GEGENSTAND: Antrag auf Anordnung der Auskunftserteilung gem. R. 191 VerfO

SACHVERHALT:
Die Klägerinnen beantragen gem. R. 191 VerfO die Anordnung der Auskunftserteilung durch die Beklagten zu 1, 3, 5 bzw. 6, wie die über ihre jeweiligen Streamingdienste abrufbaren Video-Dateien im Zeitraum vom 28.08.2019 (Tag der Veröffentlichung der Erteilung des Klagepatents) bis heute kodiert sind.
Die Klägerinnen nehmen die Beklagten im zugrundeliegenden Hauptverfahren wegen behaupteter mittelbarer Patentverletzung hinsichtlich des Gebiets des Königreichs Dänemark, der Bundesrepublik Deutschland, der Republik Finnland, der Französischen Republik, der Italienischen Republik, des Königreichs der Niederlande, der Republik Österreich, der Portugiesischen Republik und des Königreichs Schweden in Anspruch. Die Beklagten haben Nichtigkeitswiderklagen erhoben.

Nach dem Klagevortrag betreiben die Beklagten 1, 3, 5 und die Beklagte zu 6 (diese lediglich zusammen mit der Beklagten zu 1 bzw. zu 5) Streamingdienste, welche für die jeweilige Beklagten in der Klageschrift im Einzelnen (nicht abschließend) als angegriffene Ausführungsformen benannt werden (vgl. Klagebegründung, S. 28 Ziff. 1, S. 12 unter Ziff. 2 und 4), während die Beklagten zu 2 und 4 Zahlungsabwicklungsdienstleistung hierzu erbringen. Die Anträge auf Informationsübermittlung beziehen sich auf die über diese Streamingdienste abrufbaren Videodateien.
In der Klageschrift haben die Klägerinnen die behauptete Patentverletzung beispielhaft anhand des Streamingdienstes www.brazzers.com der Beklagten zu 1 und des Streamingdienstes www.pornhub.com der Beklagten zu 3, jeweils aufgerufen über den Microsoft-Edge-Browser, mit je einem dort in der dynamischen Wiedergabequalitätseinstellung „auto“ (für automatisch) aufgerufenen Video unter Verwendung des Analysetools Charles Web Debugging Proxy (fortan Charles Proxy) und des mithilfe des Microsoft Edge DevTools öffentlich zugänglichen Quellcodes des verwendeten Media Players unter dem Microsoft-Edge-Browser begründet (Klagebegründung, S. 35 ff. bzw. 76 ff.) und pauschal behauptet, dass die Ausführungen entsprechend für alle weiteren angegriffenen Ausführungsformen gälten (Klagebegründung, S. 34). Charles Proxy ist eine HTTP web-testing Proxy-Server-Anwendung, die es dem Benutzer ermöglicht, den gesamten HTTP- und SSL-/HTTPS-Verkehr zwischen seinem Rechner und dem Internet einzusehen, insbesondere Anforderungen („Requests“) und Antworten („Responses“) einschließlich HTTP-Header und Metadaten (z. B. Cookies, Caching- und Kodierungsinformationen), und dabei die der Endbenutzerstation für das Streaming zur Verfügung stehende Bandbreite zu drosseln. Die auf diese Weise nach ihrem Vortrag gewonnenen Informationen haben die Klägerinnen für den erstgenannten Streamingdienst als Anlagen K6 (Charles-Proxy-Aufzeichnungen), K7 (Quellcode) und für den zweitgenannten Streamingdienst als Anlagen K8 (Charles-Proxy-Aufzeichnungen), K9 (Quellcode) zur Klageschrift vorgelegt.
Die Beklagten haben in ihren Klageerwiderungen eine Patentverletzung durch die Streamingdienste www.brazzers.com und www.pornhub.com in Abrede gestellt. Hierzu legen sie teilweise das Klagepatent anders aus und tragen teilweise abweichend zur technischen Funktionsweise der beiden Streamingdienste vor, wobei sie den vorgelegten Charles-Proxy-Aufzeichnungen und Quellcodes teilweise einen anderen Aussagegehalt als die Klägerinnen beimessen. Die über die genannten Webseiten verfügbaren Videos seien entgegen den Anforderungen des Klagepatents weder mit einer bestimmten Bitrate kodiert noch jeweils als mehrere Dateien (streamlets) auf einem Satz von Servern wie in einem bloßen Datenschrank gespeichert. Mit Blick auf die übrigen in der Klageschrift als angegriffene Ausführungsformen benannten Streamingdienste rügen sie das gänzliche Fehlen eines schlüssigen, jedenfalls eines substantiierten Vortrags zur Benutzung der Lehre des Klagepatents. Da schon nach dem Klagevortrag die beiden in der Klageschrift erörterten Streamingdienste unterschiedlich ausgestaltet seien, gehe der pauschale Verweis, die anderen funktionierten entsprechend, ins Leere.
In ihren Repliken zu den einzelnen Klageerwiderungen vertiefen die Klägerinnen ihren Verletzungsvortrag zu den in der Klageschrift beispielhaft erläuterten beiden Streamingdiensten, bei denen dem Endnutzer indes mittlerweile die Wiedergabequalitätseinstellung „auto“ nicht mehr zur Auswahl stehe. Zudem legen sie Abgleiche des Quellcodes der Media Player von weiteren (aber nicht allen) der in der Klageschrift angeführten Streamingdienste der Beklagten zu 1 und 5 (Anlagen K19a bis 19e) und der Beklagten zu 3 (Anlagen K20a bis K20c) unter dem Microsoft-Edge-Browser vor. Sie meinen, dass der Aufruf von Video-Dateien der Beklagten nicht (nur) unmittelbar von den Ursprungsservern der Beklagten erfolge, sondern von Servern eines Content Delivery Networks (CDN), auf denen die Videokopien – wie von den Beklagten im Rahmen ihrer Patentauslegung als erforderlich angesehen – in einzelnen Segmenten kodiert seien. Jedenfalls die auf den CDN-Servern vorgehaltenen Video-Dateien seien patentgemäß kodiert. Ein CDN sei ein Dienst eines Dienstleisters, der die Seiten einer Website auf geografisch über strategisch günstige Standorte verteilten Servern zwischenspeichere, um zur Vermeidung von Latenzen eine schnellere Bereitstellung von Webseiten zu ermöglichen. Aus diesem Grund würden Ursprungsserver in der Regel in Verbindung mit CDN-Diensten eingesetzt. Nur wenn ein angeforderter