GEGENSTAND: Aussetzungsantrag und Verlegungsantrag

SACHVERHALT
Die Beklagten beantragen die Aussetzung des Verfahrens und Aufhebung des Verkündungstermins vom 22. November 2024 und hilfsweise die Verlegung des Verkündungstermins auf einen späteren Zeitpunkt, mindestens auf den 6. Dezember 2024.
Diese Anträge wurden ausweislich des Activities Logs des CMS am 21.11.2024 um 15:14 im CMS angebracht und am 22.11.2024 um 11:24 – mithin nach der Verkündung – eine Registry number durch die Registratur des Gerichts zugewiesen. Die Parteivertreter der Beklagten haben durch Email vom 21.11.2024 um 15:23 Gericht und Gegenseite über den Antrag vorab informiert. Der Antrag wurde vom Vorsitzenden am 21.11.2024 sodann zur Kenntnis genommen und durch Anordnung vom 21.11.2024 (ORD_62305/2024) bestätigt, dass der Verkündungstermin wie den Parteien durch Email vom 4. November 2024 an die Parteien mitgeteilt, stattfinden wird. In der mündlichen Verhandlung war Termin zur Verkündung einer Entscheidung vorläufig auf den 6.12.2024, 10 Uhr bestimmt worden. Zugleich war mitgeteilt worden, dass je nach Fortschritt der Beratungen des Spruchkörpers ein früherer Verkündungstermin an die Parteien mit zeitlichem Vorlauf kommuniziert werde. Dies ist durch Email des Vorsitzenden vom 4.11.2024 an die Parteien geschehen.
Zuvor hatte der Beklagtenvertreter durch Email vom 25. Oktober 2024 an Gericht und Gegner mitgeteilt, dass […].
Der Klägervertreter hat durch Email vom 26. Oktober 2024 an Gericht und Gegenseite […]. Durch Email vom 4.11.2024 an die Parteivertreter wurde – nachdem keine weiteren Mitteilungen […] weder über das CMS, noch per Email erfolgt sind – der Verkündungstermin am 22.11.2024 mitgeteilt […].
Hierauf erfolgte von Seiten der Klägerin am selben Tag durch Email an Gericht und Gegenseite […]. Eine Aussage dazu, ob eine Entscheidung gewünscht wird oder nicht, erfolgte nicht. Die
Beklagten haben sich zu […] nicht verhalten, bis der vorliegend zu verbescheidende Antrag am Vortag des Verkündungstermins nachmittags gestellt wurde.
Die Beklagten tragen vor, […]. Vor diesem Hintergrund habe keine der Parteien ein legitimes Interesse an einer Fortführung des Verfahrens. Dennoch habe die Klägerin auf Anfrage der Beklagten durch Email vom 18. November 2024 erklärt, einer Aussetzung des Verfahrens nicht zuzustimmen. Hierfür könne sie kein berechtigtes Interesse geltend machen.

ENTSCHEIDUNGSGRÜNDE
Der Antrag sowie der Hilfsantrag waren zurückzuweisen.
1. Es fehlt an den Voraussetzungen einer Aussetzung nach R.295 VerfO. Insbesondere liegt kein gemeinsamer Antrag nach R. 295 d) VerfO vor. Die Klägerin hat der Aussetzung nach dem eigenen Vortrag der Beklagten widersprochen.
2. Auch ist keine Aussetzung nach R. 295 m) VerfO geboten. Nach eigenem Vortrag der Beklagten ist […]. Es sind auch keine anderweitigen Mitteilungen der Klägerseite im Verfahren gemacht worden, die eine Aussetzung gebieten würden. Sie haben daher Anspruch darauf, dass das Verfahren durch gerichtliche Entscheidung abgeschlossen wird. Die Beklagten können hierüber nicht einseitig disponieren.
Insbesondere können sich die Beklagten nicht auf das Erfordernis der ordnungsgemäßen Rechtspflege nach Regel 295 m) VerfO berufen. Sie haben vielmehr das Gericht gleichsam „bis zur letzten Sekunde“ darüber im Ungewissen gelassen, ob eine Entscheidung gefällt werden soll oder nicht […].

4. Daher kam eine Aussetzung ebenso wenig in Betracht wie eine Aufhebung oder Verlegung des Verkündungstermins.

ENTSCHEIDUNG
Der Antrag vom 21. November 2024,
das Verfahren ACT_545551/2023 betreffend das EP 2 568 724 (“EP 724”) einschließlich aller damit verbundener Verfahren (“Related Proceedings”), insbesondere CC_596561/2023 und CC_596895/2023, auszusetzen und den Verkündungstermin vom 22. November 2024 aufzuheben
sowie der Hilfsantrag,
den Verkündungstermin vom 22. November 2024 auf einen späteren Zeitpunkt zu verlegen, mindestens auf den in der mündlichen Verhandlung vorläufig festgesetzten Verkündungstermin vom 6. Dezember 2024,
werden zurückgewiesen.

FACTS
The defendants request the suspension of the proceedings and the cancellation of the date of pronouncement of 22 November 2024 and, in the alternative, the transfer of the date of pronouncement to a later date, at least to 6 December 2024.

According to the CMS activity log, these requests were submitted to the CMS on 21 November 2024 at 3:14 p.m. and assigned a registry number by the court registry on 22 November 2024 at 11:24 a.m., i.e. after the announcement. The defendant's representatives informed the court and the opposing party of the request in advance by email on 21 November 2024 at 3:23 p.m. The request was then acknowledged by the presiding judge on 21 November 2024 and confirmed by order of 21 November 2024 (ORD_62305/2024) that the date of the announcement would take place as communicated to the parties by email on 4 November 2024. At the hearing, the date for the pronouncement of a decision was provisionally set for 6 December 2024 at 10 a.m. At the same time, it was announced that, depending on the progress of the deliberations of the adjudicating body, an earlier date for the pronouncement would be communicated to the parties in advance. This was done by email from the presiding judge to the parties on 4 November 2024.
Previously, the defendant's representative had informed the court and the opposing party by email on 25 October 2024 that [...].

The plaintiff's representative informed the court and the opposing party by email on 26 October 2024 [...]. By email dated 4 November 2024 to the parties' representatives, the date of the announcement was set for 22 November 2024 [...], after no further notifications [...] had been made either via the CMS or by email.

The plaintiff responded on the same day by email to the court and the opposing party [...]. No statement was made as to whether a decision was desired or not. The
defendants did not respond to [...] until the request to be decided in the present case was filed in the afternoon on the day before the date of the announcement.
The defendants argue [...]. Against this background, neither party has a legitimate interest in continuing the proceedings. Nevertheless, at the defendant's request, the plaintiff declared by email dated 18 November 2024 that it did not agree to a suspension of the proceedings. It cannot assert any legitimate interest in this regard.

REASONS FOR THE DECISION
The application and the alternative application were to be dismissed.

1. The requirements for a suspension pursuant to R.295 RoP are not met. In particular, there is no joint request pursuant to R. 295 d) RoP. According to the defendant's own submission, the plaintiff objected to the suspension.
2. Nor is a suspension pursuant to R. 295 m) RoP required. According to the defendant's own submission, [...]. No other statements have been made by the plaintiff in the proceedings that would require a suspension. You are therefore entitled to have the proceedings concluded by a court decision. The defendants cannot decide on this unilaterally.
In particular, the defendants cannot invoke the requirement of proper administration of justice under Rule 295 m) VerfO. Rather, they left the court in the dark ‘until the last second’ as to whether a decision was to be made or not [...].

suspend proceedings ACT_545551/2023 concerning EP 2 568 724 (‘EP 724’) including all related proceedings (‘Related Proceedings’), in particular CC_596561/2023 and CC_596895/2023, and to set aside the date of announcement of 22 November 2024
and the alternative application to
postpone the date of announcement of 22 November 2024 to a later date, at least to the date of announcement provisionally set at the oral hearing of 6 December 2024,
are dismissed.
