GEGENSTAND: R. 262A VerfO – Schutz vertraulicher Informationen
GRÜNDE DER ANORDNUNG:
I.
Der auf den Schutz von Geschäftsgeheimnissen und sonstiger vertraulicher Informationen gerich-tete Antrag der Beklagten zu 1), 2) und 6) ist zulässig und hat in der Sache Erfolg.

Nach Art. 9 Abs. 1 und 2 lit. a) der Richtlinie (EU) 2016/943 ist vorgesehen, dass in einem gericht-lichen Verfahren auf Antrag der Zugang zu von den Parteien oder Dritten vorgelegten Dokumen-ten, die Geschäftsgeheimnisse oder angebliche Geschäftsgeheimnisse enthalten, ganz oder teil-weise auf eine begrenzte Anzahl von Personen beschränkt werden kann. Der Schutz vertraulicher Informationen ist im EPGÜ in Art. 58 vorgesehen und in der Verfahrensordnung des Einheitlichen Patentgerichts in R. 262A implementiert (vgl. UPC_CFI_54/2023 (LK Hamburg), Anordnung v. 23. November 2023 – Avago Technologies International v. Tesla Germany; UPC_CFI_463/2023 (LK Düs-seldorf), Anordnung v. 11. März 2024 – 10x Genomics v. Curio Bioscience; UPC_CFI_16/2024 (LK Düsseldorf), Anordnung v. 22. April 2024 – Ortovox v. Mammut).

Die durch R. 262A.2 und 3 VerfO normierten formellen Anforderungen sind gewahrt. Auch wurden die Vertreter der Klägerinnen, wie von R. 262A.4 VerfO gefordert, vor dem Erlass einer Schutzan-ordnung gehört. Sie haben von der ihnen eingeräumten Möglichkeit zur Stellungnahme Gebrauch gemacht.
II.
Gegen die Einordnung der unter 1. des Tenors genannten Informationen als geheimhaltungsbe-dürftig haben die Klägerinnen zu Recht keine Einwände erhoben, so dass es insoweit keiner wei-teren Ausführungen Bedarf. Die Klägerinnen haben allerdings zu Recht darauf hingewiesen, dass die Anlage BBY 9 nur in der geschwärzten Fassung im CMS hochgeladen wurde. Die als “unredac-ted“ gekennzeichnete Fassung der Anlage BBY 9 ist identisch mit der als “redacted“ gekennzeich-neten Fassung.
Der Kreis der Zugangsberechtigten entspricht dem übereinstimmend erklärten Willen der Par-teien, wobei die namentlich benannten Vertreter der Klägerinnen in Übereinstimmung mit dem Antrag der Beklagten zu 1), 2) und 6) von den Klägerinnen benannt worden sind.
ANORDNUNG:
1. Die in den grau unterlegten Textabschnitten der ungeschwärzten Fassung des Schrift-satzes vom 13. Mai 2025 (Antrag nach R. 352 VerfO, App_22466/2025) enthaltenen Informationen sowie die in den ungeschwärzten Versionen der Anlagen BBY 1, BBY 6 (mit Übersetzung BBY 6a) und BBY 9 (mit Übersetzung BBY 9a) enthaltenen Informati-onen, die in den geschwärzten Versionen der genannten Anlagen geschwärzt sind, werden als geheimhaltungsbedürftig im Sinne von Art. 58 EPGÜ, R. 262.2 VerfO einge-stuft.
2. Der Zugang zu den unter 1. genannten Informationen wird auf Seiten der Klägerinnen beschränkt auf:
a) die Prozessbevollmächtigten der Klägerinnen im vorliegenden Verfahren,
b) die Hilfspersonen der Prozessbevollmächtigten (einschließlich Experten sowie ih-rer Teammitglieder),
c) […], Head Strategic IP Solutions bei der Klägerin zu 1),
d) […], Lead Patent Counsel Strategic IP Solutions bei der Roche Diagnostics GmbH.
3. Die in Ziffer 1. als vertraulich eingestuften Informationen sind von den unter 2. genann-ten Personen bis auf weiteres als solche zu behandeln und dürfen außerhalb dieses Gerichtsverfahrens nicht verwendet oder offengelegt werden, es sei denn, sie sind der empfangenden Partei außerhalb dieses Verfahrens zur Kenntnis gelangt, sofern die empfangende Partei sie nicht auf vertraulicher Grundlage aus einer anderen Quelle als von den Beklagten zu 1), 2) und 6) oder den mit diesen verbundenen Unternehmen erhalten hat und diese Quelle nicht durch eine Vertraulichkeitsvereinbarung mit den Beklagten zu 1), 2) und 6) oder den mit diesen verbundenen Unternehmen oder durch eine andere Geheimhaltungspflicht gebunden ist.
4. Bei schuldhafter Zuwiderhandlung gegen diese Anordnung kann das Gericht für jeden Fall der Zuwiderhandlung ein nach den Umständen des Einzelfalls zu bemessendes Zwangsgeld verhängen.
5. Den Beklagten zu 1), 2) und 6) wird aufgegeben, den Klägerinnen die ungeschwärzte Version der Anlage BBY 9 unter Verweis auf diese Geheimhaltungsanordnung zur Ver-fügung zu stellen. Dies kann durch E-Mail an die Prozessbevollmächtigten der Kläge-rinnen, bei das Gericht in cc gesetzt wird, erfolgen.

