Anordnung
des Gerichts erster Instanz des Einheitlichen Patentgerichts

LEITSÄTZE:
1. Weist ein Kleinunternehmen im zuletzt erstellten Jahresabschluss einen Be-triebsverlust aus und stehen Vermögenswerte als Sicherheit nicht in ausreichen-dem Maße zur Verfügung, ist auf Antrag des Gegners eine Sicherheitsleistung nach Regel 158 EPGVerfO anzuordnen.
2. Bei der Bemessung der Sicherheitsleistung sind für die spätere Kostenfestset-zung maßgeblich werdende Billigkeitsgründe zu berücksichtigen. Denn die Be-messung der Sicherheitsleistung hat sich an den nach Art. 69 EPGÜ festzuset-zenden Kosten zu orientieren; nach Art. 69 EPGÜ können Billigkeitsgründe der Kostentragung ganz oder teilweise entgegenstehen.
3. Bei der Möglichkeit einer Gebühren- bzw. Kostenreduktion zum Zwecke der Ge-währung des wirksamen Zugangs zum Recht handelt es sich um einen das EPG-Recht bestimmenden Grundsatz. Dieser ist als Billigkeitserwägung auch bei der Bemessung einer von einem Kleinunternehmen zu erbringenden Sicherheitsleis-tung zu beachten.
4. Eine Partei, die sowohl ihre eigenen Kosten (Gerichtsgebühren und Vertretungs-kosten) als auch eine gerichtlich festgesetzte Sicherheit leisten kann, ist zur Kos-tentragung im Stande. Prozesskostenhilfe kann in diesem Fall nicht bewilligt wer-den.

Sachverhalt
Die Antragstellerin hat mit Schriftsatz vom 21.10.2024 b e a n t r a g t,
das Gericht möge der Verletzungsklägerin anordnen, innerhalb von 14 Tagen, hilfsweise innerhalb einer vom Gericht festzusetzenden Frist, für die Kosten des Rechtsstreits und die sonstigen Kosten angemessene Sicherheit in Höhe von EUR 257.000,00 durch Hinterlegung oder Bankbürgschaft zu leisten (Regel 158 VerfO).
Zur Begründung hat die Antragstellerin unter anderem ausgeführt, die Anordnung einer Sicherheitsleistung sei geboten, da die Klägerin nicht über ausreichend finanzielle Mittel verfüge. Mit dem Antrag hat sie insofern insbesondere auf das Credit Rating der Tokyo Shoko Research verwiesen, nach dem die Kreditwürdigkeit der Antragsgegnerin für Februar 2024 mit gerade einmal von 100 Punkten und damit in der Kategorie „einige Vorsicht notwendig“ („some alert necessary“) bewertet worden sei. Die auf gerichtlichen Hinweis von der Antragsgegnerin vorgelegten Bilanzen hat die Antragstellerin in ihrer Stellungnahme vom 22.01.2025 dahin bewertet, dass die finanzielle Lage der Antragsgegnerin prekär sei; der Anlage PB13a sei zu entnehmen, dass die Antragsgegnerin zuletzt einen Betriebsverlust zu verzeichnen gehabt habe. Der aus Sicht der Antragstellerin erforderliche Sicherungsbetrag errechnet sich wie
folgt:

Die Antragsgegnerin hat b e a n t r a g t,
den Antrag der Antragstellerin zurückzuweisen,
hilfsweise, die Sicherheitsleistung auf einen angemessenen Betrag zu reduzieren, der nicht überschreitet, wobei der Antragsgegnerin zugleich eine angemessene Zeit von mindestens vier Wochen eingeräumt wird, um die Sicherheit in Form einer Bürgschaft beizubringen.
Die Antragsgegnerin hat ferner b e a n t r a g t,
der Antragsgegnerin Prozesskostenhilfe für das Verfahren vor dem Einheitlichen Patentgericht zu gewähren.
Die Antragsgegnerin hat unter Vorlage und Verweis auf ihre Bilanzen der Jahre 2021, 2022 und 2023 vorgetragen, die Finanzen der Antragsgegnerin seien ausgeglichen, stabil und vertrauenswürdig. Es bestünden keine Zahlungsschwierigkeiten. Ihren Prozesskostenhilfeantrag hat die Antragsgegnerin damit begründet, dass nach Art. 47 der EU-Grundrechtecharta und Art. 6 der Europäischen Menschenrechtskon-
vention (EMRK) auch kleine Unternehmen das Recht auf Zugang zu einem Gerichtsverfahren haben; das gelte auch vor dem UPC. Sie sei auch bedürftig, da sie nicht in der Lage sei, die Kosten des Verfahrens aus eigenen Mitteln zu tragen, wenn eine zu hohe, jedenfalls die geforderte exorbitante Sicherheitsleistung (€ 260.000) angeordnet werde. Als Nachweis für die Bedürftigkeit hat dien Antragsgegnerin auf die vorgelegten Bilanzen verwiesen.
Mit Blick auf den Prozesskostenhilfeantrag der Antragsgegnerin hat die Antragstellerin
b e a n t r a g t,
dem Antrag auf Prozesskostenhilfe nicht stattzugeben. Zur Begründung hat die Antragstellerin ausgeführt, die Antragsgegnerin sei keine natürliche Person; dies sei nach Art. 71 EPGÜ allerdings erforderlich, um Prozesskostenhilfe zu erhalten.
Gründe
A.
Eine Sicherheitsleistung ist anzuordnen.
1. Nach Regel 158.1 EPGVerfO kann das Gericht zu jedem Zeitpunkt des Verfahrens auf einen mit einer Begründung versehenen Antrag einer Partei anordnen, dass die andere Partei innerhalb einer festgelegten Frist für die Kosten des Rechtsstreits und sonstigen der antragstellenden Partei entstandenen und/oder
noch entstehenden Kosten, welche die andere Partei möglicherweise tragen muss, angemessene Sicherheit zu leisten hat.
2. Der Berichterstatter hat den Parteien gemäß Regel 158.2 EPGVerfO rechtliches Gehör gewährt.
3. Nach der Rechtsprechung des Berufungsgerichts (UPC_CoA_217/2024) genügt es mit Blick auf einen Antrag auf Leistung einer Prozesskostensicherheit, wenn der Antragsteller hinreichend darlegt, welche Anstrengungen unternommen wurden, um öffentlich verfügbare Informationen über die finanzielle Lage des Antragsgegners zu finden. Die Antragstellerin hat diese Anforderungen erfüllt, indem sie mit dem Antrag auf die negative Bewertung der Tokyo Shoko Research („some alert necessary“) verwiesen hat.
4. Anordnung einer Sicherheitsleistung Die finanzielle Lage der Antragsgegnerin rechtfertigt die nordnung einer Sicherheitsleistung: Die Antragsgegnerin hat zwar vorgetragen, dass sich aus den letzten Bilanzen
Bruttogewinne in Höhe von umgerechnet € (2022) und €
(2023) ergeben. Tatsächlich ergibt sich aus dem als Anlage PB13a vorgelegten Jahresabschluss (Gewinn- und Verlustrechnung) für den Zeitraum 01/10/2022 bis 30/09/2023 allerdings nach Abzug der Vertriebs-, Verwaltungs- und Gemeinkosten vom Betrag des Bruttogewinns ein Betriebsverlust in Höhe von
(umgerechnet Ein solcher Betriebsverlust ist in der Gewinn- und Verlustrechnung auch explizit als solcher ausgewiesen. Zwar weist die Gewinn- und Verlustrechnung letztlich nach Hinzurechnung nicht-ope-
rativer und nicht weiter spezifizierter ordentlicher Erträge und nach Abzug nicht-operativer Aufwendungen einen Jahresüberschuss in Höhe von Yen (umgerechnet aus. Der solchermaßen errechnete Jahresüber-
schuss rechtfertigt die Zurückweisung des Antrags auf Anordnung einer Sicherheitsleistung allerdings nicht, da er nicht einmal die zu erwartenden Kosten der Antragstellerin für die erste Instanz annähernd deckt. Maßgeblich zu berücksichtigen ist aber vor allem, dass die Antragsgegnerin im fraglichen Zeitraum einen Betriebsverlust erlitten hat, so dass die wirtschaftliche Lage der Antragsgegnerin als angespannt zu bewerten ist; aus dem Jahresabschluss für den Zeitraum bis ergibt sich auch nicht, dass die Antragsgegnerin aktuell über Vermögenswerte verfügt, die die Zurückweisung des Antrags auf An-
ordnung einer Sicherheitsleistung rechtfertigen. Bestätigt wird die als angespannt zu bewertende wirtschaftliche Lage der Antragsgegnerin durch den von ihr gestellten Antrag auf Prozesskostenhilfe.
