ORDONNANCE

FAITS et PROCEDURE

HEWLETT-PACKARD DEVELOPPEMNT COMPANY, L.P (dite « HP » ci-après) a initié à l’encontre de
LAMA FRANCE (dite « LAMA » ci-après) une action en contrefaçon devant la présente Division en
date du 11 octobre 2023 sur le fondement des brevets EP2089230 et EP1737669.

LAMA a soumis un mémoire en défense et une demande reconventionnelle en annulation des brevets en cause.
HP a ensuite fait une demande en modification desdits brevets.

Il reste un dernier mémoire en réplique conformément à R. 32.3 RdP, attendu de la part de LAMA pour le 16 août 2024.

C’est à ce stade de la procédure écrite devant la présente division que HP a soumis au juge-rap-porteur
une requête en communication d’informations datée du 15 juillet 2024 sur le fondement de R.191 RdP, en demandant à la JUB d’ordonner à LAMA sous astreinte de 10 000 euros par jour de retard à compter de la signification de l’ordonnance de communication d’informations :

- A titre principal, de communiquer l’identité de tout tiers ou partenaires de LAMA FRANCE ou de ses filiales, intervenant dans la production et la distribution des produits litigieux (article 67.1.a) et c) AJUB), les factures correspondantes, même caviardées, afin de confirmer l’identité des tiers désignés ;

- A titre subsidiaire, si le droit français devait s’appliquer, de communiquer l’identité de tout tiers ou partenaires de LAMA FRANCE ou de ses filiales, en dehors de France, intervenant dans la production
et la distribution des produits litigieux (article 67.1.a) et c) AJUB), les factures correspon-dantes, même caviardées, afin de confirmer l’identité des tiers désignés ;

- A très subsidiaire, si le régime de responsabilité français devait s’appliquer pour des actes de contrefaçon définis selon l’AJUB, de communiquer l’identité de tout tiers ou partenaires de LAMA FRANCE ou de ses filiales, en dehors des pays Allemagne, Autriche, Belgique, Danemark, France, Italie, Pays-Bas, Portugal et Suède, intervenant dans la production et la distribution des produits litigieux (article 67.1.a) et c) AJUB), les factures correspondantes, même caviardées, afin de confirmer l’identité des tiers désignés.

HP précise qu’elle consent à ce que les informations confidentielles des factures puissent être caviardées ou qu’elle ne s’opposera pas à ce que des mesures de confidentialité selon la règle 262A du RdP soient adoptées.

Suite à une ordonnance préliminaire du juge rapporteur du 25 juillet 2024, LAMA a soumis ses observations écrites en réponse le 31 juillet 2024 en s’opposant à la requête la disant inadmissible car la contrefaçon n’a pas encore été établie à son encontre, tardive et non justifiée au vu des faits du dossier. A titre subsidiaire, LAMA propose de limiter la communication d’informations à certaines factures tel que qu’exposé en page 14 de ses observations écrites, sous confidentialité tel que prévu par R.262 A RdP, et sans astreinte.

MOTIFS

Le cadre légal

-Règle 191 RdP -Demande d’ordonnance de communication d’informations :
« La Juridiction peut, sur demande motivée d’une partie, ordonner à l’autre partie ou à tout tiers de communiquer des informations sous le contrôle de cette autre partie ou de ce tiers, tel que précisé à l’article 67 de l’Accord, ou d’autres informations raisonnablement nécessaires au soutien des prétentions de cette partie. La règle 190, § 1 deuxième phrase, § 5 et 6 s’applique mutatis mutandis. »

-Article 67 AJUB - Pouvoir d'ordonner la communication d'informations :
« 1. La Juridiction peut, en réponse à une demande justifiée et proportionnée du requérant et conformément au règlement de procédure, ordonner à un contrefacteur d'informer le requérant
en ce qui concerne :
a) l'origine et les canaux de distribution des produits ou procédés litigieux;»

Sur l’admissibilité de la demande

Contrairement à ce que prétend LAMA, la demande en communication d'informations sur le fon-dement
de R.191 RdP est admissible en cours de procédure, avant même que l'existence d'une infraction est établie, si cela est nécessaire pour l'instruction de l'affaire à ce stade de la procédure.

La Cour rappelle que la Division locale de la JUB de Düsseldorf l’a déjà admis en ces termes : "En principe, la règle 191 du RdP concerne l'information en cours de procédure afin d'obliger les parties à fournir des informations concernant les conclusions à présenter (voir Tilmann/Plassmann/ Ahrens, Règle 191 para. Ahrens, Règle 191 para. 1 – en référence à la procédure de « discovery »). Toutefois, le libellé de la deuxième phrase n'empêche pas d'ordonner la communication des informations susmentionnées dans la décision finale." (UPC_CFI_7/2023 (LD Düsseldorf), décision du juillet 2024).

En outre, cette même position a été adoptée par la présente Division locale dans son ordonnance rendue le 31 juillet dernier (UPC_CFI_ 425/2023, LD Paris). La Cour considère en effet que la règle 191 du RdP peut être invoquée à différents stades de la procédure, afin d'enjoindre les parties à communiquer des informations au cours du traitement de l’affaire ou au stade de la décision finale. En outre, la Cour note qu'il est approprié d'appliquer le même raisonnement en ce qui concerne le droit à l'information prévu par la directive 2004/48/CE relative à l’exécution au sein de l’UE (Art. 8) qui permet de présenter une telle demande à tout stade de la procédure.

Pour ces raisons, la demande de HP est recevable.

Sur la "demande motivée"

La question est de savoir si les informations dont la communication est demandée par le requérant
sont raisonnablement nécessaires à la défense des intérêts de cette partie, conformément à l'Art. 67(1) AJUB et à la règle 191 du RdP.

Dans sa requête, LAMA demande à titre principal de communiquer : « l’identité de tout tiers ou partenaires de LAMA FRANCE ou de ses filiales, intervenant dans la production et la distribution des produits litigieux (Article 67.1.(a) et (c) AJUB), les factures correspondantes, même caviardées, afin de confirmer l’identité des tiers désignés. »

LAMA soutient que la demande de HP de communiquer ces informations renverse la charge de la preuve.

La Cour rappelle qu'une demande d'information au titre de R. 191 du RdP doit être suffisamment justifiée et proportionnée pour être accueillie.

En l'espèce, HP souhaite, dans le cadre de son action en contrefaçon initiée à l’encontre de LAMA, démontrer que ce dernier est responsable d’actes de contrefaçon de ses deux brevets. La question se pose donc de savoir si LAMA est fabricant, importateur, et/ou offre, met sur le marché les produits allégués de contrefaçon conformément à l’article 25 AJUB.

La demande de HP en elle-même est donc motivée. Il convient toutefois en outre d’examiner si cette demande est suffisamment justifiée et proportionnée pour être accueillie.

En l’espèce, LAMA conteste être fabricant et importateur des produits qu’elle offre à destination de professionnels.

Concernant la fabrication, à ce stade de la procédure, le seul élément qui permettrait de dire que LAMA aurait un rôle dans la fabrication des produits allégués de contrefaçon serait ses propres mentions sur son site internet dans la capture d’écran produite dans le procès-verbal de constat établi à la demande de HP (pièce 49 HP) : « Lama France fait remanufacturer des cartouches jet d'encre et laser depuis 1996 pour différentes marques. »

Cependant, l’attestation de l’expert-comptable indique clairement que LAMA a seulement une activité de négoce, et qu’elle n’a pas de « production propre ». (pièce 49 LAMA)

En outre, LAMA a apporté des éléments de clarification sur le rôle de ses deux filiales dans sa ré-ponse
écrite du 31 juillet 2024 en produisant les extraits de Kbis de chacune.

Concernant l’importation, il existe des éléments dans le dossier tendant à indiquer que des pro-duits
proposés par LAMA et allégués de contrefaçon par HP seraient l’objet d’importation parallèle sur le marché de l’UE, venant d’Asie ou d’Amérique du sud. Aussi, la Cour considère à ce stade de la procédure comme nécessaire et proportionné de faire droit à la demande de communication en des termes plus limités que ceux demandés par HP et plus conformes à la réponse subsidiaire faite par LAMA dans ses observations du 31 juillet 2024 (page 14), soit la communication des :

-Factures relatives aux cartouches alléguées de contrefaçon, objet du litige, et qui ont été importées
par LAMA FRANCE hors territoire de l’Union européenne, en laissant apparaître la mention du pays d’importation hors territoire de l’Union européen et en caviardant les données relatives à l’identification des fournisseurs (tels que notamment le nom commercial, l’adresse du siège so-cial, les numéros d’identification de la société, le nom du représentant légal de la société).

HP ayant d’ores et déjà indiqué ne pas s’opposer sur le principe à des mesures de confidentialité relatives aux informations concernées, la communication de ces factures sera soumise à des mesures de confidentialité prévues à R. 262A du RdP, en limitant l’accès des informations à :
- une personne physique pour la société LAMA,
- une personne physique pour la société HP,
- les représentants des parties à la présente procédure devant la JUB.

Cette injonction à communiquer ne sera pas assortie d’astreinte, à ce stade.

Pour ne pas affecter le calendrier de la procédure écrite, le délai pour communiquer ces éléments sera de 14 jours à compter de la notification de la présente ordonnance du 2 août 2024. L’information doit être produite au 16 août 2024 (date à laquelle LAMA doit soumettre son dernier jeu d’écritures concernant la demande de HP pour la modification de ses brevets en cause selon R.32.3 RdP), et des observations écrites de HP sont attendues seulement sur ce point au plus tard au 29 août 2024.

Le Juge rapporteur informe les parties que la procédure écrite sera clôturée le 30 août 2024 con-formément
à R.35 RdP.

La conférence de mise en état est maintenue au 6 septembre 2024.

PAR CES MOTIFS
Le Juge rapporteur ordonne à LAMA France de communiquer au 16 août 2024 les éléments d’ information suivantes :
-Factures relatives aux cartouches alléguées de contrefaçon, objet du litige, et qui ont été impor-tées par LAMA FRANCE hors territoire de l’Union européenne, en laissant apparaître la mention du pays d’importation hors territoire de l’Union européen et en caviardant les données relatives à l’identification des fournisseurs (tels que notamment le nom commercial, l’adresse du siège social, les numéros d’identification de la société, le nom du représentant légal de la société) ;
-La communication de ces factures est soumise à des mesures de confidentialité prévues par R. 262A du RdP, en limitant l’accès des informations à :
- une personne physique pour la société LAMA FRANCE, dont le nom et la fonction devront être communiqués par cette dernière avant le 16 août 2024,
- une personne physique pour la société HEWLETT-PACKARD DEVELOPPEMNT COMPANY, dont le nom et la fonction devront être communiqués par cette dernière avant le 16 août 2024,
- les représentants des parties à la présente procédure.
-Dit que des observations écrites de HEWLETT-PACKARD DEVELOPPEMNT COMPANY sont atten-dues
seulement sur ce point au plus tard au 29 août 2024 ;
- Informe les parties que la procédure écrite sera clôturée le 30 août 2024 conformément à R.35 RdP ;
- la conférence de mise en état est maintenue au 6 septembre 2024 ;
- la présente ordonnance est susceptible de révision sur demande d’une partie dans les conditions prévues par R. 333 RdP.

ORDER

FACTS AND PROCEEDINGS

HEWLETT-PACKARD DEVELOPMENT COMPANY, L.P (hereinafter referred to as ‘HP’) brought an infringement action against
LAMA FRANCE (hereinafter referred to as ‘LAMA’) before this Division on

on 11 October 2023 on the basis of patents EP2089230 and EP1737669.

LAMA submitted a statement of defence and a counterclaim for annulment of the patents in question.
HP then filed an application for amendment of the said patents.


A final reply is still pending from LAMA in accordance with R. 32.3 RdP, which is expected by 16 August 2024.

It is at this stage of the written proceedings before this Division that HP submitted to the judge-rapporteur
a request for disclosure of information dated 15 July 2024 on the basis of R.191 RdP, asking the JUB to order LAMA, subject to a penalty of €10,000 per day of delay from the date of service of the order for disclosure of information:


- Primarily, to disclose the identity of any third parties or partners of LAMA FRANCE or its subsidiaries involved in the production and distribution of the disputed products (Article 67.1.a) and c) AJUB), together with the corresponding invoices, even if redacted, in order to confirm the identity of the third parties designated;


- In the alternative, if French law were to apply, to disclose the identity of any third parties or partners of LAMA FRANCE or its subsidiaries outside France involved in the production

and distribution of the disputed products (Article 67.1.a) and c) AJUB), the corresponding invoices, even if redacted, in order to confirm the identity of the third parties designated;

- In the alternative, if the French liability regime were to apply to acts of infringement defined under the AJUB, to disclose theidentity of any third parties or partners of LAMA FRANCE or its subsidiaries, outside Germany, Austria, Belgium, Denmark, France, Italy, the Netherlands, Portugal and Sweden, involved in the production and distribution of the disputed products (Article 67.1.a) and c) AJUB), the corresponding invoices, even if redacted, in order to confirm the identity of the third parties designated.

HP specifies that it consents to the redaction of confidential information on the invoices or that it will not object to the adoption of confidentiality measures in accordance with Rule 262A of the RdP.


Following a preliminary order by the reporting judge on 25 July 2024, LAMA submitted its written observations in response on 31 July 2024, opposing the request on the grounds that it was inadmissible because the infringement had not yet been established against it, was late and was unjustified in view of the facts of the case. In the alternative, LAMA proposes to limit the disclosure of information to certain invoices as set out on page 14 of its written observations, subject to confidentiality as provided for in R.262 A RdP, and without penalty.

GROUNDS


The legal framework

-Rule 191 of the Rules of Procedure -Request for an order to disclose information:

"The Court may, on the reasoned request of a party, order the other party or any third party to disclose information under the control of that other party or third party, as specified in Article 67 of the Agreement, or other information reasonably necessary to support that party's claims. Rule 190, § 1, second sentence, § 5 and 6 shall apply mutatis mutandis."

-Article 67 AJUB - Power to order disclosure of information:

‘1. The Court may, in response to a justified and proportionate request by the claimant and in accordance with the Rules of Procedure, order an infringer to inform the claimant
with regard to:
(a) the origin and distribution channels of the infringing products or processes;’

On the admissibility of the request

Contrary to LAMA's claim, the request for disclosure of information on the basis of
R.191 RdP is admissible during the proceedings, even before the existence of an infringement has been established, if this is necessary for the investigation of the case at that stage of the proceedings.


The Court recalls that the Local Division of the JUB in Düsseldorf has already admitted this in the following terms: "In principle, Rule 191 of the RdP concerns information during proceedings in order to oblige the parties to provide information concerning the conclusions to be presented (see Tilmann/Plassmann/Ahrens, Rule 191 para. Ahrens, Rule 191 para. 1 – with reference to the “discovery” procedure). However, the wording of the second sentence does not preclude ordering the disclosure of the above-mentioned information in the final decision." (UPC_CFI_7/2023 (LD Düsseldorf), decision of July 2024).

Furthermore, this same position was adopted by this Local Division in its order issued on 31 July (UPC_CFI_ 425/2023, LD Paris). The Court considers that Rule 191 of the Rules of Procedure may be invoked at different stages of the proceedings in order to require the parties to disclose information during the proceedings or at the stage of the final decision. Furthermore, the Court notes that it is appropriate to apply the same reasoning with regard to the right to information provided for in Directive 2004/48/EC on enforcement within the EU (Art. 8), which allows such a request to be made at any stage of the proceedings.

For these reasons, HP's request is admissible.


On the ‘reasoned request’

The question is whether the information requested by the applicant
is reasonably necessary for the defence of that party's interests, in accordance with Art. 67(1) AJUB and Rule 191 of the RdP.

In its application, LAMA primarily requests disclosure of: ‘the identity of any third parties or partners of LAMA FRANCE or its subsidiaries involved in the production and distribution of the disputed products (Article 67.1.(a) and (c) AJUB), the corresponding invoices, even if redacted, in order to confirm the identity of the third parties designated.’


LAMA argues that HP's request to disclose this information reverses the burden of proof.

The Court notes that a request for information under Rule 191 of the Rules of Procedure must be sufficiently justified and proportionate in order to be granted.

In the present case, HP wishes, in the context of its infringement action brought against LAMA, to demonstrate that the latter is liable for acts of infringement of its two patents. The question therefore arises as to whether LAMA is a manufacturer, importer and/or offers or places on the market the allegedly infringing products in accordance with section 25 AJUB.


HP's request is therefore justified in itself. However, it must also be examined whether this request is sufficiently justified and proportionate to be upheld.
In this case, LAMA disputes that it is the manufacturer and importer of the products it offers to professionals.


With regard to manufacturing, at this stage of the proceedings, the only element that would suggest that LAMA played a role in the manufacture of the allegedly counterfeit products would be its own statements on its website in the screenshot produced in the report drawn up at HP's request (Exhibit 49 HP): ‘Lama France has been remanufacturing inkjet and laser cartridges for various brands since 1996.’

However, the certified public accountant's statement clearly indicates that LAMA is only engaged in trading and does not have its own production facilities. (Exhibit 49 LAMA)


In addition, LAMA provided clarification on the role of its two subsidiaries in its
written response of 31 July 2024 by producing extracts from each of their Kbis certificates.


With regard to imports, there is evidence in the file to suggest that the products
offered by LAMA and alleged to be counterfeit by HP are the subject of parallel imports into the EU market from Asia or South America. Therefore, at this stage of the proceedings, the Court considers it necessary and proportionate to grant the request for disclosure in terms more limited than those requested by HP and more in line with the alternative response made by LAMA in its observations of 31 July 2024 (page 14), namely the disclosure of:


-Invoices relating to the allegedly counterfeit cartridges that are the subject of the dispute and which were imported

by LAMA FRANCE outside the territory of the European Union, showing the country of import outside the territory of the European Union and redacting the data relating to the identification of the suppliers (such as the trade name, the address of the registered office, the company identification numbers, the name of the company's legal representative).


As HP has already indicated that it does not object in principle to confidentiality measures relating to the information concerned, the disclosure of these invoices will be subject to the confidentiality measures provided for in R. 262A of the Rules of Procedure, limiting access to the information to:
- one natural person for LAMA,
- one natural person for HP,

- the representatives of the parties to the present proceedings before the JUB.

This order to disclose information will not be accompanied by a penalty payment at this stage.

In order not to affect the timetable for the written proceedings, the deadline for disclosing this information will be 14 days from the notification of this order of 2 August 2024. The information must be produced by 16 August 2024 (the date on which LAMA must submit its final set of pleadings concerning HP's request for modification of its patents in question pursuant to R.32.3 RdP), and written observations from HP are expected on this point only by 29 August 2024 at the latest.

The Reporting Judge informs the parties that the written procedure will be closed on 30 August 2024 in accordance with
R.35 RdP.

The pre-trial conference is maintained on 6 September 2024.

FOR THESE REASONS
The Judge-Rapporteur orders LAMA France to communicate the following information by 16 August 2024:
-Invoices relating to the allegedly counterfeit cartridges that are the subject of the dispute and which were imported by LAMA FRANCE outside the territory of the European Union, showing the country of import outside the territory of theEuropean Union and redacting the data relating to the identification of the suppliers (such as the trade name, the address of the registered office, the company identification numbers, the name of the company's legal representative);
-The communication of these invoices is subject to the confidentiality measures provided for in R. 262A of the RdP, limiting access to the information to:

- one natural person for LAMA FRANCE, whose name and position must be communicated by the latter before 16 August 2024,
- one natural person for HEWLETT-PACKARD DEVELOPMENT COMPANY, whose name and position must be communicated by the latter before 16 August 2024,

- the representatives of the parties to these proceedings.
- States that written observations from HEWLETT-PACKARD DEVELOPMENT COMPANY are expected
on this point only by 29 August 2024 at the latest;

- Informs the parties that the written procedure will be closed on 30 August 2024 in accordance with R.35 RdP;
- the pre-trial conference is maintained on 6 September 2024;
- this order is subject to review at the request of a party under the conditions provided for in R. 333 RdP.
