LEITSÄTZE:
1. Der Antrag eines Antragstellers gem. R. 191 Alt. 2 VerfO, der Berichterstatter möge feststellen, dass die im Antrag gem. Art. 191 Alt. 2 VerfO begehrten Informationen nicht entscheidungserheblich sind, ist unzulässig.
2. Ein solcher Antrag verbunden mit der Rücknahme des Antrags gem. R. 191 Alt. 2 VerfO unter der Bedingung, dass das Gericht die mangelnde Entscheidungserheblichkeit feststellt, ist regelmäßig dahin auszulegen, dass der Antrag gem. R. 191 Alt. 2 VerfO selbst unter die Bedingung gestellt wird, dass es auf die begehrten Informationen entscheidungserheblich ankommt.
3. Eine solche Bedingung ist als innerprozessuale Bedingung zulässig, selbst wenn die Informationsübermittlung gem. R. 191 Alt. 2 VerfO von einem am Rechtsstreit nicht beteiligten Dritten verlangt wird.

GEGENSTAND: R. 191 VerfO
SACHVERHALT:
Die Klägerinnen nehmen die Dritte in einem Nebenverfahren zum zwischen ihnen und den Beklagten geführten Hauptverfahren UPC_CFI_471/2023 auf die Übermittlung von Informationen gem. R. 191 Alt. 2 VerfO in Anspruch (App_50861/2024). Die Beklagten und die Dritte sind der begehrten Informationsübermittlung entgegengetreten, die Dritte unter Vorbehalt weiterer Ausführungen nach Erhalt von Akteneinsicht in die Akte des Hauptverfahrens. Zuvor hatte die Dritte zum Zweck der Rechtsverteidigung gegen den Antrag auf Informationsübermittlung einen Antrag gem. R. 262.1 lit. b) und R.262.3 VerfO auf Akteneinsicht in die Akte des Hauptverfahrens gestellt und dabei auch Zugang zu den gem. R. 262A VerfO durch Zugangsbeschränkung geschützten vertraulichen, angegriffene Ausführungsformen betreffenden Informationen der Beklagten für die Prozessbevollmächtigten und zwei namentlich benannte natürliche Personen der Dritten unter Auferlegung von Geheimhaltungspflichten begehrt (App_10340/2025, App_10341/2025).
Mit Schriftsatz vom 12.03.2025 (App_12073/2025) haben die Klägerinnen beantragt, festzustellen, dass die in ihrem Antrag auf Informationsübermittlung von der Dritten begehrten Informationen nicht entscheidungserheblich sind, und den Antrag gegen die Dritte unter der Bedingung, dass das Gericht die mangelnde Entscheidungserheblichkeit feststellt, zurückgenommen und vorsorglich mit Blick auf eine mögliche Anwendbarkeit der R. 265.1 VerfO beantragt, die Rücknahme zuzulassen. Ferner haben sie beantragt, die am 18.03.2025 ablaufende Frist für eine Stellungnahme auf die Erwiderungen der Beklagten und der Dritten zum Antrag gem. R. 191 VerfO bis zum 08.04.2025 zu verlängern. Am 18.03.2025 haben die Klägerinnen im dazu aus technischen Gründen eingerichteten Ersatzworkflow ORD_10992/2025 vorsorglich eine Stellungnahme zu den vorgenannten Erwiderungen eingereicht, in der sie ihre Anträge auf Übermittlung von Informationen durch die Dritte vorsorglich neu gefasst haben, aber nicht von ihrem Begehren aus dem Schriftsatz vom 12.03.2025 abgerückt sind.
