LEITSÄTZE:
1. Führt der Beklagte in seiner Replik zur Nichtigkeitswiderklage neuen Stand der Technik in das
Verfahren ein, mit dem er das Fehlen der Neuheit und/oder der erfinderischen Tätigkeit be-
gründet, handelt es sich um eine Erweiterung der Nichtigkeitswiderklage im Sinne von R. 263
VerfO. Eine Zulassung dieses weiteren Standes der Technik kommt daher nur in Betracht,
wenn der Beklagte das Gericht davon überzeugen kann, dass die in Rede stehenden Schriften
nicht bereits mit der Nichtigkeitswiderklage vorgelegt werden konnten und wenn die Zulas-
sung weiterer Schriften den Kläger nicht unangemessen in seiner Verfahrensführung beein-
trächtigt.
2. Vergleichbares gilt, wenn bereits mit der Nichtigkeitswiderklage vorgelegter Stand der Tech-nik erstmals in der Replik zur Nichtigkeitswiderklage für einen neuen Angriff auf die Neuheit und/oder die erfinderische Tätigkeit herangezogen wird. Auch dann muss der Beklagte das Gericht davon überzeugen, dass es ihm bei gebotener Sorgfalt nicht möglich war, den erst-mals in der Replik zur Nichtigkeitswiderklage enthaltenen (weiteren) Angriff auf die Neuheit und/oder die erfinderische Tätigkeit bereits in die Nichtigkeitswiderklage aufzunehmen und dass die Zulassung dieses weiteren Angriffs auf die Neuheit und erfinderische Tätigkeit nicht zu einer unangemessenen Benachteiligung des Klägers in der Wahrnehmung seiner Rechte führt.

KURZE DARSTELLUNG DES SACHVERHALTS:
1. Die Klägerin nimmt die Beklagte wegen einer Verletzung des deutschen, des französischen

und des italienischen Teils des Europäischen Patents EP 2 778 423 B1 (nachfolgend: Streit-patent) in Anspruch.
2. Das Streitpatent wurde am 11. März 2013 in deutscher Verfahrenssprache angemeldet. Die Veröffentlichung des Hinweises auf Patenterteilung erfolgte am 28. Februar 2018. Das Streit-patent steht in Deutschland, Frankreich und Italien in Kraft. Gegen die Erteilung des Streit-patents wurde beim Europäischen Patentamt kein Einspruch eingelegt.
3. Das Streitpatent trägt die Bezeichnung „Kreiselpumpenaggregat“. Sein Schutzanspruch 1 lau-tet:
Schutzanspruch 1:
„Heizungsumwälzpumpenaggregat mit einer Kreiselpumpe (1), mit einem die Pumpe (1) an-treibenden Elektromotor (7), mit einem elektronischen Drehzahlsteller (11) für den Motor (7) und mit einer internen elektronischen Regelung (16), bei welcher die Stellgröße die Drehzahl des Motors (7) ist, wobei der Drehzahlsteller (11) und die Regelung (16) Teil des Aggregates bilden, ein Signaleingang zur externen Ansteuerung des Motors (7) vorgesehen ist und Mittel (20) zum Umschalten von der internen elektronischen Regelung (16) auf eine externe Dreh-zahlsteuerung oder zum Zuschalten einer externen Drehzahlsteuerung vorgesehen sind, dadurch gekennzeichnet, dass die Mittel (20) zum Umschalten elektronische Mittel sind, wel-che ermitteln, ob eine externe Steuerung angeschlossen ist oder nicht und bei Ermittlung einer angeschlossenen externen Steuerung auf die externe Steuerung umschalten.“

7. Mit ihrer Klage wendet sich die Klägerin gegen das Angebot und den Vertrieb von Heizungs-umwälzpumpen durch die Beklagte in Deutschland, Frankreich und Italien. Dazu zählen die über das deutsche Unternehmen Jürgen Schlösser Armaturen GmbH unter den Produktbe-zeichnungen JSA 20-4/130, JSA 20-6/130, JSA 25-4/180 und JSA 25-6/180 unter anderem in Deutschland angebotenen Heizungsumwälzpumpen, die die Beklagte auch unter ihren Pro-duktbezeichnungen „GPA III“ anbietet und vertreibt (nachfolgend: „angegriffene Ausfüh-rungsform“):

8. Auch über ihre Internetseite www.shinhoopump.com bietet die Beklagte ihre GPA III Pum-pen unter anderem in Deutschland, Frankreich und Italien ansässigen Interessenten auf Deutsch, Französisch und Italienisch an:

ANTRÄGE DER PARTEIEN:
Klage:
9. Die Klägerin beantragt,
I. festzustellen, dass die Beklagte das EP 2 778 423 B1 verletzt, wenn sie Heizungs-umwälzpumpenaggregate mit einer Kreiselpumpe, mit einem die Pumpe antrei-benden Elektromotor, mit einem elektronischen Drehzahlsteller für den Motor und mit einer internen elektronischen Regelung, bei welcher die Stellgröße die Drehzahl des Motors ist, wobei der Drehzahlsteller und die Regelung Teil des Ag-gregates bilden, ein Signaleingang zur externen Ansteuerung des Motors vorge-sehen ist und Mittel zum Umschalten von der internen elektronischen Regelung auf eine externe Drehzahlsteuerung oder zum Zuschalten einer externen Dreh-zahlsteuerung vorgesehen sind, in Deutschland, Frankreich oder Italien anbie-tet/anbieten lässt, in Verkehr bringt/in Verkehr bringen lässt oder gebraucht/ge-brauchen lässt oder zu den genannten Zwecken einführt oder besitzt, bei denen die Mittel zum Umschalten elektronische Mittel sind, welche ermitteln, ob eine externe Steuerung angeschlossen ist oder nicht und bei Ermittlung einer ange-schlossenen externen Steuerung auf die externe Steuerung umschalten;
II. die Beklagte zu verurteilen, es zu unterlassen, Heizungsumwälzpumpenaggre-gate mit einer Kreiselpumpe, mit einem die Pumpe antreibenden Elektromotor, mit einem elektronischen Drehzahlsteller für den Motor und mit einer internen elektronischen Regelung, bei welcher die Stellgröße die Drehzahl des Motors ist, wobei der Drehzahlsteller und die Regelung Teil des Aggregates bilden, ein Sig-naleingang zur externen Ansteuerung des Motors vorgesehen ist und Mittel zum Umschalten von der internen elektronischen Regelung auf eine externe Dreh-zahlsteuerung oder zum Zuschalten einer externen Drehzahlsteuerung vorgese-hen sind,
in Deutschland, Frankreich oder Italien anzubieten/anbieten zu lassen, in Ver-kehr zu bringen/in Verkehr bringen zu lassen, zu gebrauchen/gebrauchen zu las-sen oder zu den genannten Zwecken einzuführen oder zu besitzen, bei denen die

Mittel zum Umschalten elektronische Mittel sind, welche ermitteln, ob eine ex-terne Steuerung angeschlossen ist oder nicht und bei Ermittlung einer ange-schlossenen externen Steuerung auf die externe Steuerung umschalten;
III. die Beklagte zu verurteilen, der Klägerin in einer geordneten und aus sich heraus verständlichen Aufstellung Auskunft darüber zu erteilen, in welchem Umfang sie die zu Ziff. II. bezeichneten Handlungen seit dem 28. Februar 2018 begangen hat, und zwar unter Angabe
1. des Ursprungs und der Vertriebswege der verletzenden Erzeugnisse,
2. der ausgelieferten, erhaltenen oder bestellten Mengen und der Preise, die für die verletzenden Erzeugnisse gezahlt wurden, und
3. der Identität aller an der Herstellung oder dem Vertrieb von verletzenden Erzeugnissen beteiligten dritten Personen,
wobei die Beklagte zum Nachweis der Angaben gemäß vorstehender Ziff. III. 1. bis III. 3. die entsprechenden Kaufbelege, nämlich Rechnungen, hilfsweise Liefer-scheine, in Kopie vorzulegen hat, wobei geheimhaltungsbedürftige Details au-ßerhalb der auskunftspflichtigen Daten geschwärzt werden dürfen;
IV. die Beklagte zu verurteilen, der Klägerin in einer geordneten und aus sich heraus verständlichen Aufstellung darüber Rechnung zu legen, in welchem Umfang sie die zu Ziff. II. bezeichneten Handlungen seit dem 28. Februar 2018 begangen hat, und zwar unter Angabe
1. der einzelnen Lieferungen, aufgeschlüsselt nach Liefermengen, Lieferzei-ten, Lieferpreisen und Typenbezeichnungen sowie den Namen und An-schriften der gewerblichen Abnehmer,
2. der einzelnen Angebote, aufgeschlüsselt nach Angebotsmengen, Ange-botszeiten, Angebotspreisen und Typenbezeichnungen sowie den Namen und Anschriften der gewerblichen Angebotsempfänger,
3. der betriebenen Werbung, aufgeschlüsselt nach Werbeträgern, deren Auf-lagenhöhe, Verbreitungszeitraum und Verbreitungsgebiet,
4. der nach den einzelnen Kostenfaktoren aufgeschlüsselten Gestehungskos-ten und des erzielten Gewinns;
V. die Beklagte zu verurteilen, die sich in ihrem unmittelbaren oder mittelbaren Be-sitz oder in ihrem Eigentum befindlichen, unter Ziff. II. bezeichneten Erzeugnisse an einen von der Klägerin zu benennenden Gerichtsvollzieher zum Zwecke der Vernichtung auf ihre, der Beklagten, Kosten herauszugeben;
VI. die Beklagte zu verurteilen, die unter Ziff. II. bezeichneten, seit dem 28. Februar 2018 in Verkehr gebrachten Erzeugnisse gegenüber den gewerblichen Abneh-mern unter Hinweis auf den gerichtlich (Urteil des EPG vom …) festgestellten pa-

tentverletzenden Zustand der Sache und mit der verbindlichen Zusage zurückzu-rufen, etwaige Entgelte zu erstatten sowie notwendige Verpackungs- und Trans-portkosten sowie mit der Rückgabe verbundene Zoll- und Lagerkosten zu über-nehmen und die Erzeugnisse wieder an sich zu nehmen;
VII. die Beklagte im Fall der Zuwiderhandlung gegen die Verurteilungen zu II., III., IV., V. oder VI. zu verpflichten, an das Gericht für jeden Fall der Zuwiderhandlung ein Zwangsgeld in Höhe von bis zu 250.000,- EUR zu zahlen;
VIII. festzustellen, dass die Beklagte verpflichtet ist, der Klägerin allen den vorläufigen Schadensersatz gemäß Ziff. IX. übersteigenden Schaden zu ersetzen, der ihr durch die zu Ziffer II. bezeichneten, seit dem 28. February 2018 begangenen Handlungen entstanden ist und noch entstehen wird;
IX. die Beklagte zu verurteilen, der Klägerin vorläufigen Schadensersatz in Höhe von 64.000,- EUR zu bezahlen;
X. die Beklagte trägt die Kosten des Rechtsstreits und die sonstigen Kosten der Klä-gerin;
XI. sollte das Gericht die Vollstreckung aus diesem Urteil von der Beibringung einer Sicherheit durch die Klägerin abhängig machen, beantragt die Klägerin die Fest-setzung folgender Teilsicherheiten:
10. Hinsichtlich der Formulierung der „insbesondere, wenn“-Anträge wird auf die Klageschrift Bezug genommen.
11. Die Beklagte beantragt,
I. die Klage abzuweisen;
II. der Klägerin die Kosten des Verfahrens aufzuerlegen.
Widerklage:
12. Die Beklagte beantragt,
I. das Europäische Patent EP 2 778 423 B1 gemäß Art. 65(2) UPCA i.V.m. Art. 138 Abs. 1 und Art. 139 Abs. 2 EPÜ in vollem Umfang für nichtig zu erklären;

II. der Klägerin die Kosten des Verfahrens aufzuerlegen.
13. Die Klägerin beantragt,
I. die Nichtigkeitswiderklage zurückzuweisen;
II. der Beklagten die Kosten der Nichtigkeitswiderklage und die hiermit verbunde-nen Kosten der Klägerin aufzuerlegen.
Anträge auf Änderung des Patents:
14. Die Klägerin beantragt für den Fall, dass die Kammer die Nichtigkeitswiderklage für begrün-det erachtet, bedingt in Form von Hilfsanträgen die Aufrechterhaltung des Streitpatents im Umfang der als Hilfsantrag 1 bis 6 formulierten Anspruchssätze in der entsprechenden Rei-henfolge. Hinsichtlich der Formulierung der Hilfsanträge im Einzelnen wird auf den Antrag auf Änderung des Patents vom 22. Juli 2024 Bezug genommen.
15. Die Beklagte ist den Hilfsanträgen entgegengetreten.
TATSÄCHLICHE UND RECHTLICHE STREITPUNKTE:
Verletzungsklage:
16. Nach Auffassung der Beklagten sieht das Streitpatent Aufgabe und Lösung explizit darin, sämtliche im zitierten Stand der Technik vorbekannten Pumpentypen in einem Aggregat zu vereinen, um dieses sodann für sämtliche der genannten Einsatzzwecke nutzen zu können.
17. Die anspruchsgemäß vorgesehenen Mittel müssten solche sein, die sowohl ein echtes Um-schalten von der internen elektronischen Regelung auf eine externe Drehzahlsteuerung als auch ein Zuschalten der externen Drehzahlsteuerung erlauben. Bei letzterem würden die in-terne und die externe Drehzahlsteuerung miteinander in zeitlicher und sachlicher Hinsicht kombiniert. Die Unteransprüche 6 und 7 stellten spezifische Ausprägungen dieses „Zuschal-tens“ gesondert unter Schutz. Die voneinander grundsätzlich getrennten Funktionen des Um- und des Zuschaltens müssten anspruchsgemäß in einem dafür vorgesehenen Mittel ver-eint sein.
18. Für die Verwirklichung der durch das Streitpatent unter Schutz gestellten technischen Lehre sei es erforderlich, dass die elektronischen Mittel (zum Um- und Zuschalten) „ermitteln“, ob eine externe Steuerung angeschlossen ist und daraufhin den Prozess des „Umschaltens“ ein-schließlich eines möglichen „Zuschaltens“ auslösen. Hiermit müsse eine Entscheidungslogik verbunden sein, die über ein bloßes „Übersetzen“ des PWM-Signals und eines Überschrei-bens der internen Regelung beim Anlegen eines externen Steuersignals hinausgehe.
19. Ausgehend von einem solchen Verständnis mache die angegriffene Ausführungsform aus Beklagtensicht von der technischen Lehre des Streitpatents keinen Gebrauch.
20. Die Beklagte bediene sich eines von der Klägerin selbst geschaffenen, weit vor dem Priori-tätstag veröffentlichten Standes der Technik für Heizungsumwälzungspumpen. Dieser Stand der Technik entspreche dem „GRUNDFOS DATENHEFT UPM2, UPM GEO, UPM2K Umwälz-pumpen 50/60 Hz“ (nachfolgend: „UPM-Pumpe“) aus dem Dezember 2012 (vgl. Anlage B&B 7). Die dort beschriebenen Signale, Kontrollprinzipien, Schnittstellen und PWM-Input-Signale und deren Beispielwerte sowie Schaltzeichnungen und Graphen stimmten mit der

angegriffenen Ausführungsform in allen hier relevanten Belangen identisch überein. Ent-sprechend verhalte sich die „UPM-Pumpe“ aus dem Stand der Technik auch in allen relevan-ten Funktionen (Erkennen und Umschalten auf das externe Signal) identisch zu der angegrif-fenen Ausführungsform.
21. Weder sei die angegriffene Ausführungsform in der Lage, die jeweilige Betriebsumgebung zu ermitteln. Noch erlaube sie das Zuschalten externer Steuersignale. Bei der angegriffenen Ausführungsform seien keine elektronischen Mittel vorhanden, die das Zuschalten einer ex-ternen Drehzahlsteuerung erlauben würden. Eine Regelungslogik, die ein bedarfsweises Zu-schalten mit dem internen Steuerungssignal erlauben würde, sei weder nachgewiesen noch in der angegriffenen Ausführungsform tatsächlich vorhanden. Eine bedarfsweise Umschal-tung auf eine externe Steuerung sei nicht möglich. Sobald ein stabiles (d.h. störungsfreies) externes PWM-Signal anliege, gehe dieses stets der internen Regelung der angegriffenen Ausführungsform vor und steuere hiernach dauerhaft, d.h. bis zum Fortfall des Signals, die Pumpe. Solange die angegriffene Ausführungsform ein stabiles PWM-Signal empfange, werde die Drehzahl ihres Motors ausschließlich durch den Wert dieses externen Signals be-stimmt. Die angegriffene Ausführungsform habe keine Möglichkeit, das stabile PWM-Signal nur für einen bestimmten Zeitraum oder unter bestimmten Bedingungen zu verwenden.
22. Daneben bediene sich die angegriffene Ausführungsform auch keines elektronischen Mit-tels, das nach einer Ermittlung, ob eine externe Steuerung angeschlossen sei und der Ermitt-lung der Bedarfsumstände, selbst auf diese umschalte. Ein Mittel, das in der Lage sei, eine externe Steuerung sowohl um- als auch zur internen Regelung zuzuschalten sei dort nicht vorhanden. In der angegriffenen Ausführungsform werde lediglich das Eingangs-PWM-Signal in eine für den eingebauten Mikroprozessor lesbare Sprache „übersetzt“, der dann die in-terne Pumpenregelung im Sinne eines Overrides „überschreibe“. Ein Zuschalten sei nicht möglich. Dafür würden die Eingangssignale durch die Schnittstellen in Befehle umgewandelt, die der Mikroprozessor lesen könne. Dieser Mikroprozessor sei darüber hinaus von der Soft-ware abhängig, mit der er programmiert sei. Diese Software werde von der Beklagten selbst entwickelt und auf den Prozessor gespielt. Die interne Logik der Software lasse nur zu, dass der Mikroprozessor das Signal der internen Regelung mit dem übersetzten Eingangs-PWM-Signal überschreibe. Die Pumpe werde dann über „externe Elemente und Komponenten“ gesteuert, die an die Schnittstellen angeschlossen seien. Wie der Mikroprozessor die Signale zu leiten habe und was an-, aus- und umgeschaltet werde, beeinflusse allein die Software, die kein patentgemäßes Entscheiden und bedarfsgemäßes Um- oder Zuschalten ermögliche. Es gebe mithin bei der angegriffenen Ausführungsform keine zusätzliche Entscheidungslogik, die über das aus dem Stand der Technik bekannte reine Durchstellen hinausginge.
23. Schließlich weist die Beklagte auf vorgerichtlich zwischen den Parteien geführte Vergleichs-gespräche hin. Dort habe die Beklagte aus rein wirtschaftlichen Gründen unter anderem ihre Lizenzbereitschaft signalisiert. Auch die Klägerin habe sich zunächst lizenzwillig gegeben. Im Zeitpunkt der Zustellung der Klage zum Einheitlichen Patentgericht hätten sich die Parteien mitten in Preisverhandlungen befunden.
24. Die Klägerin ist diesem Vorbringen entgegengetreten.
25. Soweit sich die Beklagte auf außergerichtliche Lizenzverhandlungen beziehe, hätten diese so nicht stattgefunden. Die Klägerin habe kein vorrangiges Interesse an der Auslizenzierung des Streitpatents an Wettbewerber. Ihr Ziel sei vielmehr die exklusive Eigennutzung der zu ihren Gunsten patentierten technischen Lehre. Vor diesem Hintergrund hätten die Prozessbevoll-

mächtigten nur für den Fall einer schnellen Konfliktlösung und unter im Einzelnen aufgelis-teten Rahmenbedingungen (vgl. Anlage K 11) ausnahmsweise die Einräumung einer Lizenz in Aussicht gestellt. Das entsprechende Schreiben sei den Prozessbevollmächtigten der Be-klagten jedoch erst nach Zustellung der vorliegenden Verletzungsklage zugegangen.
26. Entgegen der Auffassung der Beklagten mache die angegriffene Ausführungsform von der technischen Lehre des Streitpatents Gebrauch.
27. Aus dem Stand der Technik seien
Heizungsumwälzpumpen, die (nur) mittels einer internen elektronischen Rege-lung betrieben werden,
Heizungsumwälzpumpen, die (nur) über eine externe Steuerung zur Drehzahl-steuerung der Pumpe betrieben werden (typischerweise in Heizthermen) sowie
Heizungsumwälzpumpen, die (nur) mittels einer internen elektronischen Rege-lung betrieben werden, deren Sollwerte jedoch durch externe Vorgaben verän-dert werden können,
bekannt gewesen. Davon ausgehend liege der Erfindung die Aufgabe zugrunde, ein gattungs-gemäßes Kreiselpumpenaggregat so auszubilden, dass es sowohl in einer Heizungsanlage mit Betrieb der internen elektronischen Regelung als auch in einer Heiztherme mit externer An-steuerung oder (sogar) kombiniert Verwendung finden könne.
28. Entgegen der Auffassung der Beklagten sei das Vorhandensein von Mitteln zum Umschalten von der internen elektronischen Regelung auf eine externe Drehzahlsteuerung als auch zum Zuschalten einer externen Drehzahlsteuerung für eine Verwirklichung der unter Schutz ge-stellten technischen Lehre keine Bedingung. Zuschalten und bedarfsweises Umschalten seien ein und dasselbe und keine voneinander unabhängigen Alternativen. Dementspre-chend sei das Vorhandensein von sowohl Mitteln zum Umschalten von der internen elektro-nischen Regelung auf eine externe Drehzahlsteuerung als auch von Mitteln zum Zuschalten einer externen Drehzahlsteuerung für eine Verwirklichung der beanspruchten technischen Lehre keine Bedingung. Abgedeckt sei vielmehr auch ein Kreiselpumpenaggregat, das sowohl in einer Heizungsanlage mit Betrieb der internen elektronischen Regelung als auch in einer Heizungstherme mit externer Ansteuerung Verwendung finden könne. Dies gewährleisteten bei der erfindungsgemäßen Lösung insbesondere die Mittel zum ständigen Umschalten.
29. Ausgehend von einem solchen Verständnis habe die Beklagte die Verwirklichung der durch Patentanspruch 1 geschützten technischen Lehre nicht erheblich in Abrede gestellt.
Nichtigkeitswiderklage:
30. Nach Auffassung der Beklagten ist das Streitpatent in vollem Umfang für nichtig zu erklären, da der Nichtigkeitsgrund der mangelnden Ausführbarkeit im Sinne von Art. 138 Abs. 1 lit. b) EPGÜ gegeben sei.
31. Aus Sicht der Beklagten ergebe sich für den Fachmann aus der Streitpatentschrift nicht, was unter den „elektronischen Mitteln“ zu verstehen sei und wie diese auszugestalten seien, um zum erfindungsgemäßen Gegenstand zu gelangen. Aus dem Stand der Technik kenne der Fachmann bereits frequenzumrichtergesteuerte Heizungsumwälzungspumpenaggregate so-wie eine Signalübertragung über ein pulsweitenmoduliertes Signal, über das die Drehzahl

der Pumpe gesteuert werden könne. Dass hierbei zur Leistungseinstellung des Motors zu-sätzlich zum pulsweitenmodulierten Signal ein Drehzahlsteller, beispielsweise in Form eines Frequenzumrichters oder einer H-Brücke, erforderlich sei, sei dem Fachmann ebenfalls be-kannt. Da dem Fachmann auch klar sei, dass für diese aus dem Stand der Technik bekannten Pumpenaggregate irgendwelche Mittel erforderlich seien, die das anliegende Signal erken-nen und auswerten könnten, um es dem Drehzahlsteller, also dem Frequenzumrichter, zur Verfügung zu stellen, werde er versuchen, in der Streitpatentschrift hinsichtlich der Ausge-staltung der elektronischen Mittel fündig zu werden. Hierbei werde er allerdings nicht er-folgreich sein. Denn die „Mittel zum Umschalten oder Zuschalten“ seien in der Streitpatent-schrift nur sehr grob umrissen.
32. Daher fehle es zumindest aus zwei Gründen an der Ausführbarkeit:
33. Lege der Fachmann das Merkmal „Mittel“ entsprechend Patentanspruch 1 so aus, dass die gleichen Mittel zum Umschalten und Zuschalten geeignet wären, wäre die Erfindung nicht ausführbar, denn die Mittel würden in Patentanspruch 1 im Plural verwendet. Dies stehe im Widerspruch dazu, dass das, was man neutral als eine „Hardware-Einrichtung“ bezeichnen könnte, zugleich zwei Zwecke zu erfülle habe. Lege der Fachmann hingegen den Plural „die Mittel“ so aus, dass damit wirklich mehrere Einrichtungen gemeint seien, und zwar je we-nigstens eine zum Umschalten und zum Zuschalten, liege ebenfalls keine ausführbare Erfin-dung vor, weil das kennzeichnende Merkmal auf Mittel, die ausschließlich zum Zuschalten einer externen Drehzahl-Steuerung vorgesehen seien (aber nicht zum Umschalten), nicht eingehe und dementsprechend keine ausführbare Lehre angebe, mit der dieser Zweck er-reichbar wäre. Der Fachmann stehe daher vor dem Problem, die Mittel entweder als ein Bauteil auszuführen, wisse dann aber nicht, ob die „Mittel zum Umschalten“ das eine Bauteil betreffen oder doch mehrere Mittel erforderlich seien. Oder aber, er sehe mehrere Mittel jeweils zum Zuschalten oder zum Umschalten vor, erfahre dann aber nichts hinsichtlich einer Ausgestaltung von Mitteln zum Zuschalten.
34. Darüber hinaus sei das „Mittel zum Umschalten“ in Patentanspruch 1 auch undefiniert. Der Fachmann entnehme Abs. [0012] der Beschreibung des Streitpatents sowie Figur 2 dessel-ben, dass eine Entscheidung darüber getroffen werden solle, ob die Umschaltung ständig oder bedarfsweise erfolge. Die Kriterien dafür, ob die Umschaltung erfolgen solle, könnten also nicht rein digital (an oder aus) ausgeführt sein, wie es das Ausführungsbeispiel mit den Schalterkontakten am Hardware-Stecker für ein Kabel einer externen Steuerung vermuten lassen würde. Bei diesem Ausführungsbeispiel würde ein Mikroschalter an der Steckerauf-nahme für die Signalleitung dafür sorgen, dass bei eingestecktem Kabel die Umschaltung vorgenommen würde, und zwar unabhängig von allen etwaigen anderen Umständen im Be-triebszustand der Pumpe. Der Fachmann käme daher zu dem Schluss, dass das elektronische Mittel zum Umschalten folglich selbst feststellen müsse, ob eine Steuerung angeschlossen sei und selbst umschalten. Dies setze voraus, dass das Mittel in einem ersten Schritt in der Lage sei, einen Rechnungsprozess durchzuführen, an dessen Ende die Frage beantwortet sei, ob eine externe Regelung angeschlossen sei oder nicht. In einem weiteren Schritt müsse das elektronische Mittel dann anhand vorbestimmter Parameter „entscheiden“, ob auf die ex-terne Steuerung umgeschaltet werde oder nicht („Zuschalten“/„Umschalten“). Es komme erneut auf einen Rechnungsprozess an. Dies könne ein einfacher Stecker oder Mikroschalter allerdings nicht leisten. Demgegenüber sei Patentanspruch 1 so formuliert, dass im Fall des Erkennens einer externen Steuerung automatisch umgeschaltet werde. Das widerspreche aber der Bedeutung des Wortes „Zuschalten“, wonach es möglich sein müsse, dass bei Er-

kennung einer externen Steuerung die interne Regelung nicht abgeschaltet, sondern beibe-halten werde. Dafür müsse ein pumpeninterner Rechnungsprozess Signale senden und pa-rallel verarbeiten, während bestimmt werde, ob und wie auf welche Signale umgeschaltet werde. Wie die Mittel hierfür gestaltet werden könnten, sei für den Fachmann basierend auf der Streitpatentschrift ebenfalls nicht ersichtlich.
35. Überdies sei in der Streitpatentschrift auch nicht ausreichend offenbart, wie die elektroni-schen Mittel ermitteln, ob eine externe Steuerung angeschlossen sei oder nicht.
36. Des Weiteren sei die durch Patentanspruch 1 unter Schutz gestellte Lehre des Streitpatents jeweils ausgehend von der DE 101 39 510 A1 (D 5), dem GRUNDFOS DATENHEFT UPM2, UPM GEO, UPM2K Umwälzpumpen 50/60 Hz Dokument „Grundfosliterature-4927111.pdf“ einschließlich eines Screenshots einer Internetseite (D 6/D 6a), der WO 2008/073413 A2 (D 15), der WO 2008/073436A2 (D 16), einer Grundfos-Anleitung „Grundfos Magna Serie 2000 Montage und Betriebsanleitung“ (D 17) sowie dem „GRUNDFOS Data Booklet MAGNA, UPE Serie 200 circulator pump“ (D 19) nicht neu (Art. 24 Abs. 1 lit. c) EPGÜ i.V.m. Art. 138 Abs. 1 lit. a), Art. 54 EPÜ), wobei die Entgegenhaltungen D 15 bis D 19 erst mit der Replik zur Nichtigkeitswiderklage in das Verfahren eingeführt wurden.
37. Schließlich stellt die Beklagte die erfinderische Tätigkeit in Abrede (Art. 24 Abs. 1 lit. c) EPGÜ i.V.m. Art. 138 Abs. 1 lit. a), Art. 56 EPÜ). In diesem Zusammenhang beruft sich die Beklagte auf eine Kombination der EP 0 866 228 A2 (D 1), der EP 0 735 273 A1 (D 2), der D 6 und der EP 2 151 578 B1 (D 8), jeweils mit der Entgegenhaltung D 5. Ergänzend dazu hat sich die Beklagte erstmals in der Replik zur Nichtigkeitswiderklage im Hinblick auf Patentanspruch 1 auf eine Kombination der Entgegenhaltung D 5 mit einem Handbuch “ALPHA (model A) Ma-nual (D 7)“ sowie der D 5 mit der Verordnung (EU) Nr. 622/2012 der Kommission vom 11. Juli 2012 zur Änderung der Verordnung (EG) Nr. 641/2009 in Bezug auf die Anforderun-gen an die umweltgerechte Gestaltung von externen Nassläufer-Umwälzpumpen und in Pro-dukte integrierten Nassläufer Umwälzpumpen (D 20) berufen.
38. Ergänzend dazu hat die Beklagte mit Schriftsatz vom 19. Februar 2025 im Rahmen eines An-trages auf Zulassung weiterer Schriftsätze (App_8530/2025) eine Entscheidung des Chinesi-schen Nationalen Amtes für Geistiges Eigentum vom 6. Januar 2025 (nachfolgend: Amt, vgl. Anlagen B&B D 21) vorgelegt, von der sie mit Schriftsatz vom 10. Februar 2025 (App_11606/2025) als Anlage B&B D 22 eine deutsche Übersetzung zur Akte gereicht hat.
39. Im Hinblick auf die Ausführungen zur aus Sicht der Beklagten ebenfalls fehlenden Rechtsbe-ständigkeit der Unteransprüche wird auf die Nichtigkeitswiderklage Bezug genommen.
40. Die Klägerin verteidigt das Streitpatent in der erteilten Fassung. Hilfsweise macht sie insge-samt 7 Hilfsanträge geltend, hinsichtlich deren Fassung auf die Replik vom 22. Juli 2024 Be-zug genommen wird.
Rechtsfolgen:
41. Nach Auffassung der Beklagten sind die durch die Klägerin geltend gemachten Ansprüche auf Rechnungslegung, Rückruf und Vernichtung unverhältnismäßig.
42. Angaben zu den Namen und Anschriften der gewerblichen Abnehmer sowie der einzelnen Angebote, aufgeschlüsselt nach Angebotsmengen, -zeiten, -preisen und Typenbezeichnun-gen sowie den Namen und Anschriften der Angebotsempfänger müsse die Beklagte unter

