Anordnung
des Gerichts erster Instanz des Einheitlichen Patentgerichts

Leitsätze:
1. Möchte der Kläger die nach Art. 67 EPGÜ zu erteilende Auskunft in elektronischer Form erhalten, muss dies konkret beantragt werden. Lässt der Urteilsausspruch offen, ob eine Auskunft in Papierform oder elektronisch erteilt werden soll, kann die Auskunft grundsätzlich wahlweise in einer der beiden Formen erteilt werden.
2. Das nach Art. 82 EPGÜ festzusetzende Zwangsgeld hat sowohl Beuge- als auch Straffunktion. Ein Zwangsgeld kann daher nicht nur verhängt werden, um die Befolgung einer Anordnung zu erzwingen, sondern auch, um die Nichtbefolgung einer gerichtlichen Anordnung in der Vergangenheit zu bestrafen.

VERFAHRENSSPRACHE: DEUTSCH
Sachverhalt
Die Lokalkammer hat die Antragsgegnerinnen mit Hauptsachentscheidung vom 13.09.2024 wegen Patentverletzung unter anderem dazu verurteilt,
B. II. der Klägerin darüber Auskunft zu erteilen, in welchem Umfang sie die zu B.I. bezeichneten Handlungen seit dem 28. Dezember 2016 begangen haben, und zwar unter Angabe
1. des Ursprungs und der Vertriebswege der unter Ziffer B.I. genannten Erzeugnisse unter Nennung
a. der Namen und Anschriften der Lieferanten und anderer Vorbesitzer, und
b. der Namen und Anschriften der gewerblichen Abnehmer sowie der Verkaufsstellen, für die die Erzeugnisse bestimmt waren;
2. der Menge der ausgelieferten, erhaltenen oder bestellten Erzeugnisse sowie der Preise, die für die betreffenden Erzeugnisse bezahlt wurden; und
3. der Identität aller an dem Vertrieb der in Ziffer B.I. genannten Erzeugnissen beteilig-ten dritten Personen,
wobei zum Nachweis der Angaben die entsprechenden Kaufbelege (nämlich Rechnungen, hilfs-weise Lieferscheine) in Kopie vorzulegen sind, wobei geheimhaltungsbedürftige Details außer-halb der auskunftspflichtigen Daten geschwärzt werden dürfen;
H. Im Falle jeder Zuwiderhandlung gegen die Anordnungen nach Ziffern B.I und D haben die jeweiligen Beklagte ein Zwangsgeld in Höhe von bis zu EUR 100.000 für jeden Tag der Zuwiderhandlung an das Gericht zu zahlen; bei Zuwiderhandlungen gegen die Anordnun-gen gem. Ziffer B.II beträgt das Zwangsgeld bis zu EUR 50.000 für jeden Tag der Zuwider-handlung.
K. Das Urteil ist für die Klägerin ohne Leistung einer Sicherheit vorläufig vollstreckbar.
Die Antragstellerin hat gegenüber den Antragsgegnerinnen mit Schreiben vom 20.09.2024 gemäß R. 118.8 EPGVerfO angezeigt, dass sie die Entscheidung in vollem Umfang vollstrecken wird. Sie hat die Antragsgegnerinnen aufgefordert, die nach Ziffer B.II. der Entscheidung geschuldete Auskunft im ausgeurteilten Umfang bis zum 7. Ok-tober 2024 zu erteilen.
Mit Schriftsatz vom 07.10.2024 (App_ 52799/2024; Mitteilung der Vollstreckungsab-sicht der Antragstellerin nach Regel 118.8 EPGVerfO) gaben die Antragsgegnerinnen eine Stellungnahme zur Vollstreckungsankündigung ab. In diesem Zusammenhang wurde unter anderem mitgeteilt, dass im Fall einer Zurückweisung des Antrags der Antragsgegnerinnen auf aufschiebende Wirkung (App_ 53031/2024 UPC_CoA_549/2024), innerhalb einer Woche nach Zustellung der entsprechenden Entscheidung des Berufungsgerichts Auskunft erteilt werde.
Mit Anordnung vom 30.10.2024 hat das Berufungsgericht den Antrag auf aufschie-bende Wirkung im Hinblick auf die Antragsgegnerinnen zurückgewiesen. Diese Anord-nung wurde den Parteien am 30.10.2024 zugestellt.
Mit Schriftsatz vom 11.11.2024 hat die Antragstellerin einen Antrag auf Festsetzung von Zwangsgeld eingereicht.
Mit Schreiben vom 12.11.2024 erfolgte eine Auskunftserteilung der Antragsgegnerin-nen in Papierform: Den Prozessbevollmächtigten der Antragstellerin wurden – wie nachfolgend abgebildet – 16 Kartons (DIN A4) mit ausgedruckten Rechnungen sowie ein Karton (DIN A3) mit einer ausgedruckten Tabelle überreicht. Hierzu wurde ein 1,5-seitiges, mit „Rechnungslegung“ überschriebenes Schreiben (Anlage AG-ZV 1) vorge-legt.
Mit Schriftsatz vom 25.11.2024 hat die Antragstellerin moniert, dass die Auskunft nicht vollständig erteilt wurde. So fehlten etwa Angaben dazu, zu welchem Preis die Beklag-ten die Verletzungsprodukte von ihren Herstellerinnen bezogenen haben, vollständig; das Schreiben der Antragsgegnerinnen vom 12. November 2024 führe lediglich die Namen der Hersteller auf.
Die Antragstellerin ist der Ansicht, dass die Auskunft elektronisch hätte erteilt werden müssen. Dies sei nicht geschehen. Die vorgelegte Auskunft mache eine Auswertung unmöglich. Der Auskunftsanspruch sei auch deshalb noch nicht erfüllt, weil nach wie vor bestimmte Angaben fehlten (Beispiel: Bezugspreise). Die Auskunft sei auch mit Blick auf bestimmte Werte in den mit der Auskunft gelieferten Tabellen („UNIT_PRICE_LOCA“) nicht nachvollziehbar.
