In data 16.4.2025 3V Sigma s.p.a. ha depositato un ricorso ai sensi dell’Art. 60.5 UPCA e rule 192 e ss. RoP per l’emissione di un ordine inaudita altera parte di protezione delle prove nei confronti di Azienda Chimica e Farmaceutica s.p.a. - A.C.E.F. s.p.a. e di Azienda Chimica e Farmaceutica s.r.l. - A.C.E.F. s.r.l. (di seguito, anche unitariamente, ACEF, salvo ove diversamente specificato), prima dell’avvio del giudizio di merito.
3V Sigma è il titolare dei brevetti EP’812 ed EP’426. Le due privative rivendicano, rispettivamente, (i) nuovi composti della famiglia delle s-triazine caratterizzati da un’elevata capacità di assorbimento dei raggi ultravioletti e (ii) composizioni cosmetiche contenenti i suddetti composti per la protezione di pelle e capelli dalle conseguenze dannose dell’esposizione alla luce solare.
3V Sigma espone che uno dei suoi concorrenti - MFCI CO., Ltd. con base a Hunagshi, Hubei, Cina - ha di recente lanciato sul mercato un nuovo filtro UVB per la preparazione di composizioni cosmetiche per la protezione solare, recante il nome commerciale MFSorb (513) DBT (di seguito MFSorb 513). Questo prodotto è destinato al circuito degli operatori professionali nel settore della produzione delle creme solari.
Le società ACEF distribuiscono i prodotti di MFCI e, in particolare, il filtro MFSorb 513. Le attività di vendita e promozione sono attualmente in corso di svolgimento, come è possibile ricavare dalla pubblicità presente sul sito internet www.acef.it, riconducibile ad ACEF s.r.l.. Con l’ausilio di un trader professionale parte ricorrente ha acquistato un campione di 25 kg di prodotto MFSorb 513 e lo ha fatto analizzare da un laboratorio esterno, ottenendo conferma della riproduzione di alcuni degli insegnamenti contenuti nelle rivendicazioni di EP’812 e di EP’426.
3V Sigma ha concluso chiedendo l’emissione di un ordine di protezione delle prove, giustificata dalla necessità di (i) prevenire qualsiasi possibile eccezione in ordine alla effettiva provenienza
dalle resistenti del campione di prodotto esaminato e di (ii) acquisire tutta la documentazione tecnica, contabile e commerciale relativa al filtro MFSorb 513. La definitiva conferma della sospettata contraffazione dei brevetti sua titolarità e l’identificazione di tutti i soggetti coinvolti nella filiera distributiva le avrebbe quindi consentito di avviare un successivo giudizio di merito per l’accertamento della violazione del brevetto.
Con order n. 21103/2025 depositato il 5.5.2025 il judge rapporteur, su delega del Panel, avvalendosi della facoltà prevista dalla rule 194.1(c) RoP, impregiudicata ogni possibile valutazione in ordine all’eventuale accoglimento della domanda, ha disposto la convocazione del richiedente all’udienza del 7.5.2025 al fine di richiedere le seguenti integrazioni del ricorso: (i) l’indicazione di un elenco di parole chiave da utilizzare per la ricerca e la successiva acquisizione di copia di documenti in formato digitale potenzialmente rilevanti; (ii) l’indicazione dei nominativi dei representatives e degli esperti di parte autorizzati ad essere personalmente presenti durante l’esecuzione dell’order; (iii) l’indicazione precisa dei luoghi dove le misure richieste avrebbero dovuto essere eseguite.
In ottemperanza a tale invito, il richiedente ha depositato una nota difensiva integrativa in data 8.5.2025 (app. n. 21787/2025).
ORDINE RICHIESTO DA 3V SIGMA
La ricorrente ha chiesto che la Divisione Locale di Milano del Tribunale Unificato dei Brevetti emetta un order inaudita altera parte di protezione delle prove nei confronti delle resistenti ACEF disponendo:
1. la descrizione e il prelevamento di campioni del prodotto MFSorb 513 importato, promosso e commercializzato o distribuito dalle resistenti. Il prelevamento e la conservazione dei campioni di prodotto dovranno essere effettuati con ogni e più opportuna modalità idonea a preservarne le caratteristiche anche in vista delle analisi di laboratorio che 3V Sigma si riserverà di chiedere nel successivo giudizio di merito ex Art. 53.1(g) UPCA, rules 170.2(g) e/o 201 RoP;
2. la descrizione e il prelevamento di copia di tutta la documentazione tecnica (ivi inclusi, senza limitazione: schede tecniche, manuali d’uso, specifiche di prodotto, documentazione di magazzino, certificati di produzione e controllo qualità, report di analisi, etc.) e commerciale (ivi inclusi, senza limitazione: corrispondenza, contratti di fornitura, contratti di vendita, etc.) relativa al prodotto MFSorb 513 importato, promosso e commercializzato o distribuito dalle resistenti, che permetta di individuarne le caratteristiche rilevanti a valutarne la contraffazione di EP’872 ed EP’426;
3. la descrizione e il prelevamento di copia di tutta la documentazione contabile e commerciale relativa alle attività di importazione, promozione, distribuzione e commercializzazione del prodotto MFSorb 513 da parte delle resistenti nonché di qualsivoglia altro terzo, e in particolare (anche se in via non limitativa) la corrispondenza commerciale, i registri IVA, ordini, documenti di trasporto, e fatture ricevute per l’acquisto dell’MFSorb 513 e le fatture emesse per la successiva rivendita dello stesso, al fine di individuare tutti i soggetti oltre alle resistenti a qualsiasi titolo coinvolti nella catena produttiva/distributiva del prodotto MFSorb 513.
La misura di preservation of evidence richiesta dovrà essere eseguita:
a) presso qualunque sede, sede secondaria o unità locale, pertinenze, magazzini, uffici, stabilimenti, impianti ed altri siti, anche appartenenti a soggetti terzi, che si trovino nella disponibilità e/o siano in qualsiasi modo utilizzati dalle resistenti per l’attività aziendale, nonché nei luoghi o presso i professionisti negli studi dei quali la documentazione oggetto del provvedimento sia conservata;
b) nominando ai sensi della rule 196.4 RoP un esperto tecnico selezionato tra i consulenti brevettuali in materia chimico-farmaceutica, e un esperto tecnico-informatico per permettere l’accesso alla documentazione tecnica e agli strumenti informatici, nonché a supporti anche digitali di qualsiasi natura, autorizzando gli stessi a compiere ogni attività utile all’espletamento della finalità del provvedimento e ad avere accesso a qualsiasi tipo di locale, magazzino, laboratorio, ufficio o altro sito pertinente, autorizzando la ricerca di ogni e qualsivoglia oggetto o documento rilevante ai fini della descrizione, nonché l’accesso ai dispositivi informatici, account online e/o alla documentazione cartacea ed elettronica su cui siano presenti informazioni relative all’illecito di cui in narrativa, autorizzando gli stessi a effettuare copia della documentazione rilevante con le modalità ritenute più idonee, anche di copia forense, e con facoltà di farsi assistere da rispettivi ausiliari se necessario, anche a fronte della necessità di eseguire le operazioni di descrizione contemporaneamente presso più luoghi nella disponibilità delle resistenti;
c) autorizzando la presenza di rappresentanti della parte ricorrente allo svolgimento delle operazioni di esecuzione del provvedimento, nelle persone dei sottoscritti legali della stessa, nonché di uno o più consulenti tecnici e informatici da essi delegati, ai sensi della rule 196.3 RoP.
La ricorrente ha inoltre chiesto di essere autorizzata ad accedere al report dell’esperto nominato dal Tribunale nonché a tutto il materiale raccolto nel corso delle operazioni di attuazione dell’order di protezione delle prove, immediatamente dopo il loro deposito, al fine di esercitare il proprio diritto di difesa in vista dell’instaurazione del giudizio di merito entro i termini stabiliti nell’emanando provvedimento e decorrenti dall’accesso al suddetto report e alle suddette informazioni.
MOTIVI DELL’ORDER
1. Giurisdizione e competenza.
Il Tribunale Unificato dei Brevetti ha giurisdizione rispetto all’application depositata da 3V Sigma, in conformità alle previsioni degli Artt. 32.1(c) e 60.1 UPCA considerato che:
a) i due titoli azionati dalla ricorrente sono brevetti europei per i quali in data 14.4.2025 la società titolare ha revocato la propria dichiarazione di opt-out, ai sensi dell’art. 83, comma 4, UPCA e della rule 5.7 RoP (v. doc. TC14a e TC14b);
b) la domanda qui svolta è ricompresa da quelle rientranti nelle controversie di cui all’Art. 32.1 (c) UPCA (azioni per misure provvisorie e cautelari e ingiunzioni).
I due brevetti sono in vigore, inter alia, in Italia, come risulta dell’estratto del registro dell’Ufficio Italiano Brevetti e Marchi (v. doc. TC13)
La Divisione Locale di Milano è competente ai sensi degli Artt. 32.1(c) e 33.1(b) UPCA, poiché le società ACEF hanno la loro sede legale in Italia - in Fiorenzuola D’Arda (PC), via Umbria n. 8/14 (v. doc. TC02 e TC03) - e qui esercitano la propria attività d’impresa, ai sensi degli artt. 4 e 71a, Regolamento UE n. 1215/2012.
Da ultimo, il ricorso è stato depositato davanti alla Divisione Locale di Milano, dove 3V Sigma intende iniziare il giudizio di merito ai sensi degli Artt. 32.1(a) e 33.1(b) UPCA, in conformità alle previsioni della rule 192.1 RoP.
2. Sussistenza dei requisiti indicati dalla rule 192.2 RoP
2.1. Contenuto della domanda
Il ricorso per la protezione delle prove contiene:
(a) tutti gli elementi di dettaglio richiesti dalla rule 13.1, lettere da (a) a (i), RoP;
(b) una chiara indicazione delle misure richieste, compresa l’esatta ubicazione - in quanto nota o ragionevolmente sospettata - delle prove da conservare (sedi degli uffici e dei magazzini, come da nota integrativa depositata l’8.5.2025);
(c) le ragioni per cui le misure proposte sono necessarie per conservare le prove rilevanti;
(d) i fatti e le prove addotti a sostegno della domanda.
2.2. Concisa descrizione del futuro giudizio di merito
Sulla base delle prove ottenute all’esito del presente procedimento, 3V Sigma ha chiarito che intende avviare un successivo giudizio di merito dinanzi alla Divisione Locale di Milano nei confronti delle resistenti ACEF e di qualsiasi altro soggetto che dovesse risultare coinvolto nella catena produttiva e distributiva del prodotto MFSorb 513, al fine di (i) accertare la contraffazione dei brevetti EP’872 ed EP’426, (ii) ottenere l’emissione di un’inibitoria permanente ai sensi dell’Art. 63 UPCA, (iii) ottenere l’emissione di ogni altra ulteriore e appropriata misura ancillare o correttiva ai sensi dell’Art. 64 UPCA, nonché (iv) ottenere il risarcimento dei danni ai sensi dell’Art. 68 UPCA.
Di conseguenza, le condizioni previste dalla rule 192.2 RoP sono pienamene soddisfatte.
3. Onere della prova per il richiedente ai sensi dell’Art. 60 UPCA - prove ragionevolmente disponibili fornite dal richiedente
3.1. Titolarità di brevetti validi
3V Sigma ha dimostrato di essere la titolare attuale dei brevetti EP’872 ed EP’426 (vedi doc. TC11 e TC12), concessi - rispettivamente - in data 5.5.2021 e in data 4.9.2019 e come tali assistiti da una presunzione di validità (v. Corte di Giustizia C-44/21, 28 aprile 2022, par. 41).
Parte ricorrente ha dichiarato che non è stata presentata alcuna opposizione presso l’Ufficio Europeo dei Brevetti e non ha segnalato l’esistenza di alcuna azione di revoca / nullità intentata dinanzi a tribunali nazionali, come richiesto dalle rules 13.1(h) e 192.2(a) RoP, né alcun altra circostanza relativa alla validità dei brevetti oggetto di causa in grado di influenzare la decisione del Tribunale sulla emissione o meno di un order inaudita altera parte (cfr. rule 192.3 RoP, secondo periodo).
Allo stato attuale degli atti, il Tribunale non dispone di elementi per dubitare della validità dei brevetti oggetto di causa, né tantomeno vi sono motivi per dubitare che la ricorrente abbia taciuto informazioni rilevanti.
L’esame del Registry ha inoltre consentito di verificare che non sono state depositate protective letters dalle resistenti.
3.2. Allegazioni del ricorrente in tema di contraffazione dei brevetti
EP’872 protegge nuovi composti chimici triazinici caratterizzati dalla presenza di una core structure costituita da una triazina simmetrica e aventi una elevata capacità di assorbimento dei filtri solari, in particolare della regione UV-B, e il loro utilizzo per la realizzazione di formulazioni o creme per la protezione di luce solare. Secondo la prospettazione del ricorrente, nel presente caso assumono rilevanza - in particolare - le rivendicazioni 2, 3, 4, 5 e 6.
I composti chimici descritti in EP’872 rientrano in una formula di struttura generale (I) descritta al par. [0019]. La rivendicazione indipendente 1 si riferisce a composti rientranti nella formula generale (I) e caratterizzati dalle sostituzioni dei gruppi sostituenti X, A e B descritte al par. [0019].
La rivendicazione dipendente 2 rivendica composti di cui alla suddetta formula (I) selezionati proprio tra i composti di formula (V), (VI) o (VII), descritti al par. [0021].
La rivendicazione 3 rivendica i composti delle rivendicazioni precedenti selezionati tra i composti di formula (V), (VI) o (VII) in cui il rapporto tra la capacità di assorbimento nella regione UV-A e la capacità di assorbimento nella regione UV-B è superiore a un rapporto UV-A/UV-B di 0.20 e preferibilmente superiore a un rapporto UV-A/UV-B di 0.30.
Le successive rivendicazioni dipendenti 4 e 5 riguardano composizioni cosmetiche contenenti i composti delle rivendicazioni precedenti selezionati tra i composti di formula (V), (VI) o (VII), da soli o in miscela con altri filtri aventi proprietà di assorbimento dei raggi UV-A e UV-B (rivendicazione 4) e da soli o in miscela con filtri aventi proprietà di assorbimento dei raggi UV-A UV-B specificamente individuati.
La rivendicazione dipendente 6 è una rivendicazione d’uso dei composti delle rivendicazioni 1 e 2 per la protezione della pelle e dei capelli.
EP’426 protegge composizioni cosmetiche rivolte alla protezione di pelle e capelli dalle radiazioni UV, in modo che l’utilizzo di una combinazione di più filtri solari sia in grado di fornire un’ampia protezione sia contro i raggi UV-A. Le combinazioni di più filtri solari nelle formule cosmetiche sono necessarie anche per conferire altre proprietà essenziali o desiderabili, quali - ad esempio - stabilità rispetto all’esposizione a luce e calore, buona compatibilità con altre sostanze usate nella formulazione, resistenza all’acqua e buona aderenza alla pelle.
Secondo la prospettazione del ricorrente, nel presente caso assumono rilevanza - in particolare - le rivendicazioni dipendenti 3, 4, 5 e 6.
La rivendicazione indipendente 1 ha ad oggetto composizioni cosmetiche per uso topico per la protezione dai raggi UV di pelle e capelli comprendenti:
- almeno un agente o filtro solare (a) selezionato tra quelli ricompresi nella formula generale (I) e caratterizzati dalle sostituzioni dei gruppi sostituenti A e B descritte al paragrafo [0019] e
- almeno un altro agente o filtro UV (b) scelto fra p-metossicinnamato di 2-etilesile, 2-idrossi-4-metossibenzofenone, acido 2-idrossi-4-metossibenzofenone-5 solfonico, etilesil salicilato, etilesil dimetil PABA, drometrizolo trisilossano, 3-(4’-metilbenzilidene)-d, l-canfora, dietilesil butamido triazone, Etilesil Triazone, 4-(terz-butil)-4’-metossi-dibenzoilmetano, estere 2-etilesilico dell’acido 2-ciano-3, 3-difenilacrilico, bis-etilesilossifenol-metossifeniltriazina, metilene-bis-benzotriazolil-tetrametilbutilfenolo, 2-(4-dietilammino- 2-idrossibenzoil)-esil estere dell’acido benzoico, 2,4-bis-[4-[5-(1,1-dimetilpropil) benzoxazol-2-il]fenilimino]-6-[(2-etilesil)imino]-1,3,5-triazina, trisbifeniltriazina, biossido di titanio e zinco ossido e,
- opzionalmente, altri componenti come solventi, diluenti, ausiliari e carriers normalmente usati in campo cosmetico.
La rivendicazione dipendente 3 è diretta alle composizioni cosmetiche delle rivendicazioni 1 e 2 in cui l’agente o filtro (a) è selezionato tra i composti di formula (V), (VI) e (VII) descritti in EP’426 (e in EP’872).
La rivendicazione dipendente 4 si riferisce alle composizioni cosmetiche delle rivendicazioni da 1 a 3 in cui il componente (a) (agente o filtro UV) ha un rapporto tra la capacità di assorbimento nella regione UV-A e la capacità di assorbimento nella regione UV-B superiore a 0.20 e preferibilmente superiore 0.30.
La rivendicazione dipendente 5 riguarda le composizioni cosmetiche delle rivendicazioni precedenti in cui il componente (b) è selezionato da un più ristretto elenco di filtri UV già noti.
La rivendicazione 6 ha ad oggetto l’uso delle composizioni cosmetiche delle rivendicazioni da 1 a 4 come schermo solare per la protezione di pelle e capelli.
Le società ACEF sono attive, tra l’altro, nella vendita di materie prime per l’industria cosmetica (v. doc. TC02, TC03, TC16a e TC16b).
ACEF s.r.l. distribuisce i prodotti di MFCI Co., Ltd. (v. doc. TC6) e, in particolare, il filtro denominato MFSorb 513 impiegato per la preparazione di composizioni cosmetiche per la protezione solare e descritto sul sito internet di MFCI come “un filtro UVB ad altre prestazioni con un’eccezionale estinzione specifica di 1500” (v. doc. TC7).
ACEF s.r.l. promuove la vendita del filtro MFSorb 513 sul suo sito internet www.acef.it (v. doc. TC10 e TC15).
3V Sigma si è rivolta a un trader specializzato per acquistare un campione di MFSorb 513. L’acquisto è stato effettuato il 3.3.2025 e ha avuto ad oggetto una latta di 25 kg di prodotto proveniente dal Lotto identificato con il codice n. W1268804 (v. doc. TC17).
Il campione di prodotto è stato quindi consegnato a un laboratorio di analisi esterno in data 25.3.2025, al fine di verificare la presenza nel MFSorb 513 dei composti di formula (V), (VI) e (VII) descritti nei due brevetti oggetto di causa.
Il report di analisi è stato rilasciato il 2.4.2025 e ha concluso in questi termini (v. doc. TC18):
“on the base of the results reportes above, it can be concluded that:
- the HPLC-UV traces obtained are comparable with those provided by the customer
- the signals attributed to dimeramides D, E and F are detectable
- the in-depth analysis by HPLC-MS confirmed the presence of dimeramides E and F in
the sample
- the in-depth analysis by HPLC-MS excluded the presence of dimeramide D in the
sample”.
3V Sigma ha fatto esaminare il report a un esperto tecnico di sua fiducia. Questi ha concluso
nel senso che le analisi effettuate dal laboratorio incaricato permettono di confermare la
presenza nel campione di MFSorb 513 fornito da 3V Sigma di dimerammidi E e dimerammidi
F, corrispondenti alle strutture rispettivamente di formula (VII) e di formula (VI) che risultano
descritte e rivendicate in EP’872 e in EP’426 (v. doc. TC19).
Allo stato attuale degli atti, il Tribunale osserva che parte ricorrente ha fornito prove ragionevoli
a sostegno del fondato sospetto della violazione dei brevetti di sua titolarità, in particolare da
parte della resistente ACEF s.r.l.. L’onere probatorio a carico del ricorrente probatorio deve
essere peraltro modulato in base al contenuto della domanda che, nel caso di specie, incide su
di un diritto processuale (alla prova) e non su un diritto di natura sostanziale (come nel caso di
inibitoria e/o risarcimento del danno).
Parte ricorrente ha il fondato timore che le società ACEF possano contestare l’identità di
caratteristiche tra il campione di prodotto fatto esaminare e l’MFSorb 513 da loro
commercializzato. Ha inoltre chiarito di non avere la possibilità di acquistare il prodotto dalle
resistenti a causa del rapporto di concorrenza diretta esistente con le controparti, tale da
precludere la possibilità di attivare un canale di vendita.
Il Tribunale ritiene quindi che l’acquisizione di alcune delle prove richieste sia indispensabile
ai fine di ottenere una definitiva conferma del sospetto dell’interferenza.
4. Requisiti previsti dalle rules 194.2 and 197 RoP
Ai sensi delle rules 194.2 e 197 RoP, il Tribunale, nell’esercizio del suo potere discrezionale di
decidere sulla domanda senza sentire il resistente - come previsto dalla rule 194.1(d) RoP - deve
tenere conto dell’urgenza della domanda e dei motivi per concedere un’ordinanza inaudita
altera parte.
In conformità alle previsioni della rule 197 RoP, il Tribunale può ordinare misure per la protezione delle prove “without the defendant having been heard”, in particolare “where there is a demonstrable risk of evidence being destroyed or otherwise ceasing to be available”.
Nel caso in esame è provata la sussistenza di tale rischio.
4.1. Urgenza
I risultati dei testi di laboratorio e la valutazione dell’esperto di parte sono divenuti disponibili pochi giorni prima del deposito del ricorso.
3V Sigma non è in posizione di procedere a un acquisto diretto di ulteriore campione di prodotto presso ACEF, in virtù del rapporto di concorrenza diretto esistente tra le parti in causa.
È poi evidente che parte ricorrente non abbia alcuna possibilità di reperire ulteriore documentazione tecnica riferita al MFSorb 513.
Come si è già osservato in precedenza, l’attività di promozione e commercializzazione del MFSorb 513 è in corso di svolgimento. La ricorrente ha quindi la necessità di ottenere una conferma in tempi ragionevolmente rapidi del sospetto di contraffazione dei brevetti di sua titolarità, in modo da avviare un successivo giudizio di merito.
4.2. Ragioni per concedere un ordine senza sentire il resistente - rischio di distruzione delle prove
Uno dei principali obbiettivi della ricorrente è di ottenere copia dei documenti tecnici relativi al MFSorb 513 conservati dalle resistenti in formato digitale.
È generalmente noto che i dati digitali e i file possono essere facilmente nascosti o cancellati nella eventualità in cui la parte resistente venga avvisata in anticipo della richiesta di un ordine di protezione delle prove.
Pertanto, vi è il rischio concreto che le prove in formato digitale possano essere facilmente rimosse od occultate nel caso in cui le società resistenti siano ascoltate in udienza o comunque informate dell’esistenza del presente procedimento prima dell’esecuzione della misura.
Di conseguenza, tenendo conto di tutti fattori potenzialmente rilevanti, questo order deve essere concesso inaudita altera parte, perché esiste un rischio dimostrabile che le prove possano essere distrutte o comunque cessare di essere disponibili (art. 60.5 UPCA).
5. Pagamento delle court fees
Le court fees sono state regolarmente pagate (v. doc. TC22). Sono pertanto soddisfatte le condizioni previste dalla rule 192.5 RoP.
6. Bilanciamento degli interessi in conflitto e modalità di esecuzione
6.1. Bilanciamento degli interessi
La ponderazione degli interessi in conflitto conduce il Tribunale a ritenere di concedere la misura, considerando il potenziale rischio di danno per ciascuna delle parti, in caso di concessione - per la sola resistente ACEF s.r.l. - o di diniego della misura - a carico del ricorrente.
Tenendo conto del principio di proporzionalità, la minaccia di distruzione definitiva delle prove a carico di 3V Sigma deve essere ritenuta prevalente rispetto ai rischi derivanti dall’esecuzione delle misure a carico di ACEF s.r.l.. Tali misure hanno una natura strettamente processuale, limitandosi a consentire la raccolta delle prove e non incidono in modo diretto sulle posizioni soggettive della resistente e sulla sua attività commerciale, salvo alcuni limitati effetti che saranno considerati in seguito a fini della quantificazione della cauzione.
In questo caso il Tribunale ritiene che la richiesta di emissione di un ordine inaudita altera parte per la protezione delle prove sia adeguatamente giustificata e deve pertanto essere accolta, con alcune limitazioni oggettive e soggettive come qui di seguito specificate.
6.2. Limitazione oggettiva e soggettiva della misura
Da un punto di vista oggettivo, Il Tribunale ritiene che la misura vada concessa limitatamente all’acquisizione di alcuni campioni di prodotto MFSorb 513 e della documentazione tecnica riferibile a questo stesso prodotto, con esclusione della documentazione contabile e commerciale. L’application è infatti diretta, innanzitutto, a verificare e a suffragare i sospetti circa la natura contraffattoria del prodotto distribuito dalle resistenti.
L’acquisizione dei documenti contabili e commerciali è invece strumentale, da un lato, a identificare altri soggetti potenzialmente coinvolti nelle attività promozionali e distributive e, dall’altro, a fornire evidenza dei volumi di vendita ai fini della determinazione del danno risarcibile. È noto che le società di diritto italiano sono soggette a specifici obblighi di conservazione delle scritture contabili e sul punto non sono state neppure allegati rischi di possibile distruzione o occultamento di questi documenti. Inoltre, le regole processuali vigenti in ambito TUB consentono di ottenere - a determinate condizioni - nel corso del successivo giudizio di merito informazioni complete su tutti i profili indicati. Si richiamano sul punto le previsioni generali contenute nell’Art. 67 UPCA e nelle rule 190 e 191 RoP.
Il precedente richiamato dal ricorrente a supporto della propria richiesta di acquisizione dei documenti contabili non appare pertinente. Dalla lettura del provvedimento citato (v. Divisione
Locale di Düsseldorf, UPC CFI n. 539/2024, order del 18.10.2024) si ricava infatti che in quel caso la parte ricorrente aveva già ripetutamente richiesto alla sua controparte di fornire informazioni sui canali di distribuzione e di approvvigionamento nonché sull’identità del fornitore, senza esito alcuno. Nel caso all’esame di questa Divisione Locale, invece, non vi è alcuna evidenza di un analogo ostinato rifiuto da parte dei resistenti.
Sotto il profilo soggettivo, il Tribunale ritiene che la misura di protezione delle prove possa essere autorizzata solo nei confronti di ACEF s.r.l., con esecuzione della stessa presso la sua sede legale, includendo uffici e magazzini nella sua disponibilità presenti a questo stesso indirizzo, e non anche nei confronti di ACEF s.p.a..
Dall’esame dei documenti allegati dal ricorrente, risulta che tutte le condotte potenzialmente contraffattorie lamentate - promozione, commercializzazione, vendita di MFSorb 513 - siano riferibili soltanto ad ACEF s.r.l..
ACEF s.p.a. detiene l’intero capitale sociale di ACEF s.r.l. (v. doc. TC03). Tuttavia, la sola circostanza del controllo societario esercitato da ACEF s.p.a. non appare sufficiente a giustificare un’estensione dell’ordine di protezione delle prove nei suoi confronti. Allo stato degli atti non vi è infatti alcun riscontro di un suo diretto coinvolgimento nelle condotte di violazione del brevetto lamentate dalla ricorrente.
6.3 Modalità di esecuzione
Ai sensi della rule 196.4 RoP, le misure autorizzate debbono essere attuate da un esperto nominato dal Tribunale - specificamente menzionato nel dispositivo - in conformità alla legge nazionale del luogo in cui le misure sono eseguite, ossia la legge italiana.
L’esperto designato è incluso nell’elenco degli esperti in materia brevettuale che sono soliti collaborare con i tribunali nazionali, in modo che la scelta garantisca competenza, indipendenza e imparzialità, come richiesto dalla rule 196.5 RoP. L’esperto sarà supportato da un ausiliario di sua fiducia, in particolare da un esperto in informatica forense, per procedere presso la sede della resistente ACEF s.r.l..
La ricerca e la copia di documenti in formato digitale su supporti e dispositivi utilizzati dalla resistente ACEF s.r.l. saranno effettuate sulla base dell’elenco delle keywords indicate dalla ricorrente nella memoria integrativa depositata in data 8.5.2025.
Questo metodo di selezione dei dati ha lo scopo di garantire la più elevata probabilità di effettiva rilevanza e correlazione tra i documenti recuperati e la violazione dei brevetti come lamentata dal ricorrente.
L’ausiliario opererà sotto il diretto controllo e la diretta responsabilità dell’esperto ed è soggetto agli stessi obblighi professionali di riservatezza in relazione a tutte le informazioni a cui ha accesso nell’esercizio delle sue funzioni.
Il compito demandato all’esperto e al suo ausiliario è di proteggere le prove. Il presente provvedimento viene emesso inaudita altera parte e l’esperto nominato dal Tribunale si trova nelle condizioni di operare soltanto sulla base di quanto illustrato dal ricorrente. Il dovere di agire in modo indipendente e imparziale esclude in radice che possa essere prestata qualsiasi attività di supporto consultivo alla parte ricorrente, dovendosi attenere soltanto alle istruzioni dettate dal Tribunale per l’esecuzione del presente provvedimento.
L’esperto nominato procederà assistito dall’ufficiale giudiziario competente.
All’esecuzione della misura autorizzata potranno essere presenti i rappresentanti della ricorrente e un esperto tecnico di parte, i cui nominativi sono indicati nel dispositivo del presente ordine. Nessun altro rappresentante, dipendente o collaboratore della ricorrente è quindi autorizzato a presenziare all’esecuzione delle misure.
La parte convenuta nei cui confronti è autorizzata la misura richiesta ha facoltà di contattare i propri legali e consulenti tecnici di parte in modo che possano prendere parte all’esecuzione dell’ordine di protezione delle prove, con l’espressa avvertenza che - in ogni caso - l’effettiva esecuzione del provvedimento non potrà essere ritardata in alcun modo.
L’esperto nominato dal Tribunale dovrà presentare una relazione scritta, insieme a una copia completa di tutti i documenti e i dati acquisiti a seguito dell’esecuzione delle misure, immediatamente e non oltre due giorni dopo il completamento dell’esecuzione delle misure.
Per ragioni di chiarezza, si precisa sin da ora che l’esperto nominato dal Tribunale ai sensi della rule 196.5 RoP non può essere equiparato alla figura del Court expert prevista dall’Art. 57 UPCA e dalle rules 185 e ss. RoP, con la conseguenza - in particolare - che i costi della per la sua attività professionale sono da anticipare a cura del ricorrente, salvo successiva definitiva regolazione delle spese di lite all’esito del giudizio di merito.
