ORDONNANCE

action en nullité ACT_22178/2025 ;
Vu l’article 33.3 de l’Accord relatif à une juridiction unifiée du brevet ;
Vu les Règles 29, 38, 315, 316, 331 et s. et 340 du Règlement de procédure ;
VEOLIA PROPRETE (ACT_22178/2025) ;

numéro No. ACT_7950/2025 UPC_CFI_130/2025.
.
qualifications et une expérience dans le domaine technique concerné;

société TIRU, que cette dernière considère elle-même comme nul en l’état ;

RdP.

Rendue à Paris, le 22 juillet 2025.

ORDER
Facts and procedure:

An order for the preservation of evidence was issued on 23 December 2024 by this division at the
request of TIRU against VALINEA ENERGIE (hereinafter "VALINEA"), on the basis of patent EP 3 178
578 entitled "Waste incineration plant and associated process " (hereinafter "EP 578").
These evidence preservation measures were the subject of an appeal for review by the panel, which
rejected the request for review, as well as an appeal before the Luxembourg Court of Appeal, which,
by order of 15 July last, dismissed the appeal lodged by VALINEA.
At the same time, TIRU initiated evidence preservation proceedings against the manufacturer of the
incinerator alleged to be infringing, MAGUIN.
TIRU initiated infringement proceedings on the merits before this division on 18 February 2025
against VALINEA. At the same time, infringement proceedings on the merits were brought against the
manufacturer of the allegedly infringing incinerator, MAGUIN (ACT_7999/2025: Infringement action
TIRU v. MAGUIN and ACT_7950/2025: Infringement action TIRU v. VALINEA ENERGIE).
On 13 May 2025, VEOLIA PROPRETE (hereinafter "VEOLIA"), in its capacity as licensor for the
operation of the said furnace, initiated proceedings for revocation of EP 578 against TIRU before the
Central Division of Paris (ACT_22178/2025).
On 4 June 2025, in the context of the infringement proceedings before this Division, VALINEA filed its
statement of defence and a counterclaim for revocation of EP 578.
By application dated 26 June 2025, TIRU requested the judge-rapporteur to:
-a referral of the counterclaims for invalidity CC_27246/2025 (VALINEA ENERGIE) and
CC_28259/2025 (MAGUIN) of patent EP 578 to the Central Division of Paris, which is already hearing
invalidity proceedings ACT_22178/2025;
-a joinder of the infringement actions ACT_7950/2025 (VALINEA ENERGIE) and ACT_7999/2025
(MAGUIN) of patent EP 578 before the Local Division of Paris.
If the counterclaims for invalidity are dismissed,
-a stay of proceedings in the infringement case pending the decision of the Central Division of Paris.
VALINEA replied requesting:
Pursuant to Article 33.3 of the Agreement on a Unified Patent Court;
Having regard to Rules 29, 38, 315, 316, 331 et seq. and 340 of the Rules of Procedure;
-the dismissal of TIRU's request (i) to sever the counterclaims for invalidity brought by MAGUIN and
VALINEA ENERGIE (CC_28259/2025 and CC_27246/2025) in the infringement proceedings pending
before the Paris Local Division (ACT_7999/2025 and ACT_7950/2025) and (ii) to refer those
counterclaims to the Central Division, which is hearing the action for invalidity of the same patent
brought by VEOLIA PROPRETE (ACT_22178/2025);
VALINEA defers to the decision of the Judge-Rapporteur on the joinder of infringement actions
pending before the Paris Local Division against MAGUIN (ACT_7999/2025) and against VALINEA
ENERGIE (ACT_7950/2025), as well as on TIRU's request to stay proceedings in the infringement
actions pending before the Paris Local Division against MAGUIN (ACT_7999/2025) and against
VALINEA ENERGIE (ACT_7950/2025), subject, however, to such a stay of proceedings being ordered
only after TIRU has filed its reply to VALINEA ENERGIE's defence.
A pre-trial hearing was held by the judge-rapporteur on 4 July 2025, during which the parties
presented their respective arguments in support of their applications and comments in response and
maintained the positions adopted in writing.