Inhalt nicht im CDN zwischengespeichert sei, werde er vom Ursprungsserver aufgerufen und danach für künftige Anfragen im CDN-Cache zwischengespeichert, wobei die Dauer der Zwischenspeicherung variiere. Wie die Charles Proxy-Aufzeichnungen und die Ergebnisse des Rückverfolgungs-Programms „TRACERT“ (Trace Route) zeigten, verwende der Streamingdienst www.brazzers.com der Beklagten zu 1 CDN-Server der Dienstleister Reflected Networks, Inc., und Edgecast, Inc., mit Standort in Frankfurt bzw. München, der Streamingdienst www.pornhub.com der Beklagten zu 3 verwende CDN-Server des Dienstleisters Cloudflare, Inc., mit Standort in Frankfurt, und die Streamingdienste www.mygf.com und www.bangbros.com der Beklagten zu 5 und 6 bzw. der Beklagten zu 1 und 6 verwendeten CDN-Server des Dienstleisters Reflected Networks, Inc., mit Standort in Frankfurt.
Die Klägerinnen sind Auffassung, dass ihnen die begehrten Informationen zu übermitteln seien, weil es jedenfalls bei Zugrundelegen der Argumentation der Beklagten für die Frage der Patentverletzung von Bedeutung sei, in welcher konkreten Ausgestaltung und unter Verwendung welchen Kodierungsschemas die Video-Dateien der angegriffenen Streamingdienste kodiert seien. Da sich der Vortrag der Beklagten zur angeblichen Art der Kodierung auf die derzeitige Ausgestaltung beschränke, sei es zudem denkbar, dass sich das Kodierungsschema im für die Patentverletzung maßgeblichen Zeitraum geändert habe. Mehr als die angestellten Analysen sei den Klägerinnen nicht möglich, um zu eruieren, wie die angegriffenen Ausführungsformen funktionierten. Das Kodierungsschema selbst lasse sich aus zugänglichen Quellen nicht weiter feststellen. Da die Beklagten ihren Nichtverletzungsvortrag mitunter auf für die Klägerinnen nicht überprüfbare Informationen zum Kodierungsschema stützten, seien die Beklagten zu 1, 3, 5 und 6 zur Auskunft verpflichtet. Die Klägerinnen hätten in der Replik (S. 67 ff.) konkrete Anhaltspunkte aufgezeigt, dass die Video-Dateien jedenfalls auf den CDN-Servern von Cloudfare nicht in der von den Beklagten behaupteten Weise kodiert seien. Daher überwögen die Interessen der Klägerinnen an der begehrten Informationsübermittlung.
Die Beklagten treten den Anträgen entgegen. Diese seien in sachlicher Hinsicht unklar und unbe-stimmt, zudem verspätet und stellten unzulässige Ausforschungsanträge dar. Für die in R. 191 Alt. 2 VerfO erwähnte Anordnung der Übermittlung von anderen Informationen als solchen gem. Art. 67 EPGÜ fehle es an einer erforderlichen Grundlage im EPGÜ. Abgesehen davon setze, wie sich aus Art. 67 EPGÜ ergebe, die Anordnung der Vorlage von Informationen eine Patentverletzung voraus und komme daher erst im Endurteil oder jedenfalls dann in Betracht, wenn die Frage der Verletzung (für die Instanz) entschieden sei. Jedenfalls seien die Voraussetzung der R. 191 Alt. 2 VerfO im Streitfall nicht gegeben. Für die Streamingdienste www.brazzers.com und www.pornhub.com, den einzigen in der Klagebegründung substantiiert erörterten Streaming-diensten, hätten die Beklagten in ihren Klageerwiderungen im Wege des substantiierten Bestrei-tens unter Offenbarung von vertraulichen Informationen und Vorlage einer schriftlichen Zeugen-aussage vorgetragen, wie Videokopien erstellt und kodiert würden und auf welche Weise von die-sen Videos einzelne Segmente erzeugt würden. Sollten darüber hinaus aus Sicht der Klägerinnen Sachverhaltsfragen – wie nicht – klärungsbedürftig sein, die sie nur mit unverhältnismäßigem Auf-wand gemäß R. 191 VerfO klären könnten, ließen sie jede Konkretisierung vermissen. Es werde klargestellt und in der Duplik erneut aufgegriffen werden, dass die Ausführungen in der Klageerwi-derung zur Kodierung von Videokopien und dem Erzeugen von Segmenten für den Zeitraum seit dem 28.08.2019 gälten.
Die von den Klägerinnen angeführten Zweifel am Vortrag der Beklagten bestünden nicht, sondern beruhten auf einem unrichtigen Verständnis des Klagepatents und einem technischen Fehlver-ständnis der Aufgabe und Funktionsweise von CDNs. Bereits auf der Basis des Vortrags der Kläge-rinnen in der Replik führten CDNs allein die Distribution von Videosegmenten durch, nachdem das Video bereits woanders kodiert und (zumindest teilweise) segmentiert worden sei. Server, die wie CDNs als Cache-Server der bloße Auslieferung einzelner Videosegmente dienten, seien keine pa-tentgemäßen Server. Unabhängig davon sei der Vortrag in den Klageerwiderungen, der sich er-kennbar (und von den Klägerinnen auch erkannt) auf die Ursprungsserver bezogen habe, richtig. Hierzu werde jeweils in der anstehenden Duplik noch näher ausgeführt.
Zweifel am Tatsachenvortrag einer Partei könnten zudem nicht die Anordnung der Vorlage von Informationen gegen sie rechtfertigen, sondern müssten ggf. durch das Gericht im Wege der Wür-digung des Tatsachenvortrags und der angebotenen Beweismittel bewertet werden, was aber erst nach Abschluss der mündlichen Verhandlung möglich sei.
Abgesehen davon benötigten die Klägerinnen die begehrten Informationen zur Rechtsverfolgung schon deshalb nicht, weil zu erwarten sei, dass sich die Beklagten in der anstehenden Duplik in-nerhalb der ihnen zustehenden Einlassungsfrist zum replizierenden Vortrag der Klägerinnen äu-ßern werden. Bei dieser Sachlage dürften durch eine Anordnung der Informationsübermittlung die bestehenden Einlassungsfristen grundsätzlich nicht verkürzt werden.
Ergänzend wird auf die gewechselten Schriftsätze verwiesen.
Die Klägerinnen beantragen,
nach Maßgabe von R. 191 EPGVerfO anzuordnen,

