VERFAHRENSSPRACHE: Deutsch

GEGENSTAND: Geheimnisschutz gem. R. 262A VerfO – Überprüfung gem. R. 333 VerfO

SACHVERHALT
R. 333 VerfO.
ENTSCHEIDUNGSGRÜNDE
Der zulässige Antrag (I.) bleibt in der Sache ohne Erfolg (II.).
I. Der Antrag ist zulässig, insbesondere statthaft.

PATENT IN DISPUTE:
European Patent No. EP 2 479 680

DECISION:
Local Chamber Mannheim

JUDGES INVOLVED:
This order was issued with the participation of Presiding Judge Dr Tochtermann, legally qualified judge Böttcher and legally qualified judge Dr Schober.

LANGUAGE OF THE PROCEEDINGS: German

SUBJECT MATTER: Protection of secrets pursuant to R. 262A VerfO – Review pursuant to R. 333 VerfO

FACTS
The defendants 1) to 3) and the plaintiffs are in dispute over the order restricting access pursuant to R. 262A VerfO, which the defendants 1) to 3) in their application dated 13 May 2024 (App_26934/2024) with regard to information on the functioning of the contested embodiments contained in their statement of defence dated 13 May 2024 and in the attached Annex BPV 5.

On 3 July 2024, the rapporteur issued a final confidentiality order pursuant to R. 262A VerfO. Although the information claimed to be protected has been classified as confidential, the further request of defendants 1) to 3) was rejected and restricting access, which provides for access by the plaintiffs' legal representatives and their assistants without any numerical limitation and without naming individual persons, as well as three natural persons named by the plaintiffs, whom the defendants 1) to 3) considered excluded. For the further content of the order, including the further facts of the case and the parties' submissions, reference is made to the aforementioned order.
Defendants 1) to 3) have appealed against the order with their application of 9 July 2024 for review by the panel pursuant to Rule 333 of the Rules of Procedure.

Repeating and expanding on their previous submissions, defendants 1) to 3) argue that the three natural persons named by the plaintiffs should not be granted access to the confidential information because, according to the plaintiffs' own statements, they are specifically responsible for making strategic decisions regarding the parallel proceedings in the United States. Once they have gained knowledge of the confidential information on the functioning of the contested embodiments, they would not be able to disregard it in this context. Without the present legal dispute, the three named persons would have no knowledge of the confidential information and would not be able to use it as a basis for strategic decisions in other proceedings in other jurisdictions. Against this background, the interests of the defendant outweigh those of the plaintiff.
For further details, reference is made to the written submissions exchanged between the parties, including the annexes (see workflows for App_26934/2024, App_36698/2024 and App_40530/2024).

By order of 9 July 2024 (ORD_40677/2024), the rapporteur provisionally suspended access to the three named persons of the plaintiffs until the panel has decided on the application pursuant to Rule 333 of the Rules of Procedure.
Defendants 1) to 3) request

the review of the rapporteur's order pursuant to R. 262A of 3 July 2024 by the panel pursuant to R. 333 VerfO.
REASONS FOR THE DECISION
The admissible application (I.) is unsuccessful on the merits (II.).
I. The application is admissible, in particular because it is permissible.

The term ‘procedural decision or order’ within the meaning of Rule 333.1 VerfO must be interpreted broadly (see Court of Appeal, order of 21 March 2024, UPC_CoA_486/2023, GRUR-RS 2024, 9289 para. 33 et seq.). The order deciding on an application pursuant to Rule 262A VerfO is such a procedural order. Upon application, it determines whether and, if so, which information contained in written submissions and, if applicable, which evidence contains confidential information in relation to the parties and who, if any, of the parties may have access to it. An order pursuant to R. 262A VerfO restricts the fundamental right of the parties to unrestricted access to the subject matter of the dispute (see R. 262A.3, R. 264 VerfO) arising from their right to a fair hearing. The order therefore has an influence on the conduct of the proceedings and is thus an order governing the conduct of proceedings.

II. The application for review is unsuccessful on the merits. The panel exercises the power to order measures under R. 262A VerfO in the same way as the rapporteur.

1. The three persons named by the plaintiffs in the order of 3 July 2024 were rightly excluded from access to information classified as confidential concerning the functioning of the contested embodiments.

