Verletzungsklage und Nichtigkeitswiderklage – Rücknahme, Erledigung und Gebührenerstattung, Regel 265 VerfO, Regel 360 RoP, Regel 370.9 VerfO

KURZE DARSTELLUNG DES SACHVERHALTS
Die Klägerin ist Inhaberin des Europäischen Patents EP 3 225 320 B1, welches eine Vorrichtung und ein Verfahren zum Messen der Gradheit eines stabförmigen Werkstücks betrifft (Anlage CBH 4, nachfolgend Streitpatent). Die Beklagte stellt in Deutschland her, bietet an und bringt in Verkehr Vorrichtungen zur Messung der Gradheit von stabförmigen Erzeugnissen unter der Bezeichnung „Straightness Control Type TQC“ (angegriffene Ausführungsform 1) und „Total Quality Control Type TQC 2.0“ (angegriffene Ausführungsform 2).
Die angegriffenen Ausführungsformen verwirklichen nach Ansicht der Klägerin die technische Lehre des Streitpatents, weshalb sie die Beklagte wegen Patentverletzung auf Unterlassung, Informationserteilung, Bücheroffenlegung, Vernichtung, Rückruf, Kostentragung der Urteilsveröffentlichung und Schadenersatz bzw. Schadenersatzfeststellung in Anspruch nimmt (ACT_569315/2024, UPC_CFI_300/2023). Die Beklagte bestreitet eine Benutzung des Streitpatents.
Die Beklagte hat Widerklage auf Nichtigerklärung des Streitpatents erhoben (CC_597425/2023). Die Klägerin ist der Nichtigkeitswiderklage entgegengetreten und hat hilfsweise Anträge auf Änderung des Patents gestellt (App_11005/2024).
Die Beschwerdekammer des EPA hat das Streitpatent in der mündlichen Verhandlung am 04.07.2024 (T-0367/23-3.4.02) vollständig widerrufen.
Infolge des rechtskräftigen Widerrufs ist der Klage nach Ansicht der Klägerin die Grundlage entzogen, weshalb sie sich veranlasst sieht, die Klage gem. Regel 265.1 VerfO zurückzunehmen (App_42913/2024). Da das schriftliche Verfahren noch nicht abgeschlossen ist, begehrt sie zudem die Rückerstattung der Gerichtsgebühren in Höhe von 60 % gem. Regel 370.9 (b) (i) VerfO (App_42919/2024). Für den Fall, dass die Beklagte die Nichtigkeitswiderklage nicht zurücknehmen sollte, hat die Klägerin in ihrem Antrag auf Klagerücknahme vorsorglich ihr Einverständnis mit einer Erledigung nach Regel 360 VerfO erklärt. Die Beklagte hat erklärt, sie mache kein berechtigtes Interesse im Sinne der Regel 265.1 S. 3 VerfO geltend.
Hinsichtlich der Nichtigkeitswiderklage begehrt die Beklagte gem. Regel 360 VerfO die Feststellung, dass die Nichtigkeitswiderklage durch den Widerruf des Streitpatents gegenstandslos geworden ist und sich das Verfahren erledigt hat (App_45647/2024). Da das schriftliche Verfahren noch nicht abgeschlossen ist, begehrt die Beklagte des Weiteren, die Rückerstattung der Gerichtsgebühren der Widerklage in Höhe von 60 % gem. Regel 370.9 (b) (i) VerfO und Regel 370.9 (c) (i) VerfO analog (App_45658/2024).

ANTRÄGE
Die Klägerin beantragt,
die Rücknahme der Verletzungsklage gem. Regel 265 VerfO,
die Rückerstattung der Gerichtsgebühren in Höhe von 60 % gem. Regel 370.9 (b) (i) VerfO.
Die Beklagte beantragt,
a) festzustellen, dass die Widerklage durch den Widerruf des Europäischen Patents EP 3 225 320 gegenstandslos geworden ist und sich das Verfahren erledigt hat,
b) das Verfahren betreffend die Widerklage abzutragen,
c) die Rückerstattung der Gerichtsgebühren der Widerklage in Höhe von 60 % gem. Regel 370.9 (b) (i) VerfO analog und Regel 370.9 (c) (i) VerfO analog und
d) der Klägerin und Widerbeklagten die Kosten des Widerklageverfahrens aufzuerlegen.

TATSÄCHLICHE UND RECHTLICHE STREITPUNKTE
1. Die Klägerin ist der Ansicht, bei der gem. Regel 265.2 (c) VerfO zu treffenden Kostengrundentscheidung sei Art. 69 Abs. 3 EPGÜ zu beachten, wonach unnötige Kosten von der Partei zu tragen seien, die diese verursacht habe. Dies führe zu einer Kostentragungspflicht der Beklagten, da diese sich nicht verfahrensfördernd verhalten habe und insbesondere mit ihrem Vortrag in der Klageerwiderung erheblichen und unnötigen Aufwand bei beiden Parteien verursacht habe. Nachdem sie, die Klägerin, in der Klageschrift die angegriffene Ausführungsform 1 konkret bezeichnet habe, sei keine ergiebige Stellungnahme seitens der Beklagten hierauf erfolgt. Erst in der Duplik habe sich bestätigt, dass die Beklagte selbst von einer Verwirklichung des Streitpatents ausgehe. Die Beklagte habe mit den Ausführungen zur angegriffenen Ausführungsform 2, zu welcher die Beklagte von sich aus vorgetragen habe, abgelenkt. Jedenfalls mit der Klageerwiderung habe keine ausreichende Aufklärung über die Funktionsweise der angegriffenen Ausführungsform 2 vorgelegen. Der Vortrag der Beklagten hierzu sei unvollständig und lückenhaft geblieben. Zur klägerseitigen Bearbeitung des Falls sei es daher erforderlich gewesen, in erheblichem Maße weitere Quellen zu identifizieren, auszuwerten und aufzubereiten sowie vertieften vorsorglichen Vortrag zu einer Ausführungsform zu halten, die gar nicht angegriffen gewesen sei. Hätte die Beklagte sich verfahrensfördernd verhalten, wäre der überwiegende Teil der Klageerwiderung, der Replik und der Duplik nicht erforderlich gewesen. Dass hierdurch erheblicher und unnötiger Mehraufwand bei der Klägerin entstanden sei, werde vorsorglich anwaltlich versichert. Eine Darlegung der konkret entstandenen Kosten werde Gegenstand des Kostenfestsetzungsverfahrens sein, in dem die einzelnen Kostenpunkte konkret substantiiert würden, sollte dies durch eine entsprechende Kostengrundentscheidung gestützt sein.

