SACHVERHALT UND ANTRÄGE
Die Klägerin zu 1 nimmt die Beklagte wegen behaupteter Verletzung des EP 3 215 288 betreffend eine Metallsinterzubereitung in Deutschland, Italien und Frankreich in Anspruch (ACT_13227/2024 UPC_CFI_114/2024). Die Beklagten verteidigen sich unter anderem mit einem betrieblichen Vorbenutzungsrecht. In der gegen die Klägerin zu 2 als noch eingetragene Patentinhaberin gerichteten Nichtigkeitswiderklage (CC_43919/2024 UPC_CFI_448/2024) macht sie darüberhinausgehend auf der Grundlage des betrieblichen Vorbenutzungsrechts auch eine offenkundige Vorbenutzung geltend.
I. Berichtigung
In der Anordnung vom 2. Dezember 2024 (App_54645/2024) hat die Kammer unter dem Punkt „Korrektur des Aktivrubrums“ ausgeführt:
Die Widerbeklagte im Nichtigkeitswiderklageverfahren (Klägerin zu 2) CC_43919/2024 ist gem. R. 25.1, 42.2, 305.1 (c) VerfO durch die Klägerin (zu 1) zu ersetzen. Da die Beklagte hiergegen keine Einwände vorgebracht hat, kann auf die Begründung des Antrags verwiesen werden.
Der vorsorglich erhobene Einspruch der Klägerinnen ist daher jedenfalls unbegründet und zurückzuweisen.
Im Tenor findet sich aber keine entsprechende Anordnung. Dies gilt es zu berichtigen. Die Parteien wurden angehört.
Heraeus hat ausgeführt:
Zur beabsichtigten Korrektur der Anordnung vom 02.12.2024 (Austausch der Widerbeklagten) erübrigt sich nach den Gründen der Anordnung vom 25.09.2024 (Passivlegitimation der bisherigen Widerbeklagten) eine weitere Stellungnahme.
Vibrantz hat ausgeführt:
Der Ersetzungsantrag vom 7. Oktober 2024 wurde „namens der Widerbeklagten sowie der Klägerin“ gestellt. Gem. Regel 42.2 VerfO kann lediglich der eingetragene Inhaber (engl. Fassung: „…each such registered proprietor shall as soon as practicable after service of the Statement for revocation apply to Court…“) einen Ersetzungsantrag stellen. Der Antrag der – nicht eingetragenen – Klägerin ist daher zurückzuweisen. 2 In Bezug auf den Ersetzungsantrag der Widerbeklagten merken wir lediglich an, dass
dieser erst zwei Monate nach der Zustellung der Nichtigkeitswiderklage gestellt wurde, obschon die Übertragung des Klagepatents bereits vor der Erhebung der Verletzungsklage erfolgt sein soll (vgl. Regel 42.2 „so bald wie möglich“). Die Entscheidung über die Ersetzung, die Bindung der in die Widerklage eintretenden Klägerin an den bisherigen Verfahrensstand und die Kosten stellen wir in das Ermessen des Gerichts.
II. absolutes Verfahrenshindernis
In App_2369/2025 hat Heraeus beantragt:
Das Gericht entscheidet im Wege der Anordnung, dass der Fortführung des Verfahrens, soweit es gegen den deutschen Teil der EP 3 215 288 gerichtet ist, aufgrund entgegenstehender Rechtskraft ein absolutes Verfahrenshindernis entgegensteht.
Zur Begründung hat Heraeus ausgeführt:
Die Nichtigkeitswiderklage missachtet mit Blick auf den deutschen Teil des Streitpatents die entgegenstehende Rechtskraft des vorangehenden nationalen Nichtigkeitsurteils und ist damit unzulässig. Der Fortführung des Verfahrens steht insoweit ein absolutes Verfahrenshindernis entgegen.
Vibrantz hat beantragt:
Der Antrag wird zurückgewiesen.
Wir beantragen insoweit vorsorglich, die Anerkennung der Entscheidung des Bundespatentgerichts gem. Art. 45 Abs. 1 lit. a) EuGVVO für eine Entscheidung des Gerichts über den aufrechterhaltenen Teil des Streitpatents zu versagen.
Zur Begründung hat Vibrantz u.a. ausgeführt:
Die Entscheidung des Bundespatentgerichts stelle keine rechtskräftige Entscheidung im Sinne eines absoluten Verfahrenshindernis gem. R. 362 VerfO dar.
Der Berichterstatter hat hierzu am 30. Januar 2025 Hinweise erteilt.
