Anordnung des Gerichts erster Instanz des Einheitlichen Patentgerichts, erlassen am 22. Juli 2025

Leitsätze:
1. Im Rahmen von Regel 198.1 EPGVerfO (Aufhebung einer Anordnung der Beweis-sicherung im Falle verspäteter Einleitung des Hauptsacheverfahrens) ist zwischen Fristlänge und Fristbeginn zu unterscheiden. Während kein gerichtliches Ermessen zur Bestimmung der Fristlänge besteht, steht die Festlegung des Fristbeginns im Ermessen des Gerichts.
2. Das nach Regel 198.1 EPGVerfO bestehende Ermessen hinsichtlich der Festlegung des Fristbeginns umfasst auch eine spätere Änderung des Fristbeginns; eine Änderung des Fristbeginns kann insbesondere im Falle einer verspäteten Vorlage des Besichtigungsberichts durch den Sachverständigen veranlasst sein.
3. Ändert der Berichterstatter den Fristbeginn nach Regel 198.1 EPGVerfO, kann diese verfahrensleitende Anordnung nach Regel 333 EPGVerfO zur Überprüfung gestellt werden. Der Antrag auf Überprüfung ist innerhalb von 15 Tagen einzureichen; andernfalls erwächst die Anordnung zur Änderung des Fristbeginns in Rechtskraft.

GEGENSTAND DES VERFAHRENS
Antrag der Antragsgegnerin auf Aufhebung der Anordnung auf Beweissicherung und Inspektion nach Regel 198.1 EPGVerfO

SACHVERHALT
Die Antragstellerin hat am 24. Januar 2025 Beweissicherungsmaßnahmen und eine Inspektion nach Regeln 192 ff. EPGVerfO beantragt. Das Gericht hat am 3. Februar 2025 Beweissicherungsmaßnahmen und eine Inspektion ohne vorherige Anhörung der Antragsgegnerin angeordnet. Ziffer XI. der Anordnung lautet:
„Die Anordnung der Beweissicherung wird auf Antrag der Antragsgegnerin unbeschadet etwaiger Schadenersatzforderungen aufgehoben oder auf andere Weise außer Kraft gesetzt werden, wenn die Antragstellerin nicht innerhalb einer Frist von 31 Kalendertagen oder 20 Werktagen – je nachdem, welcher Zeitraum länger ist – ab dem 28. Februar 2025 das Hauptverfahren in der Sache einleitet (Regel 198.1 EPGVerfO).“
Regel 198.1 EPGVerfO lautet:
„Das Gericht stellt sicher, dass eine Anordnung der Beweissicherung auf Antrag des Antragsgegners, unbeschadet etwaiger Schadenersatz-forderungen, aufgehoben oder auf andere Weise außer Kraft gesetzt wird, wenn der Antragsteller nicht innerhalb einer Frist von 31 Kalendertagen oder 20 Werktagen – je nachdem, welcher Zeitraum länger ist – ab dem in der gerichtlichen Anordnung, unter angemessener Berücksichtigung des Datums, bis zu dem der Bericht gemäß Regel 196.4 vorliegen soll, festgelegten Datum das Hauptverfahren in der Sache bei dem Gericht einleitet.“
Bei der Festlegung des Datums in Ziffer XI. der Anordnung ging das Gericht davon aus, dass der Bericht spätestens am 28. Februar 2025 vorliegen würde.
Tatsächlich lieferte der Sachverständige seinen Bericht jedoch nicht wie vorgesehen spätestens am 28. Februar 2025 ab. Die Abgabefrist wurde in Abstimmung mit dem Gericht mehrfach verlängert.
Mit E-Mail vom 17. März 2025 hat der Sachverständige dem Gericht mitgeteilt, dass er den Bericht fertiggestellt hat. Am 18. März 2025 hat der Berichterstatter angeordnet, den Bericht im CMS zugänglich zu machen. Gegenüber den Vertretern der Antragstellerin wurde angeordnet, den Bericht gegenüber der Antragstellerin bis zur Klärung etwaiger Geheimhaltungserfordernisse geheim zu halten. Ziffer 4. der Verfahrensanordnung vom 18. März 2025 lautet:

„Die in Ziff. XI. der Anordnung vom 3. Februar 2025 gesetzte Frist zur Einleitung des Hauptsacheverfahrens wird dahin angepasst, dass als Ausgangspunkt für die Fristberechnung nicht der 28. Februar 2025 gilt, sondern die Frist von 31 Kalendertagen oder 20 Werktagen – je nachdem, welcher Zeitraum länger ist – zur Einleitung der Hauptsacheklage ab dem Tag zu laufen beginnt, an dem der Bericht des Sachverständigen Nils T.F. Schmid und die Ergebnisse der Inspektion/Besichtigung gemäß Ziff. I der Anordnung vom 3. Februar 2025 der Antragstellerin zugänglich gemacht werden dürfen.“
Der Sachverständige hat den Bericht schließlich am 19. März 2025 im CMS zugänglich gemacht. Die Antragsgegnerin hat diesen sodann mit Schriftsatz vom 31. März 2025 in geschwärzter Fassung freigeben, woraufhin der Berichterstatter am 2. April 2025 anordnete, dass die geschwärzte Fassung der Antragstellerin zugänglich gemacht werden darf.
Das Verfahren in der Hauptsache wurde am 3. Mai 2025 eingeleitet.
Die Antragsgegnerin ist der Ansicht, die Antragstellerin habe nicht innerhalb der mit Anordnung vom 3. Februar 2025 in Ziffer XI. gesetzten Frist Klage erhoben. Die Frist sei am 31. März 2025 abgelaufen. Die Klageerhebung am 3. Mai 2025 sei daher nach Fristablauf erfolgt.
Mit der in Ziffer 4 der Anordnung vom 18. März 2025 vorgenommenen „Neuanknüpfung“ des Fristbeginns an den Tag, an dem der Bericht des Sachverständigen und die Ergebnisse der Inspektion/Besichtigung gemäß Ziff. I der Anordnung vom 3. Februar 2025 der Antragstellerin zugänglich gemacht werden dürfen, habe die Frist zur Klageerhebung nicht wirksam verlängern können. Gemäß R. 9.4 EPGVerfO sei die Frist aus R. 198.1 EPGVerfO nicht verlängerbar. Die Veränderung des Ausgangspunktes für die Fristberechnung vom 28. Februar 2025 auf den Tag, an dem der Bericht des Sachverständigen und die Ergebnisse der Inspektion der Antragstellerin zugänglich gemacht werden dürfen, umgehe R. 9.4 EPGVerfO. In der Wirkung unterscheide sich die Änderung des Anknüpfungspunktes für die Frist nicht von einer Verlängerung der Frist.