2. Die Klägerin ist ferner der Ansicht, die Erhebung einer Nichtigkeitswiderklage sei vor dem Hintergrund der anhängigen Beschwerde im Einspruchsverfahren vor dem EPA mit baldigem Termin zur mündlichen Verhandlung nicht erforderlich gewesen.
3. Mit Blick auf die Nichtigkeitswiderklage ist die Klägerin der Ansicht, diese sei ohne Klagerücknahme bei Gegenstandslosigkeit und Erledigung nach Regel 360 VerfO abzuweisen. Fraglich sei, ob der Widerruf des Streitpatents ein erledigendes Ereignis für die Nichtigkeitswiderklage sei und, wenn dem so sei, die Erledigung bedinge. Dazu sei zu erwägen, ob die Erledigung die vorherige Zulässigkeit und Begründetheit der Nichtigkeitswiderklage voraussetze. Werde dies vorausgesetzt, sei vorliegend zu berücksichtigen, dass die Nichtigkeitswiderklage jedenfalls teilweise unbegründet sei und das Streitpatent jedenfalls in dem durch die Beschwerdekammer des EPA nicht geprüften Umfang des ersten Hilfsantrags unbegründet sei. Mit Prüfung dieser Voraussetzungen entstünde jedoch zusätzlicher und ob des Widerrufs des Streitpatents schlussendlich unnützer Aufwand. Nach der Regel 360 VerfO scheine es allerdings nicht darauf anzukommen, ob die Klage ursprünglich zulässig und begründet war. Es erscheine vertretbar, dass mit dem Widerruf des Streitpatents die Klage gegenstandslos geworden und eine Erledigung entsprechend Regel 360 VerfO eingetreten sei. Die in Regel 360 VerfO vorgesehene Folge der Klageabweisung dürfte allerdings nicht das Interesse der Beklagten widerspiegeln.
4. Die Klägerin regt zudem an, unmittelbar mit der Entscheidung über die Klagerücknahme und die Entscheidung über die Nichtigkeitswiderklage (jeweils) eine Entscheidung zur Obergrenze für die erstattungsfähigen Kosten zu treffen. Da die vorliegenden Verfahren in einem frühen Stadium zu einem Ende gelangten, in dem wesentliche und auch aufwändige Verfahrensschritte noch nicht stattgefunden hätten, sei es angemessen, die Obergrenze für die erstattungsfähigen Kosten hieran anzupassen und somit allein anteilig und deutlich niedriger anzusetzen. Eine Orientierungshilfe könne in Regel 370.9 (b) VerfO gesehen werden. Übertrage man den dortigen Gedanken auf die Festsetzung der erstattungsfähigen Kosten der Parteien gemäß den Angaben des Verwaltungsausschusses, sei eine Obergrenze von 40 % des Wertes der Tabelle anzusetzen, basierend auf den jeweiligen Streitwerten in Höhe von 500.000,00 € mithin also jeweils 22.400,00 €. Höchstens könne jedoch eine Obergrenze in Höhe von 50 % des Tabellenwerts noch billig sein.
5. Die Beklagte ist der Ansicht, bei der Kostenentscheidung nach Regel 265.2 (c) VerfO handele es sich nicht um eine Kostengrundentscheidung, sondern um die nachgelagerte Entscheidung über die erstattungsfähigen Kosten nach R. 150 ff. VerfO. Dass der Kläger im Fall der Klagerücknahme die Kosten zu tragen habe, werde von der Verfahrensordnung offensichtlich vorausgesetzt. Die Behauptung der Klägerin, dass sich die Beklagte nicht verfahrensfördernd verhalten und so erheblichen und unnötigen Aufwand bei beiden Parteien verursacht habe, sei zurückzuweisen. Tatsächlich seien die Behauptungen der Klägerin in der Klageschrift zu der Vorrichtung, die einem Zeugen bei der Beklagten erläutert und angeboten wurde, fehlerhaft gewesen. Anscheinend sei die Klägerin von dem Zeugen diesbezüglich unzutreffend unterrichtet worden. Jedenfalls bestreite auch die Klägerin inzwischen nicht mehr, dass dem Zeugen die angegriffene Ausführungsform 2 (und nicht die angegriffene Ausführungsform 1) erläutert und angeboten worden sei. Sie habe vielmehr in ihrer Replik ausdrücklich deshalb die Klage noch erweitert. Ihr Vortrag zur angegriffenen Ausführungsform 2 sei ausführlich gewesen. Die Klägerin bleibe jeden Hinweis schuldig, worin der angebliche durch die Beklagte verschuldete unnötige Mehraufwand liegen solle.

6. Zum Zeitpunkt der Erhebung der Nichtigkeitswiderklage, so die Beklagte, sei die mündliche Verhandlung im Beschwerdeverfahren vor dem EPA noch nicht terminiert gewesen. Sowohl in den Erwägungsgründen des EPGÜ als auch in der Präambel der Verfahrensordnung werde herausgestellt, dass das EPG in der Lage sein solle, rasche Entscheidungen sicherzustellen. Vor diesem Hintergrund sei es sachgerecht, durch Einlegung der Nichtigkeitswiderklage sicherzustellen, dass die Argumente gegen die Schutzfähigkeit des inzwischen widerrufenen Streitpatents vor einer Entscheidung über deren angebliche Verletzung berücksichtigt werden können. Die Nichtigkeitswiderklage wäre zudem in vollem Umfang erfolgreich gewesen. Die Hilfsanträge der Klägerin seien teils unzulässig und im Übrigen unbegründet.
7. Zur Nichtigkeitswiderklage führt die Beklagte aus, diese sei durch den Widerruf des Streitpatents gegenstandslos geworden, die Hauptsache habe sich erledigt. Es greife Regel 360 VerfO ein. Das Verfahren sei deshalb „abzutragen“. Für die Frage, ob die Zulässigkeit und Begründetheit der Widerklage Voraussetzung für eine Erledigung seien, sei kein Raum mehr, nachdem die Klägerin bereits in ihrem Antrag auf Klagerücknahme (vorsorglich) ihr Einverständnis mit der Erledigung erklärt habe und sodann sie, die Beklagte, die Feststellung der Erledigung der Widerklage beantragt habe. Sie sehe von einer Klagerücknahme ab, da sie sich damit in die Rolle der unterlegenen Partei begeben würde. Das sei angesichts des Widerrufs des Streitpatents angebracht und keineswegs unnützer Aufwand.
8. Die Beklagte ist darüber hinaus der Ansicht, ihr sei ein Teil der Gerichtsgebühren der Nichtigkeitswiderklage zu erstatten. Zwar fehlten für den Fall der Erledigung der Widerklage aufgrund eines vollständigen und rechtskräftigen Widerrufs des Streitpatents Vorschriften zur Erstattung. Es seien indes die Regeln 370.9 b) (i) und c) (i) VerfO analog anwendbar.
9. Da im Kostenfestsetzungsverfahren die Angemessenheit der Kosten, deren Erstattung begehrt werde, gerichtlich überprüft werde, besteht nach Auffassung der Beklagten kein Bedürfnis, in der Kostengrundentscheidung pauschal die Obergrenze der erstattbaren Kosten herabzusetzen.

GRÜNDE DER ENTSCHEIDUNG
I.
10. Die Rücknahme der Klage ist gem. Regel 265.1 VerfO zuzulassen. Die Klägerin hat den Antrag auf Klagerücknahme vor dem Erlass einer Endentscheidung gestellt. Die Beklagte hat in ihrer Stellungnahme auf diesen Antrag mitgeteilt, keine berechtigten Interessen im Sinne der Regel 265.1 VerfO geltend zu machen. Derartig berechtigte Interessen sind auch sonst nicht zu erkennen.

11. Folge der Zulassung der Klagerücknahme ist nach Regel 265.2 (a) und (b) VerfO die Beendigung des Verfahrens sowie die Aufnahme der Entscheidung in das Register.

