Regel 262.1 (b) VerfO – Antrag auf Zugang zum Register/Akte
SACHVERHALT
1 Die Klägerin nahm die Beklagten wegen Verletzung des Streitpatents gerichtlich in Anspruch (ACT_24735/2024 UPC_CFI_208/2024). Die Beklagten wandten unter anderem die mangelnde Rechtsbeständigkeit des Streitpatents ein und erhoben Widerklage auf Nichtigerklärung (CC_49779/2024 UPC_CFI_504/2024). Die Klägerin stellte einen Antrag auf Änderung des Patents (App_654111/2024). Mit Entscheidungen vom 07.01.2025 wurde die Rücknahme der Klage und die Rücknahme der Widerklage zugelassen. Das Verfahren ist beendet.
2 Die Klägerin warf der Antragstellerin außergerichtlich eine Verletzung des Streitpatents vor.
3 Die Antragstellerin hat einen Antrag auf Akteneinsicht bzw. Zugang zum Register gem. Regel 262.1 (b) VerfO gestellt, zu dem die Parteien Gelegenheit zur Stellungnahme erhalten haben.
ANTRÄGE
4 Die Antragstellerin beantragt,
den Zugang zum Register und zur Akte, einschließlich aller Schriftsätze und Beweismittel in den drei vor die Lokalkammer München gebrachten Verfahren in Bezug auf das Streitpatent ACT_24735/2024 UPC_CFI_208/2024, CC_49779/2024 UPC_CFI_504/2024 und App_654111/2024 UPC_CFI_504/2024, einschließlich, aber nicht beschränkt auf:
− Klageschrift
− Klageerwiderung
− Widerklage auf Nichtigerklärung
− Alle unterstützenden Beweismittel
− Gutachten
− Schriftliche Beweismittel
− Alle Entscheidungen und Anordnungen
5 Die Beklagten beantragen,
den Antrag abzuweisen soweit er über den Zugang zu den nachfolgend aufgeführten Schriftsätzen hinausgeht:

STREITPUNKTE DER PARTEIEN
6 Die Antragstellerin ist der Ansicht, sie habe ein berechtigtes Interesse, Zugang zu
diesen Akten zu erhalten, um die früheren rechtlichen und technischen Argumente der Klägerin, ihre Standpunkte zur Auslegung der Ansprüche, zur Gültigkeit des Streitpatents und zu allen beantragten oder verteidigten Änderungen in Bezug auf das Streitpatent zu prüfen. Darüber hinaus seien die Verfahren beendet, so dass die Integrität der Verfahren nicht mehr in Rede stehe. Die Antragstellerin erklärte zudem, bereit zu sein, angemessene Schwärzungen oder Vertraulichkeitsmaßnahmen zu akzeptieren, die das Gericht anordne.
7 Die Beklagten erheben keine Einwände dagegen, der Antragstellerin die in ihrem
Antrag genannten Schriftsätze der Verfahrensakte zugänglich zu machen. Im Übrigen sei der Antrag abzulehnen. Die Antragstellerin habe kein legitimes Interesse dargetan (und es sei auch sonst kein legitimes Interesse ersichtlich), das den Zugang zu den weiteren Teilen der Verfahrensakte rechtfertige.
8 Selbst wenn man dies anders sehen wollte, wäre der Zugang jedenfalls auf die von den Parteien vorgelegten nicht-vertraulichen (geschwärzten) Fassungen der Schriftsätze zu beschränken. Dies gelte insbesondere für den Vortrag der Parteien im Kontext des FRAND-Einwands (Klageerwiderung 2 (nicht-technischer Teil) vom 02.09.2024 sowie der Replik (FRAND) vom 11.12.2024. In Anbetracht der Begründung der Antragstellerin für den Zugang, die sich auf die rechtlichen und technischen Argumente der Klägerin im Zusammenhang mit der Verletzung und dem Rechtsbestand des Streitpatents beziehe, sei ein Zugang zu den genannten Schriftsätzen nicht erforderlich und allenfalls in den jeweils geschwärzten Fassungen zu gewähren.
9 Bezüglich der darüberhinausgehenden Teile der Verfahrensakte, insbesondere der gestellten Anträgen nach R. 190.1, 191, 262.2 sowie 262A EPG-VerfO sowie der Schriftsätze zu prozessualen Einzelfragen, scheide ein Zugang von vornherein aus, weil sich der Antrag der Antragstellerin nur auf die Aktenzeichen der Hauptakte und ein bestimmtes beigeordnetes Aktenzeichen beziehe. Unabhängig davon sei aber auch hier ein legitimes Interesse der Antragstellerin, das den Zugang zu diesen Teilen der Verfahrensakten rechtfertigen würde, aus den vorstehend genannten Gründen nicht dargetan oder erkennbar. Auch hier überwögen die Vertraulichkeitsinteressen der Parteien. Jedenfalls wäre der Zugang auf die nicht-vertraulichen (geschwärzten) Fassungen nebst der nicht-vertraulichen Anlagen zu beschränken. Dies gelte auch dann, wenn insoweit gestellte Geheimhaltungsanträge vor Beendigung des Verfahrens nicht beschieden worden seien.
10 Die Klägerin macht sich die Stellungnahme und Ausführungen der Beklagten
vollumfänglich zu eigen.
GRÜNDE FÜR DIE ANORDNUNG
11 Der Antrag ist zulässig und hat in der Sache im Wesentlichen Erfolg. Die Antragstellerin kann gemäß Regel 262.1 (b) VerfO im tenorierten Umfang Zugang zu Schriftsätzen und Beweismitteln des Verfahrens verlangen.

12 Die Antragstellerin hat als Mitglied der Öffentlichkeit einen begründeten Antrag im Sinne von Regel 262.1 (b) VerfO gestellt.
a)
13 Ein begründeter Antrag in diesem Sinne ist ein Antrag, in dem nicht nur angegeben wird, zu welchen Schriftsätzen und Beweismitteln Zugang begehrt wird, sondern der auch den Zweck des Antrags angibt und erläutert, warum der Zugang zu den angegebenen Dokumenten für diesen Zweck erforderlich ist, und der somit alle Informationen bereitstellt, die der Berichterstatter benötigt, um die erforderliche Interessenabwägung vorzunehmen (Berufungsgericht, Anordnung v. 10.04.2024, UPC_CoA_404/2023 – Ocado/Autostore; Anordnung v. 09.01.2025, UPC_CoA_480/2024, Powell Gilbert/Abbott; Lokalkammer Düsseldorf, Anordnung v. 17.06.2025, UPC_CFI_177/2023 – Slavik/MyStromer; Lokalkammer München, Anordnung v. 22.07.2025, UPC_CFI_439/2023 – Bardehle/Nokia).

14 Der Antrag der Antragstellerin genügt diesen Anforderungen. Abgesehen davon, dass sie auf den von der Klägerin außergerichtlich erhobenen Verletzungsvorwurf betreffend das Streitpatent abgestellt hat, ist das Verfahren bereits beendet. Letzteres führt dazu, dass regelmäßig eine geringere Begründungstiefe genügt. Ein allgemeines Interesse für eine Einsichtnahme reicht bereits aus, wohingegen ein Antragsteller besonderer Gründe bedarf, wenn er während eines laufenden Verfahrens Einsicht in die Schriftsätze nehmen möchte (vgl. 15 Der Antrag hat überwiegend Erfolg. Soweit die Antragstellerin in der Spezifizierung ihres Antrags auch Entscheidungen und Anordnungen des Gerichts aufgeführt hat, ist dem allerdings nicht zu entsprechend. Diese sind nicht Gegenstand der Regel 262.1 (b) VerfO.

16 Für eine Entscheidung über einen Antrag nach Regel. 262.1 (b) VerfO sind die Interessen eines Mitglieds der Öffentlichkeit, Zugang zu den beantragten Unterlagen zu erhalten, gegen die in Art. 45 EPGÜ genannten Interessen abzuwägen. Zu diesen Interessen gehört der Schutz vertraulicher Informationen und personenbezogener Daten („die Interessen einer der Parteien oder sonstiger Betroffener“), sie sind jedoch nicht darauf beschränkt. Auch die allgemeinen Interessen der Justiz und der öffentlichen Ordnung sind zu berücksichtigen. Das allgemeine Interesse der Justiz umfasst den Schutz der Integrität von Verfahren. Die öffentliche Ordnung ist z.B. gefährdet, wenn ein Antrag missbräuchlich ist oder wenn Sicherheitsinteressen auf dem Spiel stehen (Berufungsgericht, Anordnung v. 10.04.2024, UPC_CoA_404/2023 – Ocado/Autostore; Anordnung v. 09.01.2025, UPC_CoA_480/2024, Powell Gilbert/Abbott; Anordnung vom 25.04.2025, UPC_CoA_5/2025 – Nicoventures/Juul Labs; Lokalkammer Düsseldorf, Anordnung v. 17.06.2025, UPC_CFI_177/2023 – Slavik/MyStromer; Lokalkammer München, Anordnung v. 20.12.2024, UPC_CFI_342/2024 – Phoenix Contact/I.L.M.E.; Lokalkammer München, Anordnung v. 22.07.2025, UPC_CFI_439/2023 – Bardehle/Nokia).
17 Sobald das Gericht eine das Verfahren in erster Instanz abschließende Entscheidung oder Anordnung getroffen hat, hat die Öffentlichkeit in der Regel ein Interesse daran, dass Schriftsätze und Beweismittel zugänglich gemacht werden. Dies ermöglicht ein besseres Verständnis der ergangenen Entscheidung im Hinblick auf die von den Parteien vorgebrachten Argumente und die herangezogenen Beweise. Es ermöglicht auch die Kontrolle des Gerichts, was für das Vertrauen der Öffentlichkeit in das Gericht wichtig ist (Berufungsgericht, Anordnung v. 10.04.2024, UPC_CoA_404/2023 – Ocado/Autostore; Anordnung v. 09.01.2025, UPC_CoA_480/2024, Powell Gilbert/Abbott; Lokalkammer Düsseldorf, Anordnung v. 17.06.2025, UPC_CFI_177/2023 – Slavik/MyStromer; Lokalkammer München, Anordnung v. 20.12.2024, UPC_CFI_342/2024 – Phoenix Contact/I.L.M.E.; Zentralkammer Paris, Anordnung v. 14.10.2024, UPC_CFI_255/2023 – Meril/Edwards; Lokalkammer München, Anordnung v. 22.07.2025, UPC_CFI_439/2023 – Bardehle/Nokia).