Die Beklagten sind der beantragten Akteneinsicht der Dritten entgegengetreten. Mit einem weiteren Schriftsatz vom 18.03.2025 (App_10341/2025) beantragen die Klägerinnen in verlängerter Stellungnahmefrist (vgl. App_11142/2025) insoweit, die Entscheidung über die Akteneinsicht der Dritten zurückzustellen bis zur Entscheidung über ihren Antrag zur Feststellung der fehlenden Entscheidungserheblichkeit der von der Dritten verlangten Informationen und sodann bei fehlender Entscheidungserheblichkeit die Akteneinsicht zurückzuweisen. Im Fall, dass ihrem Antrag zur fehlenden Entscheidungserheblichkeit nicht stattgegeben wird oder bereits

zuvor eine Entscheidung über die Akteneinsicht ergehen sollte, erheben die Klägerinnen keine Einwände gegen eine Akteneinsicht in die geschwärzte Fassung der Akte, verwahren sich jedoch gegen einen (nicht begehrten) Zugang zu ihren vertraulichen, nicht die angegriffenen Ausführungsformen betreffenden Informationen gem. R. 262A VerfO unter Berufung auf schlechthin fehlende Relevanz und verweisen hinsichtlich der Akteneinsicht im Übrigen auf die Stellungnahme der Beklagten.
Dem Antrag der Klägerinnen auf Fristverlängerung für die Stellungnahme zu den Erwiderungen der Beklagten und der Dritten auf den Antrag gem. R. 191 VerfO ist lediglich die Dritte entgegengetreten (vgl. für die Stellungnahme aus technischen Gründen eröffneter Workflow zu ORD_12307/2025). Die Beklagten und die Dritte haben ihrerseits eine Verlängerung der auf den 26.03.2025 gesetzten Frist (ORD_12307/2025) zur Stellungnahme zu dem Schriftsatz der Klägerinnen vom 12.03.2025 mit dem Antrag auf Feststellung der fehlenden Entscheidungserheblichkeit der begehrten Informationen beantragt (App_13923/2025 und App_14402/2025). Über sämtliche vorgenannten Fristverlängerungsanträge ist noch nicht entschieden worden. Die Beklagten haben mit Schriftsatz vom 26.03.2025 unter Aufrechterhaltung ihres Fristverlängerungsantrags vorläufig auf den vorgenannten Schriftsatz der Klägerinnen vom 12.03.2025 im dafür aus technischen Gründen eingerichteten Ersatzworkflow ORD_12307/2025 erwidert.
GRÜNDE DER ANORDNUNG:
Der Antrag der Klägerinnen, die fehlende Entscheidungserheblichkeit der von der Dritten verlangten Informationen festzustellen, ist unzulässig, jedoch dahin auszulegen, dass das Verlangen nach Informationsübermittlung nur unter der zulässigen Bedingung gestellt wird, dass die bisherigen Darlegungen der Klägerinnen zur Begründung einer Patentverletzung nicht ausreichen. Eine solcher Antrag führt im Streitfall zur Zurückstellung der Entscheidung über das Verlangen nach Informationsübermittlung bis zur Entscheidung des Spruchkörpers über die Patentverletzung auf der Grundlage des in der mündlichen Verhandlung erreichten Sach- und Streitstands. Entsprechend wird auch der Antrag der Dritten auf Akteneinsicht zurückgestellt.
1. Der Antrag eines Antragstellers gem. R. 191 Alt. 2 VerfO, der Berichterstatter möge feststellen, dass die im Antrag gem. Art. 191 Alt. 2 VerfO begehrten Informationen nicht entscheidungserheblich sind, ist unzulässig.
Die begehrten Informationen sind nur dann entscheidungserheblich, wenn sich das Klagepatent nach der mündlichen Verhandlung als rechtsbeständig erweisen und die bisherigen Ausführungen der Klägerinnen aufgrund des Fehlens der mit der beantragten Informationsübermittlung begehrten und gebotenen Informationen zur Darlegung einer Patentverletzung nicht ausreichen. Für die Vorab-Feststellung der fehlenden Entscheidungserheblichkeit durch den Berichterstatter haben die Klägerinnen jedenfalls kein Rechtsschutzbedürfnis, weil eine solche Feststellung den Spruchkörper nicht binden würde. Letztendlich begehren die Klägerinnen vorab eine positive Festlegung durch den Berichterstatter, dass ihr bisheriger Vortrag hinreichend für die Bejahung einer Patentverletzung ist, was indes der Entscheidung im Hauptsacheverfahren zu überlassen ist. Abgesehen von der fehlenden Bindungswirkung ist für die begehrte Vorab-Feststellung durch den Berichterstatter zudem keine Grundlage ersichtlich.
2. Ein solcher Antrag verbunden mit der Rücknahme des Antrags gem. R. 191 Alt. 2 VerfO unter der Bedingung, dass das Gericht die mangelnde Entscheidungserheblichkeit feststellt, ist jedoch regelmäßig dahin auszulegen, dass der Antrag gem. R. 191 Alt. 2 VerfO unter die

Bedingung gestellt wird, dass es auf die begehrten Informationen entscheidungserheblich ankommt. Abweichende Anhaltspunkte, die ein anderes Ergebnis rechtfertigen, sind im Streitfall nicht ersichtlich.
Die Auslegung des Begehrens der Klägerinnen als bedingten Antrag auf Informationsübermittlung durch die Dritte trägt ihrem Ansinnen Rechnung, sich mit dem Antrag dagegen abzusichern, dass ihr bisheriges Vorbringen entgegen ihrer eigenen Rechtsauffassung nicht zur Begründung einer Patentverletzung ausreicht, sondern hierfür weitere Informationen erforderlich sind, über die nach ihrer Ansicht die Dritte verfügt.
3. Ein solcher hilfsweiser Antrag auf Informationsübermittlung gem. R. 191 Alt. 2 VerfO scheitert nicht an einer Bedingungsfeindlichkeit des Antrags.
Insbesondere steht nicht entgegen, dass mit ihm ein bedingtes Prozessrechtsverhältnis zwischen dem Antragsteller und dem Dritten begründet würde. Bei einem Antrag auf Informationsübermittlung – ebenso bei einem Antrag auf Vorlage von Beweismitteln – handelt es sich unabhängig davon, ob er sich gegen eine andere Partei des Rechtsstreits oder gegen einen Dritten richtet, lediglich um eine prozessuale Maßnahme, die auf prozessualen Befugnisse des Gerichts beruht. Soweit ein Verbot der bedingten Klageerhebung besteht, gilt dieses für solche prozessualen Maßnahmen nicht. Vielmehr ist es Anträgen zur Informationsverschaffung wie auch zur Beweiserhebung und der vorgelagerten Beweisbeschaffung immanent, dass sie von den Parteien auch fürsorglich für den Fall gestellt werden können, dass die bisher vorgetragenen Tatsachen oder die bisher vorgelegten Beweismittel entgegen ihrer Einschätzung zur Rechtsverfolgung oder Rechtsverteidigung nicht ausreichen. Gegen eine solche innerprozessuale Bedingung bestehen keine Bedenken. Selbst ohne eine solche ausdrückliche Bedingung steht es im pflichtgemäßen Ermessen des Berichterstatters, ob er begehrten Informations- oder Beweisermittlungen – für die Beweissicherung mögen aufgrund der Dringlichkeit andere Maßstäbe mit Blick auf die Entscheidungserheblichkeit gelten – nachgeht, deren Entscheidungserheblichkeit noch nicht feststeht (vgl. zum Ermessen des Berichterstatters mit Blick auf die Festlegung der Reihenfolge, in der über Streitpunkte entschieden wird, Berufungsgericht, Anordnung vom 24.09.2024, UPC_CoA_298/2024, UPC_CoA_299/2024, UPC_CoA_300/2024 Rn. 54 f.). Dies gilt umso mehr, als der Spruchkörper an eine vom Berichterstatter angenommene fehlende oder bestehende Entscheidungserheblichkeit nicht gebunden ist. Dementsprechend sieht R. 114 VerfO vor, dass der Spruchkörper die mündliche Verhandlung ausnahmsweise vertagen und weitere Beweise erheben kann. Dies gilt auch, wenn sich fehlende Informationen, die Gegenstand eines Antrags auf Informationsübermittlung gegen einen Dritten sind, auf der Grundlage des Ergebnisses der mündlichen Verhandlung als entscheidungserheblich erweisen.
4. Da die Entscheidungserheblichkeit der begehrten Informationen erst mit dem Ergebnis der mündlichen Verhandlung feststeht, führt der so verstandene Antrag der Klägerinnen zur Zurückstellung der Entscheidung über die lediglich bedingt begehrte Informationsermittlung gem. R. 191 Alt. 2 VerfO. Für den Fall, dass der Antrag anders zu verstehen sollte, übt der Berichterstatter sein Ermessen dahingehend aus, die Entscheidung über die Informationsermittlung entsprechend zurückzustellen. In beiden Fällen stehen die weiteren zwischen den Parteien umstrittenen Punkte einer Zurückstellung nicht entgegen.
a) Insbesondere kann die zwischen den Parteien umstrittene Frage dahinstehen, ob eine Anordnung der Informationsübermittlung durch einen Dritten gem. R. 191 Alt. 2 VerfO voraussetzt, dass der Dritte einen Gerichtsstand im Forumstaat hat. Selbst wenn ein ggf.

erforderlicher internationaler Gerichtstand in einem grenzüberschreitenden Fall wie dem vorliegenden nach der Brüssel Ia Verordnung nicht gegeben sein sollte, schlösse dies eine Informationsübermittlung nicht von vorneherein aus. Allenfalls müsste dann – ebenso wie bei einem Antrag auf Vorlage von Beweismitteln – im Fall der Gewährbarkeit der Informationsübermittlung nach dem Verfahrensrecht des EPG die Durchführung im Wege der internationalen Rechtshilfe ersucht werden, falls der Dritte außerhalb des Gebiets der EPG-Mitgliedstaaten ansässig ist. Diese Fragen müssen indes nicht abschließend geklärt werden, solange die Entscheidungserheblichkeit der begehrten Informationen nicht feststeht.
b) Entgegen der Auffassung der Beklagten und der Dritten fehlt es für die Vorschrift R. 191 Alt. 2 VerfO nicht an der erforderlichen Grundlage im EPGÜ. Vielmehr ist die in R. 191 Alt. 2 VerfO vorgesehene Informationsübermittlung als milderes Mittel durch eine Gesamtbetrachtung der Vorschriften der Art. 59, 60, 43, 41 (1), 41(2) EPGÜ gedeckt. Da der Antragsteller über eine zu beweisende Tatsache nicht letzte Gewissheit haben muss, dienen die Vorlage von Beweismitteln gem. Art. 59 EPGÜ und die Maßnahmen der Beweissicherung und der Inspektion von Räumlichkeiten gem. Art. 60 EPGÜ neben der Beweisgewinnung bzw. -sicherung auch der Informationsbeschaffung. Ihre Beschränkung auf Fälle der reinen Beweisnot, bei denen der Antragsteller die zugrundeliegende Information bereits sicher kennt, wird ihrem Wortlaut nicht gerecht, der auf die Vorlage ausreichender Beweismittel für eine aufgestellte Behauptung bzw. geltend gemachte Ansprüche, nicht aber zusätzlich auf die subjektive Gewissheit und Kenntnis des Antragstellers von der zu beweisenden Tatsache abstellt. Diese Fragen müssen indes ebenfalls nicht abschließend geklärt werden, solange die Entscheidungserheblichkeit der begehrten Informationen nicht feststeht.
c) Dies gilt auch für alle weiteren zwischen den Beteiligten umstrittenen Fragen. Ein Anspruch, eine Entscheidung über den Antrag gem. R. 191 Alt. 2 VerfO vor Klärung der Entscheidungserheblichkeit der begehrten Informationen zu erhalten, besteht regelmäßig nicht. Erst Recht besteht er nicht, wenn der Antragsteller klar und eindeutig zu erkennen gibt, dass er seinen Antrag nicht unbedingt stellt, sondern von der Entscheidungserheblichkeit der begehrten Informationen abhängig macht, wie bei zutreffender Auslegung mit Schriftsatz vom 12.03.2025 geschehen.
d) Da durch eine Informationsübermittlung in die Rechte des Dritten eingegriffen wird, spricht dies ebenfalls dafür, hierüber erst bei Entscheidungserheblichkeit der begehrten Informationen zu entscheiden.
5. Über den Antrag aus dem Schriftsatz der Klägerinnen vom 12.03.2025 konnte ohne (abschließende) Anhörung der Beklagten und der Dritten entschieden werden. Der Antrag auf Feststellung der fehlenden Entscheidungserheblichkeit ist wie ausgeführt unzulässig. Mit Blick auf die Zurückstellung der Entscheidung über den Antrag gem. R. 191 Alt. 2 VerfO ist das Gericht zum einen an die zulässige Bedingung gebunden. Zum anderen werden durch die Zurückstellung der Entscheidung über den Antrag auf Informationsübermittlung die Rechte der Beteiligten nicht beeinträchtigt. Wie ausgeführt, besteht ein Anspruch auf Entscheidung vor feststehender Entscheidungserheblichkeit der begehrten Informationen nicht.
6. Weil die Entscheidung über den Antrag gem. R. 191 Alt. 2 VerfO aus den genannten Gründen zurückgestellt wird, bedürfen die noch offenen Fristverlängerungsanträge keiner Entscheidung. Aus dem gleichen Grund bedarf der Antrag auf Akteneinsicht der Dritten

derzeit keiner Entscheidung. Auf diese Begehren wird u.U. zurückzukommen sein, sofern die begehrten Informationen entscheidungserheblich sein sollten.
ANORDNUNG:
1. Der Antrag der Klägerinnen, der Berichterstatter möge feststellen, dass die im Antrag gem. Art. 191 Alt. 2 VerfO begehrten Informationen nicht entscheidungserheblich sind, wird zurückgewiesen.
2. Die Entscheidung über den Antrag der Klägerinnen gem. Art. 191 Alt. 2 VerfO auf Übermittlung von Informationen durch die Dritte wird zurückgestellt, sofern er nicht ohnehin zulässig unter der Bedingung der feststehenden Entscheidungserheblichkeit der begehrten Informationen gestellt sein sollte.
3. Die Entscheidung über den Antrag der Dritten auf Akteneinsicht wird zurückgestellt.
4. Die Entscheidung über die Fristverlängerungsanträge der Beteiligten wird zurückgestellt.

The plaintiffs are claiming against the third party in ancillary proceedings to the main proceedings between them and the defendants, UPC_CFI_471/2023, for the transmission of information pursuant to Rule 191(2) of the Rules of Procedure (App_50861/2024). The defendants and the third party have opposed the requested transfer of information, the third party subject to further comments after inspection of the file in the main proceedings. Previously, for the purpose of defending itself against the request for transmission of information, the third party had filed a request pursuant to Rule 262.1(b) and Rule 262.3 VerfO for access to the file of the main proceedings, including access to the defendant's confidential information relating to the contested embodiments protected by access restrictions pursuant to Rule 262A VerfO, for the representatives and two named natural persons. R. 262A VerfO, which were protected by access restrictions, for the legal representatives and two named natural persons of the third party, subject to confidentiality obligations (App_10340/2025, App_10341/2025).
By written submission dated 12 March 2025 (App_12073/2025), the plaintiffs requested that the information sought by the third party in its request for information transfer not be deemed relevant to the decision and that the request against the third party be withdrawn on the condition that the court finds that the information is not relevant to the decision and, as a precautionary measure with a view to the possible applicability of R. 265.1 VerfO, that the withdrawal be allowed. They also requested that the deadline for submitting comments on the responses of the defendant and the third party to the application pursuant to Rule 191 VerfO, which expires on 18 March 2025, be extended until 8 April 2025. On 18 March 2025, the plaintiffs submitted a statement on the aforementioned responses as a precautionary measure in the substitute workflow ORD_10992/2025 set up for technical reasons, in which they recast their requests for the third party to provide information as a precautionary measure, but did not withdraw their request made in the written submission of 12 March 2025.
The defendants opposed the third party's request for access to the files. In a further written submission dated 18 March 2025 (App_10341/2025), the plaintiffs request, within the extended deadline for submitting comments (see App_11142/2025), the decision on the third party's access to the files be postponed until a decision has been made on their application for a declaration that the information requested by the third party is not relevant to the decision and, if the information is not relevant, that access to the files be refused. In the event that their application for a declaration of irrelevance is not granted or

the plaintiffs do not object to access to the redacted version of the file, but object to (unrequested) access to their confidential information not relating to the contested forms of execution pursuant to R. 262A VerfO, citing a complete lack of relevance, and refer to the defendant's statement regarding access to the files.
Only the third party opposed the plaintiffs‘ request for an extension of the deadline for responding to the defendants’ and the third party's replies to the application pursuant to R. 191 VerfO (see the workflow opened for technical reasons for the statement on ORD_12307/2025). The defendants and the third party, for their part, have requested an extension of the deadline set for 26 March 2025 (ORD_12307/2025) for commenting on the plaintiffs' written statement of 12 March 2025 with the request for a declaration that the requested information is not relevant to the decision (App_13923/2025 and App_14402/2025). 5 and App_14402/2025). No decision has yet been made on any of the above requests for an extension of the deadline. In their written statement of 26 March 2025, the defendants provisionally responded to the aforementioned written statement of the plaintiffs of 12 March 2025 in the substitute workflow ORD_12307/2025 set up for technical reasons, while maintaining their application for an extension of the deadline.
REASONS FOR THE ORDER:
The plaintiffs‘ request to establish that the information requested by the third party is not relevant to the decision is inadmissible, but must be interpreted as meaning that the request for information is only admissible on the condition that the plaintiffs’ previous statements are insufficient to substantiate a patent infringement. In the event of a dispute, such an application leads to the postponement of the decision on the request for the provision of information until the decision of the court on the patent infringement on the basis of the facts and the state of the dispute as established in the oral proceedings. Accordingly, the third party's application for access to the files is also postponed.
1. The request of an applicant pursuant to Rule 191(2) VerfO that the rapporteur determine that the information requested in the application pursuant to Article 191(2) VerfO is not relevant to the decision is inadmissible.
The requested information is only relevant to the decision if, after the oral hearing, the patent in suit proves to be legally valid and the plaintiffs' previous submissions are insufficient to establish patent infringement due to the lack of the information requested and required in the request for disclosure. In any case, the plaintiffs have no legal interest in a preliminary ruling by the rapporteur on the lack of relevance to the decision, because such a ruling would not be binding on the panel. Ultimately, the plaintiffs are seeking a preliminary ruling by the rapporteur that their previous submissions are sufficient to establish patent infringement, which is, however, a matter for the decision in the main proceedings. Apart from the lack of binding effect, there is also no apparent basis for the preliminary ruling sought by the rapporteur.

However, such an application, combined with the withdrawal of the application pursuant to Rule 191(2) VerfO on the condition that the court finds that the information is not relevant to the decision, must generally be interpreted as meaning that the application pursuant to Rule 191(2) VerfO is subject to the

that the information sought is relevant to the decision. There are no other indications in the case at hand that would justify a different conclusion.
The interpretation of the plaintiffs' request as a conditional request for the transfer of information by the third party takes into account their intention to safeguard themselves against the possibility that, contrary to their own legal opinion, their previous submissions are not sufficient to establish patent infringement, but that further information is required for this purpose, which, in their opinion, is available to the third party.
3. Such an alternative request for the transfer of information pursuant to Rule 191(2) VerfO does not fail due to the request being conditional.
In particular, it is not precluded by the fact that it would establish a conditional procedural legal relationship between the applicant and the third party. A request for the transfer of information – as well as a request for the production of evidence – is, regardless of whether it is directed against another party to the legal dispute or against a third party, merely a procedural measure based on the procedural powers of the court. Insofar as there is a prohibition on bringing a conditional action, this does not apply to such procedural measures. Rather, it is inherent in applications for the provision of information, as well as for the taking of evidence and the prior gathering of evidence, that they can also be made by the parties as a precautionary measure in case the facts presented or the evidence submitted to date are insufficient for the pursuit or defence of their legal claims, contrary to their assessment. There are no objections to such an intra-procedural condition. Even without such an express condition, it is within the discretion of the reporting judge to decide whether to pursue requested information or evidence – for the preservation of evidence, different standards may apply with regard to the relevance of the evidence due to the urgency of the case – whose relevance for the decision has not yet been established (see on the discretion of the rapporteur with regard to determining the order in which points at issue are decided, Court of Appeal, order of 24 September 2024, UPC_CoA_298/2024, UPC_CoA_299/2024, UPC_CoA_300/2024, para. 54 et seq.). This applies all the more so as the panel is not bound by the rapporteur's assumption that a point is irrelevant or relevant for the decision. Accordingly, Rule 114 of the Rules of Procedure provides that the panel may, in exceptional cases, adjourn the oral hearing and take further evidence. This also applies if missing information that is the subject of a request for information to be provided by a third party proves to be relevant to the decision on the basis of the outcome of the oral hearing.
4. Since the relevance of the requested information for the decision is only determined with the outcome of the oral hearing, the plaintiffs' request, as understood above, leads to the postponement of the decision on the merely conditionally requested information gathering pursuant to Rule 191 Alt. 2 VerfO. In the event that the application is to be understood differently, the rapporteur exercises his discretion to defer the decision on the disclosure of information accordingly. In both cases, the other points disputed between the parties do not preclude a deferral.
a) In particular, the question disputed between the parties as to whether an order for the disclosure of information by a third party pursuant to Rule 191 Alt. 2 VerfO requires that the third party has a place of jurisdiction in the forum state. Even if a

international place of jurisdiction required in a cross-border case such as the present one were not to exist under the Brussels Ia Regulation, this would not preclude the transfer of information from the outset. At most, as in the case of a request for the production of evidence, if the transfer of information is possible under the procedural law of the EPG, international legal assistance would have to be requested if the third party is located outside the territory of the EPG Member States. However, these questions do not need to be conclusively clarified as long as the relevance of the requested information for the decision is not established.
b) Contrary to the opinion of the defendant and the third parties, the provision in Rule 191(2) of the Rules of Procedure does not lack the necessary basis in the EPGÜ. Rather, the transfer of information provided for in R. 191 Alt. 2 VerfO is covered as a less severe measure by an overall assessment of the provisions of Articles 59, 60, 43, 41(1) and 41(2) EPGÜ. Since the applicant does not have to have absolute certainty about a fact to be proven, the submission of evidence pursuant to Art. 59 EPGÜ and the measures for securing evidence and inspecting premises pursuant to Art. 60 EPGÜ serve not only to obtain or secure evidence but also to gather information. Their restriction to cases of pure lack of evidence, in which the applicant already has certain knowledge of the underlying information, is not in line with their wording, which refers to the submission of sufficient evidence for an assertion made or claims asserted, but not additionally to the subjective certainty and knowledge of the applicant regarding the fact to be proven. However, these questions do not need to be clarified conclusively as long as the relevance of the requested information to the decision is not established.
c) This also applies to all other questions disputed between the parties. There is generally no right to obtain a decision on the application pursuant to Rule 191(2) VerfO before the relevance of the requested information to the decision has been clarified. This is all the more so if the applicant clearly and unambiguously indicates that he is not necessarily submitting his application, but is making it dependent on the relevance of the requested information, as was correctly interpreted in the written submission of 12 March 2025.
d) Since the transfer of information would interfere with the rights of third parties, this also argues in favour of only deciding on this issue once the requested information is relevant to the decision.
5. The application in the plaintiffs' written statement of 12 March 2025 could be decided without a (final) hearing of the defendant and the third parties. The application for a declaration of lack of relevance to the decision is inadmissible as explained above. With regard to the postponement of the decision on the application pursuant to Rule 191(2) VerfO, the court is bound by the admissible condition. Furthermore, the postponement of the decision on the application for the transfer of information does not prejudice the rights of the parties involved. As stated, there is no right to a decision before the relevance of the requested information to the decision has been established.
6. Because the decision on the application pursuant to Rule 191(2) VerfO is deferred for the reasons stated, the pending applications for extension of time do not require a decision. For the same reason, the application for access to the files by the third party

does not currently require a decision. These requests may have to be revisited if the requested information should prove to be relevant to the decision.
ORDER:
1. The plaintiffs' request that the rapporteur determine that the information requested in the application pursuant to Art. 191 Alt. 2 VerfO is not relevant to the decision is rejected.
2. The decision on the plaintiffs' application pursuant to Art. 191 Alt. 2 VerfO for the transfer of information by the third party is postponed, unless it is admissible in any case on the condition that the requested information is relevant to the decision.
3. The decision on the third party's application for access to the files is postponed.
4. The decision on the parties' applications for an extension of the time limit is postponed.