6.4. Tutela delle informazioni riservate
Come più volte precisato da questo Tribunale (Divisione Locale di Milano, UPC CFI n. 337/2024, order n. 51269/2024 dell’11.9.2024; Divisione Locale di Milano, UPC CFI n. 127/2025, order n. 11002/2025 del 18.3.2025) devono essere integralmente recepiti i principi di diritto stabiliti dalla Corte D’Appello nella sua decisione del 23.7.2024 (Apl. no. 20002/2024 - UPC CoA no. 177/2024), con la quale è stata fornita un’interpretazione sistematica in tema di ordine di protezione delle prove. Si riportano integralmente i passaggi motivazionali più rilevanti nel testo originale in lingua inglese.
An application for the preservation of evidence or inspection of premises within the meaning of Article 60 UPCA and rules 192 et seq. RoP implies a request to disclose to the applicant the outcome of the measures, including the report written by the person who carried out the measures. This follows from the fact that the legitimate purpose of the measures is the use of the evidence in proceedings on the merits of the case (rules 196.2 and 199.2 RoP), which includes the use of the evidence to decide whether to initiate proceedings on the merits and to determine whether and to what extent the evidence will be submitted in these proceedings.
Disclosure of the evidence to the applicant or to certain persons acting on behalf of the applicant is indispensable for that purpose. Moreover, rules 196.1 and 199.1 RoP provide that the Court may decide in its order that the evidence shall be disclosed to certain named persons and shall be subject to appropriate terms of non-disclosure. This confirms that the procedure initiated by an application under Article 60 UPCA aims at not merely the preservation of evidence and the inspection of premises as such, but also at the disclosure of the evidence to the applicant.
However, the granting of an application for preservation of evidence or inspection of premises does not imply an unconditional order to disclose the evidence to the applicant. Pursuant to Article 60(1) UPCA the order must be subject to the protection of confidential information (see also Article 7(1) of Directive 2004/48/EC of the European Parliament and of the Council of 29 April 2004 on the enforcement of intellectual property rights). Where the evidence may contain confidential information, this entails that the Court must hear the other party before deciding whether and to what extent to disclose the evidence to the applicant. In this context, the Court must give the other party access to the evidence and must provide that party with the opportunity to request the Court to keep certain information confidential and to provide reasons for such confidentiality. If the other party makes such a confidentiality request, the Court must provide the applicant with the opportunity to respond in a manner that respects the potential confidentiality interests of the other party. The Court may do this, for example, by granting access only to the representatives of the applicant whom the Court, pursuant to rule 196.3(a) RoP, has authorised to be present during the execution of the measures and subject to appropriate terms of non-disclosure.
The opportunity for the other party to make a confidentiality request must be distinguished from the remedies available against the order for the preservation of evidence or the inspection of premises, such as the review of an order for preservation of evidence without hearing the defendant pursuant to rule 197.3 RoP. Therefore, the Court must hear the other party on the request for disclosure even if this party has decided not to file a remedy against the order to preserve evidence or inspect premises. For the same reasons, the failure to apply for a review of an order for the preservation of evidence or for the inspection of premises, cannot not be considered as a tacit approval of the disclosure of evidence. 4. Pursuant to Article 60(8) UPCA the Court shall ensure that measures to preserve evidence or to inspect premises are revoked or otherwise cease to have effect, at the defendant’s request, if the applicant does not bring, within a period not exceeding 31 calendar days or 20 working days, whichever is longer, action leading to a decision on the merits of the case before the Court (see also Article 7(3) of Directive 2004/48/EC and Article 50(6) of the Agreement on Trade-Related Aspects of Intellectual Property Rights). Rules 198.1 and 199.2 RoP specify that the time period runs from the date specified in the Court’s order, taking into account the date when the report referred to in rule 196.4 RoP is to be presented. These rules must be interpreted in the light of the purpose of the measures for the preservation of evidence or inspection of premises, which is to use the outcome of these measures in the proceedings on the merits of the case (rules 196.2 and 199.2 RoP). In view of this, the Court must, as a general principle, specify in its order a time period that starts to run from the date of disclosure of the evidence to the applicant or from the date on which the Court has made a final decision not to grant the applicant access to the evidence.
È evidente che l’accesso ai sistemi e ai dispositivi informatici della resistente ACEF s.r.l. e l’acquisizione di alcuni dati in essi contenuti comporta il rischio concreto di una possibile estrazione di informazioni riservate.
Per questo motivo, la Corte ritiene che debba essere applicato uno standard di cautela molto elevato, impedendo temporaneamente qualsiasi accesso al contenuto della relazione dell’esperto e dei suoi allegati, anche da parte dei rappresentanti della ricorrente, e subordinando tale accesso all’effettiva verifica dell'esistenza di informazioni riservate meritevoli di tutela.
Come chiarito dalla Corte d’Appello, la domanda ai sensi dell’articolo 60 UPCA e della rule 192 RoP implica una richiesta di accesso da parte della ricorrente ai contenuti dei documenti acquisiti all’esito dell’esecuzione delle misure. Parte ricorrente non è tenuta a presentare alcuna ulteriore richiesta di accesso dopo l’esecuzione della misura. Il report dell’esperto e i suoi allegati saranno depositati presso la Cancelleria della Divisione Locale di Milano e la ricorrente avrà pieno accesso ad essi a partire dal 30.6.2025, a meno che la resistente non si avvalga della possibilità di richiedere la tutela delle informazioni riservate, indipendentemente dal fatto che altri rimedi - come la revisione o l’appello - siano effettivamente proposti.
L’accesso della ricorrente avverrà mediante ritiro di una copia (precedentemente messa a disposizione dall’esperto, come già previsto in questo ordine) presso la sede della Cancelleria, sotto la supervisione del judge rapporteur e con l’assistenza di un cancelliere. Le attività saranno riportate in un apposito verbale che sarà poi caricato sul CMS.
Se entro il 30.6.2025 la resistente avrà presentato effettivamente una richiesta di tutela delle informazioni riservate, il Tribunale stabilirà con uno specifico order, dopo aver consultato le parti, se, a chi e a quali informazioni sarà concesso l’accesso.
Le richieste di riesame e di appello possono essere presentate indipendentemente (v. successivi paragrafi 6.8 e 6.9) e l’esito di questi eventuali rimedi dovrà essere ovviamente rispettato.
Ai sensi dell’art. 60.8 UPCA e della rule 198 RoP, l’ordine di protezione delle prove sarà revocato o altrimenti cesserà di avere effetto, su richiesta della resistente, se la ricorrente non inizierà un’azione di merito dinanzi al Tribunale entro un periodo non superiore a 31 giorni di calendario o 20 giorni lavorativi, a seconda di quale sia il periodo più lungo, che inizierà a decorrere dalla data di accesso al contenuto delle prove da parte del ricorrente o dalla data in cui il Tribunale avrà preso la decisione finale di non concedere al richiedente l’accesso alle prove.
6.5. Restrizioni all’utilizzo del written report del Court expert
La relazione scritta dell’esperto e qualsiasi altro documento ottenuto all’esito dell’esecuzione dell’ordine di protezione delle prove potranno essere utilizzati solo nel successivo procedimento di merito, in conformità alle previsioni della rule 196.2 RoP.
6.6. Notifica
Tenuto conto della necessità di garantire l’effetto sorpresa, la notifica del ricorso - insieme al presente ordine - sarà effettuata dalla ricorrente secondo la legge nazionale italiana presso la sede della resistente ACEF s.r.l., immediatamente al momento dell’esecuzione del presente ordine, in ossequio alla rule 197.2 RoP.
6.7. Cauzione
Ai sensi delle rules 196.3 e 196.6 RoP, il Tribunale ordina a 3V Sigma di fornire una garanzia adeguata - anche come condizione per l’esecutività di questo ordine - per le spese legali e per l’eventuale risarcimento di qualsiasi danno subito o che potrebbe essere subito dalla resistente, mediante deposito dell’importo di 15.000 Euro.
Tale importo è quantificato tenendo anche conto del prezzo commerciale applicato per la vendita del prodotto MFSorb 513 (75 Euro al Kg) e della quantità di campione di prodotto che sarà verosimilmente necessario dovere prelevare, ovvero almeno 25 Kg complessivi provenienti - ove possibile - anche da diversi lotti di produzione. Questa merce campione non potrà infatti essere commercializzata da ACEF s.r.l..
Questo ordine diventerà efficace ed eseguibile solo dopo che la cauzione nella misura testé indicata sarà stata effettivamente versata dal ricorrente.
6.8. Riesame
Le parti resistenti possono richiedere il riesame di questo order, come previsto dall’Art. 60.6 UPCA e dalla rule 197.3 RoP.
6.9. Appello
Le parti possono presentare appello entro quindici giorni dalla notifica di questo ordine ai sensi dell’art. 73.2(a) UPCA e della rule 220.1 RoP.