18 Die in Anwendung dieser Grundsätze vorzunehmende Interessenabwägung ergibt, dass der Antragstellerin der begehrte Zugang zu den Schriftsätzen und Beweismitteln im tenorierten Umfang zu gewähren ist.
19 Nachdem das Verletzungs- und Nichtigkeitswiderklageverfahren zwischen der Klägerin und den Beklagten vollständig beendet ist, hat die Antragstellerin ein allgemeines Interesse an der Gewährung des Zugangs zu den Schriftsätzen und Beweismitteln, welches die in Art. 45 EPGÜ genannten Interessen überwiegt. Auf dieses allgemeine Interesse hat sich die Antragstellerin auch berufen. Anhaltspunkte, die zugunsten einer Verweigerung oder grundsätzlichen Einschränkung des Zugangs sprechen könnten, sind nicht ersichtlich. Insbesondere ist der Antrag nicht aus missbräuchlichen Erwägungen heraus gestellt worden. Auch die Parteien haben den Zugang zum Register für die Antragstellerin als solches nicht in Abrede gestellt.
20 Von dem anzuerkennenden allgemeinen Interesse am Zugang zu den Schriftsätzen und Beweismitteln des Verletzungs- und Nichtigkeitswiderklageverfahrens sind die Schriftsätze und Beweismittel mit ihrem vollständigen Inhalt erfasst, soweit nicht eine der Parteien des Verfahrens bezüglich einzelner in den Schriftsätzen enthaltenen Informationen einen Antrag auf Vertraulichkeit nach Regel 262.2 VerfO gestellt hat.
Daher sind der Antragstellerin die Schriftsätze – vorbehaltlich des Vertrauensschutzes – grundsätzlich mit allen Inhalten einschließlich des nicht-technischen Vortrages zugänglich zu machen.
21 Ob die Schriftsätze und Beweismittel eines Verfahrens in gesonderten Workflows eingereicht worden sind, ist grundsätzlich unbeachtlich. Die gesonderten Workflows sind allein dem CMS geschuldet. Das Bereitstellen von Workflows seitens des CMS ändert jedoch nichts daran, dass die Schriftsätze und Beweismittel Bestandteile des Verfahrens sind. Da die Antragstellerin keine weiteren Antragsnummern genannt und in der Spezifizierung ihres Antrags lediglich stichwortartig auf Beweise bzw. Beweismittel Bezug genommen hat, versteht das Gericht den Antrag allerdings dahingehend, dass von diesem nur die Anträge der Beklagten gem. Regeln 190.1, 191 VerfO (App_44881/2024, App_44882/2024) umfasst sein sollen.
c)
22 Zugang zu den Schriftsätzen und Beweismitteln des Verletzungs- und Nichtigkeitswiderklageverfahrens kann vorliegend nicht uneingeschränkt gewährt werden. Da die Antragstellerin ihren Antrag allein auf Regel 262.1 (b) VerfO stützt, sind Anträge auf Vertraulichkeit gemäß Regel 262.2 VerfO zu berücksichtigen. Zudem ist gemäß Art. 45 EPGÜ und Regel 262.1 VerfO den Grundsätzen der Verordnung (EU) 2016/679 Rechnung zu tragen.
23 In dem Verfahren, in das die Antragstellerin Einsicht zu nehmen begehrt, haben die Parteien bei Einreichung ihrer Schriftsätze und Anlagen hinsichtlich zahlreicher Informationen gemäß Regel 262.2 VerfO beantragt, sie vertraulich zu behandeln. Die Vertraulichkeit dieser Informationen stellt auch die Antragstellerin nicht in Frage. Ein Antrag nach Regel 262.3 VerfO ist nicht gestellt. Aus diesem Grund kann Zugang nur zu den von den Parteien zu ihren Schriftsätzen und Anlagen eingereichten redigierten Fassungen gewährt werden, in denen die vertraulichen Informationen geschwärzt sind.
24 Das gilt auch, soweit nach Auffassung der Parteien Anträge auf Vertraulichkeit noch nicht beschieden wurden. Nach der Konzeption von Regel 262 VerfO und des CMS sind Schriftsätze und Beweismittel gemäß Regel 262.1 (b) VerfO nur auf Antrag zugänglich zu machen. Haben die Parteien des Verfahrens zuvor oder innerhalb der 14-tägigen Frist nach Regel 262.2 S. 2 VerfO einen Antrag auf Vertraulichkeit gestellt, werden die betroffenen Informationen von der Akteneinsicht ausgenommen, es sei denn, der Einsichtsuchende stellt einen Antrag nach Regel 262.3 VerfO. Da ein solcher Antrag vorliegend nicht gestellt ist, sind von vornherein nur die geschwärzten Fassungen („redacted version“/“redacted for public“) der Antragstellerin zugänglich zu machen. Etwas anderes hat auch die Antragstellerin nicht geltend gemacht.
25 In diesen redigierten Fassungen der Schriftsätze und Beweismittel sind zudem die personenbezogenen Daten im Sinne der Verordnung (EU) 2016/679 zu schwärzen.

26 Was die praktische Umsetzung der Akteneinsicht angeht, sollen der Antragstellerin zunächst nur die Schriftsätze der Parteien ohne die Anlagen zur Verfügung gestellt werden. Die Schwärzung der personenbezogenen Daten ist mit einem gewissen personellen und zeitlichen Aufwand verbunden, der eine zeitnahe Bereitstellung aller Anlagen ausschließt, zumal Akteneinsichtsgesuche in zweistelliger Zahl anhängig sind. Die Antragstellerin mag nach Erhalt der Schriftsätze der Kanzlei mitteilen, welche
Anlagen für sie nach Lektüre der Schriftsätze im Einzelnen noch von Interesse sind. Insofern kann davon ausgegangen werden, dass die Antragstellerin anhand der Schriftsätze sämtliche Anlagen identifizieren kann und ihr bereits einzelne Anlagen zur Verfügung stehen oder sie unschwer aus anderen Quellen erlangt werden können. Sollte die Antragstellerin an ihrem ursprünglichen Antrag vollumfänglich festhalten, wird dies nicht beanstandet. Allerdings ist dann mit einer längeren Bearbeitungszeit allein aufgrund der Prüfung der Vorgaben der Verordnung (EU) 2016/ 679 zu rechnen.
27 Um sicherzustellen, dass an die Antragstellerin keine vertraulichen Informationen gelangen, wird der Ansatz anderer Lokalkammern aufgegriffen (Lokalkammer Mannheim, Anordnung v. 26.03.2025, UPC_CFI_210/2023 – Ampersand/Panasonic; Lokalkammer Düsseldorf, Anordnung v. 09.04.2025, UPC_CFI_135/2024 – Epson/Dolby) und den Parteien aufgeben, dem Gericht die Schriftsätze und Beweismittel, zu denen der Antragstellerin Zugang gewährt wird, in ihrer redigierten, um vertrauliche Informationen bereinigten Fassung zur Verfügung zu stellen. Die Kanzlei wird den Parteien dafür einen geschützten Datenraum zur Verfügung stellen, in den die Dateien hochgeladen werden können. Zum Schutz der vertraulichen Informationen dürfte es auch im Interesse der Parteien liegen, wenn sie diese Schriftsätze und Beweismittel, soweit Zugang gewährt wird, in der jeweils teilweise geschwärzten Fassung zusammenstellen und zur Verfügung stellen.

28 Mit dieser Anordnung werden sämtliche Anträge der Antragstellerin (App_30187/2025, App_30190/2025 und App_30191/2025) beschieden. Zwecks Reduzierung der Workflows wird die Anordnung nur in dem Workflow App_30187/2025 hochgeladen. Die anderen Workflows werden, sobald möglich, geschlossen.

2. In den Schriftsätzen und Beweismitteln enthaltene personenbezogene Daten im Sinne der Verordnung (EU) 2016/678 sind zu schwärzen.

Aufgrund des mit der Schwärzung der personenbezogenen Daten verbundenen personellen und zeitlichen Aufwands sollen der Antragstellerin zunächst nur die Schriftsätze ohne Anlagen bereitgestellt werden. Nach Erhalt der Schriftsätze mag die Antragstellerin per Email an die Kanzlei (Contact_Munich.Loc@unifiedpatentcourt.org) die Anlagen zu den Schriftsätzen abrufen, derer sie dann noch bedarf. Hierbei sind die Anlagen konkret zu bezeichen.
ANWEISUNG AN DIE KANZLEI
Der Antragstellerin ist zu den in der vorstehenden Anordnung genannten Schriftsätzen und Beweismitteln der Klägerin und der Beklagten in dem Verfahren ACT_24735/2024 UPC_CFI_208/2024, CC_49779/2024 UPC_CFI_504/2024 einschließlich App_ 65411/2024 UPC_CFI_504/2024, App_44881/2024 und App_44882/2024 Zugang zu gewähren. Es sind zunächst die Schriftsätze ohne Anlagen bereitzustellen und im Nachgang auf konkreten Abruf der Antragstellerin die dann noch von ihr verlangten Anlagen. In den Schriftsätzen und Beweismitteln enthaltene personenbezogene Daten im Sinne der Verordnung (EU) 2016/678 sind zu schwärzen.