Die Antragsgegnerin hat daher am 15. Mai 2025 b e a n t r a g t,
die Anordnung zur Beweissicherung und Inspektion der Lokalkammer München vom 3. Februar 2025 gem. Regel 198.1 VerfO, unbeschadet etwaiger Schadensersatzforderungen aufzuheben oder auf andere Weise außer Kraft zu setzen und in diesem Rahmen:
- Patentanwalt Nils T.F. Schmid, die bei der Beweissicherung anwesenden Vertreter der Antragstellerin sowie alle weiteren Personen, denen vertrauliche Informationen aus der Beweissicherung zugänglich gemacht wurden, zu verpflichten, die Informationen weiterhin vertraulich zu behandeln,
- (klarstellend) auszusprechen, dass die Antragstellerin und ihre Vertreter die aus der Beweissicherung erlangten Informationen – unabhängig von deren Vertraulichkeit – nicht für die Beweisführung im entsprechenden Verfahren in der Sache verwendet werden dürfen, und
- der Antragstellerin die Kosten des Beweissicherungsverfahrens aufzuerlegen.
Die Antragstellerin ist dem Antrag entgegengetreten und hat b e a n t r a g t,
1. den Antrag der Antragsgegnerin vom 15. Mai 2025 auf Aufhebung der Anordnung zur Beweissicherung und Inspektion der Lokalkammer München vom 3. Februar 2025 zurückzuweisen und die Anordnung zur Beweissicherung und Inspektion der Lokalkammer München vom 3. Februar 2025 zu bestätigen;
2. der Antragsgegnerin die Kosten des Verfahrens aufzuerlegen.
Hilfsweise hat sie für den Fall, dass das Gericht wider Erwarten der Auffassung sein sollte, dass die Klage nicht innerhalb der gemäß R. 198.1 VerfO gesetzten Frist erhoben worden ist, hat sie b e a n t r a g t,
3. festzustellen, dass die im Beweissicherungsverfahren erlangten, nicht vertraulichen Informationen in der von der Antragsgegnerin mit Schriftsatz vom 31. März 2025 freigegebenen (geschwärzten) Fassung nebst Anlagen (soweit geschwärzt in der jeweiligen geschwärzten Fassung) weiterhin im Rahmen des Hauptsacheverfahrens verwertbar bleiben und keinem Beweisverwertungs-verbot unterliegen.
Auf die Begründung der Antragstellerin im Schriftsatz vom 6. Juni 2025 wird verwiesen.