REASONS FOR THE ORDER:
I.
The request of defendants 1), 2) and 6) for the protection of trade secrets and other confidential information is admissible and successful on the merits.

According to Article 9(1) and (2)(a) of Directive (EU) 2016/943, in court proceedings, access to documents submitted by the parties or third parties that contain trade secrets or alleged trade secrets may be restricted in whole or in part to a limited number of persons upon request. The protection of confidential information is provided for in Article 58 of the UPCA and implemented in Rule 262A of the Rules of Procedure of the Unified Patent Court (see UPC_CFI_54/2023 (LK Hamburg), order of 23 November 2023 – Avago Technologies International v. Tesla Germany; UPC_CFI_463/2023 (LK Düsseldorf), order of 11 March 2024 – 10x Genomics v. Curio Bioscience; UPC_CFI_16/2024 (LK Düsseldorf), order of 22 April 2024 – Ortovox v. Mammut).

The formal requirements laid down in R. 262A.2 and 3 RoP have been complied with. The representatives of the plaintiffs were also heard before the protective order was issued, as required by R. 262A.4 RoP. They made use of the opportunity granted to them to comment.
II.
The plaintiffs did not raise any objections to the classification of the information referred to in point 1 of the operative part as confidential, so that no further comments are necessary in this regard.
However, the plaintiffs were right to point out that Annex BBY 9 was only uploaded to the CMS in the redacted version. The version of Annex BBY 9 marked as ‘unredacted’ is identical to the version marked as ‘redacted’.
The group of authorised persons corresponds to the unanimously declared will of the parties, whereby the named representatives of the plaintiffs have been appointed by the plaintiffs in accordance with the request of the defendants 1), 2) and 6).
ORDER:
1. The information contained in the grey-shaded sections of the unredacted version of the document dated 13 May 2025 (request pursuant to R. 352 RoP, App_22466/2025) and the information contained in the unredacted versions of Annexes BBY 1, BBY 6 (with translation BBY 6a) and BBY 9 (with translation BBY 9a), which are redacted in the redacted versions of the aforementioned annexes, are classified as confidential within the meaning of Art. 58 UPCA, R. 262.2 RoP.
2. Access to the information referred to in 1. shall be restricted on the part of the applicants to:
a) the applicants' legal representatives in the present proceedings,
b) the legal representatives' assistants (including experts and their team members),
c) [...], Head of Strategic IP Solutions at the first applicant,
d) [...], Lead Patent Counsel Strategic IP Solutions at Roche Diagnostics GmbH.
3. The information classified as confidential in section 1 shall be treated as such by the persons named in section 2 until further notice and may not be used or disclosed outside these court proceedings, unless it has come to the knowledge of the receiving party outside these proceedings, provided that the receiving party has not obtained it on a confidential basis from a source other than the defendants 1), 2) and 6) or their affiliated companies and this source is not bound by a confidentiality agreement with the defendants 1), 2) and 6) or their affiliated companies or by any other obligation of confidentiality.
4. In the event of a culpable breach of this order, the court may impose a penalty payment to be determined in accordance with the circumstances of the individual case for each instance of the breach.
5. Defendants 1), 2) and 6) are ordered to provide the plaintiffs with the unredacted version of Exhibit BBY 9, with reference to this confidentiality order. This can be done by email to the plaintiffs' legal representatives, with the court in cc.
