DECISION
La Cour d’appel :
(i) accorde le retrait de l’appel et déclare la procédure close ;
(ii) ordonne l’inscription de la présente décision au registre ;

DECISION OF THE COURT OF FIRST INSTANCE UNDER APPEAL
□ Decision of the Central Division, Paris Section, of 27 January 2025 in main proceedings ACT_578871/2023

Reference:
UPC_CFI_360/2023
ACT_578871/2023
ORD_4257/2025

SUMMARY OF THE FACTS AND PROCEEDINGS
1. On 6 October 2023, Hanshow brought an action for invalidity of the contested patent before the Central Division (Paris section) of the Unified Patent Court (the ‘Central Division’).
2. Following Hanshow's request for withdrawal in accordance with Rule 265 of the Rules of Procedure, the Central Division declared the case (UPC_CFI_360/2023 ACT_578871/2024) closed, set the value of the proceedings at €2,500,000 and declared that the costs of the proceedings were to be borne by Hanshow (Decision of the Central Division of 27 January 2025, ORD_4257/2025, hereinafter the ‘Contested Decision’).
3. On 27 March 2025, Hanshow lodged an appeal against the Contested Decision (APL_14908/2025 UPC_CoA_285/2025) concerning the legal costs.

4. On 9 July 2025, Hanshow requested that its appeal be withdrawn and that the proceedings be terminated without a decision on the merits, in accordance with Rule 265 of the Rules of Procedure (" Rp"), that each party bear the costs it has incurred and that 60% of the procedural costs be reimbursed pursuant to Rule 370.9(b)(i) Rp (App_32621/2025 UPC_CoA_285/2025).

5. VusionGroup confirmed that it had no objection to Hanshow's request for withdrawal and accepted Hanshow's proposal regarding costs.

REASONS FOR THE DECISION
6. According to Rule 265.1 RdP, as long as no final decision has been made, a claimant may request to withdraw its claim. The Court shall rule on the request for withdrawal after hearing the other party. The request for withdrawal shall not be accepted if the other party has a legitimate interest in the case being decided by the Court.
7. In the present case, the request is admissible since no final decision has been rendered.

8. Considering Hanshow's request for withdrawal, VusionGroup's consent, and the latter's lack of legitimate interest in having the case heard by the Court, the withdrawal of the application must be granted and the proceedings closed, in accordance with the provisions of Rule 265 RdP.

9. The proceedings being closed, the contested decision under appeal is without effect (CdA, 24 January 2025, UPC_CoA_505/2024 APL_49883/2024, DexCom v. Abbott).

10. Although Article R.265.2(c) RdP provides that a decision on costs must be made in accordance with Part 1, Chapter 5 RdP, a decision on costs is not necessary in this case as both parties have requested that the Court refrain from making a decision on costs.

11. In the event of withdrawal of the action under the conditions set out in Rule 265 RdP, the party liable for the costs of the proceedings shall be reimbursed 60% of the costs, in accordance with Rule 370.9 (b) (i) RdP, if the action is withdrawn before the close of the written proceedings.

12. In the present case, as the written proceedings have not been closed, Hanshow's request for reimbursement is granted.
DECISION
The Court of Appeal:
(i) grants the withdrawal of the appeal and declares the proceedings closed;

(ii) orders that this decision be entered in the register;
(iii) orders the reimbursement of 60% of the costs incurred by Hanshow before the Court of Appeal
(iv) declares that there is no need to rule on costs.
