould in such a way that deformations in the cover part are compensated for during manufacture’,
and

b) how, in its view, it can be determined that such placement in the aforementioned sense takes place in a process used to manufacture egg packaging.
4. The parties are requested to upload to the CMS any sketches or documents to which they may wish to refer for clarification during the oral hearing but which have not yet been submitted to the file.

5. The parties are given until 28 August 2025 to comply with the requirements.
The upload must be made using the upload option provided in this procedural order. In the interests of effective proceedings, only the first defendant will be granted an upload option on the defendant's side. If necessary, a statement for both defendants must be uploaded there.
If the upload option is not to be used, the parties are requested to indicate this in the CMS by selecting the appropriate option.

IV. No interim hearing will be held.
V. Upon expiry of the period specified in section III. 5, the interim proceedings shall be concluded.

The parties shall be notified of the conclusion of the interim proceedings when this order is posted in the CMS. At the same time, the proceedings will now be supervised by the previous rapporteur in his capacity as chair (R. 110 VerfO).

VI. At the beginning of the oral hearing, the presiding judge will introduce the facts and the state of the dispute. The parties will then be given the opportunity to prepare their pleadings on this basis during an adjournment of the hearing.

The setting of time limits (R. 113.1 sentence 2 VerfO) will be dispensed with for the time being. Reference is made to R. 113.3 VerfO.