BEGRÜNDUNG
Der Antrag auf Aufhebung der Anordnung vom 3. Februar 2025 hat keinen Erfolg.
Die Antragstellerin hat das Verfahren in der Hauptsache fristgerecht eingeleitet. Deshalb besteht kein Anlass, die Anordnung zur Beweissicherung und Inspektion der Lokalkammer München vom 3. Februar 2025 aufzuheben.
1. Für die Berechnung der Frist zur Einleitung des Verfahrens in der Hauptsache ist der in der Anordnung vom 18. März 2025 festgelegte Fristbeginn maßgebend.
Fristbeginn ist danach der Tag, an dem der Bericht des Sachverständigen und die Ergebnisse der Inspektion/Besichtigung gemäß Ziff. I der Anordnung vom 3. Februar 2025 der Antragstellerin zugänglich gemacht werden durften. Dabei handelt es sich um ein eindeutig bestimmbares Datum im Sinne von Regel 198.1 EPGVerfO. Das genannte Ereignis (Zugänglichmachung des Berichts gegenüber der Antragstellerin) trat am 2. April 2025 ein. Gemäß Regel 300(a) EPGVerfO begann die Berechnung mit dem Tag, der auf den Tag folgt, an dem das maßgebliche Ereignis (Zugänglichmachen des Berichts) eingetreten ist. Dies ist der 3. April 2025. Der Zeitraum vom 3. April 2025 bis zum 3. Mai 2025, dem Tag der Einreichung der Hauptsacheklage, beträgt 31 Tage.
2. Soweit sich die Antragsgegnerin mit ihrem Antrag vom 15. Mai 2025 darauf beruft, mit der in Ziffer 4 der Anordnung vom 18. März 2025 vorgenommenen „Neuanknüpfung“ des Fristbeginns habe die Frist zur Klageerhebung nicht wirksam verlängert werden können, da die Frist aus Regel 198.1 EPGVerfO nicht verlängerbar sei, kann sie damit schon deshalb keinen Erfolg haben, da sie die entsprechende Anordnung des Berichterstatters nicht fristgerecht gemäß Regel 333 EPGVerfO zur Überprüfung gestellt hat. Damit ist die Anordnung vom 18. März 2025 in Rechtskraft erwachsen. Folglich hat die Berechnung der Frist zur Erhebung der Hauptsacheklage auf Grundlage dieser Anordnung zu erfolgen.
3. Unabhängig davon ist festzustellen, dass die mit der Anordnung vom 18. März 2025 erfolgte Neubestimmung des Fristbeginns keinen Verstoß gegen die Verfahrens-ordnung darstellt.
Der Berichterstatter hat sich mit der Änderung des Fristbeginns nicht über Regel 9.4 EPGVerfO hinweggesetzt. Nach Regel 9.4 EPGVerfO darf die in Regel 198.1 EPGVerfO genannte Frist vom Gericht nicht verlängert werden. In diesem Zusammenhang ist zwischen Fristlänge und Fristbeginn zu unterscheiden. Nach Regel 9.4 EPGVerfO ist das Gericht nicht befugt, die in Regel 198.1 EPGVerfO genannte Frist („Frist von 31 Kalendertagen oder 20 Werktagen“) zu verlängern; das Gericht darf dem Antragsteller also beispielsweise nicht eine Frist von 40 statt der in der Verfahrensordnung vorgesehenen 31 Kalendertage gewähren, um das Hauptsacheverfahren einzuleiten. Insofern hat das Gericht keinerlei Ermessen.
Demgegenüber räumt die Verfahrensordnung dem Gericht in Regel 198.1 EPGVerfO insofern Ermessen ein, als es um die Bestimmung des Fristbeginns geht („…ab dem in der gerichtlichen Anordnung [festgelegten Datum] unter angemessener Berücksichtigung des Datums, bis zu dem der Bericht gemäß Regel 196.4 vorliegen soll…“). Die Verfahrensordnung zeigt dabei auch den für die Ermessensausübung wesentlichen Maßstab auf („Berücksichtigung des Datums, bis zu dem der Bericht … vorliegt“).
Der Verfahrensordnung lässt sich entgegen der Ansicht der Antragsgegnerin nicht entnehmen, dass das Gericht den von ihm nach Regel 198.1 EPGVerfO bestimmten, auf einer Prognose der Vorlage des Berichts beruhenden Fristbeginn, später nicht mehr abändern darf. Regel 198.1 EPGVerfO ist vielmehr dahin zu verstehen, dass es ermessensfehlerhaft wäre, eine Änderung des Fristbeginns nicht anzuordnen, wenn sich die Vorlage des Berichts entgegen der ursprünglichen Prognose des Gerichts verzögert. Denn dadurch würde der Zeitraum, der dem Antragsteller mit Regel 198.1 EPGVerfO als angemessen zugestanden wird, um die Einleitung des Hauptsacheverfahrens zu prüfen und vorzunehmen, zu Lasten des Antragstellers verkürzt. Dies ist offensichtlich nicht im Sinne der Verfahrensordnung, weshalb eine Neubestimmung des Fristbeginns im Falle einer verspäteten Vorlage des Berichts nach der Verfahrensordnung ohne weiteres möglich ist. Das nach Regel 198.1 EPGVerfO bestehende Ermessen hinsichtlich der Festlegung des Fristbeginns umfasst daher auch eine spätere Änderung des Fristbeginns
Der vorliegende Fall zeigt die Notwendigkeit der Neubestimmung des Fristbeginns besonders deutlich:
Mit der ursprünglichen Anordnung vom 3. Februar 2025 ging das Gericht davon aus, dass der Bericht am 28. Februar 2025 vorliegen dürfte und legte dem entsprechend den Fristbeginn fest. Allerdings wurde der Bericht dem Gericht erst am 17. März 2025 vorgelegt, wobei dann noch eine Überprüfung auf geheimhaltungsbedürftige Informationen durch die Antragsgegnerin zu erfolgen hatte, ehe der Bericht am 2. April 2025 in einer geschwärzten Fassung der Antragstellerin zugänglich gemacht werden durfte. Ausgehend von der ursprünglichen Fristberechnung hätte die Antragstellerin folglich über die Einleitung des Hauptverfahrens entscheiden müssen, ohne dass ihr der Bericht vorgelegen hätte – ein offensichtlich absurdes und der Verfahrensordnung evident widersprechendes Ergebnis.
Soweit der Vertreter der Antragsgegnerin behauptet, die Lokalkammer München habe im Verfahren UPC_CFI_755/2024 mit Anordnung vom 09.12.2024 bereits entschieden, dass das Einheitliche Patentgericht bei der Fristsetzung nach Regel 213.1 VerfO kein Ermessen habe (Schriftsatz vom 15. Mai 2025 Rn. 11 in App_23201/2025 UPC_CFI_63/2025), stellt er die Ausführungen in der genannten Anordnung falsch dar. Der entsprechenden Anordnung ist ohne weiteres zu entnehmen, dass der Bitte der dortigen Antragstellerin, von einer Fristsetzung mit Blick auf eine Hauptsacheklage abzusehen, nicht entsprochen werden konnte, da Regel 213.1 EPGVerfO insofern kein Ermessen eröffnet. Der Vertreter der Antragsgegnerin wird auf Art. 48 Abs. 6 EPGÜ und Regel 291 EPGVerfO hingewiesen und erneut (siehe schon Anordnung vom 28. Mai 2025), aber auch
letztmalig ermahnt, wahrheitsgemäß vorzutragen. Diese letztmalige Ermah-
nung gilt gleichermaßen für das Verfahren in der Hauptsache.
Es ergeht folgende