ORDER
Il Tribunale Unificato dei Brevetti - Tribunale di Primo grado - Divisione Locale di Milano
1. ordina che alla ricorrente sia consentito nei soli confronti di ACEF s.r.l.:
a) di ottenere, raccogliere e conservare presso gli uffici, magazzini e altri locali nella disponibilità di ACEF s.r.l., ubicati presso la sua sede in Fiorenzuola D’Arda (PC) - via Umbria n. 8/14, tutta la documentazione tecnica relativa al prodotto denominato MFSorb 513, con esclusione della documentazione contabile e commerciale riferita al medesimo prodotto, previa verifica e accesso anche a tutti i supporti digitali e i supporti dati, su qualsiasi tipo di dispositivo, nella disponibilità e in uso alla resistente ACEF s.r.l., comprese unità/sistemi di archiviazione esterni e cloud; al fine di selezionare e raccogliere i documenti in formato digitale verranno utilizzate le keywords indicate dalla ricorrente nella nota autorizzata depositata in data 8.5.2025;
b) di procedere alla descrizione dettagliata dei prodotti identificati con il nome commerciale MFSorb 513 in quanto presenti presso uffici, magazzini e altri locali sopra indicati, con la realizzazione di video e di fotografie e con l’espressa autorizzazione a raccogliere dei campioni del prodotto MFSorb 513, provenienti -
ove possibile - anche da lotti di produzione differenti e comunque in un quantitativo
sufficiente ad eseguire in seguito eventuali analisi di laboratorio; la conservazione
dei campioni di prodotto cosi acquisiti dovrà avvenire secondo le modalità indicate
dall’esperto nominato dal Tribunale e comunque in modo da assicurare l’integrità
degli stessi per tutta la prevedibile durata del successivo giudizio di merito, a cura
di un custode che dovrà essere nominato secondo le disposizioni della legge italiana
sull’esecuzione dei provvedimenti giudiziari (e, in particolare, secondo la regola di
cui all’art. 521bis del codice di procedura civile italiano, individuando il custode in
un dipendente della resistente dalla stessa nominativamente indicato all’Ufficiale
Giudiziario al momento dell’esecuzione della misura e il cui nominativo e la
relativa qualifica andranno inserite nella relazione del Court expert);
2. ordina ad ACEF s.r.l. di consentire alle persone incaricate di eseguire il presente ordine
(i) di accedere ai locali sopra indicati e di proteggere le prove; (ii) di scattare fotografie o
girare filmati a scopo documentario, ove ritenuti rilevanti per la protezione delle prove
come ordinata; (iii) di consentire il pieno e completo accesso a tutti i documenti tecnici,
in qualsiasi formato, in suo possesso e nella sua disponibilità riguardanti solo e
strettamente il prodotto MFSorb 513, anche mediante accesso a qualsiasi tipo di
dispositivo, unità o sistema di archiviazione in uso, anche in cloud;
3. dispone che nel caso in cui il resistente non ottemperi spontaneamente a tali istruzioni, i
soggetti incaricati dell’esecuzione del provvedimento sono autorizzati - in conformità alle
disposizioni della legge italiana in materia di esecuzione dei provvedimenti giudiziari - a
richiedere l’intervento di un fabbro, a forzare l’accesso ai sistemi informatici e, in ogni
caso, a richiedere l’assistenza delle forze dell’ordine qualora ritenuto necessario;
4. dispone che il presente provvedimento sia eseguito, con l’Ufficiale Giudiziario
territorialmente competente dal dott. Diego Pallini Gervasi, con studio professionale in
- nominato quale Court Expert, assistito da un ausiliario
di sua fiducia esperto in informatica forense;
5. dispone che per la parte ricorrente sono autorizzati a essere presenti durante l’esecuzione
di questo ordine soltanto gli avvocati Luca Pellicciari e Lorenzo Battarino e l’esperto
tecnico di parte dott.ssa Silvia Bertuccio, con esclusione tassativa di qualunque altro
rappresentante, dipendente o collaboratore della ricorrente; i soggetti autorizzati sono
tenuti a mantenere riservate tutte le informazioni di cui verranno a conoscenza nel corso
dell’esecuzione di questo provvedimento;
6. ordina al Court Expert incaricato di presentare al Sub-Registry della Divisione Locale di Milano del Tribunale Unificato dei Brevetti una relazione scritta sui risultati dell’esecuzione dell’ordine di protezione delle prove, allegando tutti i documenti raccolti, subito dopo il completamento delle attività richieste e, in ogni caso, non oltre due giorni dopo la conclusione di tutte le operazioni; tre copie della suddetta relazione e dei documenti dovranno essere rese disponibili, una per il Tribunale e una per ciascuna delle parti;
7. dispone che la relazione scritta e qualsiasi altro risultato dell’esecuzione dell’ordine di protezione delle prove possano essere utilizzati solo nel successivo giudizio di merito;
8. dà atto che l’ordine di protezione delle prove sarà revocato o altrimenti cesserà di avere effetto, su richiesta della resistente, ove la ricorrente non introduca il giudizio di merito dinanzi al Tribunale entro un periodo non superiore a 31 giorni di calendario o 20 giorni lavorativi, a seconda di quale sia il periodo più lungo, che inizierà a decorrere dalla data di accesso al contenuto delle prove raccolte da parte del ricorrente o dalla data in cui il Tribunale avrà adottato la decisione finale di non concedere al richiedente l’accesso alle prove;
9. dispone che l’accesso alla relazione scritta del perito e ai suoi allegati sia consentito al ricorrente a partire dal 30.6.2025, presso la sede della Sub Registry della Divisione Locale di Milano, sotto la supervisione del judge rapporteur, con l’assistenza di un cancelliere, a meno che la resistente non si avvalga della facoltà di presentare un’istanza di tutela delle informazioni riservate entro il 30.6.2025; nel caso in cui tale istanza di riservatezza sarà effettivamente presentata, il Tribunale deciderà se e quali persone avranno accesso e a quali informazioni;
10. dispone che il presente ordine, unitamente a una copia del ricorso e dei relativi allegati, nonché alla letter of service e alla nota di istruzioni per l’accesso ai procedimenti mediante il CMS, sia notificato dalla ricorrente presso la sede della resistente immediatamente al momento dell’esecuzione del presente ordine, in conformità con la legge italiana in materia di notifica di atti giudiziari;
11. dispone che il presente ordine diventerà efficace ed eseguibile all’esito del versamento a cura del ricorrente di una cauzione di 15.000 Euro;
12. differisce ogni decisione sui costi al successivo procedimento di merito;
13. dà atto che la resistente può richiedere il riesame di questo ordine entro trenta giorni dall’esecuzione delle misure, ai sensi dell’Art. 60.6 UPCA e della rule 197.3 RoP;
14. dà atto che le parti possono presentare appello entro quindici giorni dalla notifica di questo ordine ai sensi dell’art. 73.2(a) UPCA e delle rules 220.1(c) e 224.2(b) RoP.

On 16 April 2025, 3V Sigma s.p.a. filed an appeal pursuant to Article 60.5 UPCA and Rule 192 et
seq. RoP for the issuance of an ex parte order for the protection of evidence against Azienda
Chimica e Farmaceutica s.p.a. - A.C.E.F. s.p.a. a n d Azienda Chimica e Farmaceutica s.r.l. -
A.C.E.F. s.r.l. (hereinafter also referred to collectively as ACEF, unless otherwise specified), prior
to the commencement of the proceedings on the merits.
3V Sigma is the owner of patents EP'812 and EP'426. The two patents claim, respectively, (i) new
compounds of the s-triazine family characterised by a high capacity to absorb ultraviolet rays and
(ii) cosmetic compositions containing the aforementioned compounds for the protection of skin
and hair from the harmful effects of exposure to sunlight.
3V Sigma states that one of its competitors, MFCI CO., Ltd., based in Hunagshi, Hubei, China,
has recently launched a new UVB filter for the preparation of cosmetic compositions for sun
protection, under the trade name MFSorb (513) DBT (hereinafter MFSorb 513). This product is
intended for professional operators in the sunscreen cream manufacturing sector.
ACEF distributes MFCI's products and, in particular, the MFSorb 513 filter. Sales and promotion
activities are currently underway, as can be seen from the advertising on the website www.acef.it,
which can be traced back to ACEF s.r.l.. With the help of a professional trader, the applicant
purchased a 25 kg sample of MFSorb 513 and had it analysed by an external laboratory, obtaining
confirmation of the reproduction of some of the teachings contained in the claims of EP'812 and
EP'426.
3V Sigma concluded by requesting the issuance of an order to preserve evidence, justified by the
need to (i) prevent any possible exception regarding the actual origin of the product sample examined by the defendants and (ii) to acquire all technical, accounting and
commercial documentation relating to the MFSorb 513 filter. The definitive confirmation of the
suspected infringement of its patents and the identification of all those involved in the distribution
chain would therefore enable it to initiate subsequent proceedings on the merits to ascertain the
infringement of the patent.
By order no. 21103/2025 filed on 5 May 2025, the judge rapporteur, acting on behalf of the Panel
and exercising the power provided for in rule 194.1(c) of the RoP, without prejudice to any
possible assessment of the merits of the application, ordered the applicant to appear at the hearing
on 7 May 2025 in order to request the following additions to the appeal:
(i) a list of keywords to be used for the search and subsequent acquisition of copies of potentially
relevant documents in digital format; (ii) the names of the representatives and experts authorised
to be personally present during the execution of the order; (iii) the precise indication of the places
where the requested measures should have been carried out.
In compliance with this request, the applicant filed a supplementary defence brief on 8 May 2025
(app. no. 21787/2025).
ORDER REQUESTED BY 3V SIGMA
The applicant requested that the Milan Local Division of the Unified Patent Court issue an order
inaudita altera parte for the protection of evidence against the defendants ACEF, ordering:
1. the description and sampling of the product MFSorb 513 imported, promoted, marketed or
distributed by the defendants. The sampling and storage of product samples must be carried out in
the most appropriate manner to preserve their characteristics, also in view of the laboratory
analyses that 3V Sigma reserves the right to request in the subsequent proceedings on the merits
pursuant to Article 53.1(g) UPCA, rules 170.2(g) and/or 201 RoP;
2. the description and collection of copies of all technical documentation (including, without
limitation: technical data sheets, user manuals, product specifications, warehouse documentation,
production and quality control certificates, analysis reports, etc.) and commercial documentation
(including, without limitation: correspondence, supply contracts, sales contracts, etc.) relating to
the MFSorb 513 product imported, promoted and marketed or distributed by the defendants,
which allows the relevant characteristics to be identified in order to assess the infringement of
3. the description and removal of copies of all accounting and commercial documentation relating
to the import, promotion, distribution and marketing of the MFSorb 513 product by the defendants
and any other third party, and in particular (but not limited to) commercial correspondence, VAT
records, orders, transport documents, and invoices received for the purchase of MFSorb 513 and
invoices issued for the subsequent resale thereof, in order to identify all persons other than the
defendants who are involved in any capacity in the production/distribution chain of the MFSorb
513 product.
