KURZE DARSTELLUNG DES SACHVERHALTS:
1. Die Klägerin hat die Beklagten wegen Verletzung des Europäischen Patents EP 3 375 337 B1 (nachfolgend: Streitpatent) in Anspruch genommen, wobei das Verfahren unter dem Aktenzeichen ACT_459767/2023 (UPC_CFI_7/2023) geführt wird. Die Beklagten haben eine Widerklage auf Nichtigerklärung des Streitpatents erhoben (CC_573257/2023). Die Klägerin ist der Nichtigkeitswiderklage entgegengetreten und hat hilfsweise Anträge auf Änderung des Streitpatents gestellt (App_586918/2023).
2. Mit einer am 3. Juli 2024 verkündeten Entscheidung hat die Lokalkammer Düsseldorf der
Verletzungsklage überwiegend stattgegeben und auf die durch die Beklagten erhobene Nich-
tigkeitswiderklage das Streitpatent eingeschränkt aufrecht erhalten. Nach der in dieser Ent-
scheidung getroffenen Kostengrundentscheidung haben von den Kosten der Klage die Klä-
gerin 15 % und die Beklagte zu 85 % zu tragen und die Kosten der Nichtigkeitswiderklage
haben beide Parteien zu 50% zu tragen.
3. Den Streitwert für die Klage und die Nichtigkeitswiderklage hat die Lokalkammer Düsseldorf
nicht explizit in der Entscheidung festgesetzt Es ergibt sich aber aus der Festsetzung der
Obergrenzen der erstattungsfähigen Vertretungskosten für die Klägerin auf EUR 47.600,00
und für die Beklagte auf EUR 8.400,00 ein inherent festgelegter Streitwert der Klage von EUR
500.000,00 sowie aus der Obergrenze für beide Parteien auf jeweils EUR 28.000,00 ein Streit-
wert für die Widerklage von EUR 500.000,00.
4. Mit Schriftsatz vom 5. August 2024 hat die Klägerin einen Antrag auf Kostenfestsetzung ge-stellt (ACT_45185/2024, UPC_CFI_7/2023). Die Klägerin beziffert ihre Kosten wie folgt:

Die Klägerin trägt vor, dass sie die Gerichtskosten in Höhe von EUR 11.000,00 gezahlt hat und versichert anwaltlich, dass die ihr entstandene Kosten für die rechts- und anwaltliche Beratung sich auf insgesamt ca. EUR 112.000,00 belaufen, und dass sie einen Testkauf am 25. Mai 2024 für das Verletzungsprodukt „Duschwanne Bette Floor mit Minimum-Wannen-träger“ zum Nettopreis von EUR 600,00 durchgeführt hat.

ANTRÄGE DER PARTEIEN:
6. Die Klägerin beantragt,
das Kostenfestsetzungsverfahren gemäß R. 151 VerfO durchzuführen und die zu er-stattenden Kosten auf die tenorierte Obergrenze von insgesamt EUR 84.950,00 festzu-setzen.

TATSÄCHLICHE UND RECHTLICHE STREITPUNKTE:
7. Die Beklagte ist dem Kostenfestsetzungsantrag der Klägerin entgegengetreten.
8. Sie ist der Auffassung, die den Obergrenzen entsprechend angemeldeten Kosten der Vertre-
tung seien im Verhältnis zur Bedeutung der Sache erheblich zu hoch. Die Zeitspanne für Ver-
letzungshandlungen habe nur ca. 11 Monate vor Klageeinreichung betragen. Während des
Rechtsstreits habe die Beklagte der Klägerin einen Vergleichsvorschlag im September 2023
unterbreitet, aus dem sich ergäbe, dass nur Verletzungshandlungen bis zum 31. Mai 2023
vor Klageeinreichung in Rede stünden. Sie habe eine Schadensersatzzahlung in Höhe von
EUR 10.000,00 bzw. EUR 15.000 angeboten. Dies habe die Klägerin auch zum Anlass genom-
men im Verfahren ihren Schadensersatzantrag später entsprechend zu beziffern. Die Kläge-
rin habe daher schon früh im Verfahren Kenntnis von allen relevanten Tatsachen gehabt, um
den sehr begrenzten wirtschaftlichen Wert der Sache frühzeitig zu erkennen. Die wesentli-
chen Kosten der Vertretung seien bei der Klägerin erst nach September 2023 in Kenntnis der
wirtschaftlichen Bedeutung der Sache entstanden und daher unverhältnismäßig und unan-
gemessen. Die angemeldeten Kosten seien unter Berücksichtigung des kurzen Verletzungs-
zeitraums, der geringen Umsätze in den von vorneherein nur begrenzten Territorien und des
geringen Gewinns erheblich zu reduzieren. Angemessen sei insoweit allenfalls ein Betrag von
maximal EUR 37.000,00.