Whether and to what extent a party's access to certain confidential information contained in submitted pleadings or evidence is restricted must be assessed in light of the circumstances of the individual case. In doing so, the interests of the parties to the proceedings must be weighed against each other. On the part of the party affected by a possible restriction of access, particular consideration must be given to its right to a fair hearing and its right to the effective exercise of its rights in fair proceedings; on the part of the applicant, particular consideration must be given to the interest of the holder of the confidential information in protecting that information. The court may grant the application in particular if the reasons given by the applicant for the order significantly outweigh the other party's interest in unrestricted access to the information or evidence in question (R. 262A.5 VerfO). The number of persons authorised to have access must not exceed what is necessary to ensure the rights of the parties to the proceedings to an effective remedy and a fair trial and must include at least one natural person from each party and the respective lawyers or (other) representatives of those parties to the proceedings (R. 262A.6 VerfO, see already Local Chamber Mannheim UPC_CFI_359/2023 of 21 March 2024 = GRUR Patent 2024, 253, 255 et seq. and, with the same content, Local Chamber Düsseldorf UPC_CFI_355/2023 ORD_7096/2024). Insofar as the access rights of a specific person are at issue, particular importance is attached to that person's reliability and the assurance that they will not misuse the confidential information obtained. Furthermore, it is particularly important to consider the interest of the party concerned in granting access to that person.

According to this standard, the three persons named by the plaintiffs are to be granted access on the grounds set out in the order of 3 July 2024. The fact that defendants 1) to 3) are using the confidential information to defend themselves against allegations of patent infringement does give their interest in confidentiality particular weight. Without the plaintiffs' patent infringement action, defendants 1) to 3) would in all likelihood not have seen any reason to disclose the confidential information on the functioning of the contested embodiments to the plaintiffs. Contrary to the opinion of defendants 1) to 3), however, the highlighted function of the three persons named by the plaintiffs in other relevant pending and potential patent infringement disputes between the parties and their involvement in relevant property right applications, grant proceedings and legal validity proceedings are not decisive against granting access. Rather, the plaintiffs have a significant interest in ensuring that the appropriate legal action in the present dispute is taken internally by those persons who are particularly familiar with the relevant intellectual property rights situation and technology (Local Chamber Mannheim UPC_CFI_359/2023 of 21 March 2024 = GRUR Patent 2024, 253, 254 and, with the same content, Local Chamber Düsseldorf UPC_CFI_355/2023 ORD_7096/2024 = GRUR-RS 2024, 7098 marginal no. 29; Local Chamber Düsseldorf UPC_CFI_463/2023 ORD_8550/2024, procedural order of 11 March 2024). The defendants are sufficiently protected against the use of confidential information for purposes unrelated to the proceedings by the confidentiality order. As representatives authorised before the US Patent Office, the persons named are well versed in handling confidential information. There are no indications of a lack of reliability on the part of the persons named, which must be demonstrated by the applicant pursuant to Rule 262A VerfO.

2. In all other respects, the Board of Appeal exercises its power pursuant to Rule 262A VerfO in the same manner as in the order of 3 July 2024 and confirms the other measures taken in the order.

In particular, the number of three natural persons who are to be granted access to the plaintiffs in the present legal dispute, as specified in the order of 3 July 2024, is not objectionable. For the reasons stated in the order of 3 July 2024, there is also no justification for limiting the number or specifying the names of the EPG representatives acting on behalf of the plaintiffs in the present legal dispute and their internal assistants who are to be granted access to the confidential information. It is up to the plaintiffs and their legal representatives to decide who from this group will be called upon to handle the case in order to pursue the appropriate legal action in the present dispute, as long as there are no grounds for considering a particular person to be unreliable, which must be demonstrated by the applicant in accordance with Rule 262A of the Rules of Procedure. As stated in the order of 3 July 2024, the plaintiffs' legal representatives must ensure that confidentiality and purpose limitation are observed on their part. A court-ordered exclusion of EPG representatives who are handling the plaintiffs' property right applications or their property rights in legal proceedings is not justified in the case in dispute, since such an exclusion is already out of the question for the plaintiffs' employees involved, as discussed above.

3. Since the order of 3 July 2024 is confirmed, there was no need to request the plaintiffs separately to comment on the application of defendants 1) to 3) pursuant to R. 333 VerfO.
4. There are no grounds for allowing the appeal. The decision on the application of defendants 1) to 3) pursuant to R. 262A VerfO is made as an individual decision, taking into account the circumstances of the individual case.

There is no reason to postpone the effectiveness of the granting of access. Even if access should ultimately be restricted to certain persons, in the absence of any indications to the contrary, the named persons and the EPG representatives and their internal assistants on the side of the plaintiffs' legal representatives offer sufficient assurance that such a restriction can also be implemented retrospectively and that the persons subsequently excluded from access will maintain confidentiality.

ORDER

The application by defendants 1) to 3) dated 9 July 2024 for review by the panel of judges of the order of the rapporteur pursuant to Rule 262A of the Rules of Procedure dated 3 July 2024 is dismissed.