Berücksichtigung des Verhältnismäßigkeitsgrundsatzes nicht machen. Die geforderten Anga-ben seien zur Bezifferung des Schadenersatzes nicht erforderlich.
43. Ein Rückruf der Heizungsumwälzpumpen, die in weiten Teilen bereits in Gebäudeheizungs-systeme eingebaut seien, sei, sofern dieser nicht im privaten Umfeld ohnehin ausgenommen sei, auch im gewerblichen Kontext sowohl unter Berücksichtigung des damit verbundenen Aufwands als auch der Kosten unverhältnismäßig.
44. Darüber hinaus sei ein Rückruf auch deshalb unverhältnismäßig, weil sich die Parteien vor Einreichung der Klage zum Einheitlichen Patentgericht in Lizenzverhandlungen befunden hätten. Die Klägerin habe die Beklagte über ihre Bereitschaft zur Vergabe einer Lizenz ge-täuscht, verlange nunmehr jedoch gleichwohl mit einer nicht gebotenen Klage einen voll-ständigen Rückruf.
45. Abgesehen davon sei ein Rückruf auch unter Berücksichtigung der Interessen der Abnehmer, insbesondere der Handwerker sowie der Immobilieneigentümer, nicht mit dem Verhältnis-mäßigkeitsgrundsatz vereinbar.
46. Schließlich könne das Gericht einen möglichen Schadenersatz in geeigneten Fällen wie dem Vorliegenden als Pauschalbetrag festsetzen. Die Parteien hätten zum Zeitpunkt der Klageer-hebung über eine Lizenz verhandelt. Dem Pauschalbetrag sei daher die höchstwahrschein-lich vereinbarte Lizenzgebühr zugrunde zu legen.
47. Die Klägerin ist diesen Ausführungen entgegengetreten.
48. Insbesondere benötige die Klägerin die im Rahmen der Auskunftserteilung und Rechnungs-legung begehrten Informationen zur Ermittlung des ihr zustehenden Schadenersatzes sowie zur Überprüfung der von der Beklagten zu machenden Angaben. Die Anordnung der bean-tragten Rechnungslegung sei auch verhältnismäßig. Bereits aufgrund sie treffender buchhal-terischer Aufbewahrungspflichten lägen der Beklagten die beizubringenden Informationen vor. Die Beklagte könne diese daher ohne unzumutbaren Aufwand in eine geordnete und aus sich heraus verständliche Aufstellung überführen. Das zwischen den Parteien beste-hende Wettbewerbsverhältnis mache die begehrte Rechnungslegung ebenfalls nicht unver-hältnismäßig.
49. Auch der begehrte Rückruf begegne unter Verhältnismäßigkeitsgesichtspunkten keinen Be-denken. Infolge der Handlungen der Beklagten befinde sich eine der Klägerin derzeit noch nicht bekannte Vielzahl von patentverletzenden Heizungsumwälzpumpen in den deutschen, französischen und italienischen Vertriebswegen. Diese Pumpen blockierten eine mögliche Nachfrage an entsprechenden von der Klägerin hergestellten Modellen. Daher bestehe ein schützenswertes Interesse der Klägerin, diesen von der Beklagten geschaffenen Störungszu-stand zu beseitigen. Ein milderes Mittel zur Beseitigung des Störungszustandes sei nicht er-sichtlich. Ebenso wenig könne sich die Beklagte mit Erfolg auf Interessen Dritter berufen. Dass einer Rückrufanordnung Interessen Dritter gegenüberstehen, sei dieser immanent. Dies allein begründe keine Unverhältnismäßigkeit. Hierfür müssten die betroffenen Drittin-teressen vielmehr ein Gewicht haben, dass sie das Interesse des Patentinhabers an der Durchsetzung des gesetzlich vorgesehenen Rückrufanspruchs erheblich überwiegen. Dies sei vorliegend jedoch nicht der Fall.
50. Ebenso wenig sei die begehrte Vernichtung unverhältnismäßig. Insoweit fehle es bereits an

Angaben der Beklagten, wie sie die Erzeugnisse in eine nicht patentverletzende Form abzu-wandeln gedenke.
51. Soweit die Beklagte eine Pauschalierung des Schadenersatzes anstrebe, sei es an der Kläge-rin, mit ihrem Vortrag darüber zu entscheiden, ob das Gericht Schadenersatz nach Art. 63 Abs. 3 lit. a) oder b) EPGÜ zusprechen solle. Darüber hinaus begehre die Klägerin im vorlie-genden Verfahren zunächst nur die Feststellung der Schadenersatzpflicht dem Grunde nach. Die Höhe des Schadenersatzes sei daher allenfalls in einem nachgelagerten Schadenersatz-verfahren relevant.
52. Die Beklagte ist dem Vorbringen der Klägerin entgegengetreten. Insbesondere bestehe als Alternative zum Rückruf die Möglichkeit einer Verplombung/Versiegelung der Signalein-gänge der Pumpen, sodass der Anschluss einer externen Drehzahlsteuerung unmöglich ge-macht werde. Auch könne die Beklagte von ihren Abnehmern strafbewehrte Absichtserklä-rungen unterzeichnen zu lassen, die garantieren sollen, dass eine externe Ansteuerung der Pumpe unterbleibe.
RECHTLICHE WÜRDIGUNG:
A. Zulässigkeit der Klage und der Nichtigkeitswiderklage
53. Die Verletzungsklage ist zulässig. Insbesondere ist die internationale Zuständigkeit der Lokal-kammer Düsseldorf nach Art. 31 EPGÜ i.V.m. Art. 71b Abs. 2 i.V.m. Art. 7 Abs. 2 der Verord-nung (EU) Nr. 1215/2012 (nachfolgend: Brüssel Ia-VO) gegeben. Gemäß Art. 32 Abs. 1 lit. a) EPGÜ ist das Einheitliche Patentgericht (EPG) darüber hinaus für Klagen wegen tatsächlicher oder drohender Verletzung von Europäischen Patenten ausschließlich zuständig, soweit – wie hier – kein Opt-out (Art. 83 Abs. 3 EPGÜ) erklärt wurde. Nachdem die Beklagte innerhalb der Einspruchsfrist keinen Einspruch eingelegt hat, gelten im Übrigen sowohl die Zuständig-keit des EPG als auch die Zuständigkeit der Lokalkammer Düsseldorf als anerkannt, R. 19 Abs. 7 VerfO.
54. Gegen die Zulässigkeit der Nichtigkeitswiderklage bestehen ebenfalls keine Bedenken. Ins-besondere ist das EPG auch international zuständig. Gemäß Art. 32 Abs. 1 lit. e) EPGÜ ist das EPG für Widerklagen auf Nichtigkeit von (europäischen) Patenten ausschließlich zuständig. Da derzeit kein Opt-Out von der ausschließlichen Zuständigkeit des Gerichts in Bezug auf das Streitpatent in Kraft ist, ist die internationale Zuständigkeit des EPG – als gemeinsames Ge-richt der Mitgliedstaaten des EPGÜ – gemäß Art. 31 EPGÜ i.V.m. Art. 24 Abs. 4, 71a Abs. 2 lit. a), 71b Abs. 1 Brüssel Ia-VO für die vorliegende Nichtigkeitswiderklage gegeben.
B. Relevanter Fachmann
55. Der relevante Fachmann ist nach Auffassung der Kammer ein Mechatroniker mit Fachhoch-schulabschluss und mehrjähriger Erfahrung in der Entwicklung von Umwälzpumpen.
C. Schutzbereich des Streitpatents
56. Das Streitpatent betrifft ein Kreiselpumpenaggregat in Gestalt eines Heizungsumwälzungs-aggregats.
57. Wie der Fachmann den einleitenden Bemerkungen in der Streitpatentschrift entnimmt be-stehen Kreiselpumpenaggregate typischerweise aus einer Kreiselpumpe und einem diese an-

treibenden Elektromotor, einem elektronischen Drehzahlsteller (wie etwa einem Frequenz-umrichter) für den Motor sowie einer internen elektronischen Regelung, bei welcher die Stellgröße die Drehzahl des Motors ist, wobei Drehzahlsteller und Regelung einen Teil des Aggregats bilden und typischerweise in einem Klemmen- bzw. Elektronikkasten neben dem Pumpen- und Motorgehäuse angeordnet sind. Regelgröße einer solchen Regelung sind bei-spielsweise der Differenzdruck zwischen dem Eingang und dem Ausgang der Pumpe, der Vo-lumenstrom sowie davon abgeleitete Größen (Abs. [0002]).
58. Bei modernen Heizumwälzungspumpen der vorgenannten Art zählt es, so führt die Streitpa-tentschrift weiter aus, zum Stand der Technik, dass die interne elektronische Regelung nicht nur eine Vielzahl von anwählbaren Regelkurven bereitstellt, sondern dass das Aggregat über einen internen Prozessor mit entsprechender Software verfügt, der in der Lage ist, anhand der Gegebenheiten in der Heizungsanlage, insbesondere der sich einstellenden Druckver-läufe, der sich annähernden Temperatur des Fördermediums, des Förderstroms und derglei-chen, die Sollwertgrößen der Regelung selbstständig an die Heizungsanlage anzupassen. Diese selbstlernende Sollwertanpassung der internen Regelung hat den Vorteil, dass sich die Pumpe in nahezu idealer Weise an die Anforderungen der Heizungsanlage anpasst und mit vergleichsweise geringer Energie betrieben werden kann (Abs. [0003]).
59. Daneben zählen frequenzumrichtergesteuerte Heizungsumwälzpumpenaggregate zum Stand der Technik, bei denen eine externe Steuerung zur Drehzahlsteuerung der Pumpe vor-gesehen ist. Diese externe Steuerung ist typischerweise Teil der zentralen Steuerung einer Heizungsanlage. Die Schnittstelle zur Drehzahlsteuerung ist ein Steuereingang an der Pumpe, über die ein pulsweitenmoduliertes Signal übermittelt wird, wobei die Pulsweite die effek-tive Spannung bzw. Frequenz und damit die Drehzahl der Pumpe bestimmt. Derartige Pum-pen sind beispielsweise in Gasthermen zu finden, wie sie als Kompaktheizgeräte in Wohnun-gen anzutreffen sind oder auch in kleineren Häusern Verwendung finden (Abs. [0004]).
60. Davon ausgehend haben sich ausweislich der Beschreibung des Streitpatents unterschiedli-che Pumpenbaureihen etabliert: Einerseits selbstlernende Heizungsumwälzpumpen, die in Heizungsanlagen vor Ort verbaut werden, und andererseits fremdgesteuerte Heizungsum-wälzpumpen, die typischerweise herstellerseitig in Heizthermen verbaut werden. Beispiele für Pumpen des Standes der Technik sind beispielsweise in der EP 0 886 228 A2 sowie in der EP 0 735 273 A1 offenbart. Da die hydraulischen Anforderungen in beiden Fällen häufig gleich sind, unterscheiden sich die Kreiselpumpenaggregate in ihrem mechanischen Aufbau praktisch nicht. Es sind jedoch herstellerseitig bei gleichen Anschlussdaten des Pumpenge-häuses stets zwei Baureihen zu produzieren. Auch müssen hinsichtlich des Ersatzes stets für jede der vorgenannten Anwendungen unterschiedliche Kreiselpumpenaggregate bevorratet werden, was aufwändig und teuer ist (Abs. [0005]).
61. Schließlich zählt es bei Heizungsumwälzungspumpen größerer Bauart, wie sie beispielsweise in Gruppen von zwei bis acht Pumpen parallel verbaut werden, zum Stand der Technik (Grundfos-Pumpe Typ Magna UPE), diese einzelnen Heizungsumwälzpumpen, die jeweils eine interne elektronische Regelung aufweisen, von außen anzusteuern, wobei hierbei nicht die interne Regelung als solche beeinflusst wird, sondern lediglich die Sollwertvorgaben (Abs. [0006]).
62. Davon ausgehend liegt der Erfindung nach der Streitpatentbeschreibung die Aufgabe (das technische Problem) zugrunde, ein gattungsgemäßes Kreiselpumpenaggregat so auszubil-den, dass es sowohl in einer Heizungsanlage mit Betrieb der internen elektronischen Rege-lung als auch in einer Heizterme mit externer Ansteuerung oder kombiniert Verwendung

finden kann (Abs. [0007]).
63. Zur Lösung dieser Aufgabe stellt Patentanspruch 1 des Streitpatents ein Heizungsumwälz-pumpenaggregat unter Schutz, das durch eine Kombination der folgenden Merkmale ge-kennzeichnet ist:
1. Heizungsumwälzpumpenaggregat
1.1. mit einer Kreiselpumpe (1),
1.2. mit einem die Pumpe (1) antreibenden Elektromotor (7),
1.3. mit einem elektronischen Drehzahlsteller (11) für den Motor (7)
1.4. und mit einer internen elektronischen Regelung (16),
1.4.1. bei welcher die Stellgröße die Drehzahl des Motors (7) ist.
2. Der Drehzahlsteller (11) und die Regelung (16) bilden einen Teil des Aggregates.
3. Es ist ein Signaleingang zur externen Ansteuerung des Motors (7) vorgesehen.
4. Es sind Mittel (20) vorgesehen
4.1. zum Umschalten von der internen elektronischen Regelung (16) auf eine externe Drehzahlsteuerung oder zum Zuschalten einer externen Drehzahl-steuerung.
4.2. Die Mittel (20) zum Umschalten sind elektronische Mittel, welche ermit-teln, ob eine externe Steuerung angeschlossen ist oder nicht und bei Er-mittlung einer angeschlossenen externen Steuerung auf die externe Steu-erung umschalten.
64. Gemäß Art. 69 EPÜ i.V.m. dem Protokoll über dessen Auslegung ist der Patentanspruch nicht
nur der Ausgangspunkt, sondern die maßgebliche Grundlage für die Bestimmung des Schutz-
bereichs eines europäischen Patents. Für die Auslegung eines Patentanspruchs kommt es
nicht allein auf seinen genauen Wortlaut im sprachlichen Sinne an. Vielmehr sind die Be-
schreibung und die Zeichnungen als Erläuterungshilfen für die Auslegung des Patentan-
spruchs stets mit heranzuziehen und nicht nur zur Behebung etwaiger Unklarheiten im Pa-
tentanspruch anzuwenden. Das bedeutet aber nicht, dass der Patentanspruch lediglich als
Richtlinie dient und sich sein Gegenstand auch auf das erstreckt, was sich nach Prüfung der
Beschreibung und der Zeichnungen als Schutzbegehren des Patentinhabers darstellt

65. Dies vorausgeschickt bedürfen einige Merkmale der Erläuterung.
66. Das durch Patentanspruch 1 unter Schutz gestellte Heizungsumwälzungspumpenaggregat zeichnet sich dadurch aus, dass es über eine interne elektronische Regelung (16) verfügt

(Merkmal 1.4.), die zusammen mit dem Drehzahlsteller (11) einen Teil des Aggregates bildet (Merkmal 2.). Da zugleich auch ein Signaleingang zur externen Ansteuerung des Motors (7) vorgesehen ist (Merkmal 3.), kann die Pumpe – anders als bei den in den Abs. [0003] und [0004] beschriebenen, aus dem Stand der Technik bekannten Lösungen – nicht nur aus-schließlich intern oder extern, sondern je nach Bedarf entweder intern oder extern gesteuert werden.
67. Erfindungsgemäß sind weiterhin Mittel (20) zum Umschalten von der internen elektroni-schen Regelung auf eine externe Drehzahlsteuerung oder zum Zuschalten einer externen Drehzahlsteuerung vorgesehen (Merkmale 4. und 4.1.).
68. Während unter einem Umschalten ausgehend vom allgemeinen Sprachgebrauch ein (voll-ständiger) Wechsel von der internen elektronischen Regelung auf eine externe Drehzahl-steuerung zu verstehen ist, tritt die externe Drehzahlsteuerung bei einem Zuschalten neben die interne Regelung.
69. Dass auch das Streitpatent von einem solchen Verständnis ausgeht, wird bereits mit Blick auf die (allerdings für die Reichweite des Schutzbereichs nicht entscheidende) englische Fassung des Patentanspruchs deutlich („means (20) are provided for switching over from the internal electronic regulation (16) to an external speed control or for the connection of an external speed control“). Entweder erfolgt ein Wechsel von der internen auf die externe Steuerung („switching over from … to“ = Umschalten) oder die externe Steuerung tritt lediglich zur in-ternen Steuerung hinzu („for connection of …“ = Zuschalten).
70. Damit im Einklang führt die Streitpatentschrift in Abs. [0028] im Rahmen der Erläuterung des bevorzugten Ausführungsbeispiels weiter aus:
„[…] wird die Steuer- und Regelelektronik (12) mittels eines elektronischen Schalters (20) so geschaltet, dass dann, wenn ein PWM-Signal an dem durch den Stecker (14) gebildeten Ein-gang anliegt, über den Frequenzumrichter (11) ein entsprechendes Drehzahlsignal für den Mo-tor (7) erzeugt […]. Die Steuer- und Regelelektronik (12) schaltet also dann auf den externen Eingang um, die interne Regelung kann dann ganz oder teilweise abgeschaltet sein.“

Wird die interne Regelung ganz abgeschaltet, entspricht dies dem Umschalten. Bei einer teil-weisen Abschaltung der internen Regelung bleibt diese demgegenüber noch aktiv, die ex-terne Steuerung wird mithin lediglich zugeschaltet.
71. Der Fachmann, der sich die Reichweite des Schutzbereichs von Patentanspruch 1 zu erschlie-ßen versucht, darf allerdings nicht aus dem Blick verlieren, dass die Merkmale 4. und 4.1. nicht verlangen, dass die Mittel tatsächlich umschalten oder zuschalten. Vielmehr sind da-nach lediglich Mittel (20) zum Umschalten von der internen elektronischen Regelung auf eine externe Drehzahlsteuerung oder zum Zuschalten einer externen Drehzahlsteuerung vorge-sehen. Merkmal 4.1. enthält somit lediglich Zweckangaben. Enthält ein Patentanspruch Zweckangaben, dienen diese üblicherweise dem besseren Verständnis der Erfindung. Sie ha-ben im Regelfall mittelbar die Wirkung, den durch das Patent geschützten Gegenstand da-hingehend zu definieren, dass er nicht nur die räumlich-körperlichen Merkmale erfüllen, son-dern auch ausgebildet sein muss, um für den im Patentanspruch angegebenen Zweck ver-wendbar zu sein (UPC_CFI_463/2023 (LK Düsseldorf), Anordnung v. 30.04.2024, Leitsatz 2 – 10x Genomics v. Curio Bioscience). Mit anderen Worten definieren Zweckangaben die durch ein Patent geschützte Sache näher dahin, dass diese nicht nur die räumlich-körperlichen

Merkmale erfüllen muss, die der Patentanspruch explizit formuliert. Vielmehr muss die Sa-che darüber hinaus so ausgebildet sein, dass sie die im Patentanspruch erwähnte Wirkung herbeiführen kann. Auf Merkmal 4.1. gewendet muss das Mittel somit derart ausgebildet sein, dass es ein Umschalten oder ein Zuschalten herbeiführen kann. Eine Eignung zum ku-mulierten Um- und Zuschalten verlangt Merkmal 4.1. nicht.
72. Die in Abs. [0007] der Streitpatentbeschreibung formulierte Aufgabe zwingt ebenso wenig zu einer anderen Bewertung wie der in der Streitpatentschrift gewürdigte Stand der Technik.
73. Wie der Fachmann den Absätzen [0003], [0004] und [0006] der Streitpatentschrift ent-nimmt, waren im Stand der Technik insgesamt drei Typen von Heizungsumwälzpumpen- aggregaten bekannt:
1. Heizungsumwälzungspumpen mit einer internen elektronischen Regelung (Abs. [0003]);
2. frequenzumrichtergesteuerte Heizungsumwälzungsaggregate, bei denen eine externe Steuerung zur Drehzahlsteuerung der Pumpe vorgesehen ist (Abs. [0004]);
3. Heizungsumwälzpumpen größerer Bauart, bei denen Gruppen von zwei bis acht Pumpen parallel verbaut sind, die jeweils eine interne elektronische Regelung aufweisen, die jeweils (auch) von außen angesteuert werden können, ohne dass die interne Regelung beeinflusst werden soll (Abs. [0006]).

Während die beiden erstgenannten Varianten entweder intern oder extern gesteuert wer-den, zeichnen sich Heizungsumwälzungspumpen der dritten Gruppe dadurch aus, dass die interne elektronische Regelung um eine externe Ansteuerung ergänzt wird, ohne dass dies zu einer Beeinträchtigung der internen elektronische Regelung führt.
74. Davon ausgehend wird der Fachmann weiterhin in seine Überlegungen einbeziehen, dass sich die in Abs. [0005] genannten Nachteile ausschließlich auf die beiden erstgenannten Va-rianten beziehen: Obwohl die hydraulischen Anforderungen in beiden Fällen häufig die glei-chen sind, unterscheiden sich die Kreiselpumpenaggregate in ihrem mechanischen Aufbau kaum. Gleichwohl sind bei gleichen Anschlussdaten des Pumpengehäuses stets zwei Baurei-hen zu produzieren, die sodann auch entsprechend bevorratet werden müssen.
75. Bezeichnet es das Streitpatent vor diesem Hintergrund als Aufgabe der Erfindung, ein gat-tungsgemäßes Kreiselpumpenaggregat so auszubilden, dass es sowohl in einer Heizungsan-lage mit Betrieb der internen elektronischen Regelung als auch in einer Heiztherme mit ex-terner Ansteuerung oder kombiniert Verwendung finden kann (Abs. [0007], Hervorhebung hinzugefügt), liest der Fachmann dies mit dem ihm zuvor vermittelten Wissen über die im Stand der Technik bekannten Pumpentypen. Daraus wird ihm klar, dass damit letztlich zwei Konstellationen angesprochen sind:
1. Das Heizungsumwälzpumpenaggregat ist sowohl in Heizungsanlagen mit Betrieb der internen Regelung als auch in einer Heiztherme mit externer Ansteuerung einsetzbar.

2. Das Heizungsumwälzpumpenaggregat ist in Heizungsanlagen einsetzbar, die so-wohl intern als auch extern angesteuert werden („oder kombiniert“).
Nur in der letztgenannten Variante bedarf es zwingend der Möglichkeit der Zuschaltung. Da-mit im Einklang verlangt Merkmal 4.1. lediglich die Eignung zur Umschaltung oder Zuschal-tung, nicht aber, dass das entsprechende Mittel stets sowohl zum Um- als auch zum Zuschal-ten geeignet sein muss.
76. Merkmal 4.2. konkretisiert die Mittel (20) zum Umschalten weiter dahingehend, dass es sich um elektronische Mittel handeln muss, die ermitteln, ob eine externe Steuerung angeschlos-sen ist oder nicht und die bei Ermittlung einer angeschlossenen externen Steuerung auf diese umschalten.
77. Bis auf die Vorgabe, dass es sich um elektronische (und damit nicht etwa nur mechanische) Mittel handeln soll, werden die Mittel ausschließlich funktional beschrieben: Sie müssen (1) ermitteln, ob eine externe Steuerung angeschlossen ist oder nicht und (2) für den Fall, dass eine angeschlossene externe Steuerung angeschlossen ist, auf diese umschalten. Mehr ver-langt Merkmal 4.2. nicht. Er enthält insbesondere keine Vorgaben dazu, wie die Ermittlung des Anschlusses einer externen Steuerung erfolgt. Diese kann mithin unmittelbar dadurch erfolgen, dass etwa der Kontakt zwischen Stecker und Gegenstecker durch einen Mikroschal-ter innerhalb des Steckers erfasst wird (vgl. Abs. [0027]). Ebenso vom Schutzbereich erfasst ist jedoch auch eine Gestaltung, bei welcher die Ermittlung mittelbar, etwa durch die Erfas-sung des Vorhandenseins eines externen Steuersignals, erfolgt. Darüber hinaus stellt Pa-tentanspruch 1 die Entscheidung, wie das Umschalten erfolgt, in das Belieben des Fach-manns.
78. Soweit die Beklagte demgegenüber das Vorhandensein einer Entscheidungslogik in dem Sinne verlangt, dass das Mittel in der Lage sein muss, eigene Entscheidungen in Bezug auf das externe Signal und die Übernahme der Steuerung der Drehzahl zu treffen, lässt sich ein solches Verständnis bereits nicht mit dem Wortlaut von Patentanspruch 1 in Einklang brin-gen. Danach ermitteln die Mittel (20), ob eine externe Steuerung angeschlossen ist oder nicht. Ist eine solche externe Steuerung angeschlossen, schalten die Mittel (20) auf die ex-terne Steuerung um. Einen eigenen Entscheidungsspielraum für die Frage des Umschaltens räumt Patentanspruch 1 dem Mittel gerade nicht ein. Ist die Bedingung – Anschluss einer externen Steuerung – erfüllt, ist die Folge des Eintritts dieser Bedingung vielmehr das Um-schalten. Dafür, dass die Mittel, wie von der Beklagten weiter vertreten, im Fall der Ermitt-lung des Anschlusses einer externen Steuerung zwischen einem Umschalten und einem Zu-schalten der externen Steuerung entscheiden, findet sich in Patentspruch 1 ebenso wenig ein Hinweis.
79. Die Streitpatentbeschreibung zwingt zu keiner anderen Bewertung. Dies gilt insbesondere auch unter Berücksichtigung von Abs. [0012], wo es heißt:
„Dabei sind erfindungsgemäß die Mittel zum Umschalten der internen elektronischen Rege-lung auf eine externe Drehzahlsteuerung oder zum Zuschalten einer externen Drehzahlsteue-rung so ausgebildet sein, dass diese ermitteln, ob eine externe Steuerung angeschlossen ist oder nicht und bei Ermittlung einer angeschlossenen externen Steuerung auf die externe Steu-erung ständig oder ggf. bedarfsweise umschalten.

