Anordnung
des Gerichts erster Instanz des Einheitlichen Patentgerichts
erlassen am 09. Dezember 2024
Leitsätze:
1. Art. 32 (1) a), c) EPGÜ eröffnen die sachliche Zuständigkeit des EPG für den Erlass
einstweiliger Maßnahmen, mit denen ein Antragsteller um Rechtsschutz vor
drohenden (ausländischen) Prozessführungs- und/oder Vollstreckungsverboten
nachsucht.
2. Ein (ausländisches) Prozessführungs- und/oder Vollstreckungsverbot verstößt gegen
den allgemeinen europäischen Justizgewährungsanspruch (Art. 47 EU-Charta). Die
Verbote stehen auch im Widerspruch zum deutschen Justizgewährungsanspruch
gem. Art. 2 Abs. 1, 19 Abs. 4 GG und sind als unerlaubte Handlung im Sinne des §
823 Abs. 1 BGB zu qualifizieren.
3. Besondere Umstände im Sinne der Regel 211.5 VerfO lassen sich nicht nur mit einer
(vermeintlich) langen Dauer der Beschaffung einer Sicherheit begründen.
4. Regel 213.1 VerfO eröffnet für das Gericht kein Ermessen.

GEGENSTAND DES VERFAHRENS
Antrag auf Erlass einstweiliger Maßnahmen – R. 206 ff. VerfO
SACHVERHALT
1. Die Antragstellerin ist eingetragene Inhaberin des Europäischen Patents EP 1 770 912 B1
mit dem Titel „Verfahren und Vorrichtung zur Initialisierung von 10BASE-T Netzwerken“
(nachfolgend: Streitpatent). Das Streitpatent, welches ausschließlich in Deutschland in
Kraft steht, betrifft den 1000Base-T1 Automotive Ethernet Standard.
2. Das Streitpatent sieht die Antragstellerin durch Herstellung und Vertrieb des KFZ […] in
der Bundesrepublik Deutschland verletzt, weshalb sie die […] und […] vor dem EPG in
dem Verfahren UPC_CFI_208/2024 ACT 24735/2024 (Lokalkammer München, Panel 2)
unter anderem auf Unterlassung in Anspruch nimmt. In der Klageschrift vom 01.05.2024
stellte die Antragstellerin die ihrer Ansicht nach gegebene Patentverletzung anhand eines
Chips des Lieferanten Marvell dar, welcher in dem […] verbaut sein soll. Die in Anspruch
Genommenen treten der Klage u.a. mit Blick auf Komponenten der Antragsgegnerin mit
dem Einwand der Erschöpfung entgegen.
3. Die Antragstellerin nimmt die […] und die […] zudem wegen der (vermeintlichen)
Benutzung von weiteren Patenten vor deutschen Gerichten und dem EPG in Anspruch,
so u.a. vor dem Landgericht München I (Az. 7 O 4992/22) wegen (behaupteter) Benutzung
des Europäischen Patents EP 1 903 733. Dieses betrifft den 100Base-T1 Automotive
Ethernet Standard. In diesem Verfahren ist Termin zur mündlichen Verhandlung bestimmt
auf den 20.02.2025.
4. Die Antragsgegnerin ist ein Halbleiterhersteller mit Sitz in Taiwan. Sie und die
Antragstellerin schlossen eine Lizenzvereinbarung, welche der Antragsgegnerin für ihre
[…]produkte eine Lizenz an den Patenten der Antragstellerin inklusive des Streitpatents
einräumt (Anlage EIP 4). Die Lizenzvereinbarung […].
5. Mit Schriftsatz vom 31.10.2024 erhob die Antragsgegnerin vor dem Court of Chancery of
the State of Delaware (USA) Klage gegen die Antragstellerin. Mit dieser Klage, die an den
United States District Court for the District of Delaware verwiesen wurde, nimmt die
Antragsgegnerin die Antragstellerin zunächst wegen eines angeblichen Verstoßes gegen
eine Lizenzvereinbarung zwischen der Antragstellerin und […] in Anspruch (Anlage EIP
2). Sie stellt darüber hinaus die nachfolgend wiedergegebenen Anträge B. und C., wobei
das Wort „[…]“ in der öffentlich verfügbaren Fassung der US-Klage jeweils geschwärzt ist:
„B. Permanently enjoining Avago Sales from breaching the License Agreement by
pursuing claims against […] in Germany for infringing SEPs by using Realtek´s
products;
C. Permanently enjoining Avago Sales from enforcing any injunction it obtains in
Germany against […].”
6. Auf Deutsch:
„B. Avago Sales dauerhaft zu untersagen, gegen die Lizenzvereinbarung zu
verstoßen, indem sie in Deutschland Ansprüche gegen […] wegen der Verletzung von
SEPs aufgrund der Verwendung von Realtek-Produkten geltend macht;
C. Avago Sales dauerhaft zu untersagen, in Deutschland gegen […] erwirkte
Unterlassungsanordnungen zu vollstrecken;“
7. In der Klageschrift vom 31.10.2024 (Anlage EIP 2) trägt die Antragsgegnerin u.a. vor, die
Antragstellerin habe gegen die Lizenzvereinbarung verstoßen, indem sie […] vor
mehreren Gerichten in Deutschland wegen angeblicher Patentverletzung verklagte, weil
diese die Schaltkreise der Antragsgegnerin in ihren Fahrzeugen verwendete. Hierdurch
werde die Lizenz der Antragsgegnerin zur Nutzung der Patente der Antragstellerin
vereitelt. Aber selbst wenn die Produkte der Antragsgegnerin nicht lizensiert wären, hätte
die Antragstellerin eine Verpflichtung zu einer FRAND-gemäßen Lizenzierung ihrer
Patente. Dieser Verpflichtung sei die Antragstellerin jedoch nicht nachgekommen. Die
deutschen Gerichte würden ihre Entscheidung bis zum 20.02.2025 fällen. Wenn am
20.02.2025 festgestellt werde, dass […] die Patente verletzt, werde die daraus
resultierende Unterlassungsanordnung den Verkauf von […] in Europa und wahrscheinlich
auch in den Vereinigten Staaten stoppen und auch die Lieferkette von […] dezimieren.
Dies würde ihr, der Antragsgegnerin, immensen Schaden zufügen, nämlich den Verlust
ihrer Zulieferbeziehungen. In Deutschland stünden ihr, der Antragsgegnerin, keine
angemessenen Rechtsbehelfe zur Verfügung. Deshalb habe sie einen
Unterlassungsanspruch, der der Antragstellerin untersage, in Deutschland Ansprüche
gegen […] wegen einer Verletzung durch die Nutzung von ihren Produkten geltend zu
machen und/oder eine in Deutschland erwirkte Unterlassungsanordnung gegen […] zu
vollstrecken.
8. Mit Schriftsatz vom 07.11.2024 reichte die Antragsgegnerin in dem US-amerikanischen
Verfahren einen Beschleunigungsantrag ein (Anlage EIP 5). Sie beantragt mit diesem,
einen Verhandlungstermin Anfang Februar 2025 zu bestimmen und eine Entscheidung
des US-amerikanischen Gerichts jedenfalls noch vor dem 20.02.2025.
9. Am 22.11.2024 erließ das Landgericht München I (Az. 7 O 14547/24) eine einstweilige
Verfügung ohne Anhörung der Antragsgegnerin, mit welcher der Antragsgegnerin
untersagt wurde, die US-amerikanische Klage weiterzubetreiben, insbesondere in Bezug
auf die Anträge B und C (Anlage EIP 1).
ANTRAG DER ANTRAGSTELLERIN
10. Die Antragstellerin beantragt gemäß Antragschrift vom 29.11.2024 in Verbindung mit dem
Schriftsatz vom 05.12.2024:
1. Der Antragsgegnerin wird untersagt,
die Klage vom 31. Oktober 2024, die zunächst von ihr vor dem Court of Chancery
of the State of Delaware (USA) (Anlage EIP 1) eingereicht wurde (Aktenzeichen
2024-1127-NAC), und die anschließend an den U.S. District Court of the District of
Delaware verwiesen wurde (Aktenzeichen 1:24-cv-01235-GBW)
weiterzubetreiben, insbesondere in Bezug auf die Anträge B und C, und auch
sofern damit der Antragstellerin unmittelbar oder mittelbar verboten werden soll,
die bei der Lokalkammer München des Einheitlichen Patentgerichts eingereichte
Patentverletzungsklage vom 1. Mai 2024 (ACT_24735/2024) weiter zu betreiben
oder um weitere Klageansprüche aus weiteren SEP der Antragstellerin zu
erweitern oder weitere Verletzungsklagen wegen Verletzung von SEP aus dem
Portfolio der Antragstellerin gegen die mit der oben genannten Klage in Anspruch
genommenen Unternehmen des […]-Konzerns, nämlich […] und […], oder ihre
verbundenen Konzernunternehmen oder weitere Unternehmen des […]-Konzerns,
bei einer Lokalkammer des EPG auf dem Gebiet der Bundesrepublik Deutschland
sowohl mit Wirkung für die Bundesrepublik Deutschland als auch mit Wirkung für
andere Mitgliedstaaten des EPGÜ zu erheben und zu betreiben („Anti-Suit
Injunction“); und
Unterlassungsurteile des EPG, die gegen die mit der oben genannten Klage in
Anspruch genommenen Unternehmen des […]-Konzerns, nämlich […] und […],
oder ihre verbundenen Konzernunternehmen oder weitere Unternehmen des […]-
Konzerns ergehen, in der Bundesrepublik Deutschland zu vollstrecken („Anti-
Enforcement Injunction“),
wobei diese Unterlassungsverpflichtung umfasst,
- das Gebot, die Anträge auf Erlass einer Anti-Suit Injunction und einer Anti-
Enforcement Injunction vom 31. Oktober 2024, welche zunächst vor dem Court of
Chancery of the State of Delaware (USA) (Anlage EIP 1) (Aktenzeichen 2024-
1127-NAC) beantragt wurden, und die anschließend an den U.S. District Court of
the District of Delaware verwiesen wurden (Aktenzeichen 1:24-cv-01235-GBW),
unabhängig davon, bei welchem U.S. Gericht sie zum Zeitpunkt der Vollziehung
dieser Entscheidung gerade anhängig sind, unverzüglich nach Zustellung dieses
Verfügungsbeschlusses zurückzunehmen,
- das Verbot, dieses Anti-Suit Injunction- und Anti-Enforcement Injunction-
Verfahren, außer zum Zweck der Antragsrücknahme weiter zu betreiben,
- das Verbot, für den Fall, dass in der Zwischenzeit die oben genannten Anti-Suit
Injunction- und/oder Anti-Enforcement Injunction-Anordnungen ergehen, diese
gegen die Antragstellerin zu vollstrecken, und
- das Verbot, andere gleichwertige Maßnahmen zu beantragen, mit denen der
Antragstellerin unmittelbar oder mittelbar verboten werden soll, ihre Patentrechte
gegen Unternehmen des […]-Konzerns bei einer Lokalkammer des EPG auf dem
Gebiet der Bundesrepublik Deutschland sowohl mit Wirkung für die
Bundesrepublik Deutschland als auch mit Wirkung für andere Mitgliedstaaten des
EPGÜ durchzusetzen.
2. Im Falle jeder Zuwiderhandlung gegen die Anordnung nach Ziffer 1. hat die
Antragsgegnerin an das Gericht ein (ggf. wiederholtes) Zwangsgeld in Höhe von bis zu
EUR 100.000,00 für jeden Tag der Zuwiderhandlung zu zahlen.
3. Die Antragsgegnerin hat die Kosten des Verfahrens zu erstatten.
4. Die Anordnungen sind sofort wirksam und vollstreckbar.
5. Die Anordnungen ergehen ohne vorherige Anhörung der Antragsgegnerin (Regel 206.3
VerfO).
6. Die Zustellung der hier beantragten Anordnung, sowie der Antragsschrift nebst Anlagen
und englischer Übersetzungen an die Antragsgegnerin, wird im Wege der alternativen
Zustellung durch formlose postalische Zusendung am Sitz der Antragsgegnerin, No. 2
Innovation Road II, Hsinchu Science Park, Hsinchu 300, Taiwan, und durch formlose
elektronische Übermittlung an Frau ,
unter der geschäftlichen E-Mailadresse zugelassen (Regel
275.1 VerfO), wobei die Zustellung an dem Datum als erfolgt gilt, für das entweder, der
beauftragte Versanddienstleister bestätigt hat, die im hiesigen Antrag genannten
Unterlagen an der im hiesigen Antrag genannten Anschrift zugestellt zu haben oder, an
dem die hier genannten Unterlagen per E-Mail an Frau erfolgreich abgesetzt
wurden.
VORBRINGEN DER ANTRAGSTELLERIN
11. Die Antragstellerin trägt vor, sie habe am 01.11.2024 Kenntnis von der Klage der
Antragsgegnerin vom 31.10.2024 erlangt.