GROUNDS
On the joinder of the two infringement actions
The claimant (TIRU) bases its request for joinder on Rule 340 of the Rules of Procedure, however, the
legal basis for its request should be reclassified, as Rule 302 of the Rules of Procedure should apply in
this case.
Rule 302 – Multiple claimants or patents:

3. The Court may, in the interests of the proper administration of justice, order the joinder of parallel
infringement or invalidity proceedings concerning the same patent (or patents) pending before the
same local or regional division or before the central division or before the Court of Appeal.
In this case, the panel considers that, since the two actions were brought in parallel on the basis of
the same patent, concerning the same alleged infringing product (the incinerator manufactured and
supplied by MAGUIN, operated by VALINEA), in view of the very similar arguments put forward in
defence, and in view of the parallel measures taken to preserve evidence, which were subject to
almost identical criticism in defence, it is in the interests of good administration to examine the two
cases together and, to that end, to order that they be joined. The main proceedings will therefore be
continued on their merits under the same case number No. ACT_7950/2025 UPC_CFI_130/2025.
.
On the bifurcation of the counterclaim for revocation of the patent in question and the request for a
stay of proceedings on the infringement claims
The legal framework:
Art. 33.3 b) UPCA:

3. A counterclaim for invalidity referred to in Article 32(1)(e) may be brought in connection with an
infringement action referred to in Article 32(1)(a). After hearing the parties, the local or regional
division concerned may:
a) either rule on both the infringement action and the counterclaim for invalidity and request the
President of the Court of First Instance to assign, in accordance with Article 18(3), a technically
qualified judge from the pool of judges with qualifications and experience in the technical field
concerned;
b) either refer the counterclaim for invalidity to the central division for decision and stay the
infringement action or rule on it; or
c) or, with the agreement of the parties, refer the case back to the central division for decision.
Rule 37 – Application of Article 33(3) of the Agreement:
(..)
4. Where the Chamber decides to proceed in accordance with Article 33(3)(b) of the Agreement, the
Chamber may stay the infringement proceedings pending a final decision in the invalidity proceedings;
it shall stay the infringement proceedings where there is a likelihood that the relevant claims of the
patent will be declared invalid on any ground by the final decision in the invalidity proceedings.
5. Where the chamber decides to proceed in accordance with Article 33(3)(b) of the Agreement and
not to stay proceedings, the reporting judge of the regional or local division shall communicate to the
central division the dates set for the pre-trial conference and for the hearing in accordance with Rule
28.
4
The present case:
According to TIRU, since the counterclaims are simply a repetition of the arguments and claims made
by VEOLIA PROPRETE in its application for annulment before the Central Division of Paris, it would be
in accordance with the rules of the JUB to order their referral so that they can be examined by the
Central Division already seized of the action for revocation of the same patent by VEOLIA (which is
part of the same group as VALINEA and has the same representative in both cases).
The defendants (VALINEA and MAGUIN) oppose this request for bifurcation concerning their
counterclaims for invalidity, arguing that:
- there is no risk of contradiction between the decisions that may be taken in the infringement
proceedings pending before the Local Division of Paris (ACT_7999/2025 and ACT_7950/2025) and the
invalidity proceedings pending before the Central Division of Paris (ACT_22178/2025) since the
invalidity action pending before the Central Division of Paris should result in a decision on the merits
before the infringement actions (including the counterclaims for invalidity) pending before the Local
Division of Paris,
-the parallel pursuit of infringement proceedings and invalidity proceedings will not result in a
significant additional workload for the parties, since the claims and arguments raised by VEOLIA
PROPRETE (in the invalidity proceedings) and VALINEA ENERGIE (in its counterclaim brought in the
infringement proceedings) are the same,
- such a joinder of the counterclaims for invalidity and the action for invalidity before the Central
Division would considerably slow down the action for invalidity, insofar as MAGUIN is not yet a party
to those proceedings and has therefore not yet had the opportunity to file a statement of defence in
order to defend its position in those separate proceedings, even though each of the parties has filed a
statement of claim.
VALINEA adds that, since TIRU has announced that it will request an unconditional amendment to its
patent, the joinder requested by TIRU would cause significant harm to:
- on the one hand, VEOLIA PROPRETE, in that this joinder would considerably slow down the action
for invalidity that it has brought before the Central Division to have TIRU's patent declared invalid,
which TIRU itself considers to be invalid as it stands;
- on the other hand, VALINEA ENERGIE, in that this joinder would deprive it of an identical
interpretation of the scope of the claims of TIRU's patent, concerning the assessment of the validity
of that patent and the assessment of its infringement.
TIRU requests that its application for dismissal of the counterclaims be accompanied by a stay of
proceedings in its main infringement action before this division, in order to avoid any contradictory
decisions. TIRU asserts that this stay of proceedings would only delay the outcome of the
infringement proceedings by two or three months at most. (See timeline produced in TIRU's
procedural application)
VALINEA expressed surprise at this request from TIRU but deferred to the decision of the judge
rapporteur on this point. At the pre-trial hearing, VALINEA's representatives emphasised that the
actions of TIRU, which belongs to the PAPREC group, a direct competitor of the VEOLIA group, had
disrupted the operation of the incinerator in question by delaying its commissioning as a
precautionary measure pending the outcome of this dispute, which had a significant economic
impact and that this disruption should last as short a time as possible.
MAGUIN puts forward similar arguments in opposition to the request for a stay and bifurcation,
emphasising in addition that it is not a subsidiary of the VEOLIA group and asserting that it is not
concerned by the revocation proceedings before the Central Division of Paris.

