Sachverhalt und Gründe
Die Klägerin und die Beklagten haben übereinstimmend erklärt, sich verglichen zu haben. Die Klägerin hat einen Antrag auf Zulassung der Klagerücknahme gestellt, die Beklagten derselben zugestimmt. Die Parteien haben mitgeteilt, keine Kostenanträge zu stellen. Die Klagerücknahme war entsprechend zuzulassen.
Eine Erstattung von Gerichtsgebühren findet nach regeln 370.9.(b),(e) VerfO nicht statt. Die Entscheidung war im Zeitpunkt der Rücknahme vollständig abgefasst und signiert und musste nur noch hochgeladen werden, was den Parteien bekannt war. Zudem haben die Parteien das Gericht mehrmals bis auf die letzte Sekunde darüber im Unklaren gelassen, ob der Verkündungstermin stattfinden soll oder nicht und erst auf entsprechende gerichtliche Anordnungen hin überhaupt Stellung genommen und reagiert. Dies rechtfertigt die Annahme außergewöhnlicher Umstände nach R.370.9(e)VerfO.

TENOR DER ENTSCHEIDUNG:
1. Die Rücknahme der Klage wird auf Antrag der Klägerin und mit Zustimmung der Beklagten zugelassen.
2. Der Verkündungstermin wird aufgehoben.
3. Das Verfahren wird für beendet erklärt.
4. Diese Entscheidung soll in das Register aufgenommen werden.
5. Die Gerichtskosten trägt die Klägerin.
6. Es wird festgestellt, dass keine Gerichtsgebühren zu erstatten sind.
7. Der Streitwert wird auf 6.000.000,- EUR festgesetzt.

Facts and grounds
The plaintiff and the defendants have jointly declared that they have reached a settlement. The plaintiff has filed a request for the withdrawal of the action, which the defendants have agreed to. The parties have stated that they will not submit any claims for costs. The withdrawal of the action was therefore granted.
Court fees will not be reimbursed in accordance with rules 370.9.(b) and (e) of the RoP. The decision had been fully drafted and signed at the time of withdrawal and only needed to be uploaded, which was known to the parties. In addition, the parties left the court in the dark until the last second as to whether the date of the pronouncement was to take place or not and only commented and reacted after receiving corresponding court orders. This justifies the assumption of exceptional circumstances under R.370.9(e) RoP.
