GEGENSTAND: R. 36 VerfO – Antrag auf Zulassung eines weiteren Schriftsatzes
GRÜNDE DER ANORDNUNG:
1. Gemäß R. 36 VerfO kann der Berichterstatter auf einen mit einer Begründung versehenen Antrag einer Partei, eingereicht vor dem Tag, an dem der Berichterstatter das schriftliche Verfahren abschließen möchte, den Austausch weiterer Schriftsätze innerhalb einer festzu-setzenden Frist zulassen (vgl. dazu: UPC_CFI_16/2024 (LK Düsseldorf), Anordnung v. 30. Ok-tober 2024 – Ortovox v. Mammut; UPC_CFI_11/2024 (LK Düsseldorf), Anordnung v. 26. Feb-ruar 2025 – Grundfos v. Hefei; UPC_CFI_115/2024 (LK Düsseldorf), Anordnung v. 4. März 2025 – Hartmann v. Omni-Pac).
2. Die Klägerin hat vor Abschluss des schriftlichen Verfahrens und damit rechtzeitig einen An-trag auf Zulassung eines weiteren Schriftsatzes gestellt. Der Antrag der Klägerin ist auch mit einer Begründung versehen. Sie hat ausgeführt, es sei angezeigt, dass jede Partei des Verlet-zungsverfahrens die Gelegenheit zu zwei Schriftsätzen betreffend den erstmals mit der Kla-geerwiderung erhobenen FRAND-Einwand der Beklagten erhalte. Sie hat ferner darauf ver-wiesen, dass die „FRAND-Replik“ der Beklagten – gemeint ist die Duplik (rechtlicher Teil) im Verletzungsverfahren vom 27. Dezember 2024 – neuen Vortrag enthalte, diese beispiels-weise zur Begründung einer marktbeherrschenden Stellung der Klägerin erstmals auf „Diensteanbieter“ abstellten.
3. In Ausübung des nach R. 36 VerfO eingeräumten Ermessens erscheint die Zulassung eines weiteren Schriftsatzes der Klägerin zum FRAND-Einwand aus Gründen der Fairness, der Bil-ligkeit und der Effizienz sowie des Rechts auf rechtliches Gehör geboten (vgl. dazu CoA_520/2024, Anordnung v. 1. November 2024 – Scandit v. Hand Held). Die Beklagten wer-den hierdurch nicht benachteiligt. Eine Verzögerung des Verfahrens ist mit der Zulassung nicht verbunden. Vor verspätetem Vorbringen sind die Beklagten zudem durch R. 9.2 VerfO ausreichend geschützt.
4. Die Klägerin hat bereits mit Antragstellung nach R. 36 VerfO den begehrten weiteren Schrift-satz zum FRAND-Einwand eingereicht. Ein erneuter Upload ist nicht erforderlich.
ANORDNUNG:
1. Auf ihren Antrag vom 27. Januar 2025 wird der Klägerin eingeräumt, bis zum 14. Au-gust 2025 einen Schriftsatz zum FRAND-Einwand der Beklagten einzureichen.
2. Mit Ablauf der Frist gilt das schriftliche Verfahren als abgeschlossen, R. 36 S. 2 VerfO.

SUBJECT: R. 36 RoP – Request for admission of a further written statement
REASONS FOR THE ORDER:
1. Pursuant to R. 36 RoP, the rapporteur may, upon a reasoned request by a party submitted before the date on which the rapporteur intends to close the written proceedings, allow the exchange of further written submissions within a period to be determined (see: UPC_CFI_16/2024 (LK Düsseldorf), Order of 30 October 2024 – Ortovox v. Mammut; UPC_CFI_11/2024 (LK Düsseldorf), order of 26 February 2025 – Grundfos v. Hefei; UPC_CFI_115/2024 (LK Düsseldorf), order of 4 March 2025 – Hartmann v. Omni-Pac).
2. Before the conclusion of the written proceedings and thus in good time, the plaintiff filed a request for leave to file a further written statement. The plaintiff's request is also accompanied by a statement of reasons. It argued that it was appropriate for each party to the infringement proceedings to have the opportunity to submit two written statements on the FRAND objection raised by the defendant for the first time in its statement of defence. It further pointed out that the defendant's ‘FRAND reply’ – meaning the rejoinder (legal part) in the infringement proceedings of 27 December 2024 – contained new arguments, for example, for the first time referring to ‘service providers’ to justify the plaintiff's dominant position.
3. In exercising the discretion granted under Rule 36 RoP, the admission of a further written submission by the plaintiff on the FRAND objection appears necessary for reasons of fairness, equity and efficiency, as well as the right to a fair hearing (see CoA_520/2024, order of 1 November 2024 – Scandit v. Hand Held). This does not disadvantage the defendants. The admission does not entail any delay in the proceedings. Furthermore, the defendants are sufficiently protected against late submissions by Rule 9.2 RoP.
4. The plaintiff has already submitted the requested further statement on the FRAND objection in accordance with R. 36 RoP. A new upload is not necessary.
ORDER:
1. Upon its request of 27 January 2025, the plaintiff is granted until 14 August 2025 to submit a written statement on the defendants' FRAND objection.
2. Upon expiry of the time limit, the written proceedings shall be deemed closed, R. 36 p. 2 RoP.
