GEGENSTAND: R. 354 VerfO – Androhung von Zwangsmitteln

KURZE DARSTELLUNG DES SACHVERHALTS:
1. Mit einer Anordnung vom 10. Juli 2025 hat die Lokalkammer Düsseldorf der Antragsgegnerin
auf Antrag der Antragstellerin unter anderem aufgegeben,
A.I. es zu unterlassen,
spanabhebende Werkzeuge eines chirurgischen, Drehmoment übertragenden Instru-ments mit einem distalen Eingriffssegment, an das sich ein Werkzeugschaft anschließt, dessen proximaler Endabschnitt für ein Drehmoment übertragendes Einsetzen in eine Werkzeugaufnahme des Instruments vorbereitet ist, wofür der proximale Endab-schnitt zumindest in einen Funktionsabschnitt "Drehmoment-Übertragung" und einen axial hiervon beabstandeten Funktionsabschnitt "Axialverriegelung" (6b) unterteilt ist, wobei sich der Funktionsabschnitt "Axialverriegelung" (6b) bezüglich des Eingriffsseg-ments proximal zum Funktionsabschnitt "Drehmoment-Übertragung" anordnet, mit einem weiteren Funktionsabschnitt "Eindrehhilfe" vorzugsweise als Bestandteil des Funktionsabschnitts "Drehmoment-Übertragung",
in der Bundesrepublik Deutschland und/oder Frankreich anzubieten, in Verkehr zu bringen oder zu gebrauchen und/oder zu diesen Zwecken einzuführen oder zu besit-zen,
bei denen der Funktionsabschnitt "Eindrehhilfe" axial zwischen den Funktionsabschnit-ten "Drehmoment-Übertragung" und "Axialverriegelung" vorzugsweise im Bereich ei-nes Radialabsatzes zwischen den Funktionsabschnitten, „Drehmoment-Übertragung" und "Axialverriegelung" vorgesehen ist; und dass der Funktionsabschnitt "Drehmo-ment-Übertragung" mit einem Zweiflach ausgebildet ist, dessen zwei diametral vonei-nander abgewandte Angriffsebenen vorzugsweise keilförmig in Richtung Funktionsab-schnitt "Axialverriegelung" aufeinander zulaufen, und der Funktionsabschnitt "Ein-drehhilfe" eine Anzahl, vorzugsweise vier, keilförmig ausgerichtete Abgleitebenen hat, von denen jeweils zwei Abgleitflächen zu beiden Längsseiten jeweils einer Angriffs-ebene in einem Winkel zu dieser ausgebildet sind und dabei die Längskanten der je-weiligen Angriffsebene zumindest axialabschnittsweise brechen;

III. der Antragstellerin schriftlich und in elektronischer Form, die mit Hilfe eines Compu-ters ausgewertet werden kann, in einer für jeden Monat eines Kalenderjahres und nach patentverletzenden Erzeugnissen strukturierten Aufstellung ab dem 11. Juli 2018, Auskunft über die unter Nr. I. genannten Erzeugnisse zu erteilen, über
1. den Ursprung und die Vertriebswege der unter Nr. I. genannten Erzeugnisse un-ter Angabe
a) der Namen und Anschriften der Hersteller, Lieferanten und anderer Vorbe-sitzer;
b) der Namen und Anschriften der gewerblichen Abnehmer sowie der Ver-kaufsstellen, für die die Erzeugnisse bestimmt waren;
c) der einzelnen Angebote, aufgeschlüsselt nach Angebotsmengen, -zeiten, -preisen sowie Typenbezeichnung und Namen und Anschriften der ge-werblichen Angebotsempfänger;
d) der einzelnen Lieferungen, aufgeschlüsselt nach Liefermengen, -zeiten und -preisen sowie Typenbezeichnungen und Namen und Anschriften der Ab-nehmer;
2. die Identität aller an der Herstellung und dem Vertrieb der unter Nr. I. genannten Erzeugnisse beteiligten dritten Personen.
2. Die Antragsgegnerin wurde ausweislich des Activities Log im CMS am selben Tag über die ohne Sicherheitsleistung vollstreckbare Anordnung informiert.
3. Mit anwaltlichem Schriftsatz vom 21. Juli 2025 (App_33098/2025) hat die Antragstellerin ihre Absicht mitgeteilt, die am 10. Juli 2025 ergangene Anordnung der Lokalkammer Düssel-dorf in vollem Umfang zu vollstrecken. Zugleich hat sie die Antragsgegnerin aufgefordert, der Antragstellerin die Auskunft gemäß der Anordnung innerhalb eines Monats ab Zustellung der Mitteilung der Vollstreckungsabsicht vollständig zu erteilen. Ergänzend dazu hat die An-tragstellerin die Androhung eines Zwangsgeldes für den Fall des Verzuges bzw. der Nichtbe-folgung der Anordnung beantragt.
4. Den letztgenannten Antrag hat die Antragstellerin auf Bitten der Sub-Registry der Lokalkam-mer Düsseldorf noch einmal im vorliegenden Workflow eingereicht.
5. Über den die Mitteilung der Vollstreckungsabsicht enthaltenden Schriftsatz wurde die An-tragsgegnerin ausweislich des Activities Log im CMS noch am Tag des Eingangs informiert.
6. Von der ihr mit einer vorläufigen Verfahrensanordnung vom 22. Juli 2025 eingeräumten Möglichkeit zur Stellungnahme hat die Antragsgegnerin keinen Gebrauch gemacht.