The requested preservation of evidence measure shall be carried out:
a) at any premises, secondary premises or local units, appurtenances, warehouses, offices,
factories, plants and other sites, including those belonging to third parties, which are available to
and/or are in any way used by the defendants for their business activities, as well as at the
premises or offices of the professionals where the documentation subject to the order is kept;
b) appointing, pursuant to Rule 196.4 RoP, a technical expert selected from among patent
attorneys specialising in chemical and pharmaceutical matters, and a technical IT expert to allow
access to technical documentation and IT tools, as well as to digital media of any kind, authorising
them to carry out any activity necessary to fulfil the purpose of the measure and to have access to
any type of premises, warehouse, laboratory, office or other relevant site, authorising the search
for any and all objects or documents relevant to the description, as well as access to IT devices,
online accounts and/or paper and electronic documentation containing information relating to the
offence described above, authorising them to make copies of the relevant documentation in the
manner deemed most appropriate, including forensic copies, and with the right to be assisted by
their respective assistants if necessary, including in the event of the need to carry out the
description operations simultaneously at several locations available to the defendants;
c) authorising the presence of representatives of the applicant during the execution of the order, in
the persons of the undersigned legal representatives of the applicant, as well as one or more
technical and IT consultants appointed by them, in accordance with rule 196.3 RoP.
The appellant also requested authorisation to access the report of the expert appointed by the
Court and all the material gathered during the implementation of the order for the protection of
evidence, immediately after their filing, in order to exercise her right of defence in view of the
establishment of the proceedings on the merits within the time limits set out in the forthcoming order and starting from the date of access to the aforementioned report
and information.
GROUNDS FOR THE ORDER
1. Jurisdiction and competence.
The Unified Patent Court has jurisdiction over the application filed by 3V Sigma, in accordance
with the provisions of Articles 32.1(c) and 60.1 UPCA, considering that:
a) the two titles invoked by the applicant are European patents for which, on 14 April 2025, the
proprietor revoked its opt-out declaration, pursuant to Article 83(4) UPCA and Rule 5.7 RoP (see
documents TC14a and TC14b);
b) the claim made here is included among those falling within the disputes referred to in Article
32.1
(c) UPCA (actions for provisional and protective measures and injunctions).
The two patents are in force, inter alia, in Italy, as shown in the extract from the register of the
Italian Patent and Trademark Office (see doc. TC13).
The Milan Local Division has jurisdiction pursuant to Articles 32.1(c) and 33.1(b) UPCA, since
the ACEF companies have their registered offices in Italy - in Fiorenzuola D'Arda (PC), via
Umbria
n. 8/14 (see doc. TC02 and TC03) - and carry out their business activities here, pursuant to
Articles 4 and 71a of EU Regulation No. 1215/2012.
Finally, the appeal was filed with the Local Division of Milan, where 3V Sigma intends to
commence proceedings on the merits pursuant to Articles 32.1(a) and 33.1(b) UPCA, in
accordance with the provisions of Rule 192.1 RoP.
2. Existence of the requirements set out in Rule 192.2 RoP
2.1. Content of the application
The appeal for protection of evidence contains:
(a) all the details required by Rule 13.1, letters (a) to (i), RoP;
(b) a clear indication of the measures requested, including the exact location - as known or
reasonably suspected - of the evidence to be preserved (offices and warehouses, as per the
supplementary note filed on 8 May 2025);
(c) the reasons why the proposed measures are necessary to preserve relevant evidence;
(d) the facts and evidence in support of the request.
2.2. Concise description of the future judgment on the merits
Based on the evidence obtained at the end of these proceedings, 3V Sigma has made it clear that it
intends to bring subsequent proceedings on the merits before the Local Division of Milan against
the defendants ACEF and any other party involved in the production and distribution chain of the
product MFSorb 513, in order to (i) establish the infringement of patents EP'872 and EP'426, (ii)
obtain a permanent injunction pursuant to Article 63 of the UPCA, (iii) obtain any other further
and appropriate ancillary or corrective measures pursuant to Article 64 of the UPCA, and (iv)
obtain compensation for damages pursuant to Article 68 of the UPCA.
Consequently, the conditions set out in Rule 192.2 RoP are fully satisfied.
3. Burden of proof for the applicant under Article 60 UPCA - reasonably available evidence
provided by the applicant
3.1. Ownership of valid patents
3V Sigma has proven to be the current holder of patents EP'872 and EP'426 (see documents TC11
and TC12), granted on 5 May 2021 and 4 September 2019, respectively, and as such presumed
valid (see Court of Justice C-44/21, 28 April 2022, paragraph 41). The applicant has stated that no
opposition has been filed with the European Patent Office and has not reported the existence of
any revocation/invalidity proceedings before national courts, as required by rules 13.1(h) and
192.2(a) of the Rules of Procedure, nor any other circumstances relating to the validity of the
patents at issue that could influence the Court's decision on whether or not to issue an order
without hearing the other party (see Rule 192.3, second sentence, of the Rules of Procedure).
At this stage of the proceedings, the Court has no grounds to doubt the validity of the patents at
issue, nor are there any reasons to doubt that the applicant has withheld relevant information.
The Registry's examination also confirmed that no protective letters had been filed by the
defendants.
3.2. The applicant's allegations regarding patent infringement
EP'872 protects new triazine chemical compounds characterised by the presence of a core
structure consisting of a symmetrical triazine and having a high absorption capacity for sun
filters, in particular in the UV-B region, and their use in the manufacture of formulations or
creams for protection against sunlight. According to the applicant, claims 2, 3, 4, 5 and 6 are
particularly relevant in the present case.
The chemical compounds described in EP'872 fall within a general structural formula (I)
described in paragraph [0019]. Independent claim 1 refers to compounds falling within the general
formula (I) and characterised by the substitutions of substituent groups X, A and B described in
paragraph [0019].
Dependent claim 2 claims compounds according to the above formula (I) selected from the
compounds of formula (V), (VI) or (VII) described in paragraph [0021].
Claim 3 claims the compounds of the preceding claims selected from the compounds of formula
(V), (VI) or (VII) wherein the ratio of the absorption capacity in the UV-A region to the
absorption capacity in the UV-B region is greater than a UV-A/UV-B ratio of 0.20 and preferably
greater than a UV-A/UV-B ratio of 0.30.
The subsequent dependent claims 4 and 5 relate to cosmetic compositions containing the
compounds of the preceding claims selected from the compounds of formula (V), (VI) or (VII),
alone or in combination with other filters having UV-A and UV-B absorption properties (claim 4)
and alone or in combination with specifically identified filters having UV-A and UV-B absorption
properties.
Dependent claim 6 is a claim for the use of the compounds of claims 1 and 2 for the protection of
the skin and hair.
EP'426 protects cosmetic compositions intended for the protection of skin and hair from UV
radiation, so that the use of a combination of several sun filters is capable of providing broad
protection against both UV-A and UV-B rays. Combinations of several sunscreens in cosmetic
formulations are also necessary to impart other essential or desirable properties, such as, for
example, stability when exposed to light and heat, good compatibility with other substances used
in the formulation, water resistance and good adhesion to the skin.
According to the applicant, the following are particularly relevant in the present case
- Claims 3, 4, 5 and 6.
Independent claim 1 relates to cosmetic compositions for topical use for the protection of skin and
hair from UV rays, comprising:
- at least one sunscreen agent or filter (a) selected from those included in the general formula
(I) and characterised by the substitutions of substituent groups A and B described in
paragraph [0019] and
- at least one other UV agent or filter (b) selected from 2-ethylhexyl p-methoxycinnamate, 2-
hydroxy-4-methoxybenzophenone, 2-hydroxy-4-methoxybenzophenone-5 sulfonic acid,
ethylhexyl salicylate, ethylhexyl dimethyl PABA, drometrizole
trisiloxane, 3-(4'-methylbenzylidene)-d, l-camphor, diethylhexyl butamido triazone, Ethylhexyl Triazone, 4-
(tert-butyl)-4'-methoxy-dibenzoilmethane, 2-ethylhexyl ester of 2-cyano-3, 3-
diphenylacrylic acid, bis-ethylhexyloxyphenol-methoxyphenyl triazine, methylene-bis-benzotriazolyl-
tetramethylbutylphenol, 2-(4-diethylamino-2-hydroxybenzoyl)-hexyl ester of
benzoic acid, 2,4-bis-[4-[5-(1,1-dimethylpropyl)benzoxazol-2-yl]phenylimino]-6-[(2-
ethylhexyl)imino]-1,3,5-triazine, trisbiphenyl triazine, titanium dioxide and zinc oxide and,
- optionally, other components such as solvents, diluents, auxiliaries and carriers normally
used in the cosmetic field.
Dependent claim 3 relates to the cosmetic compositions of claims 1 and 2 in which the agent or
filter (a) is selected from the compounds of formula (V), (VI) and (VII) described in EP'426 (and
in EP'872).
Dependent claim 4 refers to the cosmetic compositions of claims 1 to 3 in which component (a)
(UV agent or filter) has a ratio of absorption capacity in the UV-A region to absorption capacity in
the UV-B region greater than 0.20 and preferably greater than 0.30.
Dependent claim 5 relates to the cosmetic compositions of the previous claims in which
component (b) is selected from a more restricted list of already known UV filters. Claim 6 relates
to the use of the cosmetic compositions of claims 1 to 4 as a sunscreen for the protection of skin
and hair.
The ACEF companies are active, among other things, in the sale of raw materials for the
cosmetics industry (see documents TC02, TC03, TC16a and TC16b).
ACEF s.r.l. distributes the products of MFCI Co. (see doc. TC6) and, in particular, the filter called
MFSorb 513 used for the preparation of cosmetic compositions for sun protection and described
on MFCI's website as 'a high-performance UVB filter with an exceptional specific extinction of
1500' (see doc. TC7).
ACEF s.r.l. promotes the sale of the MFSorb 513 filter on its website www.acef.it (see documents
TC10 and TC15).
3V Sigma turned to a specialised trader to purchase a sample of MFSorb 513. The purchase was
made on 3 March 2025 and concerned a 25 kg tin of product from the batch identified with code
no. W1268804 (see doc. TC17).
The product sample was then delivered to an external analysis laboratory on 25 March 2025 in
order to verify the presence in MFSorb 513 of the compounds of formula (V), (VI) and (VII)
described in the two patents in question.
The analysis report was issued on 2 April 2025 and concluded as follows (see doc. TC18): 'on the
basis of the results reported above, it can be concluded that:
- the HPLC-UV traces obtained are comparable with those provided by the customer
- the signals attributed to dimeramides D, E and F are detectable
- the in-depth analysis by HPLC-MS confirmed the presence of dimeramides E and F in the
sample
- the in-depth analysis by HPLC-MS excluded the presence of dimeramide D in the sample".