12. Die Klage der Antragsgegnerin ziele auf ein umfassendes Klage- und
Vollstreckungsverbot ab. Würde das angerufene US-Gericht dem Klageantrag B.
stattgeben, wäre hiervon auch das Verfahren UPC_CFI_208/2024 ACT 24735/2024
erfasst. Im Ergebnis wäre die Antragstellerin gezwungen, ihre Patentverletzungsklagen
gegen […] in Deutschland betreffend das EP 1 903 733 und das Streitpatent
zurückzunehmen und weitere Patentverletzungsklagen gegen […] aus
standardessentiellen Patenten (nachfolgend: SEP) in Deutschland und vor Gerichten des
EPGÜ zu unterlassen bzw. zurückzunehmen. Ähnliches gelte für die Vollstreckung
etwaiger Unterlassungsurteile gegen […] in Deutschland und in anderen Mitgliedstaaten
des EPGÜ, und zwar unabhängig davon, ob sie SEP der Antragstellerin betreffen oder
nicht. Denn der Klageantrag C. sei noch viel weitereichender. Demnach solle der
Antragstellerin dauerhaft untersagt werden, in Deutschland und vor EPGÜ-Gerichten
erwirkte Unterlassungen gegen […] zu vollstrecken, unabhängig davon, ob die
Unterlassung auf der Verletzung eines SEP beruhe oder nicht, und ob die Antragsgegnerin
überhaupt betroffen sei oder nicht. Dieses Vollstreckungsverbot betreffe daher sämtliche
deutschen Patentverletzungsverfahren der Antragstellerin gegen […] sowie Verfahren vor
dem EPG. Das Verbot solle sich auch auf Ansprüche wegen Patentverletzung durch
Ethernet-Chips in […]-Produkten erstrecken, die nicht von der Antragsgegnerin, sondern
von anderen Parteien wie Marvell geliefert werden.
13. Mit Blick auf Maßnahmen US-amerikanischer Gerichte sei von Bedeutung, dass etwaige
US-amerikanische Anti-Suit Injuctions (nachfolgend: ASI) und Anti-Enforcement
Injunctions (nachfolgend: AEI) sofort in den USA vollstreckbar seien. Würde sich die
Antragstellerin den Maßnahmen widersetzen, würde dies nach US-amerikanischem Recht
ein „contempt of court“ darstellen. Es würden erheblichen Geldbußen und unter
Umständen sogar Ordnungshaft drohen, wie Anordnungen der letzten Jahre gezeigt
hätten (Eidesstattliche Versicherung, Anlage EIP 6). Diese könnten nicht nur gegen die
Antragstellerin, sondern jedenfalls auch gegen ihre Konzernmutter, Broadcom Inc.,
verhängt werden.
14. Die Begründungsversuche der Antragsgegnerin für die begehrten Klage- und
Vollstreckungsverbote seien offensichtlich unzutreffend und würden sich auch nicht aus
der Lizenzvereinbarung ergeben. Es sei insbesondere festzuhalten, dass die Verfahren in
Deutschland (national und EPG) das einzig richtige Forum seien, um die Frage nach einer
etwaigen Erschöpfung der Patente der Antragstellerin mit Blick auf […] Fahrzeuge in
Deutschland zu klären. Selbst wenn das US-Gericht feststellen sollte, dass die
Antragsgegnerin eine Lizenz an den klageweise geltend gemachten Patenten der
Antragstellerin haben sollte (wie nicht), so würde dies die Frage nach einer etwaigen
Erschöpfung in Deutschland mit Blick auf […] Fahrzeuge nicht beantworten. Dies zeige
eindeutig, dass es der Antragsgegnerin nicht darum gehe, ihre vermeintlichen Rechte aus
der Lizenzvereinbarung durchzusetzen, sondern sie versuche, die Verfahren der
Antragstellerin in Deutschland (nationale und EPG) zu Gunsten von […] mit rechtswidrigen
Mitteln zu verhindern.
15. Die Antragstellerin begehre den Schutz solcher Patentverletzungsverfahren, die vor den
deutschen Lokalkammern des EPG geführt und erhoben werden, unabhängig davon, ob
es sich um Klageanträge mit Wirkung für andere Vertragsmitgliedstaaten (d. h. nicht in
Deutschland) handele. ASI und AEI seien mit den europäischen Grundsätzen des
Zivilprozessrechts unvereinbar. In jedem Fall verstießen sie gegen die Charta der
Grundrechte der Europäischen Union (nachfolgend: Charta). Darüber hinaus sei das
Verhalten der Antragsgegnerin nach deutschem materiellen Recht zu beurteilen.
Ausländische Klage- und Vollstreckungsverbote verstießen gegen deutsches Recht, da in
diesen ein rechtswidriger Eingriff in die geschützten Rechtsgüter der Antragstellerin liege.
Ihr stehe deshalb ein deliktsrechtlicher Unterlassungsanspruch gem. § 823 Abs. 1 i. V. m.
§ 1004 BGB zur Seite.
16. Zudem sei nach allgemeiner Lebenserfahrung damit zu rechnen, dass die
Antragsgegnerin auch nicht davor zurückschrecken würde, die von ihr in den USA
beantragten Klage- und Vollstreckungsverbote auch auf andere Vertragsmitgliedsstaaten
auszuweiten, sollte sie es für nötig halten. Dass diese derzeit auf „Deutschland“
beschränkt seien, liege aller Wahrscheinlichkeit nach allein daran, dass die Antragstellerin
ihre Rechte gegen […] derzeit nur vor deutschen Gerichten und deutschen Lokalkammern
des EPG geltend mache. Insofern bestehe aber auch für alle übrigen
Vertragsmitgliedsstaaten eine Begehungsgefahr.
17. Die Anordnung der hier beantragten einstweiligen Maßnahmen sei in zeitlicher Hinsicht
dringlich. Es bestehe eine konkrete Gefahr, dass das angerufene US-Gericht zeitnah die
beantragte ASI und AEI erlasse. Die einstweilige Regelung sei auch sachlich dringend
erforderlich, um erheblichen Schaden von der Antragstellerin abzuwenden. Der
Antragstellerin könne nicht zugemutet werden erst die von der Antragsgegnerin
beantragte US-Entscheidung abzuwarten, die sich mit Blick auf die drohenden,
erheblichen Sanktionierungsmaßnahmen möglicherweise nicht mehr effektiv beseitigen
ließe, weil die Antragstellerin unter dem Druck der Sanktionen die entsprechenden Klagen
in Deutschland vor dem EPG zurücknehmen müsste. Der Erlass der hier beantragten
Unterlassungsverfügung sei daher geboten, um der Antragstellerin einen effektiven
Zugang zum Recht (und daher zu den Gerichten) weiterhin zu ermöglichen. Die
Antragstellerin begehre folglich einstweiligen Rechtsschutz, weil im Kern die
Durchsetzung von Patentrechten im hiesigen Forum in Gefahr sei. Vor diesem Hintergrund
überwiege auch das Interesse der Antragstellerin an den beantragten einstweiligen
Maßnahmen etwaige Interessen der Antragsgegnerin.
18. Aufgrund der besonderen Dringlichkeit sei dem Antrag der Antragstellerin ohne vorherige
Anhörung der Antragsgegnerin stattzugeben. Eine vorherige Anhörung der
Antragsgegnerin würde den Zweck dieses Verfahrens sehr wahrscheinlich vereiteln. Eine
Anhörung und die Durchführung einer mündlichen Verhandlung würden, insbesondere
auch mit Blick auf die anstehenden Feiertage zum Jahreswechsel, die Anordnung der hier
beantragten Unterlassungsverfügung erheblich verzögern, so dass zu befürchten sei,
dass das US-Gericht die ASI und AEI Maßnahmen vorher erlasse. Dies gelte umso mehr
da davon auszugehen sei, dass die Antragsgegnerin das US-Gericht über das hiesige
Verfahren informieren würde. Zudem sei davon auszugehen, dass die Antragsgegnerin
bei Kenntnis des hiesigen Verfügungsantrags umgehend selbst einstweilige Maßnahmen,
eine sog. Temporary Restraining Order, ergreifen würde, um das hiesige Verfahren zu
verhindern. Eine Anhörung sei auch nicht erforderlich. Denn die Position und die
Rechtsmeinung der Antragsgegnerin sei aus ihrer US-Klage (Anlage EIP 2) bereits
ersichtlich. Bei den Schriftsätzen, die im Rahmen des US-Verfahrens ausgetauscht
worden seien, handele sich in diesem Zusammenhang um den einzigen „Schriftverkehr“
zwischen den Parteien. Die Klage der Antragsgegnerin in den USA sei insoweit ein
„Klageüberfall“ gewesen. Sie, die Antragstellerin, habe nie beabsichtigt, gegen die
Antragsgegnerin vorzugehen.
19. Die Antragstellerin bittet darum, keine Sicherheitsleistung anzuordnen. Es sei schon nicht
ersichtlich, welcher Schaden der Antragsgegnerin durch die hier beantragten einstweiligen
Maßnahmen überhaupt entstehen würde. Umgekehrt würde die Anordnung einer
Sicherheitsleistung an die Antragsgegnerin das hiesige Verfahren erheblich verzögern.
Hinterlegung oder Bankbürgschaft würden, auch mit Blick auf die bevorstehenden
Feiertage, aller Wahrscheinlichkeit mindestens drei bis vier Wochen in Anspruch nehmen.
Dies bereits wegen der internen Prozesse bei der Antragstellerin (Eidesstattliche
Versicherung Anlage EIP 7). Hinzu komme die Zeit, die für die (internationale)
Überweisung des Hinterlegungsbetrags an die Hinterlegungsstelle, d.h. das Amtsgericht
in Bayern, erforderlich sei.
20. Die Zuständigkeit des EPG ergebe sich aus Art. 32 (1) lit. c), 62 (1) EPGÜ, da die
Antragstellerin einstweilige Maßnahmen im Zusammenhang mit einem beim EPG geltend
gemachten Europäischen Patent begehre. […].
21. Die Antragstellerin sei auf eine alternative Zustellung angewiesen. Auch wenn eine
Zustellung nach Regel 275.1 VerfO dem Grundsatz nach subsidiär sei, sei zu beachten,
dass diese Norm dem Gericht ein pflichtgemäßes Ermessen einräume. Das Gericht könne
demnach überprüfen, ob gute Gründe dafür vorliegen, nicht nach dem eigentlich
vorgesehenen Verfahren zuzustellen. Regel 275.1 VerfO dürfe nicht zu eng verstanden
werden, sofern die Umstände des Einzelfalls eine bestimmte Herangehensweise für einen
effektiven Rechtsschutz andeuteten. Die Vorschrift werde auch dann subsidiär
angewendet, wenn die vorrangigen Zustellungen nach den Regeln 271 ff. VerfO erkennbar
erfolglos sein würden. Ein herkömmlicher Versuch der Zustellung nach Taiwan wäre
praktisch aussichtslos.
22. Wegen des Sach- und Streitstandes wird auf die Antragsschrift vom 29.11.2024, den
Schriftsatz der Antragstellerin vom 05.12.2024, die Klageschrift der Antragsgegnerin vom
31.10.2024 (Anlage EIP 2) und den Beschleunigungsantrag der Antragsgegnerin vom
07.11.2024 (Anlage EIP 5) Bezug genommen.
PROZESSGESCHEHEN
23. Die Antragstellerin hat den Antrag auf Erlass einstweiliger Maßnahmen am 29.11.2024
eingereicht. Am selben Tag hat sie überdies einen Antrag gem. Regel 262.2 VerfO im
Hinblick auf die in der Antragsschrift vom 29.11.2024 grau markierten Informationen
gestellt.
24. Die Berichterstatterin hat der Antragstellerin mit Anordnung vom 03.12.2024 Hinweise
erteilt. Die Antragstellerin hat hierauf mit Schriftsatz vom 05.12.2024 Stellung genommen.
Auch insoweit hat die Antragstellerin einen Antrag gem. Regel 262.2 VerfO gestellt.
GRÜNDE DER ANORDNUNG
25. Der zulässige Antrag auf Erlass einstweiliger Maßnahmen ist begründet.
I.
26. Der Antrag auf Erlass einstweiliger Maßnahmen ist zulässig.

27. Die internationale Zuständigkeit des EPG folgt aus Art. 31 EPGÜ i. V. m. Art. 71b Nr. 2
Brüssel Ia-VO. Der Erfolgsort der glaubhaft gemachten drohenden unerlaubten Handlung
liegt im Zuständigkeitsgebiet des EPG.

28. Die sachliche Zuständigkeit des EPG für den Erlass der einstweiligen Maßnahmen (AASI
und AEI) ergibt sich aus Art. 32 (1) EPGÜ.
29. Nach Art. 32 (1) c) EPGÜ besitzt das Gericht die ausschließliche Zuständigkeit für Klagen
auf Erlass von einstweiligen Maßnahmen und Sicherungsmaßnahmen und einstweiligen
Verfügungen. Die dahingehende Zuständigkeit ist jedenfalls auf Klagen bezogen, die
gemäß Art. 32 (1) a) EPGÜ in die ausschließliche Zuständigkeit des EPG fallen. Dies sind
u.a. Klagen wegen tatsächlicher oder drohender Verletzung von Patenten.
30. Als eine Verletzung eines Patents ist nicht nur die rechtswidrige Benutzung eines Patents
anzusehen, sondern auch ein Eingriff in das Eigentumsrecht des Patentinhabers durch
Untersagung der Geltendmachung seines Patentrechts (so auch: Grabinski/W.Tilmann, in
Tilmann/Plasmann, Einheitspatent, Einheitliches Patentgericht, 2. Aufl., Art. 32 Rn. 61a).
