GEGENSTAND: Verletzungsklage – Kostenfestsetzung

KURZE ZUSAMMENFASSUNG DES SACHVERHALTS:
Die Beklagten haben während des laufenden Verletzungsrechtsstreits im Wege eines Antrags gem. R. 9.1 VerfO Kostenfestsetzung für bezifferte anwaltliche Vertretungskosten beantragt, die ihnen in einem Berufungsverfahren der Klägerinnen gegen die Anordnung der Leistung einer Prozesskostensicherheit für den Rechtsstreit nach ihrem Vortrag entstanden sind.

In dem Berufungsverfahren hatte das Berufungsgericht die Berufungsrücknahme der Klägerinnen mit Zustimmung der Beklagten zugelassen und den Klägerinnen die Kosten des Berufungsverfahrens gem. R. 265.2 VerfO auferlegt.
Die Klägerinnen widersprechen dem Antrag auf Kostenfestsetzung. Die Parteien streiten insbesondere darüber, ob die für die Berufungserwiderung geltend gemachten Rechtsanwaltskosten veranlasst waren, nachdem die Klägerinnen am 11.11.2024 die Berufungsrücknahme erklärt und die Beklagten dieser am 15.11.2024 zugestimmt hatten. Die Berufungserwiderungsfrist lief am 19.11.2024 ab. Die Beklagten, die am Tag des Fristablaufs ihre Berufungserwiderung eingereicht hatten, behaupten, sie hätten erst am 20.11.2024 über das CMS Kenntnis von der am 19.11.2024 durch das Berufungsgericht erfolgten Zulassung der Berufungsrücknahme erlangt.

GRÜNDE FÜR DIE ANORDNUNG:
Der Antrag ist unzulässig. Im Fall seiner Zulässigkeit ist er durch die Kostengrundentscheidung des Spruchkörpers in seiner Entscheidung vom 06.06.2025 über die Verletzungs- und Nichtigkeitswiderklage gegenstandslos geworden.
1. Der Antrag ist unzulässig.
Für Kosten, welche für die Beantragung, Bekämpfung oder Verteidigung von verfahrensleitenden Anordnungen, zu denen auch Anordnungen zur Prozesskostensicherheit gem. R. 158 VerfO gehören, entstanden sind, findet ein gesondertes Kostenfestsetzungsverfahren nach R. 150 VerfO nicht statt. Vielmehr werden diese ggf. in dem der Sachentscheidung nachfolgenden Kostenfestsetzungsverfahren gem. R. 150 VerfO als Teil der insgesamten Verfahrenskosten mit festgesetzt.
Der Antrag ist nicht als vorgezogener Teil eines späteren Kostenfestsetzungsverfahren zulässig. Die Verfahrensordnung sieht die Kostenfestsetzung als gesondertes Verfahren vor, das der Sachentscheidung und ggf. einer Entscheidung über die Festsetzung von Schadensersatz nachfolgt (R. 150 VerfO). Damit ist eine vorgezogene Einreichung eines Teils der Kosten unvereinbar. Eine solche Vorgehensweise würde zudem zur Zersplitterung des Verfahrensgegenstands des Kostenfestsetzungsverfahrens und seiner Grundlagen führen.
2. Jedenfalls ist der Antrag der Sache nach gegenstandslos geworden.
a) Grundlage für die Kostenfestsetzung ist die Kostengrundentscheidung in der Sachentscheidung, R. 150, 118.5 VerfO.
Bei der Kostengrundentscheidung gem. Art. 69 (1) bis (3) EPGÜ, R. 118.5 VerfO steht dem Gericht ein pflichtgemäßes Ermessen zu. Es kann entweder über die gesamten Kosten des Verfahrens einheitlich mit einer globalen Quote entscheiden oder Kosten für einzelne Vorkommnisse während des Verfahrens, etwa für einzelne Angriffs- oder Verteidigungsmittel oder verfahrensleitende Anordnung, etwa für einen Antrag auf Prozesskostensicherheit, gesondert ausscheiden. In diesem Fall ist das Gericht bei der Verteilung der ausgeschiedenen Kosten an Vorgaben zur Kostenverteilung gebunden, die das Berufungsgericht in einem Berufungsverfahren betreffend den Verfahrensgegenstand, für den diese Kosten angefallen sind, gemacht hat. Solche Vorgaben zwingen das erstinstanzliche Gericht indes nicht, von einer einheitlichen Kostenentscheidung abzusehen und Kosten auszuscheiden.
b) Im Streitfall hat sich der Spruchkörper gegen eine Kostengrundentscheidung entschieden, die die Kosten, die für einzelne verfahrensleitende Anordnungen und deren Bekämpfung oder Verteidigung durch die Parteien entstanden sind, ausscheidet und gesondert verteilt. Vielmehr hat er eine einheitliche Kostengrundentscheidung getroffen. Dabei hat er es in Anbetracht des wechselseitigen Unterliegens für angemessen und geboten erachtet, dass die Klägerinnen die Gerichtskosten der Verletzungsklage und die Beklagten die Gerichtskosten der Nichtigkeitswiderklage und die Parteien ihre außergerichtlichen Kosten selbst tragen (vgl. Entscheidung vom 06.06.2025, UPC_CFI_471/2023, Rn. 174). Eine Veranlassung zur weiteren Aufschlüsselung, welche Partei in den zahlreichen Widerspruchs- und Rechtsbehelfsverfahren gegen verfahrensleitende Anordnungen mit welchem (wechselndem) Erfolg vorgegangen ist, und zur entsprechenden Verteilung dieser Kosten hat er offenkundig nicht gesehen.
c) Da die Kostengrundentscheidung nicht vorsieht, einzelne Kosten auszuscheiden, ist der vorliegende Kostenfestsetzungsantrag der Beklagten gegenstandslos geworden.