ANTRÄGE DER PARTEIEN:
7. Die Antragstellerin beantragt:
Die Antragsgegnerin wird, unter Androhung an das Gericht zahlbarer wiederholter Zwangsgelder in Höhe von bis zu EUR 30.000,00 für jeden Tag des Verzugs und/oder Nichtbefolgung, dazu verpflichtet, innerhalb einer Frist von einem (1) Monat ab Zustel-lung der Mitteilung der Vollstreckungsabsicht, der Antragstellerin die Auskünfte ge-mäß Anordnung A.III. der Anordnung der Lokalkammer Düsseldorf vom 10.07.2025, UPC_CFI_213/2025 zu erteilen.

GRÜNDER DER ANORDNUNG:
8. Der Antrag der Antragstellerin hat in der Sache im tenorierten Umfang Erfolg.
9. Gemäß R. 354 Abs. 3 VerfO können Entscheidungen und Anordnungen des Gerichts für den Fall, dass eine Partei sich nicht an die Bestimmungen der Anordnung oder einer früheren Anordnung hält, an das Gericht zahlbare, wiederholte Zwangsgeldzahlungen vorsehen. Der Betrag dieser Zahlungen ist im Hinblick auf die Bedeutung der in Rede stehenden Anordnung vom Gericht festzusetzen (UPC_CoA_845/2024, APL_68523/2024, Anordnung v. 30.05.2025, Rz. 31 – Belkin v. Philips).
10. Nach R. 118 Abs. 8 Satz 1 VerfO sind die in R. 118 Abs. 1 VerfO genannten Anordnungen gegen den Beklagten erst vollstreckbar, nachdem der Kläger dem Gericht mitgeteilt hat, wel-chen Teil der Anordnungen er zu vollstrecken beabsichtigt, nachdem der Kläger gemäß R. 7 Abs. 2 VerfO gegebenenfalls eine beglaubigte Übersetzung der Anordnungen in die Amts-sprache des Vertragsmitgliedstaates, in dem die Vollstreckung erfolgen soll, eingereicht hat und nachdem die Mitteilung und gegebenenfalls die beglaubigte Übersetzung dem Beklag-ten von der Kanzlei zugestellt wurde (UPC_CoA_845/2024, APL_68523/2024, Anordnung v. 30.05.2025, Rz. 35 – Belkin v. Philips).
11. Eine solche Mitteilung ihrer (umfassenden) Vollstreckungsabsicht hat die Antragstellerin mit anwaltlichem Schriftsatz vom 21. Juli 2025 zur Akte gereicht, wobei die Antragsgegnerin noch am selben Tag über diese Vollstreckungsabsicht benachrichtigt wurde.
12. Da eine Anordnung nach Art. 67 Abs. 1 EPGÜ einen die Verhältnismäßigkeit wahrenden An-trag verlangt, muss die (ab der Mitteilung nach R. 118 Abs. 8 Satz 1 VerfO laufende) Frist in einem entsprechenden Antrag des Klägers (bzw. des Antragstellers) enthalten sein. Die Frist ist damit in jedem Fall bereits in der Entscheidung in der Hauptsache zu setzen. Damit wird bezweckt, dass der Beklagte (bzw. Antragsgegner) Klarheit darüber hat, welche Frist ihm zur Verfügung steht.
13. Erfolgt – wie hier – keine Fristsetzung in der Endentscheidung bzw. Anordnung, ist es Sache des Klägers (bzw. Antragstellers), mit der Mitteilung der Vollstreckungsabsicht dem Beklag-ten (bzw. Antragsgegner) auch eine Frist für die Auskunftserteilung zu setzen. Dies ist hier geschehen. Mit der Mitteilung ihrer Vollstreckungsabsicht hat die Antragstellerin die An-tragsgegnerin aufgefordert, die Auskunft binnen eines Monats ab Zustellung der Mitteilung der Vollstreckungsabsicht zu erteilen (so auch: UPC_CoA_845/2024, APL_68523/2024, An-ordnung v. 30.05.2025, Rz. 39 – Belkin v. Philips). Nachdem Boijn nach dem unbestritten gebliebenen Vortrag der Antragstellerin ganz am Anfang der Aktivitäten mit den streitgegen-ständlichen Fräsern in Deutschland bzw. Europa steht (vgl. UPC_CFI_213/2025 (LK Düssel-dorf), Anordnung v. 10. Juli 2025, Rz. 115 – Aesculap v. Shanhai International), erscheint diese Frist auch unter Berücksichtigung des Verhältnismäßigkeitsgrundsatzes angemessen, um die geschuldeten Informationen zu übermitteln.
14. Für die antragstellerseitig begehrte Verpflichtung zur Auskunftserteilung unter gleichzeitiger Fristsetzung besteht davon ausgehend weder Raum noch Notwendigkeit. Die Verpflichtung zur Auskunftserteilung findet sich bereits in der Anordnung vom 10. Juli 2025 (dort unter Ziffer A. III). Die Fristsetzung ist schon durch die Antragstellerin erfolgt.
15. Erfolgreich ist der Antrag der Antragstellerin allerdings, soweit die Antragstellerin zusätzlich die Androhung von Zwangsgeldern begehrt.
16. Auch wenn es einer solchen Androhung zumindest nach einer durch die Lokalkammer Mann-heim vertretenen Auffassung vor der Verhängung von Zwangsmitteln nicht zwingend bedarf (UPC_CFI_365/2023, Anordnung v. 23. Juli 2025, S. 6 – Fujifilm v. Kodak), wird eine derartige Androhung zumindest in der Literatur teilweise gefordert (vgl. Tilmann/v. Falck/Stoll, Ein-heitspatent, R. 354 Rz. 75; Kircher, Handbuch, 3. Aufl., § 27 Rz. 49). Nachdem die Frage der Notwendigkeit einer solchen Androhung bisher nicht durch das Berufungsgericht geklärt wurde, hat die Antragstellerin vor diesem Hintergrund jedenfalls im vorliegenden Eilverfah-ren ein berechtigtes Interesse an einer solchen Androhung, um die mit der begehrten Aus-kunft angestrebte Aufklärung der Herkunft und der Vertriebswege der angegriffenen Aus-führungsform möglichst schnell und effektiv durchzusetzen und dieses Ziel nicht durch die ansonsten – je nach vertretener Auffassung – möglicherweise drohende spätere Forderung nach einer vorgelagerten Androhung zu gefährden.
17. Die Festsetzung einer Höchstgrenze pro Tag gibt der Lokalkammer die notwendige Flexibili-
tät, um im Fall einer Zuwiderhandlung auch das Verhalten der Antragsgegnerin zu berück-
sichtigen und davon ausgehend gemäß R. 354 Abs. 4 VerfO ein angemessenes Zwangsgeld
festsetzen zu können (vgl. dazu: UPC_CFI_213/2025 (LK Düsseldorf), Anordnung v. 10. Juli
2025, Rz. 115 – Aesculap v. Shanhai International; UPC_CFI_452/2023 (LK Düsseldorf), An-
ordnung v. 11.12.2023, S. 9 – Ortovox v. Mammut).

ANORDNUNG:
Der Antragsgegnerin wird, unter Zurückweisung des weitergehenden Antrages, für den Fall
der nicht ordnungsgemäßen Erfüllung der Verpflichtung zur Auskunftserteilung gemäß Ziffer
A.III. der Anordnung vom 10. Juli 2025 ein an das Gericht zahlbares, ggf. wiederholtes
Zwangsgeld in Höhe von bis zu 30.000,- EUR für jeden Tag des Verzugs und/oder der Nicht-
befolgung der Anordnung, beginnend einen Monat ab Zustellung der Vollstreckungsabsicht
der Antragstellerin, angedroht.

BRIEF STATEMENT OF THE FACTS:
1. By order of 10 July 2025, the Local Division of Düsseldorf ordered the respondent
, at the request of the applicant, inter alia, to

A.I. to refrain from
cutting tools of a surgical, torque-transmitting instrument with a distal engagement segment connected to a tool shank, the proximal end section of which is prepared for torque-transmitting insertion into a tool holder of the instrument, for which the proximal end section is divided at least into a functional section ‘torque transmission’ and an axially spaced functional section ‘axial locking’ (6b), wherein the functional section ‘axial locking’ (6b) being arranged with respect to the engagement segment proximally to the functional section ‘torque transmission’ with a further functional section ‘screw-in aid’ preferably as a component of the functional section ‘torque transmission’,

in the Federal Republic of Germany and/or France, to put them into circulation or to use them and/or to import them or possess them for these purposes,

in which the functional section ‘turning aid’ is provided axially between the functional sections ‘torque transmission’ and ‘axial locking’, preferably in the area of a radial shoulder between the functional sections ‘torque transmission’ and ‘axial locking’; and that the functional section ‘torque transmission’ is designed with a double flat surface, the two diametrically opposed engagement planes of which preferably run towards each other in a wedge shape in the direction of the functional section ‘axial locking’, and the functional section has a number, preferably four, of wedge-shaped sliding planes, two of which are formed as sliding surfaces on both longitudinal sides of an engagement plane at an angle to the latter, thereby breaking the longitudinal edges of the respective engagement plane at least in axial sections;

III. to provide the applicant in writing and in electronic form, which can be evaluated with the aid of a computer, in a list structured for each month of a calendar year and according to patent-infringing products, starting on 11 July 2018, information on the products mentioned under No. I. regarding

1. the origin and distribution channels of the products referred to in No. I, stating
a) the names and addresses of the manufacturers, suppliers and other previous owners;
b) the names and addresses of the commercial purchasers and the points of sale for which the products were intended;

c) the individual offers, broken down by offer quantities, times, prices and type designations and the names and addresses of the commercial recipients of the offers;
d) the individual deliveries, broken down by delivery quantities, times and prices as well as type designations and the names and addresses of the recipients;

2. the identity of all third parties involved in the manufacture and distribution of the products referred to in No. I.
2. According to the activity log in the CMS, the respondent was informed on the same day of the order, which was enforceable without security.

3. In a letter from its lawyer dated 21 July 2025 (App_33098/2025), the applicant announced its intention to enforce the order issued by the Local Division of the Düsseldorf Local Division on 10 July 2025 in its entirety. At the same time, it requested the respondent to provide the applicant with the information in accordance with the order within one month of delivery of the notification of the intention to enforce. In addition, the applicant requested the imposition of a penalty payment in the event of default or non-compliance with the order.

4. At the request of the Düsseldorf Local Chamber Sub-Registry, the applicant resubmitted the latter request in the present workflow.
5. According to the activities log in the CMS, the respondent was informed of the written statement containing the notice of enforcement on the day of receipt.

6. The respondent did not make use of the opportunity to comment granted to it in a preliminary procedural order dated 22 July 2025.

Requests of the parties:
7. The applicant requests:
The respondent is ordered, under penalty of repeated penalty payments payable to the court of up to EUR 30,000.00 for each day of delay and/or non-compliance, to provide the applicant with the information requested in accordance with order A.III. of the order of the Local Court of Düsseldorf dated 10.06.2025 within a period of one month from delivery of the notice of intent to enforce.

