I. PROCEDURELE ACHTERGROND
1. In de procedurele beschikking van 7 oktober 2024 heeft het Gerecht partijen (i.e. NV CRETES (hierna
“CRETES)(eiser in de inbreukvordering (UPC_CFI_216/2024) en verweerder in de tegenvordering
strekkende tot nietigverklaring (UPC_CFI_556/2024)) en BV HYLER (hierna: "HYLER")(verweerder in
de inbreukvordering (UPC_CFI_216/2024) en eiser in de tegenvordering strekkende tot
nietigverklaring (UPC_CFI_556/2024)) geïnformeerd dat de datum van de Statement of Defence (16
september 2024) als determinerend zou worden beschouwd en verzocht partijen om stelling in te
nemen omtrent het stroomlijnen van de inbreukprocedure (UPC_CFI_216/2014) en de
nietigheidsprocedure (UPC_CFI_556/2024).
2. Volgende schrijvens werden op 26 oktober 2024 overgemaakt aan het Gerecht:
• uitgaande van HYLER: “De partijen stemmen er tevens mee in dat de datum van kennisgeving
van de “Statement of Defence” in de inbreukprocedure, met name 16 september 2024, als
determinerend wordt beschouwd voor de termijnen in de nietigheidsprocedure.”
• uitgaande van CRETES: “Vooreerst bevestigen de partijen dat zij akkoord gaan met het feit dat
de datum van kennisgeving door de UPC van de “Statement of Defence” in de inbreukprocedure,
met name 16 september 2024, als determinerend wordt beschouwd voor de termijn voor zowel
de “Reply to the Statement of Defence” als voor “Defence to the Counterclaim for Revocation”.
3. Op 15 november 2024, een vrijdagavond, om 22u 22 (zie CMS-registratie) laadde CRETES haar
“Reply to the Statement of Defence” (UPC_CFI_216/2024) op in het CMS. Uit het CMS zal verder
blijken dat de “Defence to the Counterclaim for Revocation” (UPC_CFI_556/2024) pas op 22
november 2024 (15.24u) werd opgeladen in het CMS. HYLER zal vervolgens op 16 januari 2024 haar
Rejoinder to the Reply to the Statement of defence (UPC_CFI_216/2024) en de Reply to the Defence
to the Counterclaim for Revocation (procedure UPC-CFI_556/2024) opladen in het CMS.
4. Op 11 februari 2025 diende CRETES onderhavig algemeen procedureel verzoek in (R. 9 RoP)
(verzoeknummer (en workflow) App_6987/2025).
5. Het verzoek strekt er in hoofdorde toe om de Rejoinder to the Reply to the Statement of defence
(UPC_CFI_216/2024) en de Reply to the Defence to the Counterclaim for Revocation (procedure
UPC-CFI_556/2024) uit de debatten te werden aangezien neergelegd op 16 januari 2025 i.p.v. 15
januari 2025 en dit in toepassing van R. 29(d) RoP (juncto R. 300 (c) RoP.
6. Verder (en ondergeschikt) strekt onderhavig verzoek ertoe om (minstens) de randnummers 506 tot
510 van de Rejoinder to the Reply to the Statement of defence (UPC_CFI_216/2024) en de Reply to
the Defence to the Counterclaim for Revocation (procedure UPC-CFI_556/2024) van HYLER uit de
debatten te weren en meer concreet het volgende onderdelen:(i) de nieuwe aangebrachte niet-
inbreukargumentatie op basis van nieuwe varianten van de FL20, (ii) nieuw stuk I.21 van (HYLER)
en (iii) de nieuwe vordering tot vaststelling van niet-inbreuk van (HYLER). De rechtsgrond die
hieromtrent wordt ingeroepen betreft Preambule 7 van de RoP juncto R. 24(e) tot (h) RoP en R.
29(e) RoP.
7. Uiterst ondergeschikt verzoekt CRETES op haar een bijkomende termijn toe te kennen als
“bijkomende antwoordmogelijkheid” ter bescherming van de rechten van verdediging. Dit verzoek
wordt gegrond op de toepassing van R. 36 RoP.
8. Alvorens een voorlopige beschikking af te wachten van het Gerecht diende HYLER als verweer op
het verzoek van CRETES een algemeen procedureel R. 9 RoP in op 13 februari 2025. Dit verzoek
werd het verzoeknummer (en workflow) App_7312/2025 toegewezen.
9. Op 15 februari 2025 werd bij voorlopige beschikking HYLER bevolen om haar verweer op het
verzoek van CRETES op te laden in de workflow App_6987/2025 en dit uiterlijk op maandag 17
februari 2025 (16u), waarna partijen werden ingelicht dat het Gerecht vervolgens zou overgaan tot
het uitvaardigen van een eindbeschikking in zowel App_6987/2025 als App_7312/2025.
10. HYLER gaf gevolg aan dit bevel van het Gerecht, hetgeen deze toelaat over te gaan tot beoordeling
van het verzoek.
11. Op 17 februari 2025 diende CRETES een nieuw algemeen procedureel verzoek (R. 9 RoP) in dat het
verzoeknummer (en workflow) App_7916/2025 werd toegewezen. Dit verzoek betreft een
antwoord op het verweer van HYLER (weergegeven in App_7312/2025). In haar voorlopige
beschikking van 15 februari 2025 heeft de JR naast het bevel aan HYLER om dit verweer op te laden
in App_6987/2025 aangegeven dat hij na uitvoering ervan zou overgaan tot eindbeschikking. Het
Gerecht legt het nieuwe R. 9 RoP verzoek naast zich neer, en laat de daarin vervatte stellingen
buiten beschouwing in het licht van de voorlopige beschikking van 15 februari 2025, waarin CRETES
geen mogelijkheid werd geboden om nader stelling te nemen.