31. Eine derartige Verletzung des Eigentumsrechts der Antragstellerin steht vorliegend im
Raum. Die Antragsgegnerin begehrt mit ihrer Klage vom 31.10.2024 (Anlage EIP 4) vor
den US-amerikanischen Gerichten den Erlass einer ASI und einer AEI. Der Antragstellerin
soll die Geltendmachung auch des Streitpatents vor dem EPG (vor einer deutschen
Lokalkammer des EPG) dauerhaft untersagt werden, gleichfalls soll die Durchsetzung
etwaiger Entscheidungen des EPG (bzw. einer deutschen Lokalkammer des EPG)
untersagt werden. Derartige Untersagungsmaßnahmen bzw. Prozessführungsverbote
greifen in das Eigentumsrecht der Antragstellerin in Bezug auf das Streitpatent ein.

32. Die Zuständigkeit der Lokalkammer München ist auf Art. 33 Abs. (1) a) EPGÜ gestützt.
Die Verletzung des Eigentumsrechts der Antragstellerin droht im Zuständigkeitsbereich
der hiesigen Lokalkammer. Der Antragstellerin soll u.a. untersagt werden, die vor der
Lokalkammer München anhängige Klage UPC_CFI_208/2024 ACT 24735/2024 nicht
weiter zu betreiben bzw. insoweit erlassene Entscheidungen sollen nicht vollstreckt
werden dürfen.

33. […] steht der Zuständigkeit des EPG bzw. der Lokalkammer München nicht entgegen.
[…]. Die Antragstellerin macht mit ihrem Antrag auf Erlass einstweiliger Maßnahmen […]
Ansprüche wegen einer unerlaubten Handlung.

34. Schließlich ist auch keine Rechtshängigkeitssperre infolge des Verfahrens vor dem
Landgericht München I (Az. 7 O 14547/24) eingetreten. Dieses Verfahren betrifft einen
anderen Streitgegenstand. Vor dem Landgericht München I ist die drohende Verletzung
des EP Patents EP 1 903 733 sowie der Zugang zur nationalen deutschen Gerichtsbarkeit
streitgegenständlich. Vorliegend droht die Verletzung des Streitpatents infolge der
drohenden Untersagung des Zugangs zum EPG.
II.
35. Der Antrag auf Erlass einstweiliger Maßnahmen ist gem. Art. 62 (1), (2) EPGÜ i. V. m.
Regel 211 Abs. 1, 2, 3 VerfO begründet. Es ist überwiegend wahrscheinlich, dass die
Antragstellerin zur Einleitung des Verfahrens berechtigt ist und ihre Rechte aus dem
Streitpatent verletzt werden. Die im Rahmen der Ermessensentscheidung
vorzunehmende Interessensabwägung fällt zu Gunsten der Antragstellerin aus.

36. Die Antragstellerin ist entsprechend Regel 8 (5) VerfO als anspruchsberechtigt
anzusehen. Sie ist im Register als Inhaberin des Streitpatents eingetragen.

37. Es ist überwiegend wahrscheinlich, dass die Antragstellerin in ihren Rechten bezüglich
des Streitpatents verletzt wird. Die Antragstellerin hat die drohende Verletzung ihres
Eigentumsrechts in Bezug auf das Streitpatent und weiterer Patente durch die seitens der
Antragsgegnerin vor dem US-amerikanischen Gericht gestellten Anträge B. und C. in der
Klageschrift vom 31.10.2024 (Anlage EIP 4) glaubhaft gemacht.
a.
38. Nach Art. 47 Abs. 1 EU-Charta hat jede Person, deren durch das Recht der Union
garantierte Rechte oder Freiheiten verletzt worden sind, das Recht bei einem Gericht
einen wirksamen Rechtsbehelf einzulegen. Art. 47 Abs. 2 EU-Charta gibt jeder Person
das Recht, dass ihre Sache von einem unabhängigen, unparteiischen und zuvor durch
Gesetz errichteten Gericht in einem fairen Verfahren, öffentlich und innerhalb
angemessener Frist verhandelt wird. Art. 47 EU-Charta verbürgt folglich auf europäischer
Ebene einen allgemeinen Justizgewährungsanspruch, sprich den Zugang zu Gerichten.
Gemäß Art. 17 Abs. 2 EU-Charta handelt es sich bei geistigem Eigentum um jedenfalls
eigentumsähnliche Rechte, welche nach der Charta zu schützen sind. Folglich schützen
Art. 47 Abs. 1 und 2 EU-Charta auch den Zugang einer Person zum EPG zwecks
Geltendmachung einer (behaupteten) rechtswidrigen Benutzung eines Patents.
b.
39. Nach deutschem Recht, welches vorliegend gem. Art. 24 (1) e) EPGÜ Anwendung findet,
gewähren Art. 2 Abs. 1, 19 Abs. 4 GG den allgemeinen Justizgewährungsanspruch. §§
823 Abs. 1, 1004 (analog) BGB bieten eine materiell-rechtliche Grundlage zum Schutz
des Eigentums, die sich nur mittels des soeben dargestellten verfassungsrechtlich
geschützten rechtsstaatlichen Grundsatzes durchsetzen lässt.
c.
40. Die von der Antragsgegnerin mit der Klageschrift vom 31.10.2024 (Anlage EIP 4) in dem
US-amerikanischen Verfahren mit den Anträgen B. und C. beantragten ASI und AEI
stellen sich bei ihrer Anordnung als umfassendes Prozessführungsverbot vor dem EPG
und umfassendes Vollstreckungsverbot von Entscheidungen des EPG dar. Derartige
Verbote verstoßen gegen die zuvor erörterten Justizgewährungsansprüche; es handelt
sich um unerlaubte Eingriffe in das jedenfalls eigentumsähnliche Recht der Antragstellerin.
d.
41. Die Anträge B. und C. der Klageschrift vom 31.10.2024 (Anlage EIP 4) betreffen auch das
Verfahren UPC_CFI_208/2024 ACT 24735/2024 und Verfahren vor dem EPG soweit sie
vor einer deutschen Lokalkammer geltend gemacht werden. Dies ist zwar dem Wortlaut
der Anträge B. und C. nicht ausdrücklich zu entnehmen, in denen lediglich von „Verfahren
gegen […] in Deutschland“ die Rede ist. Dies könnte bei erster Betrachtung so verstanden
werden, dass (nur) Verfahren vor den nationalen Gerichten bzw. der deutschen
Gerichtsbarkeit erfasst werden sollen, nicht jedoch Verfahren vor dem EPG, bei dem es
sich um ein gemeinsames, einheitliches europäisches Gericht der Vertragsmitgliedstaaten
handelt. Auch wenn das EPG über eine dezentrale Struktur verfügt und verschiedene
Kammern an verschiedenen Standorten in Vertragsmitgliedstaaten errichtet worden sind,
gibt es kein „deutsches EPG“ oder ein „EPG in Deutschland“. Die in Deutschland
errichteten Lokalkammern des EPG sind auch kein Teil der deutschen Gerichtsbarkeit.
Dafür, dass die Anträge B. und C. der Klageschrift vom 31.10.2024 (Anlage EIP 4) nur das
Verfahren vor dem Landgericht München I betreffen sollen, könnte darüber hinaus
sprechen, dass die Antragsgegnerin in der Klageschrift auf den 20.02.2025 als
Entscheidungsdatum der „deutschen Gerichte“ abstellt.
42. Gleichwohl erscheint es bei einer Gesamtbetrachtung aufgrund des objektiven
Empfängerhorizonts wahrscheinlich, dass die Antragsgegnerin mit der gewählten
Antragsformulierung auch das Verfahren UPC_CFI_208/2024 ACT 24735/2024 und
Verfahren vor dem EPG erfassen will. In der Klageschrift vom 31.10.2024 wird das
Streitpatent ausdrücklich genannt (Anlage EIP 4, Rn. 158). Das Streitpatent wird allerdings
nur vor der Lokalkammer München in dem Verfahren UPC_CFI_208/2024 ACT
24735/2024 geltend gemacht. Die Antragsgegnerin führt zudem hinsichtlich der Klagen
der Antragstellerin aus „In April/May of 2024, Avago Sales sued […] in the Unified Patent
Court („UPC“) in Germany, and in German courts, for infringement“ (Anlage EIP 4, Rn. 73)
und „Avago Sales inappropriately sued […] in the UPC despite Realtek´s valid license“
(Anlage EIP 4, Rn. 75). Zwischen den verschiedenen eingeklagten Patenten und/oder den
Gerichtsbarkeiten wird sodann nicht weiter differenziert. In dem Beschleunigungsantrag
vom 07.11.2024 wird das Streitpatent ebenfalls ausdrücklich genannt (Anlage EIP 6, Rn.
15) und die Klagen der Antragstellerin in gleicher Weise wie in der Klageschrift erwähnt
(Anlage EIP 6, Rn. 32, 41). Eine weitere Differenzierung zwischen dem Patent, welches
Gegenstand des Verfahrens vor dem Landgericht München I ist, und dem Streitpatent wird
auch in diesem Antrag nicht vorgenommen. Da das Streitpatent nur in Deutschland in Kraft
steht, weshalb sich die Antragstellerin in dem genannten Verfahren vor dem EPG auch
nur gegen (vermeintliche) Benutzungshandlungen in Deutschland wendet, ist es
wahrscheinlich, dass die Antragsgegnerin mit der – als solchen ungenauen –
Formulierung in den Anträgen B. und C. der Klageschrift vom 31.10.2024 (Anlage EIP 4)
auch das Verfahren UPC_CFI_208/2024 ACT 24735/2024 und Verfahren vor dem EPG
erfassen will. Sie hat in den Anträgen nur auf den Ort, an dem die Gerichte ansässig sind
bzw. ihren Standort haben, abgestellt, jedoch keine Einschränkung auf eine (deutsche)
Gerichtsbarkeit vorgenommen.
e.
43. Die Anträge B. und C. der Klageschrift vom 31.10.2024 (Anlage EIP 4) sind des Weiteren
gegen Verletzungsklagen aus allen SEPs der Antragstellerin, die sie beim EPG erheben
will, gerichtet. Sie sind nicht beschränkt auf die von der Antragstellerin bislang vor dem
EPG (oder den deutschen Gerichten) geltend gemachten Patente.
f.
44. Die genannten Anträge der Antragsgegnerin sind allerdings insoweit beschränkt, als dass
sie nur auf die Durchsetzung und Vollstreckung von Patentrechten in Deutschland zielen.
Unabhängig von der Ungenauigkeit der seitens der Antragsgegnerin gewählten
Formulierung, verdeutlicht diese unter Berücksichtigung des gesamten Inhalts der
Klageschrift vom 31.10.2024 (Anlage EIP 4), dass hinsichtlich Verfahren, die die
Antragstellerin wegen (vermeintlicher) Benutzung ihrer Patente vor einem anderen
Gericht, das nicht zur deutschen Gerichtsbarkeit gehört oder dessen angerufener Standort
sich außerhalb Deutschlands befindet, keine ASI und/oder AEI beantragt. Da keine
tatsächlichen Umstände vorgetragen und glaubhaft gemacht und auch sonst nicht
ersichtlich sind, aus denen sich die Beantragung einer ASI und/oder AEI im Hinblick auf
andere Länder ergibt, kann insoweit auch keine Erstbegehungsgefahr angenommen
werden. Der Verweis der Antragstellerin auf die allgemeine Lebenserfahrung genügt
insoweit nicht, zumal die Antragstellerin selbst vorträgt, dass sie selbst derzeit nur vor
deutschen Gerichten und deutschen Lokalkammern des EPG Rechte geltend macht.

45. Die gemäß Art. 62 (2) EPGÜ und Regel 211 Abs. 3 VerfO vorzunehmende Abwägung der
Interessen der Parteien, in die sämtliche Umstände des Einzelfalls einzufließen haben,
fällt vorliegend zu Gunsten der Antragstellerin aus. Der Erlass der einstweiligen
Anordnung ist sowohl zeitlich als auch objektiv dringlich. Es kann der Antragstellerin nicht
zugemutet werden, mit der Durchsetzung ihrer Ansprüche bis zum Abschluss eines
Hauptsacheverfahrens zu warten (vgl. zum Erfordernis der objektiven Dringlichkeit bzw.
sachlichen Erforderlichkeit: Lokalkammer Düsseldorf, Anordnung v. 31.10.2024,
UPC_CFI_347/2024 – Valeo Electrification/Magna PT u.a.; Lokalkammer München,
Anordnung v. 25.11.2024, UPC_CFI_443/2024 – Häfele/Kunststoff KG Nehl).
a.
46. Die Anordnung der beantragten einstweiligen Maßnahmen ist in zeitlicher Hinsicht
dringlich, R. 209.2 (b) VerfO.
47. Die für die Anordnung einstweiliger Maßnahmen notwendige zeitliche Dringlichkeit fehlt
nur dann, wenn sich der Verletzte bei der Verfolgung seiner Ansprüche in einer solchen
Weise nachlässig und zögerlich verhalten hat, dass aus objektiver Sicht der Schluss
geboten ist, dem Verletzten sei an einer zügigen Durchsetzung seiner Rechte nicht
gelegen, weswegen es auch nicht angemessen erscheint, ihm die Inanspruchnahme
vorläufigen Rechtschutzes zu gestatten (vgl. auch Lokalkammer München, UPC_CFI
443/2024, Entscheidung v. 25.11.2024 – Häfele/Kunststoff KG Nehl; Lokalkammer
Düsseldorf, UPC_CFI_347/2024 – Valeo Electrification/Magna PT u.a). Ein nachlässiges
und zögerliches Verhalten ist vorliegend nicht zu erkennen.