ANORDNUNG
1. Den Antrag der Antragsgegnerin vom 15. Mai 2025 auf Aufhebung der Anordnung zur Beweissicherung und Inspektion der Lokalkammer München vom 3. Februar 2025 wird zurückgewiesen.
2. Die Antragsgegnerin hat die Kosten des Verfahrens zu tragen.

2. Request by the respondent to set aside the order for preservation of evidence and inspection pursuant to Rule 198.1 EPGVerfO

FACTS
On 24 January 2025, the applicant applied for measures to preserve evidence and an inspection pursuant to Rules 192 et seq. EPGVerfO. On 3 February 2025, the court ordered measures to preserve evidence and an inspection without first hearing the respondent. Section XI of the order reads as follows:

"The order for the preservation of evidence shall be revoked or otherwise set aside at the request of the respondent, without prejudice to any claims for damages, if the applicant does not initiate the main proceedings in the matter within a period of 31 calendar days or 20 working days, whichever is longer, from 28 February 2025 (Rule 198.1 EPGVerfO)."

Rule 198.1 EPGVerfO reads:
"The court shall ensure that an order for the preservation of evidence is revoked or otherwise rendered ineffective upon request of the respondent, without prejudice to any claims for damages, if the applicant fails to initiate the main proceedings on the merits within a period of 31 calendar days or 20 working days, whichever is longer
– from the date specified in the court order, taking into account the date by which the report is to be submitted in accordance with Rule 196.4, initiate the main proceedings on the merits before the court."

When setting the date in section XI of the order, the court assumed that the report would be available by 28 February 2025 at the latest.
However, the expert did not deliver his report by 28 February 2025 as planned. The deadline was extended several times in consultation with the court.
In an email dated 17 March 2025, the expert informed the court that he had completed the report. On 18 March 2025, the rapporteur ordered that the report be made available in the CMS. The representatives of the applicant were ordered to keep the report confidential from the applicant until any confidentiality requirements had been clarified. Paragraph 4 of the order of 18 March 2025 reads as follows


"The deadline for initiating the main proceedings set in section XI of the order of 3 February 2025 is adjusted so that the starting point for calculating the deadline is not 28 February 2025, but the period of 31 calendar days or 20 working days – whichever is longer – for initiating the main proceedings shall commence on the day on which the report of the expert Nils T.F. Schmid and the results of the inspection/viewing pursuant to Section I of the order of 3 February 2025 may be made available to the applicant."

The expert finally made the report available in CMS on 19 March 2025. The respondent then released it in a redacted version by written submission dated 31 March 2025, whereupon the rapporteur ordered on 2 April 2025 that the redacted version be made available to the applicant.