In view of these factors and in accordance with the principle of procedural efficiency (point 7 of the
preamble to the Rules of Procedure), after weighing up the respective interests of the parties in order
to ensure a fair trial (point 5 of the preamble to the Rules of Procedure), the panel considers that the
claimant has an interest in obtaining a quick decision on the alleged infringement and that the
defendants also have an interest in ensuring that the uncertainty of the ongoing litigation, which has
delayed the commissioning of the allegedly infringing furnace, is quickly removed by a decision on
the merits. In this context, it is appropriate to order the bifurcation of the counterclaims for invalidity
of the patent to the Central Division. Account is taken of the fact that the Central Division was first
seized of the application for revocation of the patent and should therefore deliver its decision more
quickly, and that the arguments on the validity of the patent put forward by VEOLIA before the
Central Division are virtually identical to those put forward in the counterclaims before this local
division by VALINEA and MAGUIN.
It is therefore for reasons of economy and efficiency that this bifurcation measure should be ordered
only in respect of counterclaims.
For the same reasons of efficiency, in order to avoid slowing down the infringement proceedings,
which is in the interests of the claimant but also of the defendants, as the duration of this dispute
inevitably has an economic impact, particularly for companies in the VEOLIA group (such as VALINEA),
a direct competitor of PAPREC, to which TIRU belongs, in the waste treatment by incineration market,
the request for a stay of proceedings in the infringement action pending the outcome of the parallel
action before the Central Division on the validity of the patent will not be granted.
The infringement action before this division will be continued without any extension of time limits,
taking into account the version of the patent as unconditionally amended by TIRU before the Central
Division, as will the interpretation of the claims as upheld before the Central Division in the context of
the validity challenge for the assessment of infringement, in accordance with Article 69 of the EPC
and the established case law of the JUB on this point (UPC_CoA_335/2023 and UPC_CoA_1/2024).
Furthermore, the panel notes that, on the one hand, with regard to a possible delay in the
proceedings before the Central Division due to MAGUIN's intervention, such a delay is not certain
insofar as MAGUIN has a defence similar to that of the VEOLIA group companies on the validity issue
and, on the other hand, with regard to the risk of contradictory decisions between the local and
central divisions if the Central Division delivers its decision later, the local division always has the
option, pending the final decision of the central division, either to stay proceedings if necessary at
any stage of the proceedings (Rule 295(m), which provides for the possibility of staying proceedings
in all cases where the proper administration of justice so requires), or to give a decision on the merits
of the infringement on condition that the patent is declared valid by the Central Division as provided
for in Rule
118.2 of the Rules of Procedure.
Consequently, the counterclaims for invalidity should be referred back to the Central Division for
decision and the proceedings on the infringement claim, which are continuing in accordance with the
time limits laid down in the Rules of Procedure before this Division, should not be stayed.

On those grounds,
The panel orders:
-the joinder of cases ACT_7950/2025 UPC_CFI_130/2025 and ACT_7999/2025 UPC_CFI_132/2025,
which are pending before this Division, under a single case number ACT_7950/2025
UPC_CFI_130/2025,
-the referral of the counterclaims for invalidity of the EP 578 patent of VALINEA and MAGUIN to the
Central Division of Paris, in accordance with Article 33-3 of the UPCA,
-at this stage of the proceedings, rejects the request for a stay of proceedings in the infringement
action pending the decision on the merits of the Central Division hearing an action for revocation of
patent EP 578 brought by VEOLIA,
-invites TIRU to file its response to the defence brief by 11 August 2025 at the latest concerning its
infringement claim, based on the version of the patent as it wishes to see it amended unconditionally
by the Central Division,
-recalls that, as soon as the dates of the pre-trial conference and the oral hearing have been set in
accordance with Rule 28 of the Rules of Procedure by the reporting judge, the latter will
communicate them to the Central Division in Paris in accordance with Rule 37-5 of the Rules of
Procedure,
-states that this order is subject to appeal in accordance with the provisions of Rule 220-2 of the Rules
of Procedure.

Given in Paris on 22 July 2025.