Rule 262.1 (b) RoP – Request for access to the register/file
FACTS
1 The plaintiff brought legal action against the defendants for infringement of the patent in suit (ACT_24735/2024 UPC_CFI_208/2024). The defendants, among other things, asserted that the patent in suit lacked legal validity and filed a counterclaim for a declaration of invalidity (CC_49779/2024 UPC_CFI_504/2024). The plaintiff filed an application for amendment of the patent (App_654111/2024). By decisions of 7 January 2025, the withdrawal of the action and the withdrawal of the counterclaim were allowed. The proceedings are closed.
2 The plaintiff accused the applicant out of court of infringing the patent in suit.
3 The applicant filed a request for inspection of the files and access to the register pursuant to Rule 262.1 (b) RoP, on which the parties were given the opportunity to comment.

ISSUES IN DISPUTE BETWEEN THE PARTIES
6 The applicant is of the opinion it has a legitimate interest in obtaining access to
these files in order to examine the applicant's previous legal and technical arguments, its views on the interpretation of the claims, on the validity of the patent in suit and on all amendments requested or defended in relation to the patent in suit. Furthermore, the proceedings have been concluded, so that the integrity of the proceedings is no longer at issue. The applicant also stated that it was prepared to accept any redactions or confidentiality measures ordered by the Court.
7 The defendants do not object to granting the applicant access to the documents in the case file referred to in its
application. In all other respects, the application should be dismissed. The applicant has not demonstrated any legitimate interest (nor is any legitimate interest apparent) that would justify access to the other parts of the case file.
8 Even if one were to take a different view, access would in any case have to be limited to the non-confidential (redacted) versions of the pleadings submitted by the parties. This applies in particular to the parties' submissions in the context of the FRAND objection (statement of defence 2 (non-technical part) of 2 September 2024 and the reply (FRAND) of 11 December 2024. In view of the applicant's reasons for requesting access, which relate to the legal and technical arguments of the plaintiff in connection with the infringement and the legal status of the patent in suit, access to the aforementioned pleadings is not necessary and should, if granted, be limited to the redacted versions.
9 With regard to the remaining parts of the case file, in particular the requests made pursuant to Rules 190.1, 191, 262.2 and 262A UPC Rules of Procedure and the pleadings on individual procedural issues, access was ruled out from the outset because the applicant's request only referred to the file numbers of the main file and a specific associated file number. Irrespective of this, however, the applicant had not demonstrated or made apparent any legitimate interest that would justify access to these parts of the case file for the reasons stated above. Here, too, the confidentiality interests of the parties prevail. In any case, access would have to be restricted to the non-confidential (redacted) versions and the non-confidential annexes. This would also apply if confidentiality requests made in this regard had not been decided before the end of the proceedings.

REASONS FOR THE ORDER
11 The application is admissible and essentially successful. Pursuant to Rule 262.1 (b) RoP, the applicant may request access to the written pleadings and evidence in the proceedings to the extent specified in the operative part of this order.