The main proceedings were initiated on 3 May 2025.
The respondent is of the opinion that the applicant did not bring an action within the time limit set in point XI of the order of 3 February 2025. The time limit expired on 31 March 2025.
The action was therefore brought after the expiry of the time limit.
By ‘re-linking’ the start of the time limit in point 4 of the order of 18 March 2025 to the date on which the expert's report and the results of the inspection/viewing pursuant to point I of the order of 3 February 2025 were made available to the applicant, the court could not effectively extend the time limit for bringing an action. I of the order of 3 February 2025, the deadline for bringing an action could not be effectively extended. Pursuant to R. 9.4 EPGVerfO, the deadline under R. 198.1 EPGVerfO could not be extended. The change in the starting point for calculating the time limit from 28 February 2025 to the date on which the expert's report and the results of the inspection may be made available to the applicant circumvents R. 9.4 EPGVerfO. In effect, the change in the starting point for the time limit is no different from an extension of the time limit.

The respondent therefore applied on 15 May 2025 for
the order for the preservation of evidence and inspection by the Munich Local Division of 3 February 2025 pursuant to Rule 198.1 RoP to be set aside or otherwise rendered ineffective, without prejudice to any claims for damages, and in this context:

- to oblige patent attorney Nils T.F. Schmid, the representatives of the applicant present during the preservation of evidence and all other persons to whom confidential information from the preservation of evidence was made available to continue to treat the information as confidential,

- (for clarification) to declare that the applicant and its representatives may not use the information obtained from the preservation of evidence – regardless of its confidentiality – for the presentation of evidence in the relevant proceedings on the merits, and
- to order the applicant to bear the costs of the evidence preservation proceedings.

The applicant opposed the application and requested that

1. dismiss the respondent's application of 15 May 2025 for annulment of the order for preservation of evidence and inspection issued by the Munich Local Division on 3 February 2025 and confirm the order for preservation of evidence and inspection issued by the Munich Local Division on 3 February 2025;

2. to order the respondent to pay the costs of the proceedings.
In the alternative, in the event that the court should, contrary to expectations, take the view that the action was not brought within the time limit set in accordance with R. 198.1 RoP, it has requested that
3. to declare that the non-confidential information obtained in the evidence preservation proceedings, in the (redacted) version released by the respondent in its written submission of 31 March 2025, together with the annexes (insofar as redacted in the respective redacted version), remains admissible in the main proceedings and is not subject to any prohibition on the use of evidence.

Reference is made to the applicant's statement of grounds in the written submission of 6 June 2025.

STATEMENT OF GROUNDS
The application for annulment of the order of 3 February 2025 is unsuccessful.
The applicant initiated the main proceedings within the time limit. Therefore, there is no reason to set aside the order of the Munich Local Division of 3 February 2025 for the preservation of evidence and inspection.
1. The start of the period specified in the order of 18 March 2025 is decisive for calculating the time limit for initiating the main proceedings.

Accordingly, the time limit began on the day on which the expert's report and the results of the inspection/viewing pursuant to Section I of the order of 3 February 2025 were made available to the applicant. This is a clearly determinable date within the meaning of Rule 198.1 EPGVerfO. The aforementioned event (making the report available to the applicant) occurred on 2 April 2025. Pursuant to Rule 300(a) EPGVerfO, the calculation began on the day following the day on which the relevant event (making the report available) occurred. This is 3 April 2025. The period from 3 April 2025 to 3 May 2025, the date on which the main action was filed, is 31 days.

Insofar as the respondent, in its application of 15 May 2025, argues that the ‘reconnection’ of the start of the period in point 4 of the order of 18 March 2025 did not effectively extend the period for bringing an action because the period under Rule 198.1 EPGVerfO cannot be extended, it cannot succeed in this argument because it did not submit the corresponding order of the rapporteur for review in accordance with Rule 333 EPGVerfO within the time limit. The order of 18 March 2025 has therefore become final. Consequently, the time limit for bringing the main action must be calculated on the basis of this order.