48. Der Zeitraum des Zuwartens im Sinne von Regel 211.4 VerfO ist ab dem Tag zu
bemessen, an dem ein Antragsteller von der Rechtsverletzung eine solche Kenntnis hat
oder hätte haben müssen, die ihn in die Lage versetzt, einen Antrag auf einstweilige
Maßnahmen nach Regel 206.2 VerfO erfolgversprechend zu stellen (Berufungsgericht,
Anordnung v. 25.09.2024, UPC_CFI_182/2024 – Ortovox Sportartikel/Mammut Sports
Group u.a.). Dem Vortrag der Antragstellerin zufolge erhielt sie am 01.11.2024 Kenntnis
von der Klageschrift der Antragsgegnerin (Anlage EIP 4). Da diese auf den 31.10.2024
datiert, ist das Vorbringen der Antragstellerin glaubhaft. Ausgehend vom 01.11.2024 (oder
dem frühestens möglichen Zeitpunkt, dem 31.10.2024) kann ein Antrag auf Erlass
einstweiliger Maßnahmen, der am 29.11.2024 bei Gericht eingegangen ist, nicht als
zögerlich oder nachlässig angesehen werden.
49. Nichts anderes folgt aus dem Umstand, dass die Antragstellerin vor dem Landgericht
München I Tage zuvor einen ähnlichen Antrag eingereicht hat, der zum Beschluss des
Landgerichts München I vom 22.11.2024 (Az. 7 O 14547/24, Anlage EIP 1) führte.
Abgesehen davon, dass die Dringlichkeit im Hinblick auf jedes Verfahren gesondert zu
betrachten ist, ist es der Antragstellerin zuzugestehen, die Reichweite des Beschlusses
des Landgerichts München I zu überprüfen und die Erfolgsaussichten eines Antrags auf
Erlass einer Anti-ASI beim EPG verlässlich und ordnungsgemäß zu prüfen. Hierfür bedarf
es eines gewissen Zeitraums, der jedenfalls vorliegend nicht überschritten ist. Zu
berücksichtigen ist insoweit insbesondere, dass eine (gefestigte) Rechtsprechung des
EPG zu dieser Thematik nicht existiert; Entscheidungen des EPG hierzu sind nicht
veröffentlicht. Vielmehr handelt es sich – soweit ersichtlich – bei dem vorliegenden Antrag
auf Erlass derartiger Maßnahmen um den ersten, der seitens des EPG zu entscheiden ist.
b.
50. Der Erlass der einstweiligen Maßnahme ist auch objektiv dringlich. Er ist sachlich geboten
und erforderlich. Die Antragstellerin kann nicht auf ein Hauptsacheverfahren verwiesen
werden.
51. Sollte das US-amerikanische Gericht die von der Antragsgegnerin beantragte ASI
und/oder AEI erlassen, wären diese sofort in den USA vollstreckbar. Die Antragstellerin
könnte sich – infolge der ihr drohenden Sanktionen bei Nichtbeachtung der Anordnungen
des US-amerikanischen Gerichts – insbesondere gezwungen sehen, die vor der
Lokalkammer München anhängige Klage UPC_CFI_208/2024 ACT 24735/2024
zurückzunehmen. Die ihrer Ansicht nach gegebene rechtswidrige Benutzung des
Streitpatents durch die […] und die […] würde demzufolge einer gerichtlichen Kontrolle
durch das zuständige Gericht entzogen. Auch die Frage, ob im Hinblick auf die von der
Antragsgegnerin an den […]-Konzern gelieferten Komponenten tatsächlich (in
Deutschland) Erschöpfung eingetreten ist, könnte nicht geprüft werden. Etwaige Rechte
der Antragstellerin, insbesondere solche auf Unterlassung der behaupteten
Patentverletzung in Deutschland und Feststellung einer Schadenersatzpflicht bzw. das
Recht auf Schadenersatz, könnten vor der Lokalkammer München bzw. dem EPG dann
nicht durchgesetzt werden. Die Anträge B. und C. der Klageschrift vom 31.10.2024
(Anlage EIP 4) sind zudem auf eine dauerhafte Untersagung von Klagen aus sämtlichen
SEP der Antragstellerin vor einer Lokalkammer des EPG, die ihren Standort in
Deutschland hat, und/oder gegen eine Vollstreckung aus Entscheidungen des EPG
gerichtet, wobei die Vollstreckung sogar ohne Bezug zu den Komponenten der
Antragsgegnerin untersagt werden soll. Würde sich die Antragstellerin an dahingehende
ASI und/oder AEI halten (müssen), würde dieser Eingriff in ihr jedenfalls
eigentumsähnliches Recht zu einer (materiellen und finanziellen) Entwertung des
Streitpatents bzw. der SEP führen, wodurch der Antragstellerin der Eintritt eines
erheblichen Schadens droht.
52. Der Antragstellerin droht auch dann ein erheblicher Schaden, wenn sie bei Anordnung der
ASI und/oder AEI diese nicht beachten würde. Die Antragstellerin hat glaubhaft gemacht,
dass das US-amerikanische Gericht bei Verstoß gegen eine angeordnete ASI und/oder
AEI wahrscheinlich erhebliche Sanktionen verhängen wird. Dem glaubhaft gemachten
Vortrag der Antragstellerin ist zu entnehmen, das US-amerikanische Gerichte in der
Vergangenheit bei Missachtung des Gerichts Strafzahlungen in Höhe von bis zu USD
100.000,00 pro Tag der Zuwiderhandlung angeordnet haben, wobei sich diese
Strafzahlungen ab bestimmten Zeitpunkten eines andauernden Verstoßes verdoppelt und
vervierfachen können (Eidesstattliche Versicherung, Anlage EIP 6).
53. Da die Anordnung der ASI und/oder die AEI in dem US-amerikanischen Verfahren in
Anbetracht des Beschleunigungsantrages der Antragsgegnerin vom 07.11.2024 (Anlage
EIP 5), der ausdrücklich auf den Verhandlungstermin vor dem Landgericht München I
Bezug nimmt, und um eine gerichtliche Entscheidung jedenfalls vor diesem Termin bittet,
zeitnah bevorsteht, kann die Antragstellerin nicht auf eine Hauptsacheklage vor dem EPG
verwiesen werden. Eine solche könnte unter keinen Umständen bis zum 20.02.2025
vollständig durchgeführt werden; eine Entscheidung des Gerichts im Klageverfahren vor
dem 20.02.2025 ist ausgeschlossen. Eine (endgültige) Unterlassungsanordnung des
Gerichts, die Auswirkungen auf das US-amerikanische Gericht zeitigen könnte, käme
folglich zu spät. Die Rechte der Antragstellerin würden mit einer Unterlassungsanordnung,
die erst nach Anordnung der ASI und/oder AEI erlassen wird, jedoch allenfalls
unzureichend gewahrt.
c.
54. Bei der Interessensabwägung kann zudem nicht außer Acht gelassen werden, dass die
Antragsgegnerin an dem Verfahren UPC_CFI_208/2024 ACT 24735/2024 nicht beteiligt
ist und ihre Angaben in der Klageschrift vom 31.10.2024 (Anlage EIP 4) bzw. dem
Beschleunigungsantrag vom 07.11.2024 (Anlage EIP 5) zu etwaigen angemessenen
Rechtsbehelfen sowie dem Umfang einer etwaigen Unterlassungsanordnung in diesem
Verfahren jedenfalls missverständlich sind.
55. Den Angaben der Antragsgegnerin und dem Vorbringen der […] und die […] in dem
Verfahren UPC_CFI_208/2024 ACT 24735/2024 zufolge sind die Kfz […] mit einer
Komponente der Antragsgegnerin ausgestattet. Da der insoweit erhobene Einwand der
Erschöpfung jedenfalls voraussetzt, dass diese Komponente (jedenfalls teilweise) von
dem Streitpatent Gebrauch macht, wäre prinzipiell ein rechtliches Interesse der
Antragsgegnerin anzunehmen, weshalb es der Antragsgegnerin offensteht, nach Regel
316 VerfO einen Antrag auf Streithilfe einzureichen. Ein Streithelfer wird gemäß Regel 317
VerfO grundsätzlich als Partei behandelt; die Antragsgegnerin hätte dem Vorbringen der
Antragstellerin in dem Verfahren vor dem EPG mithin entgegentreten können und ihre
Rechte umfassend verteidigen können. Ihr stand und steht mithin ein angemessener
Rechtsbehelf zur Seite. Von diesem hat die Antragsgegnerin jedoch keinen Gebrauch
gemacht.
56. Die Antragstellerin stützt ihre Klage UPC_CFI_208/2024 ACT 24735/2024 auf eine
Benutzung des Streitpatents in Deutschland. Die beantragten Rechtsfolgen, insbesondere
auch eine etwaige Unterlassungsanordnung sind auf das Territorium Deutschlands
beschränkt. Angesichts dessen erschließt sich nicht, weshalb, wie die Antragsgegnerin in
ihrer Klageschrift und dem Beschleunigungsantrag vorträgt, bei Erlass einer
Unterlassungsanordnung ein Verkaufsstopp „in Europa und wahrscheinlich auch in den
Vereinigten Staaten“ drohen sollte. Ein solcher würde jedenfalls nicht unmittelbar aus der
ausgeurteilten Unterlassung folgen. Soweit die Antragsgegnerin in diesem
Zusammenhang auf den 20.02.2025 Bezug nimmt, dem Tag, an dem vor dem Landgericht
München I verhandelt wird, ändert dies nichts. Wie bereits ausgeführt, differenziert die
Antragsgegnerin in der Klageschrift vom 31.10.2024 (Anlage EIP 4) nicht deutlich
zwischen dem Verfahren vor dem Landgericht München I und dem Verfahren
UPC_CFI_208/2024 ACT 24735/2024. Sie trägt vielmehr vor, die „deutschen Gerichte“
würden bis zum 20.02.2025 entscheiden, wobei, wie bereits ausgeführt, unter „deutsche
Gerichte“ auch die Lokalkammer München zu fassen ist. Aus dem genannten Datum kann
folglich nicht der Schluss gezogen werden, die Antragsgegnerin argumentiere hinsichtlich
der Folgen nur mit Blick auf das Verfahren vor dem Landgericht München I. Dies auch
deshalb nicht, weil bei dieser Sichtweise jeder Vortrag zu dem Verfahren vor dem EPG
fehlen würde, obgleich dieses Verfahren auch Grundlage der Anträge B. und C. der
Klageschrift vom 31.10.2024 (Anlage EIP 4) sind.
d.
57. Schließlich spricht auch die Abwägung der der Parteien möglicherweise drohenden
Schäden für einen Erlass der einstweiligen Maßnahmen.
58. Wenn der Antrag abgewiesen wird, besteht die glaubhaft gemachte Gefahr, dass die von
der Antragsgegnerin beantragte ASI und/oder AEI angeordnet wird. Dies wäre mit den
bereits unter b. dargestellten Konsequenzen für die Antragstellerin verbunden. Der
Antragstellerin drohen demzufolge erhebliche Schäden.
59. Werden die einstweiligen Maßnahmen erlassen, ist der Antragsgegnerin untersagt, die
Anträge B. und C. ihrer Klageschrift vom 31.10.2024 (Anlage EIP 4) weiterzubetreiben.
Dies beinhaltet u.a. die Rücknahme dieser Anträge. Zwar ist nicht auszuschließen, dass
auch dies zu einem Schaden auf Seiten der Antragsgegnerin führen kann. Der ihr etwaig
drohende Schaden ist indes weniger gravierend. Die Antragsgegnerin ist nicht an der
Durchsetzung ihrer Rechte aus der Lizenzvereinbarung gehindert. Das US-amerikanische
Verfahren kann hinsichtlich der übrigen Klageanträge fortgeführt werden, so dass
insbesondere die behauptete Verletzung der zwischen den Parteien geschlossene
Lizenzvereinbarung überprüft werden würde. Die von der Antragstellerin beantragten
einstweiligen Maßnahmen beziehen sich allein auf die beantragte ASI und AEI. Darüber
hinaus wird die von der Antragstellerin behauptete Benutzung des Streitpatents in dem
Verfahren UPC_CFI_208/2024 ACT 24735/2024 geprüft. Dies erfolgt einschließlich des
erhobenen Einwands der Erschöpfung, sofern es auf diesen entscheidungserheblich
ankommen sollte. Der Antragsgegnerin ist es zudem unbenommen, die […] und die […]
in der Rechtsverteidigung zu unterstützen und/oder in dem Verfahren einen
Streithilfeantrag zu stellen.
III.
60. Die von der Antragstellerin beantragte Anordnung einstweiliger Maßnahmen ohne
vorherige Anhörung der Antragsgegnerinnen erscheint vorliegend angemessen und
geboten, R. 206.3, 209.2 (c) VerfO i. V. m. R. 212.1 VerfO.
61. Die Antragstellerin hat glaubhaft gemacht, dass ihr ohne den Erlass einer ex-parte-
Anordnung aufgrund der mit der Einbeziehung der Gegenseite verbundenen Verzögerung
wahrscheinlich ein nicht wiedergutzumachender Schaden droht. Die Antragsgegnerin hat
ihren Sitz in Taiwan. Eine Zustellung des Antrags auf Erlass einstweiliger Maßnahmen
würde jedenfalls einen solchen Zeitraum in Anspruch nehmen, der in Anbetracht des
Beschleunigungsantrages der Antragsgegnerin in dem US-amerikanischen Verfahren
(Anlage EIP 5) aller Voraussicht nach dazu führen würde, dass eine Entscheidung über
den Antrag auf Erlass einstweiliger Maßnahmen erst nach einer Entscheidung des US-amerikanischen
Gerichts und etwaiger Anordnung der ASI und/oder AEI erfolgen könnte.
62. Infolge des Beschleunigungsantrages der Antragsgegnerin vom 07.11.2024 (Anlage EIP
5) sowie des von der Antragstellerin behaupteten Umstandes, dass die Klageschrift vom
31.10.2024 (Anlage EIP 2) der einzige „Schriftverkehr“ der Parteien zu dieser Thematik
gewesen ist, die Antragstellerin mithin von den Anträgen B. und C. „überrascht“ worden
ist, ist es ebenfalls wahrscheinlich, dass die Antragsgegnerin selbst umgehend
einstweilige Maßnahmen, eine sogenannte Temporary Restraining Order ergreifen würde.
Das US-amerikanische Verfahren könnte folglich unter Verkürzung der Fristen noch weiter
beschleunigt werden (vgl. Eidesstattliche Versicherung Anlage EIP3). Die Anhörung der
Antragsgegnerin würde dann dazu führen, dass der hier geltend gemachte Schutz der
Rechte der Antragstellerin verkürzt oder gar ausgehebelt würde.
63. Angesichts dessen sowie vor dem Hintergrund, dass die Klageschrift der Antragsgegnerin
vom 31.10.2024 (Anlage EIP 2) und der Beschleunigungsantrag vom 07.11.2024 (Anlage
EIP 5) dem Antrag auf Erlass einstweiliger Maßnahmen als Anlagen beigefügt wurden,
die Rechtsposition und Argumentation der Antragsgegnerin mit Blick auf eine ASI
und/oder AEI vom Gericht mithin berücksichtigt werden können, erscheint es vorliegend
angezeigt, ausnahmsweise von einer vorherigen Anhörung der Antragsgegnerin
abzusehen.
IV.
64. Gemäß Regel 211.5 VerfO hat das Gericht die Erbringung einer Sicherheitsleistung
anzuordnen, wenn die Anordnung einstweiliger Maßnahmen – wie hier – ohne vorherige
Anhörung des Antragsgegners erfolgt.
65. Besondere Umstände, die vorliegend ausnahmsweise gegen eine solche Anordnung
sprechen könnten, sind weder vorgetragen noch ersichtlich. Es kann auf der Grundlage
des vorgetragenen und glaubhaftgemachten Sachverhalts insbesondere nicht festgestellt
werden, dass ein Schaden der Antragsgegnerin ausgeschlossen ist. Soweit die
Antragstellerin argumentiert, die Anordnung einer Sicherheitsleistung würde die
Wirksamkeit der begehrten Maßnahme verzögern, kann dem nicht gefolgt werden. Die
von ihr vorgetragenen Verzögerungen durch interne Prozesse bei der Antragstellerin hat
sie selbst in der Hand und selbst zu verantworten. Auch der Verweis auf die vermeintlichen
Zeitläufe bei einer Hinterlegung der Sicherheit verfängt nicht. Die Hinterlegung einer
Sicherheit gem. Regel 352 VerfO kann unmittelbar beim EPG erfolgen. Das EPG hat
hierfür eigens eine Kontoverbindung eingerichtet. Die Daten der Kontoverbindung sind auf
der Webseite des EPG veröffentlicht
66. Die Sicherheitsleistung soll die Prozesskosten, andere Kosten wegen der Vollstreckung
sowie eine mögliche Kompensation für entstandene oder wahrscheinlich entstehende
Schäden abdecken, Regel 352.1 VerfO. Da sich die Höhe möglicher
Vollstreckungsschäden im Zeitpunkt des Erlasses einer Anordnung für die Lokalkammer
nur schwer abschätzen lassen, orientiert sich die Höhe der festgesetzten
Sicherheitsleistung grundsätzlich an der Höhe des Streitwertes. Auch wenn der Streitwert
nicht zwingend mit dem Schadensrisiko korrespondiert, bietet er jedenfalls einen
Anhaltspunkt, welche wirtschaftliche Bedeutung die Antragstellerseite der Sache beimisst.
Die Antragstellerin ist hierauf hingewiesen worden, hat indes zur konkreten Höhe der
Sicherheit nichts weiter vorgetragen.
67. Solange diese Sicherheit nicht erbracht ist, fehlt es an der Vollstreckbarkeit der
Anordnung. Die Festsetzung von Zwangsgeldern (Art. 82 (4) EPGÜ, Regel 354.4 VerfO)
kommt nur für Zuwiderhandlungen in Betracht, in deren Zeitpunkt die Sicherheitsleistung
bereits erbracht und die betreffende Antragsgegnerin über die Erbringung der
Sicherheitsleistung nachweislich in formalisierter Form unterrichtet wurde.
V.
68. Eine Kostengrundentscheidung ist vorliegend nicht zu treffen. Eine solche sieht die
Verfahrensordnung lediglich im Hauptsacheverfahren (vgl. Regel 118.5 VerfO), nicht aber
im Verfahren auf Anordnung vorläufiger Maßnahmen vor. Die Kosten des Eilverfahrens
sind grundsätzlich im Hauptsacheverfahren geltend zu machen. Eine im Eilverfahren
mögliche Anordnung einer vorläufigen Kostenerstattung (Regel 211.1 (d) VerfO) setzt
einen entsprechenden bezifferten Antrag voraus. Ein solcher ist vorliegend nicht gestellt.
VI.
69. Eine alternative Zustellung gem. Regel 275 Abs. 1 VerfO kann derzeit nicht zugelassen
werden. Ein dahingehendes Ermessen ist derzeit nicht eröffnet.
70. Eine alternative Zustellung erfordert nach dem Wortlaut der Regel 275.1 VerfO, dass eine
„Zustellung nach Abschnitten 1 und 2 nicht vorgenommen werden“ konnte. Die alternative
Zustellung ist demzufolge subsidiär; es muss zunächst ein (erfolgloser) Zustellversuch
nach den jeweils einschlägigen Regeln unternommen worden sein (Berufungsgericht,
UPC_CoA_69/2024, Anordnung v. 29.07.2024 – NEC/TCL; UPC CFI, Lokalkammer
Hamburg, UPC_CFI_169/2024, Anordnung v. 18 April 2024 – Daedalus/Xiaomi;
Lokalkammer Mannheim, UPC_CFI_ 219/2023, Anordnung v. 08.12.2023 –
Panasonic/Xiaomi). Erst dann ist für das Gericht das Ermessen eröffnet, eine alternative
Zustellung zuzulassen.
71. Dieses gestufte Konzept gilt nicht nur für Anordnungen und/oder Entscheidungen in einer
Hauptsacheklage, sondern auch für Anordnungen in einem Eilverfahren. Eine
Differenzierung nach Verfahrensart ist weder Regel 275.1 VerfO noch den sonstigen
Regelungen der VerfO zur Zustellung von Anordnungen oder Entscheidungen zu
entnehmen. Sie entspricht auch nicht den (internationalen) Regelungen sowie Abkommen
betreffend die Zustellung von gerichtlichen Anordnungen oder Entscheidungen. Das
Erfordernis eines Zustellversuches nach den einschlägigen (internationalen) Normen
hängt im Übrigen auch nicht davon ab, ob der Zustellversuch erfolgversprechend oder
vermeintlich aussichtslos sein wird.
72. Ein (erfolgloser) Zustellversuch gemäß Regel 276. 1 i. V. m. Regel 274 (a) (iii) VerfO ist
bislang nicht unternommen worden.
VI.
73. Der Bitte der Antragstellerin, von einer Fristsetzung mit Blick auf eine Hauptsacheklage
abzusehen, kann nicht entsprochen werden. Regel 213.1 VerfO eröffnet kein Ermessen.
ANORDNUNG
I. Der Antragsgegnerin wird untersagt,
die Klage vom 31. Oktober 2024, die zunächst von ihr vor dem Court of Chancery of
the State of Delaware (USA) (Anlage EIP 1) eingereicht wurde (Aktenzeichen 2024-
1127-NAC), und die anschließend an den U.S. District Court of the District of Delaware
verwiesen wurde (Aktenzeichen 1:24-cv-01235-GBW) weiterzubetreiben,
insbesondere in Bezug auf die Anträge B und C, und auch sofern damit der
Antragstellerin unmittelbar oder mittelbar verboten werden soll,
die bei der Lokalkammer München des Einheitlichen Patentgerichts eingereichte
Patentverletzungsklage vom 1. Mai 2024 (ACT_24735/2024) weiter zu betreiben oder
um weitere Klageansprüche aus weiteren SEP der Antragstellerin zu erweitern oder
weitere Verletzungsklagen wegen Verletzung von SEP aus dem Portfolio der
Antragstellerin gegen die mit der oben genannten Klage in Anspruch genommenen
Unternehmen des […]-Konzerns, nämlich […] und […], oder ihre verbundenen
Konzernunternehmen oder weitere Unternehmen des […]-Konzerns, bei einer
Lokalkammer des EPG auf dem Gebiet der Bundesrepublik Deutschland sowohl mit
Wirkung für die Bundesrepublik Deutschland als auch mit Wirkung für andere
Mitgliedstaaten des EPGÜ zu erheben und zu betreiben („Anti-Suit Injunction“); und
Unterlassungsurteile des EPG, die gegen die mit der oben genannten Klage in
Anspruch genommenen Unternehmen des […]-Konzerns, nämlich […] und […], oder
ihre verbundenen Konzernunternehmen oder weitere Unternehmen des […]-Konzerns
ergehen, in der Bundesrepublik Deutschland zu vollstrecken („Anti-Enforcement
Injunction“),
wobei diese Unterlassungsverpflichtung umfasst,
- das Gebot, die Anträge auf Erlass einer Anti-Suit Injunction und einer Anti-
Enforcement Injunction vom 31. Oktober 2024, welche zunächst vor dem Court of
Chancery of the State of Delaware (USA) (Anlage EIP 1) (Aktenzeichen 2024-1127-
NAC) beantragt wurden, und die anschließend an den U.S. District Court of the District
of Delaware verwiesen wurden (Aktenzeichen 1:24-cv-01235-GBW), unabhängig
davon, bei welchem U.S. Gericht sie zum Zeitpunkt der Vollziehung dieser
Entscheidung gerade anhängig sind, unverzüglich nach Zustellung dieses
Verfügungsbeschlusses zurückzunehmen,
- das Verbot, dieses Anti-Suit Injunction- und Anti-Enforcement Injunction-Verfahren,
außer zum Zweck der Antragsrücknahme weiter zu betreiben,
- das Verbot, für den Fall, dass in der Zwischenzeit die oben genannten Anti-Suit
Injunction- und/oder Anti-Enforcement Injunction-Anordnungen ergehen, diese gegen
die Antragstellerin zu vollstrecken, und
- das Verbot, andere gleichwertige Maßnahmen zu beantragen, mit denen der
Antragstellerin unmittelbar oder mittelbar verboten werden soll, ihre Patentrechte
gegen Unternehmen des […]-Konzerns bei einer Lokalkammer des EPG auf dem
Gebiet der Bundesrepublik Deutschland sowohl mit Wirkung für die Bundesrepublik
Deutschland als auch mit Wirkung für andere Mitgliedstaaten des EPGÜ
durchzusetzen.
II. Im Falle jeder Zuwiderhandlung gegen die Anordnung nach Ziffer 1. hat die
Antragsgegnerin an das Gericht ein (ggf. wiederholtes) Zwangsgeld in Höhe von bis
zu 100.000,00 € für jeden Tag der Zuwiderhandlung zu zahlen.
III. Die Anordnung ist nur vollstreckbar, wenn die Antragstellerin zugunsten der
Antragsgegnerin eine Sicherheit in Form einer Hinterlegung oder Bankbürgschaft in
Höhe von 500.000,00 € geleistet hat.
ANWEISUNG AN DIE (HILFS-)KANZLEI
Diese Anordnung ist gemeinsam mit der Antragsschrift vom 29.11.2024 und dem Schriftsatz
vom 05.12.2024 nebst sämtlichen Anlagen gem. Regel 276. 1 i. V. m. Regel 274 (a) (iii) VerfO
an die Antragsgegnerin Realtek Semiconductor Corporation, No. 2 Innovation Road II,
Hsinchu Science Park, Hsinchu 300, Taiwan, vertreten durch ihren CEO Huang, Yung-Fang,
zuzustellen.
HINWEIS AN DIE ANTRAGSTELLERIN
Wird das Hauptsacheverfahren nicht innerhalb einer Frist von höchstens 31 Kalendertagen

1. The applicant is the registered proprietor of the European patent EP 1 770 912 B1
entitled "Method and apparatus for initialising 10BASE-T networks" (hereinafter: patent in
suit). The patent in suit, which is only in force in Germany, relates to the 1000Base-T1
Automotive Ethernet standard.
2. The applicant considers the patent in dispute to have been infringed by the manufacture
and sale of the [...] motor vehicle in the Federal Republic of Germany, which is why it is
seeking an injunction against [...] and [...] before the UPC in proceedings
UPC_CFI_208/2024 ACT 24735/2024 (Local Division Munich, Panel 2). In the statement
of claim dated 1 May 2020, the applicant presented what it considers to be a patent
infringement based on a chip from the supplier Marvell, which is said to be installed in
the [...]. The defendants countered the action with the defence of exhaustion, inter alia
with regard to components of the defendant.
3. The applicant is also suing [...] and [...] for the (alleged) use of other patents before
German courts and the UPC, including before the Regional Court of Munich I (case no. 7
O 4992/22) for the (alleged) use of European patent EP 1 903 733, which relates to the
100Base-T1 Automotive Ethernet standard. In these proceedings, an oral hearing has
been scheduled for 20 February 2025.
4. The defendant is a semiconductor manufacturer based in Taiwan. It and the Applicant
concluded a licence agreement which grants the Respondent a licence to the Applicant's
patents, including the patent in dispute, for its [...] products (Annex EIP 4). The licence
agreement [...].
5. In a statement dated 31 October 2024, the defendant brought an action against the
applicant before the Court of Chancery of the State of Delaware (USA). In this action,
which was referred to the United States District Court for the District of Delaware, the
defendant first asserts a claim against the applicant for an alleged breach of a licence
agreement between the applicant and [...] (Annex EIP 2). It also submits the following
claims B. and C., whereby the word "[...]" is blacked out in the publicly available version
of the US complaint:
"B. Permanently enjoining Avago Sales from breaching the Licence Agreement by
pursuing claims against [...] in Germany for infringing SEPs by using Realtek's
products;
C. Permanently enjoining Avago Sales from enforcing any injunction it obtains in
Germany against [...]."
6. In German:
"B. Permanently enjoin Avago Sales from breaching the Licence Agreement by
asserting claims in Germany against [...] for infringement of SEPs based on the use
of Realtek products;
C. Permanently enjoin Avago Sales from enforcing injunctions obtained in Germany
against [...];"
7. In the statement of claim dated 31 October 2024 (Annex EIP 2), the defendant submits,
inter alia, that the applicant breached the licence agreement by suing [...] in several
courts in Germany for alleged patent infringement because it used the defendant's
circuits in its vehicles. This frustrates the defendant's licence to use the applicant's
patents. But even if the defendant's products were not licensed, the applicant would have
an obligation to licence its patents in accordance with FRAND. However, the applicant
did not f u l f i l this obligation. The
German courts would make their decision by 20 February 2025. If it is determined on 20
February 2025 that [...] infringes the patents, the resulting injunction will stop the sale of
[...] in Europe and probably also in the United States and also decimate [...]'s supply
chain. This would cause it, the defendant, immense damage, namely the loss of its
supplier relationships. In Germany, the defendant would have no adequate legal
remedies at its disposal. Therefore, it is entitled to an injunction prohibiting the applicant
from asserting claims in Germany against [...] for infringement through the use of its
products and/or from enforcing an injunction obtained in Germany against [...].
8. In a written submission dated 7 November 2024, the defendant filed a motion to expedite
in the US proceedings (Annex EIP 5). With this application, it requests that a hearing
date be set for the beginning of February 2025 and a decision by the US court before 20
February 2025 in any case.
9. On 22 November 2024, the Munich I Regional Court (case no. 7 O 14547/24) issued a
preliminary injunction without hearing the defendant, prohibiting the defendant from
pursuing the US action, in particular with regard to claims B and C (Annex EIP 1).
REQUEST OF THE APPLICANT
10. According to the petition dated 29.11.2024 in conjunction with the pleading dated
05.12.2024, the petitioner requests the following
1. The defendant is prohibited from
continuing the action of 31 October 2024, which was initially filed by it before the
Court of Chancery of the State of Delaware (USA) (Exhibit EIP 1) (case number
2024-1127-NAC), and which was subsequently transferred to the U.S. District
Court of the District of Delaware (case number 1:24-cv-01235-GBW), in particular
with regard to claims B and C, and also insofar as it seeks to directly or indirectly
prohibit the applicant,
to continue to pursue the patent infringement action filed with the Local Division
Munich of the Unified Patent Court dated 1 May 2024 (ACT_24735/2024) or to
expand it to include further claims arising from further SEPs of the applicant or to
bring further infringement actions for infringement of SEPs from the applicant's
portfolio against the companies of the [...] group claimed in the above-mentioned
action, namely [...] and [...], or their affiliated group companies or further
companies of the [...] group, namely [...] and [...].
affiliated group companies or other companies of the [...] group, before a Local
Division of the UPCA on the territory of the Federal Republic of Germany, both
with effect for the Federal Republic of Germany and with effect for other member
states of the UPCA ("Anti-Suit Injunction"); and
to enforce in the Federal Republic of Germany injunctions issued by the UPC
against the companies of the [...] group claimed in the above-mentioned action,
namely [...] and [...], or their affiliated group companies or other companies of the
[...] group ("anti-enforcement injunction"),
whereby this injunction obligation includes
- the bid to enforce the applications for an anti-suit injunction and an anti-enforcement
injunction dated 31 October 2024, which were initially filed in the
Court of Chancery of the State of Delaware (USA) (Annex EIP 1) (file number
2024- 1127-NAC), and which were subsequently transferred to the U.S. District
Court of the District of Delaware (Docket No. 1:24-cv-01235-GBW), regardless of
which U.S. court they are currently pending in at the time of entry of this Order,
immediately upon service of this Order,
- prohibiting the continuation of these anti-suit injunction and anti-enforcement
injunction proceedings except for the purpose of withdrawing the motion,
- in the event that the above anti-suit injunction and/or anti-enforcement injunction
orders are issued in the meantime, the prohibition to enforce them against the
applicant, and
- the prohibition to apply for other equivalent measures aimed at directly or
indirectly prohibiting the applicant from enforcing its patent rights against
companies of the [...] group at a Local Division of the UPCA on the territory of the
Federal Republic of Germany both with effect for the Federal Republic of
Germany and with effect for other member states of the UPCA.
2. In the event of any infringement of the order under 1. above, the Respondent shall
pay to the Court a (possibly repeated) penalty payment of up to EUR 100,000.00 for
each day of infringement.
3. The defendant must reimburse the costs of the proceedings.
4. The orders are effective and enforceable immediately.
5. The orders are issued without prior hearing of the defendant (Rule 206.3 RoP).
6. The service of the order requested here, as well as the notice of motion together with
the annexes and English translations to the respondent, is effected by way of
alternative service by informal postal delivery at the registered office of the
respondent, No. 2 Innovation Road II, Hsinchu Science Park, Hsinchu 300, Taiwan,

whereby service is deemed to have been effected on the date on which either the
contracted delivery service provider has confirmed that the documents referred to in
this request have been delivered to the address stated in this request or on which the
documents referred to here were successfully sent by e-mail to Ms .
SUBMISSION OF THE APPLICANT
11. The applicant submits that she became aware of the defendant's action of 31 October
2024 on 1 November 2024.
12. The defendant's action is aimed at a comprehensive prohibition of action and
enforcement. If the US court seised were to grant application B., the proceedings
UPC_CFI_208/2024 ACT 24735/2024 would also be covered by this. As a result, the
applicant would be forced to withdraw its patent infringement actions against [...] in
Germany relating to EP 1 903 733 and the patent in suit and to refrain from or withdraw
further patent infringement actions against [...] arising from standard-essential patents
(hereinafter: SEP) in Germany and before UPCA courts. The same applies to the
enforcement of any injunctions against [...] in Germany and in other UPCA member
states, irrespective of whether they concern SEPs of the applicant or not. This is
because claim C. is even more far-reaching. According to this, the applicant should be
permanently prohibited from enforcing injunctions obtained in Germany and before
UPCA courts against [...], regardless of whether the injunction is based on the
infringement of an SEP or not, and whether the defendant is affected at all or not. This
prohibition of enforcement therefore concerns all German patent infringement
proceedings of the applicant against [...] as well as proceedings before the UPC. The
prohibition should also extend to claims for patent infringement by Ethernet chips in [...]
products that are not supplied by the defendant, but by other parties such as Marvell.
13. With regard to measures taken by US courts, it is important that any US Anti-Suit
Injunctions (hereinafter: ASI) and Anti-Enforcement Injunctions (hereinafter: AEI) are
immediately enforceable in the USA. If the applicant were to oppose the measures, this
would constitute a "contempt of court" under US law. There would be a threat of
considerable fines and possibly even imprisonment, as orders in recent years have
shown (affidavit, Annex EIP 6). These could be imposed not only on the applicant, but in
any case also on its parent company, Broadcom Inc.
14. The respondent's attempts to justify the requested prohibition of action and enforcement
are obviously incorrect and do not result from the licence agreement. In particular, it
should be noted that the proceedings in Germany (national and EPG) are the only
appropriate forum to clarify the question of any exhaustion of the applicant's patents with
regard to [...] vehicles in Germany. Even if the US court were to find that the respondent
had a licence to the patents asserted by the petitioner (as it did not), this would not
answer the question of possible exhaustion in Germany with regard to [...] vehicles. This
clearly shows that the defendant is not seeking to enforce its alleged rights under the
licence agreement, but is attempting to prevent the applicant's proceedings in Germany
(national and EPG) in favour of [...] by unlawful means.
15. The applicant seeks the protection of such patent infringement proceedings which are
conducted and brought before the German Local Divisions of the UPC, irrespective of
whether they concern applications with effect in other Contracting Member States (i.e.
not in Germany). ASI and AEI are incompatible with the European principles of civil
procedural law. In any event, they violate the Charter of Fundamental Rights of the
European Union (hereinafter: Charter). Furthermore, the behaviour of the defendant is to
be assessed in accordance with German substantive law. Foreign prohibitions on legal
action and enforcement violate German law, as they constitute an unlawful interference
with the applicant's protected legal interests. She is therefore entitled to injunctive relief
under tort law pursuant to Section 823 (1) i. V. m.
§ Section 1004 BGB.
16. Furthermore, according to general life experience, it is to be expected that the defendant
would not shy away from extending the prohibition of action and enforcement requested
by it in the USA to other contracting member states, should it deem it necessary. The
fact that these are currently limited to "Germany" is in all likelihood solely due to the fact
that the Applicant currently only asserts its rights against [...] before German courts and
German Local Divisions
of the UPC. In this respect, however, there is also a risk of infringement for all other
contracting member states.
17. The order of the interim measures requested here is urgent in terms of time. There is a
concrete risk that the US court seised will issue the requested ASI and AEI in the near
future. The interim measures were also urgently required in order to avert considerable
damage to the applicant. The applicant could not be expected to wait for the US decision
requested by the defendant, which could possibly no longer be effectively eliminated in
view of the impending, considerable sanctioning measures, because the applicant would
have to withdraw the corresponding actions in Germany before the UPC under the
pressure of the sanctions. The issuance of the injunction requested here is therefore
necessary in order to enable the applicant to continue to have effective access to justice
(and therefore to the courts). The applicant is therefore seeking interim relief because, in
essence, the enforcement of patent rights in the forum here is at risk. Against this
background, the applicant's interest in the requested interim measures also outweighed
any interests of the defendant.
18. Due to the particular urgency, the applicant's request should be granted without a prior
hearing of the Requests. A prior hearing of the defendant would very likely frustrate the
purpose of these proceedings. A hearing and the holding of an oral hearing would
significantly delay the order of the injunction requested here, especially in view of the
upcoming New Year's holidays, so that it is to be feared that the US court will issue the
ASI and AEI measures beforehand. This applies all the more as it can be assumed that
the defendant will inform the US court about the proceedings here. In addition, it could be
assumed that the defendant would immediately take interim measures itself, a so-called
Temporary Restraining Order, in order to prevent the proceedings here, if it became
aware of the application for an injunction here. A hearing is also not necessary. This is
because the position and legal opinion of the defendant is already clear from its US
lawsuit (Annex EIP 2). The pleadings that had been exchanged in the US proceedings
were the only "correspondence" between the parties in this context. In this respect, the
action brought by the defendant in the USA was a
was a "lawsuit robbery". She, the claimant, had never intended to take legal action against
the
defendant to proceed.
19. The applicant requests that no security be ordered. It is not apparent what damage the
defendant would suffer at all as a result of the interim measures applied for here.
Conversely, ordering the defendant to provide security would considerably delay the
proceedings here. Deposit or bank guarantee would, also in view of the forthcoming
public holidays
would in all probability take at least three to four weeks. This is already due to the internal
processes at the applicant (Affidavit Annex EIP 7). Added to this is the time required for
the (international) transfer of the deposit amount to the depository, i.e. the Local Court in
Bavaria.
20. The UPCA's jurisdiction arises from Art. 32(1)(c), 62(1) UPCA, since the Applicant seeks
provisional measures in connection with a European patent asserted before the UPC.
[...].
21. The applicant is dependent on alternative service. Even if service in accordance with
Rule 275.1 RoP is subsidiary in principle, it should be noted that this standard grants the
court discretion in accordance with its duties. Accordingly, the court can review whether
there are good reasons for not serving according to the procedure actually provided for.
Rule 275.1 RoP should not be understood too narrowly if the circumstances of the
individual case indicate a particular approach for effective legal protection. The provision
is also applied on a subsidiary basis if the priority notifications pursuant to Rules 271 et
seq. RoP would be recognisably unsuccessful. A conventional attempt to effect service in
Taiwan would be practically futile.
22. Reference is made to the statement of claim dated 29 November 2024, the claimant's
statement of claim dated 5 December 2024, the defendant's statement of claim dated 31
October 2024 (Annex EIP 2) and the defendant's request for acceleration dated 7
November 2024 (Annex EIP 5) with regard to the facts of the case and the dispute.
COURSE OF THE PROCEEDINGS
23. The applicant filed the application for interim measures on 29 November 2024. On the
same day, it also filed an application pursuant to Rule 262.2 RoP with regard to the
information marked in grey in the application of 29 November 2024.
24. The rapporteur issued instructions to the applicant in an order dated 3 December 2024.
The applicant responded to this in a statement dated 5 December 2024. In this respect,
too, the petitioner filed a motion pursuant to Rule 262.2 RoP.
REASONS FOR THE ORDER
25. The admissible application for interim measures is well-founded.
I.
26. The application for interim measures is admissible.
1.
27. The UPCA's international jurisdiction follows from Art. 31 UPCA in conjunction with Art.
71b No. 2 Brussels Ia Regulation. The place of occurrence of the prima facie case of
imminent tort lies within the jurisdiction of the UPC.
2.
28. The UPCA's subject-matter jurisdiction for the adoption of provisional measures (AASI
and AEI) arises from Art. 32 (1) UPCA.
29. According to Art. 32 (1) c) UPCA, the Court has exclusive jurisdiction for actions for the
adoption of provisional and protective measures and interim measures. This jurisdiction
is in any case related to actions that fall under the exclusive jurisdiction of the UPCA
pursuant to Art. 32 (1) a) UPCA. These are
inter alia, actions for actual or threatened infringement of patents.
30. Not only the unlawful use of a patent is to be regarded as an infringement of a patent, but
also an interference with the property right of the patent proprietor by prohibiting the
assertion of his patent right (see also: Grabinski/W.Tilmann, in Tilmann/Plasmann,
Einheitspatent, Einheitliches Patentgericht, 2nd ed., Art. 32 para. 61a).
31. Such an infringement of the applicant's property right is at issue in the present case. With
its action of 31 October 2024 (Annex EIP 4), the respondent seeks the issuance of an
ASI and an AEI before the US courts. The applicant is also to be permanently prohibited
from asserting the patent in dispute before the UPC (before a German Local Division of
the UPC), and the enforcement of any decisions of the UPC (or a German Local Division
of the UPC) is also to be prohibited. Such prohibition measures or prohibitions of
litigation interfere with the applicant's property rights in relation to the patent in suit.

32. The jurisdiction of the Local Division Munich is based on Art. 33 (1) (a) UPCA. The
infringement of the petitioner's property right is imminent within the jurisdiction of the
Local Division here. Among other things, the applicant is to be prohibited from pursuing
the action UPC_CFI_208/2024 ACT 24735/2024 pending before the Local Division in
Munich and decisions issued in this respect are not to be enforced.

33. [...] does not preclude the jurisdiction of the UPC or the Local Division Munich. [...]. With
its application for interim measures, the applicant [...] asserts claims in tort.
5.
34. Finally, no lis pendens has arisen as a result of the proceedings before the Regional
Court of Munich I (Case No. 7 O 14547/24). These proceedings concern a different
subject matter. Before the Regional Court of Munich I, the threatened infringement of the
EP patent EP 1 903 733 and access to national German jurisdiction are at issue. In the
present case, there is a threat of infringement of the patent in dispute as a result of the
impending prohibition of access to the UPC.
II.
35. The request for interim measures is justified pursuant to Art. 62 (1), (2) UPCA in
conjunction with Rule 211 (1), (2), (3) RoP. It is highly probable that the applicant is
entitled to initiate the proceedings and that its rights under the patent in suit are infringed.
The balancing of interests to be carried out as part of the discretionary decision is in
favour of the applicant.

36. The Applicant is to be regarded as entitled to make a claim in accordance with Rule 8 (5)
RoP. It is entered in the register as the proprietor of the patent in suit.
2.
37. It is highly probable that the applicant's rights in relation to the patent in suit will be
infringed. The applicant has substantiated the imminent infringement of its property rights
in relation to the patent in suit and other patents through the applications B. and C. filed
by the defendant before the US court in the statement of claim dated 31 October 2024
(Annex EIP 4).
a.
38. According to Article 47(1) of the EU Charter, any person whose rights or freedoms
guaranteed by Union law have been violated has the right to an effective remedy before
a court or tribunal. Art. 47 para. 2 of the EU Charter gives everyone the right to have their
case heard by an independent and impartial tribunal previously established by law, in a
fair hearing, in public and within a reasonable time.
publicly and within a reasonable time. Art. 47 of the EU Charter therefore guarantees a
general right to justice at European level, i.e. access to justice. According to Art. 17 para.
2 of the EU Charter, intellectual property is in any case property-like rights that must be
protected under the Charter. Consequently, Art. 47 (1) and (2) of the EU Charter also
protect a person's access to the UPC for the purpose of asserting an (alleged) unlawful
use of a patent.
b.
39. Under German law, which is applicable in the present case pursuant to Art. 24 (1) e)
UPCA, Art. 2 (1), 19 (4) GG grant the general right to the protection of justice. §§
Sections 823 (1), 1004 (analogous) BGB provide a substantive legal basis for the
protection of property, which can only be enforced by means of the constitutionally
protected rule of law principle just described.
c.
40. The ASI and AEI requested by the defendant in the statement of claim of 31 October
2024 (Annex EIP 4) in the US proceedings with Requests B. and C. constitute, when
ordered, a comprehensive prohibition on litigation before the UPC and a comprehensive
prohibition on the enforcement of UPC decisions. Such prohibitions are in breach of the
previously discussed claims for the preservation of justice; they are unauthorised
interferences with the applicant's rights, which are in any case similar to property rights.
d.
41. Requests B. and C. of the application of 31 October 2024 (Annex EIP 4) also concern
the proceedings UPC_CFI_208/2024 ACT 24735/2024 and proceedings before the UPC
insofar as they are asserted before a German Local Division. This is not expressly stated
in the wording of requests B. and C., which only refer to "proceedings against [...] in
Germany". At first glance, this could be understood to mean that (only) proceedings
before the national courts or the German jurisdiction are to be covered, but not
proceedings before the UPC, which is a common, uniform European court of the
contracting member states. Even though the UPC has a decentralised structure and
various chambers have been established at different locations in contracting member
states, there is no "German UPC" or "UPC in Germany". The Local Divisions of the UPC
established in Germany are also not part of the German jurisdiction. The fact that
requests B. and C. of the statement of claim dated 31 October 2024 (Annex EIP 4) only
concern the proceedings before the Regional Court of Munich I could also be supported
by the fact that the defendant refers to 20 February 2025 as the decision date of the
"German courts" in the statement of claim.
42. Nevertheless, on the basis of the objective horizon of the recipient, it seems likely that
the defendant also intends to cover the UPC_CFI_208/2024 ACT 24735/2024
proceedings and proceedings before the UPC with the chosen wording of the application.
The patent in dispute is expressly mentioned in the statement of claim of 31 October
2024 (Annex EIP 4, para. 158). However, the patent in suit is only asserted before the
Local Division Munich in the proceedings UPC_CFI_208/2024 ACT 24735/2024. The
respondent also states with regard to the petitioner's actions "In April/May of 2024,
Avago Sales sued [...] in the Unified Patent Court ("UPC") in Germany, and in German
courts, for infringement" (Annex EIP 4, para. 73) and "Avago Sales inappropriately sued
[...] in the UPC despite Realtek's valid licence" (Annex EIP 4, para. 75). No further
differentiation is then made between the various patents sued for and/or the jurisdictions.
In the acceleration request of 7 November 2024, the patent in dispute is also expressly
mentioned (Annex EIP 6, para. 15) and the applicant's actions are mentioned in the
same way as in the statement of claim (Annex EIP 6, paras. 32, 41). No further
differentiation is made in this application between the patent which is the subject of the
proceedings before the Munich I Regional Court and the patent in dispute. Since the
patent in suit is only in force in Germany, which is why the applicant in the
aforementioned proceedings before the UPC is also only challenging (alleged) acts of
use in Germany, it is likely that the defendant also intends to cover the proceedings
UPC_CFI_208/2024 ACT 24735/2024 and proceedings before the UPC with the - as
such imprecise - wording in Requests B. and C. of the application of 31 October 2024
(Annex EIP 4). In the applications, it has only referred to the place where the courts are
located or have their seat, but has not made any restriction to a (German) jurisdiction.
e.
43. Requests B. and C. of the statement of claim of 31 October 2024 (Annex EIP 4) are
further directed against infringement claims from all SEPs of the applicant that it intends
to file with the UPC. They are not limited to the patents previously asserted by the
Applicant before the UPC (or the German courts).
f.
44. However, the aforementioned requests of the Respondent are limited to the extent that
they are only aimed at the enforcement and execution of patent rights in Germany.
Irrespective of the imprecision of the wording chosen by the defendant, taking into
account the entire content of the statement of claim of 31 October 2024 (Annex EIP 4),
this makes it clear that no ASI and/or AEI is requested with regard to proceedings
brought by the applicant for (alleged) use of its patents before another court that does
not belong to the German jurisdiction or whose location is outside Germany. Since no
Since no factual circumstances have been presented and made credible and no other
circumstances are apparent from which the application for an ASI and/or AEI with regard
to other countries can be inferred, no risk of first infringement can be assumed in this
respect. The Applicant's reference to general life experience is not sufficient in this
respect, especially since the Applicant herself submits that she currently only asserts
rights before German courts and German Local Divisions of the UPC.
3.
45. The balancing of the interests of the parties to be carried out in accordance with Art. 62
(2) UPCA and Rule 211 (3) RoP, which must take into account all circumstances of the
individual case, is in favour of the applicant in the present case. The issuance of the
interim order is both temporally and objectively urgent. The applicant cannot reasonably
be expected to wait until the conclusion of the main proceedings to enforce its claims
(see on the requirement of objective urgency or factual necessity: Local Division
Düsseldorf, order of 31 October 2024, UPC_CFI_347/2024 - Valeo Electrification/Magna
PT and others; Local Division Munich, order of 25 November 2024, UPC_CFI_443/2024
- Häfele/Kunststoff KG Nehl).
a.
46. The order for the requested interim measures is urgent in terms of time, R. 209.2 (b)
RoP.
47. The temporal urgency required for the order of provisional measures is only lacking if the
injured party has behaved in such a negligent and hesitant manner in the pursuit of his
claims that from an objective point of view it must be concluded that the injured party is
not interested in a speedy enforcement of his rights, which is why it does not appear
appropriate to allow him to claim provisional legal protection (cf. also Local Division
Munich, UPC_CFI 443/2024, decision of 25 November 2024 - Häfele/Kunststoff KG
Nehl; Local Division Düsseldorf, UPC_CFI_347/2024 - Valeo Electrification/Magna PT
and others). There is no evidence of negligent and hesitant behaviour in the present
case.
48. The period of waiting within the meaning of Rule 211.4 RoP is to be measured from the
date on which an applicant has or should have had such knowledge of the infringement
as to enable him to file a request for interim measures under Rule 206.2 RoP in a
promising manner (Court of Appeal, order of 25 September 2024, UPC_CFI_182/2024 -
Ortovox Sportartikel/Mammut Sports Group and others). According to the claimant's
submission, it received knowledge of the defendant's statement of claim on 1 November
2024 (Annex EIP 4). As this is dated 31 October 2024, the claimant's submission is
credible. On the basis of 1 November 2024 (or the earliest possible date, 31 October
2024), an application for the adoption of
provisional measures received by the court on 29 November 2024 cannot be considered
dilatory or negligent.
49. Nothing else follows from the fact that the applicant filed a similar application before the
Regional Court of Munich I days earlier, which led to the decision of the Regional Court
of Munich I of 22 November 2024 (case no. 7 O 14547/24, Annex EIP 1). Apart from the
fact that urgency must be considered separately with regard to each procedure, the
applicant is entitled to review the scope of the decision of the Regional Court of Munich I
and to reliably and properly examine the prospects of success of an application for an
anti-ASI at the UPC. This requires a certain period of time, which in any case has not
been exceeded in the present case. In this respect, it must be taken into account in
particular that there is no (established) case law of the UPC on this topic; decisions of
the UPC in this regard have not been published. Rather, the present application for the
adoption of such measures is - as far as can be seen - the first to be decided by the
UPC.
b.
50. The adoption of the interim measure is also objectively urgent. It is objectively required
and necessary. The applicant cannot be referred to proceedings on the merits.
51. Should the US court issue the ASI and/or AEI requested by the Respondent, these would
be immediately enforceable in the USA. The applicant could - as a result of the sanctions
threatening it in the event of non-compliance with the orders of the US court - be forced
in particular to withdraw the action UPC_CFI_208/2024 ACT 24735/2024 pending before
the Local Division in Munich. In their opinion, the unlawful use of the patent in dispute by
[...] and [...] would thus be removed from judicial review by the competent court. The
question of whether exhaustion has actually occurred (in Germany) with regard to the
components supplied by the defendant to the [...] group could also not be examined. Any
rights of the applicant, in particular those to cease and desist the alleged patent
infringement in Germany and to establish a liability for damages or the right to damages,
could then not be enforced before the Local Division Munich or the UPC. Requests B.
and C. of the statement of claim of 31 October 2024 (Annex EIP 4) are also aimed at a
permanent prohibition of actions arising from all SEPs of the applicant before a Local
Division of the UPC located in Germany and/or against enforcement from decisions of
the UPC, whereby enforcement is to be prohibited even without reference to the
defendant's components. If the applicant were to (have to) comply with the ASI
and/or AEI , this interference in its in any case
right similar to ownership would lead to a (material and financial) devaluation of the
patent in dispute or the SEP, which would threaten the applicant with considerable
damage.
52. The applicant is also threatened with significant damage if it would not comply with the
ASI and/or AEI if ordered to do so. The applicant has made a credible case that the US
court is likely to impose significant sanctions in the event of a violation of an ordered ASI
and/or AEI. The applicant's credible submission shows that US courts have in the past
ordered penalties of up to USD 100,000.00 per day of non-compliance in the event of
contempt of court, whereby these penalties can double and quadruple from certain points
in time of a persistent violation (Affidavit, Annex EIP 6).
53. Since the order of the ASI and/or the AEI in the US proceedings is imminent in view of
the defendant's request for acceleration dated 7 November 2024 (Annex EIP 5), which
expressly refers to the hearing date before the Regional Court of Munich I and requests
a court decision at least before this date, the applicant cannot be referred to a main
action before the UPC. Under no circumstances could such an action be completed in
full by 20 February 2025; a decision by the court in the action before 20 February 2025 is
ruled out. A (final) injunction by the court, which could have an impact on the US court,
would therefore come too late. However, the rights of the applicant would at best be
insufficiently protected by an injunction issued after the ASI and/or AEI order.
c.
54. Furthermore, when weighing up the interests, it cannot be disregarded that the defendant
is not involved in the proceedings UPC_CFI_208/2024 ACT 24735/2024 and that its
statements in the statement of claim of 31 October 2024 (Annex EIP 4) and the request
for acceleration of 7 November 2024 (Annex EIP 5) regarding any appropriate legal
remedies and the scope of any injunction in these proceedings are in any case
misleading.
55. According to the information provided by the defendant and the submissions of [...] and
[...] in the proceedings UPC_CFI_208/2024 ACT 24735/2024, the motor vehicles [...] are
equipped with a component of the defendant. Since the objection of exhaustion raised in
this respect presupposes in any case that this component makes (at least partial) use of
the patent in suit, a legal interest of the defendant could in principle be assumed, which
is why it is open to the defendant to file an application to intervene under Rule
316 RoP to file an application to intervene. An intervener is generally treated as a party
pursuant to Rule 317 RoP; the respondent could therefore have countered the
applicant's submissions in the proceedings before the UPC and comprehensively
defended its rights. It therefore had and still has an appropriate legal remedy at its
disposal. However, the respondent did not make use of this.
56. The applicant bases its action UPC_CFI_208/2024 ACT 24735/2024 on use of the patent
in suit in Germany. The requested legal consequences, in particular a possible
injunction, are limited to the territory of Germany. In view of this, it is not clear why, as
the defendant argues in its statement of claim and the request for acceleration, there
should be a threat of a sales ban "in Europe and probably also in the United States" if an
injunction is issued. In any event, this would not follow directly from the injunction issued.
Insofar as the defendant refers in this context to 20 February 2025, the date of the
hearing before the Regional Court of Munich I, this does not change anything. As already
explained, the defendant does not clearly differentiate between the proceedings before
the Regional Court of Munich I and the proceedings UPC_CFI_208/2024 ACT
24735/2024 in the statement of claim of 31 October 2024 (Annex EIP 4). Rather, it
submits that the "German courts" will decide by 20 February 2025, whereby, as already
explained, "German courts" also includes the Local Division of Munich. Consequently, it
cannot be concluded from the date mentioned that the defendant is arguing with regard
to the consequences only with regard to the proceedings before the Munich I Regional
Court. This is also not the case because, in this view, any submission on the
proceedings before the UPC would be missing, although these proceedings are also the
basis of applications B. and C. of the statement of claim of 31 October 2024 (Annex EIP
4).
d.
57. Finally, the consideration of the potential damage to the parties also speaks in favour of
the adoption of provisional measures.
58. If the application is rejected, there is a credible risk that the ASI and/or AEI requested by
the defendant will be ordered. This would have the consequences for the applicant
already described under b. above. The applicant is therefore threatened with
considerable damage.
59. If the interim measures are granted, the defendant is prohibited from continuing to
pursue applications B. and C. of its application of 31 October 2024 (Annex EIP 4). This
includes, among other things, the withdrawal of these applications. It cannot be ruled out
that this could also lead to damage on the part of the defendant. However, the potential
damage it could suffer is less serious. The defendant is not interested in
from enforcing its rights under the licence agreement. The US proceedings can be
continued with regard to the other claims, so that in particular the alleged infringement of
the licence agreement concluded between the parties would be reviewed. The interim
measures requested by the applicant relate solely to the requested ASI and AEI. In
addition, the use of the patent in suit alleged by the applicant will be examined in the
proceedings UPC_CFI_208/2024 ACT 24735/2024. This includes the objection of
exhaustion raised, insofar as this is relevant to the decision. The defendant is also at
liberty to support [...] and [...] in their legal defence and/or to file an application to
intervene in the proceedings.
III.
60. The order for interim measures requested by the applicant without prior hearing of the
defendants appears appropriate and necessary in the present case, R. 206.3, 209.2 (c)
RoP in conjunction with R. 212.1 RoP.
61. The applicant has made a credible case that, without an ex parte order, it is likely to
suffer irreparable harm due to the delay associated with the involvement of the other
party. The defendant is domiciled in Taiwan. In any event, service of the application for
interim measures would take such a period of time that, in view of the defendant's
request for acceleration in the US proceedings (Exhibit EIP 5), it is likely that a decision
on the application for interim measures could only be made after a decision by the US
court and any order by the ASI and/or AEI.
62. As a result of the Respondent's request for acceleration dated 7 November 2024 (Annex
EIP 5) and the fact alleged by the Applicant that the statement of claim dated 31 October
2024 (Annex EIP 2) was the only "correspondence" between the parties on this subject,
i.e. that the Applicant was "surprised" by Requests B. and C., it is also likely that the
Respondent itself would immediately take interim measures, a so-called Temporary
Restraining Order. The US proceedings could therefore be accelerated even further by
shortening the deadlines (see Affidavit Exhibit EIP3). Hearing the defendant would then
lead to the protection of the applicant's rights asserted here being curtailed or even
cancelled out.
63. In view of this and in view of the fact that the defendant's statement of claim of 31
October 2024 (Annex EIP 2) and the request for acceleration of 7 November 2024
(Annex EIP 5) were attached to the application for interim measures as annexes, the
defendant's legal position and argumentation with regard to an ASI
and/or AEI can therefore be taken into account by the court, it appears appropriate in the
present case to exceptionally refrain from a prior hearing of the defendant.
IV.
64. Pursuant to Rule 211.5 RoP, the court must order the provision of a security if the order
for interim measures - as here - is made without a prior hearing of the defendant.
65. Special circumstances that could exceptionally speak against such an order in the
present case have neither been presented nor are apparent. In particular, it cannot be
established on the basis of the submitted and credible facts that any damage to the
defendant is excluded. Insofar as the applicant argues that the order of a security deposit
would delay the effectiveness of the requested measure, this cannot be accepted. The
delays caused by internal processes at the applicant, which it claims, are within its own
control and for which it is responsible. The reference to the alleged time lapses when
depositing the security does not hold water either. The deposit of a security pursuant to
Rule 352 RoP can be made directly with the UPC. The EPG has set up a bank account
for this purpose. The account details are published on the EPG website
66. The security is intended to cover the costs of the proceedings, other costs arising from
the enforcement and possible compensation for damages incurred or likely to be
incurred, Rule 352.1 RoP. As it is difficult to estimate the amount of possible
enforcement damages at the time an order is issued for the Local Division, the amount of
the security set is generally based on the amount in dispute. Even if the amount in
dispute does not necessarily correspond to the risk of damage, it does provide an
indication of the economic importance the applicant attaches to the matter. The applicant
has been made aware of this, but has not provided any further information on the specific
amount of the security.
67. As long as this security has not been provided, the order is not enforceable. The
imposition of periodic penalty payments (Art. 82 (4) UPCA, Rule 354.4 RoP) can only be
considered for infringements in which the security has already been provided and the
respondent concerned has been demonstrably informed in a formalised form that the
security has been provided.
V.
68. A basic decision on costs is not to be made in the present case. The Rules of Procedure
only provide for such a decision in proceedings on the merits (see Rule 118.5 RoP), but
not in proceedings for an order for interim measures. The costs of the summary
proceedings are generally to be claimed in the main proceedings. A possible order for
provisional reimbursement of costs in summary proceedings (Rule 211.1 (d) RoP)
requires a corresponding quantified application. Such an application has not been made
in the present case.
VI.
69. Alternative service pursuant to Rule 275 (1) RoP cannot be authorised at present. There
is currently no discretion in this regard.
70. According to the wording of Rule 275.1 RoP, alternative service requires that a
"service in accordance with sections 1 and 2 could not be effected". Alternative service is
therefore subsidiary; an (unsuccessful) attempt at service must first have been made in
accordance with the relevant rules (Court of Appeal, UPC_CoA_69/2024, order v.
29.07.2024 - NEC/TCL; UPC CFI, Local Division Hamburg, UPC_CFI_169/2024, order of
18 April 2024 - Daedalus/Xiaomi; Local Division Mannheim, UPC_CFI_ 219/2023, order
of 08.12.2023 - Panasonic/Xiaomi). Only then does the court have the discretion to allow
alternative service.
71. This tiered concept applies not only to orders and/or decisions in an action on the merits,
but also to orders in summary proceedings. A differentiation according to the type of
proceedings cannot be found in Rule 275.1 RoP or the other provisions of the RoP on
the service of orders or decisions. It also does not correspond to the (international)
regulations and agreements regarding the service of court orders or decisions. Moreover,
the requirement of an attempt at service in accordance with the relevant (international)
standards does not depend on whether the attempt at service is likely to be successful or
supposedly futile.
72. An (unsuccessful) attempt at service pursuant to Rule 276. 1 i. V. m. Rule 274 (a) (iii)
RoP has not yet been made.
VI.
73. The petitioner's request to refrain from setting a time limit with a view to an action on the
merits cannot be granted. Rule 213.1 RoP does not confer any discretion.
ORDER
I. The defendant is prohibited from
continuing the action of 31 October 2024, which it initially filed in the Court of
Chancery of the State of Delaware (USA) (Exhibit EIP 1) (Case No. 2024- 1127-
NAC), and which was subsequently transferred to the U.S. District Court of the
District of Delaware (Case No. 1:24-cv-01235-GBW), in particular with regard to
claims B and C, and also insofar as it seeks to directly or indirectly prohibit the
applicant,
the patent infringement action filed with the Local Division Munich of the Unified
Patent Court on 1 May 2024 (ACT_24-cv-035-GBW). May 2024 (ACT_24735/2024)
filed with the Munich Local Division of the Unified Patent Court or to expand it to
include further claims arising from further SEPs of the applicant or further
infringement actions for infringement of SEPs from the applicant's portfolio against
the companies of the [...] group claimed in the above-mentioned action, namely [...]
and [...], or their affiliated group companies or other companies of the [...] group,
before a Local Division of the UPC on the territory of the Federal Republic of
Germany, both with effect for the Federal Republic of Germany and with effect for
other member states of the UPCA ("anti-suit injunction"); and
to enforce in the Federal Republic of Germany injunctions issued by the UPC against
the companies of the [...] group claimed in the above action, namely [...] and [...], or
their affiliated group companies or other companies of the [...] group ("Anti-
Enforcement Injunction"),
whereby this injunction includes,
- Order granting the motions for anti-suit injunction and anti-enforcement injunction
dated 31 October 2024, which were initially filed in the Court of Chancery of the State
of Delaware (USA) (Exhibit EIP 1) (Case No. 2024-1127- NAC), and subsequently
transferred to the U.S. District Court of the District of Delaware (Docket No. 1:24-cv-
01235-GBW), regardless of which U.S. court they are currently pending in at the time
of entry of this Order, immediately upon service of this Order,
- prohibiting the continuation of these anti-suit injunction and anti-enforcement
injunction proceedings except for the purpose of withdrawing the motion,
- the prohibition, in the event that the above-mentioned anti-suit injunction and/or
anti-enforcement injunction orders are issued in the meantime, to enforce them
against the applicant, and
- the prohibition to apply for other equivalent measures aimed at directly or indirectly
prohibiting the applicant from enforcing its patent rights against companies of the [...]
group at a Local Division of the UPCA on the territory of the Federal Republic of
Germany, both with effect for the Federal Republic of Germany and with effect for
other member states of the UPCA.
II. In the event of any violation of the order under section 1, the defendant shall pay to
the court a (possibly repeated) penalty payment of up to € 100,000.00 for each day of
violation.
III. The order is only enforceable if the applicant has provided security in favour of the
defendant in the form of a deposit or bank guarantee in the amount of € 500,000.00.