ANORDNUNG
Der Antrag der Beklagten auf Kostenfestsetzung vom 16.12.2024 (App_66435/2024) wird zurückgewiesen.

SUBJECT MATTER: Infringement action – determination of costs

BRIEF SUMMARY OF THE FACTS:
During the ongoing infringement proceedings, the defendants filed a request pursuant to Rule 9.1 RoP for a determination of costs for quantified legal representation costs incurred by them in appeal proceedings brought by the plaintiffs against the order to provide security for the costs of the proceedings.


In the appeal proceedings, the Court of Appeal had allowed the plaintiffs to withdraw their appeal with the consent of the defendants and had imposed the costs of the appeal proceedings on the plaintiffs pursuant to Rule 265.2 RoP.

The plaintiffs object to the request for a determination of costs. The parties dispute in particular whether the legal fees claimed for the response to the appeal were incurred after the plaintiffs had declared the withdrawal of the appeal on 11 November 2024 and the defendants had agreed to this on 15 November 2024. The deadline for responding to the appeal expired on 19 November 2024. The defendants, who had submitted their response to the appeal on the day the deadline expired, claim that they only became aware of the appeal court's approval of the withdrawal of the appeal on 19 November 2024 via the CMS on 20 November 2024.

REASONS FOR THE ORDER:
The request is inadmissible. If it were admissible, it would have become moot as a result of the decision on costs issued by the court in its decision of 6 June 2025 on the counterclaim for infringement and annulment.
1. The application is inadmissible.

No separate proceedings for the determination of costs pursuant to Rule 150 of the Rules of Procedure shall be held for costs incurred in connection with the application for, opposition to or defence of procedural orders, including orders for security for costs pursuant to Rule 158 of the Rules of Procedure. Rather, these will be determined as part of the total costs of the proceedings in the proceedings for the determination of costs pursuant to R. 150 RoP following the decision on the merits.
The request is not admissible as an advance part of subsequent proceedings for the determination of costs. The Rules of Procedure provide for the determination of costs as a separate procedure following the decision on the merits and, where applicable, a decision on the determination of damages (R. 150 VerfO). This is incompatible with the advance submission of part of the costs. Such an approach would also lead to a fragmentation of the subject matter of the cost determination proceedings and its basis.

2. In any case, the request has become moot.
a) The basis for the determination of costs is the decision on the costs in the decision on the merits, Rule 150, 118.5 RoP.
In the decision on the costs pursuant to Art. 69 (1) to (3) UPCA, R. 118.5 RoP, the court has discretionary power. It may either decide on the entire costs of the proceedings uniformly with a global quota or separately allocate costs for individual events during the proceedings, such as for individual means of attack or defence or procedural orders, such as for an application for security for legal costs. In this case, when allocating the costs that have been apportioned, the court is bound by the guidelines on the allocation of costs laid down by the court of appeal in appeal proceedings concerning the subject matter of the proceedings for which these costs were incurred. However, such guidelines do not oblige the court of first instance to refrain from making a uniform decision on costs and to apportion costs.

b) In the case in dispute, the panel ruled against a decision on the basis of costs which excluded and separately allocated the costs incurred by the parties for individual procedural orders and their challenge or defence. Instead, it made a uniform decision on the basis of costs. In view of the mutual defeat, it considered it appropriate and necessary that the plaintiffs bear the court costs of the infringement action and the defendants bear the court costs of the counterclaim for annulment and that the parties bear their own extrajudicial costs (see decision of 6 June 2025, UPC_CFI_471/2023, para. 174). It clearly saw no reason to further break down which party had taken action in the numerous opposition and appeal proceedings against procedural orders with what (varying) success and to allocate those costs accordingly.

c) Since the decision on costs does not provide for the separation of individual costs, the defendant's application for a determination of costs has become moot.

ORDER
The defendant's application for a determination of costs dated 16 December 2024 (App_66435/2024) is dismissed.