II. VORDERINGEN EN ARGUMENTATIE
12. Het verzoek van CRETES strekt formeel tot het volgende
• In hoofdorde:
de Rejoinder to the Reply to the Statement of defence inclusief de Reply to the Defence to the
Counterclaim for Revocation van (HYLER) uit de debatten te weren.
• In ondergeschikte orde:
te zeggen voor recht dat (i) de nieuwe aangebrachte niet-inbreukargumentatie op basis van
nieuwe varianten van de FL20, (ii) nieuw stuk I.21 van (HYLER) en (iii) de nieuwe vordering tot
vaststelling van niet-inbreuk van (HYLER) (…); en bijgevolg randnummers 506-510 van de Re-
joinder to the Reply to the Statement of defence inclusief de Reply to the Defence to the Coun-
terclaim for Revocation, stuk I.21 van (HYLER) en de nieuwe vordering tot vaststelling van niet-
inbreuk van (HYLER) uit de debatten te weren.
• In uiterst ondergeschikte orde:
een bijkomende antwoordmogelijkheid aan Verzoekster toe te kennen om te kunnen
antwoorden op de nieuwe niet-inbreukargumentatie en -vordering en bijhorend stuk I.21 van
(HYLER), teneinde haar rechten van verdediging te vrijwaren.
13. In haar verweer argumenteerde/vorderde HYLER als volgt:
• In hoofdorde: de vordering van (CRETES) tot wering uit de debatten van de Rejoinder to the
Reply to the Statement of defence inclusief de Reply to the Defence to the Counterclaim for
Revocation van (HYLER) als ongegrond te verklaren;
• In ondergeschikte orde: de termijn voor de neerlegging van de Rejoinder to the Reply to the
Statement of defence inclusief de Reply to the Defence to the Counterclaim for Revocation van
(HYLER) retroactief te verlengen met één dag, rekening houdend met de beginselen van eer-
lijkheid, billijkheid en proportionaliteit;
• Tevens in hoofdorde: de vordering van (CRETES) tot wering uit de debatten van randnummers
506-510 van de Rejoinder to the Reply to the Statement of defence inclusief de Reply to the
Defence to the Counterclaim for Revocation, stuk 1.21 van (HYLER) en de nieuwe vordering tot
vaststelling van niet-inbreuk van (HYLER) als ongegrond te verklaren;
• In ondergeschikte orde: (CRETES) een bijkomende termijn van één week te geven om te ant-
woorden op randnummers 506-510 van de Rejoinder to the Reply to the Statement of defence
inclusief de Reply to the Defence to the Counterclaim for Revocation, stuk 1.21 van (HYLER) en
de nieuwe vordering tot vaststelling van niet-inbreuk van (HYLER);
• In uiterst ondergeschikte orde: indien de vorderingen van (HYLER) zoals opgenomen in deze
brief worden afgewezen, (HYLER) de mogelijkheid te geven om, al dan niet via het CMS-plat-
form, een officiële reactie in te dienen op het algemeen procedureel verzoek van (CRETES); en
• In ieder geval: voor zover nodig en technisch mogelijk, dit algemeen procedureel verzoek op
te nemen op het CMS-platform als (preliminaire) reactie op het algemeen procedureel verzoek
van (CRETES).
III. MOTIVERING VAN DE BESCHIKKING
III.1. Omtrent het verzoek tot wering uit de debatten van “Rejoinder to the Reply to the Statement of
Defence” (UPC_CFI_216/2024) en de “Reply to the Defence to the Counterclaim for Revocation”
(procedure UPC-CFI_556/2024)
III.1.1. Briefwisseling tussen de raadslieden van HYLER en CRETES omtrent procedure-agenda
14. Allereerst ziet het Gerecht (i.e LD Brussel oordelend als kamer) zich verplicht om in zijn beoordeling
gebruik te maken van de briefwisseling uitgewisseld tussen de raadslieden. Het Gerecht is zich
bewust dat dergelijke briefwisseling als confidentieel dient beschouwd te worden doch bij gebreke
aan een bevoegde stafhouder en/of Orde van Advocaten op UPC niveau, die eventueel beslissing
zou kunnen nemen omtrent de gemaakte afspraken tussen haar leden op basis van confidentiële
briefwisseling en een deontologie, ziet het Gerecht zich verplicht om tot een beoordeling over te
gaan gebruik makende van deze confidentiële briefwisseling. Het Gerecht zal zich hierbij beperken
tot de feitelijk gegevens die werden aangehaald (zonder te citeren uit de confidentiële
briefwisseling).
15. Uit de confidentiële briefwisseling tussen de raadslieden, concreet een eerste ontwerp vanwege de
raadslieden van HYLER, blijkt dat deze aan de JR wenste een concrete conclusieagenda over te
maken. In deze voorgestelde conclusieagenda werd weliswaar melding gemaakt van
opeenvolgende termijnen na het neerleggen van bepaalde schriftelijke argumentatie, doch werd
deze geconcretiseerd door het duiden van volgende data:
• 16 november 2024 voor CRETES voor het neerleggen van haar “Defence to the
Counterclaim” samen met de “Reply to the Statement of Defence” en desgevallend een
“Application to amend the patent”.
• 16 januari 2025 voor HYLER voor het neerleggen “Reply to the Defence to the Counterclaim”
samen met de “Rejoinder to the Reply to the Statement of Defence” en desgevallend
“Defence to an Application to amend the patent”.
• 16 februari 2025 voor CRETES voor de “Rejoinder to the Reply to the Defence to the
Counterclaim” desgevallend samen met een “Reply to the Defence to an Application to
amend the patent.
16. Bovenvermelde agenda werd op zich niet betwist. CRETES zal wel stellen dat zij geen meerwaarde
zag in het weergegeven van de concrete conclusieagenda en om deze reden werd deze dan ook
weggelaten in de communicatie aan de JR.
17. In het licht van het bovenstaande oordeelt het Gerecht dat tussen partijen afstand werd gedaan
van een wettelijke (conclusie-)termijnregeling weergegeven in de RoP en vervangen door een
concrete (datum-gerelateerde en niet termijn-gerelateerde) conclusie-agenda.
18. Dergelijke overeengekomen conclusie-agenda kan worden toegestaan door het Gerecht indien
deze niet substantieel afwijkt van de wettelijke (termijn-gerelateerde) conclusie-agenda
weergegeven in de regels (RoP). De tussen partijen overeengekomen conclusieagenda ligt volstrekt
in lijn met de wettelijke (termijn-gerelateerde) procedure-agenda gezien enkel de (wettelijke)
uiterste termijndatum voor het neerleggen van conclusies werd overeengekomen. Op geen enkel
ogenblik wordt hierdoor de procedure-agenda op zich ter beoordeling van de zaak in gevaar
gebracht.
19. Het feit dat CRETES haar “Defence to the Counterclaim” samen met de “Reply to the Statement of
Defence” op 15 november 2024 neerlegde i.p.v. 16 november 2024 doorkruist deze afspraken niet.
20. Verder dient erop gewezen dat de “Reply to the Statement of Defence” in UPC_CFI_556/2024 door
CRETES pas in het CMS werd opgeladen op 22 november 2024 (15.24u) waaromtrent HYLER
blijkbaar nooit een punt heeft gemaakt (en op zich 7 dagen te laat was). In de strikte lezing van
CRETES zou dit dan ook kunnen betekenen dat dit laattijdig was en alleszins HYLER de mogelijkheid
zou hebben gegeven om te antwoorden tot 22 januari 2025.
III.1.2. Volledigheidshalve, de omstandigheden van het geval verantwoorden de (formele) toepassing van
R. 29 RoP niet en de vorderingen tot wering van de “Rejoinder to the Reply to the Statement of
defence” (UPC_CFI_216/2024) en de “Reply to the Defence to the Counterclaim for Revocation”
(procedure UPC-CFI_556/2024) evenmin.
21. Het Gerecht merkt op dat CRETES haar “Defence tot he Counterclaim” samen met de “Reply to the
Statement of Defence” op 15 november 2024 (in UPC_CFI_216/2024) heeft opgeladen in het CMS
op een vrijdagavond om 22.22u (zie tevens hierboven omtrent het opladen ervan in
UPC_CFI_556/2024). Dit betreft 1u 44min voorafgaandelijk de voorziene termijn in de RoP. In een
strikte toepassing van de RoP diende HYLER immers haar “Reply to the Defence to the Counterclaim”
samen met de “Rejoinder to the Reply to the Statement of Defence” neer te leggen op 15 januari
2025 (en dit uiterlijk om 23.59u). Zij laadde deze echter op in het CMS op 16 januari 2025 (18.34u).
Het Gerecht ziet niet in hoe de rechten van verdediging in hoofde van CRETES hierdoor werden
aangetast. CRETES laadde haar “Rejoinder to the Reply to the Defence to the Counterclaim” op 15
februari 2025 op in het CMS (zonder enig voorbehoud hieromtrent te maken).
22. De neerlegging door HYLER op 16 januari 2025 van haar “Reply to the Defence to the Counterclaim”
samen met de “Rejoinder to the Reply to the Statement of Defence” bracht verder trouwens op
geen enkele wijze de procedure-agenda in gevaar (zoals evenmin de overeengekomen conclusie-
agenda dit deed – zie randnummer 18), zodat het normdoel van R. 29 RoP evenmin werd aangetast.
23. Tenslotte dient vastgesteld dat CRETES onderhavig verzoek pas aan het Gerecht overmaakte op 11
februari 2025. Het vermeend niet-naleven van de termijn door HYLER vraagt geen omstandig
onderzoek in hoofde van CRETES. Indien zij zich werkelijk aangetast zag in haar rechten, kon zij
reeds een dergelijk verzoek aan het Gerecht richten op 16 januari 2025. Zij wachtte echter tot 11
februari 2025. Ondanks het gegeven dat er geen termijn wordt bepaald omtrent een dergelijk
verzoek tot wering, kan het neerleggen ervan op 11 februari 2025 niet in lijn worden gebracht met
de beginselen van eerlijkheid en billijkheid en wordt het als niet proces-loyaal beschouwd.
III.1.3. Besluit
24. Het Gerecht wijst het verzoek uitgaande van CRETES tot wering uit de debatten van de Rejoinder to
the Reply to the Statement of defence (UPC_CFI_216/2024) en de Reply to the Defence to the
Counterclaim for Revocation (procedure UPC_CFI_556/2024) af als ongegrond.
25. Gezien het Gerecht tot een beoordeling kon komen op basis van bovenstaande overwegingen, kan
het abstractie maken van bijkomende verweren geformuleerd door HYLER.
III.2. Omtrent het verzoek tot wering uit de debatten van (minstens) de randnummers 506 tot 510 van
de “Rejoinder to the Reply to the Statement of defence” (UPC_CFI_216/2024) en de “Reply to the
Defence to the Counterclaim for Revocation” (procedure UPC-CFI_556/2024) van HYLER te weren
en meer concreet: (i) de nieuw aangebrachte niet-inbreukargumentatie op basis van nieuwe
varianten van de FL20, (ii) nieuw stuk I.21 van (HYLER), en (iii) de nieuwe vordering tot vaststelling
van niet-inbreuk van (HYLER)
26. CRETES stelt dat dat HYLER in haar “Rejoinder to the Reply to the Statement of Defence”
(UPC_CFI_216/2024) en de “Reply to the Defence to the Counterclaim for Revocation” (procedure
UPC-CFI_556/2024) “een volledig nieuw luik m.b.t. de beweerde niet-inbreuk van haar machine op
EP 4 284 152” heeft geformuleerd. Daarbij zou zij ook gebruik hebben gemaakt van een nieuw stuk
I.21. (die door te voeren wijzigingen aan de machine zouden inhouden waardoor tot de vaststelling
van niet-inbreuk dient besloten te worden), hetgeen HYLER verwoordt in een nieuwe vorde-
ring/verweer (“Te oordelen dat de door (HYLER) aangebrachte aanpassingen en voorgestelde vari-
anten (zie randnummers 506-510) leiden tot een vaststelling van niet-inbreuk wat EP 4 284 152
betreft”).
III.2.1. De vordering strekkende tot vaststelling van niet-inbreuk door HYLER
27. Het Gerecht oordeelt tot de wering van vermelde vordering en motiveert als volgt:
28. Een niet-inbreuk vordering wordt in artikel 32 (1) (b) UPCA weergegeven als een afzonderlijke aard
van vordering (“actions for the declarations of non-infringement of patents and supplementary
protection certificates”) waarvoor de UPC bevoegd is. Daarnaast wordt deze vordering gebaseerd
op feiten die noch werden aangereikt door HYLER in haar inbreukvordering noch kunnen worden
beschouwd als een vordering die past in de procedure-economie als reactie op een stelling die
HYLER zou hebben ingenomen in haar “Reply to the Statement of defence” (UPC_CFI_216/2024)
en/of de “Defence to the Counterclaim for Revocation” (procedure UPC-CFI_556/2024).
29. Opdat een dergelijke vordering al dan niet kan worden toegestaan, had een verzoek in toepassing
van R. 263 RoP (“Leave to change claim or amend case”) dienen te worden overgemaakt aan het
Gerecht en de weergegeven procedure te worden doorlopen. Dergelijk verzoek werd niet gesteld
aan het Gerecht (voorafgaandelijk het stellen van de niet-inbreuk vordering in de “Rejoinder to the
Reply to the Statement of defence” (UPC_CFI_216/2024) en de “Reply to the Defence to the
Counterclaim for Revocation” (procedure UPC-CFI_556/2024) zodat de vordering buiten
beschouwing zal worden gelaten in huidige stand van de procedure.
30. Het past hierbij te wijzen op de beslissing van het hof van beroep van de UPC van 21 november
2024 (UPC_CoA_456/2024) waarbij voorbeelden werden aangereikt van omstandigheden die de
toepassing van R. 263 RoP noodzaken (zie rechtsoverweging 23):
(23) “Niet elk nieuw argument is wijziging van de zaak waarvoor een partij op grond van R.
263 Pr een verzoek om verlof moet indienen. Van wijziging van de zaak is sprake als de aard
of omvang van het geschil verandert. In een inbreukzaak is daarvan bijvoorbeeld sprake als
de eiser een beroep doet op een ander octrooi of bezwaar maakt tegen een ander product”.
In een a contrario toepassing van bovenstaande overweging, oordeelt het Gerecht dat het stellen
van de niet-inbreukvordering met betrekking tot nieuwe, voorgenomen producten, althans
productvarianten de aard en omvang van het geschil wordt veranderd.
Overigens heeft HYLER het Gerecht niet kunnen overtuigen dat deze vordering niet “with
reasonable diligence” eerder had kunnen worden ingesteld (zie randnummer 34).
III.2.2. Nieuwe niet-inbreuk argumentatie-lijn en nieuw stuk
31. Het Gerecht oordeelt het buiten beschouwing laten van zowel de niet-inbreuk argumentatie en het
nieuw stuk (I.21) voor de beoordeling van het geschil en motiveert als volgt:
32. Allereerst herhaalt het Gerecht de hierboven weergegeven rechtsoverweging 23 van het hof van
beroep van de UPC en oordeelt het Gerecht dat de argumentatie en bijbehorende/ondersteunend
stuk (I. 21) de aard en omvang van het geschil verandert (zie ook UPC CFI, Centrale Divisie Parijs, 18
december 2024, Tandem Diabetes Care v Roche Diabetes Care met verwijzing naar bovenvermelde
beschikking van het hof van beroep van 21 november 2024).
33. Verder, en in lijn met het voorafgaande, wordt gewezen op R. 29 (c) RoP waarin expliciet wordt
aangegeven dat de “Rejoinder to the Reply to the Statement of Defence” beperkt dient te zijn tot
een antwoord op de argumenten/stellingen (“matters”) aangereikt in de “Reply to the Statement
of Defence”. Deze regel sluit aan bij en moet worden uitgelegd in het licht van het front-loaded
karakter van de UPC-procedure, waarin partijen gehouden zijn hun volledige zaak (“full case”) zo
vroeg mogelijk in de procedure uiteen ze zetten (Preambule RoP, 7, vgl. RoP 24 RoP, waaruit volgt
dat het verweer in beginsel volledig in de “Statement of Defence” moet zijn neergelegd). De
argumentatie-lijn van HYLER voldoet allerminst aan deze wettelijke beperkingen doch houdt een
nieuwe argumentatie-lijn in, die het Gerecht niet beschouwt als een antwoord op de
argumenten/stellingen weergegeven in de “Reply to the Statement of Defence” door CRETES.
34. Tenslotte (en ter ondersteuning van het bovenstaande) overtuigt HYLER het Gerecht niet omtrent
de reden waarom HYLER niet eerder (en concreet in haar “Statement of Defence”) de nieuwe
varianten heeft voorgelegd opdat CRETES in de mogelijkheid was deze mee te nemen in haar “Reply
to the Statement of Defence”. Het door HYLER ontwikkelde argument dat ze niet eerder beschikbaar
waren, acht het hof niet overtuigend. HYLER was alleszins in de mogelijkheid om na ontvangst van
de “Statement of Claim” de gepaste inspanningen te leveren om een volledig verweer te voeren. Er
kan in de “Reply to the Statement of Defence” geen argument worden gevonden die HYLER zouden
hebben genoodzaakt om pas in haar “Rejoinder to the Reply to the Statement of Defence” deze
argumentatie-lijn (en bijkomend stuk) te formuleren.
III.2.3. Besluit
35. In toepassing van het bovenstaande worden de randnummers 506 tot 510 van de “Rejoinder to the
Reply to the Statement of defence” (UPC_CFI_216/2024) en de “Reply to the Defence to the
Counterclaim for Revocation” (procedure UPC-CFI_556/2024) van HYLER buiten beschouwing
gelaten voor de verdere beoordeling van het geschil.
III.3. Omtrent het verzoek tot een bijkomende termijn van één week om te antwoorden op de nieuwe
niet-inbreukargumentatie en -vordering
35. In het licht van het voorafgaandelijk is het verzoek tot het verlenen van een bijkomende termijn
van één week om te antwoorden op de nieuwe inbreukargumentatie en -vordering zonder
voorwerp geworpen.
IV. HOGER BEROEP
36. In toepassing van R. 333 (5) RoP wordt hoger beroep toegestaan tegen onderhavige
eindbeschikking.
V. BESLISSING
Het Gerecht
1. Wijst de vordering in hoofdorde af als ongegrond.
2. Oordeelt dat de vordering in ondergeschikte orde gegrond is als hierna weergegeven.
3. Laat in de huidige stand van de procedure volgende onderdelen van de “Rejoinder to the Reply
to the Statement of defence” met inbegrip van de “Reply to the Defence to the Counterclaim for
Revocation” buiten beschouwing voor de verdere beoordeling van het geschil :(i) de niet-inbreuk-
argumentatie op basis van nieuwe varianten van de FL20, (ii) stuk I.21 van BV HYLER en (iii) de
vordering tot vaststelling van niet-inbreuk van de BV HYLER en bijgevolg randnummers 506-510
uit de “Rejoinder to the Reply to the Statement of defence” met inbegrip van de “Reply to the
Defence to the Counterclaim for Revocation”.
4. Oordeelt dat de vordering in uiterst ondergeschikte orde geen voorwerp meer heeft.

I. PROCEDURAL BACKGROUND
1. In the procedural order dated 7 October 2024, the Tribunal ordered the parties (viz. NV CRETES
(hereinafter CRETES)(claimant in the infringement action (UPC_CFI_216/2024) and defendant in the
counterclaim seeking annulment (UPC_CFI_556/2024)) and BV HYLER (hereinafter:
"HYLER")(defendant in the infringement claim (UPC_CFI_216/2024) and plaintiff in the counterclaim
seeking annulment (UPC_CFI_556/2024)) informed that the date of the Statement of Defence (16
September 2024) would be considered determinative and invited the parties to take position on
streamlining the infringement (UPC_CFI_216/2014) and invalidity (UPC_CFI_556/2024) proceedings.
2. The following briefs were transmitted to the Tribunal on 26 October 2024:
• outgoing from HYLER: "The parties also agree that the date of notification of the Statement of
Defence in the infringement proceedings, specifically 16 September 2024, shall be considered
determinative of the time limits in the invalidity proceedings."
• FROM CRETES: "First, the parties confirm that they agree that the date of notification by the UPC of
the Statement of Defence in the infringement proceedings, namely 16 September 2024, shall be
considered as determinative for the time limits for both the Reply to the Statement of Defence and
Defence to the Counterclaim for Revocation."
3. On 15 November 2024, a Friday evening, at 10.22pm (see CMS registration), CRETES uploaded its
"Reply to the Statement of Defence" (UPC_CFI_216/2024) in the CMS. The CMS will further show that
the "Defence to the Counterclaim for Revocation" (UPC_CFI_556/2024) was not loaded into the CMS
until 22 November 2024 (3.24pm). HYLER will then upload its Rejoinder to the Reply to the Statement
of defence (UPC_CFI_216/2024) and the Reply to the Defence to the Counterclaim for Revocation
(proceedings UPC-CFI_556/2024) into CMS on 16 January 2024.
4. On 11 February 2025, CRETES filed this general procedural request (R. 9 RoP) (request number (and
workflow) App_6987/2025).
5. The request seeks in main order to have the Rejoinder to the Reply to the Statement of defence
(UPC_CFI_216/2024) and the Reply to the Defence to the Counterclaim for Revocation (proceedings
UPC-CFI_556/2024) withdrawn from the debates as filed on 16 January 2025 instead of 15 January
2025 and this in application of R. 29(d) RoP (juncto R. 300(c) RoP.
6. Further (and subordinately), the present application seeks to exclude from the debates (at a minimum)
marginal numbers 506 to 510 of HYLER's Rejoinder to the Reply to the Statement of defence
(UPC_CFI_216/2024) and the Reply to the Defence to the Counterclaim for Revocation (proceeding
UPC-CFI_556/2024) and, more specifically, the following parts:(i) the newly introduced non-infringement
argument based on new variants of the FL20, (ii) new Exhibit I.21 by (HYLER) and (iii) the
new claim for a finding of non-infringement by (HYLER). The legal basis relied upon in this regard
concerns Preamble 7 of the RoP in conjunction with R. 24(e) to (h) RoP and R. 29(e) RoP.
7. Extremely subordinately, CRETES requests that an additional period be granted to it as an "additional
response option" to protect the rights of defence. This request is grounded on the application of R. 36
RoP.
8. Before awaiting an interim order from the Tribunal, HYLER filed a general procedural R. 9 RoP as a
defence to CRETES' application on 13 February 2025. This application was assigned the application
number (and workflow) App_7312/2025.
9. On 15 February 2025, an interim order ordered HYLER to upload its defence to CRETES' application in
workflow App_6987/2025 by Monday 17 February 2025 (4pm), after which the parties were informed
that the Tribunal would then proceed to issue a final order in both App_6987/2025 and
App_7312/2025.
10. HYLER complied with this order of the Tribunal, allowing it to proceed with the assessment of the
application.
11. On 17 February 2025, CRETES filed a new general procedural request (R. 9 RoP) which was assigned
the request number (and workflow) App_7916/2025. This request concerns a response to HYLER's
defence (reproduced in App_7312/2025). In its preliminary order dated 15 February 2025, the JR, in
addition to ordering HYLER to charge this defence in App_6987/2025, indicated that it would proceed
to final order after its execution. The Court disregards the new R. 9 RoP application, and disregards the
contentions contained therein in the light of the interim order of 15 February 2025, which did not give
CRETES an opportunity to make further submissions.
II. CLAIMS AND ARGUMENTS
12. CRETES' application formally seeks the following.
• In Main Order:
To exclude from the debates the Rejoinder to the Reply to the Statement of defence including the
Reply to the Defence to the Counterclaim for Revocation of (HYLER).
• In subordinate order:
rule that (i) the new non-infringement argument made on the basis of new variants of the FL20,
(ii) new Exhibit I.21 of (HYLER) and (iii) the new claim for a finding of non-infringement of (HYLER)
(...); and, consequently, exclude from the debates marginal numbers 506-510 of the Re- joinder to
the Reply to the Statement of defence including the Reply to the Defence to the Coun- terclaim for
Revocation, piece I.21 of (HYLER) and the new claim for a finding of non-infringement of (HYLER).
• In extremely subordinate order:
Granting an additional reply opportunity to the Applicant to respond to the new non-infringement
argument and claim and accompanying Exhibit I.21 of (HYLER) in order to preserve its rights of
defence.
13. In its defence, HYLER argued/claimed as follows:
• In main order: declare the claim of (CRETES) for expulsion from the debates of the Rejoinder to
the Reply to the Statement of defence including the Reply to the Defence to the Counterclaim for
Revocation of (HYLER) as unfounded;
• In subordinate order: the time limit for filing the Rejoinder to the Reply to the Statement of
defence including the Reply to the Defence to the Counterclaim for Revocation of
(HYLER) be retroactively extended by one day, taking into account the principles of honour,
fairness and proportionality;
• Also in main order: declare (CRETES') claim for expulsion from the debates of marginal numbers
506-510 of the Rejoinder to the Reply to the Statement of defence including the Reply to the
Defence to the Counterclaim for Revocation, piece 1.21 of (HYLER) and the new claim for a finding
of non-infringement of (HYLER) as unfounded;
• In subordinate order: grant (CRETES) an additional period of one week to respond to margin
numbers 506-510 of the Rejoinder to the Reply to the Statement of defence including the Reply to
the Defence to the Counterclaim for Revocation, piece 1.21 of (HYLER) and the new claim for a
finding of non-infringement of (HYLER);
• In extremely minor order: if the claims of (HYLER) as contained in this letter are rejected, to allow
(HYLER) to submit, through the CMS plat- form or otherwise, an official response to the general
procedural request of (CRETES); and
• In any case: to the extent necessary and technically possible, to include this general procedural
request on the CMS platform as a (preliminary) response to the general procedural request of
(CRETES).
III. GROUNDS FOR THE DECISION
III.1. On the request for expulsion from the debates of "Rejoinder to the Reply to the Statement of Defence"
(UPC_CFI_216/2024) and the "Reply to the Defence to the Counterclaim for Revocation" (proceedings
UPC-CFI_556/2024)
III.1.1. Exchange of letters between counsel for HYLER and CRETES regarding procedural agenda
14. First of all, the Tribunal (i.e. the Brussels District Court as the Chamber) is obliged to make use of the
correspondence exchanged between counsel in its assessment. The Tribunal is aware that such
correspondence should be considered confidential, but in the absence of a competent President of the
Bar and/or Bar Association at UPC level, who could possibly take a decision about the agreements
made between its members on the basis of confidential correspondence and a code of ethics, the
Tribunal is obliged to make an assessment using this confidential correspondence. The Court will limit
itself to the factual information that was quoted (without quoting from the confidential
correspondence).
15. It appears from the confidential exchange of letters between the counsels, specifically a first draft by
HYLER's counsels, that the latter wished to submit a concrete agenda for conclusions to the JR. While
this proposed conclusion agenda mentioned successive deadlines after the filing of certain written
arguments, it was concretised by indicating the following dates:
• 16 November 2024 for CRETES to file its "Defence to the Counterclaim" together with the
"Reply to the Statement of Defence" and, if appropriate, an "Application to amend the patent".
• 16 January 2025 for HYLER for filing "Reply to the Defence to the Counterclaim" together with
the "Rejoinder to the Reply to the Statement of Defence" and, where appropriate, "Defence to
an Application to amend the patent".
• 16 February 2025 for CRETES for the "Rejoinder to the Reply to the Defence to the
Counterclaim" if necessary together with a "Reply to the Defence to an Application to amend
the patent.
16. The above agenda was not in itself disputed. However, CRETES will argue that it saw no added value in
displaying the concrete claim agenda and for this reason it was omitted in the communication to the
JR.
17. In the light of the above, the Tribunal finds that between the parties, a statutory (conclusive) agenda
was waived in the RoP and replaced by a concrete (date-related and not deadline-related) conclusive
agenda.
18. Such agreed statement agenda can be allowed by the Tribunal if it does not deviate substantially from
the statutory (term-related) statement agenda reflected in the rules (RoP). The schedule of
submissions agreed between the parties is perfectly in line with the statutory (time-related) agenda of
proceedings as only the (statutory) deadline for filing submissions was agreed. At no point does this
compromise the procedural agenda per se for consideration of the case.
19. The fact that CRETES filed its Defence to the Counterclaim together with the Reply to the Statement of
Defence on 15 November 2024 instead of 16 November 2024 does not thwart these agreements.
20. It should also be noted that the "Reply to the Statement of Defence" in UPC_CFI_556/2024 was only
uploaded by CRETES into CMS on 22 November 2024 (3.24pm) around which HYLER apparently never
made a point (and was itself 7 days late). Therefore, in the strict reading of CRETES, this could mean
that this was late and would have in any case allowed HYLER to reply until 22 January 2025.
III.1.2. For the sake of completeness, the circumstances of the case justify the (formal) application of
R. 29 RoP and neither do the claims for dismissal of the Rejoinder to the Reply to the Statement of
defence (UPC_CFI_216/2024) and the Reply to the Defence to the Counterclaim for Revocation
(proceedings UPC-CFI_556/2024).
21. The Tribunal notes that CRETES uploaded its "Defence to the Counterclaim" together with the "Reply to
the Statement of Defence" on 15 November 2024 (in UPC_CFI_216/2024) in the CMS on a Friday
evening at 10.22pm (see also above regarding its upload in UPC_CFI_556/2024). This relates to 1h
44min prior to the deadline provided in the RoP. Indeed, in a strict application of the RoP, HYLER had
to file its "Reply to the Defence to the Counterclaim" together with the "Rejoinder to the Reply to the
Statement of Defence" on 15 January 2025 (and this no later than 23.59h). However, it uploaded them
to CMS on 16 January 2025 (6.34pm). The Tribunal fails to see how this affected CRETES' rights of
defence. CRETES uploaded its "Rejoinder to the Reply to the Defence to the Counterclaim" into the CMS
on 15 February 2025 (without making any reservation in this regard).
22. Furthermore, the filing by HYLER on 16 January 2025 of its "Reply to the Defence to the Counterclaim"
together with the "Rejoinder to the Reply to the Statement of Defence" in no way jeopardised the
procedural timetable (just as the agreed schedule of submissions did not - see paragraph 18 above), so
that the purpose of R. 29 of the Rules of Procedure was not affected either.
23. Finally, it should be noted that CRETES did not submit the present application to the Tribunal until 11
February 2025. HYLER's alleged failure to meet the deadline does not require detailed investigation on
CRETES' part. If its rights were really affected, it could have made such an application to the General
Court as early as 16 January 2025. However, it waited until February 11, 2025. Despite the fact that no
deadline is set regarding such an application for expulsion, its filing on 11 February 2025 cannot be
brought in line with the principles of fairness and equity and is considered not litigation-loyal.
III.1.3. Decision
24. The General Court dismisses as unfounded the application emanating from CRETES for expulsion from
the debates of the Rejoinder to the Reply to the Statement of defence (UPC_CFI_216/2024) and the
Reply to the Defence to the Counterclaim for Revocation (proceedings UPC_CFI_556/2024).
25. Given that the Tribunal could reach an assessment on the basis of the above considerations, it may
abstract from additional defences formulated by HYLER.
III.2. With regard to the request to exclude from the debates (at least) marginal numbers 506 to 510 of
HYLER's "Rejoinder to the Reply to the Statement of defence" (UPC_CFI_216/2024) and the "Reply to
the Defence to the Counterclaim for Revocation" (proceedings UPC-CFI_556/2024), and more
specifically: (i) the newly introduced non-infringement argument based on new variants of the FL20,
(ii) new Exhibit I.21 by (HYLER), and (iii) the new claim for a finding of non-infringement by (HYLER).
26. CRETES submits that in its "Rejoinder to the Reply to the Statement of Defence" (UPC_CFI_216/2024)
and the "Reply to the Defence to the Counterclaim for Revocation" (proceedings UPC-CFI_556/2024),
HYLER "formulated a completely new part regarding the alleged non-infringement of its machine on EP
4 284 152". In doing so, it also allegedly used a new piece of
I.21. (which would entail modifications to be made to the machine leading to a finding of non-infringement),
which HYLER put forward in a new form of order/defence ("Hold that the modifications
and proposed variations made by (HYLER) (see marginal numbers 506-510) lead to a finding of non-infringement
as regards EP 4 284 152").
III.2.1. The claim seeking a declaration of non-infringement by HYLER
27. The General Court ruled in favour of the rejection of the said claim and reasoned as follows:
28. A non-infringement claim is reflected in Section 32(1)(b) UPCA as a separate nature
of claim ("actions for the declarations of non-infringement of patents and supplementary
protection certificates") for which the UPC has jurisdiction. In addition, this claim is based on facts that
were neither provided by HYLER in its infringement claim nor can be considered as a claim that fits into
the procedural economy in response to a position allegedly taken by HYLER in its "Reply to the
Statement of defence" (UPC_CFI_216/2024) and/or the "Defence to the Counterclaim for Revocation"
(proceedings UPC-CFI_556/2024).
29. In order for such a claim to be allowed or not, an application under R. 263 RoP ("Leave to change claim
or amend case") should have been made to the Tribunal and the procedure shown should have been
followed. No such application was made to the Tribunal (prior to raising the non-infringement claim in
the "Rejoinder to the Reply to the Statement of defence" (UPC_CFI_216/2024) and the "Reply to the
Defence to the Counterclaim for Revocation" (proceedings UPC-CFI_556/2024) so the claim will be
disregarded in current state of the proceedings.
30. It is appropriate here to refer to the decision of the UPC Court of Appeal of 21 November 2024
(UPC_CoA_456/2024) which provided examples of circumstances necessitating the application of R.
263 RoP (see paragraph 23 of law):
(23) "Not every new argument is modification of the case for which a party must apply for
leave under R. 263 Pr. Modification of the case occurs when the nature or scope of the dispute
changes. For example, in an infringement case, this occurs if the plaintiff invokes a different
patent or objects to a different product."
In an a contrario application of the above consideration, the Tribunal held that asserting the non-infringement
claim in relation to new, intended products, or at least product variants changes the
nature and scope of the dispute.
Incidentally, HYLER failed to convince the Tribunal that this claim could not have been brought "with
reasonable diligence" earlier (see marginal 34).
III.2.2. New non-infringement line of argument and new document
31. The Tribunal finds the disregard of both the non-infringement argumentation and the new piece (I.21)
for the assessment of the dispute and reasons as follows:
32. First, the Tribunal reiterates UPC Court of Appeal paragraph 23 reproduced above and finds that the
argumentation and accompanying/supporting piece (I. 21) changes the nature and scope of the
dispute (see also UPC CFI, Paris Central Division, 18 December 2024, Tandem Diabetes Care v Roche
Diabetes Care with reference to the above-mentioned Court of Appeal order of 21 November 2024).
33. Further, and in line with the foregoing, reference is made to R. 29(c) RoP which explicitly states that
the "Rejoinder to the Reply to the Statement of Defence" should be limited to a response to the
arguments/assertions ("matters") provided in the Reply to the Statement of Defence. This rule is
consistent with and should be interpreted in light of the front-loaded
nature of UPC proceedings, in which parties are required to set out their full case ("full case") as early
as possible in the proceedings (Preamble RoP, 7, cf. RoP 24 RoP, from which it follows that, in principle,
the defence must be set out in full in the Statement of Defence). HYLER's line of argument by no
means complies with these legal restrictions but involves a new line of argument, which the Court
does not regard as a response to the arguments/statements set out in the Reply to the Statement of
Defence by CRETES.
34. Finally (and in support of the above), HYLER does not convince the Court as to why HYLER did not
submit the new variants earlier (and concretely in its Statement of Defence) so that CRETES was in a
position to include them in its Reply to the Statement of Defence. The argument developed by HYLER
that they were not available earlier is not, in the court's view, convincing. HYLER was in every way in a
position to make the appropriate efforts to present a full defence after receiving the Statement of
Claim. No argument can be found in the "Reply to the Statement of Defence" that would have
compelled HYLER to formulate this line of argument (and additional document) only in its "Rejoinder to
the Reply to the Statement of Defence".
III.2.3. Decision
35. In application of the above, marginal numbers 506 to 510 of HYLER's "Rejoinder to the Reply to the
Statement of defence" (UPC_CFI_216/2024) and "Reply to the Defence to the Counterclaim for
Revocation" (proceedings UPC-CFI_556/2024) are disregarded for further assessment of the dispute.
III.3. On the request for an additional one-week period to respond to the new non-infringement argument
and claim
35. In the light of the foregoing, the request for the granting of an additional one-week time limit to
respond to the new non-infringement argument and claim is thrown without object.
IV. APPEAL
36. In application of R. 333 (5) RoP, an appeal is allowed against this final decision.
V. DECISION
The Tribunal
1. Dismisses the claim in main order as unfounded.
2. Judges that the claim in subordinate order is well founded as shown below.
3. At the present stage of the proceedings, disregard the following parts of the "Rejoinder to the
Reply to the Statement of defence" including the "Reply to the Defence to the Counterclaim for
Revocation" for the further assessment of the dispute :(i) the non-infringement argument on the
basis of new variants of the FL20, (ii) piece I.21 of BV HYLER and (iii) the
UPC_CFI_216/2024 & UPC_CFI_556/2024

claim for a finding of non-infringement by BV HYLER and, consequently, marginal numbers 506-510
from the "Rejoinder to the Reply to the Statement of defence" including the "Reply to the
Defence to the Counterclaim for Revocation".
4. Judge that the claim in extremely subordinate order no longer has merit.
5. State appeal to against this final order. Appeal may be in- filed within 15 days of service ("service")
of this decision (R. 224.1(b) RoP in conjunction with R. 220.2. RoP).