5. Höhe der Sicherheitsleistung
Für die Höhe der Sicherheitsleistung sind die Kosten des Rechtsstreits und die sonstigen der antragstellenden Partei entstandenen und/oder noch entstehenden Kosten, welche die andere Partei möglicherweise tragen muss, maßgeblich (Regel 158.1 EPGVerfO). Nach Art. 69 Abs. 1 EPGÜ werden die Kosten des Rechtsstreits und sonstigen Kosten der obsiegenden Partei in der Regel, soweit sie zu-
mutbar und angemessen sind, bis zu einer gemäß der Verfahrensordnung festgelegten Obergrenze von der unterlegenen Partei getragen, sofern Billigkeitsgründe dem nicht entgegenstehen.
a. Sicherheitsleistung für die Kosten der Antragstellerin
Die Obergrenze beträgt bei dem hier maßgeblichen Streitwert von 500.000,00 € für die Verletzungsklage und weiteren 500.000,00 € für die Nichtigkeitswiderklage nach der Tabelle des Verwaltungsausschusses für die sich aus dem Streitwert ergebenden Obergrenzen für erstattungsfähige Kosten 112.000,00 € für die erste Instanz und weitere 112.000,00 € im Falle einer Berufung.
b. Sicherheitsleistung für die Gerichtskosten
Im Hinblick auf die Gerichtskosten sind nach Regel 159 EPGVerfO für die Wider-klage auf Nichtigerklärung und die jeweilige Berufung jeweils € 11.000,00 anzusetzen.
c. Billigkeitsgründe
Kosten in Höhe der vorgenannten Beträge können nach Art. 69 EPGÜ nur fest-gesetzt werden, sofern Billigkeitsgründe dem nicht entgegenstehen. Da sich die Bemessung der Sicherheitsleistung an den nach Art. 69 EPGÜ festzusetzenden Kosten orientiert, gilt auch für die Sicherheitsleistung, dass für die Kostenfestset-zung maßgebliche Billigkeitsgründe zu berücksichtigen sind.
Das EPGÜ lässt offen, was als Billigkeitsgrund für eine reduzierte Kostenfestset-zung im Hinblick auf die genannten Gerichtsgebühren bzw. Obergrenzen für die Vertretungskosten anzusehen ist. Sowohl das EPGÜ (Art. 36 Abs. 3) als auch die EPGVerfO (Regel 370.8, Regel 376A.2 i.V.m. dem Beschluss des Verwaltungs-ausschusses betreffend die Prozesskostenhilfe vom 27.09.2023) zeigen jedoch, dass zumindest im Falle kleiner und mittlerer Unternehmen (KMU) sowie bedürf-tiger Privatpersonen eine Wechselwirkung zwischen der Höhe der Gerichtsge-bühren bzw. die Höhe der erstattungsfähigen Kosten der Vertretung und dem Grundsatz des wirksamen Zugangs zum Recht anzuerkennen ist. Die genannten Regelungen sehen daher Gebühren- bzw. Kostenermäßigungen von 50% bzw. 40% vor, um den wirksamen Zugang zum Recht zu gewährleisten. Bei dem damit zum Ausdruck kommenden Erfordernis einer Gebühren- bzw. Kostenreduktion zum Zwecke der Gewährung des fairen Zugangs zum Recht handelt es sich um einen Grundsatz des EPG-Rechts, der als Billigkeitserwägung auch bei der Be-messung der Sicherheitsleistung zu beachten ist. Damit gewährleistet das EPGÜ und die Verfahrensordnung des EPG das Recht auf ein faires Verfahren (Art. 6 EMRK). Die EMRK verlangt zwar keinen kostenfreien Justizzugang; bei der Be-messung von Kostentragung und -vorschüssen ist allerdings darauf zu achten, dass diese nicht unangemessen hoch sind und für Betroffene abschreckende Wirkung haben (EGMR 19. 6. 2001 – 28249/95 Rn. 57 ff.); gleiches gilt für Sicher-heitsleistungen.

