GEGENSTAND: R. 262.1(b) VerfO – Öffentlicher Zugang zum Register
KURZE DARSTELLUNG DES SACHVERHALTS:
Die Klägerin nimmt die Beklagten wegen Verletzung des nach ihrem Vorbringen für den Opus Au-dio Codec essentiellen Europäischen Patents EP 3 605 534 (nachfolgend: Streitpatent) vor der Lo-kalkammer Düsseldorf in Anspruch. Die Klage richtet sich gegen alle Fernseher sowie alle sonstigen elektronischen Geräte der Beklagten, die das Betriebssystem „Android TV“ in der Version 5.0 oder einer nachfolgenden Version verwenden (nachfolgend: angegriffene Ausführungsform). Die Be-klagten treten dem Verletzungsvorwurf entgegen und erheben den FRAND-Einwand. Sie haben zudem Nichtigkeitswiderklage erhoben. Das Streitpatent war nicht Gegenstand eines früheren Rechtsbestandsverfahrens.
Sowohl im Verletzungsverfahren als auch im Verfahren betreffend die Nichtigkeitswiderklage (nachfolgend gemeinsam: Hauptverfahren) sind die in R. 12 VerfO genannten Schriftsätze ausge-tauscht. Eine Anordnung nach R. 35 VerfO zum Abschluss des schriftlichen Verfahrens ist noch nicht ergangen.
Die Klägerin nimmt die Antragstellerin vor der Lokalkammer Hamburg wegen Verletzung des Streitpatents in Anspruch. Die Klage richtet sich gegen die von der Antragstellerin vertriebenen Beamer (Videoprojektoren) sowie alle sonstigen elektronischen Geräte, die das Betriebssystem „Android TV“ in der Version 5.0 oder einer nachfolgenden Version verwenden. Die Antragstellerin beabsichtigt nach ihren Angaben, sich gegen den erhobenen Verletzungsvorwurf zu verteidigen und gegebenenfalls Nichtigkeitswiderklage gegen das Streitpatent zu erheben. Die Frist zur Einrei-chung der Klageerwiderung und Erhebung einer möglichen Nichtigkeitswiderklage vor der Lokal-kammer Hamburg läuft bis zum 7. Mai 2025.

II. Soweit die in Ziffer I. genannten Schriftsätze, Anlagen und Beweismittel geheimhal-tungspflichtige Informationen enthalten und die Parteien entsprechend geschwärzte Fassungen eingereicht haben, sind der Antragstellerin lediglich diese geschwärzten Fassungen der Dokumente vorzulegen;
hilfsweise,
III. der Antragstellerin Zugang zu allen im Rahmen der Nichtigkeitswiderklage beim Ge-richt eingereichten und von der Kanzlei aufgenommen Schriftsätze nebst Anlagen und Beweismittel zu gewähren.
Die Klägerin beantragt,
I. die Anträge zu I. bis III. zurückzuweisen;
hilfsweise,
II. der Antragstellerin entsprechend ihrem Antrag zu II. zur Wahrung der Geheimhal-tungsinteressen der Parteien lediglich die geschwärzte Version geheimhaltungsbedürf-tiger Schriftsätze und Beweismittel zugänglich zu machen;
III. die Antragstellerin zu verpflichten, die ihr zur Verfügung gestellten Schriftsätze und Beweismittel bis zum rechtskräftigen Abschluss des Verfahrens vertraulich zu behan-deln.
WESENTLICHE STREITPUNKTE:
Die Antragstellerin trägt vor, die im Hauptsacheverfahren von der Klägerin und den Beklagten vor-getragene Auslegung der Patentansprüche sei für ihren eigenen Vortrag in dem Verfahren vor der Lokalkammer Hamburg von Interesse. Da das Klagepatent bisher noch kein Rechtsbestandsverfah-ren durchlaufen habe, gelte dies ebenfalls für die im Rahmen des Rechtsbestands vorgetragene Argumentation der Klägerin. Die Erwiderungen der Klägerin auf den von den Beklagten vorgeleg-ten Stand der Technik könnten zudem ihre, der Antragstellerin, Recherchestrategie nach vorbe-kanntem Stand der Technik beeinflussen. Es sei ferner möglich, dass sie von der Erhebung der Nichtigkeitswiderklage absehen könne, wenn sich aus dem Vortrag der Parteien des Hauptverfah-rens die hinreichende Wahrscheinlichkeit einer Rechtsbeständigkeit des Streitpatents ergebe.
Die Klägerin ist der Ansicht, der Antrag sei bereits unzulässig, soweit er sich auf Dokumente be-ziehe, die weder Schriftsätze noch Beweismittel seien. Ihre, der Klägerin, Interessen, konkret das Interesse an der Integrität des noch in erster Instanz anhängigen Verfahrens, überwiege das von der Antragstellerin geltend gemachte Interesse. Einem Zugang zu geheimhaltungsbedürftigen In-formationen, den die Antragstellerin aber selbst nicht verlange, würden auch Geheimhaltungsin-teressen entgegenstehen. Klarzustellen sei, dass Gegenstand des Verfahrens vor der Lokalkammer Hamburg zwar dasselbe Patent sei, jedoch unterschiedliche Produkte betroffen seien und die An-tragstellerin die technische und funktionale Vergleichbarkeit der Produkte nicht einmal ansatz-weise dargetan habe. Selbst wenn man von einem direkten Interesse der Antragstellerin im Sinne der Rechtsprechung des Berufungsgerichts ausgehen wollte, stehe diesem die außergewöhnlich hohe Gefahr einer Gefährdung der Verfahrensintegrität gegenüber. So beträfen die im Zusammen-hang mit dem FRAND-Einwand der Beklagten ausgetauschten Argumente unter anderem die au-ßergerichtliche Kommunikation zwischen den Parteien. Auch seien sie, die Klägerin, und der Ver-walter des Opus-Patentpools, Vectis, unverändert um eine Lizenzierung des Streitpatents an die

Beklagten bemüht. Eine im Anschluss an die Akteneinsicht angepasste Argumentation der Antrag-stellerin im Parallelverfahren – in das dann wiederum die Beklagten Einsicht nehmen könnten – könnte für die Beklagten einen Anreiz setzen, sich einer Lizenz weiter grundlos zu verschließen. Darüber hinaus bestehe die Gefahr indirekter Preisabsprachen, wenn die Beklagten beider Verfah-ren ihre Verhaltensweisen in den Lizenzverhandlungen mit ihr, der Klägerin, beziehungsweise mit Vectis aufeinander abstimmten, weil sie durch die wechselseitige Akteneinsicht Einblick sowohl in die finanziellen Angebote der jeweiligen Partei als auch in Verhandlungsstrategien und Besonder-heiten des jeweiligen Einzelfalls erhalten könnten. Die Situation wäre vergleichbar mit einer soge-nannten „Licensing Negotiation Group“ (LNG), bei der sich Nutzer von standardisierten Technolo-gien zur Verhandlung von Lizenzverträgen mit SEP-Inhabern zusammenschlössen und gegen die erhebliche kartellrechtliche Bedenken bestünden.
Die Beklagten haben von der ihnen eingeräumten Möglichkeit zur Stellungnahme keinen Gebrauch gemacht.
GRÜNDE FÜR DIE ANORDNUNG:
Der Antrag der Antragstellerin gemäß R. 262.1(b) VerfO ist zulässig und teilweise begründet.
1. Die Antragstellerin hat als Mitglied der Öffentlichkeit einen begründeten Antrag im Sinne von R. 262.1(b) VerfO gestellt. Ein begründeter Antrag in diesem Sinne ist ein Antrag, in dem nicht nur angegeben wird, zu welchen Schriftsätzen und Beweismitteln Zugang begehrt wird, sondern der auch den Zweck des Antrags angibt und erläutert, warum der Zugang zu den angegebenen Doku-menten für diesen Zweck erforderlich ist, und der somit alle Informationen bereitstellt, die der Berichterstatter benötigt, um die erforderliche Interessenabwägung vorzunehmen (CoA_404/2023, Entscheidung v. 10. April 2024, Rn. 44 – Ocado v. Autostore; CoA_480/2024, Ent-scheidung v. 9. Januar 2025, Rn. 10 – Abbott v. Powell Gilbert). Der Antrag der Antragstellerin vom 14. Februar 2025 erfüllt diese Anforderungen und ist daher zulässig. Dem Antrag lässt sich insbe-sondere entnehmen, warum aus Sicht der Antragstellerin die Gewährung von Akteneinsicht erfor-derlich ist und zu welchem Zweck diese begehrt wird.
Ob ein Interesse in Bezug auf alle oder nur auf einen Teil der Dokumente dargelegt wird, zu denen Zugang verlangt wird, ist hingegen keine Frage des Vorliegens eines begründeten Antrags und da-mit der Zulässigkeit. Ebenfalls erst im Rahmen der Begründetheit des Antrags von Bedeutung ist die Frage, ob es sich bei allen von der Antragstellerin genannten Dokumenten um Schriftsätze und Beweismittel im Sinne des R. 262.1(b) VerfO handelt (vgl. UPC_CFI_75/2023 (ZK München), Anord-nung v. 22. August 2024 – Astellas v. Healios).
2. In der Sache hat der Antrag teilweise Erfolg.
a) Bei der Entscheidung über einen Antrag nach R. 262.1(b) VerfO sind die Interessen eines Mitglieds der Öffentlichkeit, Zugang zu den beantragten Unterlagen zu erhalten, gegen die in Art. 45 EPGÜ genannten Interessen abzuwägen. Zu diesen Interessen gehört der Schutz vertraulicher Informa-tionen und personenbezogener Daten („die Interessen einer der Parteien oder sonstiger Betroffe-ner“), sie sind jedoch nicht darauf beschränkt. Auch die allgemeinen Interessen der Justiz und der öffentlichen Ordnung sind zu berücksichtigen. Das allgemeine Interesse der Justiz umfasst den Schutz der Integrität von Verfahren. Die öffentliche Ordnung ist z.B. gefährdet, wenn ein Antrag

missbräuchlich ist oder wenn Sicherheitsinteressen auf dem Spiel stehen (CoA_404/2023, Ent-scheidung v. 10. April 2024, Rn. 43 – Ocado v. Autostore; CoA_480/2024, Entscheidung v. 9. Januar 2025, Rn. 10 ff. – Abbott v Powell Gilbert; CFI_342/2024 (LK München), Anordnung v. 20. Dezem-
ber 2024, Rn. 16 – Phoenix Contact v. I.L.M.E.).
aa) Sobald das Gericht eine das Verfahren in erster Instanz abschließende Entscheidung oder Anord-nung getroffen hat, hat die Öffentlichkeit in der Regel ein Interesse daran, dass Schriftsätze und Beweismittel zugänglich gemacht werden. Dies ermöglicht ein besseres Verständnis der ergange-nen Entscheidung im Hinblick auf die von den Parteien vorgebrachten Argumente und die heran-gezogenen Beweise. Es ermöglicht auch die Kontrolle des Gerichts, was für das Vertrauen der Öf-fentlichkeit in das Gericht wichtig ist (CoA_404/2023, Entscheidung v. 10. April 2024, Rn. 47 – O-cado v. Autostore; CoA_480/2024, Entscheidung v. 9. Januar 2025, Rn. 13 ff. – Abbott v. Powell Gilbert; CFI_75/2023 (ZK München), Anordnung v. 22. August 2024 – Astellas v. Healios; CFI_255/2023 (ZK Paris), Anordnung v. 14. Oktober 2024, Rn. 17 ff. – Meril v. Edwards; CFI_14/2023 (ZK München), Anordnung v. 22. Oktober 2024 – Regeneron v. Amgen; CFI_252/2023 (ZK München), Anordnung v. 3. Januar 2025 – NanoString v. Harvard College). Dieser Grundsatz gilt, wie das Berufungsgericht in Abbott v. Powell Gilbert (CoA_480/2024, Entscheidung v. 9. Januar 2025, Ls. 2) entschieden hat, unabhängig davon, ob
- eine Berufung gegen die Entscheidung oder Anordnung anhängig ist,
- die erlassene Anordnung einen Antrag auf einstweilige Maßnahmen betrifft (R. 206 VerfO),
- die Informationen und Beweismittel auch Gegenstand anderer Verfahren sind, bei-spielsweise weil sie dasselbe Patent oder Patente derselben Patentfamilie betreffen, und
- die erstinstanzliche Entscheidung alle Argumente und Beweismittel in der Sache be-handelt.
bb) Ein Mitglied der Öffentlichkeit kann auch ein spezifischeres Interesse an den Schriftsätzen und Be-weismitteln eines bestimmten Falles haben als das oben erwähnte allgemeine Interesse. Dies gilt insbesondere dann, wenn das Mitglied der Öffentlichkeit ein unmittelbares Interesse am Gegen-stand des Verfahrens hat, wie z.B. die Rechtsbeständigkeit eines Patents, das ihn auch als Wettbe-werber oder Lizenznehmer betrifft, oder wenn einer Partei in diesem Fall vorgeworfen wird, ein Patent durch ein Produkt verletzt zu haben, das mit einem Produkt identisch oder diesem ähnlich ist, das von dem Mitglied der Öffentlichkeit auf den Markt gebracht wurde oder werden soll. Wenn ein Mitglied der Öffentlichkeit ein solch unmittelbares berechtigtes Interesse am Gegenstand be-stimmter Verfahren hat, entsteht dieses Interesse nicht erst nach Abschluss des Verfahrens, son-dern kann durchaus sofort bestehen (UPC_CoA_404/2023, Entscheidung v. 10. April 2024, Rn. 53 – Ocado v. Autostore; UPC_CFI_342/2024 (LK München), Anordnung v. 20. Dezember 2024, Rn. 17 – Phoenix Contact v. I.L.M.E.; UPC_CFI_33/2024 (LK Wien), Anordnung v. 12. August 2024 – Swarco v. Strabag).
b) Die in Anwendung dieser Grundsätze vorzunehmende Interessenabwägung ergibt, dass der An-tragstellerin, allerdings nur in eingeschränktem Umfang, Akteneinsicht zu gewähren ist.

aa) Die Antragstellerin hat ein spezifisches Interesse an der Akteneinsicht dargelegt, das bereits wäh-rend des laufenden Verfahrens besteht. Das spezifische Interesse betrifft allerdings nur einen Teil der Dokumente, zu dem die Antragstellerin Zugang begehrt, weshalb ihr auch nur insoweit Zugang zu gewähren ist.
(1) Das spezifische Interesse der Antragstellerin richtet sich auf die Argumentation der Parteien zur Auslegung sowie zum Rechtsbestand des Streitpatents. Insoweit hat die Antragstellerin aufgezeigt, dass sie für ihren eigenen Vortrag im Verfahren vor der Lokalkammer Hamburg und für die Ent-scheidung über das Ob einer Nichtigkeitswiderklage ein unmittelbares eigenes Interesse an dem Vorbringen der Parteien vor der Lokalkammer Düsseldorf hat. Dabei ist insbesondere zu berück-sichtigen, dass das vor der Lokalkammer Hamburg anhängige Verfahren, in dem die Antragstellerin auf Beklagtenseite selbst Partei ist, ebenfalls das Streitpatent betrifft.
In diesem Umfang ergibt auch die vorzunehmende Interessenabwägung, dass dem Interesse der Antragstellerin Vorrang zu gewähren ist. Die Klägerin hat diesbezüglich keine besonderen Geheim-haltungsinteressen aufgezeigt. Sie hat lediglich betont, dass der Antragstellerin Einsicht nur in die geschwärzten Fassungen der Schriftsätze zu gewähren ist, was die Antragstellerin aber ohnehin allein begehrt (siehe Antrag der Antragstellerin zu II.). Konkrete Einwände gegen die Akteneinsicht hat die Klägerin in diesem Zusammenhang auch im Übrigen nicht erhoben.
(2) Ein darüber hinausgehendes spezifisches Interesse hat die Antragstellerin hingegen nicht aufge-zeigt.
Dies gilt zum einen für die Argumentation der Parteien im Hauptverfahren zur Verletzungsfrage, also der Verwirklichung sämtlicher Merkmale des Streitpatents durch die angegriffene Ausfüh-rungsform. Der Antrag verhält sich hierzu nicht ausreichend, um ein spezifisches Interesse der An-tragstellerin zu erkennen. Zwar erwähnt die Antragstellerin gelegentlich das Vorbringen im Haupt-verfahren zur Nichtverletzung bzw. Verletzung (vgl. Rn. 20, 24). Näher begründet wird allerdings lediglich das Interesse an den Auslegungserwägungen der Parteien. Allein der Umstand, dass so-wohl die vor der Lokalkammer Düsseldorf angegriffenen Fernseher als auch die vor der Lokalkam-mer Hamburg angegriffenen Beamer jeweils das Betriebssystem „Android TV“ in der Version 5.0 oder einer nachfolgenden Version verwenden, reicht zur Begründung eines spezifischen Interesses an den Verletzungserwägungen nicht auf. Die Antragstellerin befasst sich hiermit auch nicht näher. Vor diesem Hintergrund kommt es auf den Einwand der Klägerin, die Antragstellerin habe zur tech-nischen und funktionalen Vergleichbarkeit der Produkte nicht ausreichend vorgetragen, nicht an.
Zum anderen fehlt es auch zu der den FRAND-Einwand betreffenden Argumentation der Parteien im Hauptverfahren an der Darlegung eines spezifischen Interesses. Aus der Begründung ihres An-trags ergibt sich kein diesbezügliches Informationsinteresse der Antragstellerin. Demgegenüber hat die Klägerin gerade mit Blick auf die in diesem Bereich ausgetauschten Argumente erhebliche Bedenken gegen eine Offenlegung geäußert.
Schließlich ist auch mit Blick auf sonstige Fragestellungen, die von der Antragstellerin und der Klä-gerin im Zusammenhang mit der Akteneinsicht nicht diskutiert worden sind, die aber in den be-gehrten Dokumenten eine Rolle spielen könnten (z.B. Fragen der Aktivlegitimation), kein spezifi-sches Interesse vorhanden.

bb) Auf ein allgemeines Interesse an einer umfassenden und damit über den soeben dargelegten Um-fang hinausgehenden Akteneinsicht kann sich die Antragstellerin nicht berufen. Dieses Interesse entsteht nach den dargestellten Grundsätzen in aller Regel erst nach dem erstinstanzlichen Ab-schluss des Verfahrens. Dass dies ausnahmsweise anders sein könnte, legt die Antragstellerin nicht dar und es ist auch nicht ersichtlich.
c) Der Antragstellerin ist vor diesem Hintergrund Einsicht in die aus der Anordnung ersichtlichen Schriftsätze ihrer im Antrag zu I. genannten Auflistung zu gewähren, soweit darin Ausführungen zum Rechtsbestand und/oder zur Auslegung des Streitpatents enthalten sind.
Die Einsicht in weitere Schriftsätze, insbesondere die Nr. 46 („2024-10-28_Reply Defence to revo-
cation FRAND - Dolby_D170655VLU01 - signed.pdf - Pleading - German - Redacted version availa-
ble”) und die Nr. 70 und 74 der Auflistung der Antragstellerin („Duplik_rechtlich_Frand - Pleading
– German“), sowie in die in der Auflistung genannten Anlagen ist zur Erfüllung des oben dargeleg-
ten spezifischen Interesses nicht erforderlich. Bei dem Schriftsatz Nr. 75 handelt es sich um eine
Doppelnennung im Vergleich zur Nr. 71.
Weil die Akteneinsicht somit ausschließlich in bestimmte Schriftsätze zu gewähren ist, kommt es nicht mehr darauf an, dass es sich bei einem Teil der von der Antragstellerin verlangten Unterlagen nicht um Schriftsätze und Beweismittel im Sinne von R. 262.2(b) VerfO handelt, worauf die Klägerin zu Recht hinweist.
d) Soweit es die praktische Umsetzung der Akteneinsicht angeht, greift die Lokalkammer Düsseldorf den Ansatz der Lokalkammer Mannheim (UPC_CFI_210/2023, Anordnung v. 26. März 2025 – Pa-nasonic v. OPPO) auf. Im eigenen Interesse der Klägerin wird dieser daher aufgegeben, von den redacted versions der genannten Schriftsätze weitergehend geschwärzte Versionen im oben dar-gestellten Umfang zu erstellen und dieser der Antragstellerin auf einem verschlüsselten Datenträ-ger (USB) oder über Zugriff auf einen verschlüsselten Online-Datenraum zur Verfügung zu stellen.
e) Über den ausdrücklich hilfsweise gestellten Antrag zu III. der Antragstellerin war nicht zu entschei-den. Es ist dem Vorbringen der Antragstellerin bereits nicht zu entnehmen, unter welchen Voraus-setzungen über den Hilfsantrag zu entscheiden ist.
ANORDNUNG:
Die Antragstellerin erhält – unter Zurückweisung ihrer weitergehenden Anträge – Zugang zu den redacted versions der nachfolgend genannten Schriftsätze der Klägerin und der Beklag-ten in dem Verfahren UPC_CFI_135/2024, ACT_15136/2024, wobei der Klägerin aufgegeben wird, diese bis auf die Erwägungen zur Auslegung und zum Rechtsbestand des Streitpatents weiter zu schwärzen und der Antragstellerin sodann auf einem verschlüsselten Datenträger (USB) oder über Zugriff auf einen verschlüsselten Online-Datenraum zur Verfügung zu stel-len:

BRIEF STATEMENT OF THE FACTS:
The plaintiff is suing the defendants before the Düsseldorf Regional Court for infringement of European patent EP 3 605 534 (hereinafter: the contested patent), which it claims is essential for the Opus Audio Codec. The action is directed against all televisions and all other electronic devices of the defendants that use the operating system ‘Android TV’ in version 5.0 or a subsequent version (hereinafter: contested embodiment). The defendants contest the infringement allegation and raise the FRAND objection. They have also filed a counterclaim for annulment. The patent in dispute was not the subject of earlier legal proceedings.
Both in the infringement proceedings and in the proceedings concerning the counterclaim for annulment (hereinafter referred to collectively as the main proceedings), the pleadings referred to in R. 12 VerfO have been exchanged. An order pursuant to R. 35 VerfO to close the written proceedings has not yet been issued.
The plaintiff is suing the applicant before the Local Chamber in Hamburg for infringement of the patent in dispute. The action is directed against the projectors (video projectors) sold by the applicant and all other electronic devices that use the ‘Android TV’ operating system in version 5.0 or a subsequent version. According to its statements, the applicant intends to defend itself against the infringement allegation and, if necessary, to file a counterclaim for annulment of the patent in dispute. The deadline for filing a statement of defence and a possible counterclaim for annulment before the Hamburg Local Chamber is 7 May 2025.

II. Insofar as the pleadings, exhibits and evidence referred to in section I contain information subject to confidentiality and the parties have submitted redacted versions accordingly, only these redacted versions of the documents shall be submitted to the applicant;
alternatively,
III. to grant the applicant access to all pleadings submitted to the court in the context of the counterclaim for annulment and recorded by the law firm, together with the annexes and evidence.
The applicant requests that
I. the applications under I. to III. be dismissed;
alternatively,
II. to grant the applicant, in accordance with its application under II., access only to the redacted version of the pleadings and evidence subject to confidentiality in order to protect the parties' interests in confidentiality;
III. to order the applicant to treat the pleadings and evidence made available to it as confidential until the proceedings have been finally concluded.
MAIN POINTS OF DISPUTE:
The applicant submits that the interpretation of the patent claims put forward by the plaintiff and the defendants in the main proceedings is relevant to its own submissions in the proceedings before the Hamburg Local Chamber. Since the patent in suit has not yet undergone any proceedings to determine its legal validity, this also applies to the plaintiff's arguments put forward in the context of the legal validity proceedings. The plaintiff's responses to the state of the art submitted by the defendants could also influence the applicant's search strategy based on the prior art. It is also possible that it may refrain from bringing a counterclaim for annulment if the submissions of the parties to the main proceedings indicate that there is a sufficient likelihood that the contested patent is valid.
The plaintiff is of the opinion that the application is already inadmissible insofar as it relates to documents that are neither written pleadings nor evidence. Its interests, specifically its interest in the integrity of the proceedings still pending at first instance, outweigh the interest asserted by the applicant. Access to confidential information, which the applicant itself does not request, would also be contrary to confidentiality interests. It should be clarified that although the subject matter of the proceedings before the Hamburg Local Chamber is the same patent, different products are affected and the applicant has not even begun to demonstrate the technical and functional comparability of the products. Even if one were to assume that the applicant has a direct interest within the meaning of the case law of the Court of Appeal, this would be offset by the exceptionally high risk of jeopardising the integrity of the proceedings. For example, the arguments exchanged in connection with the defendant's FRAND objection concerned, among other things, the out-of-court communication between the parties. Furthermore, the plaintiff and the administrator of the Opus patent pool, Vectis, were still seeking to license the disputed patent to the

Defendants. An argument adjusted by the applicant in the parallel proceedings following inspection of the files – which the Defendants would then also be able to inspect – could create an incentive for the Defendants to continue to refuse a licence without reason. Furthermore, there is a risk of indirect price fixing if the defendants in both proceedings coordinate their conduct in the licence negotiations with the applicant or with Vectis, because mutual inspection of the files would give them insight into the financial offers of the respective party as well as into the negotiation strategies and specific features of the respective individual case. The situation would be comparable to a so-called ‘licensing negotiation group’ (LNG), in which users of standardised technologies join forces to negotiate licence agreements with SEP holders, and which would give rise to considerable antitrust concerns.
The defendants did not make use of the opportunity granted to them to comment.
REASONS FOR THE ORDER:
The applicant's request pursuant to R. 262.1(b) VerfO is admissible and partially justified.
1. As a member of the public, the applicant has submitted a reasoned request within the meaning of R. 262.1(b) VerfO. A reasoned application in this sense is an application which not only specifies the documents and evidence to which access is sought, but also states the purpose of the application and explains why access to the specified documents is necessary for that purpose, thus providing all the information the rapporteur needs in order to carry out the necessary balancing of interests (CoA_404/2023, decision of 10 April 2024, para. 44 – Ocado v. Autostore; CoA_480/2024, decision of 9 January 2025, para. 10 – Abbott v. Powell Gilbert). The applicant's application of 14 February 2025 meets these requirements and is therefore admissible. In particular, the application explains why, in the applicant's view, access to the files is necessary and for what purpose it is sought.
Whether an interest is demonstrated in relation to all or only some of the documents to which access is requested is not, however, a question of the existence of a well-founded application and thus of admissibility. The question of whether all the documents referred to by the applicant are written pleadings and evidence within the meaning of R. 262.1(b) VerfO is also only relevant in the context of the merits of the application (see UPC_CFI_75/2023 (ZK Munich), order of 22 August 2024 – Astellas v. Healios).
2. The application is partially successful on the merits.
a) When deciding on an application under Rule 262.1(b) VerfO, the interests of a member of the public in obtaining access to the documents requested must be weighed against the interests referred to in Article 45 EPGÜ. These interests include the protection of confidential information and personal data (‘the interests of one of the parties or other persons concerned’), but are not limited to these. The general interests of the judiciary and public order must also be taken into account. The general interest of the judiciary includes the protection of the integrity of proceedings. Public order is endangered, for example, if an application is

is abusive or if security interests are at stake (CoA_404/2023, decision of 10 April 2024, para. 43 – Ocado v. Autostore; CoA_480/2024, decision of 9 January 2025, para. 10 et seq. – Abbott v Powell Gilbert; CFI_342/2024 (LK Munich), order of 20 December
2024, para. 16 – Phoenix Contact v I.L.M.E.).
aa) Once the court has issued a decision or order concluding the proceedings at first instance, the public generally has an interest in the documents and evidence being made available. This allows for a better understanding of the decision taken in light of the arguments put forward by the parties and the evidence relied upon. It also enables the court to be monitored, which is important for public confidence in the court (CoA_404/2023, decision of 10 April 2024, para. 47 – O-cado v. Autostore; CoA_480/2024, decision of 9 January 2025, para. 13 et seq. – Abbott v. Powell Gilbert; CFI_75/2023 (ZK Munich), order of 22 August 2024 – Astellas v. Healios; CFI_255/2023 (ZK Paris), order of 14 October 2024, para. 17 ff. – Meril v. Edwards; CFI_14/2023 (ZK Munich), order of 22 October 2024 – Regeneron v. Amgen; CFI_252/2023 (ZK Munich), order of 3 January 2025 – NanoString v. Harvard College). This principle applies, as the Court of Appeal ruled in Abbott v. Powell Gilbert (CoA_480/2024, decision of 9 January 2025, para. 2), regardless of whether
- an appeal against the decision or order is pending,
- the order issued concerns an application for interim measures (R. 206 VerfO),
- the information and evidence are also the subject of other proceedings, for example because they concern the same patent or patents of the same patent family, and
- the first-instance decision deals with all arguments and evidence in the case.
bb) A member of the public may also have a more specific interest in the pleadings and evidence in a particular case than the general interest mentioned above. This applies in particular if the member of the public has a direct interest in the subject matter of the proceedings, such as the legal validity of a patent which also affects him as a competitor or licensee, or if a party in the case is accused of infringing a patent by a product which is identical or similar to a product which has been or is to be placed on the market by the member of the public. If a member of the public has such a direct legitimate interest in the subject matter of certain proceedings, this interest does not arise only after the proceedings have been concluded, but may well exist immediately (UPC_CoA_404/2023, decision of 10 April 2024, para. 53 – Ocado v. Autostore; UPC_CFI_342/2024 (LK Munich), order of 20 December 2024, para. 17 – Phoenix Contact v. I.L.M.E.; UPC_CFI_33/2024 (LK Vienna), order of 12 August 2024 – Swarco v. Strabag).
b) The balancing of interests to be carried out in application of these principles shows that the applicant must be granted access to the files, albeit to a limited extent.

aa) The applicant has demonstrated a specific interest in inspecting the files, which already exists during the ongoing proceedings. However, the specific interest only concerns part of the documents to which the applicant is seeking access, which is why access should only be granted to that extent.
(1) The applicant's specific interest relates to the parties' arguments concerning the interpretation and legal status of the contested patent. In this respect, the applicant has demonstrated that it has a direct interest of its own in the submissions made by the parties before the Local Chamber in Düsseldorf for the purposes of its own case before the Local Chamber in Hamburg and for the decision on whether a counterclaim for annulment is admissible. In particular, it must be taken into account that the proceedings pending before the Hamburg Local Chamber, in which the applicant itself is a party on the defendant's side, also concern the patent in dispute.
To this extent, the balancing of interests to be carried out also shows that the applicant's interest must be given priority. The plaintiff has not demonstrated any particular interests in confidentiality in this regard. It has merely emphasised that the applicant should only be granted access to the redacted versions of the written pleadings, which is what the applicant wants anyway (see the applicant's application under II.). Nor has the plaintiff raised any specific objections to the inspection of the files in this connection.
(2) However, the applicant has not demonstrated any specific interest beyond this.
This applies, on the one hand, to the parties' arguments in the main proceedings on the question of infringement, i.e. the realisation of all the features of the contested patent by the contested embodiment. The application does not provide sufficient information to identify a specific interest on the part of the applicant. The applicant does occasionally refer to the arguments put forward in the main proceedings regarding non-infringement or infringement (see para. 20, 24). However, it only provides detailed reasons for its interest in the parties' interpretations. The mere fact that both the televisions challenged before the Local Chamber in Düsseldorf and the projectors challenged before the Local Chamber in Hamburg use the “Android TV” operating system in version 5.0 or a subsequent version is not sufficient to justify a specific interest in the infringement considerations. The applicant does not address this issue in more detail. Against this background, the plaintiff's objection that the applicant did not sufficiently demonstrate the technical and functional comparability of the products is irrelevant.
On the other hand, the parties' arguments in the main proceedings concerning the FRAND objection also fail to demonstrate a specific interest. The applicant's statement of reasons does not reveal any interest on its part in obtaining such information. In contrast, the plaintiff has expressed considerable reservations about disclosure, particularly in view of the arguments exchanged in this area.
Finally, there is no specific interest in other issues that were not discussed by the applicant and the plaintiff in connection with the access to the files but which could play a role in the requested documents (e.g. questions of standing to sue).

bb) The applicant cannot invoke a general interest in comprehensive access to the files beyond the scope outlined above. According to the principles outlined above, such an interest generally only arises after the conclusion of the proceedings at first instance. The applicant has not demonstrated that this could be different in this case, nor is this apparent.
c) Against this background, the applicant must be granted access to the written submissions listed in her application under I. that are apparent from the order, insofar as they contain statements on the legal status and/or interpretation of the contested patent.
Access to further written submissions, in particular No. 46 ("2024-10-28_Reply Defence to revo-
cation FRAND - Dolby_D170655VLU01 - signed.pdf - Pleading - German - Redacted version available
‘) and Nos. 70 and 74 of the applicant's list (‘Duplik_rechtlich_Frand - Pleading
– German’), as well as the annexes referred to in the list, is not necessary to fulfil the above-mentioned
specific interest set out above. Pleading No. 75 is a
duplicate entry compared to No. 71.
Since access to the files is therefore to be granted exclusively to certain written submissions, it is no longer relevant that some of the documents requested by the applicant are not written submissions and evidence within the meaning of R. 262.2(b) VerfO, as the applicant rightly points out.
d) As far as the practical implementation of access to the files is concerned, the Düsseldorf Local Chamber follows the approach of the Mannheim Local Chamber (UPC_CFI_210/2023, order of 26 March 2025 – Panasonic v. OPPO). In the applicant's own interest, it is therefore ordered to prepare further redacted versions of the aforementioned pleadings to the extent described above and to make these available to the applicant on an encrypted data carrier (USB) or via access to an encrypted online data room.
e) No decision was made on the applicant's expressly alternative request under III. It is not clear from the applicant's submission under what conditions a decision on the alternative request is to be made.
ORDER:
The applicant is granted access to the redacted versions of the following pleadings of the plaintiff and the defendant in the proceedings UPC_CFI_135/2024, ACT_15136/2024, rejecting the applicant's further requests, whereby the plaintiff is ordered to redact these documents, except for the considerations on the interpretation and legal status of the contested patent, and then make them available to the applicant on an encrypted data carrier (USB) or via access to an encrypted online data room:
