Rücknahme Antrag auf einstweilige Maßnahmen – R. 265 VerfO
KURZE DARSTELLUNG DES SACHVERHALTS
Die Antragstellerin beantragte mit Schriftsatz vom 29.11.2024 den Erlass einstweiliger Maßnahmen. Am 09.12.2024 erließ das Gericht ohne Anhörung der Antragsgegnerin eine Anordnung. Die Anordnung ist der Antragsgegnerin (bislang) nicht zugestellt worden.
Mit Schriftsatz vom 03.01.2025 erklärte die Antragstellerin die Rücknahme des Antrags auf Erlass einstweiliger Maßnahmen. Die Antragstellerin bittet darum, die Rücknahme, entsprechend dem Vorgehen bei der Anordnung vom 09.12.2024, ohne Anhörung der Antragsgegnerin zuzulassen. Da die Zustellung an die Antragsgegnerin noch nicht erfolgt sei, sich auch niemand für die Antragsgegnerin bestellt habe und die Antragsgegnerin auch nicht anderweitig Kenntnis von der Anordnung der Lokalkammer Kenntnis erlangt habe, wäre eine vorherige Anhörung nicht sinnvoll möglich. Ein berechtigtes Interesse der Antragsgegnerin, das hiesige Verfahren fortzusetzen, sei auch nicht ersichtlich.
Die Antragstellerin beantragt:
Die Rücknahme des Antrags auf einstweilige Maßnahmen wird zugelassen und das Verfahren wird gemäß Regel 265.1, 2 VerfO für beendet erklärt.
GRÜNDE DER ANORDNUNG
I.
Die Rücknahme des Antrags auf einstweilige Maßnahmen ist gem. Regel 265.1 VerfO zulassen. Die Voraussetzungen dieser Norm sind gegeben.
Klage im Sinne der Regel 265.1 VerfO ist auch ein Antrag auf Erlass einstweiliger Maßnahmen.
Die Antragsrücknahme ist seitens der Antragstellerin zudem vor Erlass einer Endentscheidung erklärt worden. Die Anordnung vom 09.12.2024 steht dem nicht entgegen. Die Anordnung vom 09.12.2024 erging gem. Regel 212.1 VerfO ohne Anhörung der Antragsgegnerin, weshalb der Antragsgegnerin entsprechend Regel 212.3 VerfO das Recht auf Prüfung der Anordnung zusteht. Da die Anordnung vom 09.12.2024 bislang nicht zugestellt worden ist, hat die Frist zur Überprüfung noch nicht zu laufen begonnen. Demzufolge ist die Anordnung vom 09.12.2024 keine die Instanz beendende Entscheidung.
Berechtigte Interessen der Antragsgegnerin im Sinne der Regel 265.1 S. 3 VerfO, die der Zulassung der Rücknahme entgegenstehen könnten, sind weder vorgetragen noch sonst wie ersichtlich. Die Anordnung vom 09.12.2024 ist ohne Anhörung der Antragsgegnerin ergangen, weshalb diese bislang nicht aktiv am Verfahren beteiligt gewesen ist. Die Anordnung vom 09.12.2024 ist zudem mangels Zustellung bislang nicht vollzogen worden.
Angesichts dessen bedurfte es auch keiner Anhörung der Antragsgegnerin gem. Regel 265.1 S. 2 VerfO.
II.
Folge der Zulassung der Rücknahme ist nach Regel 265.2 (a) und (b) VerfO die Beendigung des Verfahrens sowie die Aufnahme der Entscheidung in das Register. Nach Regel 265.2 (c) VerfO hat das Gericht zudem bei Zulassung einer Rücknahme eine Kostentscheidung gemäß Teil 1 Kapitel 5 zu treffen. Angesichts dessen hat die Antragstellerin infolge der Rücknahme die Kosten des Verfahrens auf Erlass einstweiliger Maßnahmen zu tragen.
ANORDNUNG
1. Die Rücknahme des Antrags auf Erlass einstweiliger Maßnahmen wird zugelassen.
2. Das Verfahren wird für beendet erklärt.
3. Diese Entscheidung ist in das Register aufzunehmen.
4. Die Antragstellerin trägt die Kosten des Verfahrens.

BRIEF STATEMENT OF THE FACTS
The applicant applied for interim measures by written submission dated 29 November 2024. On 9 December 2024, the court issued an order without hearing the respondent. The order has not (yet) been served on the respondent.
In a written submission dated 3 January 2025, the applicant declared that it was withdrawing its application for interim measures. The applicant requests that the withdrawal be allowed without hearing the respondent, in accordance with the procedure followed in the order of 9 December 2024. Since service on the respondent has not yet been effected, no one has appointed a representative for the respondent, and the respondent has not otherwise become aware of the order of the Local Division, a prior hearing would not be reasonably possible. Nor is there any apparent legitimate interest on the part of the respondent in continuing the present proceedings.
The applicant requests:
The withdrawal of the application for interim measures is granted and the proceedings are declared closed in accordance with Rule 265.1, 2 RoP.
REASONS FOR THE ORDER
I.
The withdrawal of the application for interim measures is to be granted in accordance with Rule 265.1 RoP. The requirements of this provision are met.
An action within the meaning of Rule 265.1 RoP also includes an application for interim measures.
The applicant also declared the withdrawal of the application before a final decision was issued. The order of 9 December 2024 does not preclude this. The order of 9 December 2024 was issued pursuant to Rule 212.1 RoP without hearing the respondent, which is why the respondent is entitled to review the order pursuant to Rule 212.3 RoP. As the order of 9 December 2024 has not yet been served, the period for review has not yet begun to run. Consequently, the order of 9 December 2024 is not a decision that ends the proceedings.
No legitimate interests of the respondent within the meaning of Rule 265.1 sentence 3 RoP that could preclude the admission of the withdrawal have been put forward or are otherwise apparent. The order of 9 December 2024 was issued without hearing the respondent, which is why the latter has not yet been actively involved in the proceedings. Furthermore, the order of 9 December 2024 has not yet been enforced due to lack of service.
In view of this, there was no need to hear the respondent pursuant to Rule 265.1 sentence 2 RoP.
II.
Pursuant to Rule 265.2 (a) and (b) RoP, the consequence of the admission of the withdrawal is the termination of the proceedings and the entry of the decision in the register.
Pursuant to Rule 265.2 (c) RoP, the court must also decide on costs in accordance with Part 1, Chapter 5 when granting a withdrawal. In view of this, the applicant shall bear the costs of the proceedings for the interim measures as a result of the withdrawal.
ORDER
1. The withdrawal of the application for interim measures is granted.
2. The proceedings are declared closed.
3. This decision shall be entered in the register.
4. The applicant shall bear the costs of the proceedings.