3V Sigma had the report examined by a technical expert of its choice. The expert concluded that
the analyses carried out by the laboratory in charge confirm the presence in the sample of MFSorb
513 supplied by 3V Sigma of dimeramides E and dimeramides F, corresponding to the structures
of formula (VII) and formula (VI) respectively, which are described and claimed in EP'872 and
EP'426 (see doc. TC19).
At this stage of the proceedings, the Court finds that the applicant has provided reasonable
evidence to support its well-founded suspicion that its patents have been infringed, in particular by
the defendant ACEF s.r.l.. The burden of proof on the applicant must also be adjusted according
to the content of the claim, which, in the present case, concerns a procedural right (to evidence)
and not a substantive right (as in the case of an injunction and/or compensation for damages).
The applicant has a well-founded fear that ACEF may contest the identity of characteristics
between the product sample examined and the MFSorb 513 marketed by them. It has also clarified
that it is unable to purchase the product from the defendants due to the direct competitive
relationship with the counterparties, which precludes the possibility of establishing a sales
channel.
The Court therefore considers that the acquisition of some of the evidence requested is
indispensable in order to obtain definitive confirmation of the suspicion of interference.
4. Requirements under Rules 194.2 and 197 RoP
Pursuant to Rules 194.2 and 197 RoP, the Tribunal, in exercising its discretion to decide on the
application without hearing the respondent – as provided for in Rule 194.1(d) RoP – must take
into account the urgency of the application and the reasons for granting an order without hearing
the other party.
In accordance with rule 197 of the Rules of Procedure, the Tribunal may order measures for the
preservation of evidence 'without the defendant having been heard', in particular 'where there is a
demonstrable risk of evidence being destroyed or otherwise ceasing to be available'.
In the present case, the existence of such a risk has been proven.
4.1. Urgency
The results of the laboratory tests and the expert's assessment became available a few days before
the application was filed.
3V Sigma is not in a position to proceed with a direct purchase of an additional product sample
from ACEF, due to the direct competitive relationship between the parties involved.
It is also clear that the applicant has no possibility of obtaining further technical documentation
relating to MFSorb 513.
As already noted above, the promotion and marketing of MFSorb 513 is currently underway. The
applicant therefore needs to obtain confirmation within a reasonably short period of time of the
suspected infringement of its patents in order to initiate subsequent proceedings on the merits.
4.2. Reasons for granting an order without hearing the defendant - risk of destruction of evidence
One of the applicant's main objectives is to obtain copies of the technical documents relating to
MFSorb 513 held by the defendants in digital format.
It is generally known that digital data and files can be easily hidden or deleted if the defendant is
given advance notice of a request for an order for the preservation of evidence.
Therefore, there is a real risk that the evidence in digital format could be easily removed or
concealed if the defendant companies are heard at a hearing or otherwise informed of the
existence of these proceedings before the measure is enforced.
Consequently, taking into account all potentially relevant factors, this order must be granted
without hearing the other party, because there is a demonstrable risk that the evidence may be
destroyed or otherwise cease to be available (Article 60.5 UPCA).
5. Payment of court fees
The court fees have been duly paid (see doc. TC22). The conditions laid down in rule 192.5 RoP
are therefore satisfied.
6. Balancing of conflicting interests and manner of execution
6.1. Balancing of interests
The weighing of the conflicting interests leads the Court to grant the measure, considering the
potential risk of harm to each of the parties in the event of granting the measure - for the sole
defendant ACEF s.r.l. - or refusing the measure - for the applicant.
Taking into account the principle of proportionality, the threat of definitive destruction of the
evidence against 3V Sigma must be considered to outweigh the risks arising from the execution of
the measures against ACEF s.r.l.. These measures are strictly procedural in nature, limited to
allowing the collection of evidence, and do not directly affect the subjective position of the
defendant or its commercial activity, except for some limited effects that will be considered below
for the purposes of quantifying the security.
In this case, the Court considers that the request for an order without hearing for the protection of
evidence is adequately justified and must therefore be granted, subject to certain objective and
subjective limitations as specified below.
6.2. Objective and subjective limitation of the measure
From an objective point of view, the Court considers that the measure should be granted only to
the extent of the acquisition of certain samples of the MFSorb 513 product and the technical
documentation relating to that product, excluding accounting and commercial documentation. The
application is in fact aimed, first and foremost, at verifying and substantiating the suspicions
regarding the counterfeit nature of the product distributed by the defendants.
The acquisition of accounting and commercial documents is, on the other hand, instrumental, on
the one hand, in identifying other parties potentially involved in promotional and distribution
activities and, on the other, in providing evidence of sales volumes for the purpose of determining
the amount of damages to be awarded. It is well known that companies incorporated under Italian
law are subject to specific obligations to keep accounting records, and no risks of possible
destruction or concealment of these documents have been alleged in this regard. Furthermore, the
procedural rules in force under the TUB allow, under certain conditions, for complete information
on all the aspects indicated to be obtained during the subsequent proceedings on the merits.
Reference is made in this regard to the general provisions contained in Article 67 of the UPCA
and Rules 190 and 191 of the RoP.
The precedent cited by the appellant in support of its request for the acquisition of accounting
documents does not appear to be relevant. A reading of the cited measure (see Düsseldorf
Division of Düsseldorf, UPC CFI No. 539/2024, order of 18 October 2024), it appears that in that case the
appellant had already repeatedly requested its counterparty to provide information on the
distribution and supply channels and on the identity of the supplier, without success. In the case
before this Local Division, however, there is no evidence of a similar persistent refusal on the part
of the defendants.
From a subjective point of view, the Court considers that the measure to preserve evidence can
only be authorised against ACEF s.r.l., to be enforced at its registered office, including offices and
warehouses at its disposal at that address, and not against ACEF s.p.a..
An examination of the documents attached by the applicant shows that all the potentially
infringing conduct complained of - promotion, marketing and sale of MFSorb 513 - can be
attributed solely to ACEF s.r.l..
ACEF s.p.a. holds the entire share capital of ACEF s.r.l. (see doc. TC03). However, the mere fact
that ACEF s.p.a. exercises corporate control does not appear sufficient to justify extending the
order for the protection of evidence against it. At this stage of the proceedings, there is no
evidence of its direct involvement in the patent infringement alleged by the applicant.
6.3 Method of execution
Pursuant to Rule 196.4 RoP, the measures authorised must be implemented by an expert
appointed by the Court - specifically mentioned in the operative part - in accordance with the
national law of the place where the measures are carried out, i.e. Italian law.
The appointed expert is included in the list of patent experts who regularly work with national
courts, so that the choice guarantees competence, independence and impartiality, as required by
Rule 196.5 RoP. The expert will be assisted by an auxiliary of his choice, in particular an expert
in computer forensics, to proceed at the premises of the defendant ACEF s.r.l..
The search for and copying of documents in digital format on media and devices used by the
defendant ACEF s.r.l. will be carried out on the basis of the list of keywords indicated by the
claimant in the supplementary statement filed on 8 May 2025.
This method of data selection is intended to ensure the highest probability of actual relevance and
correlation between the documents retrieved and the patent infringement alleged by the claimant.
The assistant shall operate under the direct control and responsibility of the expert and shall be
subject to the same professional obligations of confidentiality in relation to all information to
which he has access in the performance of his duties.
The task entrusted to the expert and his assistant is to protect the evidence. This order is issued
without hearing the other party, and the expert appointed by the Court is only able to act on the
basis of the information provided by the claimant. The duty to act independently and impartially
precludes any advisory support being provided to the applicant, as the expert must comply solely
with the instructions given by the Court for the execution of this order.
The appointed expert shall proceed with the assistance of the competent judicial officer.
The representatives of the applicant and a technical expert appointed by the applicant, whose
names are indicated in the operative part of this order, may be present during the execution of the
authorised measure. No other representative, employee or collaborator of the applicant is therefore
authorised to be present during the execution of the measures.
The defendant against whom the requested measure is authorised has the right to contact their
lawyers and technical consultants so that they may take part in the execution of the order for the
protection of evidence, with the express warning that, in any case, the actual execution of the
measure may not be delayed in any way.
The expert appointed by the Court shall submit a written report, together with a complete copy of
all documents and data acquired as a result of the execution of the measures, immediately and no
later than two days after the completion of the execution of the measures.
For the sake of clarity, it is hereby specified that the expert appointed by the Court pursuant to
rule 196.5 RoP cannot be equated with the figure of the Court expert provided for in Article 57
UPCA and rules 185 et seq. RoP, with the consequence, in particular, that the costs of his
professional activity are to be advanced by the applicant, subject to subsequent final settlement of
the costs of the proceedings at the end of the proceedings on the merits.
6.4. Protection of confidential information
As repeatedly stated by this Court (Local Division of Milan, UPC CFI No. 337/2024, order No.
51269/2024 of 11 September 2024; Local Division of Milan, UPC CFI No. 127/2025, order No.
11002/2025 of 18 March 2025), the principles of law established by the Court of Appeal in its
decision of 23 July 2024 (Appeal No. 20002/2024
- UPC CoA no. 177/2024), which provided a systematic interpretation of the
orders for the protection of evidence. The most relevant passages of the reasoning are reproduced
in full in the original English text.
An application for the preservation of evidence or inspection of premises within the meaning of
Article 60 UPCA and rules 192 et seq. RoP implies a request to disclose to the applicant the
outcome of the measures, including the report written by the person who carried out the
measures. This follows from the fact that the legitimate purpose of the measures is the use of the
evidence in proceedings on the merits of the case (rules 196.2 and 199.2 RoP), which includes the
use of the evidence to decide whether to initiate proceedings on the merits and to determine
whether and to what extent the evidence will be submitted in these proceedings.
Disclosure of the evidence to the applicant or to certain persons acting on behalf of the applicant
is indispensable for that purpose. Moreover, rules 196.1 and 199.1 RoP provide that the Court
may decide in its order that the evidence shall be disclosed to certain named persons and shall be
subject to appropriate terms of non-disclosure. This confirms that the procedure initiated by an
application under Article 60 UPCA aims not merely at the preservation of evidence and the
inspection of premises as such, but also at the disclosure of the evidence to the applicant.