12 As a member of the public, the applicant has submitted a reasoned request within the meaning of Rule 262.1 (b) RoP.

13 A reasoned request within this meaning is a request which not only specifies the documents and evidence to which access is sought, but also states the purpose of the request and explains why access to the specified documents is necessary for that purpose, thus providing all the information necessary for the rapporteur to carry out the necessary balancing of interests. 14 The applicant's request meets these requirements. Apart from the fact that it is based on the infringement allegation made by the plaintiff out of court concerning the patent in suit, the proceedings have already been terminated. The latter means that a lower level of reasoning is generally sufficient. A general interest in inspection is sufficient, whereas an applicant needs special reasons if he wishes to inspect the written pleadings during ongoing proceedings (see Court of Appeal, order of 10 April 2024, UPC_CoA_404/2023 – Ocado/Autostore; order of 9 January 2025, UPC_CoA_480/2024, Powell Gilbert/Abbott; Local Division Düsseldorf, order of 17 June 2025, UPC_CFI_177/2023 – Slavik/MyStromer Local Division Munich, order of 22 July 2025, UPC_CFI_439/2023 – Bardehle/Nokia).

15 The request is largely successful. However, insofar as the applicant also listed decisions and orders of the court in the specification of its request, this cannot be granted. These are not subject to Rule 262.1 (b) RoP.

16 For a decision on a request under Rule 262.1 (b) RoP, the interests of a member of the public in obtaining access to the requested documents must be weighed against the interests referred to in Article 45 EPGÜ.
262.1 (b) RoP, the interests of a member of the public in obtaining access to the requested documents must be weighed against the interests referred to in Art. 45 UPCA. These interests include the protection of confidential information and personal data (‘the interests of one of the parties or other affected parties’), but are not limited to these. The general interests of justice and public policy must also be taken into account. The general interest of justice includes the protection of the integrity of proceedings. Public policy is at stake, for example, if a request is abusive or if security interests are at stake (Appeal Court, order of 10 April 2024, UPC_CoA_404/2023 – Ocado/Autostore; order of 9 January 2025, UPC_CoA_480/2024, Powell Gilbert/Abbott; order of 25 April 2025, UPC_CoA_5/2025 – Nicoventures/Juul Labs; Local Division Düsseldorf, order of 17 June 2025, UPC_CFI_177/2023 – Slavik/MyStromer; Local Division Munich, order of 20 December 2024, UPC_CFI_342/2024 – Phoenix Contact/I.L.M.E.; Local Division Munich, order of 22 July 2025, UPC_CFI_439/2023 – Bardehle v Nokia).
17 Once the court has given a decision or order concluding the proceedings at first instance, the public generally has an interest in the documents and evidence being made available. This allows for a better understanding of the decision in light of the arguments put forward by the parties and the evidence relied upon. It also allows for review by the court, which is important for public confidence in the court (Court of Appeal, order of 10 April 2024, UPC_CoA_404/2023 – Ocado/Autostore; order of 9 January 2025, UPC_CoA_480/2024, Powell Gilbert/Abbott; Local Division Düsseldorf, order of 17 June 2025, UPC_CFI_177/2023 – Slavik/MyStromer; Local Division Munich, order of 20 December 2024, UPC_CFI_342/2024 – Phoenix Contact/I.L.M.E.; Central Division Paris, order of 14 October 2024, UPC_CFI_255/2023 – Meril/Edwards; Local Division Munich, order of 22 July 2025, UPC_CFI_439/2023 – Bardehle/Nokia).

18 The balancing of interests to be carried out in application of these principles shows that the applicant must be granted the requested access to the written pleadings and evidence to the extent set out in the operative part.
19 Now that the infringement and revocation proceedings between the plaintiff and the defendants have been completely concluded, the applicant has a general interest in being granted access to the written pleadings and evidence, which outweighs the interests referred to in Article 45 UPCA. The applicant has also invoked this general interest. There are no indications that could justify a refusal or fundamental restriction of access. In particular, the application has not been made for abusive reasons. Nor have the parties disputed the applicant's access to the register as such.
20 The general interest in access to the pleadings and evidence in the infringement and revocation proceedings to be recognised covers the pleadings and evidence in their entirety, unless one of the parties to the proceedings has filed a request for confidentiality in accordance with Rule 262.2 RoP with regard to individual items of information contained in the pleadings.
Therefore, the applicant must, in principle, be given access to the written submissions in their entirety, including the non-technical statements, subject to the protection of legitimate expectations.
21 Whether the written pleadings and evidence in proceedings have been submitted in separate workflows is generally irrelevant. The separate workflows are solely the responsibility of the CMS. However, the provision of workflows by the CMS does not alter the fact that the written pleadings and evidence are part of the proceedings. However, since the applicant did not specify any further application numbers and only referred to evidence or evidence in keywords in the specification of its application, the court understands the application to mean that only the defendant's requests pursuant to Rules 190.1, 191 RoP (App_44881/2024, App_44882/2024).