80. Die dort erwähnte „ggf. bedarfsweise Umschaltung“ hat in dem für die Reichweite des

Schutzbereichs maßgeblichen Patentanspruch keinen Niederschlag gefunden. Soweit Abs. [0012] sodann davon spricht, dass eine geeignete elektronische Schaltung in Abständen er-mittelt, ob der Signaleingang mit einer externen Steuerung verbunden ist oder nicht, handelt es sich dabei explizit („beispielsweise“) um ein Beispiel, auf welches die Erfindung nicht re-duziert werden kann. Gleiches gilt, soweit die Streitpatentbeschreibung unmittelbar im An-schluss von der Ermittlung eines „hand shaking“ oder geeigneter „Einmesszyklen“ spricht. Schließlich handelt es sich auch bei der in Abs. [0027] i.V.m. Figur 2 beschriebenen Gestal-tung der „Steuer- und Regelelektronik“ lediglich um die Erläuterung eines bevorzugten Aus-führungsbeispiels, ohne dass der Schutzbereich auf eine solche Gestaltung beschränkt wäre. Anhaltspunkte dafür, dass sich das Streitpatent, wie von der Beklagten vertreten, gerade durch das Vorhandensein einer inneren Entscheidungs- und Steuerungslogik von dem in Abs. [0004] der Streitpatentbeschreibung Stand der Technik abzugrenzen versucht.
81. Auch wenn die Beklagte schließlich zur Begründung ihrer abweichenden Auffassung auf die Erteilungsakte verweist, bedarf die durch das Berufungsgericht bisher nicht abschließend be-antwortete Frage, ob und ggf. in welchem Umfang diese bei der Auslegung des Streitpatents Berücksichtigung finden darf, vorliegend keiner Entscheidung. Inwiefern Abs. [0013] im Rah-men der Patentauslegung noch Berücksichtigung finden darf oder ob dieser im Rahmen des Erteilungsverfahrens hätte angepasst werden müssen, ist vorliegend nicht entscheidungser-heblich. Selbst wenn ein einfacher Schalter am Pumpenaggregat durch die im Erteilungsver-fahren erfolgte Beschränkung auf elektronische Mittel, die ausgebildet sind, zu ermitteln, ob eine externe Steuerung angeschlossen ist der nicht und bei Ermittlung einer externen Steu-erung die externe Steuerung umzuschalten möglicherweise nicht mehr von Schutzbereich des Streitpatents erfasst ist, zwingt dies ausgehend von den vorstehenden Ausführungen nicht dazu, umgekehrt nur noch eine solche Gestaltung unter den Schutzbereich zu fassen, die über eine Steuer- und Entscheidungslogik verfügt.
D. Widerklage
82. Die Nichtigkeitswiderklage hat in der Sache keinen Erfolg.
I. Ausführbarkeit der Erfindung
83. Daran, dass die Erfindung gemäß Patentanspruch 1 so deutlich und vollständig offenbart ist,
dass ein Fachmann sie ausführen kann und damit die Voraussetzungen des Art. 83 EPÜ erfüllt
werden, bestehen keine Zweifel.
84. Um den dort aufgestellten Anforderungen zu genügen, muss der Gegenstand eines Patents auf der Grundlage des Patents in seiner Gesamtheit, einschließlich der Beispiele, unter Be-rücksichtigung des allgemeinen Fachwissens des Fachmanns hinreichend offenbart sein. Auch wenn die Erfindung in der Patentschrift ausführbar offenbart sein muss, ist bei der Prü-fung der ausreichenden Offenbarung auch das allgemeine Fachwissen zu berücksichtigen (UPC_CFI_355/2023 (LK Düsseldorf), Entscheidung v. 28.01.2025, S. 36 – Fujifilm v. Kodak).
85. Davon ausgehend vermag das Vorbringen der Beklagten die Ausführbarkeit der Erfindung nicht erheblich in Frage zu stellen.
86. Soweit die Beklagte darauf verweist, der Fachmann stehe vor dem Problem, die im Anspruch angesprochenen „Mittel zum Umschalten oder zum Zuschalten“ als ein Bauteil auszuführen, wisse dann aber nicht, ob die Mittel zum Umschalten das eine Bauteil betreffen oder ob doch mehrere Bauteile erforderlich sind, oder aber er sehe mehrere Mittel jeweils zum Zuschalten

und Umschalten vor, erfahre aus der Streitpatentschrift dann aber nichts hinsichtlich einer Ausgestaltung von Mitteln zum Zuschalten, betreffen diese Überlegungen nicht die Ausführ-barkeit, sondern allenfalls die Klarheit des Anspruchs. Diese ist jedoch kein Nichtigkeitsgrund im Sinne von Art. 138 EPÜ (vgl. dazu: UPC_CFI_50/2024 (LK Düsseldorf), Entscheidung v. 10.04.2025, Rz. 134 – Yellow Sphere v. Knaus Tabbert). Das diesbezügliche Vorbringen der Beklagten ist daher von vornherein nicht geeignet, die Rechtsbeständigkeit des Streitpatents erheblich in Abrede zu stellen. Abgesehen davon kennt der Fachmann nicht nur Mittel zum Umschalten. Ihm wird vielmehr mit einem Schalter in der Streitpatentbeschreibung auch beispielhaft ein solches Mittel genannt (vgl. Abs. [0013] sowie auch Unteransprüche 3 und 4). Die Erfindung ist mithin ausführbar.
87. Nichts anders gilt im Hinblick auf die durch die Beklagte im Zusammenhang mit der Ausführ-barkeit weiterhin angesprochene technische Gestaltung der Ermittlung des Anschlusses ei-ner externen Drehzahlsteuerung. Insoweit entnimmt der Fachmann Unteranspruch 4, dass die Mittel zum Umschalten einen Sensor oder Mikroschalter aufweisen, der zur Erfassung einer Konnektierung des elektrischen Anschlusssteckers des Signaleingangs ausgebildet ist. Ergänzend dazu findet der Fachmann in Abs. [0027] weiterhin den Hinweis, dass die Rege-lungselektronik bei dem in den Figuren 1 und 2 gezeigten Ausführungsbeispiel so ausgelegt ist, dass sie selbstständig erfasst, ob der Stecker (14) durch einen Gegenstecker (19) kontak-tiert ist. Dazu ist innerhalb des Steckers (14) ein Mikroschalter vorgesehen, der dies erfasst und elektronisch ermittelt, ob über den Gegenstecker eine elektronische Steuerung ange-schlossen ist. Sobald dies der Fall ist, wird die Steuer- und Regelelektronik (12) mittels des elektronischen Schalters (20) so geschaltet, dass dann, wenn ein PWM-Signal an dem durch den Stecker (14) gebildeten Eingang anliegt, über den Frequenzumrichter (11) ein entspre-chendes Drehzahlsignal für den Motor (7) erzeugt wird. Gründe, weshalb es ausgehend von dem vorstehend im einzelnen dargestellten Verständnis des Schutzbereichs an der Ausführ-barkeit der Erfindung fehlen soll, sind nicht ersichtlich.
II. Neuheit
88. Der durch die Beklagte entgegengehaltene Stand der Technik nimmt die technische Lehre des Streitpatents nicht neuheitsschädlich vorweg.
1. Maßstab der Neuheitsprüfung
89. Eine Erfindung gilt als neu, wenn sie in wenigstens einem der bekannten Merkmale von dem
im Stand der Technik Vorhandenen abweicht. Im Stand der Technik vorweggenommen ist
nur das, was sich für eine mit dem jeweiligen technischen Gebiet vertrauten Fachperson un-
mittelbar aus der Veröffentlichung oder Vorbenutzung ergibt (vgl. UPC_CoA_382/2024 (Be-
rufungsgericht), Anordnung v. 14.02.2025, APL_39664/2024 – Abbott v. Sibio). Erkenntnisse,
die ein Fachmann erst aufgrund weiterführender Überlegungen oder der Heranziehung wei-
terer Schriften oder Benutzungen gewinnt, sind nicht Stand der Technik (vgl.
UPC_CFI_50/2024 (LK Düsseldorf), Entscheidung v. 10.04.2025, Rz. 136 – Yellow Sphere v.
Knaus Tabbert; UPC_CFI_7/2024 (LK Düsseldorf), Entscheidung v. 03.07.2024 – Kaldewei v.

2. Neuheitsprüfung im Einzelfall
90. Davon ausgehend erweist sich die durch Patentanspruch 1 unter Schutz gestellte Erfindung gegenüber dem von der Beklagten entgegengehaltenen Stand der Technik als neu.

a) DE 101 39 510 A1 (Anlage B&B D 5, nachfolgend: DE `510 oder D 5)
91. Die DE `510 A1 betrifft ein Verfahren zur Regelung der Drehzahl einer Umwälzpumpe im Heizkreislauf zwischen einem Heizkessel und mindestens einem wärmeverbrauchenden Heizkreis in einer Heizungsanlage mit einem Regelgerät. Zur Durchführung des Verfahrens wird eine Umwälzpumpe mit einer Messeinrichtung zur Erfassung der Druckdifferenz und mit einem zusätzlichen Eingang für ein Signal zur Pulsweitenmodulation eingesetzt (Abs. [0010]). Wie der Fachmann der Entgegenhaltung weiter entnimmt, wird mit dem dort offen-barten Verfahren eine herkömmliche, durch Messung der Druckdifferenz in der angeschlos-senen Leitung des Heizkreislaufs arbeitende Pumpe manipulierbar. Dadurch werden die Ar-beitsweisen einer druckdifferenzgeregelten und einer pulsweitenmodulierten Pumpe zu-sammengeführt, ohne auf die jeweiligen Vorteile zu verzichten. Eine vorzugsweise modular aufgebaute Regelschaltung kann sowohl direkt an der Umwälzpumpe als auch am Regelgerät angebracht sein. Die beiden anliegenden Signale zur Pulsweitenmodulation und zur Druck-differenz, die beide Rückschlüsse auf die gewünschte Fördermenge zulassen, werden von der Regelschaltung permanent ausgewertet (Abs. [0011]).
92. Ein Ausführungsbeispiel der in der D 5 offenbarten Erfindung ist in den nachfolgend einge-blendeten Figuren 1 und 3 der Entgegenhaltung dargestellt. Figur 1 zeigt die Reaktion einer Umwälzpumpe nach dem Verarbeiten von unterschiedlichen Signalen durch eine Regelschal-tung:

94. Bei der vorstehend eingeblendeten Anordnung sind die Messeinrichtung (4) zur Erfassung

der Druckdifferenz sowie die Regelschaltung (5) zur Signalauswahl in die Umwälzpumpe (1) integriert. Wenn das Regelgerät (3) kein Signal zur Pulsweitenmodulation an die Regelschal-tung liefert, arbeitet die Umwälzpumpe (1) nach der intern gemessenen Druckdifferenz. Liegt demgegenüber ein Signal zur Pulsweitenmodulation an der Regelschaltung (5) an, be-kommt dieses entsprechend den vorgegebenen Auswahlkriterien Vorrang oder nicht.
95. Davon ausgehend fehlt es bereits an der Offenbarung einer Kreiselpumpe (Merkmal 1.1.). Offenbart ist zwar eine Umwälzpumpe. Nichts gesagt ist jedoch über deren Typ. Soweit die Beklagte vor diesem Hintergrund in der mündlichen Verhandlung darauf verwiesen hat, der Fachmann sei ausgehend von der Verordnung (EU) 622/2012 zur Änderung der Verordnung (EG) Nr. 641/2009 in Bezug auf die Anforderungen an die umweltgerechte Gestaltung von externen Nassläufer-Umwälzpumpen und in Produkte integrierten Nassläufer-Umwälzpum-pen (vgl. Anlage D 20), nach welcher der Begriff „Umwälzpumpe“ eine Kreiselpumpe be-zeichne (Art. 2 Ziff. 1 dieser VO), gezwungen, die Pumpe als Kreiselpumpe auszuführen, ver-mag dies schon deshalb nicht zu überzeugen, weil die Verordnung zwar den Begriff der „Um-wälzpumpe“ zum Zwecke der Verordnung als Kreiselpumpe definiert. Aus der Verordnung geht jedoch nicht hervor, dass eine Umwälzpumpe (stets) als Kreiselpumpe auszuführen ist. Selbst wenn der Fachmann, was zu Gunsten der Beklagten unterstellt wird, die D 5 mit dem Wissen der D 20 liest, geht aus einer solchen Kombination daher jedenfalls nicht direkt und eindeutig hervor, dass es sich bei der in der D 5 gezeigten Umwälzpumpe tatsächlich um eine Kreiselpumpe im Sinne von Patentanspruch 1 des Streitpatents handelt.
96. Darüber hinaus offenbart die Entgegenhaltung auch keinen elektronischen Drehzahlsteller für den Motor im Sinne von Merkmal 1.3. Auch wenn eine Regelung der Drehzahl in Abs. [0018] Erwähnung findet und ein Drehzahlsteller damit unerlässlich sein dürfte, kann ein sol-cher auch etwa als hydraulische Kupplung und damit nicht elektronisch ausgestaltet sein. Es fehlt mithin auch an einer Offenbarung von Merkmal 1.3.
b) „Grundfos-Datenheft UPM2, UPM GEO, UPM2K Umwälzpumpen 50/60 Hz“ (Anlage B&B D 6, nachfolgend: Datenheft)
97. Auch das als Entgegenhaltung D 6 vorgelegte Datenheft offenbart die durch Patentanspruch 1 des Streitpatents unter Schutz gestellte technische Lehre des Streitpatents nicht neuheits-schädlich.
98. In dem Datenheft werden drei Reihen von Umwälzpumpen beschrieben. Während die UPM2 Pumpe für den Einbau in Heizkesseln oder anderen Heizungsanwendungen mit einer Fern-wärmeregelung der Pumpendrehzahl bestimmt ist, sind die Umwälzpumpen UPM Geo und UPPM2K besonders für Kaltwasseranwendungen geeignet (vgl. Anlage D 6, S. 3, linke Spalte). Wie der Fachmann dem Datenheft weiterhin entnimmt, handelt es sich bei dem Modell UPCM2 um fernregelbare, drehzahlgeregelte Hocheffizienz-Umwälzpumpen mit Perma-nentmagnetrotor und Frequenzumrichter, wobei die Regelung über ein digitales, pulswei-tenmoduliertes Niederspannungssignal erfolgt (Anlage D 6, S. 3, rechte Spalte oben). Die Re-gelung der betreffenden Pumpen erfolgt mithin grundsätzlich extern, es fehlt an einer inter-nen elektronischen Regelung im Sinne von Merkmal 1.4.
99. Die Funktionsweise des PWM-Eingangssignals ist auf S. 9 des Datenheftes wie folgt näher beschrieben:

100. Wie aus der vorstehend eingeblendeten Abbildung ersichtlich ist, erfolgt die Steuerung der Pumpe über das PWM-Signal, wenn dessen Prozentsatz zwischen 10 % und 84 % liegt. In diesem Intervall nimmt die Pumpendrehzahl linear vom Maximum zum Minimum ab. Sinkt der Prozentsatz, etwa infolge eines Kabelbruchs, unter 10 %, läuft die Pumpe mit maximaler Drehzahl weiter, um die Wärme vom primären Wärmetauscher zu übertragen. Liegt der Pro-zentsatz demgegenüber zwischen 85 % und 91 %, läuft die Pumpe mit minimaler Drehzahl. Für den Fall eines Prozentsatzes des PWM-Eingangssignals zwischen 91 und 95 % steuert die externe Drehzahlmit einer Hysterese, um zu verhindern, dass die Pumpe immer wieder an- und ausschaltet, wenn das Eingangssignal um den Schaltpunkt schwankt. Bei einem PWM-Signal zwischen 96 % und 100 % befindet sich die Pumpe in Betriebsbereitschaft.
101. Davon ausgehend fehlt es an einer internen Regelung, d.h. eines Abgleichs von Ist- und Soll-werten im Sinne von Merkmal 1.4. Die Steuerung erfolgt allein über das (externe) PWM-Signal. Fehlt es ausnahmsweise an einem solchen oder ist es zu schwach, läuft die Pumpe automatisch mit maximaler Drehzahl (vgl. Anlage D 6, S. 19, linke Spalte unten); eine interne Regelung findet auch dann nicht statt. Soweit die Beklagte vor diesem Hintergrund darauf verweist, intern werde die Pumpe von einem kleinen Frequenzumrichter geregelt, der mit Gleichspannung betrieben werde (vgl. Anlage D 6, S. 17, rechte Spalte unten), arbeitet ein solcher Frequenzumrichter selbst nicht ohne Steuerung oder Regelung zur Rückführung. Mit anderen Worten lässt ein solcher Frequenzumrichter die Pumpe mit einer bestimmten Dreh-zahl laufen, wenn er entsprechende Anweisungen erhält. Vor diesem Hintergrund ist dem Fachmann bewusst, dass der Frequenzumrichter nach seiner technischen Funktion nur der Drehzahlsteller für die Pumpe ist. Er kann die Pumpe nur in Abhängigkeit des am PWM-Ein-

gang anliegenden, d.h. extern zugeführten Niederspannungssignals regeln. Dass der Fre-quenzumrichter/Drehzahlsteller der D 6 darüber hinausgehend ein von einer internen Rege-lung erzeugtes Signal erhält, lässt sich der D 6, nach welcher die Pumpendrehzahl durch eine Fernregelung bestimmt wird (vgl. Anlage D 6, S. 3, linke Spalte), nicht entnehmen.
102. Da es an einer internen elektronischen Regelung fehlt, sind im Datenheft auch keine Mittel zum Umschalten im Sinne der Merkmalsgruppe 4. offenbart.
c) Weiterer Stand der Technik
103. Soweit die Beklagte ihren Neuheitsangriff darüber hinaus in ihrer Replik zur Nichtigkeitswi-derklage zusätzlich auf die WO 2008/073413 A2 (Anlage B&B D 15), die WO 2008/0734336A2 (Anlage B&B D 16), die „Grundfos-Anleitung – Grundfos Magna Series 2000“ (Anlage B&B D 17) sowie das „Grundfos Data Booklet MAGNA, UPE Series 2000 circulator pump“ (Anlage B&B D 19) gestützt hat, handelt es sich dabei um eine Klageerweiterung im Sinne von R. 263 VerfO (so auch: UPC_CFI_390/2023 (LK München, Panel 1), Entscheidung v. 13.09.2024, S. 42 – Koninklijke Philips N.V. v. Edrich).
104. Nach dieser Vorschrift kann eine Partei zu jedem Zeitpunkt des Verfahrens beim Gericht die Zulassung einer Klageänderung oder Klageerweiterung einschließlich einer (Nichtigkeits-) Widerklage beantragen. In dem Antrag ist zu begründen, weshalb die Änderung oder Ergän-zung nicht schon in dem ursprünglichen Schriftsatz enthalten war. Vorbehaltlich des Absat-zes 3 wird die Zulassung abgelehnt, wenn die Partei, welche die Änderung beantragt, unter Berücksichtigung aller Umstände das Gericht nicht davon überzeugen kann, dass (a) die in Rede stehende Änderung bei gebotener Sorgfalt nicht früher vorgenommen werden konnte und (b) die Änderung die andere Partei in ihrer Verfahrensführung nicht unangemessen be-hindert. Beide Bedingungen müssen unabhängig voneinander erfüllt sein. Die Beweislast, dass sowohl die Anforderungen von R. 263 Abs. 1 VerfO als auch die Ausschlussgründe ge-mäß R. 263 Abs. 2 VerfO nicht erfüllt sind, liegt beim Antragsteller. Daher muss dieser erklä-ren, warum die Änderung nicht in den ursprünglichen Schriftsätzen enthalten war. Ebenso muss das Gericht in der Lage sein, auf der Grundlage der Erklärung des Antragstellers über die in R. 263 Abs. 2 VerfO enthaltenen Ausschlusskriterien zu entscheiden (UPC_CFI_114/2024 (LK München, Panel 1), Anordnung v. 25.09.2024, S. 13 f. – Heraeus v. Vibrantz; UPC_CFI_483/2024 (LK München, Panel 2), Anordnung v. 28.02.2025 – Esko-Gra-phics v. XSYS).
105. Auch wenn zu Gunsten der Beklagten auch ohne einen ausdrücklichen Antrag unterstellt werden kann, dass mit der Einführung der weiteren Entgegenhaltungen konkludent ein An-trag auf Zulassung der damit verbundenen Erweiterung der Nichtigkeitswiderklage verbun-den ist, hat die Beklagte nichts dazu vorgetragen, was nach R. 263 Abs. 2 VerfO die Zulassung dieser Erweiterung der Nichtigkeitswiderklage trotz der Verspätung rechtfertigen könnte. Gründe, weshalb die betreffenden Schriften nicht bereits mit der Nichtigkeitswiderklage in das Verfahren eingeführt werden konnten, trägt die Beklagte nicht vor. Ebenso wenig lässt sich feststellen, dass die Zulassung der erstmals mit der Replik in das Verfahren eingeführten Entgegenhaltungen die Klägerin nicht unangemessen in ihrer Verfahrensführung behindert.
106. In diesem Zusammenhang gilt es zu berücksichtigen, dass das Verfahren vor dem EPG „front-loaded“ ausgestaltet ist. Daher sind die Nichtigkeitsgründe bereits in der Nichtigkeitswider-klage geltend zu machen. Auch sind die Dokumente, auf welche sich die Beklagte zur Begrün-dung der Nichtigkeitswiderklage stützt, mit der Nichtigkeitswiderklage vorzulegen. Dass dem so ist, geht bereits aus R. 25 Abs. 1 lit. b), c) und d) VerfO hervor. Danach muss die Widerklage

einen oder mehrere Nichtigkeitsgründe, die vorgebrachten Tatsachen und, soweit verfügbar, die vorgebrachten Beweismittel enthalten. Unter Berücksichtigung der in der Verfahrens-ordnung für den Regelfall vorgesehenen Abfolge von Schriftsätzen sowie dem damit verbun-denen strengen Fristenregime kann nur so gewährleistet werden, dass der Kläger in seiner Verfahrensführung nicht unangemessen benachteiligt wird. Finden sich die Nichtigkeits-gründe in der Nichtigkeitswiderklage, kann der Kläger auf dieses Vorbringen innerhalb einer Frist von 2 Monaten erwidern (R. 29 lit. a) VerfO) und bei Bedarf mit einem Änderungsantrag nach R. 30 Abs. 1 VerfO reagieren. Für die Duplik zur Nichtigkeitswiderklage steht ihm dem-gegenüber nur eine Monatsfrist zur Verfügung (R. 29 lit. c) VerfO). Auch kann er zu diesem Zeitpunkt Änderungsanträge nur unter den zusätzlichen Voraussetzungen von R. 30 Abs. 2 VerfO einbringen.
107. Davon ausgehend wäre es an der Beklagten gewesen, nicht nur die Gründe aufzuzeigen, die sie zunächst daran gehindert haben, die weiteren Entgegenhaltungen frühzeitig in das Ver-fahren einzuführen. Es wäre vielmehr darüber hinaus an ihr gewesen darzulegen, weshalb deren Berücksichtigung die Klägerin nicht unangemessen in ihrer Verfahrensführung behin-dert. Keine dieser Voraussetzungen hat die Beklagte hinreichend erfüllt, wobei insbesondere auch nicht ersichtlich ist, dass das ergänzende Vorbringen der Beklagten durch das Vorbrin-gen der Klägerin im Anschluss an die Nichtigkeitswiderklage veranlasst gewesen wäre. Daher sind die weiteren Entgegenhaltungen nicht zuzulassen (vergleichbar: UPC_CFI_263/2023 (CD Paris), Entscheidung v. 29.07.2024 – Bitzer v. Carrier; UPC_CFI_390/2023 (LK München, Panel 1), Entscheidung v. 13.09.2024 – Koninklijke Philips N.V. v. Edrich; UPC_CFI_430/2023 (Nor-dic-Baltic Regional Division), Vorläufige Anordnung v. 07.10.2024 – Abbott v. Dexcom).
III. Mangelnde erfinderische Tätigkeit
1. Maßstab
108. Gemäß Art. 56 EPÜ gilt eine Erfindung als auf einer erfinderischen Tätigkeit beruhend, wenn sie sich für den Fachmann nicht in naheliegender Weise aus dem Stand der Technik ergibt.
109. Nach Auffassung der Zentralkammer München (UPC_CFI_1/2023 (CD München), Entschei-dung vom 16.07.2024 – Sanofi v. Amgen), der sich die Lokalkammer Düsseldorf bereits in der Vergangenheit wiederholt angeschlossen hat (UPC_CFI_363/2023, Entscheidung vom 10.10.2024, – Seoul Viosys v. expert; UPC_CFI_16/2024, Entscheidung v. 14.01.2025 – Or-thovox v. Mammut; UPC_CFI_50/2024 (LK Düsseldorf), Entscheidung v. 08.03.2025, Rz. 166 – 173), bedarf es im Rahmen der Prüfung der erfinderischen Tätigkeit immer einer Beurtei-lung im Einzelfall unter Berücksichtigung aller relevanten Tatsachen und Umstände. Dabei ist ein objektiver Ansatz zu wählen. Die subjektiven Vorstellungen des Anmelders oder Erfin-ders sind unerheblich. Es ist nur relevant, was die beanspruchte Erfindung tatsächlich zum Stand der Technik beiträgt.
110. Die erfinderische Tätigkeit ist aus der Sicht des Fachmanns auf der Grundlage des gesamten Standes der Technik einschließlich des allgemeinen Fachwissens zu beurteilen. Es ist davon auszugehen, dass der Fachmann zum maßgeblichen Zeitpunkt Zugang zum gesamten allge-mein zugänglichen Stand der Technik hatte. Entscheidend ist, ob sich der beanspruchte Ge-genstand so aus dem Stand der Technik ergibt, dass der Fachmann ihn aufgrund seiner Kenntnisse und Fähigkeiten gefunden hätte, z. B. durch naheliegende Abwandlungen des bereits Bekannten.

111. Um zu beurteilen, ob eine beanspruchte Erfindung für einen Fachmann naheliegend war o-der nicht bedarf es zunächst der Bestimmung eines Ausgangspunktes im Stand der Technik. Es muss begründet werden, warum der Fachmann einen bestimmten Teil des Standes der Technik als realistischen Ausgangspunkt ansehen würde. Ein Ausgangspunkt ist realistisch, wenn seine Lehre für einen Fachmann von Interesse gewesen wäre, der zum Prioritätszeit-punkt des Streitpatents ein ähnliches Erzeugnis oder Verfahren wie das im Stand der Technik offenbarte zu entwickeln suchte, das also ein ähnliches Grundproblem wie die beanspruchte Erfindung hat (vgl. UPC_CoA_335/2024, Anordnung v. 26.02.2024, S. 34 – Nanostring v. 10x Genomics, unter „cc“ in der deutschen Originalfassung, „Für eine Fachperson, die sich zum Prioritätszeitpunkt des Verfügungspatents vor die Aufgabe gestellt sah, war [...] D 6 von In-teresse“). Es kann mehrere realistische Ausgangspunkte geben, wobei es nicht notwendig, den „vielversprechendsten“ Ausgangspunkt zu bestimmen.
112. Vergleicht man den beanspruchten Gegenstand nach Auslegung mit dem Stand der Technik, so stellt sich die Frage, ob es für den Fachmann naheliegend gewesen wäre, ausgehend von einer realistischen Offenbarung des Standes der Technik in Anbetracht des zugrundeliegen-den Problems zu der beanspruchten Lösung zu gelangen. Wenn es nicht naheliegend war, zu dieser Lösung zu gelangen, erfüllt der beanspruchte Gegenstand die Erfordernisse des Arti-kels 56 EPÜ.
113. Im Allgemeinen ist eine beanspruchte Lösung naheliegend, wenn der Fachmann, ausgehend vom Stand der Technik, motiviert wäre (d.h. einen Anreiz hätte, siehe den CoA in NanoString v. 10x Genomics, S. 34), die beanspruchte Lösung in Betracht zu ziehen und als nächsten Schritt („nächster Schritt“, vgl. UPC_CoA_335/2024, Anordnung v. 26.02.2024, S. 35, zweiter Absatz – Nanostring v. 10x Genomics) bei der Entwicklung des Standes der Technik umzuset-zen. Andererseits kann es von Bedeutung sein, ob der Fachmann mit besonderen Schwierig-keiten bei der Durchführung des nächsten Schritts oder der nächsten Schritte gerechnet hätte. Je nach den Tatsachen und Umständen des Falles kann es zulässig sein, Offenbarungen aus dem Stand der Technik zu kombinieren.
114. Eine technische Wirkung oder ein Vorteil, der durch den beanspruchten Gegenstand im Ver-gleich zum Stand der Technik erzielt wird, kann ein Hinweis auf erfinderische Tätigkeit sein. Ein Merkmal, das willkürlich aus mehreren Möglichkeiten ausgewählt wurde, kann im Allge-meinen nicht zur erfinderischen Tätigkeit beitragen.
115. Eine rückschauende Betrachtung muss vermieden werden. Die Frage der erfinderischen Tä-tigkeit sollte nicht dadurch beantwortet werden, dass bei Kenntnis des patentierten Gegen-stands oder der patentierten Lösung im Nachhinein nach (kombinierten) Offenbarungen des Stands der Technik gesucht wird, aus denen diese Lösung abgeleitet werden könnte.
b) Vorliegender Fall
116. Gemessen daran ist das Vorbringen der Beklagten nicht geeignet, die erfinderische Tätigkeit in Frage zu stellen.
aa) D 6 mit D 5
117. Dies gilt zunächst für die durch die Beklagte angesprochene Kombination der Entgegenhal-tung D 6 mit der Entgegenhaltung D 5.
118. Es erscheint bereits fraglich, ob es sich bei der D 6 um einen realistischen Ausgangspunkt für die Beurteilung der erfinderischen Tätigkeit handelt.

119. Die in der D 6 offenbarte Lösung unterscheidet sich von Patentanspruch 1 dadurch, dass es anders als bei der streitpatentgemäßen Lösung an einer internen elektronischen Regelung als Teil einer Baugruppe sowie davon ausgehend auch an einem Mittel zum Umschalten von einer solchen internen elektronischen Regelung auf eine externe Drehzahlsteuerung fehlt (Merkmal 1.4. und Merkmalsgruppe 4.). Auch wenn sich sowohl die D 6 als auch das Streit-patent auf eine Heizungsumwälzungspumpenbaugruppe beziehen, unterscheiden sich beide Lösungen in ihrer grundsätzlichen Auslegung und Gestaltung: Die in der D 6 offenbarte Pumpe ist allein auf eine externe Steuerung ausgerichtet. Das dem Streitpatent zugrundelie-gende Problem, ein gattungsgemäßes Kreiselpumpenaggregat so auszubilden, dass es so-wohl in einer Heizungsanlage mit Betrieb der internen elektronischen Regelung als auch in einer Heizterme mit externer Ansteuerung oder kombiniert Verwendung finden kann, stellt sich daher von vornherein nicht.
120. Abgesehen davon hat der Fachmann jedenfalls keinen Anlass, die in der D 6 offenbarte Lö-sung mit der D 5 gezeigten Gestaltung zu kombinieren.
121. Die in der D 6 offenbarten Pumpen sind auf eine Fernsteuerung der Drehzahl ausgelegt. In dieser Ausführungsform steuert im Regelfall die externe Drehzahlregelung die Pumpe. Fällt das PWM-Eingangssignal unter 10 %, läuft die Pumpe auf maximaler Drehzahl. Demgegen-über lehrt die D 5 die Hinzufügung eines weiteren kontinuierlichen Signals in Gestalt eines internen Steuersignals, das auf den Messwerten des Heizkreises basiert. Liegt kein PWM-Signal an, läuft die Pumpe auf der Grundlage des internen Steuersignals. Ist neben dem in-ternen Steuersignal ein externes PWM-Eingangssignal vorhanden, kann der Steuerkreis den Maximal- oder den Minimalwert für die Steuerung der Pumpe auswählen.
122. Davon ausgehend sind die Steuerung der D 6 und der D 5 als solche nicht kompatibel. Ein Fachmann würde daher den Regelkreis der D 5 nicht auf die interne Regelung der D 6 über-tragen.
bb) EP 0 866 228 A2 (D 1) mit D 5
123. Soweit die Beklagte das Fehlen der erfinderischen Tätigkeit weiterhin ausgehend von der
EP 0 866 228 A2 (Anlage B&B D 1, nachfolgend: EP `228 oder D 1) zu begründen versucht, ist
nicht ersichtlich, welchen Anlass der Fachmann haben sollte, die dort offenbarte Lösung mit
der in der D 5 offenbarten Steuerung zu kombinieren.
124. Die EP `228 offenbart ein Pumpenaggregat für Heizungsanlagen, welches auf eine Drossel- bzw. eine Regelkurve, vorzugsweise werksseitig, voreingestellt ist (Sp. 1, Z. 49 - 54). Durch eine solche werkseitige Voreinstellung der Drossel- bzw. Regelkurve kann das Aggregat ge-handhabt werden wie ein Pumpenaggregat ohne Steuerelektronik bzw. mit fest eingestellter Regelkurve (Sp. 2, Z. 8 - 12). Damit ein Fachmann das Aggregat auch bei Anwendungen ein-setzen kann, die eine Steuerung der Drehzahl erfordern, verfügt das Aggregat weiterhin über eine Einstellvorrichtung, mithilfe derer das Aggregat an die Erfordernisse der Heizungsanlage angepasst werden kann (Sp. 2, Z. 22 - 28). Ist die Einstellvorrichtung leitungsgebunden aus-gestaltet, kann im Aggregat beispielsweise im Klemmkasten eine Steckeraufnahme vorgese-hen sein, wie sie beispielsweise für die Aufnahme von Diagnosesteckern bekannt ist (Sp. 2, Z. 29 - 37). Wie der Fachmann Sp. 3, Z. 3 - 8 der Entgegenhaltung entnimmt, ist die Einstell-vorrichtung dabei „ausschließlich für vom Fachmann durchzuführende Einstellungen vorge-sehen“.
125. Auch wenn es sich davon ausgehend bei der D 1 um einen realistischen Ausgangspunkt für

die Beurteilung der erfinderischen Tätigkeit handeln dürfte, ist nicht ersichtlich, welchen An-lass der Fachmann haben sollte, die in der D 1 offenbarte Lösung, die sich durch eine interne Steuerung auszeichnet, die lediglich mithilfe einer ggf. leitungsgebunden anschließbaren Vorrichtung eingestellt werden kann, mit der in der D 5 offenbarten externen Steuerung zu kombinieren.
126. Das in der D 1 offenbarte Pumpenaggregat zeichnet sich gerade dadurch aus, dass es über eine interne Steuerung verfügt, die lediglich über eine externe Einstellvorrichtung durch den Fachmann an die individuellen Bedürfnisse der jeweiligen Heizungsanlage angepasst werden kann (vgl. Sp. 1, Z. 56 - Sp. 2, Z. 8). Die entsprechende Einstellvorrichtung wird dabei aus-drücklich dahingehend beschrieben, dass sie ausschließlich für vom Fachmann durchzufüh-rende Einstellungen vorgesehen ist (vgl. Sp. 3, Z. 3 - 8). Bei der in der D 1 vorgesehenen Einstellmöglichkeit handelt es sich mithin um keine externe Drehzahlsteuerung im Sinne des Streitpatents, weshalb es auch keiner Mittel zum Umschalten zwischen einer internen und einer externen Steuerung bedarf (Merkmal 3. und Merkmalsgruppe 4.).
127. Nachdem die D 1 die ihr zugrundeliegende Aufgabe, ein Pumpenaggregat zu schaffen, das einerseits den Anforderungen eines von moderner Elektronik unterstützten Pumpenaggre-gats genügt und andererseits gleichwohl ohne langwierige Einstellungen als Standardgerät einsetzbar ist, über eine voreingestellte und ausschließlich über eine separate Einstellvor-richtung änderbare Drossel- oder Regelkurve löst, bildet die Ausgestaltung der internen Steuerung den Kern der in der D 1 offenbarten Lösung. Durch die werkseitige Voreinstellung auf eine Drossel- bzw. Regelkurve kann das Aggregat wie ein Pumpenaggregat ohne Steuer-elektronik bzw. mit fest eingebauter Regelkurve gehandhabt werden (Sp. 2, Z. 8 - 12). Die notwendige Flexibilität bei der Anwendung wird über die (für den Fachmann vorgesehene) externe Einstellmöglichkeit (Sp. 3, Z. 3 - 8) erreicht.
128. Diese, den Kern der in der D 1 offenbarten Lösung bildende Kombination aus einer standar-disierten internen Steuerung und deren externer Einstellmöglichkeit würde durch das Vor-sehen einer externen Steuerung und den dann notwendigen Umschaltmitteln durchbrochen. Daher hat der Fachmann ausgehend von der D 1 keinen Anlass, die dort vorgesehene Lösung mit einer externen Steuerung sowie Umschaltmitteln zu kombinieren.
cc) EP 2 151 578 B1 (D 8) mit D 5
129. Auch ausgehend von der EP 2 151 578 (Anlage B&B D 8, nachfolgend: EP `578 oder D 8) in Kombination mit der D 5 fehlt es nicht an der erfinderischen Tätigkeit.
130. Die D 8 offenbart ein Umwälzpumpenaggregat, welches einen elektrischen Antriebsmotor und eine Steuereinrichtung zur Steuerung des Antriebsmotors aufweist. Dabei weist die Steuereinrichtung eine Kommunikationsschnittstelle auf, die zum Anschluss an mindestens einen externen Sensor und/oder mindestens eine weitere, von der Steuereinrichtung zu steuernde Einheit ausgebildet ist (Sp. 1, Z. 47 - 58). Die Steuereinrichtung ist so ausgebildet, dass sie die Funktion einer externen Steuereinheit übernehmen kann, wie sie in bekannten Anlagen verwendet wird. Die Kommunikationsschnittstelle ermöglicht die Kommunikation des Steuergerätes mit weiteren Anlagenkomponenten, insbesondere mit weiteren zu steu-ernden Geräten (Sp. 2, Z. 7 - 11). Dabei kann das Steuergerät eines Umwälzpumpenaggrega-tes oder einer Pumpe gleichzeitig die Steuerung oder Regelung weiterer Aggregate überneh-men, wie es in benannten Anlagen das externe Steuergerät übernimmt. Zusätzlich können über die Kommunikationsschnittstelle Sensoren angeschlossen werden, die das Steuergerät mit Systemparametern versorgen, um die Pumpe in Abhängigkeit von diesen Parametern

steuern zu können.
131. Ob das in der D 8 offenbarte, für große Anlagen mit zahlreichen Umwälzpumpen und mit einer zentralen Steuereinheit ausgelegte Umwälzpumpenaggregat überhaupt einen realisti-schen Ausgangspunkt für die Beurteilung der erfinderischen Tätigkeit darstellt, erscheint be-reits fraglich, bedarf jedoch keiner abschließenden Entscheidung. Selbst wenn dies der Fall sein sollte, fehlt es in der D 8 jedenfalls an der Offenbarung elektronischer Mittel im Sinne der Merkmalsgruppe 4., die feststellen, ob eine externe Steuerung angeschlossen ist oder nicht und die bei Feststellung einer angeschlossenen externen Steuerung auf diese umschal-ten (Merkmalsgruppe 4.). Ein solches elektronisches Mittel, welches die in Merkmal 4.2. ge-nannten Anforderungen in Gestalt des Umschaltens, sobald der Anschluss einer externen Steuerung ermittelt wurde, erfüllt, ist wie ausgeführt auch in der D 5 nicht offenbart.
132. Soweit die Beklagte vor diesem Hintergrund darauf verweist, bei einer Slave-Pumpe bedürfe es immer einer Koordination zwischen einer internen Regelung und einer externen Steue-rung, mag dies zutreffen. Dies bedeutet jedoch nicht zwangsläufig, dass der externen Steue-rung zwingend Vorrang einzuräumen ist, wenn das betreffende elektronische Mittel den An-schluss einer externen Steuerung detektiert (Unterstreichung hinzugefügt). Vielmehr ist die Haupt-Master-Pumpe nach der in der D 8 beschriebenen Lösung über eine Kommunikations-schnittstelle zur Datenübertragung mit zumindest einer Neben-(Slave)-Pumpe verbunden, wobei die Neben-Pumpe eine Steuereinrichtung aufweist, welche zur Steuerung der Neben-pumpe in Abhängigkeit von Daten ausgebildet ist, welche von der Hauptpumpe empfangen werden (vgl. D 8, Abs. [0021]). Die Steuerung erfolgt mithin weiterhin – in Abhängigkeit von Daten, die von der Hauptpumpe empfangen wurden – durch die Steuerung der Neben-Pumpe. Haupt-Pumpe und Neben-Pumpe sind mithin dauerhaft miteinander verbunden. Ein vollständiges Umschalten auf eine externe Steuerung für den Fall der Ermittlung des An-schlusses einer solchen durch ein elektronisches Mittel im Sinne der Merkmalsgruppe 4. fin-det nicht statt und ist auch nicht erforderlich.
133. Ausgehend vom Offenbarungsgehalt der D 8 hatte der Fachmann auch keinen Anlass, die dort offenbarte Lösung in Richtung eines Exklusivverhältnisses zwischen interner und exter-ner Steuerung weiterzuentwickeln. Ein solcher Anlass ergibt sich insbesondere auch nicht mit Blick auf das in den Figuren 1 und 2 gezeigte und in Abs. [0027] ff. beschriebene Ausfüh-rungsbeispiel. Zwar übernimmt bei der dort gezeigten Anlage die Hauptpumpe (12) die Steu-erung des Gesamtsystems, d.h. sie steuert die anderen Pumpen (44), (46) und (48) sowie die Ventile (vgl. Abs. [0036] f.). Jedoch steuert die durch die Haupt-Pumpe gesteuerte Neben-Pumpe (46) die Erwärmung des Wassers in dem Wasserspeicher sowie die Entnahme des Wassers aus dem Wasserspeicher (Abs. [0039]). Auch wenn die Neben-Pumpe (46) durch die Haupt-Pumpe und damit extern gesteuert wird, verfügt sie daher offenbar zusätzlich über eine interne Steuerung, um die von der Haupt-Pumpe empfangenen Steuersignale zu verar-beiten. Ein Umschalten von einer internen Steuerung auf eine externe Steuerung findet mit-hin nicht statt.
dd) EP 0 735 273 A1 (D 2) mit D 5
134. Schließlich ergibt sich die durch das Streitpatent unter Schutz gestellte technische Lehre auch nicht naheliegend aus der EP 0 735 273 A1 (Anlage B&B D 2, nachfolgend: EP `273 oder D 2) in Verbindung mit der Entgegenhaltung D 5.
135. In der EP `273 wird eine Doppelpumpe mit zwei in einem Gehäuse angeordneten Laufrädern offenbart, wobei jedes Laufrad von je einem Elektromotor angetrieben ist. Darüber hinaus

ist eine übergeordnete Steuerung und/oder Regelung vorgesehen, mithilfe derer die Dreh-zahlen der beiden Elektromotoren jeweils unabhängig voneinander beliebig zwischen dem Motorstillstand und der Nenndrehzahl einstell- oder regelbar sind (vgl. D 2, Abs. [0001]).
136. Die nachfolgend eingeblendete Figur 1 der D 2 verdeutlicht die dort offenbarte Lösung an-hand eines bevorzugten Ausführungsbeispiels:
137. Figur 1 zeigt eine Doppelpumpe mit einem Gehäuse (1), welches eine Pumpenansaugseite (2b) und eine Pumpenauslassseite (2a) hat. In dem Gehäuse (1) sind zwei nicht dargestellte Pumpenlaufräder angeordnet, die jeweils von den Elektromotoren (3a, 3b) angetrieben wer-den. Auf den Motorengehäusen sind Regelungen (5) als Module mittels Schraubverbindun-gen befestigt. Auf dem Regelungsmodul (5) ist das übergeordnete Steuerungsmodul (4) be-festigt, welches mittels eines Übertragungskabels (6) mit dem Regelungsmodul des zweiten Elektromotors (3b) verbunden ist und diesen über das Kabel (6) steuert.
138. Davon ausgehend fehlt es in der Entgegenhaltung jedenfalls an der Offenbarung eines elektronischen Mittels im Sinne der Merkmalsgruppe 4, welches ermittelt, ob eine externe Steuerung angeschlossen ist und das bei der Ermittlung einer angeschlossenen externen Steuerung auf eine solche externe Steuerung umschaltet.
139. Ausgehend von der D 2 hat der Fachmann auch keinen Anlass, ein solches Mittel vorzusehen. Die dort offenbarte Lösung zeichnet sich dadurch aus, dass die jeweilige Regelung (5) der einzelnen Pumpen die Motordrehzahl des zugehörigen Elektromotors entsprechend der von der übergeordneten Steuerung und/oder Regelung (4) vorgegebenen Führungsgröße einre-gelt (vgl. Unteranspruch 2). Die übergeordnete Steuerung bzw. Regelung und die jeweilige Regelung arbeiten mithin dauerhaft zusammen. Eines Umschaltens bedarf es nicht. Dass dem so ist, verdeutlicht die Erläuterung des in Figur 3 der D 2 dargestellten Blockschaltbildes, wo es in Sp. 5, Z. 40 – 45 heißt:
„Jede Regelung 5 ist über eine zusätzliche Kommunikationsschnittstelle mit der übergeordne-ten Steuerung 4 in Verbindung. Mittels der Kommunikationsschnittstelle tauschen die Rege-lungen 5 mit der übergeordneten Steuerung Daten aus.“
140. Ein solcher Datenaustausch setzt voraus, dass die übergeordnete Steuerung bzw. Regelung (4) mit den Regelungen (5) kommuniziert. Dies wird den Fachmann davon abhalten, ein Mit-tel, welches zwischen beiden Regelungen umschaltet, vorzusehen.

ee) D 5 mit D 7 bzw. D 20
141. Nachdem sich die Beklagte erstmals in der Replik zur Nichtigkeitswiderklage im Rahmen der Erörterung der erfinderischen Tätigkeit auf eine Kombination der D 5 mit der D 7 bzw. mit der D 20 berufen hat, handelt es sich auch dabei um einen neuen Angriff und daher um eine Klageerweiterung, deren Zulassung nur unter den in R. 263 VerfO niedergelegten Vorausset-zungen in Betracht kommt.
142. Diese liegen jedoch nicht vor. Weder hat es die Beklagte vermocht, tragfähige Gründe dafür aufzuzeigen, warum der nunmehr in das Verfahren eingeführte weitere Angriff auf die erfin-derische Tätigkeit nicht bereits in der Nichtigkeitswiderklage enthalten war. Noch kann vor dem Hintergrund des strengen Fristenregimes des EPG davon ausgegangen werden, dass die Klägerin durch die Zulassung nicht unangemessen in ihrer Verfahrensführung beeinträchtigt würde.
143. Soweit die Beklagte versucht, die erstmals in der Replik zur Nichtigkeitswiderklage zu fin-dende Diskussion einer Kombination der D 5 mit der D 7 bzw. der D 20 damit zu rechtfertigen, die Klägerin habe die Offenbarung einer Kreiselpumpe sowie eines Elektromotors in der D 5 in Abrede gestellt (vgl. Replik zur Nichtigkeitswiderklage, S. 26), vermag ihr dieses Vorbringen bereits deshalb nicht zum Erfolg zu verhelfen, weil sie bereits in der Nichtigkeitswiderklage selbst eingeräumt hat, aus der D 5 würden weder die Ausgestaltung der Umwälzpumpe als Kreiselpumpe noch der Antrieb der Pumpe über einen Elektromotor explizit offenbart (vgl. Nichtigkeitswiderklage, S. 25 oben). Davon ausgehend bot bereits das eigene Vorbringen der Beklagten Anlass, ausgehend von der D 5 zumindest hilfsweise das (vermeintliche) Fehlen in der erfinderischen Tätigkeit in der Nichtigkeitswiderklage zu diskutieren. Gleichwohl hat sich die Beklagte in ihrer Nichtigkeitswiderklage dazu entschieden, die erfinderische Tätigkeit ausschließlich ausgehend von der D 1, D 2, D 6 und D 8, jeweils in Kombination mit der D 5, zu erörtern. Nachvollziehbare Gründe, die es gleichwohl rechtfertigen würden, die erstmals in der Replik zur Nichtigkeitswiderklage aufgenommene Erörterung der D 5 als Ausgangs-punkt zuzulassen, hat die Beklagte nicht aufzuzeigen vermocht, weshalb die damit verbun-dene Erweiterung der Nichtigkeitswiderklage nicht zuzulassen war.
144. Wollte man dies anders sehen, hat die Beklagte jedenfalls auch nicht dargelegt, welchen An-lass der Fachmann haben sollte, die D 5 jeweils mit den genannten Schriften zu kombinieren. Greift der Beklagte – wie hier – erst im weiteren Verlauf des Nichtigkeitsverfahrens die er-finderische Tätigkeit unter Heranziehung einer weiteren Kombination von Schriften an und ist die damit verbundene Erweiterung der Nichtigkeitswiderklage ausnahmsweise zulässig, trifft den Beklagten insoweit jedenfalls eine hohe Substantiierungslast. Diesen hohen Anfor-derungen genügt das Beklagtenvorbringen nicht. Soweit die Beklagte in ihrer Replik zur Nich-tigkeitswiderklage (vgl. S. 31, zweiter vollständiger Absatz) davon ausgeht, der Fachmann sehe sich ausgehend von der D 5 vor die Aufgabe gestellt, die aus der D 5 bekannte Pumpe so zu konkretisieren, dass sie für den Einsatz als Umwälzpumpe in Heizungsanlagen optimiert sei, erscheint diese Betrachtung nicht nur rückschauend, sondern auch konstruiert und durch die Entgegenhaltung D 5 nicht veranlasst. Der bloße Verweis darauf, die D 7 beziehe sich bereits nach ihrem Titel auf eine „Umwälzpumpe“, genügt demgegenüber ebenso wenig zur Begründung einer Veranlassung wie der weitere Hinweis, beide Dokumente offenbarten jeweils für sich genommen eine Mehrzahl von Patentmerkmalen.

ff) Entscheidung des Chinesischen Nationalen Amtes für Geistiges Eigentum vom 6. Januar 2025 (nachfolgend: Amt)
145. Soweit die Beklagte außerhalb der ihr eröffneten Möglichkeiten zur Stellungnahme eine Ent-scheidung des Chinesischen Nationalen Amtes für Geistiges Eigentum vom 6. Januar 2025 vorgelegt hat (vgl. Anlage B & B 22), mit welcher ein chinesisches Parallelpatent wegen man-gelnder erfinderischer Tätigkeit vernichtet wurde, begründet das Amt seine Entscheidung mit einer Kombination der D 5 mit der D 7. Wie bereits ausgeführt hat es die Beklagte jedoch versäumt, die Kombination dieser Schriften rechtzeitig in das vorliegende Verfahren einzu-führen, weshalb ihr diesbezügliches Vorbringen und die damit verbundene Klageerweiterung nicht zuzulassen war. Vor diesem Hintergrund hat die Kammer auch die Entscheidung des Amtes nach R. 9 Abs. 2 VerfO unberücksichtigt gelassen.
E. Verletzung
I. Merkmalsverwirklichung
146. Zu Recht ist zwischen den Parteien eine Verwirklichung der Merkmalsgruppen 1. bis 3. nicht umstritten, so dass es insoweit keiner weiteren Ausführungen bedarf. Darüber hinaus macht die angegriffene Ausführungsform von den übrigen Merkmalen des Streitpatents Gebrauch. Ausgehend von dem vorstehend im Einzelnen herausgearbeiteten Verständnis verfügt die angegriffenen Ausführungsform über Mittel (20), die den Anforderungen der Merkmals-gruppe 4. genügen.
1. Funktionsweise der angegriffenen Ausführungsformen
147. Dass die angegriffene Ausführungsform über eine durch drei elektronische Komponenten realisierte interne Regelung verfügt, hat die Beklagte nicht in Abrede gestellt. Dabei erfasst eine Mehrzahl von Shunt-Widerständen die den Motor repräsentierenden Signale. Der Mikroprozessor verarbeitet die von den Shunt-Widerständen erfassten Motorstromsignale, um geeignete Signale für die Einstellung der Motordrehzahl auszugeben. Überdies verfügt die angegriffene Ausführungsform über eine H-Brücke (d.h. eine elektronische Schaltung), die den Elektromotor mit Spannung versorgt. Diese wird durch die genannten Ausgangssig-nale des Mikroprozessors gesteuert und steuert so die Geschwindigkeit des Elektromotors. Der Nutzer kann zwischen vier verschiedenen Haupt-Betriebsmodi der internen Pumpenre-gelung wählen, von denen drei in unterschiedlichen Stufen/Geschwindigkeiten zur Verfü-gung stehen. Dabei variieren die von der internen Pumpenregelung umgesetzten Regelkur-ven je nach ausgewähltem Betriebsmodus:

148. Im werksseitig voreingestellten AUTO-Modus passt die interne Regelung die Pumpenleistung in kurzen Regelintervallen innerhalb des in der vorstehenden Abbildung grün schraffierten Regelbereichs schrittweise automatisch an den tatsächlichen Wärmebedarf der Heizungsan-lage an. Abhängig vom Wärmebedarf der Heizungsanlage erfolgt mithin eine Anpassung der Sollwertgrößen über einen längeren Zeitraum durch die interne Regelung.
149. Des Weiteren weist das Pumpengehäuse der angegriffenen Ausführungsform neben einem Saug- und einem Druckanschluss zwei Anschlüsse für externe Leitungen auf, einen für die Stromversorgung und einen für den Anschluss einer Steuersignalleitung:
150. Über die Steuersignalleitung können dem pumpeninternen Mikroprozessor externe Steuer-signale in Form von Pulse-Width Modulation-Signalen (Pulsweitenmodulation) zugeführt werden.
2. Merkmale 4. und 4.1.
151. Dies vorausgeschickt verfügt die angegriffene Ausführungsform über Mittel zum Umschalten von der internen elektronischen Regelung (16) auf eine externe Drehzahlsteuerung oder zum Zuschalten einer externen Steuerung (Merkmale 4. und 4.1.). Wie die Kammer bereits im Rahmen der Auslegung des Patentanspruchs im Einzelnen dargelegt hat, muss das Mittel dafür derart ausgebildet sein, dass es ein Umschalten oder ein Zuschalten herbeiführen kann. Dies ist bei der angegriffenen Ausführungsform der Fall.
152. Der dort zu findende pumpeninterne Mikroprozessor ist über eine galvanische Trennung mit dem Anschluss für die externe Steuerung verbunden:

153. Er erkennt, wenn von der externen Steuerung über den gehäuseseitigen Anschluss PWM-Signale angelegt werden. Die Ansteuerung des elektrischen Motors erfolgt dann nicht mehr nach dem voreingestellten Betriebsmodus der internen Regelung, sondern entsprechend der von der externen Steuerung vorgegebenen PWM-Signale. Dabei gibt das Tastverhältnis der PWM-Signale die jeweils gewünschte Geschwindigkeit des elektrischen Motors vor. Es erfolgt mithin ein Umschalten von der internen auf die externe Drehzahlsteuerung.
154. Dass die Motordrehzahl bei der angegriffenen Ausführungsform entweder durch die interne Pumpenregelung oder durch die externe Drehzahlsteuerung bestimmt wird, so dass es an der Möglichkeit einer Kombination beider Steuerungen fehlt (vgl. dazu: Anlage B&B 9a/9b sowie B&B 11a/11b), steht einer Verwirklichung der unter Schutz gestellten technischen Lehre wie ausgeführt nicht entgegen. Die Einräumung der Möglichkeit des Zuschaltens der externen Drehzahlsteuerung setzt Patentanspruch 1 nicht zwingend voraus, solange die Mit-tel die Umschaltung von der internen elektronischen Regelung zur externen Drehzahlsteue-rung wie in Merkmal 4.2. beschrieben ermöglichen („oder Zuschalten“).
3. Merkmal 4.2.
155. Dass die angegriffene Ausführungsform ausgehend von dem vorstehend herausgearbeiteten Verständnis auch über elektronische Mittel im Sinne der Merkmalsgruppe 4.2. verfügt, er-schließt sich bereits aus den durch die Beklagten als Anlagen B&B 9a/9b bzw. B&B 11a/11b vorgelegten eidesstattlichen Versicherungen.
156. Danach umfasst die angegriffene Ausführungsform einen Mikroprozessor (MCU), einen PWM-Eingang für den Empfang externer PWM-Signale und eine Optokoppler-Isoliervorrich-tung. Der PWM-Eingang dient zur Verbindung mit einer externen Steuerung, um externe PWM-Signale zu empfangen. Das empfangene PWM-Signal wird dann von der Optokoppler-Isoliervorrichtung in ein von der MCU erkennbares digitales Impulssignal umgewandelt. Wenn die MCU das digitale Signal empfängt, wandet sie das digitale Impulssignal sofort in ein Drehzahlsignal um und gibt es über die H-Brücke an den Motor weiter (Anlagen B&B 9a/9b, Ziff. 5).
157. Sobald ein stabiles PWM-Signal anliegt, schaltet die angegriffene Ausführungsform auf die-ses Signal um. Sie verfügt mithin in Gestalt des Mikroprozessors über elektronische Mittel zum Umschalten von der internen Regelung zu einer externen Drehzahlsteuerung. Dass die angegriffene Ausführungsform dabei konstruktionsbedingt gezwungen ist, das stabile PWM-

Signal, sobald es vorliegt, für die Steuerung der Drehzahl zu verwenden und dementspre-chend in keiner Weise entscheiden kann (vgl. Anlagen B&B 11a/11b, Ziff. 3), führt aus dem Schutzbereich des Streitpatents nicht heraus. Die Einräumung einer Entscheidungsmöglich-keit verlangt Patentanspruch 1 nicht. Er schließt eine solche vielmehr sogar aus.
158. Der im Gehäuse der angegriffenen Ausführungsform angeordnete Mikroprozessor stellt so-mit ein elektronisches Bauteil und damit Mittel dar, welches den Anschluss der externen PWM-Drehzahlsteuerung erkennt und daraufhin auf diese umschaltet.
II. Vermeintliche Identität mit der in der Anlage B&B 7 gezeigten Gestaltung
159. Der durch die Beklagte erhobene Einwand, die im Stand der Technik („GRUNDFOS DATEN-HEFT UPM2, UPM GEO, UPM2K Umwälzpumpen 50/60 Hz“ aus dem Dezember 2012, vgl. Anlage B&B 7) beschriebenen Signale, Kontrollprinzipien, Schnittstellen und PWM-Input-Sig-nale und deren Beispielwerte sowie Schaltzeichnungen und Graphen stimmten mit der an-gegriffene Ausführungsform in allen hier relevanten belangen identisch überein, führt unab-hängig von der Frage, ob ein solcher Einwand im Rahmen der Verletzungsdiskussion bei einer wortsinngemäßen Patentverletzung überhaupt Bedeutung erlangen kann (dagegen: UPC_CFI_452/2023 (LK Düsseldorf), Anordnung v. 09.04.2024, S. 16 – Ortovox v. Mammut), schon deshalb nicht zum Erfolg, weil die dort gezeigte Umwälzpumpe anders als die ange-griffene Ausführungsform gerade nicht sowohl mittels einer internen Regelung als auch über eine externe Steuerung betrieben werden kann. Die Pumpe ist vielmehr ausschließlich zu einer externen Steuerung ausgebildet (vgl. Anlage B&B 7, S. 3). Ist kein zur Übertragung ge-eigneter PWM-Steuersignale geeignetes Kabel vorhanden, arbeitet die im Stand der Technik gezeigte Pumpe im Maximalbetrieb und nicht auf der Basis einer internen elektronischen Regelung (vgl. Merkmal 1.4.).
III. Verletzungshandlungen der Beklagten
160. Indem die Beklagte die angegriffene Ausführungsform im Geltungsbereich des Streitpatents
anbietet und vertreibt, hat sie unstreitig auch Verletzungshandlungen im Sinne von Art. 25
(a) EPGÜ begangen. Dabei begründet das Anbieten und in Verkehr bringen zugleich eine wi-
derlegbare Vermutung dafür, dass die Beklagte die angegriffene Ausführungsform ebenfalls
gebraucht bzw. zu den Zwecken des Anbietens, in Verkehrbringens oder Gebrauchens ein-
führt oder besitzt (UPC_CFI_7/2024 (Lokalkammer Düsseldorf), Entscheidung v. 03.07.2024
– Kaldewei v. Bette; UPC_CFI_363/2023 (Lokalkammer Düsseldorf, Entscheidung v.
10.10.2024 – Seoul Viosys v. expert e-Commerce; UPC_CFI_50/3035 (LK Düsseldorf), Ent-
scheidung v. 10.04.2025, Rz. 199 – Yellow Sphere v. Knaus Tabbert).
F. Rechtsfolgen
161. Nachdem sich das Streitpatent als rechtsbeständig und verletzt erwiesen hat, gilt im Hinblick auf die Rechtsfolgen Folgendes:
I. Unterlassung
162. Die Klägerin hat unter Berücksichtigung der Umstände des Falles ein Recht auf Untersagung der Fortsetzung der Verletzung gemäß Art. 25 lit. a) EPGÜ i.V.m. Art. 63 Abs. 1 EPGÜ.
II. Auskunftserteilung und Rechnungslegung
163. Ebenfalls hat die Klägerin ein Recht auf Auskunft gem. Art. 25 lit. a) EPGÜ i.V.m. Art. 67 EPGÜ.

Im Hinblick auf die begehrte Art und Weise der Auskunft bestehen keine Bedenken. Soweit die Klägerin Angaben zu den Namen und Anschriften der gewerblichen Abnehmer verlangt, begehrt sie damit Informationen über die Vertriebswege der verletzenden Erzeugnisse i.S.v. Art. 67 Abs. 1 lit. 1) EPGÜ.
164. Darüber hinaus kann die Klägerin nach Art. 68 Abs. 3 lit. a), b) EPGÜ i.V.m. R. 191 S. 1 Alt. 2 VerfO zum Zwecke der Rechtsverfolgung diejenigen Informationen verlangen, die sie zum Zwecke ihrer Rechtsverfolgung vernünftigerweise benötigt und die sie zudem in die Lage versetzen, die erteilten Auskünfte auf ihre Stichhaltigkeit überprüfen zu können und Anhalts-punkte für ihre Schadensberechnung zu erlangen (UPC_CFI_7/2023 (LK Düsseldorf), Ent-scheidung v. 03.07.2024, S. 29 – Kaldewei v. Bette; UPC_CFI_16/2024 (LK Düsseldorf), Ent-scheidung v. 14.01.2025, S. 36 – Ortovox v. Mammut; UPC_CFI_210/2023 (LK Mannheim), Entscheidung v. 22.11.2024, Rz. 179 – Panasonic v. Oppo). Dazu zählen auch Informationen zu einzelnen Angeboten, aufgeschlüsselt nach Angebotsmengen, -zeiten, -preisen und Ty-penbezeichnungen sowie der Namen und Anschriften der Angebotsempfänger.
165. Da der Antrag der Klägerin darauf gerichtet ist, zum Nachweis entsprechende Kaufbelege, nämlich Rechnungen, hilfsweise Lieferscheine vorzulegen, geht der weitere Einwand der Be-klagten, die Klägerin begehre (vermeintlich) die Vorlage von Rechnungen und Lieferschei-nen, ins Leere.
III. Rückruf
166. Die Anordnung des Rückrufs aus den Vertriebswegen in Bezug auf die unmittelbar verletzen-
den Erzeugnisse beruht auf Art. 64 Abs. 2 lit. b) EPGÜ. Die gestellte Fassung des Antrages ist
auch unter Bestimmtheitsgesichtspunkten nicht zu beanstanden.
167. Eine solche Rückrufanordnung begegnet auch unter Verhältnismäßigkeitsgesichtspunkten
(Art. 64 Abs. 4 VerfO) keinen Bedenken.
168. Dass die angegriffene Ausführungsform möglicherweise, wie von der Beklagten behauptet,
teils tief in Gebäudeheizsystemen verbaut ist, steht der Anordnung einer Verpflichtung zum
Rückruf aus den Vertriebswegen schon deshalb nicht entgegen, weil mit dem Rückruf ledig-
lich eine Rückruferklärung und damit ein bloßes Schreiben an die gewerblichen Abnehmer
geschuldet ist. Eine Entfernung aus den Vertriebswegen verlangt die Klägerin nicht. Auf die
durch die Beklagte angesprochenen Alternativmaßnahmen und insbesondere auf die Mög-
lichkeit der Verplombung kommt es daher im Zusammenhang mit dem Rückruf nicht an. Ab-
gesehen davon gehören zu den Vertriebswegen alle gewerblichen Besitzer und damit auch
die gewerblichen Endverbraucher (vgl. Tilmann/von Falck/Plassmann, Art. 64 Rz. 25). So-
lange die entsprechende Pumpe noch nicht in das Heizungssystem eines Gebäudes einge-
baut wurde, wäre sie deshalb selbst dann zurückzurufen, würde man – wie die Beklagte –
auf eine Handlung abstellen, die über die Rückruferklärung hinausgeht.
169. Die durch die Beklagte weiterhin angesprochenen Interessen der Hauseigentümer und
Handwerker stehen einer Verpflichtung zum Rückruf ebenfalls nicht entgegen. Pumpen, die
in Gebäuden privater Hauseigentümer eingebaut sind, unterfallen von vornherein nicht der
Verpflichtung zum Rückruf. Befinden sich die Pumpen demgegenüber im Besitz gewerblicher
Endabnehmer und wurden in deren Gebäude eingebaut, gelten die vorstehenden Ausfüh-
rungen entsprechend.
170. Soweit sich die Beklagte schließlich darauf beruft, die Parteien hätten sich bei Einreichung

der Klage in Lizenzverhandlungen befunden, wobei die Beklagte unter wirtschaftlichen Be-
dingungen bereit gewesen sei, angemessene Lizenzgebühren zu zahlen, sie sei jedoch durch
die Klägerin über die Bereitschaft zur Lizenzvergabe getäuscht worden, steht dies der Anord-
nung eines Rückrufs schon deshalb nicht entgegen, weil es zu keiner Lizenzvergabe gekom-
men ist. Gemäß Art. 25 EPGÜ gewährt ein Patent dem Inhaber das Recht, Dritten zu verbie-
ten, ohne seine Zustimmung die unter Buchstaben a) bis c) der Norm genannten Benutzungs-
handlungen durchzuführen. Das ausschließliche Recht zur Nutzung des Streitpatents ist da-
her der Klägerin zugewiesen, die grundsätzlich selbst entscheiden kann, ob und ggf. unter
welchen Bedingungen sie davon ausgehend das Patent lizenziert und damit Dritten ein Nut-
zungsrecht einräumt. Solange die Klägerin das Streitpatent nicht zu Gunsten der Beklagten
lizenziert und dieser damit ein Nutzungsrecht eingeräumt hat, steht der Beklagten kein Recht
zur Nutzung des Streitpatents zu. Bringt sie die angegriffene Ausführungsform gleichwohl in
patentverletzender Weise in die Vertriebswege, kann sie gegen eine daraus ggf. resultie-
rende Rückrufverpflichtung nicht mit Erfolg einwenden, sie habe auf eine spätere Lizenzein-
räumung vertraut.
IV. Vernichtung
171. Die Anordnung der Vernichtung findet ihre Grundlage in Art. 64 Abs. 2 lit. e), 64 Abs. 4 EPGÜ.
172. Da die Vernichtung den Eintritt oder Wiedereintritt der Erzeugnisse in den Markt zuverlässig
verhindern soll (UPC_CFI_16/2024 (LK Düsseldorf), Entscheidung v. 14.01.2025, S. 37 – Or-
tovox v. Mammut; Tilmann/von Falck/Tilmann, Einheitspatent, Einheitliches Patentgericht,
Art. 64 EPGÜ, Rz. 33), handelt es sich bei der durch die Beklagte als mögliche Ersatzmaßname
angesprochenen Verplombung bzw. Versiegelung der Signaleingänge der Pumpe sowie eine
Verpflichtung der Beklagten, ihre Abnehmer eine strafbewehrte Unterlassungserklärung un-
terzeichnen zu lassen, nur dann um relevante Alternativen, wenn sie sicherstellen, dass die
streitgegenständlichen Pumpen beim Einsatz einer derartigen Lösung nicht erneut in einen
patentverletzenden Zustand versetzt werden und dann in Verkehr gebracht werden können
(UPC_CFI_16/2024 (LK Düsseldorf), Entscheidung v. 14.01.2025, S. 37 – Ortovox v. Mam-
mut).
173. Dafür genügt die bloße Verpflichtung der Beklagten zur Einholung strafbewehrter Unterlas-
sungserklärungen schon deshalb nicht, weil eine solche Verpflichtung für die Klägerin kaum
zu überwachen wäre. Sie wird dem Interesse der Klägerin auf Vernichtung daher von vorn-
herein nicht gerecht.
174. Dass eine Verplombung bzw. Versiegelung der Eingänge diesen Anforderungen genügt, hat
die Beklagte ebenfalls nicht hinreichend aufzuzeigen vermocht. Hinzu kommt, dass sich auch
nicht feststellen lässt, dass es sich dabei, auch unter Berücksichtigung der dabei entstehen-
den Kosten, überhaupt um ein gegenüber einer Vernichtung milderes Mittel handelt.
Schließlich ist es der Beklagten auch nicht gelungen darzulegen, dass, ausgehend von dem
vorstehend im Einzelnen erläuterten Schutzbereich, eine mit einer Verplombung versehene
Gestaltung nicht mehr in den Schutzbereich des Streitpatents fällt.
V. Feststellung der Schadenersatzpflicht
175. Die Feststellung der Zuerkennung der Schadensersatzleistung dem Grunde nach ist auf der Grundlage von Art. 68 Abs. 1 EPGÜ möglich. Die Beklagte hätte bei entsprechender Sorgfalt erkennen müssen, dass sie durch ihre Handlungen das Streitpatent verletzt.

176. Soweit die Beklagte im Hinblick auf die Forderung nach Schadenersatz einwendet, als Scha-denersatz sei allenfalls ein Pauschalbetrag festzusetzen, bedarf diese Frage derzeit keiner Entscheidung. Die Entscheidung über die Höhe des Schadenersatzes ist dem sich ggf. an das Verletzungsverfahren anschließenden Höheverfahren vorbehalten. Im Verletzungsverfahren begehrt die Klägerin demgegenüber lediglich die Feststellung einer Schadenersatzpflicht dem Grunde nach.
VI. Vorläufiger Schadenersatz
177. Gemäß R. 119 VerfO kann das Gericht der obsiegenden Partei unter von ihm festgelegten
Bedingungen vorläufigen Schadenersatz zuerkennen, der zumindest die vorläufigen Kosten
des Schadenersatz- und Entschädigungsverfahrens auf Seiten der obsiegenden Partei abde-
cken soll.
178. Die Beklagte ist dem durch die Klägerin auf 64.000,- EUR bezifferten Betrag für den vorläufi-
gen Schadenersatz nicht erheblich entgegengetreten, weshalb dieser der Klägerin zugespro-
chen werden konnte.
VII. Androhung von Zwangsgeld
179. Die Androhung von Zwangsgeld für die Unterlassung (Art. 63 Abs. 2 EPGÜ) begegnet keinen Bedenken. Dies gilt auch unter Verhältnismäßigkeitsgesichtspunkten. Die Androhung für die Maßnahmen der Auskunft, Information, Rückruf, Entfernung und Vernichtung finden ihre Grundlage in Art. 82 Abs. 1 und 4 EPGÜ, R. 354 Abs. 3 VerfO (UPC_CFI_7/2023 (LK Düssel-dorf), Entscheidung v. 03.07.2024, S. 31, F. 5. – Kaldewei v. Bette; UPC_CFI_16/2024 (LK Düs-seldorf), Entscheidung v. 14.01.2025, S. 39 – Ortovox v. Mammut; UPC_CFI_50/2024 (LK Düs-seldorf; UPC_CFI_50/2024 (LK Düsseldorf), Entscheidung v. 10.04.2025, Rz. 276 f. – Yellow Sphere v. Knaus Tabbert).
180. Das angedrohte Zwangsgeld von bis zu 250.000,- EUR gibt der Kammer jeweils die notwen-dige Flexibilität, um im Fall der Zuwiderhandlung die jeweiligen Umstände des Einzelfalls ein-schließlich des Verhaltens des Verletzers zu berücksichtigen und davon ausgehend gemäß Art. 82 Abs. 4 S. 2 EPGÜ i.V.m. R. 354.4 VerfO ein angemessenes Zwangsgeld festsetzen zu können.
VIII. Kostengrundentscheidung
181. Gemäß Art. 69 Abs. 2 EPGÜ i.V.m. R. 118 Abs. 5 VerfO, R. 265 Abs. 2 lit. c) VerfO war eine
Kostengrundentscheidung zu treffen.
182. Da die Klägerin mit ihrer Verletzungsklage vollumfänglich obsiegt hat, ist es gerechtfertigt,
der Beklagten insoweit die Kosten des Verfahrens aufzuerlegen.
183. Die Nichtigkeitswiderklage ist erfolglos geblieben. Deren Kosten hat daher die Beklagte
ebenfalls zu tragen.
IX. Erstattungsobergrenze
184. Die Festsetzung der Obergrenze für erstattungsfähige Vertreterkosten beruht auf dem Be-
schluss des Verwaltungsausschusses über die Obergrenzen erstattungsfähiger Kosten vom
24. April 2023 (D - AC/10/24042023_D).

X. Keine Sicherheitsleistung
185. Gemäß Art. 82 Abs. 2 EPGÜ, R. 118 Abs. 8 S. 2 VerfO kann das Gericht jede Anordnung bzw. Maßnahme von einer Sicherheitsleistung abhängig machen, die es festzusetzen hat.
186. Wie bereits der Wortlaut der vorgenannten Norm verdeutlicht, steht der Kammer bei der Anordnung einer Sicherheitsleistung ein Ermessen zu, wobei das Interesse der Klägerin an einer effektiven Durchsetzung ihres Schutzrechts mit dem Interesse an der effektiven Durchsetzung möglicher Schadenersatzansprüche im Fall einer späteren Aufhebung des Urteils abzuwägen ist.
187. Es bedarf mithin stets einer Einzelfallprüfung. Zu den Faktoren, die bei der Frage nach der Anordnung einer Sicherheitsleistung zu berücksichtigen sind, gehören die finanzielle Lage des Klägers, die Anlass zu der berechtigten und realen Sorge geben kann, dass ein möglicher Schadenersatzanspruch bei einer Aufhebung oder Änderung der erstinstanzlichen Entschei-dung nicht oder nur mit einem unverhältnismäßigen Aufwand durchgesetzt und/oder voll-streckt werden kann. Ob und inwieweit solche Faktoren vorliegen, ist nicht anders als bei einem Antrag auf Sicherheitsleistung nach R. 158 VerfO anhand der von den Parteien vorge-tragenen Tatsachen und Argumente zu ermitteln. Macht die Kammer eine Anordnung oder Maßnahme von einer Sicherheitsleistung abhängig, dient dies dem Schutz der Position und der potenziellen Rechte des Beklagten. Dessen Schutz muss gegen die Belastung des Klägers durch die Anordnung einer Sicherheitsleistung abgewogen werden. Vor diesem Hintergrund obliegt es dem Beklagten, Tatsachen und Argumente vorzubringen, warum es im konkreten Fall angemessen erscheint, die Anordnung oder Maßnahme gemäß R. 118 Abs. 8 VerfO von einer vom Gericht festzusetzenden Sicherheitsleistung abhängig zu machen. Ist der Beklagte dem nachgekommen, obliegt es dem Kläger, diese Tatsachen und Gründe substantiiert zu bestreiten, zumal er in der Regel über Kenntnisse und Beweise zu seiner finanziellen Situa-tion verfügt. Ebenso ist es die Aufgabe des Klägers, gegebenenfalls darzulegen, weshalb trotz der durch den Beklagten vorgebrachten Gründe sein Interesse an der Durchsetzung seines Schutzrechts ohne Sicherheitsleistung überwiegt (vgl. UPC_CFI_50/2024 (LK Düsseldorf), Entscheidung v. 10.04.2025, Rz. 282 – 285 – Yellow Sphere v. Knaus Tabbert; UPC_CFI_16/2024 (LK Düsseldorf), Entscheidung v. 14.01.2025 – Ortovox v. Mammut; UPC_CFI_363/2024 (LK Düsseldorf), Entscheidung vom 10.10.2024 – Seoul Viosys v. expert).
188. Ausgehend von diesen Grundsätzen hat die Beklagte keine Gründe vorgetragen, die Anlass geben, die Vollstreckung im vorliegenden Fall von einer Sicherheitsleistung abhängig zu ma-chen. Die Kammer hat daher von der Anordnung einer solchen Vollstreckungssicherheit ab-gesehen.

ENTSCHEIDUNG:
A. Es wird festgestellt, dass die Beklagte das EP 2 778 423 B1 verletzt, wenn sie Heizungs-umwälzpumpenaggregate mit einer Kreiselpumpe, mit einem die Pumpe antreibenden Elektromotor, mit einem elektronischen Drehzahlsteller für den Motor und mit einer internen elektronischen Regelung, bei welcher die Stellgröße die Drehzahl des Motors ist, wobei der Drehzahlsteller und die Regelung Teil des Aggregates bilden, ein Signal-eingang zur externen Ansteuerung des Motors vorgesehen ist und Mittel zum Um-schalten von der internen elektronischen Regelung auf eine externe Drehzahlsteue-rung oder zum Zuschalten einer externen Drehzahlsteuerung vorgesehen sind, in Deutschland, Frankreich oder Italien anbietet/anbieten lässt, in Verkehr bringt/in Ver-kehr bringen lässt oder gebraucht/gebrauchen lässt oder zu den genannten Zwecken einführt oder besitzt, bei denen die Mittel zum Umschalten elektronische Mittel sind, welche ermitteln, ob eine externe Steuerung angeschlossen ist oder nicht und bei Er-mittlung einer angeschlossenen externen Steuerung auf die externe Steuerung um-schalten.
B. Der Beklagten wird aufgegeben,
I. es zu unterlassen, Heizungsumwälzpumpenaggregate mit einer Kreiselpumpe, mit einem die Pumpe antreibenden Elektromotor, mit einem elektronischen Drehzahlsteller für den Motor und mit einer internen elektronischen Regelung, bei welcher die Stellgröße die Drehzahl des Motors ist, wobei der Drehzahlsteller und die Regelung Teil des Aggregates bilden, ein Signaleingang zur externen An-steuerung des Motors vorgesehen ist und Mittel zum Umschalten von der inter-nen elektronischen Regelung auf eine externe Drehzahlsteuerung oder zum Zu-schalten einer externen Drehzahlsteuerung vorgesehen sind,
in Deutschland, Frankreich oder Italien anzubieten/anbieten zu lassen, in Ver-kehr zu bringen/in Verkehr bringen zu lassen, zu gebrauchen/gebrauchen zu las-sen oder zu den genannten Zwecken einzuführen oder zu besitzen, bei denen die Mittel zum Umschalten elektronische Mittel sind, welche ermitteln, ob eine ex-terne Steuerung angeschlossen ist oder nicht und bei Ermittlung einer ange-schlossenen externen Steuerung auf die externe Steuerung umschalten;
II. der Klägerin in einer geordneten und aus sich heraus verständlichen Aufstellung Auskunft darüber zu erteilen, in welchem Umfang sie die zu Ziff. B. I. bezeichne-ten Handlungen seit dem 28. Februar 2018 begangen hat, und zwar unter Angabe
1. des Ursprungs und der Vertriebswege der verletzenden Erzeugnisse,
2. der ausgelieferten, erhaltenen oder bestellten Mengen und der Preise, die für die verletzenden Erzeugnisse gezahlt wurden, und
3. der Identität aller an der Herstellung oder dem Vertrieb von verletzenden Erzeugnissen beteiligten dritten Personen,
wobei die Beklagte zum Nachweis der Angaben gemäß vorstehender Ziff. B. II. 1.

bis B. III. 3. die entsprechenden Kaufbelege, nämlich Rechnungen, hilfsweise Lie-ferscheine, in Kopie vorzulegen hat, wobei geheimhaltungsbedürftige Details au-ßerhalb der auskunftspflichtigen Daten geschwärzt werden dürfen;
III. der Klägerin in einer geordneten und aus sich heraus verständlichen Aufstellung darüber Rechnung zu legen, in welchem Umfang sie die zu Ziff. II. bezeichneten Handlungen seit dem 28. Februar 2018 begangen hat, und zwar unter Angabe
1. der einzelnen Lieferungen, aufgeschlüsselt nach Liefermengen, Lieferzei-ten, Lieferpreisen und Typenbezeichnungen sowie den Namen und An-schriften der gewerblichen Abnehmer,
2. der einzelnen Angebote, aufgeschlüsselt nach Angebotsmengen, Ange-botszeiten, Angebotspreisen und Typenbezeichnungen sowie den Namen und Anschriften der gewerblichen Angebotsempfänger,
3. der betriebenen Werbung, aufgeschlüsselt nach Werbeträgern, deren Auf-lagenhöhe, Verbreitungszeitraum und Verbreitungsgebiet,
4. der nach den einzelnen Kostenfaktoren aufgeschlüsselten Gestehungskos-ten und des erzielten Gewinns;
IV. die sich in ihrem unmittelbaren oder mittelbaren Besitz oder in ihrem Eigentum befindlichen, unter Ziff. II. bezeichneten Erzeugnisse an einen von der Klägerin zu benennenden Gerichtsvollzieher zum Zwecke der Vernichtung auf ihre, der Beklagten, Kosten herauszugeben;
V. die Beklagte zu verurteilen, die unter Ziff. B. I. 1. bezeichneten, seit dem 28. Feb-ruar 2018 in Verkehr gebrachten Erzeugnisse gegenüber den gewerblichen Ab-nehmern unter Hinweis auf den gerichtlich (Urteil des EPG vom 8. Mai 2025) fest-gestellten patentverletzenden Zustand der Sache und mit der verbindlichen Zu-sage zurückzurufen, etwaige Entgelte zu erstatten sowie notwendige Verpa-ckungs- und Transportkosten sowie mit der Rückgabe verbundene Zoll- und La-gerkosten zu übernehmen und die Erzeugnisse wieder an sich zu nehmen;
VI. der Klägerin vorläufigen Schadensersatz in Höhe von 64.000,- EUR zu zahlen;
VII. im Fall der Zuwiderhandlung gegen die Anordnungen gemäß Ziff. B. I., B. II., B. III., B. IV. und B. V. für jeden Fall der Zuwiderhandlung ein Zwangsgeld in Höhe von bis zu 250.000,- EUR zu zahlen.
C. Es wird festgestellt, dass die Beklagte verpflichtet ist, der Klägerin allen Schaden zu ersetzen, der ihr durch die zu Ziffer II. bezeichneten, seit dem 28. Februar 2018 began-genen Handlungen entstanden ist und noch entstehen wird.
D. Die Nichtigkeitswiderklage wird abgewiesen.
E. Die Kosten der Klage und der Nichtigkeitswiderklage trägt die Beklagte.
F. Der Streitwert der Klage und der Nichtigkeitswiderklage wird auf jeweils 1.000.000,-

EUR festgesetzt.
G. Die Obergrenze der erstattungsfähigen Vertretungskosten wird für die Klage sowie für die Nichtigkeitswiderklage insgesamt auf 200.000,- EUR festgesetzt.
H. Die Anordnungen zu Buchstaben B. I. bis B. VII. sind erst vollstreckbar, nachdem die
Klägerin dem Gericht mitgeteilt hat, welchen Teil der Anordnungen sie zu vollstrecken
beabsichtigt und, soweit erforderlich, eine beglaubigte Übersetzung der Anordnungen
in die Amtssprache des Vertragsmitgliedstaats, in dem die Vollstreckung erfolgen soll,
eingereicht hat und nachdem den Beklagte die Mitteilung und die – falls zutreffend –
(jeweilige) beglaubigte Übersetzung zugestellt wurde.

LANGUAGE OF THE PROCEEDINGS: German SUBJECT MATTER: Infringement action and counterclaim for annulment ORAL HEARING: 27 March 2025 BRIEF STATEMENT OF THE FACTS: 1. The plaintiff is suing the defendant for infringement of the German, French and Italian parts of European patent EP 2 778 423 B1 (hereinafter: the contested patent). 2. The patent in dispute was filed on 11 March 2013 in German as the language of the proceedings. The mention of the grant of the patent was published on 28 February 2018. The patent in dispute is in force in Germany, France and Italy. No opposition was filed against the grant of the contested patent at the European Patent Office. 3. The contested patent is entitled ‘Centrifugal pump unit’. Its protection claim 1 reads as follows: Protection claim 1: "Heating circulation pump unit with a centrifugal pump (1), with an electric motor (7) driving the pump (1), with an electronic speed controller (11) for the motor (7) and with an internal electronic control system (16), in which the control variable is the speed of the motor (7), wherein the speed controller (11) and the control system (16) form part of the unit, a signal input for external control of the motor (7) is provided, and means (20) for switching from the internal electronic control system (16) to an external speed control system or for connecting an external speed control system are provided, characterised in that the means (20) for switching over are electronic means which determine whether or not an external control is connected and, if an external control is detected, switch over to the external control. 4. Figures 1 and 2, which are shown below, illustrate a preferred embodiment of the invention. 5. Figure 1 shows an explosion view of a heating circulation pump unit: 6. Figure 2 is a block diagram of a unit according to Figure 1: 4 7. With its action, the plaintiff objects to the offer and sale of heating circulation pumps by the defendant in Germany, France and Italy. These include the heating circulation pumps offered, among other places in Germany, by the German company Jürgen Schlösser Armaturen GmbH under the product names JSA 20-4/130, JSA 20-6/130, JSA 25-4/180 and JSA 25-6/180, which the defendant also offers and distributes under its product names ‘GPA III’ (hereinafter: ‘infringed design’): 5 8. The defendant also offers its GPA III pumps in German, French and Italian on its website www.shinhoopump.com to interested parties based in Germany, France and Italy, among other countries: 6 7 CLAIMS OF THE PARTIES: Action: 9. The plaintiff requests that I. it be established that the defendant infringes EP 2 778 423 B1 when it manufactures heating circulation pump units with a centrifugal pump, an electric motor driving the pump, an electronic speed controller for the motor and an internal electronic control system in which the control variable is the speed of the motor, the speed controller and the control system forming part of the unit, a signal input for external control of the motor and means for switching from the internal electronic control system to an external speed control system or for connecting an external speed control system, in Germany, France or Italy, or has them offered, placed on the market, used or imported for the aforementioned purposes, in which the means for switching are electronic means which determine whether an external control is connected or not and, if an external control is detected, switch to the external control; II. the defendant is ordered to refrain from heating circulation pump units with a centrifugal pump, an electric motor driving the pump, an electronic speed controller for the motor and an internal electronic control system in which the control variable is the speed of the motor, wherein the speed controller and the control system form part of the unit, a signal input for external control of the motor is provided and means for switching from the internal electronic control system to an external speed control system or for connecting an external speed control system are provided, in Germany, France or Italy, to offer/have offered, to put into circulation/have put into circulation, to use/allow to be used or to import or possess for the aforementioned purposes, in which the means for switching are electronic means which determine whether an external control is connected or not and, if an external control is detected, switch to the external control; III. order the defendant to provide the plaintiff with information in a clear and comprehensible list of the extent to which it has committed the acts referred to in point II since 28 February 2018, specifying 1. the origin and distribution channels of the infringing products, 2. the quantities delivered, received or ordered and the prices paid for the infringing products, and 3. the identity of all third parties involved in the manufacture or distribution of infringing products, whereby the defendant must provide evidence of the information referred to in the preceding point III. 1. to III. 3., whereby details requiring confidentiality may be blacked out outside the data subject to disclosure; IV. order the defendant to provide the claimant with an orderly and comprehensible statement of the extent to which it has committed the acts referred to in point II. since 28 February 2018, specifying 1. the individual deliveries, broken down by delivery quantities, delivery times, delivery prices and type designations, as well as the names and addresses of the commercial customers, 2. the individual offers, broken down by offer quantities, offer times, offer prices and type designations, as well as the names and addresses of the commercial recipients of the offers, 3. the advertising carried out, broken down by advertising media, circulation figures, distribution period and distribution area, 4. the production costs broken down by individual cost factors and the profit achieved; V. the defendant be ordered to surrender the products referred to in section II, which are in its direct or indirect possession or ownership, to a bailiff to be appointed by the plaintiff for the purpose of destruction at the defendant's expense; VI. the defendant be ordered to surrender the products referred to in section II. and placed on the market since 28 February 2018 to commercial purchasers, with reference to the patent infringement established by the court (EPG judgment of ...) and with the binding undertaking to reimburse to reimburse any fees and necessary packaging and transport costs, as well as customs and storage costs associated with the return, and to take the products back; VII. to order the defendant, in the event of a breach of the orders in II., III., IV., V. or VI., to pay the court a penalty of up to EUR 250,000 for each case of non-compliance; VIII. to declare that the defendant is obliged to compensate the plaintiff for all provisional damages pursuant to clause IX. With regard to the wording of the ‘in particular, if’ requests, reference is made to the statement of claim. 11. The defendant requests that I. the action be dismissed; II. the plaintiff be ordered to pay the costs of the proceedings. Counterclaim: 12. The defendant requests that I. European Patent EP 2 778 423 B1 be declared invalid in its entirety pursuant to Art. 65(2) UPCA in conjunction with Art. 138(1) and Art. 139(2) EPC; 10 II. order the claimant to pay the costs of the proceedings. 13. The claimant requests that I. the counterclaim for revocation be dismissed; II. the defendant be ordered to pay the costs of the counterclaim for revocation and the claimant's costs in connection therewith. Requests for amendment of the patent: 14. In the event that the Board considers the counterclaim for revocation to be well founded, the plaintiff requests, conditionally in the form of auxiliary requests, that the contested patent be maintained to the extent of the claims formulated in auxiliary requests 1 to 6 in the corresponding order. With regard to the wording of the auxiliary requests in detail, reference is made to the request for amendment of the patent dated 22 July 2024. 15. The defendant has opposed the auxiliary requests. FACTUAL AND LEGAL ISSUES: Infringement action: 16. In the defendant's view, the contested patent explicitly sees its task and solution in combining all pump types known in the cited prior art in a single unit so that this can then be used for all the specified purposes. 17. The means provided for in the claim must be such that they allow both a genuine switchover from internal electronic control to external speed control and the connection of the external speed control. In the latter case, the internal and external speed control would be combined with each other in terms of time and function. Subclaims 6 and 7 separately protected specific embodiments of this ‘switching’. The fundamentally separate functions of switching and connecting must, according to the claim, be combined in a means provided for this purpose. 18. In order to implement the technical teaching protected by the contested patent, it is necessary for the electronic means (for switching and switching on) to ‘determine’ whether an external control is connected and then trigger the process of “switching”, including possible ‘switching on’. This must be linked to a decision-making logic that goes beyond merely ‘translating’ the PWM signal and overriding the internal control when an external control signal is applied. 19. Based on this understanding, the contested embodiment does not, in the defendant's view, make use of the technical teaching of the contested patent. 20. The defendant makes use of a state of the art for heating circulation pumps created by the plaintiff itself and published well before the priority date. This prior art corresponds to the ‘GRUNDFOS DATA SHEET UPM2, UPM GEO, UPM2K Circulation Pumps 50/60 Hz’ (hereinafter: ‘UPM pump’) from December 2012 (see Annex B&B 7). The signals, control principles, interfaces and PWM input signals described therein, together with their example values, circuit diagrams and graphs, were identical to the 11 contested embodiments in all relevant respects. Accordingly, the ‘UPM pump’ from the prior art also behaves identically to the contested embodiment in all relevant functions (detection and switching to the external signal). 21. Neither is the contested embodiment capable of determining the respective operating environment. Nor does it allow external control signals to be connected. The contested embodiment does not have any electronic means that would allow an external speed control to be connected. A control logic that would allow connection with the internal control signal as required has neither been demonstrated nor is it actually present in the contested embodiment. It is not possible to switch to an external control as required. As soon as a stable (i.e. interference-free) external PWM signal is present, this always takes precedence over the internal control of the contested embodiment and controls the pump permanently, i.e. until the signal ceases. As long as the contested embodiment receives a stable PWM signal, the speed of its motor is determined exclusively by the value of this external signal. The contested embodiment has no possibility of using the stable PWM signal only for a certain period of time or under certain conditions. 22. In addition, the contested embodiment does not use any electronic means which, after determining whether an external control is connected and determining the demand conditions, switches to this control itself. A means capable of switching an external control both to and from internal control is not present there. In the contested embodiment, the input PWM signal is merely ‘translated’ into a language readable by the built-in microprocessor, which then ‘overwrites’ the internal pump control in the sense of an override. Switching is not possible. For this purpose, the input signals are converted by the interfaces into commands that the microprocessor can read. Furthermore, this microprocessor is dependent on the software with which it is programmed. This software is developed by the defendant itself and installed on the processor. The internal logic of the software only allows the microprocessor to overwrite the signal from the internal control system with the translated input PWM signal. The pump is then controlled via ‘external elements and components’ connected to the interfaces. How the microprocessor routes the signals and what is switched on, off or over is determined solely by the software, which does not allow for patent-compliant decision-making or switching or switching over as required. There is therefore no additional decision-making logic in the contested embodiment that goes beyond the pure pass-through known from the prior art. 23. Finally, the defendant refers to the settlement discussions between the parties prior to the proceedings. There, the defendant signalled its willingness to grant a licence for purely economic reasons. The plaintiff also initially indicated its willingness to grant a licence. At the time the action was brought before the Unified Patent Court, the parties were in the middle of price negotiations. 24. The plaintiff has contested this argument. 25. Insofar as the defendant refers to out-of-court licence negotiations, these did not take place in this form. The plaintiff has no overriding interest in licensing the disputed patent to competitors. Rather, its objective was the exclusive use of the technical teaching patented in its favour. Against this background, the parties' representatives had only exceptionally offered to grant a licence in the event of a quick resolution of the dispute and under the specific conditions listed in detail (see Annex K 11). However, the corresponding letter was not received by the defendant's legal representatives until after the present infringement action had been served. 26. Contrary to the defendant's view, the contested embodiment makes use of the technical teaching of the patent in dispute. 27. The prior art includes heating circulation pumps which are operated (only) by means of an internal electronic control system, heating circulation pumps which are operated (only) by means of an external control for controlling the speed of the pump (typically in heating boilers) and heating circulation pumps which are operated (only) by means of an internal electronic control, but whose setpoints can be changed by external specifications. Based on this, the invention is based on the task of designing a generic centrifugal pump unit in such a way that it can be used both in a heating system with internal electronic control and in a boiler with external control or (even) in combination. 28. Contrary to the defendant's opinion, the presence of means for switching from the internal electronic control to an external speed control and for connecting an external speed control is not a prerequisite for implementing the technical teaching protected by the patent. Switching on and switching over as required are one and the same thing and not independent alternatives. Accordingly, the presence of both means for switching from the internal electronic control to an external speed control and means for switching on an external speed control is not a prerequisite for realising the technical teaching claimed. Rather, a centrifugal pump unit that can be used both in a heating system with internal electronic control and in a heating boiler with external control is also covered. In the solution according to the invention, this is ensured in particular by the means for continuous switching. 29. Based on this understanding, the defendant did not substantially dispute the realisation of the technical teaching protected by patent claim 1. Counterclaim for annulment: 30. In the defendant's view, the contested patent should be declared invalid in its entirety because the ground for invalidity of lack of feasibility within the meaning of Article 138(1)(b) EPC is present. 31. In the defendant's view, it is not apparent to the skilled person from the contested patent specification what is meant by ‘electronic means’ and how these are to be designed in order to arrive at the subject matter of the invention. The skilled person is already familiar from the prior art with frequency converter-controlled heating circulation pump units and signal transmission via a pulse-width modulated signal, which can be used to control the speed of the pump. The skilled person is also aware that, in addition to the pulse-width-modulated signal, a speed controller, for example in the form of a frequency converter or an H-bridge, is required to adjust the power of the motor. Since it is also clear to the skilled person that these pump units known from the prior art require some means of detecting and evaluating the applied signal in order to make it available to the speed controller, i.e. the frequency converter, he will attempt to find something in the contested patent specification regarding the design of the electronic means. However, he would not be successful in this endeavour. This is because the ‘means for switching or connecting’ are only very roughly outlined in the contested patent specification. 32. Therefore, there were at least two reasons why the invention was not feasible: 33. If the skilled person interpreted the feature ‘means’ in accordance with patent claim 1 to mean that the same means were suitable for switching and connecting, the invention would not be feasible because the means were used in the plural in patent claim 1. This contradicts the fact that what could be neutrally described as a ‘hardware device’ must fulfil two purposes at the same time. If, on the other hand, the skilled person interprets the plural ‘the means’ as really meaning several devices, at least one for switching and one for connecting, there would also be no feasible invention because the distinguishing feature relating to means which are intended exclusively for connecting an external speed control (but not for switching), and therefore does not provide any executable teaching with which this purpose could be achieved. The skilled person is therefore faced with the problem of either designing the means as a single component, but then not knowing whether the ‘means for switching’ refer to the single component or whether several means are required. Or he provides for several means for switching on or switching over, but then learns nothing about the design of the means for switching on. 34. Furthermore, the ‘means for switching over’ in patent claim 1 is also undefined. The skilled person would understand from paragraph [0012] of the description of the contested patent and Figure 2 thereof that a decision must be made as to whether the switching is to take place continuously or as required. The criteria for whether the switchover should take place could therefore not be purely digital (on or off), as the embodiment with the switch contacts on the hardware plug for a cable of an external control would suggest. In this embodiment, a microswitch on the plug receptacle for the signal line would ensure that the switchover would take place when the cable was plugged in, regardless of any other circumstances in the operating state of the pump. The skilled person would therefore conclude that the electronic means for switching must itself determine whether a control is connected and switch over itself. This presupposes that, in a first step, the means is capable of performing a calculation process which ultimately answers the question of whether or not an external control is connected. In a further step, the electronic means must then ‘decide’ on the basis of predetermined parameters whether or not to switch to the external control (‘switch on’/‘switch over’). This again depends on a calculation process. However, a simple plug or microswitch cannot perform this task. In contrast, patent claim 1 is formulated in such a way that the switch is automatically switched in the event that an external control is detected. However, this contradicts the meaning of the word ‘switch on’, according to which it must be possible for the internal control to be maintained rather than switched off when an external control is detected. To this end, a calculation process within the pump must send signals and process them in parallel while determining whether and how to switch to which signals. Based on the contested patent specification, it is also not apparent to the skilled person how the means for this could be designed. 35. Furthermore, the contested patent specification does not sufficiently disclose how the electronic means determine whether an external control is connected or not. 36. Furthermore, the teaching of the contested patent protected by claim 1 is based on DE 101 39 510 A1 (D 5), the GRUNDFOS DATA SHEET UPM2, UPM GEO, UPM2K circulation pumps 50/60 Hz document ‘Grundfosliterature-4927111.pdf’ including a screenshot of a website (D 6/D 6a), WO 2008/073413 A2 (D 15), WO 2008/073436A2 (D 16), a Grundfos manual ‘Grundfos Magna Series 2000 Installation and Operating Instructions’ (D 17) and the ‘GRUNDFOS Data Booklet MAGNA, UPE Series 200 circulator pump’ (D 19) (Art. 24 para. 1 lit. c) EPGÜ in conjunction with Art. 138(1)(a), Art. 54 EPC), whereby the citations D 15 to D 19 were only introduced into the proceedings with the reply to the counterclaim for annulment. 37. Finally, the defendant disputes the inventive step (Art. 24(1)(c) EPGÜ in conjunction with Art. 138(1)(a) and Art. 56 EPC). In this context, the defendant refers to a combination of EP 0 866 228 A2 (D 1), EP 0 735 273 A1 (D 2), D 6 and EP 2 151 578 B1 (D 8), each with citation D 5. In addition, the defendant referred for the first time in its reply to the counterclaim for annulment with regard to patent claim 1 to a combination of citation D 5 with a handbook ‘ALPHA (model A) Manual (D 7)’ and D 5 with Regulation (EU) No. 622/2012 of 11 July 2012 amending Regulation (EC) No. 641/2009 with regard to the requirements for the environmentally friendly design of external wet rotor circulation pumps and wet rotor circulation pumps integrated into products (D 20). 38. In addition, in its written submission of 19 February 2025, the defendant submitted a decision of the Chinese National Intellectual Property Office of 6 January 2025 (hereinafter: Office, cf. Annexes B&B D 21), of which it submitted a German translation to the file as Annex B&B D 22 with its written submission of 10 February 2025 (App_11606/2025). 39. With regard to the statements on the lack of legal validity of the subclaims, which the defendant also considers to be lacking, reference is made to the counterclaim for annulment. 40. The plaintiff defends the contested patent as granted. In the alternative, it asserts a total of seven alternative claims, the wording of which is referred to in the reply of 22 July 2024. Legal consequences: 41. In the defendant's opinion, the claims asserted by the plaintiff for disclosure, recall and destruction are disproportionate. 42. The defendant is not required to disclose the names and addresses of the commercial customers and the individual offers, broken down by offer quantities, times, prices and type designations, as well as the names and addresses of the recipients of the offers, taking into account the principle of proportionality. The requested information is not necessary to quantify the damages. 43. A recall of the heating circulation pumps, which are already largely installed in building heating systems, is disproportionate in a commercial context, taking into account the associated effort and costs, unless it is already excluded in the private sphere. 44. Furthermore, a recall was also disproportionate because the parties had been in licence negotiations before the action was brought before the Unified Patent Court. The plaintiff had misled the defendant about its willingness to grant a licence, but was now nevertheless demanding a complete recall with an unjustified action. 45. Apart from that, a recall was also incompatible with the principle of proportionality, taking into account the interests of the customers, in particular tradesmen and property owners. 46. Finally, the court could set a lump sum for possible damages in appropriate cases such as the present one. The parties had been negotiating a licence at the time the action was brought. The lump sum should therefore be based on the licence fee that would most likely have been agreed. 47. The plaintiff contested these arguments. 48. In particular, the plaintiff needed the information requested in the context of the disclosure and accounting in order to determine the damages to which it was entitled and to verify the information to be provided by the defendant. The order to provide the requested accounting is also proportionate. The defendant already has the information to be provided due to its applicable accounting retention obligations. The defendant can therefore convert this information into an orderly and comprehensible list without unreasonable effort. The competitive relationship between the parties also did not render the requested accounting disproportionate. 49. The requested recall also did not raise any concerns from the point of view of proportionality. As a result of the defendant's actions, a large number of patent-infringing heating circulation pumps, the exact number of which is not yet known to the plaintiff, are currently in the German, French and Italian distribution channels. These pumps block potential demand for corresponding models manufactured by the plaintiff. The plaintiff therefore has a legitimate interest in eliminating this disruptive situation created by the defendant. No less severe means of eliminating the disruptive situation are apparent. Nor can the defendant successfully invoke the interests of third parties. The fact that a recall order conflicts with the interests of third parties is inherent in such an order. This alone does not constitute disproportionateness. For this, the interests of the third parties concerned would have to be of such weight that they significantly outweigh the patent holder's interest in enforcing the legally provided right of recall. However, this is not the case here. 50. Nor is the requested destruction disproportionate. In this respect, the defendant has failed to provide any information as to how it intends to modify the products into a form that does not infringe the patent. 51. Insofar as the defendant seeks lump-sum damages, it is for the plaintiff to decide, on the basis of its submissions, whether the court should award damages under Article 63(3)(a) or (b) EPGÜ. Furthermore, in the present proceedings, the plaintiff is initially seeking only a declaration of liability for damages on the merits. The amount of damages is therefore only relevant in subsequent proceedings for damages. 52. The defendant has contested the plaintiff's arguments. In particular, as an alternative to a recall, it is possible to seal the signal inputs of the pumps so that it is impossible to connect an external speed controller. The defendant could also require its customers to sign declarations of intent, subject to penalty, guaranteeing that the pump would not be controlled externally. LEGAL ASSESSMENT: A. Admissibility of the action and the counterclaim for annulment 53. The action for infringement is admissible. In particular, the local chamber in Düsseldorf has international jurisdiction pursuant to Article 31 EPGÜ in conjunction with Article 71b(2) in conjunction with Article 7(2) of Regulation (EU) No 1215/2012 (hereinafter: Brussels Ia Regulation). Pursuant to Article 32(1)(a) EPGÜ, the Unified Patent Court (UPC) also has exclusive jurisdiction for actions for actual or threatened infringement of European patents, provided that – as in the present case – no opt-out (Article 83(3) EPGÜ) has been declared. Since the defendant did not file an opposition within the opposition period, both the jurisdiction of the EPG and the jurisdiction of the Local Chamber in Düsseldorf are deemed to have been accepted, Rule 19(7) of the Rules of Procedure. 54. There are also no objections to the admissibility of the counterclaim for annulment. In particular, the EPG also has international jurisdiction. Pursuant to Art. 32(1)(e) EPGÜ, the EPG has exclusive jurisdiction over counterclaims for the invalidity of (European) patents. Since there is currently no opt-out from the exclusive jurisdiction of the court with regard to the patent in dispute, the international jurisdiction of the EPG – as the common court of the Member States of the EPGÜ – is established pursuant to Art. 31 EPGÜ in conjunction with Art. 24(4), 71a(2)(a) and 71b(1) of the Brussels Ia Regulation. B. Relevant skilled person 55. In the opinion of the Board, the relevant skilled person is a mechatronics engineer with a technical college degree and several years of experience in the development of circulation pumps. C. Scope of protection of the contested patent 56. The contested patent relates to a centrifugal pump unit in the form of a heating circulation unit. 57. As the skilled person can see from the introductory remarks in the contested patent specification, centrifugal pump units typically consist of a centrifugal pump and an electric motor driving it, an electronic speed controller (such as a frequency converter) for the motor, and an internal electronic control system in which the controlled variable is the speed of the motor, wherein the speed controller and the control system form part of the unit and are typically arranged in a terminal or electronics box next to the pump and motor housing. The controlled variables of such a control system are, for example, the differential pressure between the inlet and outlet of the pump, the volume flow and variables derived therefrom (para. [0002]). 58. In modern heating circulation pumps of the aforementioned type, the dispute document goes on to explain that it is state of the art for the internal electronic control system not only to provide a large number of selectable control curves, but also for the unit to have an internal processor with appropriate software that is capable of independently adjusting the setpoints of the control system to the heating system based on the conditions in the heating system, in particular the pressure curves, the approaching temperature of the pumped medium, the flow rate and the like, to the heating system. This self-learning setpoint adjustment of the internal control system has the advantage that the pump adapts almost perfectly to the requirements of the heating system and can be operated with comparatively low energy consumption (para. [0003]). 59. In addition, frequency converter-controlled heating circulation pump units are state of the art, in which an external control is provided for controlling the speed of the pump. This external control is typically part of the central control system of a heating system. The interface for speed control is a control input on the pump, via which a pulse-width-modulated signal is transmitted, whereby the pulse width determines the effective voltage or frequency and thus the speed of the pump. Such pumps can be found, for example, in gas boilers, as compact heating devices in apartments or in smaller houses (para. [0004]). 60. Based on this, according to the description of the contested patent, different pump series have become established: on the one hand, self-learning heating circulation pumps, which are installed in heating systems on site, and on the other hand, externally controlled heating circulation pumps, which are typically installed by the manufacturer in heating boilers. Examples of pumps of the prior art are disclosed, for example, in EP 0 886 228 A2 and EP 0 735 273 A1. Since the hydraulic requirements are often the same in both cases, the centrifugal pump units differ practically not at all in their mechanical design. However, the manufacturer must always produce two series with the same connection data for the pump housing. In addition, different centrifugal pump units must always be kept in stock for each of the above-mentioned applications, which is time-consuming and expensive (para. [0005]). 61. Finally, in the case of larger heating circulation pumps, such as those installed in groups of two to eight pumps in parallel, it is state of the art (Grundfos pump type Magna UPE) to control these individual heating circulation pumps, each of which has an internal electronic control system, from the outside, whereby the internal control system as such is not influenced, but only the setpoint values (para. [0006]). 62. Based on this, the invention according to the description of the contested patent is based on the task (the technical problem) of designing a generic centrifugal pump unit in such a way that it can be used both in a heating system with internal electronic control and in a heating boiler with external control or in a combined application (para. [0007]). 63. To solve this problem, claim 1 of the contested patent protects a heating circulation pump unit characterised by a combination of the following features: 1. Heating circulation pump unit 1.1. with a centrifugal pump (1), 1.2. with an electric motor (7) driving the pump (1), 1.3. with an electronic speed controller (11) for the motor (7) 1.4. and with an internal electronic control system (16), 1.4.1. in which the control variable is the speed of the motor (7). 2. The speed controller (11) and the control system (16) form part of the unit. 3. A signal input is provided for external control of the motor (7). 4. Means (20) are provided 4.1. for switching from the internal electronic control system (16) to an external speed control or for connecting an external speed control. 4.2. The means (20) for switching over are electronic means which determine whether or not an external control is connected and, if an external control is detected, switch over to the external control. 64. According to Article 69 EPC in conjunction with the Protocol on its interpretation, the patent claim is not only the starting point but also the decisive basis for determining the scope of protection of a European patent. The interpretation of a patent claim does not depend solely on its precise wording in the linguistic sense. Rather, the description and drawings must always be taken into account as aids to interpreting the patent claim and not only to resolve any ambiguities in the patent claim. However, this does not mean that the patent claim merely serves as a guideline and that its subject matter also extends to what, after examination of the description and drawings, appears to be the protection sought by the patent proprietor (UPC_CoA_335/2023, order of 26 February 2023 in conjunction with order of 11 March 2024, GRUR-RS 2024, 2829, headnote 2 and paras. 73–77 – 10x Genomics v. NanoString; UPC_CFI_452/2023 (LK Düsseldorf), order of 9 April 2024, p. 13, GRUR-RS 2024, 7207, para. 49 – Ortovox v. Mam- mut; see also UPC_CFI_7/2024 (LK Düsseldorf), decision of 3 July 2024 – Franz Kalde- wei v. Bette; UPC_CFI_239/2024 (LK Den Haag), decision of 22 November 2024 – Plant-e v. Arkyne (Bioo); UPC_CFI_50/2024 (LK Düsseldorf), decision of 10 April 2025 – Yellow Sphere v. Knaus Tabbert). 65. That being said, some features require explanation. 66. The heating circulation pump unit protected by patent claim 1 is characterised in that it has an internal electronic control (16) 19 (feature 1.4.), which together with the speed controller (11) forms part of the unit (feature 2.). Since a signal input for external control of the motor (7) is also provided (feature 3.), the pump can be controlled not only internally or externally, but also either internally or externally as required, unlike the solutions known from the prior art described in paragraphs [0003] and [0004]. 67. According to the invention, means (20) are also provided for switching from the internal electronic control to an external speed control or for connecting an external speed control (features 4 and 4.1). 68. While switching is generally understood to mean a (complete) change from internal electronic control to external speed control, in the case of switching on, the external speed control operates alongside the internal control. 69. The fact that the contested patent is also based on this understanding is already clear from the English version of the patent claim (which is not decisive for the scope of protection, however) (‘means (20) are provided for switching over from the internal electronic regulation (16) to an external speed control or for the connection of an external speed control’). Either a switch is made from the internal to the external control (‘switching over from ... to’ = switching over) or the external control is merely added to the internal control (‘for connection of ...’ = switching on). 70. In line with this, the contested patent specification further states in paragraph [0028] in the context of explaining the preferred embodiment: "[...] the control and regulation electronics (12) are switched by means of an electronic switch (20) in such a way that when a PWM signal is present at the input formed by the plug (14), a corresponding speed signal for the motor (7) is generated via the frequency converter (11) [...]. The control and regulation electronics (12) then switch to the external input, and the internal regulation can then be switched off completely or partially." (Underlining added) If the internal regulation is switched off completely, this corresponds to switching over. If the internal control is partially switched off, it remains active and the external control is merely switched on. 71. However, when attempting to determine the scope of protection of claim 1, the skilled person must not lose sight of the fact that features 4 and 4.1 do not require that the means actually switch over or switch on. Rather, only means (20) for switching from the internal electronic control to an external speed control or for switching on an external speed control are provided. Feature 4.1 therefore merely contains statements of purpose. If a patent claim contains statements of purpose, these usually serve to improve understanding of the invention. As a rule, they have the indirect effect of defining the subject matter protected by the patent in such a way that it must not only fulfil the spatial and physical characteristics, but must also be designed to be usable for the purpose specified in the patent claim (UPC_CFI_463/2023 (LK Düsseldorf), order of 30 April 2024, headnote 2 – 10x Genomics v. Curio Bioscience). In other words, purpose specifications define the object protected by a patent in such detail that it must not only fulfil the spatial and physical characteristics explicitly formulated in the patent claim. Rather, the object must also be designed in such a way that it can bring about the effect mentioned in the patent claim. Applied to feature 4.1, the means must therefore be designed in such a way that it can bring about a switching or an activation. Feature 4.1 does not require suitability for cumulative switching and activation. 72. The task formulated in paragraph [0007] of the contested patent specification does not require a different assessment, nor does the state of the art acknowledged in the contested patent specification. 73. As the skilled person can see from paragraphs [0003], [0004] and [0006] of the contested patent specification, a total of three types of heating circulation pump units were known in the prior art: 1. Heating circulation pumps with internal electronic control (para. [0003]); 2. Frequency converter-controlled heating circulation units with an external control for controlling the speed of the pump (para. [0004]); 3. Larger heating circulation pumps in which groups of two to eight pumps are installed in parallel, each of which has an internal electronic control system that can (also) be controlled externally without affecting the internal control system (para. [0006]). (Underlining added) While the first two variants are controlled either internally or externally, heating circulation pumps of the third group are characterised in that the internal electronic control is supplemented by an external control without this impairing the internal electronic control. 74. On this basis, the skilled person will continue to take into account in his considerations that the disadvantages mentioned in para. [0005] relate exclusively to the first two variants: although the hydraulic requirements are often the same in both cases, the centrifugal pump units differ only slightly in their mechanical design. Nevertheless, if the connection data of the pump housing are the same, two series must always be produced, which must then also be stocked accordingly. 75. Against this background, if the contested patent describes the task of the invention as designing a centrifugal pump unit of the type known in the art in such a way that it can be used both in a heating system with internal electronic control and in a heating boiler with external control or in a combined application (para. [0007], emphasis added), the skilled person reads this with the knowledge previously imparted to him about the pump types known in the prior art. From this, it becomes clear to him that two configurations are ultimately addressed: 1. The heating circulation pump unit can be used both in heating systems with internal control and in a heating boiler with external control. 21 2. The heating circulation pump unit can be used in heating systems that are controlled both internally and externally (‘or combined’). Only in the latter variant is it absolutely necessary to have the option of switching. In line with this, feature 4.1. only requires suitability for switching or connection, but not that the corresponding means must always be suitable for both switching and connection. 76. Feature 4.2 further specifies the means (20) for switching in that they must be electronic means that determine whether an external control is connected or not and switch to it when an external control is detected. 77. Except for the requirement that the means must be electronic (and therefore not merely mechanical), the means are described exclusively in functional terms: they must (1) determine whether an external control is connected or not and (2) switch to it if an external control is connected. Feature 4.2 does not require anything more. In particular, it does not contain any specifications as to how the connection of an external control device is detected. This can therefore be done directly by detecting the contact between the plug and the mating connector by means of a microswitch inside the plug (see para. [0027]). However, the scope of protection also covers a design in which the determination is made indirectly, for example by detecting the presence of an external control signal. Furthermore, patent claim 1 leaves the decision on how the switching is to be carried out to the discretion of the skilled person. 78. In contrast, the defendant requires the existence of a decision-making logic in the sense that the means must be capable of making its own decisions with regard to the external signal and the takeover of speed control, but such an understanding cannot be reconciled with the wording of patent claim 1. According to this, the means (20) determine whether or not an external control is connected. If such an external control is connected, the means (20) switch to the external control. Patent claim 1 does not grant the means any discretion to decide whether to switch. If the condition – connection of an external control – is fulfilled, the consequence of this condition is rather the switching. There is no indication in patent claim 1 that the means, as further argued by the defendant, decide between switching over and switching on the external control when the connection of an external control is detected. 79. The description of the contested patent does not require any other assessment. This applies in particular in view of paragraph [0012], which states: "According to the invention, the means for switching the internal electronic control to an external speed control or for connecting an external speed control are designed in such a way that they determine whether an external control is connected or not and, if an external control is detected, switch to the external control permanently or as required. (Underlining added) 80. The ‘switching as required’ mentioned there is not reflected in the patent claim that is decisive for the scope of protection. Insofar as paragraph [0012] then states that a suitable electronic circuit determines at intervals whether the signal input is connected to an external control or not, this is explicitly (‘for example’) an example to which the invention cannot be reduced. The same applies insofar as the description of the contested patent immediately refers to the determination of a ‘handshake’ or suitable ‘calibration cycles’. Finally, the design of the ‘control and regulation electronics’ described in paragraph [0027] in conjunction with Fig. 2 merely describes a preferred embodiment without limiting the scope of protection to such a design. There are no indications that the contested patent, as argued by the defendant, attempts to distinguish itself from the prior art in paragraph [0004] of the contested patent description precisely by the presence of an internal decision-making and control logic. 81. Even if the defendant ultimately refers to the grant file to justify its dissenting opinion, the question of whether and, if so, to what extent this may be taken into account in the interpretation of the contested patent, which has not yet been conclusively answered by the Court of Appeal, does not need to be decided in the present case. The extent to which paragraph [0013] may still be taken into account in the interpretation of the patent or whether it should have been adapted in the grant proceedings is not relevant to the present case. Even if a simple switch on the pump unit is excluded by the limitation in the grant proceedings to electronic means designed to to determine whether an external control is connected and, if an external control is detected, to switch the external control, is no longer covered by the scope of protection of the contested patent, this does not, based on the above considerations, necessitate that, conversely, only a design that has a control and decision logic be covered by the scope of protection. D. Counterclaim 82. The counterclaim for annulment is unsuccessful on the merits. I. Feasibility of the invention 83. There is no doubt that the invention according to claim 1 is disclosed so clearly and completely that a person skilled in the art can carry it out and thus the requirements of Article 83 EPC are met. 84. In order to satisfy the requirements laid down therein, the subject-matter of a patent must be sufficiently disclosed on the basis of the patent as a whole, including the examples, taking into account the general knowledge of the skilled person. Even if the invention must be disclosed in the patent specification in a manner that is capable of being carried out, the general technical knowledge must also be taken into account when assessing whether the disclosure is sufficient (UPC_CFI_355/2023 (LK Düsseldorf), decision of 28 January 2025, p. 36 – Fujifilm v. Kodak). 85. On this basis, the defendant's arguments do not significantly call into question the feasibility of the invention. 86. Insofar as the defendant argues that the skilled person is faced with the problem of implementing the ‘means for switching or connecting’ referred to in the claim as a component, but then does not know whether the means for switching relate to one component or whether several components are required, or whether he envisages several means for switching 23 and switching, but then learns nothing from the contested patent specification regarding the design of means for switching, these considerations do not relate to the feasibility, but at most to the clarity of the claim. However, this is not a ground for invalidity within the meaning of Art. 138 EPC (see: UPC_CFI_50/2024 (LK Düsseldorf), decision of 10 April 2025, para. 134 – Yellow Sphere v. Knaus Tabbert). The defendant's argument in this regard is therefore not suitable from the outset to significantly challenge the legal validity of the contested patent. Apart from that, the skilled person is not only aware of means for switching. Rather, such a means is also mentioned as an example in the description of the contested patent in the form of a switch (see paragraph [0013] and subclaims 3 and 4). The invention is therefore feasible. 87. The same applies to the technical design of the determination of the connection of an external speed control, which the defendant continues to address in connection with feasibility. In this respect, the skilled person understands from subclaim 4 that the means for switching over comprise a sensor or microswitch which is designed to detect a connection of the electrical connection plug of the signal input. In addition, the skilled person finds in paragraph [0027] that the control electronics in the embodiment shown in Figures 1 and 2 are designed to independently detect whether the plug (14) is in contact with a mating plug (19). For this purpose, a microswitch is provided inside the plug (14) which detects this and electronically determines whether an electronic control is connected via the mating plug. As soon as this is the case, the control and regulation electronics (12) are switched by means of the electronic switch (20) in such a way that, when a PWM signal is present at the input formed by the plug (14), a corresponding speed signal for the motor (7) is generated via the frequency converter (11). There are no apparent reasons why, based on the detailed understanding of the scope of protection described above, the invention should not be feasible. II. Novelty 88. The prior art cited by the defendant does not anticipate the technical teaching of the contested patent in a manner that would destroy its novelty. 1. Standard of novelty 89. An invention is considered new if it differs from the prior art in at least one of its known features. Only that which is immediately apparent to a person skilled in the art from the publication or prior use is considered to be anticipated by the prior art (see UPC_CoA_382/2024 (Appeal Court), order of 14 February 2025, APL_39664/2024 – Abbott v. Sibio). Findings which a skilled person only gains on the basis of further considerations or the use of further documents or uses are not prior art (see UPC_CFI_50/2024 (LK Düsseldorf), decision of 10 April 2025, para. 136 – Yellow Sphere v. Knaus Tabbert; UPC_CFI_7/2024 (LK Düsseldorf), decision of 3 July 2024 – Kaldewei v. Bette; UPC_CFI_239/2024 (LK The Hague), decision of 22 November 2024 – Plant-e v. Arkyne (Bioo)). 2. Novelty examination in individual cases 90. On this basis, the invention protected by patent claim 1 is novel in relation to the prior art cited by the defendant. 24 a) DE 101 39 510 A1 (Annex B&B D 5, hereinafter: DE '510 or D 5) 91. DE '510 A1 relates to a method for controlling the speed of a circulation pump in the heating circuit between a boiler and at least one heat-consuming heating circuit in a heating system with a control device. To carry out the method, a circulation pump with a measuring device for detecting the pressure difference and with an additional input for a signal for pulse width modulation is used (para. [0010]). As the skilled person can further see from the citation, the method disclosed therein allows a conventional pump, which operates by measuring the pressure difference in the connected pipe of the heating circuit, to be manipulated. This combines the operating modes of a pressure difference-controlled pump and a pulse width modulated pump without sacrificing any of their respective advantages. A preferably modular control circuit can be installed either directly on the circulation pump or on the control device. The two adjacent signals for pulse width modulation and pressure difference, both of which allow conclusions to be drawn about the desired flow rate, are continuously evaluated by the control circuit (para. [0011]). 92. An embodiment of the invention disclosed in D 5 is shown in Figures 1 and 3 of the citation, which are shown below. Figure 1 shows the response of a circulation pump after processing different signals by a control circuit: 93. Figure 3 shows the arrangement of a circulation pump in a heating circuit with internal measurement of the pressure difference and an internal control circuit for signal selection: 94. In the arrangement shown above, the measuring device (4) for detecting the pressure difference and the control circuit (5) for signal selection are integrated into the circulation pump (1). If the control device (3) does not supply a signal for pulse width modulation to the control circuit, the circulation pump (1) operates according to the internally measured pressure difference. If, on the other hand, a signal for pulse width modulation is present at the control circuit (5), it is given priority or not in accordance with the specified selection criteria. 95. On this basis, there is already a lack of disclosure of a centrifugal pump (feature 1.1.). A circulation pump is disclosed, but nothing is said about its type. Against this background, the defendant pointed out in the oral hearing that, based on Regulation (EU) No 622/2012 amending Regulation (EC) No 641/2009 on the ecodesign requirements for external wet-rotor circulation pumps and integrated wet-rotor circulation pumps (see Annex D 20), according to which the term “circulation pump” refers to a centrifugal pump (Art. 2(1) of this Regulation), cannot be convincing, because although the Regulation defines the term ‘circulation pump’ as a centrifugal pump for the purposes of the Regulation, the Regulation does not specify that a circulation pump must (always) be designed as a centrifugal pump. However, it does not follow from the regulation that a circulation pump must (always) be designed as a centrifugal pump. Even if the skilled person, as assumed in favour of the defendant, reads D 5 with the knowledge of D 20, it is not directly and unambiguously apparent from such a combination that the circulation pump shown in D 5 is in fact a centrifugal pump within the meaning of claim 1 of the contested patent. 96. Furthermore, the citation does not disclose an electronic speed controller for the motor within the meaning of feature 1.3. Even if speed control is mentioned in paragraph [0018] and a speed controller is therefore likely to be indispensable, such a controller may also be designed as a hydraulic coupling and thus not be electronic. Feature 1.3 is therefore also not disclosed. b) ‘Grundfos data sheet UPM2, UPM GEO, UPM2K circulation pumps 50/60 Hz’ (Annex B&B D 6, hereinafter: data sheet) 97. The data sheet submitted as prior art D 6 also does not disclose the technical teaching of the contested patent protected by claim 1 of the contested patent in a manner that would destroy its novelty. 98. The data sheet describes three series of circulation pumps. While the UPM2 pump is designed for installation in boilers or other heating applications with remote control of the pump speed, the UPM Geo and UPPM2K circulation pumps are particularly suitable for cold water applications (see Annex D 6, p. 3, left column). As the skilled person can further see from the data sheet, the UPCM2 model is a remotely controllable, speed-controlled, high-efficiency circulation pump with a permanent magnet rotor and frequency converter, whereby control is via a digital, pulse-width modulated low-voltage signal (Appendix D 6, p. 3, right-hand column at the top). The pumps in question are therefore controlled externally; there is no internal electronic control within the meaning of feature 1.4. 99. The function of the PWM input signal is described in more detail on page 9 of the data sheet as follows: 26 100. As can be seen from the figure shown above, the pump is controlled by the PWM signal when its percentage is between 10% and 84%. In this interval, the pump speed decreases linearly from maximum to minimum. If the percentage falls below 10%, for example due to a cable break, the pump continues to run at maximum speed in order to transfer the heat from the primary heat exchanger. If, on the other hand, the percentage is between 85% and 91%, the pump runs at minimum speed. If the percentage of the PWM input signal is between 91 and 95%, the external speed control uses a hysteresis to prevent the pump from repeatedly switching on and off when the input signal fluctuates around the switching point. With a PWM signal between 96% and 100%, the pump is in standby mode. 101. Based on this, there is no internal control, i.e. no comparison of actual and setpoint values in the sense of feature 1.4. Control is via the (external) PWM signal alone. If, in exceptional cases, this is missing or too weak, the pump runs automatically at maximum speed (see Annex D 6, p. 19, left column at the bottom); internal control does not take place even then. Insofar as the defendant refers in this context to the fact that the pump is controlled internally by a small frequency converter operated with direct current (see Annex D 6, p. 17, right-hand column at the bottom), such a frequency converter does not itself operate without a control or feedback system. In other words, such a frequency converter allows the pump to run at a certain speed when it receives the corresponding instructions. Against this background, the skilled person is aware that, according to its technical function, the frequency converter is only the speed controller for the pump. It can only regulate the pump depending on the low-voltage signal applied to the PWM input, i.e. supplied externally. The fact that the frequency converter/speed controller of D 6 also receives a signal generated by an internal control system cannot be inferred from D 6, according to which the pump speed is determined by remote control (see Annex D 6, p. 3, left column). 102. Since there is no internal electronic control, the data sheet does not disclose any means for switching within the meaning of feature group 4. c) Further state of the art 103. Insofar as the defendant additionally bases its novelty attack in its reply to the nullity counterclaim on WO 2008/073413 A2 (Exhibit B&B D 15), WO 2008/0734336A2 (Exhibit B&B D 16), the ‘Grundfos Manual – Grundfos Magna Series 2000’ (Exhibit B&B D 17) and the ‘Grundfos Data Booklet MAGNA, UPE Series 2000 circulator pump’ (Exhibit B&B D 19), this constitutes an extension of the claim within the meaning of Rule 263 of the Rules of Procedure (see also: UPC_CFI_390/2023 (LK Munich, Panel 1), decision of 13 September 2024, p. 42 – Koninklijke Philips N.V. v. Edrich). 104. According to this provision, a party may at any time during the proceedings apply to the court for leave to amend or extend a claim, including a (nullity) counterclaim. The application must state the reasons why the amendment or addition was not already included in the original pleading. Subject to paragraph 3, the amendment shall be refused if the party requesting the amendment cannot convince the court, taking all circumstances into account, that (a) the amendment in question could not have been made earlier with due care and (b) the amendment does not unreasonably prejudice the other party in the conduct of the proceedings. Both conditions must be fulfilled independently of each other. The burden of proof that both the requirements of R. 263(1) VerfO and the grounds for exclusion under R. 263(2) VerfO are not met lies with the applicant. The applicant must therefore explain why the amendment was not included in the original pleadings. Similarly, the court must be able to decide on the basis of the applicant's explanation of the exclusion criteria contained in R. 263(2) VerfO (UPC_CFI_114/2024 (LK Munich, Panel 1), order of 25 September 2024, p. 13 et seq. – Heraeus v. Vibrantz; UPC_CFI_483/2024 (LK Munich, Panel 2), order of 28 February 2025 – Esko-Gra-phics v. XSYS). 105. Even if it can be assumed in favour of the defendant, even without an express request, that the introduction of further citations implicitly involves a request for the admission of the associated extension of the counterclaim for annulment, the defendant has not submitted any arguments which, according to R. 263(2) VerfO. The defendant has not put forward any reasons why the documents in question could not have been introduced into the proceedings at the same time as the counterclaim for annulment. Nor can it be established that the admission of the citations introduced into the proceedings for the first time in the reply does not unreasonably impede the plaintiff in its conduct of the proceedings. 106. In this context, it must be taken into account that the proceedings before the EPG are “front-loaded”. Therefore, the grounds for invalidity must already be asserted in the counterclaim for invalidity. The documents on which the defendant bases its counterclaim for invalidity must also be submitted with the counterclaim for invalidity. This is already clear from Rule 25(1)(b), (c) and (d) of the Rules of Procedure. Accordingly, the counterclaim must contain one or more grounds for invalidity, the facts alleged and, where available, the evidence adduced. Taking into account the sequence of pleadings provided for in the Rules of Procedure for the normal case and the strict time limits associated with it, this is the only way to ensure that the plaintiff is not unduly disadvantaged in the conduct of the proceedings. If the grounds for nullity are found in the counterclaim for nullity, the plaintiff may respond to this submission within a period of two months (R. 29 lit. a) VerfO) and, if necessary, react with an amendment pursuant to R. 30 (1) VerfO. In contrast, the plaintiff only has a period of one month to file a rejoinder to the counterclaim for nullity (R. 29 lit. c) VerfO). At this stage, the plaintiff may only file amendments under the additional conditions set out in R. 30 para. 2 VerfO. 107. On this basis, it would have been incumbent on the defendant not only to indicate the reasons which initially prevented it from introducing the further citations into the proceedings at an early stage. Rather, it would also have been incumbent on it to explain why their consideration did not unreasonably impede the plaintiff in the conduct of its proceedings. The defendant did not sufficiently fulfil any of these requirements, and in particular it is not apparent that the defendant's supplementary submissions were prompted by the plaintiff's submissions following the counterclaim for annulment. Therefore, the further citations are not admissible (comparable: UPC_CFI_263/2023 (CD Paris), decision of 29 July 2024 – Bitzer v. Carrier; UPC_CFI_390/2023 (LK Munich, Panel 1), decision of 13 September 2024 – Koninklijke Philips N.V. v. Edrich; UPC_CFI_430/2023 (Nordic-Baltic Regional Division), provisional order of 7 October 2024 – Abbott v. Dexcom). III. Lack of inventive step 1. Standard 108. According to Article 56 EPC, an invention is considered to involve an inventive step if it is not obvious to a person skilled in the art from the state of the art. 109. In the opinion of the Central Chamber in Munich (UPC_CFI_1/2023 (CD Munich), decision of 16 July 2024 – Sanofi v. Amgen), which the Düsseldorf Local Chamber has repeatedly endorsed in the past (UPC_CFI_363/2023, decision of 10 October 2024, Seoul Viosys v. expert; UPC_CFI_16/2024, decision of 14 January 2025, Orthovox v. Mammut; UPC_CFI_50/2024 (LK Düsseldorf), decision of 8 March 2025, paras. 166–173), the assessment of inventive step always requires an evaluation in each individual case, taking into account all relevant facts and circumstances. An objective approach must be adopted. The subjective ideas of the applicant or inventor are irrelevant. Only what the claimed invention actually contributes to the state of the art is relevant. 110. Inventive step must be assessed from the perspective of a person skilled in the art on the basis of the entire state of the art, including general technical knowledge. It must be assumed that the skilled person had access to the entire generally accessible state of the art at the relevant time. The decisive factor is whether the claimed subject matter is such that the skilled person would have found it based on their knowledge and skills, e.g. through obvious modifications of what was already known. 29 111. In order to assess whether a claimed invention was obvious to a skilled person, it is first necessary to determine a starting point in the state of the art. It must be justified why the skilled person would consider a particular part of the prior art to be a realistic starting point. A starting point is realistic if its teaching would have been of interest to a skilled person who, at the priority date of the contested patent, was seeking to develop a product or process similar to that disclosed in the prior art, i.e. one which has a similar basic problem to the claimed invention (see UPC_CoA_335/2024, order of 26 February 2024, p. 34 – Nanostring v. 10x Genomics, under ‘cc’ in the original German version, ‘For a skilled person who was faced with the task at the priority date of the patent in question, [...] D 6 was of interest’). There may be several realistic starting points, whereby it is not necessary to determine the ‘most promising’ starting point. 112. If the claimed subject-matter is compared with the prior art after interpretation, the question arises as to whether it would have been obvious to the skilled person to arrive at the claimed solution based on a realistic disclosure of the prior art in view of the underlying problem. If it was not obvious to arrive at this solution, the claimed subject matter meets the requirements of Article 56 EPC. 113. In general, a claimed solution is obvious if, based on the prior art, the skilled person would be motivated (i.e. would have an incentive, see the CoA in NanoString v. 10x Genomics, p. 34) to consider the claimed solution and take it as the next step (‘next step’, see UPC_CoA_335/2024, order of 26 February 2024, p. 35, second paragraph – Nanostring v. 10x Genomics) in developing the state of the art. On the other hand, it may be relevant whether the skilled person would have expected particular difficulties in carrying out the next step or steps. Depending on the facts and circumstances of the case, it may be permissible to combine disclosures from the prior art. 114. A technical effect or advantage achieved by the claimed subject matter in comparison with the prior art may be an indication of inventive step. A feature that has been arbitrarily selected from several possibilities cannot, in general, contribute to inventive step. 115. Retrospective analysis must be avoided. The question of inventive step should not be answered by searching retrospectively, with knowledge of the patented subject-matter or solution, for (combined) disclosures in the prior art from which this solution could be derived. b) Present case 116. Measured against this, the defendant's arguments are not suitable for calling the inventive step into question. aa) D 6 with D 5 117. This applies first of all to the combination of citation D 6 with citation D 5 referred to by the defendant. 118. It already seems questionable whether D 6 is a realistic starting point for assessing the inventive step. 30 119. The solution disclosed in D 6 differs from patent claim 1 in that, unlike the solution according to the contested patent, it lacks an internal electronic control as part of an assembly and, based on this, also lacks a means for switching from such an internal electronic control to an external speed control (feature 1.4. and feature group 4.). Even though both D 6 and the contested patent refer to a heating circulation pump assembly, the two solutions differ in their basic design and configuration: The pump disclosed in D 6 is designed solely for external control. The problem underlying the contested patent, namely to design a generic centrifugal pump unit in such a way that it can be used both in a heating system with internal electronic control and in a heating boiler with external control or in combination, does not therefore arise in the first place. 120. Apart from that, the skilled person has no reason to combine the solution disclosed in D 6 with the design shown in D 5. 121. The pumps disclosed in D 6 are designed for remote control of the speed. In this embodiment, the external speed control normally controls the pump. If the PWM input signal falls below 10%, the pump runs at maximum speed. In contrast, D 5 teaches the addition of a further continuous signal in the form of an internal control signal based on the measured values of the heating circuit. If no PWM signal is present, the pump runs on the basis of the internal control signal. If an external PWM input signal is present in addition to the internal control signal, the control circuit can select the maximum or minimum value for controlling the pump. 122. Based on this, the control of D 6 and D 5 are not compatible as such. A person skilled in the art would therefore not transfer the control circuit of D 5 to the internal control of D 6. bb) EP 0 866 228 A2 (D 1) with D 5 123. Insofar as the defendant continues to attempt to justify the lack of inventive step on the basis of EP 0 866 228 A2 (Annex B&B D 1, hereinafter: EP '228 or D 1), it is not apparent what reason the skilled person would have to combine the solution disclosed therein with the control disclosed in D 5. 124. EP '228 discloses a pump unit for heating systems which is preset, preferably at the factory, to a throttle or control curve (col. 1, lines 49-54). This factory presetting of the throttle or control curve allows the unit to be operated like a pump unit without control electronics or with a fixed control curve (col. 2, lines 8-12). To enable a specialist to use the unit in applications that require speed control, the unit also has an adjustment device that can be used to adapt the unit to the requirements of the heating system (col. 2, lines 22–28). If the adjustment device is wired, a plug socket may be provided in the unit, for example in the terminal box, as is known for accommodating diagnostic plugs (col. 2, lines 29-37). As the skilled person can see from lines 3 to 8 of the citation, the adjustment device is ‘intended exclusively for adjustments to be carried out by the skilled person’. 125. Even if, on this basis, D 1 is a realistic starting point for assessing the inventive step, it is not apparent what reason the skilled person would have to combine the solution disclosed in D 1, which is characterised by an internal control that can only be adjusted by means of a device that can be connected to the line, with the external control disclosed in D 5. 126. The pump unit disclosed in D 1 is characterised precisely by the fact that it has an internal control which can only be adjusted by the skilled person to the individual requirements of the respective heating system by means of an external adjustment device (see column 1, line 56 - column 2, line 8). The corresponding adjustment device is expressly described as being intended exclusively for adjustments to be carried out by a person skilled in the art (see column 3, lines 3-8). The adjustment option provided for in D 1 is therefore not an external speed control within the meaning of the contested patent, which is why no means for switching between internal and external control are required (feature 3 and feature group 4). 127. Since D 1 fulfils its underlying task of creating a pump unit that on the one hand meets the requirements of a pump unit supported by modern electronics and on the other hand can nevertheless be used as a standard device without lengthy adjustments, by means of a preset throttle or control curve that can only be changed by a separate adjustment device, the design of the internal control forms the core of the solution disclosed in D 1. Thanks to the factory presetting to a throttle or control curve, the unit can be operated like a pump unit without control electronics or with a permanently installed control curve (col. 2, lines 8–12). The necessary flexibility in application is achieved by the external adjustment option (intended for the skilled person) (col. 3, lines 3-8). 128. This combination of a standardised internal control and its external adjustment option, which forms the core of the solution disclosed in D 1, would be negated by the provision of an external control and the switching means then required. Therefore, based on D 1, the skilled person has no reason to combine the solution provided therein with an external control and switching means. cc) EP 2 151 578 B1 (D 8) with D 5 129. Even based on EP 2 151 578 (Annex B&B D 8, hereinafter: EP '578 or D 8) in combination with D 5, there is no lack of inventive step. 130. D 8 discloses a circulation pump unit which has an electric drive motor and a control device for controlling the drive motor. The control device has a communication interface which is designed for connection to at least one external sensor and/or at least one further unit to be controlled by the control device (col. 1, lines 47-58). The control device is designed so that it can take over the function of an external control unit as used in known systems. The communication interface enables the control device to communicate with other system components, in particular with other devices to be controlled (col. 2, lines 7-11). The control device of a circulation pump unit or a pump can simultaneously take over the control or regulation of other units, as is the case with the external control device in the aforementioned systems. In addition, sensors can be connected via the communication interface to supply the control device with system parameters so that the pump can be controlled depending on these parameters. 131. Whether the circulation pump unit disclosed in D 8, which is designed for large systems with numerous circulation pumps and a central control unit, actually constitutes a realistic starting point for assessing the inventive step is already questionable, but does not require a final decision. Even if this were the case, D 8 in any event fails to disclose electronic means within the meaning of feature group 4, which determine whether an external control is connected or not and which switch to this external control when it is detected (feature group 4). Such an electronic means, which fulfils the requirements set out in feature 4.2 in the form of switching over as soon as the connection of an external control has been detected, is also not disclosed in D 5, as explained above. 132. Insofar as the defendant points out in this context that a slave pump always requires coordination between an internal control system and an external control system, this may be true. However, this does not necessarily mean that the external control must be given priority when the electronic means in question detects the connection of an external control (emphasis added). Rather, according to the solution described in D 8, the main master pump is connected via a communication interface for data transmission to at least one auxiliary (slave) pump, wherein the auxiliary pump has a control device which is designed to control the auxiliary pump in dependence on data received from the main pump (see D 8, para. [0021]). Control therefore continues to be carried out by controlling the slave pump depending on data received from the master pump. The master pump and slave pump are therefore permanently connected to each other. A complete switchover to external control in the event that such a connection is detected by an electronic means within the meaning of feature group 4 does not take place and is also not necessary. 133. Based on the disclosure content of D 8, the skilled person also had no reason to further develop the solution disclosed therein towards an exclusive relationship between internal and external control. In particular, there is no such reason in view of the embodiment shown in Figures 1 and 2 and described in paragraphs [0027] et seq. In the system shown there, the main pump (12) controls the entire system, i.e. it controls the other pumps (44), (46) and (48) as well as the valves (see para. [0036] et seq.). However, the auxiliary pump (46) controlled by the main pump controls the heating of the water in the water storage tank and the withdrawal of water from the water storage tank (para. [0039]). Even though the auxiliary pump (46) is controlled by the main pump and thus externally, it therefore apparently also has an internal control system for processing the control signals received from the main pump. There is no switching from internal control to external control. dd) EP 0 735 273 A1 (D 2) with D 5 134. Finally, the technical teaching protected by the contested patent is also not obvious from EP 0 735 273 A1 (Annex B&B D 2, hereinafter: EP '273 or D 2) in conjunction with citation D 5. 135. EP '273 discloses a double pump with two impellers arranged in a housing, each impeller being driven by an electric motor. In addition, a higher-level control and/or regulation system is provided, with the aid of which the speeds of the two electric motors can be set or regulated independently of each other between motor standstill and the rated speed (see D 2, para. [0001]). 136. Figure 1 of D 2, shown below, illustrates the solution disclosed therein using a preferred embodiment: 137. Figure 1 shows a double pump with a housing (1) which has a pump suction side (2b) and a pump discharge side (2a). Two pump impellers (not shown) are arranged in the housing (1), each of which is driven by the electric motors (3a, 3b). Control units (5) are attached to the motor housings as modules by means of screw connections. The higher-level control module (4) is attached to the control module (5) and is connected to the control module of the second electric motor (3b) by means of a transmission cable (6) and controls it via the cable (6). 138. On this basis, the citation lacks disclosure of an electronic means within the meaning of feature group 4, which determines whether an external control is connected and switches to such an external control when an external control is detected. 139. Based on D 2, the skilled person also has no reason to provide such a means. The solution disclosed therein is characterised in that the respective control (5) of the individual pumps regulates the motor speed of the associated electric motor in accordance with the reference variable specified by the higher-level control and/or regulation (4) (see subclaim 2). The higher-level control or regulation and the respective control therefore work together permanently. No switching is required. This is clarified by the explanation of the block diagram shown in Figure 3 of D 2, where it states in column 5, lines 40–45: "Each control 5 is connected to the higher-level control 4 via an additional communication interface. The controllers 5 exchange data with the higher-level controller via the communication interface." 140. Such data exchange requires that the higher-level controller or control system (4) communicates with the controllers (5). This will prevent the skilled person from providing a means for switching between the two controllers. 34 ee) D 5 with D 7 or D 20 141. Since the defendant first referred to a combination of D 5 with D 7 or with D 20 in its reply to the counterclaim for annulment in the context of the discussion of inventive step, this also constitutes a new attack and therefore an extension of the claim, which can only be admitted under the conditions set out in R. 263 VerfO. 142. However, these conditions are not met. The defendant has not been able to show any valid reasons why the further attack on the inventive step now introduced into the proceedings was not already included in the counterclaim for annulment. Nor can it be assumed, in view of the strict time limits imposed by the EPG, that the plaintiff would be unduly prejudiced in its conduct of the proceedings by the admission. 143. Insofar as the defendant attempts to justify the discussion of a combination of D 5 with D 7 or D 20, which appears for the first time in the reply to the counterclaim for annulment, on the grounds that the plaintiff denied the disclosure of a centrifugal pump and an electric motor in D 5 (see reply to the counterclaim for annulment, p. 26), this argument cannot help it succeed because it already admitted in the counterclaim for annulment itself that neither the design of the circulation pump as a centrifugal pump nor the drive of the pump by an electric motor was explicitly disclosed in D 5 (see counterclaim for invalidity, p. 25 above). On this basis, the defendant's own submission already gave rise to a discussion, based on D 5, of at least the (alleged) lack of inventive step in the counterclaim for invalidity. Nevertheless, in its counterclaim for invalidity, the defendant decided to discuss the inventive step exclusively on the basis of D 1, D 2, D 6 and D 8, in each case in combination with D 5. The defendant has not been able to show any comprehensible reasons that would nevertheless justify allowing the discussion of D 5, which was first included in the reply to the counterclaim for invalidity, as a starting point, which is why the associated extension of the counterclaim for invalidity could not be allowed. 144. If one were to take a different view, the defendant has in any case failed to explain what reason the skilled person would have had to combine D 5 with the aforementioned documents in each case. If, as in the present case, the defendant only challenges the inventive step at a later stage of the nullity proceedings by referring to a further combination of documents and if the associated extension of the counterclaim for nullity is exceptionally admissible, the defendant bears a high burden of proof in this respect. The defendant's submissions do not satisfy these high requirements. Insofar as the defendant assumes in its reply to the counterclaim for invalidity (see p. 31, second complete paragraph) that, based on D 5, the skilled person is faced with the task of specifying the pump known from D 5 in such a way that it is optimised for use as a circulation pump in heating systems, this view appears not only retrospective, but also contrived and not prompted by the citation D 5. The mere reference to the fact that D 7 already refers to a ‘circulation pump’ in its title is equally insufficient to justify a prompting, as is the further reference to the fact that both documents, taken individually, disclose a plurality of patent features. 35 ff) Decision of the Chinese National Intellectual Property Office of 6 January 2025 (hereinafter: Office) 145. Insofar as the defendant, outside the scope of the opportunities available to it to comment, submitted a decision of the Chinese National Intellectual Property Office of 6 January 2025 (see Annex B & B 22), in which a Chinese parallel patent was revoked due to lack of inventive step, the Office justified its decision with a combination of D 5 and D 7. However, as already explained, the defendant failed to introduce the combination of these documents into the present proceedings in good time, which is why its submission in this regard and the associated extension of the action were not admissible. Against this background, the Board also disregarded the decision of the Office pursuant to Rule 9(2) of the Rules of Procedure. E. Infringement I. Realisation of features 146. The parties rightly agree that features 1 to 3 are realised, so that no further comments are necessary in this respect. Furthermore, the contested embodiment makes use of the other features of the contested patent. Based on the understanding set out in detail above, the contested embodiment has means (20) that satisfy the requirements of feature group 4. 1. Functionality of the contested embodiments 147. The defendant has not disputed that the contested embodiment has an internal control system implemented by three electronic components. A plurality of shunt resistors detect the signals representing the motor. The microprocessor processes the motor current signals detected by the shunt resistors in order to output suitable signals for setting the motor speed. Furthermore, the contested embodiment has an H-bridge (i.e. an electronic circuit) which supplies the electric motor with voltage. This is controlled by the aforementioned output signals from the microprocessor and thus controls the speed of the electric motor. The user can choose between four different main operating modes for the internal pump control, three of which are available in different stages/speeds. The control curves implemented by the internal pump control vary depending on the operating mode selected: 36 148. In the factory-set AUTO mode, the internal control automatically adjusts the pump output in short control intervals within the control range shaded in green in the figure above, step by step, to the actual heat demand of the heating system. Depending on the heat demand of the heating system, the setpoint values are adjusted over a longer period of time by the internal control system. 149. In addition to a suction and a pressure connection, the pump housing of the contested embodiment has two connections for external lines, one for the power supply and one for connecting a control signal line: 150. External control signals in the form of pulse width modulation signals can be fed to the microprocessor inside the pump via the control signal line. 2. Features 4. and 4.1. 151. That being said, the contested embodiment has means for switching from the internal electronic control (16) to an external speed control or for connecting an external control (features 4. and 4.1.). As the Board has already explained in detail in the interpretation of the patent claim, the means for this must be designed in such a way that it can bring about a switchover or connection. This is the case with the contested embodiment. 152. The microprocessor inside the pump is connected to the connection for the external control via a galvanic isolation: 37 153. It detects when PWM signals are applied by the external control via the connection on the housing side. The electric motor is then no longer controlled according to the preset operating mode of the internal control system, but according to the PWM signals specified by the external control system. The duty cycle of the PWM signals specifies the desired speed of the electric motor. This results in a switchover from internal to external speed control. 154. The fact that the motor speed in the contested embodiment is determined either by the internal pump control or by the external speed control, so that it is not possible to combine both controls (see Annex B&B 9a/9b and B&B 11a/11b), does not preclude the realisation of the technical teaching protected by the patent as described. The granting of the possibility of switching on the external speed control is not necessarily required by patent claim 1, as long as the means enable the switchover from the internal electronic control to the external speed control as described in feature 4.2 (‘or switching on’). 3. Feature 4.2. 155. Based on the above understanding, it is already clear from the affidavits submitted by the defendants as Annexes B&B 9a/9b and B&B 11a/11b that the contested embodiment also has electronic means within the meaning of feature group 4.2. 156. According to these, the contested embodiment comprises a microprocessor (MCU), a PWM input for receiving external PWM signals and an optocoupler isolation device. The PWM input is used to connect to an external control system in order to receive external PWM signals. The received PWM signal is then converted by the optocoupler isolation device into a digital pulse signal that can be recognised by the MCU. When the MCU receives the digital signal, it immediately converts the digital pulse signal into a speed signal and transmits it to the motor via the H-bridge (Appendices B&B 9a/9b, Fig. 5). 157. As soon as a stable PWM signal is present, the embodiment switches to this signal. It therefore has electronic means in the form of the microprocessor for switching from internal control to external speed control. The fact that the contested embodiment is forced by its design to use the stable PWM signal for speed control as soon as it is present and therefore cannot decide in any way (see Annexes B&B 11a/11b, para. 3) does not fall outside the scope of protection of the contested patent. Patent claim 1 does not require the granting of a decision-making option. Rather, it even excludes such an option. 158. The microprocessor arranged in the housing of the contested embodiment thus constitutes an electronic component and therefore a means which detects the connection of the external PWM speed control and then switches to it. II. Alleged identity with the design shown in Annex B&B 7 159. The defendant's objection that the signals, control principles, interfaces and PWM input signals and their example values described in the prior art (‘GRUNDFOS DATEN-HEFT UPM2, UPM GEO, UPM2K Umwälzpumpen 50/60 Hz’ from December 2012, see Annex B&B 7) are identical to the contested embodiment in all relevant respects, is irrelevant, regardless of whether such an objection can even be raised in the context of an infringement discussion in the case of a literal patent infringement (contrary to: UPC_CFI_452/2023 (LK Düsseldorf), order of 9 April 2024, p. 16 – Ortovox v. Mammut), because the circulation pump shown there, unlike the contested embodiment, cannot be operated both by means of an internal control system and via an external control system. Rather, the pump is designed exclusively for external control (see Annex B&B 7, p. 3). If no cable suitable for transmitting PWM control signals is available, the pump shown in the prior art operates at maximum capacity and not on the basis of an internal electronic control system (see feature 1.4.). III. Infringing acts by the defendant 160. By offering and distributing the contested embodiment within the scope of the contested patent, the defendant has also indisputably committed acts of infringement within the meaning of Article 25(a) EPGÜ. In this context, the offering and placing on the market also give rise to a rebuttable presumption that the defendant also uses the contested embodiment or imports or possesses it for the purposes of offering, placing on the market or using it (UPC_CFI_7/2024 (Local Chamber Düsseldorf), decision of 3 July 2024 – Kaldewei v. Bette; UPC_CFI_363/2023 (Local Chamber Düsseldorf, decision of 10 October 2024 – Seoul Viosys v. expert e-Commerce; UPC_CFI_50/3035 (LK Düsseldorf), decision of 10 April 2025, para. 199 – Yellow Sphere v. Knaus Tabbert). F. Legal consequences 161. Now that the contested patent has been found to be valid and infringed, the following legal consequences apply: I. Injunction 162. Taking into account the circumstances of the case, the plaintiff is entitled to an injunction against the continuation of the infringement pursuant to Art. 25(a) EPGÜ in conjunction with Art. 63(1) EPGÜ. II. Provision of information and accounting 163. The plaintiff also has a right to information pursuant to Art. 25(a) EPGÜ in conjunction with Art. 67 EPGÜ. 39 There are no objections to the manner of providing the information requested. Insofar as the plaintiff requests information on the names and addresses of commercial customers, it is seeking information on the distribution channels of the infringing products within the meaning of Art. 67(1)(1) EPGÜ. 164. Furthermore, pursuant to Art. 68(3)(a), (b) EPGÜ in conjunction with R. 191 p. 1 Alt. 2 VerfO, for the purpose of legal action, request the information that it reasonably requires for the purpose of legal action and that also enables it to verify the accuracy of the information provided and to obtain evidence for its calculation of damages (UPC_CFI_7/2023 (LK Düsseldorf), decision of 03.07.2024, p. 29 – Kaldewei v. Bette; UPC_CFI_16/2024 (LK Düsseldorf), decision of 14.01.2025, p. 36 – Ortovox v. Mammut; UPC_CFI_210/2023 (LK Mannheim), decision of 22 November 2024, para. 179 – Panasonic v. Oppo). This also includes information on individual offers, broken down by offer quantities, times, prices and type designations, as well as the names and addresses of the recipients of the offers. 165. Since the plaintiff's application is aimed at providing proof of purchase, namely invoices or, alternatively, delivery notes, the defendant's further objection that the plaintiff is (allegedly) seeking the submission of invoices and delivery notes is unfounded. III. Recall 166. The order to recall the directly infringing products from the distribution channels is based on Article 64(2)(b) EPGÜ. The wording of the application is also not objectionable from the point of view of specificity. 167. Such a recall order is also unobjectionable from the point of view of proportionality (Article 64(4) VerfO). 168. The fact that the contested embodiment may, as claimed by the defendant, be partially installed deep within building heating systems does not preclude the imposition of an obligation to recall the products from the distribution channels, because the recall merely requires a recall statement and thus a mere letter to the commercial customers. The plaintiff does not demand removal from the distribution channels. The alternative measures referred to by the defendant, and in particular the possibility of sealing, are therefore irrelevant in the context of the recall. Apart from that, the distribution channels include all commercial owners and thus also commercial end users (see Tilmann/von Falck/Plassmann, Art. 64, para. 25). As long as the pump in question has not yet been installed in the heating system of a building, it would therefore have to be recalled even if, like the defendant, one were to base the recall on an action that goes beyond the recall declaration. 169. The interests of homeowners and tradesmen, which the defendant continues to raise, do not preclude an obligation to recall either. Pumps installed in buildings owned by private homeowners are not subject to the recall obligation from the outset. If, on the other hand, the pumps are owned by commercial end users and have been installed in their buildings, the above statements apply accordingly. 170. Finally, insofar as the defendant claims the parties were in licence negotiations when the action was brought, during which the defendant was prepared to pay reasonable licence fees under economic conditions, but that it had been misled by the plaintiff as to its willingness to grant a licence, this does not preclude the order of a recall, if only because no licence was granted. According to Article 25 EPGÜ, a patent grants the proprietor the right to prevent third parties from performing the acts of use specified in points (a) to (c) of the provision without his consent. The exclusive right to use the patent in dispute is therefore assigned to the plaintiff, who can in principle decide for itself whether and, if so, under what conditions it will license the patent and thus grant third parties a right of use. As long as the plaintiff has not licensed the patent in dispute to the defendant and thereby granted it a right of use, the defendant has no right to use the patent in dispute. If it nevertheless places the contested embodiment on the market in a manner that infringes the patent, it cannot successfully argue against any resulting recall obligation on the grounds that it had relied on a subsequent licence being granted. IV. Destruction 171. The order for destruction is based on Art. 64(2)(e) and (4) EPC. 172. Since destruction is intended to reliably prevent the products from entering or re-entering the market (UPC_CFI_16/2024 (LK Düsseldorf), decision of 14 January 2025, p. 37 – Or- tovox v. Mammut; Tilmann/von Falck/Tilmann, Einheitspatent, Einheitliches Patentgericht, Art. 64 EPGÜ, para. 33), the sealing of the signal inputs of the pump referred to by the defendant as a possible alternative measure and an obligation on the defendant to have its customers sign a cease-and-desist declaration subject to a penalty clause are only relevant alternatives if they ensure that the pumps at issue will not be returned to a patent-infringing state when such a solution is used and cannot then be placed on the market (UPC_CFI_16/2024 (LK Düsseldorf), decision of 14 January 2025, p. 37 – Ortovox v. Mam- mut). 173. The mere obligation on the defendant to obtain declarations of discontinuance subject to a penalty clause is not sufficient for this purpose, if only because such an obligation would be almost impossible for the plaintiff to monitor. It therefore does not satisfy the plaintiff's interest in destruction from the outset. 174. The defendant has also failed to demonstrate sufficiently that sealing or sealing the entrances satisfies these requirements. In addition, it cannot be determined that this is a less severe measure than destruction, even taking into account the costs incurred. Finally, the defendant has also failed to demonstrate that, based on the scope of protection explained in detail above, a design with a seal no longer falls within the scope of protection of the contested patent. V. Determination of liability for damages 175. The determination of the award of damages on the merits is possible on the basis of Article 68(1) EPC. The defendant should have recognised, with due care, that its actions infringed the contested patent. 41 176. Insofar as the defendant objects to the claim for damages on the grounds that, if anything, a lump sum should be awarded as damages, this question does not need to be decided at present. The decision on the amount of damages is reserved for the proceedings on the amount of damages that may follow the infringement proceedings. In the infringement proceedings, on the other hand, the plaintiff merely seeks a declaration that the defendant is liable for damages on the merits. VI. Provisional damages 177. Pursuant to R. 119 VerfO, the court may award the prevailing party provisional damages under conditions determined by it, which shall at least cover the provisional costs of the damages and compensation proceedings on the part of the prevailing party. 178. The defendant did not substantially contest the amount of EUR 64,000 claimed by the plaintiff for provisional damages, which is why this amount could be awarded to the plaintiff. VII. Threat of a penalty payment 179. The threat of a penalty payment for failure to comply (Art. 63(2) EPGÜ) does not give rise to any concerns. This also applies from the point of view of proportionality. The threat of measures relating to disclosure, information, recall, removal and destruction is based on Art. 82(1) and (4) EPGÜ, R. 354(3) VerfO (UPC_CFI_7/2023 (LK Düsseldorf), decision of 3 July 2024, p. 31, para. 5 – Kaldewei v. Bette; UPC_CFI_16/2024 (LK Düsseldorf), decision of 14 January 2025, p. 39 – Ortovox v. Mammut; UPC_CFI_50/2024 (LK Düsseldorf; UPC_CFI_50/2024 (LK Düsseldorf), decision of 10 April 2025, para. 276 et seq. – Yellow Sphere v. Knaus Tabbert). 180. The threatened penalty payment of up to EUR 250,000 gives the Chamber the necessary flexibility to take into account the circumstances of the individual case, including the conduct of the infringer, in the event of an infringement and, on that basis, to set an appropriate penalty payment in accordance with Article 82(4) sentence 2 EPGÜ in conjunction with R. 354.4 VerfO. VIII. Decision on costs 181. Pursuant to Art. 69(2) EPGÜ in conjunction with R. 118(5) VerfO, R. 265(2)(c) VerfO, a decision on costs had to be made. 182. Since the plaintiff has been completely successful in its action for infringement, it is justified to order the defendant to bear the costs of the proceedings. 183. The counterclaim for annulment was unsuccessful. The defendant must therefore also bear these costs. IX. Upper limit for reimbursement 184. The upper limit for reimbursable representative costs is based on the Administrative Committee's decision on the upper limits for reimbursable costs of 24 April 2023 (D - AC/10/24042023_D). 42 X. No security deposit 185. Pursuant to Art. 82(2) EPGÜ, R. 118(8) sentence 2 VerfO, the court may make any order or measure subject to a security deposit to be determined by it. 186. As already clarified by the wording of the aforementioned provision, the Chamber has discretion when ordering security, whereby the plaintiff's interest in the effective enforcement of its property right must be weighed against the interest in the effective enforcement of possible claims for damages in the event of a subsequent annulment of the judgment. 187. It is therefore always necessary to examine each case individually. The factors to be taken into account when deciding whether to order security include the financial situation of the claimant, which may give rise to legitimate and real concerns that a possible claim for damages cannot be enforced and/or executed, or can only be enforced and/or executed with disproportionate effort, if the decision of the court of first instance is set aside or amended. Whether and to what extent such factors exist must be determined, as in the case of an application for security pursuant to R. 158 VerfO, on the basis of the facts and arguments presented by the parties. If the Chamber makes an order or measure dependent on security, this serves to protect the position and potential rights of the defendant. This protection must be weighed against the burden placed on the claimant by the order to provide security. Against this background, it is incumbent on the defendant to present facts and arguments as to why it appears appropriate in the specific case to make the order or measure pursuant to R. 118(8) VerfO dependent on security to be determined by the court. If the defendant has complied with this, it is incumbent on the claimant to substantiate these facts and reasons, especially since it generally has knowledge and evidence of its financial situation. It is also the claimant's responsibility to explain, if necessary, why its interest in enforcing its property right without security outweighs the reasons put forward by the defendant (see UPC_CFI_50/2024 (LK Düsseldorf), decision of 10 April 2025, para. 282 – 285 – Yellow Sphere v. Knaus Tabbert; UPC_CFI_16/2024 (LK Düsseldorf), decision of 14 January 2025 – Ortovox v. Mammut; UPC_CFI_363/2024 (LK Düsseldorf), decision of 10 October 2024 – Seoul Viosys v. expert). 188. Based on these principles, the defendant has not presented any reasons that would justify making enforcement in the present case dependent on the provision of security. The Chamber has therefore refrained from ordering such security for enforcement. 43 DECISION: A. It is hereby determined that the defendant infringes EP 2 778 423 B1 when it manufactures heating circulation pump units with a centrifugal pump, an electric motor driving the pump, an electronic speed controller for the motor and an internal electronic control system in which the control variable is the speed of the motor, the speed controller and the control system forming part of the unit, a signal input for external control of the motor and means for switching from the internal electronic control system to an external speed control system or for connecting an external speed control system, in Germany, France or Italy, or has them offered, placed on the market, used or imported for the aforementioned purposes, in which the means for switching are electronic means which determine whether an external control is connected or not and, if an external control is detected, switch to the external control. B. The defendant is ordered I. to refrain from offering for sale, placing on the market, importing or using heating circulation pump units with a centrifugal pump, an electric motor driving the pump, an electronic speed controller for the motor and an internal electronic control system in which the control variable is the speed of the motor, whereby the speed controller and the control system form part of the unit, a signal input for external control of the motor is provided and means for switching from the internal electronic control system to an external speed control system or for connecting an external speed control system are provided, in Germany, France or Italy, to offer/have offered, to put into circulation/have put into circulation, to use/allow to be used or to import or possess for the aforementioned purposes, in which the means for switching are electronic means which determine whether an external control is connected or not and, if an external control is detected, switch to the external control; II. to provide the plaintiff, in an orderly and comprehensible list, information on the extent to which it has committed the acts referred to in point B. I. since 28 February 2018, specifying 1. the origin and distribution channels of the infringing products, 2. the quantities delivered, received or ordered and the prices paid for the infringing products, and 3. the identity of all third parties involved in the manufacture or distribution of infringing products, whereby the defendant must provide evidence of the information pursuant to the above section B. II. 1. 44 to B. III. 3., the defendant must submit copies of the relevant purchase documents, namely invoices or, alternatively, delivery notes, whereby details requiring confidentiality may be blacked out except for the data subject to the obligation to provide information; III. provide the plaintiff with a clear and comprehensible statement of the extent to which it has committed to the actions specified in Section II. since 28 February 2018, specifying 1. the individual deliveries, broken down by delivery quantities, delivery times, delivery prices and type designations, as well as the names and addresses of the commercial recipients, 2. the individual offers, broken down by offer quantities, offer times, offer prices and type designations, as well as the names and addresses of the commercial recipients of the offers, 3. the advertising carried out, broken down by advertising media, their circulation figures, distribution period and distribution area, 4. the production costs broken down by individual cost factors and the profit achieved; IV. to surrender the products specified in Section II that are in their direct or indirect possession or ownership to a bailiff to be named by the plaintiff for the purpose of destruction at the defendant's expense; V. to order the defendant to pay the plaintiff all costs and expenses incurred by the plaintiff in connection with the proceedings, including the costs of the expert opinion and the costs of the proceedings, in accordance with the provisions of the German Civil Code (BGB) and the German Law on Costs of Expert Opinions (FEG) and the German Law on Costs II. to a bailiff to be appointed by the plaintiff for the purpose of destruction at the defendant's expense; V. to order the defendant to pay the costs of the proceedings in accordance with the costs schedule in the claim. I. 1. and placed on the market since 28 February 2018 to commercial customers, with reference to the patent infringement established by the court (EPG judgment of 8 May 2025) and with the binding undertaking to reimburse to reimburse any fees and necessary packaging and transport costs as well as customs and storage costs associated with the return and to take the products back; VI. to pay the plaintiff provisional damages in the amount of EUR 64,000; VII. in the event of a breach of the orders pursuant to Section B. I., B. II., B. III., B. IV. and B. V., to pay a penalty of up to EUR 250,000 for each case of non-compliance. C. It is hereby declared that the defendant is obliged to compensate the plaintiff for all damage incurred and to be incurred as a result of the actions referred to in Section II, which began on 28 February 2018. D. The counterclaim for annulment is dismissed. E. The costs of the action and the counterclaim for annulment shall be borne by the defendant. F. The value in dispute of the action and the counterclaim for annulment is set at EUR 1,000,000.00 in each case. G. The upper limit of the reimbursable costs of representation is set at EUR 200,000 in total for the action and the counterclaim for annulment. H. The orders in sections B. I. to B. VII. shall only become enforceable after the plaintiff has informed the court which part of the orders it intends to enforce and, where necessary, has submitted a certified translation of the orders into the official language of the Member State of the Member State in which enforcement is to take place, and after the defendant has been served with the notification and, where applicable, the (respective) certified translation.