3. Irrespective of this, it must be noted that the re-determination of the start of the time limit by order of 18 March 2025 does not constitute a violation of the Rules of Procedure.

The rapporteur did not disregard Rule 9.4 EPGVerfO by changing the start of the time limit. According to Rule 9.4 EPGVerfO, the time limit specified in Rule 198.1 EPGVerfO may not be extended by the court. In this context, a distinction must be made between the length of the time limit and the start of the time limit. According to Rule 9.4 EPGVerfO, the court is not authorised to extend the time limit specified in Rule 198.1 EPGVerfO (‘time limit of 31 calendar days or 20 working days’); the court may not, for example, grant the applicant a period of 40 calendar days instead of the 31 calendar days provided for in the Rules of Procedure to initiate the main proceedings. In this respect, the court has no discretion.

In contrast, the Rules of Procedure grant the court discretion in Rule 198.1 EPGVerfO with regard to determining the start of the time limit (‘...from the date specified in the court order, taking into account the date by which the report is to be submitted in accordance with Rule 196.4...’). The Rules of Procedure also set out the essential criterion for the exercise of discretion (‘taking into account the date by which the report ... is available’).

Contrary to the respondent's view, it cannot be inferred from the Rules of Procedure that the court may not subsequently change the start of the time limit determined by it in accordance with Rule 198.1 EPGVerfO on the basis of a forecast of when the report will be submitted. Rule 198.1 EPGVerfO is to be understood as meaning that it would be an error of discretion not to order a change in the start of the time limit if the submission of the report is delayed contrary to the court's original forecast. This would shorten the period granted to the applicant under Rule 198.1 EPGVerfO as reasonable for examining and initiating the main proceedings, to the detriment of the applicant. This is clearly not in the spirit of the Rules of Procedure, which is why it is possible to re-determine the start of the time limit in the event of late submission of the report in accordance with the Rules of Procedure.
The discretion existing under Rule 198.1 EPGVerfO with regard to determining the start of the time limit therefore also includes a subsequent change to the start of the time limit. The present case clearly demonstrates the need to re-determine the start of the time limit:
In its original order of 3 February 2025, the court assumed that the report would be available on 28 February 2025 and set the start of the period accordingly. However, the report was not submitted to the court until 17 March 2025, at which point the respondent still had to review it for information subject to confidentiality before the report could be made available to the applicant in redacted form on 2 April 2025. Based on the original calculation of the deadline, the applicant would therefore have had to decide on the initiation of the main proceedings without having the report at its disposal – an obviously absurd result that clearly contradicts the Rules of Procedure.

In so far as the respondent's representative claims that the Munich Local Division had already decided in proceedings UPC_CFI_755/2024, by order of 9 December 2024, that the Unified Patent Court had no discretion under Rule 213(1) of the Rules of Procedure for setting time limits, the Court of First Instance finds that it had no discretion under Rule 213(1) of the Rules of Procedure.1 RoP (written submission of 15 May 2025, para. 11 in App_23201/2025 UPC_CFI_63/2025), he misrepresents the statements made in that order. It is clear from the order in question that the applicant's request to refrain from setting a time limit with a view to bringing an action on the merits could not be granted, as Rule 213.1 EPGVerfO does not provide for any discretion in this respect. The representative of the respondent is referred to Art. 48(6) UPCA and Rule 291 EPGVerfO and is again (see already order of 28 May 2025), but also
for the last time, warned to present the facts truthfully. This final warning
applies equally to the proceedings in the main action.

The following

ORDER
1. The respondent's application of 15 May 2025 for the annulment of the order for the preservation of evidence and inspection by the Munich Local Division of 3 February 2025 is dismissed.
2. The respondent shall bear the costs of the proceedings.