GRÜNDE DER ANORDNUNG:
9. Der zulässige Antrag auf Kostenfestsetzung ist begründet.
10. Gegen die Zulässigkeit des Antrages auf Kostenfestsetzung bestehen keine Bedenken.
11. Der Kostenfestsetzungsantrag ist ebenfalls begründet.
I. Grundsätze
12. Nach Art. 69 Abs. 1 EPGÜ werden die Kosten des Rechtsstreits und sonstige Kosten der ob-
siegenden Partei in der Regel, soweit sie zumutbar und angemessen sind, bis zur nach der
Verfahrensordnung festgelegten Obergrenze von der unterlegenen Partei getragen, sofern
Billigkeitsgründe dem nicht entgegenstehen. In Konkretisierung dieses Grundsatzes ist die
obsiegende Partei nach R. 152 Abs. 1, 2 VerfO berechtigt, die angemessenen und verhältnis-
mäßigen Kosten der Vertretung bis zur vom Verwaltungsausschuss festgesetzten Ober-
grenze zurückzufordern.
13. Kosten des Rechtsstreits sind solche, die in dem konkret anhängigen bzw. in Rede stehenden
Verfahren (tatsächlich) entstanden sind. Hierzu zählen insbesondere die in R. 151 lit. d) VerfO
aufgezählten Kosten. Als sonstige Kosten sind solche zu begreifen, die zwar nicht in dem an-
hängigen Verfahren entstanden sind, die jedoch unmittelbar und eng mit dem betreffenden
Verfahren zusammenhängen (vgl. UPC_CFI_696/2024 (LK München, Panel 2), Entscheidung
v. 19.03.2025 – MSG Maschinenbau v. EJP Maschinenbau; UPC_CFI_363/2023 (LK Düssel-
dorf), Anordnung v. 14.04.2024 – Seoul Viosys v. expert).
14. Die jeweils in Rede stehenden Kosten müssen kumulativ zumutbar und angemessen sein,
was stets eine Frage des Einzelfalls ist. Die genannten Kriterien dienen der Sicherung des in
Art. 14 RL 2004/28 und Art. 3 RL 2004/28 niedergelegten Zwecks, ein hohes Schutzniveau für
Europäische Patente zu gewährleisten, indem verhindert werden soll, dass ein Geschädigter
von der Einleitung eines gerichtlichen Verfahrens zur Wahrung seiner Rechte abgehalten
wird, und indem sichergestellt wird, dass Maßnahmen, Verfahren und Rechtsbehelfe, die zur
Durchsetzung der Rechte des geistigen Eigentums erforderlich sind, nicht unnötig kostspielig
sind (EuGH, 28.04.2022 – C-531/200 – NovaText/Ruprecht-Karls-Universität Heidelberg;
EuGH, 28 j.04.2022 – C-559/20 – Koch Media/Funke; EuGH, 28.07.2016 – C-57/15 – United
Video Properties/Telenet). Dies betrifft auch die Rechtsverteidigung.
15. Zumutbar bedeutet unter Berücksichtigung dessen im Wesentlichen Erforderlichkeit. Grund-
sätzlich ausgehend vom ex-ante Standpunkt einer verständigen und wirtschaftlich vernünftig
denkenden Partei ist ausschlaggebend, ob die jeweils kostenauslösende Maßnahme objektiv
erforderlich und geeignet erschien, das legitime Prozessziel zu erreichen. Die Maßnahme
muss hiernach für die Rechtsverfolgung oder Rechtsverteidigung sachdienlich erschienen
sein.
16. Die Angemessenheit richtet den Blick im Wesentlichen auf die Höhe der Kosten. Die Kosten,
die durch die erforderliche Maßnahme tatsächlich verursacht worden sind, dürfen in der
konkreten Höhe nicht unverhältnismäßig sein. Sie dürfen insbesondere nicht außer Verhält-
nis zum Streitwert, der Bedeutung der Sache, zum Schwierigkeitsgrad und zur Komplexität
der entscheidungserheblichen rechtlichen und tatsächlichen Streitpunkte sowie zu den Er-
folgsaussichten der kostenauslösenden Maßnahme stehen. Auch hier ist eine ex-ante Be-
trachtung angezeigt (zu diesen Grundsätzen: UPC_CFI_696/2024 (LK München, Panel 2), Ent-
scheidung v. 19.03.2025, Rz. 18 - 22 – MSG Maschinenbau v. EJP Maschinenbau; vgl. auch
UPC_CFI_363/2023 (LK Düsseldorf), Entscheidung v. 14.04.2025 – Seoul Viosys v. expert und
UPC_CFI_121/2025 (LK Düsseldorf), Entscheidung vom 22. April 2025 – Ortovox v. Mammut).
II. Erstattungsfähigkeit im Einzelfall
17. Ausgehend von diesen Grundsätzen bestehen gegen die Erstattungsfähigkeit der durch die
Klägerin geltend gemachten Kosten keine Bedenken. Die durch die Klägerin für das Haupt-
sacheverfahren einschließlich der Nichtigkeitswiderklage geltend gemachten Kosten sind,
unter Berücksichtigung der Erstattungsquote von 85 % respektive 50%, in Höhe der geltend
gemachten EUR 84.950,00 erstattungsfähig.
1. Gerichtsgebühren für die Verletzungsklage
18. Gemäß Regel 151 lit (d) VerfO können zu den erstattungsfähigen Kosten auch die Gerichts-
gebühren zählen. Diese sind der Klägerin in der geltend gemachten Höhe von EUR 9.350,00
zuzusprechen. Sofern die Beklagten im Kostenfestsetzungsverfahren erstmals die Höhe des
Streitwerts der Verletzungsklage monieren, verfängt dies nicht. Abgesehen davon, dass dies
im Streitverfahren hätte erfolgen können und müssen, ist der Streitwert in Höhe von EUR
500.000,00 nicht übersetzt, da sich der Klageumfang auf Handlungen in sieben verschiede-
nen europäische Länder erstreckt.
2. Vertretungskosten für die Nichtigkeitswiderklage
19. Die Kostenerstattung für die Vertretungskosten betreffend die Widerklage sind in der Sache
letztlich unbeanstandet und daher wie beantragt in Höhe von EUR 28.000,00 zu erstatten.
Der Einwand der Unangemessenheit basiert inhaltlich nur auf Umständen, welche die Ver-
letzungsklage betreffen.
3. Vertretungskosten für die Verletzungsklage

20. Der Klägerin sind auch die geltend gemachten Kosten in Höhe von EUR 47.600,00 zu erstat-
ten.
21. Der Einwand der unangemessenen Höhe der Kosten verfängt nicht. Die Beklagte trägt nicht
substantiiert vor, warum diese Kosten außer Verhältnis insbesondere zur Bedeutung der
Sache, zum Schwierigkeitsgrad und zur Komplexität der entscheidungserheblichen rechtli-
chen und tatsächlichen Streitpunkte sowie zu den Erfolgsaussichten der kostenauslösen-
den Maßnahme stehen. Substantiierter Vortrag verlangt insbesondere, dass die hier vor-
getragenen Gründe sich auch mit der Höhe auseinandersetzen und sich nicht mit der Zu-
mutbarkeit bzw. Erforderlichkeit der kostenauslösenden Maßnahme befassen.
21. Der Umstand, dass die Beklagte im Prozess vorträgt, sie habe den Vertrieb der angegriffe-
nen Ausführungsform bereits eingestellt, hat für die Angemessenheit der Kosten keine Re-
levanz. Unerheblich ist in diesem Zusammenhang ebenfalls, dass die Klägerin einen außer-
gerichtlichen Vergleichsvorschlag der Beklagten während des Prozesses abgelehnt hat.
Selbst wenn man entgegen des Vortrags der Beklagten diese Gründe als Einwand mangeln-
der Erforderlichkeit ansehen wollte, greifen sie in der Sache nicht. Die Fortführung des
Rechtsstreits und die damit verbundenen Rechtsverfolgungskosten sind sachdienlich.
22. In diesem speziellen Einzelfall mag außerdem zugunsten der Klägerin zu berücksichtigen
sein, dass es sich um die erste Entscheidung in der Hauptsache des neu eingerichteten Ge-
richts überhaupt gehandelt hat. Deren Vorbereitung durch Klage und Schriftsätze verur-
sacht mehr Aufwand als eine vergleichbare Klage in einem bereits bekannten Gerichtssys-
tem. Auch aus diesem Grund ist eine Unangemessenheit nicht erkennbar.

ANORDNUNG:
1. Die Beklagte hat der Klägerin Kosten in Höhe von insgesamt EUR 84.950,00 zu erstatten.
2. Der Beklagten wird aufgegeben, die Kosten bis zum 13. Juni 2025 zu zahlen (R. 156 Abs. 3 VerfO).

BRIEF STATEMENT OF THE FACTS:
1. The plaintiff has brought an action against the defendants for infringement of European patent EP 3 375 337 B1 (hereinafter: patent in suit), the proceedings being conducted under file number ACT_459767/2023 (UPC_CFI_7/2023). The defendants have filed a counterclaim for annulment of the patent in suit (CC_573257/2023). The plaintiff has opposed the counterclaim for annulment and, in the alternative, has filed requests for amendment of the patent in suit (App_586918/2023).

2. In a decision announced on 3 July 2024, the Local Division of the Düsseldorf Regional Court
largely upheld the infringement action and upheld the patent in suit, subject to limitations, against the
counterclaim for invalidity brought by the defendants. According to the decision on costs in this decision, the plaintiff shall bear
15% of the costs of the action and the defendant
85%, and the costs of the counterclaim for annulment shall be borne by both parties in equal shares.

3. The Local Division in Düsseldorf did not explicitly set the value in dispute for the action and the counterclaim for annulment in its decision. However, it follows from the setting of the
upper limits for the reimbursable costs of representation for the plaintiff at EUR 47,600.00
and for the defendant at EUR 8,400.00
and EUR 8,400.00 for the defendant, an inherent value in dispute for the action of EUR
500,000.00 can be derived, and from the upper limit for both parties of EUR 28,000.00 each, a value in dispute
for the counterclaim of EUR 500,000.00 can be derived.

4. By written submission dated 5 August 2024, the plaintiff filed a request for a determination of costs (ACT_45185/2024, UPC_CFI_7/2023). The plaintiff quantifies its costs as follows:

The plaintiff submits that it has paid court costs in the amount of EUR 11,000.00 and assures through its legal counsel that the costs incurred by it for legal and attorney's fees amount to a total of approximately EUR 112,000.00 and that it carried out a test purchase on 25 May 2024 for the infringing product ‘Bette Floor shower tray with minimum tray support’ at a net price of EUR 600.00.

6. The plaintiff requests that
the costs be determined in accordance with R. 151 RoP and that the costs to be reimbursed be set at the upper limit of EUR 84,950.00 as stated in the operative part.


FACTUAL AND LEGAL ISSUES IN DISPUTE:
7. The defendant has opposed the plaintiff's application for a determination of costs.
8. It is of the opinion that the costs of representation claimed in accordance with the upper limits are significantly too high in relation to the importance of the matter.
The period for
infringement actions was only approximately 11 months prior to the filing of the action. During the
legal dispute, the defendant submitted a settlement proposal to the plaintiff in September 2023,
which stated that only infringements committed up to 31 May 2023
prior to the filing of the action were at issue. It offered to pay damages in the amount of
EUR 10,000.00 or EUR 15,000. The plaintiff also took this as an opportunity
to quantify its claim for damages accordingly later in the proceedings. The plaintiff
therefore had knowledge of all relevant facts at an early stage of the proceedings in order to
recognise the very limited economic value of the matter at an early stage. The essential
costs of representation were incurred by the plaintiff only after September 2023, in the knowledge of the
economic significance of the matter, and are therefore disproportionate and unreasonable.
The costs claimed should be significantly reduced in view of the short period of infringement, the low turnover in the territories, which were limited from the outset, and the
low profit. In this respect, a maximum amount of EUR 37,000.00 would be appropriate.
REASONS FOR THE ORDER:

9. The admissible request for a determination of costs is well founded.
10. There are no objections to the admissibility of the request for a determination of costs.
11. The request for a determination of costs is also well founded.

I. Principles
12. According to Art. 69(1) UPCA, the costs of the proceedings and other costs of the prevailing party
shall, as a rule, be borne by the losing party to the extent that they are reasonable and appropriate, up to the maximum amount specified in the Rules of Procedure, unless
equity considerations dictate otherwise. In concrete terms, this principle means that the
prevailing party is entitled, pursuant to Rule 152(1) and (2) RoP, to claim reimbursement of the reasonable and proportionate
costs of representation up to the maximum amount set by the Administrative Committee
.

13. Costs of the legal dispute are those that have been (actually) incurred in the specific pending or disputed proceedings.
These include, in particular, the costs listed in R. 151(d) RoP.
Other costs are those which, although not incurred in the pending proceedings, are directly and closely related to the proceedings in question (see UPC_CFI_696/2024 (LK München, Panel 2), decision of

14. The costs in question must be cumulatively reasonable and appropriate,
which is always a question to be decided on a case-by-case basis. The criteria mentioned serve to safeguard the purpose laid down in
Art. 14 of Directive 2004/28 and Art. 3 of Directive 2004/28 of ensuring a high level of protection for

European patents by preventing an injured party from being deterred
from bringing legal proceedings to protect their rights
and by ensuring that measures, proceedings and remedies necessary to
enforce intellectual property rights are not unnecessarily costly
(ECJ, 28 April 2022 – C-531/200 – NovaText v Ruprecht-Karls-Universität Heidelberg;

ECJ, 28 April 2022 – C-559/20 – Koch Media/Funke; ECJ, 28 July 2016 – C-57/15 – United
Video Properties/Telenet). This also applies to the defence of rights.
15. In light of this, reasonable essentially means necessary. Principle
Based on the ex ante perspective of a reasonable and economically rational
party, the decisive factor is whether the measure that triggered the costs appeared objectively
necessary and appropriate to achieve the legitimate objective of the proceedings. The measure
must therefore appear relevant to the pursuit or defence of legal rights
.

16. Reasonableness focuses primarily on the amount of the costs. The costs
actually incurred by the necessary measure must not be disproportionate in
the specific amount. In particular, they must not be out of proportion
to the value in dispute, the significance of the case, the degree of difficulty and complexity
of the legal and factual issues relevant to the decision, and the
prospects of success of the measure giving rise to the costs.
Here, too, an ex ante assessment is appropriate (on these principles: UPC_CFI_696/2024 (LK Munich, Panel 2), decision of
19 March 2025, para. 18 - 22 – MSG Maschinenbau v. EJP Maschinenbau; see also
UPC_CFI_363/2023 (LK Düsseldorf), decision of 14 April 2025 – Seoul Viosys v. expert and
UPC_CFI_121/2025 (LK Düsseldorf), decision of 22 April 2025 – Ortovox v. Mammut).

II. Reimbursability in individual cases
17. Based on these principles, there are no objections to the reimbursability of the costs claimed by the
plaintiff.
The costs claimed by the plaintiff for the main proceedings, including the counterclaim for annulment, are,
taking into account the reimbursement rate of 85% and 50% respectively, reimbursable in the amount of EUR 84,950.00 claimed
.

1. Court fees for the infringement action
18. Pursuant to Rule 151(d) RoP, court fees may also be included in the reimbursable costs.
These are to be awarded to the claimant in the amount claimed of EUR 9,350.00.
If the defendants object to the amount of the
value in dispute in the infringement action for the first time in the proceedings for the determination of costs, this is not valid. Apart from the fact that this
could and should have been done in the proceedings, the value in dispute of EUR
500,000.00 is not excessive, as the scope of the action extends to acts in seven different
European countries.

2. Representation costs for the counterclaim for annulment
19. The reimbursement of costs for representation in relation to the counterclaim is ultimately uncontested in the matter
and is therefore to be reimbursed as requested in the amount of EUR 28,000.00.

The objection of unreasonableness is based solely on circumstances relating to the action for infringement.
3. Costs of representation for the action for infringement

20. The plaintiff is also entitled to reimbursement of the costs claimed in the amount of EUR 47,600.00.

21. The objection that the costs are unreasonable does not hold. The defendant does not
substantiate why these costs are disproportionate, in particular in relation to the significance of the
matter, the degree of difficulty and the complexity of the legal and factual issues relevant to the decision, as well as the prospects of success of the measures that gave rise to the costs.
A substantiated submission requires, in particular, that the reasons put forward here
also address the amount and do not deal with the reasonableness
or necessity of the measure giving rise to the costs.
21. The fact that the defendant argues in the proceedings that it has already discontinued the distribution of the contested is irrelevant to the appropriateness of the costs.
In this context, it is also irrelevant that the plaintiff rejected an out-of-court settlement proposal made by the defendant during the proceedings.
Even if, contrary to the defendant's submission, these reasons were to be regarded as an objection to the necessity of the costs, they would not be relevant to the case.
The continuation of the
legal dispute and the associated legal costs are appropriate.

22. In this specific individual case, it may also be taken into account in favour of the plaintiff
that this was the first decision on the merits of the newly established court
. The preparation of the action and the written pleadings required more effort than a comparable action in an already familiar court system.
For this reason, too, no disproportionate nature is apparent.

ORDER:
1. The defendant shall reimburse the plaintiff for costs totalling EUR 84,950.00.
2. The defendant is ordered to pay the costs by 13 June 2025 (R. 156 (3) RoP).