Bei der Antragsgegnerin handelt es sich gemessen an der Empfehlung 2003/361/EG der Kommission vom 6. Mai 2003 betreffend die Definition der Kleinstunternehmen sowie der kleinen und mittleren Unternehmen (ABl. L 124 vom 20.5.2003, S. 36; zur Anwendung dieser Empfehlung siehe EuGH, Urteil vom 10.03.2021 – C-572/19 P) angesichts von Umsatz und Mitarbeiterzahl zu-mindest um ein kleines Unternehmen. Gerade im Falle kleiner Unternehmen ist darauf zu achten, dass der wirksame Zugang zum Recht gewährleistet ist. Eine erforderliche Sicherheitsleistung ist daher so zu bemessen, dass ein wirksamer Zugang zum Recht möglich ist und die Klage des Unternehmens nicht aufgrund einer von diesem nicht leistbaren Sicherheit durch Versäumnisurteil abzuweisen ist (Regel 158.5 EPGVerfO).
Angesichts dessen wird die erforderliche Sicherheit hier wie folgt berechnet und festgesetzt:
aa. Eine Sicherheitsleistung für die Kosten der Berufungsinstanz wird derzeit aus Bil-ligkeitsgründen nicht in Absatz gebracht. Zwar handelt es sich auch bei den Kos-ten für die Berufungsinstanz um Kosten des Rechtsstreits (Regel 158.1 EPG-VerfO), die bei der Festsetzung der Sicherheitsleistung in erster Instanz grund-sätzlich berücksichtigt werden können. Da aber noch nicht feststeht, ob eine erst-instanzliche Entscheidung in die Berufungsinstanz gehen wird und die Antrag-stellerin in diesem Falle einen weiteren Antrag auf Sicherheitsleistung stellen kann („… kann das Gericht zu jedem Zeitpunkt des Verfahrens…“), wird aus Bil-ligkeitsgründen davon abgesehen, etwaige Vertretungskosten und Gerichtsge-bühren für eine zweite Instanz bereits jetzt zum Gegenstand der festzusetzenden Sicherheitsleistung zu machen. Dies entspricht im Übrigen auch dem Rechtsge-danken des Prozesskostenhilferechts, nachdem im Falle einer Berufung ein neuer Antrag zu stellen ist (Regel 378.4 EPGVerfO).
bb. Ebenfalls aus Billigkeitsgründen werden die erstattungsfähigen Vertreterkosten für die erste Instanz nach dem Vorbild von Regel 376A.2 EPGVerfO i.V.m. dem Beschluss des Verwaltungsausschusses betreffend die Prozesskostenhilfe vom 27.09.2023 mit 50% der Obergrenze der erstattungsfähigen Kosten (50% von 112.000,00 € = 56.000,00 €) angesetzt. Es wird ausdrücklich darauf hingewiesen, dass es sich hierbei lediglich um eine Ermessensentscheidung im Rahmen des Antrags auf Sicherheitsleistung handelt, welche für eine spätere Kostenfestset-
zung nicht präjudiziell ist.
cc. Eine Sicherheit für die Gerichtsgebühr für die Widerklage auf Nichtigerklärung
wird nach dem Vorbild von Regel 370.8 EPGVerfO in Höhe von 60% in Ansatz
gebracht (60% von 11.000,00 € = 6.600,00 €).
dd. Mangels entgegenstehender Anhaltspunkte geht der Berichterstatter davon aus,
dass die angeordnete Sicherheitsleistung von der Antragsgegnerin, die mit ihrem
Hilfsantrag einen geringfügig niedrigeren Betrag als angemessen
und erbringbar angegeben hat, geleistet werden kann.
6. Frist für die Sicherheitsleistung
Die Antragsgegnerin hat ausweislich ihres Hilfsantrages eine Frist von vier Wo-
chen für angemessen erklärt. Dies ist aus Sicht des Gerichts nicht zu beanstan-
den.
B.
Der Prozesskostenhilfeantrag ist zurückzuweisen.
1. Die grundlegende Frage, ob auch Unternehmen aufgrund der EU-Grundrechtecharta und der Europäischen Menschenrechtskonvention einen Anspruch auf Prozeßkostenhilfe vor dem EPG haben, obwohl Art. 71 Abs. 1 EPGÜ einen solchen auf natürliche Personen zu beschränken scheint, kann hier offen bleiben, da die Antragsgegnerin derzeit nicht als bedürftig anzusehen ist.
2. Die Antragsgegnerin mag sich in einer angespannten wirtschaftlichen Situation befinden; sie ist aber trotz der von ihr mit den vorgelegten Bilanzen dargestellten wirtschaftlichen Lage offenbar im Stande, sowohl die Gerichtsgebühren für die Verletzungsklage als auch die Kosten für ihre Vertretung aufzubringen. Der Zu-
gang zum Recht (hier in Gestalt der Einreichung einer Klage wegen Patentverletzung beim EPG) war und ist der Antragsgegnerin ohne weiteres möglich; einen Prozesskostenhilfeantrag hat sie mit Blick auf ihre eigenen Kosten nicht gestellt. Die Antragsgegnerin wird bei ihrer Klage nach ihrem eigenen Vortrag durch einen Prozesskostenfinanzierer unterstützt; sie hat nicht vorgetragen, mit Blick auf die eigenen Kosten (Gerichtsgebühren für die Verletzungsklage, Kosten für ihre Vertretung) der Prozesskostenhilfe zu bedürfen.
Soweit die Antragsgegnerin ihren Prozesskostenhilfeantrag damit begründet hat, dass sie nicht in der Lage sei, die Kosten des Verfahrens aus eigenen Mitteln zu tragen, wenn eine zu hohe, jedenfalls die geforderte exorbitante Sicherheitsleistung (€ 260.000) angeordnet werde, ist die Gewährung von Prozesskostenhilfe
ebenfalls nicht veranlasst: Der Berichterstatter hat eine Sicherheitsleistung angeordnet, bei der mit Blick auf den eigenen Vortrag der Antragsgegnerin davon auszugehen ist, dass sie diese wird erbringen können; die Antragsgegnerin hat mit ihrem Hilfsantrag betreffend den Antrag der Antragstellerin auf Anordnung einer
Sicherheitsleistung klar zum Ausdruck gebracht, dass sie in der Lage ist, eine Sicherheitsleistung in Höhe von in Form einer Bankbürgschaft zu leisten. Die angeordnete Sicherheitsleistung liegt nur geringfügig über diesem Betrag. Es ist nicht ersichtlich, dass die Antragsgegnerin nicht imstande ist, diesen Betrag – sei es durch Hinterlegung oder in Form einer Bankbürgschaft – zu leisten.
Anordnung
1. Es wird angeordnet, dass die Antragsgegnerin (Verletzungsklägerin) bis zum 24. Februar 2025 Sicherheit in Höhe von € 62.600,00 zu leisten hat. Die Sicherheit kann entweder
- durch eine unwiderrufliche, unbedingte, unbefristete und selbstschuldneri-sche Bürgschaft auf erstes Anfordern einer im Hoheitsgebiet der EPG-Ver-tragsmitgliedstaaten ansässigen und zum Geschäftsbetrieb zugelassenen Bank
oder
- durch Hinterlegung des Sicherungsbetrages auf dem dafür eingerichteten Konto des Einheitlichen Patentgerichts (angegeben unter Ziffer 3. auf der In-ternetseite www.unified-patent-court.org/de/court/payments) geleistet werden.
Im Übrigen wird der Antrag auf Anordnung einer Sicherheitsleistung vom 21.10.2024 zurückgewiesen.
2. Gegen die Anordnung unter Ziffer 1. kann gemäß Artikel 73 EPGÜ und Regel 220.2 EPGVerfO Berufung eingelegt werden.
3. Die Antragsgegnerin wird darauf hingewiesen, dass gemäß Regel 355 eine Ver-säumnisentscheidung ergehen kann, wenn die Sicherheit nicht innerhalb der ge-mäß Ziffer 1 dieser Anordnung festgelegten Frist geleistet wird.
4. Der Antrag der Antragsgegnerin auf Gewährung von Prozesskostenhilfe wird ab-gelehnt.
5. Gegen die Ablehnung der Gewährung von Prozesskostenhilfe kann beim Beru-fungsgericht Berufung eingelegt werden; die Berufung ist innerhalb eines Monats nach Erhalt der Anordnung beim Berufungsgericht einzulegen und muss den Vorgaben der Regeln 377 bis 379 entsprechen (Regel 381.1 EPGVerfO).

1. If a small enterprise reports an operating loss in its most recent annual financial statements and does not have sufficient assets available as security, security shall be ordered at the request of the opposing party in accordance with Rule 158 EPGVerfO.
2. When assessing the security, considerations of equity that will be relevant for the subsequent determination of costs must be taken into account. This is because the assessment of the security must be based on the costs to be determined in accordance with Article 69 UPCA; according to Article 69 UPCA, considerations of equity may preclude the bearing of costs in whole or in part.
3. The possibility of reducing fees or costs for the purpose of granting effective access to justice is a principle that determines EPG law. This must also be taken into account as a consideration of equity when assessing the security to be provided by a small business.
4. A party that is able to bear both its own costs (court fees and representation costs) and a security deposit set by the court is able to bear the costs. Legal aid cannot be granted in this case.

Facts
In its written submission of 21 October 2024, the applicant requested
that the court order the infringement claimant to provide, within 14 days, or alternatively within a period to be determined by the court, security in the amount of EUR 257,000.00 by way of deposit or bank guarantee for the costs of the legal dispute and other costs (Rule 158 RoP).
In support of its application, the applicant argued, inter alia, that the order to provide security was necessary because the plaintiff did not have sufficient financial resources. In its application, it referred in particular to the credit rating of Tokyo Shoko Research, according to which the respondent's creditworthiness for February 2024 had been rated at just 100 points, placing it in the category ‘some alert necessary’. In its statement of 22 January 2025, the applicant assessed the balance sheets submitted by the respondent at the court's request as indicating that the respondent's financial situation was precarious; Annex PB13a showed that the respondent had recently recorded an operating loss.
The security amount required from the applicant's point of view is calculated as follows:

The respondent requested that
the applicant's request be dismissed,
alternatively, that the security be reduced to a reasonable amount not exceeding , with the respondent being granted a reasonable period of at least four weeks to provide the security in the form of a guarantee.
The respondent has further requested that
the respondent be granted legal aid for the proceedings before the Unified Patent Court.
The respondent submitted its balance sheets for 2021, 2022 and 2023 and argued that its finances were balanced, stable and reliable.
There were no payment difficulties. The respondent justified its application for legal aid on the grounds that, under Article 47 of the EU Charter of Fundamental Rights and Article 6 of the European Convention on Human Rights (ECHR), even small businesses have the right to access court proceedings; this also applies before the UPC.
It is also in need of assistance because it is unable to bear the costs of the proceedings from its own resources if an excessive, in any case exorbitant, security deposit (€260,000) is ordered. As proof of its need for assistance, the respondent referred to the balance sheets submitted.
With regard to the respondent's application for legal aid, the applicant
requested that
the application for legal aid be dismissed. In support of its application, the applicant argued that the respondent was not a natural person, which was necessary under Article 71 UPCA in order to obtain legal aid.
Reasons
A.
A security deposit must be ordered.
1. Pursuant to Rule 158.1 EPGVerfO, the court may, at any stage of the proceedings, upon a reasoned request by one party, order the other party to provide adequate security within a specified period for the costs of the proceedings and other costs incurred and/or
yet to be incurred by the requesting party which the other party may have to bear.
2. The rapporteur has granted the parties a legal hearing in accordance with Rule 158.2 EPGVerfO.
3. According to the case law of the Court of Appeal (UPC_CoA_217/2024), with regard to an application for security for costs, it is sufficient for the applicant to demonstrate sufficiently what efforts have been made to find publicly available information about the financial situation of the respondent. The applicant has fulfilled these requirements by referring to the negative assessment of Tokyo Shoko Research (‘some alert necessary’) in its application.
4. Order to provide security The financial situation of the respondent justifies the ordering of security: Although the respondent has argued that the most recent balance sheets show gross profits of € (2022) and €
(2023), the annual financial statements (profit and loss account) for the period from 01/10/2022 to 30/09/2022 submitted as Annex PB13a show a loss of €

(converted. However, the annual surplus calculated in this way does not justify rejecting the request for an order to provide security, as it does not even come close to covering the applicant's expected costs for the first instance.
However, it must be taken into account that the respondent suffered an operating loss in the period in question, so that the respondent's economic situation must be assessed as strained; the annual financial statements for the period up to also do not indicate that the respondent currently has assets that would justify rejecting the request for an order to provide security.
The respondent's financial situation, which is to be regarded as strained, is confirmed by its application for legal aid.
5. Amount of the security
The amount of the security is determined by the costs of the legal dispute and the other costs incurred and/or still to be incurred by the applicant which the other party may have to bear (Rule 158.1 EPGVerfO). According to Art. 69(1) UPCA, the costs of the proceedings and other costs incurred by the successful party shall, as a rule, be borne by the unsuccessful party, insofar as they are
reasonable and appropriate, up to a maximum amount determined in accordance with the Rules of Procedure, unless equity and fairness dictate otherwise.
a. Security for the applicant's costs
The upper limit for the amount in dispute in this case, which is €500,000.00 for the infringement action and a further €500,000.00 for the counterclaim for annulment, is €112,000.00 for the first instance and a further €112,000.00 in the event of an appeal, in accordance with the table of the Administrative Committee for the upper limits for reimbursable costs resulting from the amount in dispute.000.00 for the first instance and a further €112,000.00 in the event of an appeal.
b. Security for court costs
With regard to court costs, €11,000.00 is to be set for the counterclaim for annulment and the respective appeal in accordance with Rule 159 EPGVerfO.
c. Reasons of equity
Pursuant to Art. 69 UPCA, costs in the amount of the aforementioned amounts can only be determined if reasons of equity do not preclude this. Since the assessment of the security deposit is based on the costs to be determined pursuant to Art. 69 UPCA, reasons of equity relevant to the determination of costs must also be taken into account for the security deposit.
The UPCA leaves open what constitutes grounds of equity for a reduced determination of costs with regard to the aforementioned court fees or upper limits for representation costs. Both the UPCA (Art. 36(3)) and the EPGVerfO (Rule 370.8, Rule 376A.2 in conjunction with the Administrative Committee's decision on legal aid of 27 September 2023) show, however, that at least in the case of small and medium-sized enterprises (SMEs) and private individuals in need, an interaction between the amount of court fees or the amount of reimbursable costs of representation and the principle of effective access to justice must be recognised. The aforementioned regulations therefore provide for fee reductions of 50% and 40% respectively in order to ensure effective access to justice. The requirement expressed therein for a reduction in fees or costs for the purpose of granting fair access to justice is a principle of EPG law which must also be taken into account as an equitable consideration when assessing the security to be provided. The UPCA and the Rules of Procedure of the EPG thus guarantee the right to a fair trial (Article 6 of the ECHR). Although the ECHR does not require free access to justice, when assessing the costs to be borne and advances to be paid, care must be taken to ensure that these are not unreasonably high and do not have a deterrent effect on those concerned (ECHR 19 June 2001 – 28249/95, para. 57 et seq.); the same applies to security deposits.

The respondent is, according to Commission Recommendation 2003/361/EC of 6 May 2003 concerning the definition of micro, small and medium-sized enterprises (OJ L 124, 20.5.2003, p. 36; for the application of this recommendation, see ECJ, judgment of 10 March 2021 – C-572/19 P). In particular in the case of small undertakings, care must be taken to ensure effective access to justice. Any security required must therefore be calculated in such a way that effective access to justice is possible and the company's action is not dismissed by default because it is unable to provide security (Rule 158.5 EPGVerfO).
In view of this, the security required is calculated and set as follows:
aa. For reasons of fairness, no provision is currently made for security for the costs of the appeal proceedings. Although the costs of the appeal proceedings are also costs of the legal dispute (Rule 158.1 EPG-VerfO), which can in principle be taken into account when determining the security in the first instance, this is not the case here. However, since it is not yet certain whether a first-instance decision will be appealed and the applicant can, in this case, file a further request for security (‘... the court may, at any stage of the proceedings ...’), for reasons of fairness, no decision is made at this stage on whether any representation costs and court fees for a second instance should be included in the security to be determined. This is also in line with the legal principle of legal aid law, according to which a new application must be made in the event of an appeal (Rule 378.4 EPGVerfO).
bb. Also for reasons of fairness, the reimbursable costs of representation for the first instance are set at 50% of the upper limit of the reimbursement amount pursuant to Rule 376A.2 EPGVerfO in conjunction with the decision of the Administrative Committee on legal aid of 27 September 2023 at 50% of the upper limit of the reimbursable costs (50% of €112,000.00 = €56,000.00). It is expressly pointed out that this is merely a discretionary decision within the scope of the application for security, which is not prejudicial to a subsequent determination of costs.
cc. A security for the court fees for the counterclaim for annulment
is set at 60% in accordance with Rule 370.8 EPGVerfO
(60% of €11,000.00 = €6,600.00).
dd. In the absence of any indications to the contrary, the rapporteur assumes
that the security ordered can be provided by the respondent, who, in its
subsidiary application, has indicated a slightly lower amount than is reasonable
and feasible.
6. Deadline for providing security
According to its alternative application, the respondent has declared a period of four weeks to be reasonable.
In the court's view, this is not objectionable.
B.
The application for legal aid is to be rejected.
1. The fundamental question of whether companies are also entitled to legal aid before the EPG on the basis of the EU Charter of Fundamental Rights and the European Convention on Human Rights, even though Article 71(1) of the ECHR does not expressly provide for this, must be examined.

2. The respondent may be in a difficult economic situation, but despite the economic situation presented in the balance sheets submitted, it is apparently able to pay both the court fees for the infringement action and the costs of its representation.
Access to justice (in this case in the form of filing a patent infringement action with the EPG) was and is readily available to the respondent; she did not apply for legal aid in view of her own costs.
According to its own submission, the respondent is supported in its action by a litigation financier; it has not argued that it requires legal aid in view of its own costs (court fees for the infringement action, costs of its representation).
Insofar as the respondent has justified its application for legal aid on the grounds that it is not in a position to bear the costs of the proceedings from its own resources if an excessive, in any case exorbitant, security deposit (€260,000) is ordered, the granting of legal aid is also not warranted: The rapporteur has ordered a security deposit which, in view of the respondent's own submissions, can be assumed to be within her means; in her alternative request concerning the applicant's request for an order for a security deposit, the respondent clearly stated that she is able to provide a security deposit in the form of a bank guarantee.
The security ordered is only slightly higher than this amount. It is not apparent that the respondent is unable to provide this amount, either by deposit or in the form of a bank guarantee.
Order
1. The defendant (plaintiff in the infringement proceedings) is ordered to provide security in the amount of €62,600.00 by 24 February 2025. The security may be provided either
- by an irrevocable, unconditional, unlimited and directly enforceable guarantee on first demand from a bank established in the territory of the EPG member states and authorised to conduct business
or
- by depositing the security amount in the account set up for this purpose by the Unified Patent Court (specified in section 3 on the website www.unified-patent-court.org/de/court/payments).
In all other respects, the request for an order to provide security dated 21 October 2024 is dismissed.
2. An appeal may be lodged against the order in point 1 in accordance with Article 73 UPCA and Rule 220.2 EPGVerfO.
3. The respondent is advised that, pursuant to Rule 355, a default judgment may be rendered if the security is not provided within the time limit specified in point 1 of this order.
4. The respondent's application for legal aid is rejected.
5. An appeal may be lodged with the Court of Appeal against the refusal to grant legal aid; the appeal must be lodged with the Court of Appeal within one month of receipt of the order and must comply with the requirements of Rules 377 to 379 (Rule 381.1 EPGVerfO).