12. Nach Regel 265.2 (c) VerfO hat das Gericht zudem bei Zulassung der Klagerücknahme eine Kostentscheidung gemäß Teil 1 Kapitel 5 zu treffen.
a)
13. Obgleich die Regelung angesichts ihres Wortlauts explizit nur auf die Regeln des Kostenfestsetzungsverfahrens, d.h. auf die Regeln 150 ff. VerfO verweist, hat das Gericht auch bei Rücknahme einer Klage (auch) eine Kostengrundentscheidung im Sinne des Art. 69 EPGÜ zu treffen.
14. Denn auf diese Vorschrift wird mittelbar verwiesen. Die in Regel 265.2 (c) VerfO ausdrücklich in Bezug genommenen Regeln des Festsetzungsverfahrens können nicht losgelöst von Art. 69 EPGÜ betrachtet werden. Sie basieren vielmehr auf dieser höherrangigen Vorschrift, die die Grundlagen zur Verteilung der Kosten des Rechtsstreits dem Grunde nach enthält. Dies wird unter anderem auch daran deutlich, dass die Regeln 150 ff. VerfO die in Art. 69 EPGÜ verwendeten Begriffe, wie z.B. obsiegende Partei, Angemessenheit und Zumutbarkeit aufgreifen und sich die Kostenfestsetzung an den Vorgaben des Art. 69 EPGÜ orientiert. Die Kostenfestsetzung konkretisiert im Einzelfall die Höhe der Kosten, die diejenige Partei zu erstatten bzw. zu tragen hat, die nach Art. 69 EPGÜ dem Grunde nach die Kostenlast trägt.
15. Aufgrund des untrennbaren Zusammenhangs von Art. 69 EPGÜ und den Regeln 150 ff. VerfO kann es sich bei der Kostenentscheidung gem. Regel 265.2 (c) VerfO auch (nur) um eine Kostengrundentscheidung handeln (vgl. z. B. Lokalkammer Düsseldorf, Entscheidung v. 06.08.2024, UPC_CFI_87/2024; Lokalkammer Den Haag, Entscheidung v. 01.05.2024, UPC_CFI_379/2023), die gegebenenfalls bei einer Klagerücknahme aufgrund einer gütlichen Einigung der Parteien die von den Parteien getroffene Regelung zur grundsätzlichen Kostenverteilung enthalten kann (vgl. z. B. Lokalkammer Düsseldorf, Entscheidung v. 06.08.2024, UPC_CFI_87/2024). Die Kostenentscheidung gem. Regel 265.2 (c) VerfO kann jedoch auch eine Entscheidung sein, in der die zu erstattenden Kosten der Höhe nach festgesetzt werden. womit im Übrigen implizit auch eine Aussage darüber getroffen wird, wer die Kosten dem Grunde nach zu tragen hat.
16. Der mittelbare Verweis in Regel 265.2 (c) VerfO auf Art. 69 EPGÜ bedeutet nicht nur, dass die in Absatz 1 verankerte Regel „wer verliert, zahlt“ im Rahmen der Kostenentscheidung Bedeutung gewinnt, sondern auch, dass ebenso die übrigen Absätze der Norm Geltung beanspruchen. Demzufolge ist grundsätzlich auch zu fragen, ob Art. 69 Abs. 3 EPGÜ zur Anwendung gelangt, wonach eine Partei, die dem Gericht oder einer anderen Partei unnötige Kosten verursacht hat, diese zu tragen hat.
17. Unnötige Kosten im Sinne von Art. 69 Abs. 3 EPGÜ sind solche, die durch eine Maßnahme ausgelöst werden, die für die Rechtsdurchsetzung oder Rechtsverteidigung nicht erforderlich und/oder ungeeignet war, und die als solche separiert werden kann. Nicht gemeint sind hingegen die wegen erfolgloser Rechtsdurchsetzung oder Verteidigung insgesamt (letztlich) unnötig verursachten Kosten. Diese werden bereits durch die Grundregel des Art. 69 Abs. 1 EPGÜ erfasst (vgl. für den Fall, dass ein Beklagter keinen Anlass zur Klageerhebung gegeben hat: Berufungsgericht, Anordnung v. 04.10.2024, UPC-CoA2/2024). Ob eine separierbare Maßnahme unnötig gewesen ist, ist aus ex-ante Sicht einer verständigen und wirtschaftlich vernünftig denkenden Partei zu beurteilen. Es ist ein objektiver Maßstab anzulegen.
18. Bei der Beurteilung, ob die Voraussetzungen des Art. 69 Abs. 3 EPGÜ gegeben sind, ist im Falle der Klagerücknahme ferner zu bedenken, dass das Gericht die Prüfung im Zeitpunkt seiner Entscheidung gem. Regel 265.2 (c) VerfO vorzunehmen hat. Da das Verfahren durch die Klagerücknahme beendet wird und es nicht zu einer Sachentscheidung kommt, welche letztlich erst Gewissheit über die Notwendigkeit einzelner Maßnahmen bringt, kann die Prüfung des Vorliegens der Voraussetzungen des Art. 69 Abs. 3 EPGÜ nur summarisch erfolgen. Und zwar grundsätzlich auf Basis der Tatsachen, die im Zeitpunkt der Zulassung der Klagerücknahme unstreitig gegeben sind. Es ist nicht Aufgabe der Kostenentscheidung gem. Regel 265.2 (c) VerfO (implizit) aufzuklären und festzustellen, wie die Sachentscheidung ausgefallen wäre, wenn das Verfahren weitergeführt worden wäre, um anhand dessen beispielsweise zu bestimmen, ob einzelne separierbare Maßnahme tatsächlich unnötig gewesen sind. Ebenso wenig ist prinzipiell in diesem Rahmen eine Beweisaufnahme zu streitigen Tatsachen durchzuführen. Derartiges würde offensichtlich den Sinn und Zweck der Zulassung der Klagerücknahme und die damit verbundenen Zeit- und Arbeitserleichterungen, auch für das Gericht, konterkarieren. Es stünde zudem im Widerspruch zu Art. 41 Abs. 3 S. 1 EPGÜ.
b)
19. Unnötige Kosten im Sinne des Art. 69 Abs. 3 EPGÜ sind vorliegend nicht ersichtlich. Separierbare Maßnahmen der Beklagten, die aus ex-ante Sicht einer verständigen und wirtschaftlich vernünftig denkenden Partei unnötig gewesen sind und deshalb unnötige Kosten ausgelöst haben, sind bei summarischer Prüfung zum jetzigen Zeitpunkt nicht erkennbar, selbst nicht bei Zugrundelegung des zum Teil bestrittenen Vortrages der Klägerin.
20. Dass ein Beklagter sich in der Klageerwiderung und/oder Duplik vermeintlich nicht ausreichend mit einem klägerischen Vorbringen zu einer angegriffenen Ausführungsform auseinandergesetzt hat, kann schon im Ansatz nicht als eine separierbare Maßnahme angesehen werden. Das Vorbringen einer Partei zu einer angegriffenen Ausführungsform, mag es ausreichend sein oder nicht, zum Zwecke der Rechtsverteidigung ist keine eigenständige Maßnahme. Es gehört zu der bzw. ist Rechtsverteidigung als solches.
21. Soweit die Klägerin mit ihrem Vorbringen zur angegriffenen Ausführungsform 2 zum Ausdruck bringt, die Beklagte habe diese von sich aus, unaufgefordert in den Rechtsstreit eingeführt, folgt auch daraus nicht die Verursachung unnötiger Kosten, selbst wenn die Einführung einer weiteren angegriffenen Ausführungsform in einen Rechtsstreit prinzipiell als eine separierbare Maßnahme angesehen werden könnte. Aus Sicht einer verständigen und wirtschaftlich denkenden Partei ist es jedoch nicht zu beanstanden, wenn eine Beklagte auf einen vermeintlichen Irrtum und/oder ein vermeintliches Fehlverständnis hinweist und/oder darauf aufmerksam macht, dass eine andere Ausführungsform als die bisher im Rechtsstreit befindliche diejenige ist, die sie anbietet und vertreibt. Es liegt vielmehr in einem solchen Fall im Rahmen einer ordnungsgemäßen Rechtsverteidigung, Fehlvorstellungen zu beheben und die eigenen Vorrichtungen bzw. das Produktportfolio offenzulegen. Zudem wird hierdurch Klarheit im Hinblick auf die Reichweite einer etwaigen Verurteilung geschaffen, wodurch etwaigen Problemen bei der Vollstreckung vorgebeugt werden kann und keine Verlagerung in das Vollstreckungsverfahren erfolgt. Auch dies ist als Teil einer ordnungsgemäßen Rechtsverteidigung nicht zu verwehren oder als unnötig anzusehen. Die Kosten, die infolge der Einführung der angegriffenen Ausführungsform 2, auf welche die Klägerin im Übrigen sodann die Klage erweitert hat, entstanden sein sollen, können mithin nicht als unnötig bezeichnet werden.
22. Auch das Vorbringen der Klägerin zur Erhebung der Nichtigkeitswiderklage verhilft ihr hier nicht zum Erfolg. Bei der Nichtigkeitswiderklage handelt es sich nicht um eine separierbare Maßnahme der Rechtsverteidigung im Rahmen des Verletzungsverfahrens, sondern um eine davon zu unterscheidende (eigenständige) Widerklage. Abgesehen davon kann entsprechend Art. 33 Abs. 8 EPGÜ vor dem EPG eine Nichtigkeitsklage bzw. eine Nichtigkeitswiderklage auch dann erhoben werden, wenn die Einspruchsfrist noch nicht abgelaufen ist oder beim EPA ein Einspruch oder ein Beschwerdeverfahren anhängig ist. Dies eröffnet die Möglichkeit paralleler Rechtsbestandsangriffsverfahren vor dem EPG und dem EPA. Eine Einschränkung derartiger paralleler Verfahren, die auf den Stand des anhängigen Verfahrens vor dem EPA rekurriert, findet sich im EPGÜ nicht. Die Abstimmung parallel anhängiger Verfahren bzw. das Verhältnis der Verfahren zueinander wird für das EPG allein durch Art. 33 Abs. 10 EPGÜ sowie Regel 295 (a) VerfO bestimmt.
23. Nach alledem verbleibt es bei der allgemeinen Regel des Art. 69 Abs. 1 EPGÜ, wonach die unterlegene Partei die Kosten des Verfahrens zu tragen hat. Dies ist vorliegend die Klägerin. Infolge der Rücknahme der Klage aufgrund des Widerrufs des Streitpatents hat sie das mit der Klage verfolgte Ziel nicht erreicht.
c)
24. Eine Kostenfestsetzung ist in dieser Entscheidung nicht vonnöten. Beide Parteien gehen davon aus, dass eine solche zu einem späteren Zeitpunkt in einem gesonderten Verfahren erfolgen wird bzw. erfolgen soll. Demzufolge hat auch keine Partei zur konkreten Höhe der zu erstattenden Kosten vorgetragen. Die Erstattung eines konkret bezifferten Betrages ist nicht beantragt.
25. Der Anregung der Klägerin, mit der Kostenentscheidung gem. Regel 265.2 (c) VerfO auch eine Entscheidung über die Obergrenze der Kosten zu treffen und hierbei den Gedanken der Regel 370.9 (b) (i) VerfO zu übertragen, wird nicht entsprochen. Die Obergrenze für erstattungsfähige Kosten kommt erst im Rahmen einer Kostenfestsetzung zum Tragen. Eine solche haben die Parteien derzeit jedoch gerade nicht beantragt.
26. Abgesehen davon wird über die Obergrenze für erstattungsfähige Kosten, die es nach den Regeln der Verfahrensordnung nur für die Erstattung der Vertretungskosten gibt, siehe Regel 152.2 VerfO, nicht vom Gericht in jedem Einzelfall entschieden. Der Verwaltungsausschuss hat vielmehr entsprechend Regel 152.2 VerfO mit Beschluss vom 24.04.2023 eine Tabelle der sich aus dem Streitwert des Verfahrens ergebenden Obergrenzen für erstattungsfähige Kosten aufgestellt. Ist der Streitwert eines Verfahrens festgesetzt, steht damit grundsätzlich auch die Obergrenze für erstattungsfähige Kosten der Vertretung fest. Es bedarf deshalb grundsätzlich keiner Entscheidung in jedem Einzelfall. Eine Anhebung oder Herabsetzung der jeweils geltenden Obergrenze im Einzelfall kann lediglich auf Antrag einer Partei gemäß Art. 2 des Beschlusses des Verwaltungsausschusses vom 24.04.2023 erfolgen. In Art. 2 des Beschlusses des Verwaltungsausschusses sind die Voraussetzungen, unter denen eine Anhebung oder Herabsetzung möglich ist, im Einzelnen aufgeführt. Raum für eine darüber hinaus gehende Herabsetzung bzw. eine Herabsetzung nach anderen Kriterien ist nicht gegeben. Der hinter Regel 370.9 (b) (i) VerfO stehende Gedanke hat demnach für die Obergrenze für erstattungsfähigen Kosten der Vertretung keine Relevanz.