Heraeus beantragt:
Wir beantragen insoweit den Antrag der Widerklägerin (SSTZ v. 30.01.2025, Rn. 27) zurückzuweisen.
Zur Begründung hat Heraeus ausgeführt:
Vorab ist mit Blick auf den Hinweis des Gerichts Folgendes festzuhalten: Wann das Gericht über den Antrag in App_2369/2025 entscheidet, liegt selbstverständlich im Ermessen des Gerichts. Soweit jedoch – eine antragsgemäße Entscheidung und entsprechende Berufung der Widerklägerin unterstellt – Letztere aufgrund einheitlicher Verhandlung zur Verzögerung des Verletzungsverfahrens führen sollte, scheint der
Widerbeklagten eine Entscheidung noch vor der mündlichen Verhandlung nicht angezeigt.
Vibrantz hat hierzu ausgeführt:
Im Übrigen ist eine Entscheidung über den Antrag gem. Regel 362 VerfO im Sinne einer gesamtheitlichen Prüfung und einer möglichen Berufung mit anschließender Zurückverweisung und Abtrennung aus der Sicht der Nichtigkeitsklägerin nicht angezeigt.
GRÜNDE
Zu I:
Die Anordnung vom 2. Dezember 2024 ist im Tenor gem. Regel 353 VerfO dadurch zu berichtigen, dass eine der Begründung entsprechende Anordnung eingefügt wird. Dies wurde im Dezember schlicht übersehen.
Zu II:
Eine Entscheidung noch vor der mündlichen Verhandlung würde wegen Regel 363.2 VerfO den weiteren Fortgang des Verfahrens gefährden. Denn eine Klärung durch das Berufungsgericht dürfte nicht vor dem 1. Juli 2025, dem Tag des Haupttermins, zu erzielen sein. Da beide Parteien letztendlich befürworten, eine einheitliche Verhandlung im Haupttermin nicht zu gefährden, übt die Kammer ihr Ermessen dahingehend aus, über den Antrag erst im Anschluss an den Haupttermin zu befinden.
ANORDNUNG
I. Der Tenor der Anordnung vom 2. Dezember 2024 (App_54645/2024) wird wie folgt ergänzt: „10. Die Widerbeklagte im Nichtigkeitswiderklageverfahren (Klägerin zu 2) CC_43919/2024 ist durch die Klägerin (zu 1) zu ersetzen.“ Die bisherige Ziffer 10 wird zur Ziffer 11 und lautet wie folgt: „Die Berufung wird zugelassen.“
II. Über den Antrag nach Regel 362 VerfO (App_2369/2025) wird die Kammer im Anschluss an den Haupttermin befinden.
INFORMATION ÜBER DIE BERUFUNG, WENN ES SICH UM EINE ANORDNUNG NACH ART. 73 (2) (B) EPGÜ HANDELT:
Gegen die vorliegende Anordnung kann entweder
- durch jede Partei, die ganz oder teilweise in ihren Anträgen erfolglos war, zusammen mit der Berufung gegen die Endentscheidung des Gerichts erster Instanz in der Hauptsache Berufung eingelegt werden, oder
- nach Zulassung der Berufung durch das Gericht erster Instanz binnen 15 Tagen nach Zustellung der entsprechenden Entscheidung Berufung durch jede Partei, die ganz oder teilweise in ihren Anträgen erfolglos war, eingelegt werden (Art. 73 (2) (b) EPGÜ, R. 220.2, 224.1 (b) VerfO)
ANWEISUNGEN AN DIE KANZLEI
Die Anordnung vom 2. Dezember 2024 (App_54645/2024) ist entsprechend zu berichtigen. Die Widerbeklagte im Nichtigkeitswiderklageverfahren (Klägerin zu 2) CC_43919/2024 ist durch die Klägerin (zu 1) zu ersetzen.

FACTS AND CLAIMS
The first plaintiff is suing the defendant for alleged infringement of EP 3 215 288 concerning a metal sinter preparation in Germany, Italy and France (ACT_13227/2024 UPC_CFI_114/2024). The defendants defend themselves, inter alia, with a prior right of use in the course of trade. In the counterclaim for annulment brought against the second plaintiff as the registered patent proprietor (CC_43919/2024 UPC_CFI_448/2024), it also asserts obvious prior use on the basis of the right of prior use in the course of business.
I. Correction
In its order of 2 December 2024 (App_54645/2024), the Chamber stated under the heading ‘Correction of the active heading’:
The counter-defendant in the nullity counterclaim proceedings (plaintiff 2) CC_43919/2024 is to be replaced by the plaintiff (1) pursuant to Rules 25.1, 42.2, 305.1 (c) VerfO. Since the defendant did not raise any objections to this, reference can be made to the grounds for the application.
The plaintiffs' precautionary objection is therefore unfounded in any case and must be dismissed.
However, no corresponding order is found in the operative part. This must be corrected. The parties were heard.
Heraeus stated:
According to the reasons given in the order of 25 September 2024 (passive legal standing of the previous counter-defendants), no further statement is necessary regarding the intended correction of the order of 2 December 2024 (replacement of the counter-defendants).
Vibrantz stated:
The application for replacement dated 7 October 2024 was filed ‘on behalf of the counter-defendants and the plaintiff’. According to Rule 42.2 VerfO, only the registered proprietor (‘...each such registered proprietor shall as soon as practicable after service of the Statement for revocation apply to Court...’) may file a request for substitution. The request of the – unregistered – plaintiff must therefore be rejected.
2 With regard to the counterclaimants' application for substitution, we merely note that it was filed only two months after the counterclaim for annulment was served, even though the transfer of the patent in suit is said to have taken place before the infringement action was brought (see Rule 42.2 ‘as soon as practicable’).
We leave the decision on the substitution, the binding nature of the plaintiff entering the counterclaim to the previous state of the proceedings and the costs to the discretion of the court.
II. Absolute bar to proceedings
In App_2369/2025, Heraeus requested:
The court orders that the proceedings, insofar as they are directed against the German part of EP 3 215 288, are barred by a final and binding decision.
In support of its application, Heraeus stated:
The counterclaim for annulment disregards the conflicting legal force of the previous national annulment judgment with regard to the German part of the contested patent and is therefore inadmissible. In this respect, there is an absolute procedural obstacle to the continuation of the proceedings.
Vibrantz requested that:
The application be dismissed.
As a precautionary measure, we request that the decision of the Federal Patent Court be refused recognition pursuant to Art. 45(1)(a) of the Brussels I Regulation for a decision by the court on the upheld part of the contested patent.
In support of its application, Vibrantz has argued, inter alia, that
the decision of the Federal Patent Court does not constitute a final decision within the meaning of an absolute procedural obstacle pursuant to Rule 362 of the Rules of Procedure.
The rapporteur issued a statement on this matter on 30 January 2025.
Heraeus requests:
We request that the counterclaimant's application (SSTZ of 30 January 2025, para. 27) be dismissed.
In support of its request, Heraeus stated:
First of all, with regard to the court's statement, the following should be noted: It is, of course, at the discretion of the court to decide when it will rule on the application in App_2369/2025. However, insofar as – assuming a decision in accordance with the application and a corresponding appeal by the counterclaimant – the latter should lead to a delay in the infringement proceedings due to uniform proceedings, the
counterclaimant does not consider a decision before the oral hearing to be appropriate.
Vibrantz stated the following in this regard:
Furthermore, a decision on the application pursuant to Rule 362 VerfO in the sense of a comprehensive review and a possible appeal with subsequent referral back and separation is not appropriate from the perspective of the plaintiff seeking annulment.
REASONS
Re I:
The order of 2 December 2024 is to be corrected in accordance with Rule 353 VerfO by inserting an order corresponding to the grounds. This was simply overlooked in December.
Re II:
A decision before the oral hearing would jeopardise the further course of the proceedings due to Rule 363.2 VerfO. This is because clarification by the appeal court is unlikely to be achieved before 1 July 2025, the date of the main hearing. Since both parties ultimately agree not to jeopardise a uniform hearing on the main date, the Chamber exercises its discretion to decide on the application only after the main hearing.
ORDER
I. The operative part of the order of 2 December 2024 (App_54645/2024) is supplemented as follows: ‘10. The counter-defendant in the action for annulment (plaintiff 2) CC_43919/2024 is to be replaced by the plaintiff (1).’ The previous paragraph 10 becomes paragraph 11 and reads as follows: ‘The appeal is allowed.’
II. The Chamber will rule on the application pursuant to Rule 362 VerfO (App_2369/2025) following the main hearing.
INFORMATION ON APPEALS IN THE CASE OF AN ORDER PURSUANT TO ART. 73 (2) (B) EPGÜ:
An appeal may be lodged against this order either
- by any party that has been unsuccessful in whole or in part in its claims, together with the appeal against the final decision of the court of first instance on the main issue, or

The order of 2 December 2024 (App_54645/2024) is to be corrected accordingly. The counterclaimant in the nullity counterclaim proceedings (claimant 2) CC_43919/2024 is to be replaced by the claimant (claimant 1).