22 Access to the written pleadings and evidence in the infringement and revocation counterclaim proceedings cannot be granted without restriction in the present case. Since the applicant bases its request solely on Rule 262.1 (b) RoP, requests for confidentiality pursuant to Rule 262.2 RoP must be taken into account. In addition, pursuant to Art. 45 UPCA and Rule 262.1 RoP, the principles of Regulation (EU) 2016/679 must be taken into account.
23 In the proceedings to which the applicant seeks access, the parties requested, when submitting their written pleadings and annexes, that numerous items of information be treated as confidential in accordance with Rule 262.2 RoP. The applicant does not dispute the confidentiality of this information. No request has been made under Rule 262.3 of the Rules of Procedure. For this reason, access can only be granted to the redacted versions submitted by the parties with their written pleadings and annexes, in which the confidential information has been blacked out.
24 This also applies insofar as, in the opinion of the parties, requests for confidentiality have not yet been decided. According to the concept of Rule 262 RoP and the CMS, written submissions and evidence are only to be made accessible upon request in accordance with Rule 262.1 (b) RoP. If the parties to the proceedings have previously submitted a request for confidentiality or within the 14-day period pursuant to Rule 262.2 sentence 2 VerfO, the information concerned shall be excluded from the access to the files, unless the person seeking access submits a request pursuant to Rule 262.3 VerfO. Since no such request has been made in the present case, only the redacted versions (‘redacted version’/‘redacted for public’) of the applicant are to be made accessible from the outset. The applicant has not asserted anything to the contrary.
25 In these redacted versions of the pleadings and evidence, personal data within the meaning of Regulation (EU) 2016/679 must also be redacted.

26 With regard to the practical implementation of access to the files, the applicant shall initially only be provided with the written submissions of the parties without the annexes. The blacking out of personal data involves a certain amount of time and personnel, which precludes the timely provision of all annexes, especially since there are dozens of requests for access to files pending. After receiving the written submissions from the law firm, the applicant may indicate which
attachments are of interest to her after reading the written submissions. In this respect, it can be assumed that the applicant is able to identify all attachments on the basis of the written submissions and that individual attachments are already available to her or can be easily obtained from other sources. Should the applicant maintain its original request in full, this will not be objected to. However, a longer processing time is to be expected solely due to the examination of the requirements of Regulation (EU) 2016/679.
27 In order to ensure that no confidential information is disclosed to the applicant, the approach taken by other Local Divisions will be followed (Local Division Mannheim, order of 26 March 2025, UPC_CFI_210/2023 – Ampersand/Panasonic; Local Division Düsseldorf, order of 9 April 2025, UPC_CFI_135/2024 – Epson/Dolby) and instructing the parties to provide the court with the pleadings and evidence to which the applicant is granted access in an edited version with confidential information removed. The law firm will provide the parties with a secure data room where the files can be uploaded. In order to protect confidential information, it should also be in the interests of the parties to compile and make available these written pleadings and evidence, insofar as access is granted, in a partially redacted version.

28 This order rules on all of the applicant's requests (App_30187/2025, App_30190/2025 and App_30191/2025). In order to reduce the workflow, the order will only be uploaded to the App_30187/2025 workflow. The other workflows will be closed as soon as possible.