27. An die Klägerin sind gem. Regel 370.9 (b) (i) VerfO 60 % der bezahlten Gerichtsgebühren der Klage zurückzuerstatten. Die Klage ist vor Abschluss des schriftlichen Verfahrens zurückgenommen worden.
28. Der Streitwert der Klage beträgt 500.000,00 €. Die Klägerin hat diesen Streitwert in der Klageschrift angegeben; die Beklagte hat der Angabe nicht widersprochen. Anhaltspunkte, die Zweifel an dem angegebenen Streitwert begründen könnten, sind nicht ersichtlich. Die Gerichtsgebühr beläuft sich demnach entsprechend Regel 370.2 (a) VerfO auf 11.000,00 €, so dass 6.600,00 € zurückzuerstatten sind.

29. Die Nichtigkeitswiderklage ist gem. Regel 360 VerfO gegenstandslos geworden und hat sich in der Hauptsache erledigt. Die Nichtigkeitswiderklage ist abzuweisen. Die Kosten des Nichtigkeitswiderklageverfahrens trägt die Klägerin. Der Beklagten sind in analoger Anwendung der Regel 370.9 (b) (i) VerfO 60 % der bezahlten Gerichtsgebühren der Widerklage zurückzuerstatten.

30. Stellt das Gericht fest, dass eine Klage gegenstandslos geworden und die Erledigung der Hauptsache eingetreten ist, kann es nach Regel 360 VerfO die Klage jederzeit auf Antrag einer Partei oder von Amts wegen per Anordnung abweisen.
a)
31. Vorliegend sind sich die Parteien zu Recht einig, dass die Nichtigkeitswiderklage infolge des Widerrufs des Streitpatents durch die Technische Beschwerdekammer des EPA am 04.07.2024 gegenstandslos geworden ist. Das Streitpatent ist vollständig rechtskräftig vernichtet. Der Zweck der Nichtigkeitswiderklage ist damit entfallen; es bedarf keiner Sachentscheidung mehr.
32. Da der nach Erhebung der Nichtigkeitswiderklage rechtskräftige Widerruf des Streitpatents jedenfalls zur Unbegründetheit der Nichtigkeitswiderklage führt, handelt es sich auch um ein erledigendes Ereignis der Hauptsache.
33. Ob das von der Klägerin vorsorglich, bereits in der Klagerücknahme erklärte Einverständnis für eine übereinstimmende Erledigungserklärung ausreicht, bedarf keiner weiteren Erläuterung. Eine übereinstimmende Erledigungserklärung wird von Regel 360 VerfO nicht verlangt. Es genügt der Antrag einer Partei. Ebenso möglich ist der Erlass einer Anordnung von Amts wegen.
b)
34. Das Gericht erachtet zwar ebenso wie der Spruchkörper 1 der Lokalkammer München (Anordnung v. 19.12.2023, UPC_CFI_249/2024) und die Zentralkammer Paris (Sitz) (Anordnung v. 16.05.2024, UPC_CFI_372/2023) den in der deutschen Sprachfassung gewählten Wortlaut der Regel 360 VerfO, wonach die Klage „abzuweisen“ ist, als unglücklich. Jedenfalls in einer Konstellation wie der vorliegenden erscheint es treffender, von einem Beenden oder Abschließen des Verfahrens zu sprechen. In Anlehnung an die Anordnung des Berufungsgerichts vom 04.10.2024 in dem Verfahren UPC_CoA_2/2024, App_83/2024 belässt das Gericht es jedoch bei dem von der Verfahrensordnung gewählten Wortlaut.
35. Die Nichtigkeitswiderklage wird deshalb abgewiesen.

36. Auch wenn Regel 360 VerfO, anders als beispielsweise Regel 265.2 (c) VerfO, nicht den Erlass einer Kostenentscheidung vorschreibt, so ist vorliegend jedenfalls aufgrund des Antrages der Beklagten gleichwohl eine solche zu treffen.
37. Für eine Kostenentscheidung bei Erledigung der Hauptsache gilt Ähnliches wie für die auf Regel 265.2 (c) VerfO gestützte Kostenentscheidung. Es kann sich um eine Kostengrundentscheidung oder, wenn bereits möglich, um eine Kostenfestsetzung handeln. Die Grundsätze des Art. 69 EPGÜ sind zu berücksichtigen (Berufungsgericht, Anordnung vom 04.10.2024, UPC_CoA_2/2024). Es ist zu fragen, welche Partei die obsiegende Partei im Sinne des Art. 69 Abs. 1 EPGÜ ist und ob gegebenenfalls ausnahmsweise aufgrund der Umstände des Einzelfalls eine Abweichung von der allgemeinen Regel wegen Vorliegens besonderer Umstände im Sinne des Art. 69 Abs. 1 bis 3 EPGÜ geboten ist. Bei dieser Prüfung ist im Blick zu halten, dass aufgrund der Beendigung des Verfahrens vor Erlass einer Sachentscheidung im Zeitpunkt der Erledigung der Hauptsache grundsätzlich nicht feststeht, ob und gegebenenfalls in welchem Umfang, die Klage erfolgreich gewesen wäre. Für die Kostenentscheidung nach Erledigung der Hauptsache gem. Regel 360 VerfO kann deshalb nur eine summarische Prüfung der Erfolgsaussichten der Klage zum Zeitpunkt des erledigenden Ereignisses erfolgen. Bei der Kostenentscheidung handelt es sich um eine Billigkeitsentscheidung. Zweifelsfragen bedürfen keiner abschließenden Aufklärung und/oder Entscheidung. Das Gericht kann über die Verpflichtung zur Tragung der Prozesskosten entscheiden, ohne den Sachverhalt weiter prüfen zu müssen (Berufungsgericht, Anordnung v. 04.10.2024, UPC_CoA_2/2024).
38. Ausgehend hiervon hat die Klägerin die Kosten der Nichtigkeitswiderklage zu tragen. Zwar wird die Nichtigkeitswiderklage mit der Terminologie der Regel 360 VerfO abgewiesen. Dies führt vorliegend indes nicht zu der Feststellung, dass die Beklagte als die unterlegene Partei im Sinne des Art. 69 Abs. 1 EPGÜ anzusehen ist. Die Klägerin hat nicht obsiegt. Der Erledigung des Verfahrens bzw. der Abweisung der Nichtigkeitswiderklage liegt der vollständige rechtskräftige Widerruf des Streitpatents seitens der Technischen Beschwerdekammer des EPA zugrunde. Das (Haupt-)Ziel der Nichtigkeitswiderklage der Beklagten, die Vernichtung des Streitpatents mit ex-tunc Wirkung, ist infolge dieses Widerrufs erreicht. Dass die Klägerin hilfsweise Anträge auf Änderung des Streitpatents gestellt hat, ändert daran nichts. Abgesehen davon ist bei summarischer Prüfung nicht hinreichend sicher, dass die Klägerin mit ihrem ersten Hilfsantrag, der nicht durch die Technische Beschwerdekammer des EPA geprüft worden ist, erfolgreich gewesen wäre. Die vermeintlich fehlende Notwendigkeit der Erhebung der Nichtigkeitswiderklage ist aus den bereits dargelegten Gründen ohne Relevanz.

39. Der Beklagten sind in analoger Anwendung der Regeln 370.9 (b) (i), (c) (i) VerfO 60 % der bezahlten Gerichtsgebühren der Nichtigkeitswiderklage zurückzuerstatten.
40. Nach Regel 370.9 (b) (i) VerfO kommt unter bestimmten Voraussetzungen im Falle der Klagerücknahme die Erstattung gezahlter Gerichtsgebühren in unterschiedlicher Höhe in Betracht. Regel 370 (c) (i) VerfO sieht dieselbe Regelung für die Beendigung des Verfahrens durch Vergleich vor. Für eine Beendigung des Verfahrens wegen Gegenstandslosigkeit und Erledigung der Hauptsache gem. Regel 360 VerfO fehlt hingegen eine derartige Regelung. Insoweit besteht eine planwidrige Regelungslücke. Da zudem die Interessenslage der geregelten Sachverhalte und des nicht geregelten Sachverhalts vergleichbar ist – wegen Beendigung des Verfahrens ist keine Sachentscheidung mehr erforderlich, was zur Arbeitsersparnis auf Seiten des Gerichts führt – ist eine analoge Anwendung der Regeln 370.9 (b) (i), (c) (i) VerfO vorliegend geboten (Zentralkammer Paris (Sitz), Anordnung v. 16.05.2024, UPC_CFI_372/2023; siehe auch zu einer weiteren Analogie Zentralkammer München (Abteilung), Anordnung v. 23.07.2024, UPC_CFI_75/2023 und UPC_CFI_80/2023).
41. Da sich die Nichtigkeitswiderklage vor Abschluss des schriftlichen Verfahrens erledigt hat, sind der Beklagten Gerichtsgebühren in Höhe von 60% zu erstatten.
42. Der Streitwert des Nichtigkeitswiderklageverfahrens beträgt 500.000 €. Die Beklagte hat diesen Wert vorgeschlagen, die Klägerin ist dem nicht entgegengetreten. Anhaltspunkte dafür, dass diese Streitwertangabe unzutreffend ist, sind nicht ersichtlich. Gemäß Regel 370.4 (b) VerfO beträgt die Gerichtsgebühr mithin 11.000,00 €, so dass 6.600,00 € zurückzuerstatten sind.

43. Die Anordnung bzw. Entscheidung ist gem. Regel 351.3 VerfO bzw. Regel 350.5 VerfO in das Register aufzunehmen.

ANORDNUNGEN
I.
1. Die Rücknahme der Klage wird zugelassen.
2. Das Verletzungsverfahren wird für beendet erklärt.
3. Diese Entscheidung soll in das Register aufgenommen werden.
4. Die Kosten des Verletzungsverfahrens trägt die Klägerin.
5. Der Kanzler wird angewiesen, der Klägerin 60 % der von ihr in diesem Gerichtsverfahren gezahlten Gerichtsgebühren und damit einen Betrag von 6.600,00 € zu erstatten.

BRIEF STATEMENT OF THE FACTS
The plaintiff is the proprietor of European patent EP 3 225 320 B1, which relates to a device and method for measuring the straightness of a rod-shaped workpiece (Annex CBH 4, hereinafter referred to as the contested patent). The defendant manufactures, offers and markets devices for measuring the straightness of rod-shaped products in Germany under the names ‘Straightness Control Type TQC’ (imputed form of realisation 1) and ‘Total Quality Control Type TQC 2.0’ (imputed form of realisation 2).

In the plaintiff's view, the contested embodiments implement the technical teaching of the contested patent, which is why it is claiming injunctive relief, disclosure of information, disclosure of documents, destruction, recall, payment of the costs of publishing the judgment and damages or a declaration of damages (ACT_569315/2024, UPC_CFI_300/2023). The defendant denies using the contested patent.

The defendant has filed a counterclaim for annulment of the contested patent (CC_597425/2023). The plaintiff has opposed the counterclaim for annulment and, in the alternative, has filed requests for amendment of the patent (App_11005/2024).

The Board of Appeal of the EPO revoked the contested patent in its entirety in oral proceedings on 4 July 2024 (T-0367/23-3.4.02).

As a result of the final revocation, the plaintiff considers that the action has become devoid of any basis and therefore feels compelled to withdraw the action pursuant to Rule 265.1 RoP (App_42913/2024). Since the written proceedings have not yet been concluded, it also requests reimbursement of 60% of the court fees pursuant to Rule 370.9(b)(i) RoP (App_42919/2024). In the event that the defendant does not withdraw the counterclaim for annulment, the plaintiff has, as a precautionary measure, declared its agreement to a settlement in accordance with Rule 360 RoP in its request to withdraw the action. The defendant has declared that it does not assert any legitimate interest within the meaning of Rule 265.1 sentence 3 RoP.

With regard to the counterclaim for annulment, the defendant seeks a declaration pursuant to Rule 360 VerfO that the counterclaim for annulment has become moot due to the revocation of the contested patent and that the proceedings have been settled (App_45647/2024). Since the written proceedings have not yet been concluded, the defendant further seeks reimbursement of 60% of the court fees for the counterclaim pursuant to Rule 370.9 (b) (i) VerfO and Rule 370.9 (c) (i) VerfO analogously (App_45658/2024).


Requests
The plaintiff requests
the withdrawal of the infringement action pursuant to Rule 265 RoP,
the reimbursement of court fees in the amount of 60% pursuant to Rule 370.9 (b) (i) RoP.
The defendant requests

a) that the counterclaim has become moot due to the revocation of European patent EP 3 225 320 and that the proceedings have been discontinued,
b) that the proceedings concerning the counterclaim be discontinued,

c) to refund 60% of the court fees for the counterclaim pursuant to Rule 370.9 (b) (i) RoP by analogy and Rule 370.9 (c) (i) RoP by analogy, and
d) to order the plaintiff and counter-defendant to bear the costs of the counterclaim proceedings.


FACTUAL AND LEGAL ISSUES
1. The plaintiff is of the opinion that the decision on costs to be made in accordance with Rule 265.2 (c) RoP must take into account Article 69 (3) UPCA, according to which unnecessary costs are to be borne by the party that caused them. This leads to an obligation on the defendant to bear the costs, as it did not act in a manner conducive to the proceedings and, in particular, caused considerable and unnecessary expense to both parties with its submissions in the statement of defence. After the plaintiff had specifically identified the contested embodiment 1 in the statement of claim, no substantive response was received from the defendant. It was only in the rejoinder that it was confirmed that the defendant itself assumed that the contested patent would be implemented. The defendant had distracted attention with its comments on the contested embodiment 2, which it had presented on its own initiative. In any case, the statement of defence did not provide sufficient clarification of the functioning of the contested embodiment 2. The defendant's submission on this point remained incomplete and fragmentary. In order for the plaintiff to deal with the case, it was therefore necessary to identify, evaluate and prepare a considerable amount of additional sources and to make detailed precautionary submissions on an embodiment that had not even been challenged. If the defendant had acted in a manner conducive to the proceedings, the majority of the statement of defence, the reply and the rejoinder would not have been necessary. As a precautionary measure, it is confirmed by a lawyer that this resulted in considerable and unnecessary additional work for the plaintiff. A statement of the specific costs incurred will be the subject of the costs assessment proceedings, in which the individual cost items will be substantiated in detail, should this be supported by a corresponding decision on the basis of costs.

2. The plaintiff also thinks that filing a counterclaim for annulment wasn't necessary given the pending appeal in the opposition proceedings before the EPO with an early date set for oral proceedings.

With regard to the counterclaim for revocation, the plaintiff is of the opinion that it should be dismissed without withdrawal of the action on the grounds of irrelevance and settlement in accordance with Rule 360 RoP. It is questionable whether the revocation of the contested patent is a settlement event for the counterclaim for revocation and, if so, whether it necessitates settlement. In this regard, it must be considered whether the settlement presupposes the prior admissibility and well-foundedness of the counterclaim for annulment. If this is assumed, it must be taken into account in the present case that the counterclaim for annulment is in any case partially unfounded and that the contested patent is in any case unfounded to the extent not examined by the Board of Appeal of the EPO in the first auxiliary request. However, examining these conditions would give rise to additional work which would ultimately be pointless in view of the revocation of the contested patent. According to Rule 360 RoP, however, it does not appear to be relevant whether the action was originally admissible and well-founded. It seems reasonable that, with the revocation of the contested patent, the action has become devoid of purpose and that the case has been disposed of in accordance with Rule 360 RoP. However, the consequence of dismissing the action provided for in Rule 360 RoP is unlikely to reflect the interests of the defendant.

The plaintiff also suggests that a decision on the upper limit for reimbursable costs should be made immediately with the decision on the withdrawal of the action and the decision on the counterclaim for annulment (in each case). Since the present proceedings came to an end at an early stage, at which essential and also time-consuming procedural steps had not yet taken place, it is appropriate to adjust the upper limit for the reimbursable costs accordingly and thus to set it only proportionally and at a significantly lower level. Rule 370.9 (b) RoP can be seen as a guide. Applying this reasoning to the determination of the parties' recoverable costs in accordance with the information provided by the Administrative Committee, an upper limit of 40% of the value in the table should be set, based on the respective amounts in dispute of €500,000.00, i.e. €22,400.00 in each case. However, a maximum limit of 50% of the table value would still be reasonable.

The defendant is of the opinion that the decision on costs pursuant to Rule 265.2 (c) RoP is not a basic decision on costs, but rather a subsequent decision on the reimbursable costs pursuant to R. 150 et seq. RoP. The fact that the plaintiff must bear the costs in the event of withdrawal of the action is clearly assumed by the Rules of Procedure. The plaintiff's assertion that the defendant did not act in a manner conducive to the proceedings and thus caused considerable and unnecessary expense for both parties must be rejected. In fact, the plaintiff's assertions in the statement of claim regarding the device that was explained and offered to a witness at the defendant's premises were incorrect. Apparently, the plaintiff had been misinformed by the witness in this regard. In any case, the plaintiff no longer disputes that the contested embodiment 2 (and not the contested embodiment 1) was explained and offered to the witness. Rather, it expressly expanded the action in its reply for this reason. Its submission on the contested embodiment 2 was detailed. The plaintiff failed to indicate in what the alleged unnecessary additional expense caused by the defendant was supposed to consist.

6. According to the defendant, at the time the counterclaim for annulment was filed, no date had yet been set for the oral proceedings in the appeal proceedings before the EPO. Both the recitals of the UPCA and the preamble to the Rules of Procedure emphasise that the EPG should be able to ensure swift decisions. Against this background, it was appropriate to ensure, by bringing the counterclaim for annulment, that the arguments against the protectability of the contested patent, which had since been revoked, could be taken into account before a decision was taken on its alleged infringement. The counterclaim for annulment would also have been successful in its entirety. The plaintiff's alternative claims were partly inadmissible and otherwise unfounded.
7. With regard to the counterclaim for annulment, the defendant argues that this has become moot due to the revocation of the contested patent and that the main issue has been settled. Rule 360 RoP applies. The proceedings should therefore be ‘discontinued’. There is no longer any room for discussion as to whether the admissibility and merits of the counterclaim are a prerequisite for discontinuance, since the plaintiff had already declared its agreement to discontinuance (as a precautionary measure) in its application for withdrawal of the action and the defendant had then applied for a declaration that the counterclaim had been discontinued. It refrained from withdrawing its action, as this would place it in the position of the losing party. This was appropriate in view of the revocation of the disputed patent and was by no means a futile effort.

8. The defendant also thinks it should get back some of the court fees for the counterclaim for annulment. There are no rules on reimbursement if the counterclaim is settled because the patent in dispute is completely and legally revoked. But rules 370.9 b) (i) and c) (i) RoP apply in the same way.

9. Since the appropriateness of the costs for which reimbursement is sought is reviewed by the court in the proceedings for the determination of costs, the defendant considers that there is no need to reduce the upper limit of the reimbursable costs in the decision on the basis of costs.

REASONS FOR THE DECISION
I.

10. The withdrawal of the action is to be allowed pursuant to Rule 265.1 RoP. The plaintiff filed the request to withdraw the action before a final decision was issued. In its statement on this request, the defendant stated that it had no legitimate interests within the meaning of Rule 265.1 RoP. No such legitimate interests are otherwise apparent.

11. Pursuant to Rule 265.2 (a) and (b) RoP, the consequence of allowing the withdrawal of the action is that the proceedings are terminated and the decision is entered in the register.

12. Pursuant to Rule 265.2 (c) RoP, the court must also decide on the costs in accordance with Part 1, Chapter 5 when allowing the withdrawal of the action.

a)
13. Although the provision, in view of its wording, explicitly refers only to the rules on the determination of costs, i.e. Rules 150 et seq. RoP, the court must (also) make a decision on the basis of the costs in accordance with Article 69 UPCA even in the event of withdrawal of an action.

14. This is because there is an indirect reference to this provision. The rules of the costs assessment procedure expressly referred to in Rule 265.2(c) RoP cannot be considered in isolation from Article 69 UPCA. Rather, they are based on this higher-ranking provision, which contains the basic principles for the allocation of the costs of the proceedings. This is also clear from the fact that Rules 150 et seq. RoP take up the terms used in Article 69 UPCA, such as prevailing party, appropriateness and reasonableness, and that the determination of costs is based on the provisions of Article 69 UPCA. The determination of costs specifies in each individual case the amount of costs to be reimbursed or borne by the party which, according to Article 69 UPCA, bears the costs on the merits.
15. Due to the inseparable connection between Article 69 UPCA and Rules 150 et seq. RoP, the decision on costs pursuant to Rule 265.2 (c) RoP may also (only) be a basic decision on costs (see, for example, Local Division Düsseldorf, decision of 6 August 2024, UPC_CFI_87/2024; Local Division The Hague, decision of 01.05.2024, UPC_CFI_379/2023), which, if necessary, may contain the arrangement made by the parties on the basic allocation of costs in the event of a withdrawal of the action due to an amicable settlement between the parties (see, for example, Local Division Düsseldorf, decision of 06.08.2024, UPC_CFI_87/2024). However, the decision on costs pursuant to Rule 265.2 (c) RoP may also be a decision in which the amount of the costs to be reimbursed is determined. This also implicitly includes a statement as to who is to bear the costs on the merits.

16. The indirect reference in Rule 265.2 (c) RoP to Article 69 UPCA means not only that the ‘loser pays’ rule laid down in paragraph 1 becomes relevant in the context of the decision on costs, but also that the other paragraphs of the provision apply. Consequently, it must also be asked whether Article 69(3) UPCA applies, according to which a party that has caused unnecessary costs to the court or to another party must bear those costs.

17. Unnecessary costs within the meaning of Article 69(3) UPCA are those costs that are caused by a measure that was not necessary and/or inappropriate for the enforcement or defence of rights and that can be separated as such. This does not include costs that are (ultimately) unnecessary as a result of unsuccessful enforcement or defence of rights. These are already covered by the basic rule in Article 69(1) UPCA (see, in the event that a defendant has not given cause for bringing proceedings: Court of Appeal, order of 4 October 2024, UPC-CoA2/2024). Whether a separable measure was unnecessary must be assessed from an ex ante perspective of a reasonable and economically rational party. An objective standard must be applied.

18. When assessing whether the requirements of Article 69(3) UPCA are met in the event of withdrawal of the action, it must also be borne in mind that the court must carry out the examination at the time of its decision in accordance with Rule 265.2(c) RoP. Since the proceedings are terminated by the withdrawal of the action and no decision on the merits is made, which ultimately provides certainty as to the necessity of individual measures, the examination of whether the conditions of Article 69(3) UPCA are met can only be carried out summarily. This must be done on the basis of the facts that are undisputed at the time the withdrawal of the action is admitted. It is not the task of the decision on costs pursuant to Rule 265.2 (c) RoP (implicitly) to clarify and determine what the decision on the merits would have been if the proceedings had been continued in order to determine, for example, whether individual separable measures were in fact unnecessary. Nor is it necessary in principle to take evidence on disputed facts in this context. This would obviously defeat the purpose of allowing the withdrawal of the action and the associated savings in time and work, including for the court. It would also be contrary to Article 41(3) sentence 1 UPCA.
b)

19. Unnecessary costs within the meaning of Article 69(3) UPCA are not apparent in the present case. Upon summary examination, no separable measures taken by the defendant which, from an ex ante perspective, were unnecessary for a reasonable and economically rational party and therefore incurred unnecessary costs are apparent at this stage, even on the basis of the plaintiff's partially contested submissions.

20. The fact that a defendant has allegedly not sufficiently addressed a plaintiff's submission regarding an contested embodiment in its statement of defence and/or rejoinder cannot, in principle, be regarded as a separable measure. A party's submission on an contested form of embodiment, whether sufficient or not, is not an independent measure for the purpose of legal defence. It is part of or constitutes legal defence as such.

21. Insofar as the plaintiff expresses in its submission on the contested embodiment 2 that the defendant introduced it into the legal dispute on its own initiative and without being asked to do so, this does not give rise to unnecessary costs, even if the introduction of a further contested embodiment into a legal dispute could in principle be regarded as a separable measure. From the perspective of a reasonable and economically minded party, however, it is not objectionable for a defendant to point out an alleged error and/or misunderstanding and/or to draw attention to the fact that a different embodiment than the one previously at issue in the legal dispute is the one it offers and distributes. In such a case, it is rather part of a proper legal defence to correct misconceptions and disclose one's own devices or product portfolio. This also clarifies the scope of any possible judgment, thereby preventing any problems with enforcement and avoiding a shift to enforcement proceedings. This too cannot be denied as part of a proper legal defence or regarded as unnecessary. The costs allegedly incurred as a result of the introduction of the contested embodiment 2, to which the plaintiff then extended the action, cannot therefore be described as unnecessary.

22. Nor does the plaintiff's submission regarding the filing of a counterclaim for annulment help it to succeed in this case. The counterclaim for annulment is not a separable measure of legal defence in the infringement proceedings, but a (separate) counterclaim that must be distinguished from the latter. Apart from that, pursuant to Article 33(8) UPCA, an action for a declaration of invalidity or a counterclaim for a declaration of invalidity may also be brought before the EPG if the opposition period has not yet expired or if opposition or appeal proceedings are pending before the EPO. This opens up the possibility of parallel proceedings challenging the legal status before the EPG and the EPO. The UPCA does not contain any restriction on such parallel proceedings that refers to the status of the proceedings pending before the EPO. The coordination of parallel proceedings or the relationship between the proceedings is determined for the EPG solely by Article 33(10) UPCA and Rule 295(a) RoP.

23. In view of the foregoing, the general rule of Article 69(1) UPCA, according to which the unsuccessful party is to bear the costs of the proceedings, remains applicable. In the present case, this is the applicant. As a result of the withdrawal of the action due to the revocation of the contested patent, it has not achieved the objective pursued by the action.
c)

24. It is not necessary to make a decision on costs in this decision. Both parties assume that this will or should be done at a later date in separate proceedings. Accordingly, neither party has submitted any arguments on the specific amount of the costs to be reimbursed. No reimbursement of a specific amount has been requested.

25. The plaintiff's suggestion that the decision on costs pursuant to Rule 265.2(c) RoP should also include a decision on the upper limit of the costs, applying the principle of Rule 370.9(b)(i) RoP, is not accepted. The upper limit for reimbursable costs only comes into play in the context of a decision on costs. However, the parties have not requested this at present.
26. Apart from that, the court does not decide in each individual case on the upper limit for reimbursable costs, which, according to the Rules of Procedure, only exist for the reimbursement of representation costs, see Rule 152.2 RoP. Instead, in accordance with Rule 152.2 RoP, the Administrative Committee established a table of upper limits for reimbursable costs based on the value of the proceedings in its decision of 24 April 2023. Once the value of the proceedings has been determined, the upper limit for reimbursable costs of representation is also determined. Therefore, no decision is required in each individual case. An increase or reduction of the applicable upper limit in individual cases may only be made at the request of one of the parties in accordance with Article 2 of the Administrative Committee's decision of 24 April 2023. Article 2 of the Administrative Committee's decision lists in detail the conditions under which an increase or reduction is possible. There is no scope for a further reduction or a reduction based on other criteria. The idea behind Rule 370.9 (b) (i) RoP is therefore irrelevant to the upper limit for reimbursable costs of representation.

27. Pursuant to Rule 370.9 (b) (i) RoP, 60% of the court fees paid by the plaintiff are to be reimbursed. The action was withdrawn before the conclusion of the written procedure.

28. The value in dispute is €500,000.00. The plaintiff stated this amount in the statement of claim; the defendant did not object to this statement. There are no indications that could give rise to doubts as to the stated value in dispute. The court fees therefore amount to €11,000.00 in accordance with Rule 370.2 (a) RoP, so that €6,600.00 is to be reimbursed.
II.
29. The counterclaim for annulment has become moot pursuant to Rule 360 RoP and has been settled in the main proceedings. The counterclaim for annulment is dismissed. The costs of the counterclaim for annulment are borne by the plaintiff. In analogous application of Rule 370.9 (b) (i) RoP, 60% of the court fees paid for the counterclaim are to be reimbursed to the defendant.

30. If the court finds that an action has become devoid of purpose and that the main proceedings have been concluded, it may, pursuant to Rule 360 RoP, dismiss the action at any time at the request of a party or of its own motion by order.
a)

31. In the present case, the parties rightly agree that the counterclaim for annulment has become moot as a result of the revocation of the contested patent by the Technical Board of Appeal of the EPO on 4 July 2024. The contested patent has been completely annulled with legal effect. The purpose of the counterclaim for annulment has thus ceased to exist; no decision on the merits is required.

32. Since the revocation of the contested patent, which became final after the counterclaim for annulment was filed, in any case renders the counterclaim for annulment unfounded, this also constitutes a dispositive event in the main proceedings.

33. Whether the consent to a mutual declaration of discontinuance, which the plaintiff declared as a precautionary measure when withdrawing the action, is sufficient does not require further explanation. A mutual declaration of discontinuance is not required by Rule 360 RoP. A request by one party is sufficient. It is also possible to issue an order ex officio.
b)

34. The Court agrees with Panel 1 of the Munich Local Division (order of 19 December 2023, UPC_CFI_249/2024) and the Central Division in Paris (seat) (order of 16 May 2024, UPC_CFI_372/2023) that the wording of Rule 360 VerfO chosen in the German language version of Rule 360 RoP, according to which the action is to be ‘dismissed’, as unfortunate. In any event, in a situation such as the present one, it seems more appropriate to speak of terminating or closing the proceedings. However, following the order of the Court of Appeal of 4 October 2024 in case UPC_CoA_2/2024, App_83/2024, the Court leaves the wording chosen by the Rules of Procedure unchanged.
35. The counterclaim for annulment is therefore dismissed.

36. Even if Rule 360 RoP, unlike Rule 265.2(c) RoP, for example, does not require a decision on costs to be made, such a decision must nevertheless be made in the present case on the basis of the defendant's request.

37. The same applies to a decision on costs when the main proceedings are concluded as to the decision on costs based on Rule 265.2 (c) RoP. This may be a decision on the basis of which costs are to be borne or, if already possible, a decision on the amount of costs. The principles of Article 69 UPCA must be taken into account (Appeal Court, order of 4 October 2024, UPC_CoA_2/2024). It must be determined which party is the prevailing party within the meaning of Article 69(1) UPCA and whether, in exceptional cases, the circumstances of the individual case require a departure from the general rule due to the existence of special circumstances within the meaning of Article 69(1) to (3) UPCA. In this examination, it must be borne in mind that, due to the termination of the proceedings before a decision on the merits was issued at the time the main proceedings were discontinued, it is not clear whether and, if so, to what extent the action would have been successful. For the decision on costs after the main proceedings have been concluded in accordance with Rule 360 RoP, therefore, only a summary examination of the prospects of success of the action at the time of the event concluding the proceedings can be carried out. The decision on costs is a decision based on equity. Questions of doubt do not require final clarification and/or decision. The court may decide on the obligation to bear the costs of the proceedings without having to examine the facts further (Court of Appeal, order of 4 October 2024, UPC_CoA_2/2024).

38. On this basis, the plaintiff must bear the costs of the counterclaim for annulment. The counterclaim for annulment is dismissed using the terminology of Rule 360 RoP. However, this does not lead to the conclusion that the defendant is to be regarded as the unsuccessful party within the meaning of Article 69(1) UPCA. The plaintiff has not prevailed. The dismissal of the proceedings and the counterclaim for annulment are based on the complete and final revocation of the contested patent by the Technical Board of Appeal of the EPO. The (main) objective of the defendant's counterclaim for annulment, namely the revocation of the contested patent with ex tunc effect, has been achieved as a result of this revocation. The fact that the plaintiff has filed auxiliary requests for amendment of the contested patent does not alter this. Apart from that, it is not sufficiently certain on summary examination that the plaintiff would have been successful with its first auxiliary request, which has not been examined by the Technical Board of Appeal of the EPO. The alleged lack of necessity to bring the counterclaim for revocation is irrelevant for the reasons already stated.

39. In analogous application of Rules 370(9)(b)(i) and (c)(i) RoP, 60% of the court fees paid for the counterclaim for revocation are to be reimbursed to the defendant.

40. According to Rule 370.9 (b) (i) VerfO, under certain conditions, the reimbursement of court fees paid may be considered in varying amounts in the event of withdrawal of the action. Rule 370 (c) (i) VerfO provides for the same rule for the termination of proceedings by settlement. However, there is no such provision for termination of proceedings due to lack of subject matter and settlement of the main issue pursuant to Rule 360 RoP. In this respect, there is an unintended loophole in the rules. Since, moreover, the interests involved in the regulated and unregulated cases are comparable – due to the termination of the proceedings, no decision on the merits is required, which saves work on the part of the court – an analogous application of Rules 370.9 (b) (i), (c) (i) RoP is required in the present case (Central Chamber Paris (seat), order of 16 May 2024, UPC_CFI_372/2023; see also, for a further analogy, Munich Central Chamber (Division), order of 23 July 2024, UPC_CFI_75/2023 and UPC_CFI_80/2023).

41. Since the counterclaim for annulment was settled before the conclusion of the written proceedings, the defendant is to be reimbursed 60% of the court fees.
42. The value in dispute in the counterclaim for annulment proceedings is €500,000. The defendant proposed this value, which the plaintiff did not contest. There are no indications that this statement of the value in dispute is incorrect. Pursuant to Rule 370.4 (b) RoP, the court fees therefore amount to €11,000.00, of which €6,600.00 is to be reimbursed.

43. The order or decision shall be entered in the register in accordance with Rule 351.3 RoP and Rule 350.5 RoP.

ORDERS
I.
1. The withdrawal of the action is permitted.
2. The infringement proceedings are declared terminated.
3. This decision shall be entered in the register.

4. The costs of the infringement proceedings shall be borne by the plaintiff.
5. The Registrar is instructed to reimburse the plaintiff 60% of the court fees paid by it in these proceedings, amounting to €6,600.00.
6. The value in dispute in the infringement proceedings is set at €500,000.00.

II.
1. It is hereby determined that the counterclaim for annulment is unfounded and that the main proceedings are dismissed.
2. The counterclaim for annulment is dismissed.
3. This decision shall be entered in the register.
4. The costs of the counterclaim for annulment shall be borne by the claimant.

5. The Registrar is instructed to reimburse the defendant 60% of the court fees paid by it in these proceedings, amounting to €6,600.00.
6. The value in dispute in the counterclaim for annulment is set at €500,000.00.
