DECISIONE
Le vicende processuali
1. In data 4.12.2024, Oerlikon Textile GmbH & C KG (di seguito Oerlikon) ha depositato un’ Application for a cost decision a seguito al giudizio di merito n. 549585/2023 (CFI_241/2023) svoltosi avanti alla divisione locale di Milano nei confronti di Baghat Textile Engineers (di seguito Baghat) e conclusosi con la decisione n. 598484/2023 depositata il 4 novembre 2024.
Il Tribunale ha così statuito:
“Per tutte le ragioni sopra esposte, la Corte:
1. dichiara che Baghat Textile Engineers ha contraffatto il brevetto EP ‘848 di titolarità di Oerlikon Textile GmbH & CO KG - in vigore in Italia e in Germania - mediante la promozione e l’offerta al pubblico della macchina strutturatrice/testurizzatrice esposta alla fiera ITMA del giugno 2023 in Rho - Milano;
2. inibisce a Baghat Textile Engineers la vendita, la commercializzazione e la promozione della macchina indicata al punto n. 1 in contraffazione del brevetto ‘848 e nei territori dell’Italia e della Germania; 4
3. fissa una penalty di 12.000,00 Euro ai sensi delle rule 63(2) e 354 RoP che dovrà essere pagata alla Corte per ogni episodio di violazione dell’ordine di cui al punto n. 2;
4. ordina a Baghat Textile Engineers di pagare a Oerlikon Textile GmbH & CO KG una provvisoria liquidazione del danno pari a 15.000,00 Euro;
5. stabilisce il valore della causa in 750.000,00 Euro;
6. stabilisce che le spese del procedimento sono compensate per il 20% tra le parti mentre per il rimanente 80% sono poste a carico di Baghat Textile Engineers;
7. respinge ogni ulteriore domanda di Oerlikon Textile GmbH & CO KG”.
Alla luce del punto n. 5 del dispositivo sopra riportato, in questa sede, Oerlikon ha chiesto in particolare, ai sensi e per gli effetti delle Rules 150-155 RoP, di:
(A) quantificare le spese del procedimento sopportate da Oerlikon Textile GmbH & CO KG in 136.756,10 €, a copertura (i) delle Court fees pagate per l’instaurazione del procedimento to preserve evidence (ACT_500982/2023 – CFI_141/2023) e del giudizio di merito (ACT_ 549585/2023 – CFI_241/2023); (ii) delle spese di traduzione e di notifica; (iii) del compenso del Court Expert Ing. Marietti, nominato per eseguire l’order to preserve evidence in data 14 giugno 2023; (iv) dei compensi professionali dei Rappresentanti nel procedimento to preserve evidence, nel giudizio di merito e nel sub-procedimento ai sensi della Rule 262A RoP (APP_21554/2024);
(B) e tenuto conto della percentuale del 20% compensata tra le parti, quantificare la somma che Bhagat Textile Engineers deve rifondere ad
Oerlikon Textile GmbH & CO KG nella cifra di 109.404,88 €, ordinandone il pagamento;
(C) condannare Bhagat Textile Engineers a rifondere a Oerlikon Textile GmbH & CO KG i costi del presente procedimento nella misura che codesto Ill.mo Tribunale riterrà equa.
3 Instaurato il contraddittorio, Baghat ha in via preliminare ha invocato la sospensione del procedimento in attesa della decisione del giudice d’Appello presso il quale la pronuncia è stata impugnata.
La richiesta di sospensione è stata respinta con provvedimento del19 marzo 2025, (ord_n. 10531/2025), non impugnato: il Tribunale ha in particolare dato atto che la Corte D’Appello ha respinto l’istanza di sospensione della decisione di primo grado.
4. Nel merito, Baghat ha contestato la quantificazione delle spese compiuta da controparte (depositando le proprie note autorizzata in data 28.4.2025, nel workflow n. 10536/2025). Ha in particolare chiesto alla Corte:
I. Primo passo: ridurre del 50% l'importo degli onorari professionali recuperabili, ossia da € 120.425,30 a € 60.212,65;
II. Secondo passo: poiché gli onorari professionali rettificati di € 60.212,65 sono inferiori al massimale di recupero di € 112.000, non si applica alcun massimale;
III. Terzo passo: Sommando i € 60.212,65 agli altri costi sostenuti di € 16.330,82 si ottiene un totale di 76.543,47 euro di costi rettificati;
IV. Quarto passo: Applicando la compensazione del 20% a questa somma si ottiene un importo di € 61.234,78, che sarebbe la somma che la Convenuta sarebbe tenuta a pagare, con riserva di appello.
V. In subordine, se la Corte non è disposta a ridurre del 50% l'importo degli onorari professionali recuperabili, chiediamo di effettuare un'altra riduzione che ritenga appropriata.
Motivi della decisione
5. Questa decisione è assunta in conformità:
(i) ai seguenti principi contenuti nel Preambolo 2 delle RoP:
- proportionality, flexibility and fairness;
- discretional power for the judges to organise the proceedings in the most efficient
and cost effective manner;
-fairness and equity, having regard to the legitimate interests of all parties;
(ii)ai principi di flessibilità, proporzionalità e ragionevolezza;
(iii) agli Artt. 69 e 70 UPCA;
(iv) alle Rule 150-157 ROP,
v) alla giurisprudenza dell’UPC.
6. La domanda sui costi formulata da Oerlikon è ammissibile, giacchè è stata
pronunciata una sentenza di merito da intendersi “as a decision that concludes
litigation proceedings, that is proceedings where the ascertainment of a right is sought
by one party against another and is capable of producing the effects of res judicata on
conflicting subjective positions and from which a situation of the defeat of one party
with respect to another may arise, justifying the award of costs” (cfr. Decisione della
Central Division di Parigi, Order no. ORD_59519/2024 in ACTION NUMBER: ACT_22275/2024 UPC number: UPC_CFI_189/2024).
La decisione di primo grado è inoltre esecutiva: infatti, la Corte d’Appello, sollecitata ai sensi della rule 223 RoP, ha respinto in data 16.1.2025 (cfr. doc. 1 di parte ricorrente) la relativa istanza. Dunque, la decisione di primo grado è immediatamente esecutiva.
Infine, l’application contiene tutti gli elementi di cui alla rule 151 RoP ed è stata depositata nel termine previsto di un mese dal deposito della decisione di merito.
7. Ciò premesso, e passando al merito, la regola sorregge la decisione sui costi è contenuta nel capo n. 6 della decisione di merito n. 598484/2023, per cui le spese del procedimento sono compensate in ragione del 20% tra le parti e sono poste a carico di Baghat per il residuo 80%.
E ciò tenuto conto che il valore della causa è stato fissato dal Collegio in € 750.000,00.
8. In proposito, Oerlikon ha esposto chiesto il rimborso dei seguenti costi per un totale di 136.756,10 € comprensivo di:
a) 13.850 € di Court fees (350 € per il procedimento d’urgenza e 13.500 € per il giudizio di merito);
b) € 478,82 € per spese di traduzione e notifica;
c) € 2.002,00 € per le prestazioni dell’Ing. Marietti, nominato quale Court Expert nella fase ante causam;
d) 120.425,28 € per compensi professionali, a loro volta da scindersi in 23.712,00 € per il procedimento to preserve evidence € 96.713,28 € per il giudizio di merito.
Tutte le fatture relative ai costi e onorari dei Rappresentanti sono state regolarmente pagate da Oerlikon (cfr. doc. 16 di Oerlikon).
Quanto alle fees ed alle spese vive
9. Le spese esposte da Oerlikon sono tutte recuperabili in via generale, salvo le considerazioni che seguono quanto alla compensazione del 20% stabilita dal Tribunale.
Infatti:
(I) quanto agli esborsi di cui alla lett. a, ossia le fees corrisposte alla Corte, non vi è alcuna contestazione da parte di Baghat sulla recuperabilità.
(II) quanto ai costi di cui alla lett. b), la richiesta di recupero è fondata sulla rule 155 ROP, che prevede la “compensation for costs for interpreters and translators”;
(III) anche i costi di cui alla lettera c), le spese del Court Expert anticipate dall’attore sono rimborsabili secondo il dettato delle rule 150 e 151 RoP.
Tutte le voci di spesa sono esposte sono state effettivamente sostenute da Oerlikon e sono previste come rimborsabili nel sistema delle RoP.
Quindi l’importo totale ammonta ad € 16.330,82
Quanto ai costi di rappresentanza
10 Passando al rimborso dei costi di rappresentanza sostenuti, tale diritto non può essere riconosciuto se gli stessi:
- non sono ragionevoli e proporzionali (CJEU C- 57/15, CJEU C- 531/20);
- non sono stati ragionevolmente sostenuti;
- sono superiori al tetto massimo stabilito dall’Administrative Committee in relazione al valore della causa (ROP 152.2.).
In proposito, si deve ritenere che il tetto massimo, in ossequio al principio di proporzionalità, può essere raggiunto solo in situazioni limitate, ad esempio per la complessità delle questioni trattate, per il numero di brevetti esaminati, per le parti coinvolte o per l’uso di più lingue.
Come precisato in precedenti decisioni della Corte, i costi effettivamente causati dalla misura necessaria non devono sproporzionati in termini di importo specifico. In particolare, non devono essere sproporzionati rispetto all'importo
della controversia, all'importanza della questione, al grado di difficoltà e complessità dei punti giuridici e fattuali controversi rilevanti per la decisione e alle prospettive di successo della misura che comporta i costi (UPC, Local Division Dusselford, 22 aprile 2025, UPC_CFI_16/202, UPC_CFI_115/2025, UPC_CFI_116/2025).
11. Nel caso in esame. parte convenuta non contesta che le spese non siano state sostenute, ma che le stesse non siano ragionevoli o proporzionali.
In proposito, occorra tenere in conto che:
- la causa di merito è stata preceduta da un order to preserve evidence concesso ex parte;
- il valore della causa è stato definito dal Tribunale in € 750.000,00 pertanto il limite massimo rimborsabile ammonta ad € 112.000,00
- nel caso in esame, parte convenuta non ha contestato la validità del brevetto né ha negato la contraffazione. Quindi nessuna indagine tecnica brevettuale è stata compiuta in proposito;
- non sono state compiute altre attività istruttorie;
- il brevetto azionato è solo uno;
- le parti in lite sono solo due, attore e convenuto.
Si tratta quindi di un caso relativamente semplice, seppure tra i primi regolati dalla nuova Corte Unificata dei Brevetti (l’order to preserve evidence è stato il primo in assoluto e la sentenza che ha statuito sui danni provvisori, sulla pubblicazione e sulle misure accessorie tra le prime sul punto).
Pur tenendo conto del procedimento ante causam e del subprocedimento secondo la rule 262 A RoP, la cristallizzazione operata da Oerlikon, pari ad € 120.425,28, non appare proporzionata.
Ritiene quindi la Corte che le stesse debbano essere liquidate in un importo inferiore al massimo, che si ritiene equo fissare nella somma di € 80.000,00 che comprende la causa di merito, per € 65.000,00, e per il procedimento cautelare, per € 15.000,00.
A ciò fanno aggiunti € 20.000,00 per la causa di merito.
Il totale dei costi di rappresentanza rimborsabili ammonta dunque ad € 80.000,00, inferiore al tetto massimo previsto per il rispettivo valore della causa.
La compensazione del 20% disposta dal Tribunale
12. Sull’importo totale liquidabile, pari ad € 96.330,82 va compiuta la compensazione del 20% ordinata dalla Corte in sede di decisione finale.
E ciò su tutti i costi qui esposti, sia a titolo di fees e di spese vive sia a titolo di costi di difesa, giacchè la pronuncia di merito- che stabilisce la regola in base alla quale in
questa sede procedere alla relativa liquidazione- non ha sul punto compiuto alcuna differenziazione.
In questa sede nessuna modifica di tale decisione può essere infatti compiuta.
Si perviene così alla somma di € 77.064,65, di cui € 64.000,00 per spese di rappresentanza ed il residuo per spese fisse e spese vive sostenute.
il termine entro il quale Baghat è tenuto a rimborsare le spese ad Oerlikon
13.Secondo il dettato della rule 156, para 3, Rop la parte soccombente è tenuta a rimborsare la parte vittoria dei costi nel termine deciso dal Judge rapporteur.
In questo caso, tenuto conto del temine indicativo di cui alla rule 370, para 4, RoP da un lato e, dall’altro che la convenuta è una società con sede estera extraeuropea, appare congruo assegnare un termine di trenta giorni a partire dalla data di comunicazione della presente decisione.
ORDINE
1. La convenuta Baghat Textile Engineers deve rimborsare all’attrice Oerlikon Textile GmbH & C KG per i costi di lite l’importo complessivo di € 77.064,65.
2. Il pagamento deve essere effettuato entro un mese dalla comunicazione della presente decisione.
3. Per il resto, la richiesta di spese dell’attrice è respinta.

DECISION
The proceedings
1. On 4 December 2024, Oerlikon Textile GmbH & C KG (hereinafter Oerlikon) filed an Application for a cost decision following the judgment on the merits no. 549585/2023 (CFI_241/2023) before the Milan Local Division against Baghat Textile Engineers (hereinafter Baghat) and concluded with decision no. 598484/2023 filed on 4 November 2024.
The Court ruled as follows:

"For all the reasons set out above, the Court:

1. declares that Baghat Textile Engineers has infringed the EP '848 patent owned by Oerlikon Textile GmbH & CO KG - in force in Italy and Germany - by promoting and offering to the public the structuring/texturising machine exhibited at the ITMA trade fair in June 2023 in Rho - Milan;

2. prohibits Baghat Textile Engineers from selling, marketing and promoting the machine referred to in point 1 in infringement of patent '848 in Italy and Germany; 4

3. imposes a penalty of €12,000.00 pursuant to rules 63(2) and 354 RoP, to be paid to the Court for each breach of the order referred to in point 2;

4. orders Baghat Textile Engineers to pay Oerlikon Textile GmbH & CO KG provisional damages of 15,000.00 euros;

5. sets the value of the claim at €750,000.00;
6. orders that 20% of the costs of the proceedings shall be borne by the parties and the remaining 80% shall be borne by Baghat Textile Engineers;
7. dismisses all further claims by Oerlikon Textile GmbH & CO KG.

In light of point 5 of the above ruling, Oerlikon has specifically requested, pursuant to and for the purposes of Rules 150-155 RoP, that:

(A) quantify the costs of the proceedings incurred by Oerlikon Textile GmbH & CO KG at €136,756.10, to cover (i) the court fees paid for the initiation of the proceedings to preserve evidence (ACT_500982/2023 – CFI_141/2023) and the judgment on the merits (ACT_ 549585/2023 – CFI_241/2023); (ii) the translation and notification costs; (iii) the remuneration of the Court Expert Ing. Marietti, appointed to execute the order to preserve evidence on 14 June 2023; (iv) the professional fees of the Representatives in the proceedings to preserve evidence, in the judgment on the merits and in the sub-proceedings pursuant to Rule 262A RoP (APP_21554/2024);

(B) and taking into account the 20% percentage compensated between the parties, quantify the sum that Bhagat Textile Engineers must reimburse to
Oerlikon Textile GmbH & CO KG in the amount of €109,404.88, ordering payment thereof;

(C) order Bhagat Textile Engineers to reimburse Oerlikon Textile GmbH & CO KG for the costs of the present proceedings to the extent that this Court deems fair.
3 Once the proceedings were initiated, Baghat preliminarily requested the suspension of the proceedings pending the decision of the Appeal Court before which the judgment was challenged.

The request for suspension was rejected by order of 19 March 2025 (order no. 10531/2025), which was not appealed: the Court noted in particular that the Court of Appeal had rejected the request for suspension of the first instance decision.

4. On the merits, Baghat contested the quantification of the costs incurred by the other party (filing its authorised notes on 28 April 2025, in workflow no. 10536/2025). In particular, he asked the Court:
I. First step: to reduce the amount of recoverable professional fees by 50%, i.e. from €120,425.30 to €60,212.65;

II. Second step: since the adjusted professional fees of €60,212.65 are lower than the maximum recoverable amount of €112,000, no maximum amount applies;

III. Third step: Adding the €60,212.65 to the other costs incurred of €16,330.82 gives a total of €76,543.47 in adjusted costs;
IV. Fourth step: Applying the 20% compensation to this amount gives a sum of €61,234.78, which would be the amount that the Defendant would be required to pay, subject to appeal.

V. In the alternative, if the Court is not prepared to reduce the amount of recoverable professional fees by 50%, we request that it make another reduction that it deems appropriate.
Reasons for the decision
5. This decision is made in accordance with:
(i) the following principles contained in Preamble 2 of the RoP:
- proportionality, flexibility and fairness;

- discretionary power for the judges to organise the proceedings in the most efficient
and cost-effective manner;
- fairness and equity, having regard to the legitimate interests of all parties;
(ii) the principles of flexibility, proportionality and reasonableness;
(iii) Articles 69 and 70 UPCA;

(iv) Rules 150-157 ROP,
(v) the case law of the UPC.
6. Oerlikon's application for costs is admissible, since a judgment on the merits has been delivered, to be understood as 'a decision that concludes
litigation proceedings, that is proceedings where the ascertainment of a right is sought
by one party against another and is capable of producing the effects of res judicata on
by one party against another and is capable of producing the effects of res judicata on
conflicting subjective positions and from which a situation of the defeat of one party
with respect to another may arise, justifying the award of costs" (see Decision of the
Central Division of Paris, Order no. ORD_59519/2024 in ACTION NUMBER: ACT_22275/2024 UPC number: UPC_CFI_189/2024).

The first instance decision is also enforceable: in fact, the Court of Appeal, acting pursuant to Rule 223 RoP, rejected the relevant application on 16 January 2025 (see doc. 1 of the appellant). Therefore, the first instance decision is immediately enforceable.

Finally, the application contains all the elements required by Rule 151 RoP and was filed within the prescribed time limit of one month from the filing of the decision on the merits.

7. That being said, and moving on to the merits, the rule supporting the decision on costs is contained in section 6 of decision no. 598484/2023, according to which the costs of the proceedings are compensated in proportion of 20% between the parties and are borne by Baghat for the remaining 80%.

This takes into account that the value of the case was set by the Court at €750,000.00.
8. In this regard, Oerlikon requested reimbursement of the following costs for a total of €136,756.10, including:
a) €13,850 in court fees (€350 for the urgent proceedings and €13,500 for the judgment on the merits);
b) €478.82 for translation and notification costs;

c) €2,002.00 for the services of Mr Marietti, appointed as court expert in the pre-trial phase;

d) €120,425.28 for professional fees, to be divided into €23,712.00 for the proceedings to preserve evidence and €96,713.28 for the judgment on the merits.

All invoices relating to the costs and fees of the Representatives have been duly paid by Oerlikon (see Oerlikon's document 16).
As regards fees and out-of-pocket expenses
9. The expenses incurred by Oerlikon are all recoverable in general, except for the following considerations regarding the 20% compensation established by the Court.

In fact:
(I) with regard to the disbursements referred to in point (a), i.e. the fees paid to the Court, there is no dispute by Baghat as to their recoverability.
(II) with regard to the costs referred to in point (b), the claim for recovery is based on Rule 155 ROP, which provides for “compensation for costs for interpreters and translators”;

(III) the costs referred to in letter c), the Court Expert's fees advanced by the plaintiff, are also recoverable under Rules 150 and 151 RoP.
All items of expenditure are set out, have actually been incurred by Oerlikon and are recoverable under the RoP system.
The total amount therefore amounts to €16,330.82

As regards representation costs
10 Turning to the reimbursement of representation costs incurred, this right cannot be recognised if they:
- are not reasonable and proportionate (CJEU C- 57/15, CJEU C- 531/20);
- were not reasonably incurred;

- exceed the maximum amount set by the Administrative Committee in relation to the value of the case (ROP 152.2.).
In this regard, it must be considered that the maximum amount, in accordance with the principle of proportionality, can only be reached in limited situations, for example due to the complexity of the issues involved, the number of patents examined, the parties involved or the use of several languages.

As clarified in previous decisions of the Court, the costs actually incurred by the necessary measure must not be disproportionate in terms of the specific amount. In particular, they must not be disproportionate to the amount
in dispute, the importance of the issue, the degree of difficulty and complexity of the legal and factual issues relevant to the decision, and the prospects of success of the measure involving the costs (UPC, Local Division Dusselford, 22 April 2025, UPC_CFI_16/202, UPC_CFI_115/2025, UPC_CFI_116/2025).
11. In the present case, the defendant does not dispute that the costs were incurred, but that they are unreasonable or disproportionate.

In this regard, it should be noted that:
- the main proceedings were preceded by an ex parte order to preserve evidence;
- the value of the claim was set by the Court at €750,000.00, so the maximum amount that can be reimbursed is €112,000.00

- in the case in question, the defendant did not contest the validity of the patent or deny the infringement. Therefore, no technical patent investigation was carried out in this regard;
- no other preliminary investigations were carried out;
- only one patent was invoked;
- there are only two parties to the dispute, the plaintiff and the defendant.

This is therefore a relatively simple case, albeit one of the first to be settled by the new Unified Patent Court (the order to preserve evidence was the first ever issued and the judgment ruling on provisional damages, publication and ancillary measures was one of the first on this point).

Even taking into account the proceedings prior to the case and the sub-proceedings under Rule 262 A RoP, the crystallisation effected by Oerlikon, amounting to €120,425.28, does not appear proportionate.

The Court therefore considers that they should be settled at an amount lower than the maximum, which it considers fair to set at €80,000.00, comprising €65,000.00 for the main proceedings and €15,000.00 for the interim proceedings.

To this must be added €20,000.00 for the main proceedings.
The total reimbursable legal costs therefore amount to €80,000.00, which is below the maximum limit for the respective value of the case.

The 20% compensation ordered by the Court
12. The 20% compensation ordered by the Court in its final decision must be applied to the total amount payable of €96,330.82.

This applies to all costs set out herein, both in respect of fees and out-of-pocket expenses and in respect of defence costs, since the judgment on the merits, which establishes the rule according to which
the relevant settlement is to be made in this case, did not make any distinction on this point.
No change to that decision can be made here.

This brings the total to €77,064.65, of which €64,000.00 is for representation expenses and the remainder is for fixed costs and out-of-pocket expenses incurred.

The deadline by which Baghat is required to reimburse Oerlikon for the costs
13. According to the provisions of Rule 156, para. 3, RoP, the losing party is required to reimburse the winning party for the costs within the time limit set by the Judge Rapporteur.

In this case, taking into account the indicative time limit set out in Rule 370, para. 4, RoP, on the one hand, and, on the other hand, that the defendant is a company with its registered office outside Europe, it appears appropriate to set a time limit of thirty days from the date of notification of this decision.

ORDER
1. The defendant Baghat Textile Engineers shall reimburse the claimant Oerlikon Textile GmbH & C KG for the costs of the proceedings in the total amount of €77,064.65.
2. Payment shall be made within one month of notification of this decision.
3. For the rest, the claimant's request for costs is dismissed.
