GEGENSTAND
Verletzungsklage mit Nichtigkeitswiderklagen – Anträge auf Rücknahme der Klage und der Nichtigkeitswiderklagen – Regel 265 VerfO

ANTRÄGE DER PARTEIEN
Die Klägerin beantragt Zulassung der Rücknahme der Klage und stimmt der Rücknahme der Nichtigkeitswiderklagen zu.
Die Beklagten beantragen Zulassung der Rücknahme der Widerklagen und stimmen der Rücknahme der Klage zu.

GRÜNDE
Eine Rücknahme ist bis zum Eintritt der Rechtskraft und daher auch nach Erlass einer erstinstanzlichen aber noch nicht rechtskräftigen Entscheidung möglich. Vorliegend ist die Entscheidung vom 18. Dezember 2024 noch nicht rechtskräftig.
Aufgrund der Einigung der Parteien ist die Rücknahme zu gestatten. Eine Rückzahlung von Gerichtsgebühren findet aufgrund des Zeitpunkts der Rücknahmeerklärungen nicht statt.
Gemäß Regel 265.2(c) VerfO erlässt das Gericht bei Zulassung der Rücknahme eine Kostenentscheidung gemäß Teil 1, Kapitel 5. Ein Antrag einer Partei ist in dieser Hinsicht nicht erforderlich. Das gegenseitige Einvernehmen der Parteien kann bei der Kostenentscheidung berücksichtigt werden.

ANORDNUNG
1. Den Anträgen auf Zulassung der Rücknahme der Verletzungsklage ACT_459771/2023 UPC_CFI_9/2023 und der Nichtigkeitswiderklagen CC_588071/2023, CC_588080/2023 und CC_586627/2023 (inklusive der Anträge auf Änderung des Patents APP_9258/2024, APP_9258/2024 und APP_9258/2024) wird stattgegeben.
2. Die Verfahren betreffend die Verletzungsklage ACT_459771/2023 UPC_CFI_9/2023 und der Nichtigkeitswiderklagen CC_588071/2023, CC_588080/2023 und CC_586627/2023 (inklusive der Anträge auf Änderung des Patents APP_9258/2024, APP_9258/2024 und APP_9258/2024) werden für beendet erklärt.
3. Diese Entscheidung ist in das Register aufzunehmen.
4. Jeder Partei trägt ihre Kosten selbst. Zwischen den Parteien findet keine hier zu regelnde Kostenerstattung statt.
5. Die Klagepartei und die beklagte Partei erhalten keine Erstattung der jeweils einbezahlten Gerichtsgebühren für die Klage bzw. die Widerklagen.

Infringement action with counterclaims for annulment – Requests for withdrawal of the action and the counterclaims for annulment – Rule 265 RoP

REQUESTS OF THE PARTIES
The plaintiff requests that the withdrawal of the action be allowed and agrees to the withdrawal of the counterclaims for annulment.

The defendants request that the counterclaims be withdrawn and agree to the withdrawal of the action.

REASONS

Withdrawal is possible until the decision becomes final and therefore also after a first-instance decision has been issued but is not yet final. In the present case, the decision of 18 December 2024 is not yet final.

Based on the agreement between the parties, the withdrawal must be allowed. No court fees will be refunded due to the timing of the withdrawal declarations.
In accordance with Rule 265.2(c) RoP, the court will issue a decision on costs in accordance with Part 1, Chapter 5 upon granting the withdrawal. A request by a party is not required in this regard.
The mutual agreement of the parties may be taken into account in the decision on costs.

ORDER
1. The requests for leave to withdraw the infringement action ACT_459771/2023 UPC_CFI_9/2023 and the counterclaims for a declaration of invalidity CC_588071/2023, CC_588080/2023 and CC_586627/2023 (including the requests for amendment of the patent APP_9258/2024, APP_9258/2024 and APP_9258/2024) are granted.

2. The proceedings concerning the infringement action ACT_459771/2023 UPC_CFI_9/2023 and the counterclaims for annulment CC_588071/2023, CC_588080/2023 and CC_586627/2023 (including the requests for amendment of patents APP_9258/2024, APP_9258/2024 and APP_9258/2024) are declared closed.

3. This decision shall be entered in the register.
4. Each party shall bear its own costs. There shall be no reimbursement of costs between the parties to be settled here.
5. The plaintiff and the defendant shall not be reimbursed for the court fees paid for the action or the counterclaims.