Die Antragstellerin hat b e a n t r a g t,
gegen die Antragsgegnerinnen für die Nichtbefolgung der Anordnung in Ziffer B.II. des Urteils des Gerichts erster Instanz des Einheitlichen Patentgerichts, Verfahrensnummer UPC_CFI_390/2023, erlassen am 13. September 2024, ein Zwangsgeld in Höhe von EUR 20.000 für jeden Tag seit dem 7. Oktober 2024 festzusetzen.
Hilfsweise:
1. gegen die Beklagten für jeden Tag seit dem 7. Oktober 2024 bis zur vollstän-digen Erfüllung der mit Urteil der Kammer vom 13. September 2024 zu Ziffer B.II. ausgesprochenen Auskunftsverpflichtung ein Zwangsgeld festzusetzen, dessen Höhe ins Ermessen des Gerichts gestellt wird;
weiter hilfsweise:
2. gegen die Beklagten für jeden Tag im Zeitraum vom 7. Oktober 2024 bis zum 12. November 2024 ein Zwangsgeld festzusetzen, dessen Höhe ins Ermessen des Gerichts gestellt wird sowie
3. den Beklagten aufzugeben, der Klägerin die geschuldete Auskunft in einem vollständigen, geordneten Verzeichnis in elektronischer Form innerhalb einer vom Gericht festzusetzenden angemessenen Frist vorzulegen.
Die Antragsgegnerinnen haben b e a n t r a g t,
die Anträge zurückzuweisen.
Die Antragsgegnerinnen sind der Ansicht, die geschuldete Auskunft vollständig erteilt zu haben. Eine Vorlage in elektronischer Form sei nach dem Tenor der Hauptsache-entscheidung nicht geschuldet. Es sei zulässig gewesen, die Rechnungen teilweise zu schwärzen; dies sei allerdings nur manuell (also nicht elektronisch/digital) möglich ge-wesen, da die den Antragsgegnerinnen zur Verfügung stehende Software die weitge-hend eingescannten Rechnungen nicht habe verarbeiten können.
Im Übrigen wird auf den Vortrag der Parteien im Rahmen des workflow App_60589/2024 verwiesen.
Gründe
Der gemäß Art. 82 EPGÜ i.V.m. R. 354.4 VerfO zulässige Zwangsmittelantrag hat in der Sache überwiegend Erfolg. Die Antragsgegnerinnen haben gegen die gerichtliche Anordnung zur Auskunftserteilung zwar nicht in formeller, aber in zeitlicher und inhalt-licher Hinsicht verstoßen. Angesichts dessen war ein Zwangsgeld festzusetzen.
I. Erfüllung der Auskunftsverpflichtung in formeller Hinsicht
Gegen die Antragsgegnerinnen kann nicht deshalb ein Zwangsgeld festgesetzt werden, weil die Auskunft in Papierform und nicht in elektronischer Form erteilt wurde. Der unter Ziffer 3. gestellte Antrag war daher zurückzuweisen.
1. Weder Art. 67 EPGÜ noch die EPGVerfO enthalten spezifische Regelungen dazu, ob eine schriftlich zu erteilende Auskunft in elektronischer (digitaler) Form oder auf Papier zu leisten ist. Die Beantragung und Anordnung einer Auskunft in elektronischer Form ist allerdings nach dem insofern offenen Wortlaut von Art. 67 EPGÜ nicht ausgeschlossen. Nach Art. 76 Abs. 1 EPGÜ („…Maßgabe der von den Parteien gestellten Anträge…“) obliegt es der Klagepartei, den Antrag nach Art. 67 EPGÜ im Hinblick auf die gewünschte Form der Auskunftserteilung mög-lichst konkret zu fassen. Soll eine Auskunft (Art. 67 EPGÜ) in elektronischer Form erteilt werden, muss dies folglich konkret beantragt werden. Mangelt es dem An-trag an einer Bestimmung der Form, ist der Auskunftsantrag zwar insofern nicht wegen fehlender Bestimmtheit unzulässig; dem Schuldner der Auskunft steht es dann aber grundsätzlich frei, in welcher Form (elektronisch oder auf Papier) die Auskunft erteilt wird.
Art. 67 EPGÜ kann auch nicht zugunsten der Antragstellerseite dahin ausgelegt werden, dass einer tenorierten Auskunftsverpflichtung immer dann in elektroni-scher Form nachzukommen ist, wenn die Informationen beim Auskunftsschuld-ner in elektronischer Form vorliegen. Dafür gibt der technisch neutrale Wortlaut der Regelung keinen Anhalt; maßgeblich ist nach dem Wortlaut der Vorschrift al-lein, dass die genannten Informationen übermittelt werden. Die Lokalkammer hat in der von der Antragstellerin zitierten Passage der Entscheidung UPC_CFI_15/2023 auch nicht entschieden, dass eine Auskunft – unabhängig vom Wortlaut des entsprechenden Antrages – immer dann in elektronischer Form zu erteilen ist, wenn die Informationen beim Auskunftsschuldner in elektronischer Form vorliegen, zumal im fraglichen Fall nach dem Vortrag der Antragstellerin die Auskunftserteilung in elektronischer Form beantragt war.
Auch aus Art. 44 EPGÜ lässt sich eine Pflicht zur Auskunftserteilung in elektroni-scher Form nicht ableiten; dies schon deshalb, weil Normadressat des Art. 44 EPGÜ „das Gericht“ ist.
2. Das Erfordernis eines hinsichtlich der Form der Auskunftserteilung bestimmt ge-fassten Antrags und einer dementsprechend bestimmt gefassten gerichtlichen Anordnung ergibt sich auch aus unionsrechtlich geltenden Grundsätzen.
Auch für Maßnahmen wie die Verhängung eines Zwangsgeldes wegen Nichtbe-achtung einer gerichtlichen Anordnung ist der in Art. 7 EMRK, Art. 49 Abs. 1 GRCh positivierte unionsrechtliche Grundsatz des »nulla poena sine lege« zu beachten.
Daher setzt die Vollstreckung einer Anordnung nach Regel 354.3 EPGVerfO (Zwangsgeldzahlungen bei Nichtbeachtung der Anordnung) voraus, dass die ge-richtliche Anordnung so bestimmt gefasst ist, dass ein Verstoß eindeutig festge-stellt werden kann. Steht etwa die Nichtbeachtung der Form der Auskunftsertei-lung in Rede, kann ein Zwangsgeld nur angeordnet werden, wenn die erforderli-che Form in der gerichtlichen Anordnung auch hinreichend bestimmt zum Aus-druck gebracht wurde; andernfalls kann ein Formverstoß nicht festgestellt wer-den.
3. Die Klägerin hat eine Auskunft in elektronischer Form nicht konkret beantragt. In ihrem Antrag heißt es, dass
„…entsprechenden Kaufbelege (nämlich Rechnungen, hilfsweise Liefer-scheine) in Kopie vorzulegen sind…“
Diesem Klageantrag entsprechend wurde in der Hauptsacheentscheidung nicht bestimmt, dass die Auskunft elektronisch zu erteilen ist. Kopien können sowohl analog als auch digital erstellt werden. Der Antrag und ihm folgend die Anordnung lassen dies offen. Die Antragsgegnerinnen haben Rechnungen in Papierform vor-gelegt. Der Umstand, dass die Rechnungen nicht in elektronischer Form, sondern in Papierform vorgelegt wurden, kann angesichts des Wortlauts der Anordnung nicht mit einem Zwangsgeld geahndet werden. Dies gilt auch angesichts der Tat-sache, dass die Rechnungen eingescannt waren, so dass es nahegelegen hätte, die Auskunft in elektronischer Form zu erteilen. Es besteht die Pflicht, der Anord-nung Folge zu leisten; es besteht innerhalb der Grenzen der Schikane keine Pflicht, etwas zu tun, das in der Anordnung nicht konkret gefordert wird, aber üblich oder naheliegend sein mag. Dass die Schuldnerinnen die Papierform nur zur Schikane der Gläubigerin gewählt haben, ist angesichts der von den Schuldnerinnen angebotenen Erklärung, dass die Rechnungen nur manuell (also nicht elektronisch/digital) geschwärzt werden konnten, im Rahmen des Zwangsgeld-verfahrens nicht nachweisbar.
II. Nichterfüllung der Auskunftsverpflichtung in zeitlicher Hinsicht
Gegen die Antragsgegnerinnen kann allerdings schon deshalb ein Zwangsgeld festgesetzt werden, weil die am 12.11.2024 geleistete Auskunft zu spät erfolgte.
Leistet eine Partei einer Anordnung des Gerichts nicht Folge, so kann sie mit an das Gericht zu zahlenden Zwangsgeldern belegt werden (Art. 82 Abs. 4 EPGÜ).
Die Antragsgegnerinnen haben der Anordnung der Lokalkammer zur Aus-kunftserteilung bis zum 12.11.2024 überhaupt nicht Folge geleistet. Der am 11.11.2024 gestellte Antrag auf Festsetzung eines Zwangsgeldes war daher in der Sache begründet. Dieser erste Versuch einer Auskunftserteilung vom 12.11.2024 erfolgte verspätet, war aber bei der Festsetzung der Höhe des Zwangsgeldes zu berücksichtigen.
1. Nach Regel 354.1 EPGVerfO sind Entscheidungen und Anordnungen des Ge-richts – vorbehaltlich der Regeln 118.8 und 352 – ab dem Tag ihrer Zustellung in jedem Vertragsmitgliedstaat unmittelbar vollstreckbar.
Die Entscheidung, mit der die Antragsgegnerinnen zur Erteilung einer Auskunft verurteilt wurden, wurde den Parteien am 13.09.2024 zugestellt.
2. Die Antragstellerin hat mit Schreiben vom 20.09.2024 gemäß R. 118.8 EPGVerfO angezeigt, dass sie die Entscheidung in vollem Umfang vollstrecken wird. Sie hat die Antragsgegnerinnen aufgefordert, die nach Ziffer B. II. der Entscheidung ge-schuldete Auskunft bis zum 07.10.2024 zu erteilen.
Soweit die Antragsgegnerinnen mitgeteilt haben, eine Auskunft erst innerhalb ei-ner Woche nach einer etwaigen Zurückweisung ihres Antrags auf aufschiebende Wirkung erteilen zu wollen, ist darauf hinzuweisen, dass weder der Antrag auf aufschiebende Wirkung eine solche aufschiebende Wirkung entfaltet noch die von den Antragsgegnerinnen eingelegte Berufung gegen die Entscheidung vom 13.09.2024 (Art. 74 Abs. 1 EPGÜ). Es bestand daher von Rechts wegen kein Grund, vor der Auskunftserteilung die Verbescheidung des Antrags auf aufschie-bende Wirkung durch das Berufungsgericht abzuwarten. Dies hätten die Antrags-gegnerinnen bei zutreffender rechtlicher Beratung auch wissen müssen.
Die Auskunft war folglich am 07.10.2024, also mehr als drei Wochen nach Zu-stellung des Urteils zu erteilen; einer Fristverlängerung hat die Antragstellerin nicht zugestimmt. Bis zum 07.10.2024 wurde keine Auskunft erteilt.
3. Mit Anordnung vom 30.10.2024 hat das Berufungsgericht den Antrag auf auf-schiebende Wirkung im Hinblick auf die Antragsgegnerinnen zurückgewiesen. Diese Anordnung wurde den Parteien am 30.10.2024 zugestellt. Die Auskunft wurde jedoch auch am 30.10.2024 nicht erteilt. Die Antragsgegnerinnen haben die Auskunft auch – entgegen ihrer eigenen Zusage – nicht innerhalb einer Wo-che nach Zustellung der Entscheidung des Berufungsgerichts über den Antrag auf aufschiebende Wirkung erteilt.
Da dies – soweit ersichtlich – die erste Entscheidung des EPG zur Frage ist, wann die in einer Hauptsacheentscheidung angeordnete Auskunft zu erteilen ist, sei den Antragsgegnerinnen ausnahmsweise zugestanden, dass sie mit der Aus-kunftserteilung bis zur Entscheidung des Berufungsgerichts zugewartet haben. Nicht zuzugestehen war den Antragsgegnerinnen allerdings, die Auskunftsertei-lung während dieses Zeitraums nicht weiter vorzubereiten, so dass diese auch mit Vorliegen der Entscheidung des Berufungsgerichts am 30.10.2024 nicht er-teilt werden konnte.
Am 30.10.2024 hätte die Auskunft in jedem Falle erteilt werden müssen. Die An-tragsgegnerinnen haben sie aber weder am 30.10.2024 noch – wie zugesagt – bis zum 06.11.2024, sondern erst am 12.11.2024 erteilt. Die Antragsgegnerinnen durften entgegen ihrer Ansicht angesichts der bereits verstrichenen Zeit auch nicht darauf vertrauen, von der Antragstellerin eine Fristverlängerung eingeräumt zu bekommen.
4. Es ist auch kein rechtfertigender und die Antragstellerinnen entschuldigender Grund für die seit dem 30.10.2024 überfällige und damit verspätet erteilte Aus-kunft ersichtlich:
Die Antragsgegnerinnen mussten – seit 2023 mit einer Verletzungsklage konfron-tiert – davon ausgehen, alsbald nach dem erstinstanzlichen Urteil diese Auskunft leisten zu müssen. Dies gilt auch und gerade in Anbetracht des Umfangs der zu erteilenden Auskunft. Dementsprechend waren die Antragsgegnerinnen gehal-ten, die Auskunftserteilung spätestens mit Zustellung der Entscheidung vom 13.09.2024 vorzubereiten. Dies ist offenbar nicht mit dem erforderlichen Nach-druck geschehen, ohne dass hierfür ein nachvollziehbarer Grund ersichtlich ist. Anders ist nicht zu erklären, dass erst zwei Monate nach der Zustellung der Ent-scheidung eine Auskunft erteilt wurde.
Bei zeitgerechter Vorbereitung und nachdrücklichem Betreiben der Auskunftser-teilung – auch während des Laufs des Antrags auf aufschiebende Wirkung – hätte diese deutlich früher, nämlich spätestens am 30.10.2024, erteilt werden können; ein Zeitbedarf von zwei Monaten ist – auch unter Berücksichtigung des Umfangs der Auskunft – deutlich zu lang. Insbesondere die nach der Zurückweisung des Antrags auf Anordnung der aufschiebenden Wirkung am 30.10.2024 geltend ge-machte weitere Verzögerung wegen der manuellen Schwärzung von Unterlagen durch einen externen Dienstleister ist nur damit erklärbar, dass mit der Zusam-menstellung der Unterlagen und deren Schwärzung nicht rechtzeitig, nämlich spätestens am 13.09.2024, begonnen und diese bis zur Entscheidung des Beru-fungsgerichts über den Antrag auf aufschiebende Wirkung nicht mit dem notwen-digen Nachdruck weiterbetrieben wurde.
Die Antragsgegnerinnen durften angesichts der bereits verstrichenen Zeit auch nicht darauf vertrauen, dass von Seiten der Antragstellerin einer weiteren Frist-verlängerung am 05.11.2024 zugestimmt würde.
5. Nicht gefolgt werden kann den Antragsgegnerinnen in ihrer Ansicht, aufgrund der am 13.11.2024 geleisteten Auskunft könne kein Zwangsgeld mehr angeordnet werden, da mit einem solchen lediglich der Zweck verfolgt werde, den Schuldner zur Erfüllung einer Anordnung anzuhalten.
Mit dem nach Art. 82 Abs. 4 EPGÜ zu verhängenden Zwangsgeld soll die Nicht-befolgung der Entscheidungen des EPG geahndet werden. Dabei hat das Zwangsgeld, wie insbesondere die englische Sprachfassung („penalty payment“) zeigt, Strafcharakter; ein Zwangsgeld kann also nicht nur verhängt werden, um die Befolgung einer Anordnung zu erzwingen, sondern auch, um die in der Ver-gangenheit liegende Nichtbefolgung zu bestrafen (wie hier: LK Düsseldorf, UPC_CFI_177/2023; v.Falck/Stoll in Tilmann/Plassmann, EPGÜ Art. 82 Rn. 123 f.; aA Kircher in Bopp/Kircher, Handbuch Europäischer Patentprozess, 2. Auflage 2023, § 27 Rn. 60). Eine Beschränkung des Zwangsgeldes auf den Zweck, die betreffende Partei zur Befolgung einer gerichtlichen Anordnung anzuhalten, lässt sich dem Wortlaut von Art. 82 Abs. 4 EPGÜ nicht entnehmen.
6. Die Voraussetzungen zur Anordnung eines Zwangsgeldes liegen vor. Gegenüber den Antragsgegnerinnen war am 13.09.2024 die Auskunftserteilung angeordnet worden; Zwangsmaßnahmen für den Fall der Zuwiderhandlung waren angedroht worden. Die Anordnung vom 13.09.2024 war gemäß R. 354.1 VerfO ohne weitere Vollstreckungsanordnung und ohne Sicherheitsleistung vollstreckbar. Den An-tragsgegnerinnen war auch eine angemessene Frist zur Befolgung der Anord-nung gesetzt worden. Das in Regel 264 EPGVerfO vorgesehene Verfahren wurde durchgeführt.
III. Nichterfüllung der Auskunftsverpflichtung in inhaltlicher Hinsicht
Soweit die Antragsgegnerinnen am 12.11.2024 Unterlagen übergeben haben, sind diese gemessen an Ziffer B. II. der Anordnung vom 13.09.2024 unvollstän-dig.
Mit der Auskunft anzugeben war unter anderem die Menge der ausgelieferten, erhaltenen oder bestellten Erzeugnisse sowie der Preise, die für die betreffenden Erzeugnisse bezahlt wurden. Mit Schriftsatz vom 25.11.2024 hat die Antragstel-lerseite vorgetragen, in der Auskunft vom 12.11.2024 fehlten Angaben dazu, zu
welchem Preis die Beklagten die Verletzungsprodukte von ihren Herstellerinnen bezogenen haben, vollständig. Die Antragsgegnerinnen haben dem mit Schrift-satz vom 10.12.2024 nicht widersprochen. Damit ist die Auskunft unstreitig un-vollständig.
IV. Bestimmung der Höhe des Zwangsgeldes
Nach Art. 82 Abs. 4 Satz 2 EPGÜ muss das Zwangsgeld in angemessenem Ver-hältnis zur Bedeutung der zu vollstreckenden Anordnung stehen.
Vorliegend ist Gegenstand der zu vollstreckenden Anordnung die Erteilung einer Auskunft. Die Auskunft soll der Klagepartei die Berechnung des Schadens er-möglichen. Durch eine verspätet erteilte Auskunft verzögert sich die Geltendma-chung des Schadens. Wirtschaftlich betrachtet mag durch diese Verspätung ein Zinsschaden entstehen, im äußersten Fall erhöht sich das Insolvenzrisiko des Schuldners. Diese infolge der Nichtbeachtung der Anordnung bestehenden wirt-schaftlichen Risiken der Klagepartei sind allerdings bei der Bemessung des Zwangsgeldes nicht zu berücksichtigen, da nach Art. 82 Abs. 4 Satz 2 EPGÜ das Recht der Partei, Schadenersatz zu fordern, unberührt bleibt. Hinzu kommt, dass das Zwangsgeld nach Regel 354.3 EPGVerfO an das Gericht zu zahlen ist und nicht etwa an die gegnerische Partei.
Für ein angemessenes Verhältnis des Zwangsgeldes zum Gegenstand der zu vollstreckenden Anordnung sind daher insbesondere Art und Dauer des Versto-ßes zu berücksichtigen.
Der Art nach handelt es sich hier um den Verstoß gegen eine Anordnung, welche etwa im Vergleich zu einer Unterlassungsanordnung weniger Bedeutung zu-kommt; die Anordnung der Auskunftserteilung dient lediglich der Vorbereitung der Geltendmachung eines Schadensersatzanspruches. Das bedeutet allerdings nicht, dass eine solche – einen Hauptanspruch lediglich vorbereitende – gericht-liche Anordnung ungestraft missachtet werden darf. Anordnungen des Gerichts ist in jedem Falle Folge zu leisten. Es steht nicht im Belieben des Schuldners, ob und wann er einer Anordnung Folge leistet. Die unterschiedlich zu gewichtende Bedeutung einer Anordnung hat lediglich Einfluss auf die Höhe der zu verhän-genden Sanktion.
Bei der Dauer des Verstoßes sind hier, wie vorstehend gezeigt, jedenfalls der Zeitraum seit dem 30.10.2024 anzusetzen. Mit Blick auf die festzusetzende Höhe des Zwangsgeldes mindernd zu berücksichtigen ist, dass am 12.11.2024 ein ers-ter Versuch zur Erteilung einer vollständigen Auskunft unternommen wurde.
Angesichts von Art und Dauer des Verstoßes ist hier eine Sanktion in Höhe von jeweils 500,00 €/Tag für den Zeitraum vom 31.10.2024 bis zum 25.11.2024 fest-zusetzen, weil die Auskunft erst verspätet und dann unvollständig erfolgte (26 x 500,00 € = 13.000,00 €).
Seit dem 25.11.2024 hat die Antragsgegnerin Kenntnis davon, dass die Auskunft vom 12.11.2024 unvollständig war. Dies hat sie allerdings nicht dazu veranlasst, die Auskunft nachzubessern. Für den Zeitraum vom 25.11.2024 bis zum 17.12. 2024 ist daher ein erhöhtes Zwangsgeld von jeweils 1.500,00 € pro Tag anzuset-zen, um die Antragsgegnerinnen nunmehr zu einer vollständigen Auskunft zu ver-anlassen (22 x 1.500,00 € = 33.000,00).
Damit kommt einerseits deutlich zum Ausdruck, dass derartige Verstöße nicht hingenommen, sondern spürbar sanktioniert werden. Andererseits bewegt sich das Gericht damit am unteren Bereich der Zwangsgeldandrohung.
V. Kosten
Durch das Zwangsgeldverfahren sind durch die Tätigkeit der Parteivertreter Kos-ten entstanden. Dabei handelt es sich um Kosten des Rechtsstreits. Deren Ver-teilung im Rahmen einer gemäß Art. 69 EPGÜ zu treffenden Kostenentscheidung war zu bestimmen. Das Gericht bewertet den Antrag Ziffer 3., mit dem die An-tragstellerin unterlegen ist, mit einem Anteil von 25%.
VI. Zulassung der Berufung
Die Berufung ist zuzulassen, da es sich – soweit ersichtlich – um die erste Ent-scheidung betreffend die Festsetzung von Zwangsgeld wegen unterbliebener bzw. unvollständiger Auskunftserteilung handelt.
Aus den vorgenannten Gründen ergeht durch den Vorsitzenden Richter Dr. Zigann, den rechtlich qualifizierten Richter Brinkman, den technisch qualifizierten Richter Dr. Hansson und den Berichterstatter Pichlmaier folgende
Entscheidung
A. Gegen die Antragsgegnerinnen wird für die Nichtbefolgung der Anordnung zur Auskunftserteilung (Ziffer B.II. des Urteils des Gerichts erster Instanz des EPG, UPC_CFI_390/2023, erlassen am 13. September 2024) ein Zwangsgeld in Höhe von insgesamt € 46.000,00 festgesetzt.
B. Im Übrigen werden die Anträge der Antragstellerin zurückgewiesen.
C. Die Kosten des Zwangsgeldverfahrens tragen die Antragstellerin 25% und die Antragsgegnerinnen 75%.
D. Diese Anordnung ist sofort vollstreckbar.
E. Die Berufung wird zugelassen.
F. Der Streitwert des Zwangsgeldverfahrens wird auf 150.000,00 € festgesetzt.

Facts of the case
The Local Division ordered the defendants by main decision of 13 September 2024 for
patent infringement to, inter alia,
B. II. to provide the plaintiff with information on the extent to which they have committed the acts referred to
in B.I. since 28 December 2016, stating
1. the origin and distribution channels of the products referred to in B.I., stating
a. the names and addresses of suppliers and other previous owners, and
b. the names and addresses of the commercial customers and the points of sale for which
the products were intended
2. the quantity of products delivered, received or ordered and the prices paid for the
products concerned; and
3. the identity of all third parties involved in the distribution of the products referred to in
point B.I,
whereby copies of the corresponding proof of purchase (i.e. invoices, delivery notes, etc.) must be
submitted as proof of the information, whereby details requiring secrecy may be blacked out outside
the data required to be disclosed;
H. In the event of any infringement of the orders under B.I and D, the respective defendants shall
pay a penalty payment of up to EUR 100,000 to the court for each day of infringement; in the
event of infringement of the orders under B.II, the penalty payment shall be up to EUR 50,000
for each day of infringement.
K. The judgement is provisionally enforceable for the plaintiff without the provision of security.
By letter dated 20 September 2024, the applicant notified the respondents in accordance
with R. 118.8 EPG-VerfO that it would enforce the decision in full. She requested the
respondents to provide the information specified in section
B.II. of the decision to the extent ordered by 7 October 2024.
In a written submission dated 7 October 2024 (App_ 52799/2024; notification of the
applicant's intention to enforce pursuant to Rule 118.8 EPG-VerfO), the respondents
s u b m i t t e d a statement on the notice of enforcement. In this context
it was stated, among other things, that if the respondents' application for suspensive
effect was rejected (App_ 53031/2024 UPC_CoA_549/2024), information would be
provided within one week of service of the corresponding decision of the Court of Appeal.
By order dated 30 October 2024, the Court of Appeal rejected the application for
suspensive effect with regard to the respondents. This order was served on the parties
on 30.10.2024.
The petitioner filed an application for the imposition of a penalty payment in a pleading
dated 11 November 2024.
By letter dated 12 November 2024, the respondent provided information in paper form:
16 boxes (DIN A4) with printed invoices and one box (DIN A3) with a printed table were
handed over to the applicant's authorised representatives, as shown below. A 1.5-page
letter (Annex AG-ZV 1) with the heading "Rechnungslegung" was submitted.
In a written submission dated 25 November 2024, the applicant complained that the
information was not provided in full. For example, information on the price at which the
defendants purchased the infringing products from their manufacturers was completely
missing; the defendants' letter of 12 November 2024 only lists the names of the
manufacturers.
The applicant is of the opinion that the information should have been provided
electronically. This was not done. The information provided makes an evaluation
impossible. The right to information is also not yet fulfilled because certain information is
still missing (example: purchase prices). The information is also not comprehensible with
regard to certain values in the tables provided with the information
("UNIT_PRICE_LOCA").
The applicant has filed a complaint
against the defendants for failure to comply with the order in para.
B.II. of the judgment of the Court of First Instance of the Unified Patent Court,
case number UPC_CFI_390/2023, issued on 13 September 2024, a penalty
payment of EUR 20,000 for each day since 7 October 2024.
In the alternative:
1. against the defendants for each day since 7 October 2024 until full compliance
with the information ordered in the Chamber's judgment of 13 September 2024
under no.
B.II., the amount of which is left to the discretion of the court;
further in the alternative:
2. against the defendants for each day in the period from 7 October 2024 to
12 November 2024 to impose a penalty payment, the amount of which is left to
the discretion of the court, and
3. order the defendants to provide the plaintiff with the information owed in a
complete, organised list in electronic form within a reasonable period to be
determined by the court.
The defendants have filed a motion,
to reject the applications.
The defendants are of the opinion that they have provided the information owed in full.
According to the operative part of the main decision, submission in electronic form was
not owed. It was permissible to partially redact the invoices; however, this was only
possible manually (i.e. not electronically/digitally), as the software available to the
defendants was unable to process the largely scanned invoices.
Reference is also made to the parties' submissions in workflow App_60589/2024.
Reasons
The application for interim measures admissible pursuant to Art. 82 UPCA in conjunction
with R. 354.4 RoP is largely successful on the merits. The respondents did not violate the
court order to provide information in terms of form, but in terms of time and content. In
view of this, a penalty payment was to be imposed.
I. Fulfilment of the obligation to provide information in formal terms
A penalty payment cannot be imposed on the respondents because the
information was provided in paper form and not in electronic form. The application
made under point 3. was therefore to be rejected.
1. Neither Art. 67 UPCA nor the UPCA Rules of Procedure contain specific provisions
on whether information to be provided in writing must be provided in electronic
(digital) form or on paper. However, the request and order of information in
electronic form is not excluded according to the wording of Art. 67 UPCA, which is
open in this respect. According to Art. 76 para. 1 UPCA ("...in accordance with the
requests made by the parties..."), it is the responsibility of the party bringing the
action to define the request under Art. 67 UPCA as specifically as possible with
regard to the desired form of information to be provided. If information (Art. 67
UPCA) is to be provided in electronic form, this must therefore be specifically
requested. If the request does not specify the form, the request for information is
not inadmissible due to a lack of specificity; however, the party owing the
information is then generally free to choose the form in which the information is
provided (electronically or on paper).
Art. 67 UPCA cannot be interpreted in favour of the requesting party to the effect
that a tenor-based obligation to provide information must always be complied with
in electronic form if the information is available in electronic form from the party
obliged to provide information. The technically neutral wording of the provision
gives no indication of this; according to the wording of the provision, the only
decisive factor is that the aforementioned information is transmitted. In the passage
of decision UPC_CFI_15/2023 cited by the applicant, the Local Division also did not
decide that information - irrespective of the wording of the corresponding request -
must always be provided in electronic form if the information is available in
electronic form.
if the information is available in electronic form at the information debtor, especially
since in the case in question, according to the applicant's submission, the provision
of information was requested in electronic form.
An obligation to provide information in electronic form cannot be derived from Art.
44 UPCA either, if only because the addressee of Art. 44 UPCA is "the court".
2. The requirement of a specific application with regard to the form in which
information is to be provided and a correspondingly specific court order is also
based on principles of EU law.
The principle of "nulla poena sine lege" under EU law, as affirmed in Article 7
ECHR and Article 49(1) CFR, must also be observed for measures such as the
imposition of a penalty payment for non-compliance with a court order.
Therefore, the enforcement of an order in accordance with Rule 354.3 EPGVerfO
(penalty payments in the event of non-compliance with the order) requires that the
court order is worded so clearly that a violation can be clearly established. If, for
example, non-compliance with the form of the information return is at issue, a
penalty payment can only be ordered if the required form was also expressed
sufficiently clearly in the court order; otherwise, a breach of form cannot be
established.
3. The plaintiff did not specifically request information in electronic form. Her
application states that
"...corresponding proof of purchase (namely invoices, alternatively delivery notes)
must be submitted in copy..."
In accordance with this application, the main decision did not stipulate that the
information must be provided electronically. Copies can be made in both analogue
and digital form. The application and the subsequent order leave this open. The
defendants submitted invoices in paper form. The fact that the invoices were not
submitted in electronic form but
in paper form cannot be penalised with a penalty payment in view of the wording of
the order. This also applies in view of the fact that the invoices were scanned so
that it would have been obvious to provide the information in electronic form. There
is an obligation to comply with the order; within the limits of harassment, there is no
obligation to do something that is not specifically required in the order but may be
customary or obvious. In view of the explanation offered by the debtors that the
invoices could only be blacked out manually (i.e. not electronically/digitally), it
cannot be proven in the context of the penalty payment proceedings that the
debtors only chose the paper form to harass the creditor.
II. Failure to fulfil the obligation to provide information in terms of time
However, a penalty payment can be imposed on the respondents simply because
the information provided on 12 November 2024 was provided too late.
If a party fails to comply with an order of the court, it may be subject to periodic
penalty payments to be paid to the court (Art. 82 para. 4 UPCA).
The respondents did not comply at all with the Local Division's order to provide
information by 12 November 2024. The application filed on 11 November 2024 to
impose a penalty payment was therefore justified on the merits. This first attempt to
provide information on 12 November 2024 was late, but had to be taken into
account when determining the amount of the penalty payment.
1. Pursuant to Rule 354.1 of the UPC Rules, decisions and orders of the court are -
subject to Rules 118.8 and 352 - directly enforceable in any Contracting Member
State from the date of service.
The decision ordering the defendants to provide information was served on the
parties on 13 September 2024.
2. By letter dated 20 September 2024, the claimant notified the court in accordance
with R. 118.8 of the UPC Rules of Procedure that it would enforce the decision in
full. She has
requested the defendants to pay the costs owed under B. II. of the decision by 7
October 2024.
Insofar as the respondents have stated that they only wish to provide information
within one week after any rejection of their request for suspensive effect, it should
be noted that neither the request for suspensive effect has such a suspensive
effect nor the appeal lodged by the respondents against the decision of 13
September 2024 (Art. 74 para. 1 UPCA). There was therefore no reason as of right
to wait for the Court of Appeal to decide on the request for suspensive effect before
providing information. The opponents of the application should have been aware of
this if they had received correct legal advice.
The information was therefore to be provided on 7 October 2024, i.e. more than
three weeks after the judgment was served; the applicant did not agree to an
extension of the deadline. No information was provided by 7 October 2024.
3. By order dated 30 October 2024, the Court of Appeal rejected the application for
suspensive effect with regard to the defendants. This order was served on the
parties on 30 October 2024. However, the information was still not provided on
30.10.2024. Contrary to their own promise, the Requests did not provide the
information within one week of service of the Court of Appeal's decision on the
application for suspensive effect.
As this is - as far as can be seen - the first decision of the UPC on the question of
when the information ordered in a decision on the merits is to be provided, the
respondents were exceptionally allowed to wait until the decision of the Court of
Appeal before providing the information. However, it was not permissible for the
respondents not to prepare the information statement any further during this period,
so that it could not be issued even if the decision of the court of appeal was
available on 30 October 2024.
The information should have been provided on 30 October 2024 in any case.
However, the respondents did not provide it either on 30.10.2024 or - as promised -
until by 6 November 2024 as promised, but only on 12 November 2024. Contrary to their
opinion, the defendants could not rely on being granted an extension by the
applicant in view of the time that had already elapsed.
4. There is also no justifiable reason that excuses the applicants for the overdue and
therefore late information granted since 30 October 2024:
The defendants - confronted with an infringement action since 2023 - had to
assume that they would have to provide this information as soon as possible after
the judgement at first instance. This also and especially applies in view of the
scope of the information to be provided. Accordingly, the defendants were required
to prepare the provision of information at the latest upon service of the decision of
13 September 2024. This was evidently not done with the necessary vigour, without
there being any comprehensible reason for this. There is no other explanation for
the fact that information was not provided until two months after the decision was
served.
If the request for information had been prepared in good time and had been
vigorously pursued - even during the course of the application for suspensive effect -
it could have been issued much earlier, namely on 30 October 2024 at the latest; a
time requirement of two months is clearly too long - even taking into account the
scope of the information. In particular, the further delay claimed after the rejection
of the application for an order for suspensive effect on 30 October 2024 due to the
manual redaction of documents by an external service provider can only be
explained by the fact that the compilation of the documents and their redaction was
not started on time, namely on 13 September 2024 at the latest, and that this was
not continued with the necessary vigour until the decision of the court of appeal on
the application for suspensive effect.
In view of the time that had already elapsed, the defendants could not rely on the
applicant agreeing to a further extension of the deadline on 5 November 2024.
5. The defendants cannot be supported in their view that a penalty payment can no
longer be ordered on the basis of the information provided on 13 November 2024,
as the sole purpose of such a penalty payment is to compel the debtor to comply
with an order.
The penalty payment to be imposed under Art. 82 para. 4 UPCA is intended to
penalise non-compliance with UPCA decisions. As the English language version
("penalty payment") in particular shows, the penalty payment has a punitive
character; a penalty payment can therefore not only be imposed to enforce
compliance with an order, but also to penalise non-compliance in the past (as here:
LK Düsseldorf, UPC_CFI_177/2023; v.Falck/Stoll in Tilmann/Plassmann, UPCA
Art. 82 para. 123 f.; aA Kircher in Bopp/Kircher, Handbuch Europäischer
Patentprozess, 2nd edition 2023, § 27 para. 60). A restriction of the penalty
payment to the purpose of compelling the party concerned to comply with a court
order cannot be inferred from the wording of Art. 82 (4) UPCA.
6. The conditions for ordering a penalty payment are met. The respondents were
ordered to provide information on 13 September 2024; coercive measures were
threatened in the event of non-compliance. The order of 13 September 2024 was
enforceable in accordance with R. 354.1 RoP without any further enforcement order
and without the provision of security. The respondents had also been given a
reasonable period of time to comply with the order. The procedure provided for in
Rule 264 EPGVerfO was carried out.
III. Non-compliance with the obligation to provide information in terms of content
Insofar as the respondents handed over documents on 12 November 2024, these
are, measured against point B. II. of the order of 13/09/2024.
The information was to include, among other things, the quantity of products
delivered, received or ordered and the prices paid for the products in question. In a
written submission dated 25 November 2024, the applicant argued that the
information of 12 November 2024 lacked information on the price at which the
defendants had the price at which the defendants purchased the infringing products from their
manufacturers. The defendants did not contradict this in a letter dated 10
December 2024. The information is therefore indisputably incomplete.
IV. Determination of the amount of the penalty payment
According to Art. 82 para. 4 sentence 2 UPCA, the penalty payment must be
proportionate to the importance of the order to be enforced.
In the present case, the object of the order to be enforced is the provision of
information. The information should enable the claimant to calculate the damage. A
delay in providing information delays the assertion of the damage. From an
economic point of view, this delay may result in a loss of interest; in the worst case,
the debtor's risk of insolvency increases. However, these economic risks incurred
by the party bringing the action as a result of non-compliance with the order are not
to be taken into account when calculating the penalty payment, as the party's right
to claim damages remains unaffected under Art. 82 para. 4 sentence 2 UPCA. In
addition, according to Rule 354.3 UPCA, the periodic penalty payment is to be paid
to the court and not to the opposing party.
The nature and duration of the infringement in particular must therefore be taken
into account when determining the appropriate ratio of the penalty payment to the
subject matter of the order to be enforced.
By its nature, this is a violation of an order that is less important than an injunction,
for example; the order to provide information merely serves to prepare the assertion
of a claim for damages. However, this does not mean that such a court order -
which merely prepares a main claim - may be disregarded with impunity. Court
orders must be complied with in any case. It is not up to the debtor to decide
whether and when to comply with an order. The varying importance of an order
merely influences the amount of the sanction to be imposed.
As shown above, the period since 30 October 2024 must be taken into account for
the duration of the infringement. With regard to the amount of the penalty payment
to be imposed, the fact that a first attempt was made to provide complete
information on 12 November 2024 must be taken into account.
In view of the nature and duration of the infringement, a penalty of € 500.00 per day
for the period from 31 October 2024 to 25 November 2024 must be imposed
because the information was provided late and then incomplete (26 x € 500.00 = €
13,000.00).
Since 25 November 2024, the defendant has been aware that the information from
12 November 2024 was incomplete. However, this did not prompt her to correct the
information. For the period from 25 November 2024 to 17 December 2024, an
increased penalty payment of €1,500.00€ per day must therefore be imposed in
order to compel the defendants to provide complete information (22 x €1,500.00 =
€33,000.00).
On the one hand, this clearly expresses that such violations are not tolerated, but
rather noticeably sanctioned. On the other hand, the court is thus moving towards
the lower end of the penalty payment range.
V. Costs
The penalty payment proceedings have incurred costs due to the activities of the
party representatives. These are costs of the legal dispute. Their allocation was to
be determined in the context of a decision on costs to be made pursuant to Art. 69
UPCA. The court assessed the request under no. 3, with which the applicant was
unsuccessful, with a share of 25%.
VI. Admission of the appeal
The appeal is admissible because - as far as can be seen - this is the first decision
concerning the imposition of a penalty payment for failure to provide or incomplete
provision of information.
For the aforementioned reasons, the following decision is issued by the presiding judge
Dr Zigann, the legally qualified judge Brinkman, the technically qualified judge Dr
Hansson and the rapporteur Pichlmaier.
Decision
A. A penalty payment totalling € 46,000.00 is imposed on the respondents for non-
compliance with the order to provide information (point B.II. of the judgment of the
Court of First Instance of the UPC, UPC_CFI_390/2023, issued on 13 September
2024).
B. The remainder of the applicant's claims are dismissed.
C. The applicant shall bear 25% of the costs of the penalty payment proceedings and
the defendants 75%.
D. This order is immediately enforceable.
E. The appeal is authorised.
F. The value in dispute of the penalty payment proceedings is set at 150,000.00€ .