FOUNDER OF THE ORDER:
8. The applicant's request is successful in substance to the extent set out in the operative part.
9. Pursuant to Rule 354(3) RoP, decisions and orders of the Court may provide for repeated penalty payments payable to the Court in the event that a party fails to comply with the provisions of the order or an earlier order. The amount of these payments shall be determined by the court in view of the importance of the order in question (UPC_CoA_845/2024, APL_68523/2024, order of 30 May 2025, para. 31 – Belkin v. Philips).

10. According to Rule 118(8) sentence 1 RoP, the orders referred to in Rule 118(1) RoP are enforceable against the defendant only after the claimant has informed the court which part of the orders it intends to enforce, after the claimant has submitted, where applicable, a certified translation of the orders into the official language of the Contracting Member State in which enforcement is to take place in accordance with Rule 7(2) RoP, and after the defendant has made a statement on the order for payment. 7(2) RoP, and after the notification and, where applicable, the certified translation have been served on the defendant by the registry (UPC_CoA_845/2024, order of 30 May 2025, para. 35 – Belkin v. 11. The applicant submitted such notification of its (comprehensive) intention to enforce to the file by way of a letter from its lawyer dated 21 July 2025, whereby the respondent was notified of this intention to enforce on the same day.

12. Since an order under Article 67(1) UPCA requires an application that is proportionate, the time limit (running from the notification under Rule 118(8) sentence 1 RoP) must be included in a corresponding application by the claimant (or applicant). The time limit must therefore be set in the decision on the main issue in any case. The purpose of this is to ensure that the defendant (or respondent) is clear about the time limit available to him.

13. If, as in the present case, no time limit is set in the final decision or order, it is for the claimant (or applicant) to set a time limit for the defendant (or respondent) to provide the information when notifying the defendant (or respondent) of its intention to enforce the decision. This has been done in the present case. By notifying its intention to enforce, the applicant requested the respondent to provide the information within one month of service of the notification of its intention to enforce (see also: UPC_CoA_845/2024, APL_68523/2024, order of 30 May 2025, para. 39 – Belkin v. Philips). According to the applicant's uncontested submission, Boijn is at the very beginning of its activities with the milling cutters at issue in Germany and Europe (see UPC_CFI_213/2025 (LK Düsseldorf), order of 10 July 2025, para. 115 – Aesculap v. Shanhai International), this period also appears reasonable, taking into account the principle of proportionality, for the information owed to be provided.
14. On this basis, there is neither room nor necessity for the obligation to provide information with a simultaneous setting of a deadline as requested by the applicant. The obligation to provide information is already contained in the order of 10 July 2025 (under section A. III). The deadline has already been set by the applicant.
15. However, the applicant's application is successful insofar as the applicant additionally seeks the imposition of penalty payments.

16. Even if such a threat is not absolutely necessary before coercive measures are imposed, at least according to an opinion represented by the Local Division in Mannheim (UPC_CFI_365/2023, order of 23 July 2025, p. 6 – Fujifilm v. Kodak), such a threat is required at least in part in the literature (see Tilmann/v. Falck/Stoll, Einheitspatent, para. 354, marginal no. 75; Kircher, Handbuch, 3rd ed., § 27, marginal no. 49). Since the question of the necessity of such a warning has not yet been clarified by the Court of Appeal, the applicant has, in any case, a legitimate interest in such a warning in the present summary proceedings in order to obtain the information sought regarding the origin and distribution channels of the contestedand not to jeopardise this objective by the otherwise – depending on the opinion held – potentially imminent subsequent demand for a prior warning.
17. The setting of a maximum limit per day gives the Local Division the necessary flexibility

to take into account the conduct of the respondent in the event of an infringement
and, on that basis, to be able to set an appropriate penalty payment in accordance with Rule 354(4) RoP

ORDER:
The respondent is ordered, with the rejection of the further request, in the event of
non-proper fulfilment of the obligation to provide information in accordance with Section
A.III. of the order of 10 July 2025, to pay to the court, if necessary repeatedly,
of up to EUR 30,000 for each day of delay and/or non-compliance with the order, beginning one month after delivery of the applicant's intention to enforce the order.

DETAILS OF THE ORDER:
