SACHVERHALT
Die Antragstellerin, eine Partnerschaft von Rechtsanwälten nach deutschem Recht mit Spezialisierung im Gewerblichen Rechtsschutz, begehrt Zugang zu sämtlichen Schriftsätzen und Beweismitteln, welche die Parteien bei Gericht eingereicht haben und die von der Kanzlei aufgenommen worden sind, insbesondere folgende Schriftstücke:
und/oder hilfsweise
sämtliche verfahrensrelevante Schriftsätze und Beweismittel, die beim Gericht eingereicht und von der Kanzlei aufgenommen worden sind, insbesondere die oben aufgeführten Schriftstücke, mit gemäß R. 262.1 geschwärzten persönlichen Informationen und/oder gemäß R. 262.2 VerfO unkenntlich gemachten vertraulichen Informationen, zugänglich zu machen;
und oder hilfsweise der Antragstellerin besondere Geheimhaltungspflichten aufzuerlegen.
Hierzu beruft sie sich auf ein allgemeines Informationsinteresse, um ein besseres Verständnis und Erkenntnisgewinne über Verfahren vor dem EPG zu erlangen. Zudem arbeite eine der Rechtsanwältinnen der Antragstellerin an einem Kommentar zum Einheitspatent mit und habe daher ein konkretes wissenschaftliches Informationsinteresse. Die Interessenabwägung falle zugunsten der Antragstellerin aus, zumal das Verfahren mittlerweile abgeschlossen sei.
Die Klägerin tritt dem Antrag entgegen und beantragt ihn zurückzuweisen, wohingegen die Beklagten keine Stellungnahme eingereicht haben.
Die Anträge seien zu unbestimmt, das allgemeine Informationsinteresse könne die Antragstellerin über die Entscheidungssammlung des Gerichts befriedigen, zumal im konkreten Fall die Endentscheidung sehr umfänglich und nur minimal redigiert sei. Überdies stelle die Antragstellerin gleichlautende Anträge bei verschiedenen Kammern des EPG, ohne dass ein besonderes Interesse ersichtlich sei. Ein konkretes wissenschaftliches Interesse sei lediglich mit Blick auf die Kommentierung der angestellten Anwältin zum Sprachenregime im EPG ersichtlich und hierauf zu beschränken. Schließlich sei der Aufwand für die Parteien unverhältnismäßig, um im vorliegenden Großverfahren die relevanten Schriftstücke herauszufiltern, was nicht zuletzt an dem Workflow-System des CMS und seiner Fehleranfälligkeit liege. Allenfalls akzeptabel sei eine händische Zusammenstellung der Schriftsätze in pdf-Form und beschränkt auf die redacted versions. Eine automatisierte Einsichtnahme über das CMS trage die immense Gefahr in sich, dass versehentlich hochsensible Informationen zugänglich gemacht würden.
Hierauf hat die Antragstellerin ihren Antrag wie folgt durch einen Hilfsantrag ergänzt:
ENTSCHEIDUNGSGRÜNDE
1. Vor dem Hintergrund der Leitlinien, die das Berufungsgericht in der Entscheidung UPC_CoA_404/2023 entwickelt hat, ist unter Abwägung des mit der Einsichtnahme verbundenen Aufwands für die Parteien in dem vorliegenden, an Komplexität und Umfang am äußersten Ende des bisherigen Verfahrensspektrums vor dem UPC liegenden Falles die Einsicht einstweilen auf den zuletzt im Schriftsatz vom 11. März 2025 gestellten Hilfsantrag zu beschränken. Ein etwaiges sodann immer noch bestehendes, weitergehendes Interesse mag sodann konkret geltend gemacht werden.
2. Eine umfängliche Einsichtnahme in sämtliche Schriftstücke über das CMS war aufgrund der Vielzahl an Fehlerquellen des CMS, die in der kaum mehr überschaubaren Anzahl an Workflows, die die Parteien während der Verfahrensführung aufgrund der technischen Struktur des CMS anlegen mussten, nicht zu verantworten, zumal es im Laufe des Verfahrens mehrfach zu Systemfehlern kam und daher nicht sichergestellt werden kann, dass eine Einsicht bei Freigabe über das System tatsächlich nur die zur Freigabe vorgesehenen Schriftstücke umfasst. Ferner hat die Klägerin auf mehrere Eingaben verwiesen, die Geheimnisse enthalten, für die jedoch wohl keine korrespondierenden, indes technisch nötigen Geheimnisschutzworkflows existieren. Daher musste vorliegend im eigenen Interesse der Klägerin, die sich allein zum vorliegenden Antrag geäußert und Geheimhaltungsinteressen geltend gemacht hat, der Partei aufgegeben werden, die in der Anordnung aufgeführten Schriftstücke aus dem CMS als pdf zu extrahieren und auf einem verschlüsselten Datenträger oder Datenraum zur Verfügung zu stellen. Um den damit verbundenen Aufwand zu beschränken, hatte die einstweilen nur beschränkte Stattgabe zu erfolgen.
3. Im gewährten Umfang rechtfertigt indes das von der Antragstellerin dargelegte allgemeine Informationsinteresse an der Verfahrensführung vor dem UPC sowie auch das konkret dargetane Interesse, an wissenschaftlichen Publikationen zum EPG – wenn auch hier zunächst beschränkt auf einen vereinzelten Aspekt – mitzuwirken, in der Gesamtabwägung die Einsichtnahme im stattgebenden Umfang.
ENTSCHEIDUNG:
1. Dem Antrag der Antragstellerin auf Einsichtnahme in die Verfahrensakte wird einstweilen im nachfolgenden Umfang stattgegeben, wobei der Klägerin aufgegeben wird, der Antragstellerin die redacted versions der nachfolgend eingeblendeten Schriftstücke auf einem verschlüsselten Datenträger (USB) oder über Zugriff auf einen verschlüsselten Online- Datenraum zur Verfügung zu stellen:

FACTS
The applicant, a partnership of lawyers under German law specialising in intellectual property law, seeks access to all written pleadings and evidence submitted by the parties to the court and recorded by the law firm, in particular the following documents:

all procedural documents and evidence submitted to the court and recorded by the law firm, in particular the documents listed above, with personal information redacted in accordance with Rule 262.1 and/or confidential information rendered unrecognisable in accordance with Rule 262.2 VerfO;
and/or, alternatively, to impose special confidentiality obligations on the applicant.
In this regard, it invokes a general interest in information in order to gain a better understanding and insight into proceedings before the EPG. In addition, one of the applicant's lawyers is working on a commentary on the unitary patent and therefore has a specific scientific interest in the information. The balance of interests is in favour of the applicant, especially since the proceedings have now been concluded.
The applicant opposes the application and requests that it be dismissed, whereas the defendants have not submitted any observations.
The applications are too vague, and the applicant can satisfy the general interest in information through the court's collection of decisions, especially since the final decision in this specific case is very comprehensive and only minimally redacted. Furthermore, the applicant has filed identical applications with different chambers of the EPG without any apparent special interest. A specific scientific interest is only apparent with regard to the comments made by the lawyer employed by the applicant on the language regime in the EPG and should be limited to this. Finally, the effort required of the parties to filter out the relevant documents in the present large-scale proceedings is disproportionate, not least because of the workflow system of the CMS and its susceptibility to errors. At most, a manual compilation of the pleadings in PDF form and limited to the redacted versions would be acceptable. Automated access via the CMS carries the immense risk that highly sensitive information could be made accessible by mistake.
The applicant supplemented its application with the following auxiliary application:
REASONS FOR THE DECISION
1. Against the background of the guidelines developed by the Court of Appeal in its decision UPC_CoA_404/2023, taking into account the effort involved for the parties in the present case, which is at the extreme end of the procedural spectrum before the UPC in terms of complexity and scope, in terms of complexity and scope, at the extreme end of the spectrum of proceedings before the UPC to date, access should be provisionally restricted to the alternative request made most recently in the written submission of 11 March 2025. Any further interest that may still exist may then be asserted in concrete terms.
2. Extensive inspection of all documents via the CMS was not justifiable due to the numerous sources of error in the CMS, which were caused by the almost unmanageable number of workflows that the parties had to create during the proceedings due to the technical structure of the CMS, especially since system errors occurred several times in the course of the proceedings and it cannot therefore be ensured that, if released via the system, access would actually only cover the documents intended for release. Furthermore, the plaintiff referred to several submissions containing secrets for which, however, there are apparently no corresponding, yet technically necessary, confidentiality protection workflows. Therefore, in the present case, in the interests of the plaintiff, who was the only party to comment on the present application and assert confidentiality interests, the party was required to extract the documents listed in the order from the CMS as PDF files and make them available on an encrypted data carrier or data room. In order to limit the associated effort, the application was granted only to a limited extent for the time being.
3. However, to the extent granted, the general interest in the proceedings before the UPC as presented by the applicant, as well as the specific interest in contributing to scientific publications on the EPG – albeit initially limited to a single aspect – justify, on balance, access to the extent granted.
DECISION:
1. The applicant's request for access to the case file is granted for the time being to the extent set out below, whereby the plaintiff is ordered to provide the applicant with redacted versions of the documents listed below on an encrypted data carrier (USB) or via access to an encrypted online data room:
