GEGENSTAND: R. 262A VerfO – Schutz vertraulicher Informationen
KURZE DARSTELLUNG DES SACHVERHALTS:
Die Klägerin nimmt die Beklagten wegen einer Verletzung des europäischen Bündelpatents EP 3 490 258 in Anspruch. Sie hat ihr HEVC-essentielles Patentportfolio einschließlich des Streitpatents in einen von der Access Advance LLC (nachfolgend: Access Advance) verwalteten Patentpool eingebracht.
Mit Schriftsatz vom 20. Juni 2024 ist Access Advance dem Verfahren auf Seiten der Klägerin als Streithelferin beigetreten.
Die Lokalkammer Düsseldorf hat die Streithilfe mit Anordnung vom 26. Juni 2024 (ORD_37232/2024) zugelassen und der Streithelferin die Möglichkeit eingeräumt, einen Streithil-feschriftsatz einzureichen.
Von dieser Möglichkeit hat die Streithelferin Gebrauch gemacht. Zugleich hat sie hinsichtlich der mit dem Streithilfeschriftsatz eingereichten Anlagen einen Antrag auf Schutz vertraulicher Infor-mationen (R. 262A VerfO) gestellt.
GRÜNDE DER ANORDNUNG:
Der auf den Schutz von Geschäftsgeheimnissen und sonstiger vertraulicher Informationen gerich-tete Antrag ist zulässig und hat in der Sache Erfolg.
I. Gegen die Zulässigkeit des Antrages bestehen keine Bedenken.
1. Nach Art. 9 Abs. 1 und 2 lit. a) der Richtlinie (EU) 2016/943 ist vorgesehen, dass in einem gerichtlichen Verfahren auf Antrag der Zugang zu von den Parteien oder Dritten vorgelegten Dokumen-ten, die Geschäftsgeheimnisse oder angebliche Geschäftsgeheimnisse enthalten, ganz oder teil-weise auf eine begrenzte Anzahl von Personen beschränkt werden kann. Der Schutz vertraulicher Informationen ist im EPGÜ in Artikel 58 vorgesehen und in der Verfahrensordnung des Einheitli-chen Patentgerichts in Regel 262A implementiert (vgl. UPC_CFI_54/2023 (LK Hamburg), Anord-nung v. 03.11.2023, ORD_577703/2023 – Avago Technologies International v. Tesla Germany; UPC_CFI_463/2023 (LK Düsseldorf), Anordnung v. 11.03.2024, ORD_8550/2024 – 10x Genomics v. Curio Bioscience).
2. Die durch R. 262A.2 und .3 VerfO normierten formellen Anforderungen sind gewahrt. Auch wurden die Vertreter der Klägerin sowie der Beklagten, wie von R. 262A.4 VerfO gefordert, vor dem Erlass der Schutzanordnung gehört. Sie haben von der ihnen eingeräumten Möglichkeit zur Stellung-nahme Gebrauch gemacht.
3. Sofern vom Gericht nichts anderes angeordnet wurde, wird der Streithelfer gemäß R. 315.4 VerfO als Partei behandelt (UPC_CFI_457/2023 (LK Düsseldorf), Anordnung v. 22. Juli 2024, ORD_25519/2024 – Dolby International v. HP). Ebenso wie einer Partei steht ihm daher die Mög-lichkeit offen, hinsichtlich der in den durch ihn eingereichten Schriftsätzen enthaltenen Informati-onen einen Antrag auf Schutz vertraulicher Informationen zu stellen.
II. Dass es sich bei den durch die Streithelferin als geheimhaltungsbedürftig eingestuften Informatio-nen um Geschäftsgeheimnisse oder zumindest sonstige vertrauliche Informationen handelt, hat weder die Klägerin noch die Beklagte im Einzelnen in Abrede gestellt. Von einer Schutzbedürftig-keit der in Rede stehenden Informationen ist daher auszugehen.
Im Hinblick auf den Kreis der Zugangsberechtigten besteht ebenso kein Streit, weshalb es auch insoweit keiner weiteren Ausführungen bedarf.
ANORDNUNG:
I. Die aus der nachfolgenden Tabelle ersichtlichen, durch die Streithelferin in Papierform eingereichten Lizenzverträge werden als geheimhaltungsbedürftig eingestuft:
II. Der Zugang zu den unter Ziffer I. als geheimhaltungsbedürftig eingestuften Informati-onen wird auf Seiten der Parteien auf folgende Personen beschränkt:
1. die Prozessbevollmächtigten der Klägerin und der Beklagten;
2. folgende Mitarbeiter der Klägerin:

III. Die unter Ziffer I. als geheimhaltungsbedürftig eingestuften Informationen sind von den unter Ziffer II. genannten Personen als geheimhaltungsbedürftig zu behandeln. Sie dürfen nicht außerhalb dieses Gerichtsverfahrens verwendet oder offengelegt werden, es sei denn, sie sind der empfangenden Partei außerhalb dieses Verfahrens zur Kennt-nis gelangt. Diese Ausnahme greift allerdings nur dann, wenn diese Informationen von der empfangenden Partei auf nicht vertraulicher Basis aus anderer Quelle als von der Streithelferin oder den mit ihnen verbundenen Unternehmen erlangt wurden, voraus-gesetzt, dass diese Quelle nicht durch eine Vertraulichkeitsvereinbarung mit der Streit-helferin oder den mit ihnen verbundenen Unternehmen oder durch eine sonstige Ge-heimhaltungspflicht gegenüber diesen gebunden ist.
Diese Verpflichtung gilt jeweils auch gegenüber der Klägerin bzw. der Beklagten.
Die vorgenannten Personen sind auch gegenüber der Klägerin bzw. der Beklagten zur Geheimhaltung der in den ungeschwärzten Fassungen der vorgenannten Unterlagen enthaltenen Informationen verpflichtet.
Die Verpflichtung zur Geheimhaltung besteht auch nach Abschluss des Verfahrens fort.
IV. Bei schuldhafter Zuwiderhandlung gegen diese Anordnung kann das Gericht für jeden Fall der Zuwiderhandlung ein nach den Umständen des Einzelfalls zu bemessendes Zwangsgeld verhängen.
V. Es wird davon ausgegangen, dass die Klägerin und die Beklagten dem Vorbringen der Streithelferin folgend auf die Zustellung der unbearbeiteten Anlagen BP-Liz 1 bis BP-Liz 25 in Papierform verzichten.
VI. Der Streithelferin wird aufgegeben, den Parteien umgehend die ungeschwärzten Anla-gen BP-Liz 1 bis BP-Liz 25 in elektronischer Form zu übermitteln.

BRIEF STATEMENT OF THE FACTS:
The plaintiff is suing the defendants for infringement of European bundle patent EP 3 490 258. It has contributed its HEVC-essential patent portfolio, including the patent in dispute, to a patent pool managed by Access Advance LLC (hereinafter: Access Advance).
By written submission dated 20 June 2024, Access Advance joined the proceedings on the side of the plaintiff as an intervener.
The Local Chamber in Düsseldorf admitted the intervention by order of 26 June 2024 (ORD_37232/2024) and granted the intervener the opportunity to submit a statement in intervention.
The intervener availed itself of this opportunity. At the same time, it filed an application for protection of confidential information (R. 262A VerfO) with regard to the annexes submitted with the statement in intervention.
REASONS FOR THE ORDER:
The application for the protection of trade secrets and other confidential information is admissible and successful on the merits.
I. There are no objections to the admissibility of the application.
1. According to Article 9(1) and (2)(a) of Directive (EU) 2016/943, in court proceedings, access to documents submitted by the parties or third parties that contain trade secrets or alleged trade secrets may be restricted in whole or in part to a limited number of persons upon request. The protection of confidential information is provided for in Article 58 of the EPGÜ and implemented in Rule 262A of the Rules of Procedure of the Unified Patent Court (see UPC_CFI_54/2023 (LK Hamburg), order of 3 November 2023, ORD_577703/2023 – Avago Technologies International v. Tesla Germany; UPC_CFI_463/2023 (LK Düsseldorf), order of 11 March 2024, ORD_8550/2024 – 10x Genomics v. Curio Bioscience).
2. The formal requirements laid down in Rules 262A.2 and .3 of the Rules of Procedure have been complied with. The representatives of the applicant and the defendant were also heard before the protective order was issued, as required by Rule 262A.4 of the Rules of Procedure. They made use of the opportunity granted to them to submit their observations.
3. Unless otherwise ordered by the court, the intervener shall be treated as a party in accordance with Rule 315.4 VerfO (UPC_CFI_457/2023 (LK Düsseldorf), order of 22 July 2024, ORD_25519/2024 – Dolby International v. HP). Like a party, it therefore has the option of applying for protection of confidential information with regard to the information contained in the pleadings submitted by it.
II. Neither the plaintiff nor the defendant has disputed in detail that the information classified as confidential by the intervener constitutes trade secrets or at least other confidential information. It must therefore be assumed that the information in question is in need of protection.
There is also no dispute as to the group of persons authorised to access the information, which is why no further comments are necessary in this regard.
ORDER:
I. The licence agreements submitted by the intervener in paper form, as shown in the table below, are classified as confidential:
II. Access to the information classified as confidential under point I. shall be restricted to the following persons on the parties' side:
1. the legal representatives of the plaintiff and the defendant;
2. the following employees of the plaintiff:

III. The information classified as confidential in Section I shall be treated as confidential by the persons named in Section II. It may not be used or disclosed outside these court proceedings unless it has come to the knowledge of the receiving party outside these proceedings. However, this exception only applies if this information has been obtained by the receiving party on a non-confidential basis from a source other than the intervener or its affiliated companies, provided that this source is not bound by a confidentiality agreement with the intervener or its affiliated companies or by any other obligation of confidentiality towards them.
This obligation also applies to the plaintiff and the defendant.
The aforementioned persons are also obliged to maintain confidentiality towards the plaintiff and the defendant with regard to the information contained in the unredacted versions of the aforementioned documents.
The obligation to maintain confidentiality shall continue to apply even after the proceedings have been concluded.
IV. In the event of a culpable breach of this order, the court may impose a penalty payment to be determined in accordance with the circumstances of the individual case for each instance of the breach.
V. It is assumed that the plaintiff and the defendants, following the submissions of the intervener, will waive the delivery of the unredacted annexes BP-Liz 1 to BP-Liz 25 in paper form.
VI. The intervener is ordered to immediately transmit the unredacted Annexes BP-Liz 1 to BP-Liz 25 to the parties in electronic form.
