Kostenfestsetzungsantrag und dessen Rücknahme

VERFAHRENSGANG
Die Klägerin hatte die Beklagten vor der Lokalkammer Hamburg wegen angeblicher Verletzung des Streitpatents in Anspruch genommen (ACT_463258/2023 UPC_CFI_54/2023). Die Beklagten hatten daraufhin jeweils Widerklage auf Nichtigerklärung des Streitpatents erhoben (CC_577764/2023 und CC_577767/2023).
Mit Entscheidung vom 26 August 2024 hat die Kammer die Verletzungsklage abgewiesen und der Nichtigkeitswiderklage teilweise stattgegeben (ACT_463258/2023, CC_577764/2023 und CC_577767/2023) und zwar das Streitpatent, soweit sein Gegenstand über Anspruch 1 in der Fassung des Hilfsanspruchs 1 unter Streichung von Anspruch 3 hinausgeht, für nichtig erklärt; im Übrigen hat die Kammer die Widerklage abgewiesen. Hinsichtlich der Kosten hat die Kammer entschieden, dass von den Kosten des Rechtsstreits die Klägerin 85% und die Beklagten 15% zu tragen haben.
Die Beklagten haben mit fristgerechtem Antrag vom 26.09.2024 beantragt, die zu erstattenden Kosten der Beklagten in im Antrag näher bezifferten Höhe festzusetzen (App_53238/2024). Die Klägerin ist dem Antrag entgegengetreten. Nachfolgend hat die Klägerin gegen die Endentscheidung der Kammer in der Sache und der darin enthaltenen Kostengrundentscheidung Berufung eingelegt. Der Berichterstatter hat daraufhin mit Ordnung vom 06 Dezember 2024 bei den Parteien angefragt, ob das Kostenfestsetzungsverfahren bis zum Abschluss der Berufung ausgesetzt werden kann nach R. 295 VerfO.
Im laufenden Berufungsverfahren haben die Parteien mit Schriftsätzen vom 17. und 18. Dezember 2024 beantragt, die Rücknahme aller Klage- und Widerklageanträge zuzulassen, einschließlich des Antrags auf Änderung des Patents, und wechselseitig die Zustimmung zur Rücknahme der anderen Seite erklärt. Systembedingt ist dabei die Einreichung im CMS zunächst überwiegend über die Workflows der erstinstanzlichen Verfahren bei der Kammer erfolgt, da eine Einreichung über die Workflows der Berufungsverfahren bei dem Berufungsgericht teilweise nicht möglich war.
Die Beklagten haben auch die Zulassung der Rücknahme ihres Kostenfestsetzungsantrags beantragt (App_ 66712/2024). Die Klägerin hat der Rücknahme des Kostenfestsetzungsantrags zugestimmt (App_67037/2024).
Die Beklagten beantragen,
die Rücknahme des Kostenfestsetzungsantrags zuzulassen und das Kostenfestsetzungsverfahren für beendet zu erklären.

GRÜNDE DER ANORDNUNG
Befindet sich ein Verfahren in der Berufungsinstanz ist das Berufungsgericht für die Entscheidung über die Zulassung der Rücknahmeanträge zuständig, das heißt für die Rücknahme von Klage und Widerklage in der Berufungsinstanz. Die Rücknahme der Klage beendet in dem Fall, in dem wie hier Berufung eingelegt wurde, das Berufungsverfahren. Daher ist das Berufungsgericht befugt, im Falle der Zulassung der Rücknahme das Verfahren gemäß R. 265.2 (a) VerfO für beendet zu erklären und eine Kostenentscheidung zu treffen (CoA, 15.01.2025 - UPC_CoA_629/2024, APL_58696/2024).
Etwas anderes gilt indes für den Antrag auf Festsetzung der zu erstattenden Kosten nach Regeln 150 ff. VerfO. Dieser ist gegenwärtig noch in erster Instanz anhängig, mit der Folge, dass die Zuständigkeit für die Zulassung dessen Rücknahme noch beim Gericht erster Instanz verblieben ist und zwar nach dem Regelwerk zum Kostenfestsetzungsverfahren beim Berichterstatter. Auch im Kostenfestsetzungsverfahren ist die Zulassung von Anträgen selbstverständlich möglich, bedarf jedoch ihrerseits der Zulassung durch das Gericht. Dies ergibt sich daraus, dass es sich bei der Regelung zur Zulassung einer Rücknahme nach Regel 265 VerfO um eine Regelung in Kapitel 5 Teil 1 handelt, die sich mit „Allgemeinen Bestimmungen“ befassen und „Allgemeinen Verfahrensvorschriften“ im Speziellen zum Gegenstand haben. Regel 265 VerfO ist jedenfalls entsprechend auch auf das Kostenfestsetzungsverfahren anwendbar, auch wenn keine ausdrückliche Verweisung auf diese Regel verankert ist.
Da es sich nicht um eine Maßnahme der Verfahrensleitung nach Regeln 331 ff VerfO handelt, sondern um eine Sachentscheidung in originärer Kompetenz des Berichterstatters nach Regel 156.2 VerfO, ist der Berichterstatter auch für die Zulassung der Rücknahme originär und allein zuständig. Insoweit füllt Regel 156.2 VerfO als speziellere Regelung den Begriff „das Gericht“ in der der allgemeinen Regelung der Regel 265 VerfO näher aus bzw. geht dieser vor.

1. Die Rücknahme des Kostenfestsetzungsantrags wird zugelassen
2. Das Kostenfestsetzungsverfahren wird für beendet erklärt.
3. Die Entscheidung wird in das Register aufgenommen.

PROCEEDINGS
The plaintiff had brought an action against the defendants before the Local Division in Hamburg for alleged infringement of the patent in suit (ACT_463258/2023 UPC_CFI_54/2023). The defendants then filed counterclaims for a declaration of invalidity of the patent in suit (CC_577764/2023 and CC_577767/2023).

In its decision of 26 August 2024, the Chamber dismissed the infringement action and partially upheld the counterclaim for annulment (ACT_463258/2023, CC_577764/2023 and CC_577767/2023) and declared the patent in suit invalid insofar as its subject matter extends beyond claim 1 as amended by auxiliary claim 1, with the deletion of claim 3; in all other respects, the Chamber dismissed the counterclaim. With regard to costs, the Chamber ruled that the plaintiff shall bear 85% of the costs of the proceedings and the defendants 15%.
The defendants filed a timely request on 26 September 2024 to have the costs to be reimbursed to the defendants set at the amount specified in the request (App_53238/2024). The plaintiff opposed the request. The plaintiff subsequently lodged an appeal against the Chamber's final decision on the merits and the decision on costs contained therein. The rapporteur then asked the parties, by order of 6 December 2024, whether the costs determination proceedings could be suspended until the appeal had been concluded in accordance with R. 295 RoP.

In the ongoing appeal proceedings, the parties requested in their written submissions of 17 and 18 December 2024 that all claims and counterclaims be withdrawn, including the request for amendment of the patent, and mutually declared their consent to the withdrawal of the other party's claims. Due to the system, most of the submissions in the CMS were initially made via the workflows of the first-instance proceedings at the Chamber, as it was not possible in some cases to submit them via the workflows of the appeal proceedings at the Appeal Court.
The defendants also applied for leave to withdraw their application for a determination of costs (App_ 66712/2024). The plaintiff agreed to the withdrawal of the application for a determination of costs (App_67037/2024).
The defendants request that
the withdrawal of the application for a determination of costs be allowed and that the proceedings for the determination of costs be declared terminated.


REASONS FOR THE ORDER
If proceedings are pending before the court of appeal, the court of appeal has jurisdiction to decide on applications for withdrawal, i.e. for the withdrawal of the claim and counterclaim in the appeal proceedings. In cases such as the present one, where an appeal has been lodged, the withdrawal of the claim terminates the appeal proceedings. Therefore, if the withdrawal is allowed, the Court of Appeal is authorised to declare the proceedings closed in accordance with Rule 265(2)(a) RoP and to make a decision on costs (CoA, 15 January 2025 - UPC_CoA_629/2024, APL_58696/2024).

However, this does not apply to the request for the determination of the costs to be reimbursed under Rules 150 et seq. RoP. This is currently still pending in the first instance, with the result that the competence for granting leave to withdraw it remains with the court of first instance, namely with the rapporteur in accordance with the rules governing the procedure for determining costs. In the costs assessment proceedings, too, the admission of requests is of course possible, but requires the court's approval. This follows from the fact that the provision on the admission of a withdrawal under Rule 265 VerfO is a provision in Chapter 5, Part 1, which deals with ‘General provisions’ and specifically with ‘General procedural rules’. Rule 265 RoP is in any case applicable mutatis mutandis to the costs determination proceedings, even if no express reference to this rule is made.

Since this is not a procedural measure pursuant to Rules 331 et seq. of the Rules of Procedure, but rather a decision on the merits falling within the original jurisdiction of the rapporteur pursuant to Rule 156.2 of the Rules of Procedure, the rapporteur also has original and sole jurisdiction to grant leave to withdraw. In this respect, Rule 156.2 RoP, as a more specific provision, clarifies the term ‘the court’ in the general provision of Rule 265 RoP and takes precedence over it.

ORDER
1. The withdrawal of the application for a determination of costs is permitted.
2. The proceedings for the determination of costs are declared closed.
3. The decision shall be entered in the register.