2. dass die Beklagte zu 3 darüber Auskunft erteilt, in welcher konkreten Ausgestaltung und mit welchem Kodierungsschema die durch die Streamingdienste www.pornhub.com, www.pornhubpremium.com, www.youporn.com, www.youporn-gay.com, www.redtube.com, www.pornmd.com, www.thumbzilla.com und www.tube8.com angebotenen und gelieferten Video-Dateien zu jedem Zeitpunkt im Zeitraum vom 28. August 2019 bis heute kodiert (gewesen) sind;
3. dass die Beklagte zu 5 darüber Auskunft erteilt, in welcher konkreten Ausgestaltung und mit welchem Kodierungsschema die durch die Streamingdienste www.mygf.com angebotenen und gelieferten Video-Dateien zu jedem Zeitpunkt im Zeitraum vom 28. August 2019 bis heute kodiert (gewesen) sind;
4. dass die Beklagte zu 6 darüber Auskunft erteilt, in welcher konkreten Ausgestaltung und mit welchem Kodierungsschema die durch die Streamingdienste www.bangbros.com und www.bangpovbros.com angebotenen und gelieferten Video-Dateien zu jedem Zeitpunkt im Zeitraum vom 28. August 2019 bis heute kodiert (gewesen) sind;
5. dass die unter Ziffer 1 bis 4 begehrte Auskunftserteilung innerhalb von vierzehn Tagen nach Anordnung der Auskunftserteilung zu erfolgen hat;
6. in entsprechender Anwendung von R. 190.4 (b), 190.7 EPGVerfO, dass für den Fall, dass die Beklagten zu 1, 3, 5 und 6 ihrer Verpflichtung aus der Anordnung zur Auskunftserteilung nicht nachkommen, dieses Versäumnis bei der Entscheidung über die in Rede stehende Angelegenheit berücksichtigt wird und der plausible Vortrag der Klägerinnen über den Standort der Server und die Art und Weise, wie die Video-Dateien auf den Servern kodiert sind, als zutreffend unterstellt wird; und
7. für den Fall der Zuwiderhandlung die Zahlung eines im Ermessen des Gerichts stehendes angemessenes Zwangsgelds gemäß Art. 82 (4) EPGÜ.
Die Beklagten beantragen,
den Antrag vollumfänglichen abzuweisen.

ANORDNUNG
Die beantragten Anordnungen auf Erteilung von Auskünften kommen aus mehreren Gründen nicht in Betracht.
1. Nach R. 191 VerfO kann das Gericht auf den begründeten Antrag einer Partei anordnen, dass Informationen gemäß Art. 67 EPGÜ, die sich in der Verfügungsgewalt der anderen oder einer dritten Partei befinden, oder Informationen, welche die antragstellende Partei zum Zwecke der Rechtsverfolgung vernünftigerweise benötigt, von der anderen bzw. dritten Partei übermittelt werden müssen.

Ob der Antragsteller Informationen i.S.d. R. 191 Alt. 2 VerfO zum Zwecke der Rechtsverfolgung vernünftigerweise benötigt, beurteilt sich nach den Umständen des Einzelfalls aus Sicht einer verständigen Partei. Gegenstand der Informationsübermittlung können regelmäßig nur konkret benannte Informationen sein, eine unspezifische Ausforschung kommt grundsätzlich nicht in Betracht.
Die Anordnung der Übermittlung von Informationen i.S.d. R. 191 Alt. 2 VerfO dient allein dem Zweck, dem Antragsteller benötigte Informationen zu liefern. Demgegenüber kann sie grundsätzlich nicht dazu verwendet werden, die andere Partei, die sich zu einer Tatsache, auf die sich der Antragsteller zur Begründung seiner geltend gemachten Ansprüche oder Einwendungen stützt, erklärt hat, zu richtigem Vortrag anzuhalten, wenn der Antragsteller der Auffassung ist, die Erklärung der anderen Partei sei unrichtig. Vielmehr ist es Aufgabe des Gerichts, im Rahmen der Würdigung des wechselseitigen Tatsachenvortrags und der angebotenen Beweismittel zur gegebenen Zeit zu beurteilen, ob eine umstrittene Tatsache wahr ist. In diesem Rahmen kann die Partei, die meint, die Tatsache zu benötigen, diese Tatsache behaupten und für sie Beweis anbieten, auch wenn sie sich zwar nicht sicher ist, aber gute Grunde für die Annahme ihrer Richtigkeit hat, ohne dass ihr deswegen ein Verstoß gegen eine etwaige Wahrheitspflicht zum Vorwurf gemacht werden könnte.
Die Anordnung der Übermittlung von Informationen kommt vor diesem Hintergrund grundsätzlich nicht Betracht, solange sich die andere Partei nicht zum Vortrag des Antragstellers geäußert hat, wozu sie grundsätzlich die für die Stellungnahme zu dem Vortrag geltenden Fristen ausschöpfen kann.
Die Anordnung gem. R. 191 Alt. 2 VerfO steht im Ermessen des Gerichts und darf nicht unverhältnismäßig sein. Im Rahmen der Ermessensausübungen sind die Umstände des Einzelfalls unter Einbezug der wechselseitigen Interessen und des Grundsatzes der effizienten Verfahrensführung zu berücksichtigen (vgl. (zur Vorlageanordnung von Beweismitteln) Berufungsgericht, Anordnung vom 24.09.2024, UPC_CoA_298/2024, UPC_CoA_299/2024, UPC_CoA_300/2024 Rn. 47, 53). Auf Seiten des Antragstellers steht insbesondere das Interesse am Erhalt der Informationen, auf Seiten des Antragsgegners insbesondere das Interesse am Schutz vertraulicher Informationen. Aus Gründen der Verhältnismäßigkeit und um die Verteilung der Darlegungs- und Beweislast (hierzu Berufungsgericht, Anordnung vom 26.02.2024, UPC_CoA_335/2023, GRUR 2024, 527 Rn. 94) nicht zu überspielen, darf eine Anordnung auf Übermittlung von Informationen i.S.d. R. 191 Alt. 2 VerfO nicht auf eine unzulässige Ausforschung hinauslaufen. Eine Anordnung der Übermittlung von Informationen i.S.d. R. 191 Alt. 2 VerfO während des Rechtsstreits scheidet regelmäßig aus, wenn die begehrte Information für die im Rechtsstreit verfolgten Ansprüche oder Einwendungen nicht erheblich ist. In diesem Fall ist die Anordnung ihrer Übermittlung regelmäßig zumindest unverhältnismäßig.
Der mit Blick auf die Verfahrensleitungsbefugnisse des Berichterstatters, des Vorsitzenden Richters oder des Spruchkörpers bestehende Ermessensspielraum bei der Entscheidung über einen Antrag auf Übermittlung von Informationen i.S.d. R. 191 Alt. 2 VerfO umfasst auch die Festlegung der Reihenfolge, in der über Streitpunkte zu entscheiden ist. Dabei kann in Ausnahmefällen eine zuvor beantragte und hinreichend begründete Auskunftserteilung, deren Relevanz für die zu treffende Entscheidung sich für das Gericht erst in der mündlichen Verhandlung ergibt, zu einer Vertagung führen, um die Übermittlung von Informationen i.S.d. R. 191 Alt. 2 VerfO anzuordnen. Insoweit gelten keine anderen Grundsätze als für die Anordnung der Vorlage von Beweismitteln gem. R. 190 VerfO (vgl. Berufungsgericht, Anordnung vom 24.09.2024, UPC_CoA_298/2024, UPC_CoA_299/2024, UPC_CoA_300/2024 Rn. 54 f.).

Für das Vorliegen der Voraussetzungen einer Anordnung der Auskunftserteilung ist nach allgemeinen Grundsätzen grundsätzlich der Antragsteller darlegungs- und beweisbelastet.
2. Nach diesen Maßgaben kommt die Anordnung der Übermittlung der begehrten Informationen aus mehreren Gründen nicht in Betracht.
a) Hierbei kann dahinstehen, ob die Klägerinnen in der Antragsschrift die Voraussetzungen für einen Erlass der begehrten Anordnungen hinreichend dargelegt haben, insbesondere hinreichend aufgezeigt haben, welche konkrete Information aus welchen Gründen benötigt wird.
b) Keiner abschließenden Klärung bedarf derzeit ferner, inwiefern das Gericht im vorliegenden Fall von abstrakt gefassten Klageanträgen alle in der Klagebegründung als angegriffene Ausführungsformen bezeichneten, ggf. in relevanten Merkmalen unterschiedlich ausgestalteten Streamingdienste auf eine Patentverletzung prüfen muss und die Klägerinnen daher überhaupt zu jedem Streamingdienst Informationen zum Zwecke der Rechtsverfolgung benötigen.
c) Die Anordnung der begehrten Informationsübermittlung scheidet im Streitfall bereits deshalb aus, weil zum jetzigen Zeitpunkt noch nicht feststeht, wie sich die Beklagten auf den Vorhalt in den Repliken einlassen werden. Gründe, die es rechtfertigen würden, den Beklagten vor Ablauf der Duplikfrist vorab die Übermittlung von Informationen aufzugeben, sind nicht ersichtlich.
d) Abgesehen davon scheidet die Anordnung der Übermittlung der begehrten Informationen aus, weil die Klägerinnen diese nicht benötigen.
Die Beklagten haben zum Kodierungsschema auf ihren Ursprungsservern in den Klageerwiderungen vorgetragen. Die Klägerinnen zeigen zu den Ursprungsservern keine konkreten Informationen auf, die sie über den Vortrag der Beklagten hinaus benötigen würden. Ohne Angabe von konkreten Informationen läuft der Antrag auf eine unzulässige Ausforschung hinaus. Soweit die Klägerinnen den Vortrag der Beklagten für unrichtig halten bzw. seine Richtigkeit bezweifeln, ist R. 191 Alt. 2 VerfO im Übrigen nicht einschlägig. Wie erörtert, dient die Anordnung der Übermittlung von Informationen i.S.d. R. 191 Alt. 2 VerfO nicht dazu, die andere Partei zu vermeintlich richtigem Vortrag zu einer streitigen Tatsache anzuhalten. Abgesehen davon dürften sich die von den Klägerinnen gehegten Zweifel maßgeblich auf das Vorhandensein von CDNs stützen, während die Beklagten ihren Vortrag in den Klageerwiderungen wohl vorrangig auf ihre Ursprungsserver bezogen wissen wollten. Jedenfalls werden die Beklagten in ihrer Duplik Gelegenheit haben, sich zu den behaupteten Zweifeln und zu den Verhältnissen bei ihren Ursprungsservern und den CDNs zu erklären.
Die konkrete Ausgestaltung und das Kodierungsschema der Videodateien auf den CDN-Servern ist nicht Gegenstand des vorliegenden Auskunftsverlangens, wie sich aus dem Umstand ergibt, dass die Aufteilung der Videodateien auf den CDN-Servern und ihre dortige Kodierung in einem zeitgleichen weiteren eigenständigen Antrag der Klägerinnen gem. R. 191 VerfO erfragt werden (vgl. App_46521/2024). Abgesehen davon wäre einem solches Verlangen aus den in der Anordnung zum Workflow App_46521/2024 angeführten Gründen nicht stattzugeben, zumal die Einlassung der Beklagten im Rahmen ihrer Duplik noch aussteht.

e) Darüber hinaus kommt eine Anordnung der Informationsübermittlung für die meisten Streamingdienste auch deshalb nicht in Betracht, weil die Klägerinnen nicht alle ihnen zumutbar zur Verfügung stehenden Informationsquellen ausgeschöpft haben.
Die Klägerinnen haben lediglich einige Streamingdienste untersucht und hierzu Charles-Proxy-Aufzeichnungen vorgelegt. Sollte es hierauf ankommen, wären die Klägerinnen gehalten, entsprechend für die übrigen Streamingdienste vorzugehen. Allenfalls dann wäre es gerechtfertigt, den Beklagten, sollte dies entgegen dem Vorstehenden möglich sein, zur Widerlegung von ihren etwaigen Behauptungen die Übermittlung von geforderten, hinreichend konkretisierten Informationen zu diesen Streamingdiensten aufzugeben. Dass ihnen ein solches Vorgehen bei den übrigen Streamingdiensten unzumutbar wäre, haben die Klägerinnen nicht dargetan. Eine Unzumutbarkeit folgt insbesondere nicht ohne weiteres daraus, dass die weiteren Streamingdienste überwiegend kostenpflichtig sind.
f) Schließlich rechtfertigt es jedenfalls der bisher erreichte Sach- und Streitstand zur Auslegung, Verletzung und Rechtsbeständigkeit des Klagepatents nicht, die Beklagten mit der Anordnung der Übermittlung der begehrten Informationen zu belasten.
3. Vor diesem Hintergrund kann dahinstehen, ob für R. 191 Alt. 2 VerfO eine erforderliche Grundlage im EPGÜ fehlt und ob eine Anordnung zur Vorlage von Informationen gem. R. 191 VerfO erst in der die erste Instanz abschließenden Sachentscheidung des Verletzungsstreits ergehen kann.
4. Sollte es darauf ankommen, insbesondere bei veränderter Sachlage, sind künftige Anordnungen auf Auskunftserteilung durch die vorliegende Anordnung nicht ausgeschlossen, falls Vortrag der Beklagten erhebliche Lücken aufweisen und es auf die fehlenden konkreten Informationen für die Entscheidung des Streitfalls ankommen sollte.
5. An dem Nebenverfahren zum Streit über die Auskunftserteilung waren sämtliche Beklagten zu beteiligen. Ohne Belang ist, dass die Übermittlung lediglich von den Beklagten zu 1, 3, 5 und 6 begehrt wird, denn die Klägerin bezweckt, mit den zu übermittelnden Informationen im vorliegenden Rechtsstreit Patentverletzungen zu belegen, an denen die Beklagten zu 2 und 4 nach dem Klägervortrag ebenfalls beteiligt sind. Damit sind vom Streit auch Interessen dieser Beklagten betroffen.
6. Mit der untenstehenden Rechtsbehelfsbelehrung wird mit Bezug auf R. 191 VerfO lediglich R. 191 S. 2 i.V.m. 190.6 S. 2 VerfO formal umgesetzt und soll keine Festlegung dahin verbunden werden, dass Rechtsmittel gegen Anordnungen gem. R. 191 VerfO nach Art. 59, 73 Abs. 2 lit. a EPGÜ zu behandeln sind.

Die Anträge der Klägerinnen vom 09.08.2024 auf Auskunftserteilung betreffend die konkrete Ausgestaltung und das Kodierungsschema der Video-Dateien der Streamingdienste werden zu-rückgewiesen.

SUBJECT: Request for an order to disclose information pursuant to Rule 191 RoP

FACTS:
The plaintiffs request, pursuant to R. 191 RoP, an order requiring the defendants 1, 3, 5 and 6 to disclose how the video files available via their respective streaming services are encoded in the period from 28 August 2019 (date of publication of the grant of the patent in suit) to the present.

The plaintiffs are suing the defendants in the underlying main proceedings for alleged indirect patent infringement in the territory of the Kingdom of Denmark, the Federal Republic of Germany, the Republic of Finland, the French Republic, the Italian Republic, the Kingdom of the Netherlands, the Republic of Austria, the Portuguese Republic and the Kingdom of Sweden. The defendants have filed counterclaims for annulment.


According to the statement of claim, defendants 1, 3, 5 and defendant 6 (the latter only together with defendant 1 and defendant 5) operate streaming services which are specified in detail (but not exhaustively) in the statement of claim as infringing embodiments for the respective defendants (see Statement of claim, p. 28, para. 1, p. 12, paras. 2 and 4), while defendants 2 and 4 provide payment processing services for this purpose. The requests for information relate to the video files available via these streaming services.

In the statement of claim, the plaintiffs have provided examples of the alleged patent infringement using the streaming service www.brazzers.com of the first defendant and the streaming service www.pornhub.com of the third defendant, each accessed via the Microsoft Edge browser, with one video accessed in each case in the dynamic playback quality setting ‘auto’ (for automatic) using the analysis tool Charles Web Debugging Proxy (hereinafter Charles Proxy) and the source code of the media player used, which is publicly available via Microsoft Edge DevTools under the Microsoft Edge browser (statement of claim, p. 35 ff. and 76 ff.) and asserting, in general terms, that the statements apply accordingly to all other contested embodiments (statement of claim, p. 34). Charles Proxy is an HTTP web testing proxy server application that allows users to view all HTTP and SSL/HTTPS traffic between their computer and the Internet, in particular requests and responses, including HTTP headers and metadata (e.g. cookies, caching and encoding information), and thereby throttle the bandwidth available to the end user station for streaming. The information obtained in this way, according to their submission, was submitted by the plaintiffs for the first streaming service as Annexes K6 (Charles Proxy records) and K7 (source code) and for the second streaming service as Annexes K8 (Charles Proxy records) and K9 (source code) to the statement of claim.

In their statements of defence, the defendants denied that the streaming services www.brazzers.com and www.pornhub.com infringed the patent. In doing so, they interpreted the patent in suit differently in some respects and presented a different view of the technical functioning of the two streaming services, attributing a different meaning to the Charles proxy records and source codes submitted than the plaintiffs. Contrary to the requirements of the patent in suit, the videos available on the aforementioned websites are neither encoded with a specific bit rate nor stored as multiple files (streamlets) on a set of servers as in a mere data cabinet. With regard to the other streaming services named in the statement of claim as contested embodiments, they complain of the complete lack of a conclusive, or at least substantiated, statement on the use of the teaching of the patent in suit. Since, according to the statement of claim, the two streaming services discussed in the statement of claim are already differently designed, the blanket reference that the others function accordingly is irrelevant.

In their replies to the individual statements of defence, the plaintiffs expand on their infringement arguments regarding the two streaming services explained in the statement of claim, in which the end user no longer has the option of selecting the ‘auto’ playback quality setting. In addition, they submit comparisons of the source code of the media players of other (but not all) of the streaming services of defendants 1 and 5 (Annexes K19a to 19e) and defendant 3 (Annexes K20a to K20c) listed in the statement of claim using the Microsoft Edge browser. They believe that the defendant's video files are not (only) accessed directly from the defendant's origin servers, but from servers of a content delivery network (CDN) on which the video copies are encoded in individual segments, as deemed necessary by the defendants in their interpretation of the patent. In any case, the video files stored on the CDN servers are encoded in accordance with the patent. A CDN is a service provided by a service provider that caches the pages of a website on servers distributed across strategically located sites in order to enable faster delivery of web pages and avoid latency. For this reason, origin servers are generally used in conjunction with CDN services. Only if requested content is not cached in the CDN is it retrieved from the origin server and then cached in the CDN cache for future requests, with the duration of the caching varying. As shown by the Charles Proxy records and the results of the ‘TRACERT’ (Trace Route) tracing programme, the streaming service www.brazzers.com of the first defendant uses CDN servers of the service providers Reflected Networks, Inc. and Edgecast, Inc., located in Frankfurt and Munich, respectively. Munich, the streaming service www.pornhub.com of the third defendant uses CDN servers of the service provider Cloudflare, Inc., located in Frankfurt, and the streaming services www.mygf.com and www.bangbros.com of the fifth and sixth defendants and the first and sixth defendants, respectively, use CDN servers of the service provider Reflected Networks, Inc., located in Frankfurt.

The plaintiffs are of the opinion that the requested information should be provided to them because, in any case, based on the defendants' arguments, it is relevant to the question of patent infringement to know the specific design and coding scheme used to encode the video files of the contested streaming services. Since the defendant's submission on the alleged type of encoding is limited to the current configuration, it is also conceivable that the encoding scheme changed during the period relevant to the patent infringement. The plaintiffs are unable to go beyond the analyses carried out to determine how the contested embodiments function. The encoding scheme itself cannot be further determined from accessible sources. Since the defendants based their non-infringement submission in part on information about the encoding scheme that cannot be verified by the plaintiffs, defendants 1, 3, 5 and 6 are obliged to provide information. In their reply (p. 67 et seq.), the plaintiffs had provided concrete evidence that the video files were not encoded in the manner claimed by the defendants on Cloudfare's CDN servers. Therefore, the plaintiffs' interests in the requested transfer of information outweighed the defendants' interests.

The defendants oppose the requests. These are unclear and vague in factual terms, are also late and constitute inadmissible requests for information. The order to transfer information other than that referred to in R. 191 Alt. 2 RoP pursuant to Art. 67 UPCA lacks the necessary basis in the UPCA. Apart from that, as is apparent from Art. 67 UPCA, the order to submit information presupposes a patent infringement and can therefore only be considered in the final judgment or, in any case, when the question of infringement has been decided (for the instance). In any case, the requirements of R. 191 Alt. 2 RoP are not met in the present case. For the streaming services www.brazzers.com and www.pornhub.com, the only streaming services discussed in detail in the statement of claim, the defendants had, in their statements of defence, substantiated their objections by disclosing confidential information and submitting a written witness statement explaining how video copies were made and encoded and how individual segments were generated from these videos. Furthermore, if, in the plaintiffs' view, questions of fact were in need of clarification – which they were not – that they could only clarify with disproportionate effort in accordance with R. 191 RoP, they failed to provide any specific details. It was clarified and reiterated in the rejoinder that the statements in the statement of defence regarding the encoding of video copies and the creation of segments applied to the period since 28 August 2019.

The doubts raised by the plaintiffs regarding the defendant's submission were unfounded and based on an incorrect understanding of the patent in suit and a technical misunderstanding of the task and functioning of CDNs. Based on the plaintiffs' submission in the reply, CDNs alone carried out the distribution of video segments after the video had already been encoded and (at least partially) segmented elsewhere. Servers which, like CDNs, served as cache servers for the mere delivery of individual video segments were not servers within the meaning of the patent. Irrespective of this, the statement in the response to the complaint, which clearly referred to the origin servers (and was also recognised as such by the plaintiffs), was correct. This will be explained in more detail in the forthcoming rejoinder.

Furthermore, doubts about the statement of facts made by one party could not justify ordering the submission of information against it, but would have to be assessed by the court, if necessary, by evaluating the statement of facts and the evidence offered, which would only be possible after the conclusion of the oral proceedings.

Apart from that, the plaintiffs did not need the requested information for legal proceedings because it was to be expected that the defendants would comment on the plaintiffs' reply in the pending rejoinder within the time limit available to them. In this situation, an order to transfer information should not, in principle, shorten the existing time limits for submitting statements of defence.

in accordance with R. 191 EPGVerfO, it be ordered

3. that the fifth defendant provides information on the specific format and encoding scheme used to encode the video files offered and delivered by the streaming services www.mygf.com at any time during the period from 28 August 2019 to the present;

4. that the sixth defendant provides information on the specific form and coding scheme used to encode the video files offered and delivered by the streaming services www.bangbros.com and www.bangpovbros.com at any time during the period from 28 August 2019 to the present day;

5. that the information requested in points 1 to 4 must be provided within fourteen days of the order to provide information;
6. in accordance with R. 190.4 (b), 190.7 EPGVerfO, that in the event that the defendants in 1, 3, 5 and 6 fail to comply with their obligation to provide information pursuant to the order, this failure shall be taken into account in the decision on the matter in question and the plaintiffs' plausible submission regarding the location of the servers and the manner in which the video files are encoded on the servers shall be assumed to be correct; and

7. in the event of non-compliance, payment of an appropriate penalty payment at the discretion of the court in accordance with Art. 82 (4) UPCA.
The defendants request that
the application be dismissed in its entirety.

ORDER
The requested orders to provide information cannot be considered for several reasons.

1. Pursuant to Rule 191 RoP, the court may, upon a reasoned request by a party, order that information within the control of the other party or a third party, or information which the requesting party reasonably needs for the purpose of legal proceedings, be provided by the other party or the third party.


Whether the applicant reasonably needs information within the meaning of Rule 191(2) RoP for the purpose of legal action is assessed on the basis of the circumstances of the individual case from the perspective of a reasonable party. The subject matter of the transfer of information can only be specifically designated information; unspecific inquiries are generally not considered.
The order to transfer information within the meaning of R. 191 Alt. 2 RoP serves solely to provide the applicant with the information it needs. On the other hand, it cannot be used to compel the other party, which has made a statement on a fact on which the applicant bases its claims or objections, to make a correct statement if the applicant considers the other party's statement to be incorrect. Rather, it is the task of the court, in the context of assessing the mutual statements of fact and the evidence offered, to determine at the appropriate time whether a disputed fact is true. In this context, the party who believes that it needs the fact may assert it and offer evidence for it, even if it is not certain but has good reasons for believing that it is true, without being accused of violating any duty of truthfulness.

Against this background, an order to transmit information is generally not considered as long as the other party has not commented on the applicant's submission, for which it may, in principle, make full use of the time limits applicable to comments on the submission.

The order pursuant to Rule 191(2) RoP is at the discretion of the court and must not be disproportionate. In exercising its discretion, the circumstances of the individual case must be taken into account, including the mutual interests and the principle of efficient proceedings (see (on the order to produce evidence) Court of Appeal, order of 24 September 2024, UPC_CoA_298/2024, UPC_CoA_299/2024, UPC_CoA_300/2024, para. 47, 53). The applicant has a particular interest in obtaining the information, while the respondent has a particular interest in protecting confidential information. For reasons of proportionality and in order not to distort the distribution of the burden of proof and presentation (see Court of Appeal, order of 26 February 2024, UPC_CoA_335/2023, GRUR 2024, 527 para. 94), an order to transfer information within the meaning of R. 191 Alt. 2 RoP must not amount to an inadmissible search for information. An order to transmit information within the meaning of R. 191 Alt. 2 RoP during the legal dispute is generally ruled out if the information sought is not relevant to the claims or objections pursued in the legal dispute. In this case, ordering its transmission is generally at least disproportionate.
The discretion available to the rapporteur, the presiding judge or the panel of judges when deciding on a request for the transmission of information within the meaning of R. 191 Alt. 2 RoP also includes determining the order in which points of dispute are to be decided. In exceptional cases, the provision of information that has been requested in advance and is sufficiently justified, but whose relevance to the decision to be made only becomes apparent to the court during the oral hearing, may lead to an adjournment in order to order the transmission of information within the meaning of R. 191 Alt. 2 RoP. In this respect, no principles other than those applicable to the order to submit evidence pursuant to R. 190 RoP apply (see Appeal Court, order of 24 September 2024, UPC_CoA_298/2024, UPC_CoA_299/2024, UPC_CoA_300/2024, para. 54 et seq.).


According to general principles, the burden of proof and the burden of demonstration lie with the applicant for the existence of the conditions for an order to provide information.
2. According to these criteria, the order to transmit the requested information cannot be considered for several reasons.

a) It can be left open whether the plaintiffs have sufficiently demonstrated in their application that the conditions for issuing the requested orders have been met, in particular whether they have sufficiently demonstrated what specific information is required and for what reasons.

b) Furthermore, it does not currently require final clarification to what extent the court must, in the present case, examine all streaming services described in the statement of claim as infringing, which may differ in relevant features, for patent infringement and whether the plaintiffs therefore require information on every streaming service for the purpose of legal action.

c) The order to transfer the requested information is ruled out in the present case because it is not yet clear at this stage how the defendants will respond to the allegations made in the replies. There are no apparent reasons that would justify ordering the defendants to transfer information in advance before the expiry of the deadline for the rejoinder.

d) Apart from that, ordering the transfer of the requested information is out of the question because the plaintiffs don't need it.
The defendants have commented on the coding scheme on their original servers in their statements of defence. The plaintiffs don't show any specific information about the original servers that they would need beyond what the defendants have already said.
Without providing specific information, the request amounts to an inadmissible attempt to obtain information. Insofar as the plaintiffs consider the defendants' submission to be incorrect or doubt its accuracy, R. 191 Alt. 2 RoP is not relevant. As discussed, the order to transmit information within the meaning of R. 191 Alt. 2 RoP does not serve to compel the other party to make a supposedly correct statement on a disputed fact. Apart from that, the doubts raised by the plaintiffs appear to be based primarily on the existence of CDNs, whereas the defendants apparently wanted their statement in the statements of defence to refer primarily to their origin servers. In any case, the defendants will have the opportunity in their rejoinder to comment on the alleged doubts and on the circumstances at their origin servers and the CDNs.

The specific design and coding scheme of the video files on the CDN servers is not the subject of the present request for information, as is apparent from the fact that the distribution of the video files on the CDN servers and their coding there is requested in a simultaneous further independent application by the plaintiffs pursuant to Section 191(1) VerfGGerichtsordnung (German Code of Civil Procedure) (see App_46521/2024). R. 191 RoP (see App_46521/2024). Apart from that, such a request would not be granted for the reasons stated in the order on the workflow App_46521/2024, especially since the defendant's statement in its rejoinder is still pending.

e) Furthermore, an order to provide information is not an option for most streaming services because the plaintiffs have not exhausted all sources of information reasonably available to them.
The plaintiffs have only examined a few streaming services and submitted Charles proxy records. If this were to be decisive, the plaintiffs would be required to proceed accordingly for the remaining streaming services. Only then would it be justified to order the defendants, if this were possible contrary to the above, to refute their claims by providing the requested, sufficiently specific information on these streaming services. The plaintiffs have not demonstrated that such a course of action would be unreasonable for the remaining streaming services. In particular, the fact that the other streaming services are predominantly subject to a fee does not automatically mean that this would be unreasonable.
f) Finally, in any case, the state of the facts and the dispute as regards the interpretation, infringement and legal validity of the patent in suit does not justify ordering the defendants to provide the requested information.

3. Against this background, it can be left open whether R. 191 Alt. 2 RoP lacks a necessary basis in the UPCA and whether an order to provide information pursuant to R. 191 RoP can only be issued in the first instance decision concluding the infringement dispute.

4. Should this be relevant, in particular in the event of a change in the facts of the case, future orders for the provision of information by means of the present order are not excluded if the defendants' submissions contain significant gaps and the missing specific information is relevant to the decision of the dispute.
5. All defendants were to be involved in the ancillary proceedings concerning the dispute over the provision of information. It is irrelevant that the transfer is only requested by defendants 1, 3, 5 and 6, because the plaintiff intends to use the information to be transferred in the present legal dispute to prove patent infringements in which defendants 2 and 4 are also involved according to the plaintiff's submission. This means that the interests of these defendants are also affected by the dispute.

6. With the information on the right of appeal below, with reference to R. 191 RoP, only R. 191 sentence 2 in conjunction with 190.6 sentence 2 RoP and is not intended to imply that appeals against orders pursuant to Rule 191 RoP are to be treated in accordance with Articles 59 and 73(2)(a) UPCA.

ORDER:

The plaintiffs' requests of 9 August 2024 for information regarding the specific design and coding scheme of the streaming services' video files are rejected.