However, granting an application for preservation of evidence or inspection of premises does not
imply an unconditional order to disclose the evidence to the applicant. Pursuant to Article 60(1)
UPCA, the order must be subject to the protection of confidential information (see also Article
7(1) of Directive 2004/48/EC of the European Parliament and of the Council of 29 April 2004 on
the enforcement of intellectual property rights). Where the evidence may contain confidential
information, this entails that the Court must hear the other party before deciding whether and to
what extent to disclose the evidence to the applicant. In this context, the Court must give the other
party access to the evidence and must provide that party with the opportunity to request the Court
to keep certain information confidential and to provide reasons for such confidentiality. If the
other party makes such a confidentiality request, the Court must provide the applicant with the
opportunity to respond in a manner that respects the potential confidentiality interests of the other
party. The Court may do this, for example, by granting access only to the representatives of the
applicant whom the Court, pursuant to rule 196.3(a) RoP, has authorised to be present during the
execution of the measures and subject to appropriate terms of non-disclosure.
The opportunity for the other party to make a confidentiality request must be distinguished from
the remedies available against the order for the preservation of evidence or the inspection of
premises, such as the review of an order for preservation of evidence without hearing the
defendant pursuant to rule 197.3 RoP. Therefore, the Court must hear the other party on the
request for disclosure even if this party has decided not to file a remedy against the order to
preserve evidence or inspect premises. For the same reasons, the failure to apply for a review of
an order for the preservation of evidence or for the inspection of premises cannot be considered
as tacit approval of the disclosure of evidence. 4. Pursuant to Article 60(8) UPCA, the Court shall
ensure that measures to preserve evidence or to inspect premises are revoked or otherwise cease
to have effect, at the defendant's request, if the applicant does not bring, within a period not
exceeding 31 calendar days or 20 working days, whichever is longer, action leading to a decision
on the merits of the case before the Court (see also Article 7(3) of Directive 2004/48/EC and
Article 50(6) of the Agreement on Trade-Related Aspects of Intellectual Property Rights). Rules
198.1 and 199.2 RoP specify that the time period runs from the date specified in the Court’s
order, taking into account the date when the report referred to in rule
196.4 RoP is to be presented. These rules must be interpreted in the light of the purpose of the
measures for the preservation of evidence or inspection of premises, which is to use the outcome
of these measures in the proceedings on the merits of the case (rules 196.2 and 199.2 RoP). In
view of this, the Court must, as a general principle, specify in its order a time period that starts to
run from the date of disclosure of the evidence to the applicant or from the date on which the
Court has made a final decision not to grant the applicant access to the evidence.
It is clear that access to the computer systems and devices of the defendant ACEF s.r.l. and the
acquisition of certain data contained therein entails a real risk of confidential information being
extracted.
For this reason, the Court considers that a very high standard of caution must be applied,
temporarily preventing any access to the content of the expert's report and its annexes, even by the
representatives of the applicant, and making such access subject to the actual verification of the
existence of confidential information worthy of protection.
As clarified by the Court of Appeal, the application under Article 60 UPCA and Rule 192 RoP
implies a request by the applicant for access to the contents of the documents acquired as a result
of the execution of the measures. The applicant is not required to submit any further request for
access after the execution of the measure. The expert's report and its annexes will be filed with the
Registry of the Local Division of Milan and the applicant will have full access to them from 30
June 2025, unless the respondent avails itself of the possibility of requesting the protection of confidential information, regardless of whether other
remedies - such as review or appeal - are actually proposed.
The applicant will have access by collecting a copy (previously made available by the expert, as
already provided for in this order) at the Registry, under the supervision of the judge rapporteur
and with the assistance of a registrar. The activities will be recorded in a specific report which will
then be uploaded to the CMS.
If, by 30 June 2025, the defendant has actually submitted a request for protection of confidential
information, the Court shall, after consulting the parties, determine by a specific order whether, to
whom and to what information access shall be granted.
Requests for review and appeal may be submitted independently (see paragraphs 6.8 and 6.9
below) and the outcome of any such remedies must, of course, be respected.
Pursuant to Article 60.8 UPCA and Rule 198 RoP, the order for the protection of evidence shall
be revoked or otherwise cease to have effect, at the request of the defendant, if the applicant does
not commence proceedings on the merits before the Court within a period not exceeding 31
calendar days or 20 working days, whichever is longer, starting from the date on which the
claimant gains access to the content of the evidence or from the date on which the Court has taken
the final decision not to grant the claimant access to the evidence.
6.5. Restrictions on the use of the Court expert's written report
The written report of the expert and any other document obtained as a result of the execution of
the order for the protection of evidence may only be used in subsequent proceedings on the merits,
in accordance with the provisions of Rule 196.2 RoP.
6.6. Notification
Taking into account the need to ensure the surprise effect, the notice of appeal - together with this
order - shall be served by the applicant in accordance with Italian national law at the registered
office of the respondent ACEF s.r.l., immediately upon execution of this order, in accordance with
Rule 197.2 RoP.
6.7. Security
Pursuant to Rules 196.3 and 196.6 RoP, the Court orders 3V Sigma to provide adequate security –
also as a condition for the enforceability of this order – for legal costs and any compensation for any damage suffered or that may be suffered by the defendant, by
depositing the amount of 15,000 euros.
This amount is calculated taking into account the commercial price applied for the sale of the
product MFSorb 513 (75 euros per kg) and the quantity of product samples that will likely need to
be taken, i.e. at least 25 kg in total, where possible from different production batches. These
product samples may not be marketed by ACEF s.r.l..
This order shall become effective and enforceable only after the security deposit in the amount
indicated above has been actually paid by the applicant.
6.8. Review
The respondents may request a review of this order, as provided for in Article 60.6 UPCA and
Rule 197.3 RoP.
6.9. Appeal
The parties may appeal within fifteen days of notification of this order pursuant to Article 73.2(a)
UPCA and Rule 220.1 RoP.
ORDER
The Unified Patent Court - Court of First Instance - Local Division of Milan
1. orders that the applicant be allowed, solely in relation to ACEF s.r.l.:
a) to obtain, collect and store at the offices, warehouses and other premises available to
ACEF s.r.l., located at its registered office in Fiorenzuola D'Arda (PC)
- Via Umbria No. 8/14, all technical documentation relating to the product named
MFSorb 513, excluding accounting and commercial documentation relating to the
same product, subject to verification and access to all digital media and data carriers,
on any type of device, available and in use by the defendant ACEF s.r.l., including
external storage units/systems and cloud storage; in order to select and collect the
documents in digital format, the keywords indicated by the applicant in the authorised
note filed on 8 May 2025 will be used;
b) to proceed with a detailed description of the products identified with the trade name
MFSorb 513 as present in the offices, warehouses and other premises indicated
above, with the creation of videos and photographs and with the express
authorisation to collect samples of the MFSorb 513 product, where possible from
different production batches and in any case in sufficient quantities to allow for
subsequent laboratory analysis; the product samples thus acquired must be stored in
accordance with the procedures indicated by the expert appointed by the Court and in
any case in such a way as to ensure their integrity for the entire foreseeable duration
of the subsequent proceedings on the merits, by a custodian who must be appointed in
accordance with the provisions of Italian law on the enforcement of judicial measures
(and, in particular, in accordance with the rule set out in Article 521bis of the Italian
Code of Civil Procedure, identifying the custodian as an employee of the defendant,
named by the defendant to the bailiff at the time of enforcement of the measure,
whose name and position shall be included in the court expert's report);
2. orders ACEF s.r.l. to allow the persons appointed to execute this order
(i) to access the premises indicated above and to protect the evidence; (ii) to take
photographs or film for documentary purposes, where deemed relevant for the protection of
the evidence as ordered; (iii) to allow full and complete access to all technical documents, in
any format, in its possession and available to it, relating solely and strictly to the MFSorb
513 product, including through access to any type of device, unit or storage system in use,
including in the cloud;
3. orders that, in the event that the defendant does not voluntarily comply with these
instructions, the persons responsible for enforcing the order are authorised, in accordance
with the provisions of Italian law on the enforcement of court orders, to request the
assistance of a locksmith, to force access to the computer systems and, in any case, to
request the assistance of the police if deemed necessary;
4. orders that this order be enforced by the judicial officer with territorial jurisdiction, Dr
Diego Pallini Gervasi, with professional office in
- appointed as Court Expert, assisted by an assistant of his
choice who is an expert in computer forensics;
5. orders that only lawyers Luca Pellicciari and Lorenzo Battarino and the technical expert Dr
Silvia Bertuccio are authorised to be present during the execution of this order, with the
express exclusion of any other representative, employee or collaborator of the applicant; the
authorised persons are required to keep confidential all information that comes to their
knowledge during the execution of this order;
6. orders the Court Expert to submit a written report on the results of the execution of the
order for the protection of evidence to the Sub-Registry of the Local Division of Milan of
the Unified Patent Court, attaching all the documents collected, immediately after
completion of the requested activities and, in any case, no later than two days after the
conclusion of all operations; three copies of the aforementioned report and documents shall
be made available, one for the Court and one for each of the parties;
7. orders that the written report and any other results of the execution of the order for the
protection of evidence may only be used in the subsequent proceedings on the merits;
8. acknowledges that the order for the protection of evidence shall be revoked or otherwise
cease to have effect, at the request of the defendant, if the applicant does not bring the
proceedings on the merits before the Court within a period not exceeding 31 calendar days
or 20 working days, whichever is longer, which shall commence on the date on which the
claimant gains access to the content of the evidence gathered or on the date on which the
Court adopts its final decision not to grant the claimant access to the evidence;
9. orders that access to the expert's written report and its annexes be granted to the appellant
from 30 June 2025, at the offices of the Sub Registry of the Local Division of Milan, under
the supervision of the judge rapporteur, with the assistance of a registrar, unless the
respondent exercises its right to file an application for protection of confidential information
by 30 June 2025; in the event that such a request for confidentiality is actually submitted,
the Court shall decide whether and which persons shall have access and to what
information;
10. orders that this order, together with a copy of the application and the related annexes, as
well as the letter of service and the instructions for access to the proceedings through the
CMS, be served by the applicant at the defendant's registered office immediately upon
execution of this order, in accordance with Italian law on the service of judicial documents;
11. orders that this order shall become effective and enforceable upon payment by the applicant
of a security deposit of 15,000 euros;
12. defer all decisions on costs to the subsequent proceedings on the merits;
13. acknowledges that the respondent may request a review of this order within thirty days of
the execution of the measures, pursuant to Article 60.6 UPCA and Rule 197.3 RoP;
14. acknowledges that the parties may appeal within fifteen days of notification of this order
pursuant to Article 73.2(a) UPCA and Rules 220.1(c) and 224.2(b) RoP.
