La lite è iniziata in data 13.6.2023 con la richiesta a cura di Oerlikon nei confronti di Baghat Group di un ordine di protezione delle prove ex art. 60 dell’Agreement e le Rules 192 e segg. delle R.o.P. a tutela del brevetto EP ‘848, a seguito di unì esibizione alla fiera ITMA, programmata dal 8 al 14 giugno 2024 in Rho (Milano).
L’ordine è stato concesso dalla Corte ex parte ed è stato eseguito in data 14.6.2023: il provvedimento
non è stato oggetto di richiesta di review da parte del defendant.
Oerlikon ha introdotto tempestivamente il giudizio di merito, chiedendo l’accertamento della contraffazione, l’inibitoria assistita da penale, la pubblicazione della pronuncia e l’ordine di ritiro dal commercio a carico di Baghat. L’attore ha chiesto inoltre la condanna controparte ai sensi della Rule n. 119 R.o.P. di una sanzione pecuniaria pari ad € 100.000,00, per le spese da sostenere nel futuro giudizio di danni, con vittoria di spese.
Costituendosi, la convenuta:
• ha specificato che la propria corretta denominazione sociale è Bhagat Textile Engineers e
non Bhagat Group come indicato da controparte;
• non ha formulato preliminary objections;
• non ha introdotto il counterclaim for revocation.
• ha dichiarato:
✓ di non avere avuto conoscenza della privativa;
✓ di non avere mai commercializzato alcun esemplare della macchina nello spazio coperto dalla tutela brevettuale;
• ha ribadito il proprio impegno a non entrare in alcuna forma nel mercato coperto dalla privativa;
• ha negato la causazione di danni a controparte;
• ha chiesto la compensazione dei costi o comunque la liquidazione degli stessi al minimo,
sottolineando di dichiarato di aver collaborato in fase di esecuzione della misura concessa
ante causam e di aver esclusivamente pubblicizzato in fiera macchinari interferenti;
• ha rammentato di avere avviato trattative con l’attore al fine della bonaria definizione della lite.
Nel corso della written procedure, Baghat ha dato atto della pendenza di trattative anche in fase avanzata, confermate da Oerlikon, non andate tuttavia allo stato a buon fine.
La Corte ha sollecitato le parti a depositare documentazione al fine di valutare i costi di lite ed ha disposto, ex art. 262A delle R.o.P., la secretazione di un documento contenente informazioni riservate depositato a tal fine dall’attore.
L’Interim Conference è stata celebrata in presenza in data 27.5.2024, ove sono stati affrontati i temi che seguono.
2. L’Interim conference
Il judge rapporteur ha chiesto chiarimenti alle parti sui profili che, in via sintetica, vengono di seguito riprodotti negli aspetti più rilevanti.
1. La scorretta indicazione della denominazione della convenuta nell’atto introduttivo della lite.
Parte attrice non ha contestato l’eccezione sul punto della convenuta, la quale ha rammentato la propria corretta denominazione sociale -Baghat Textile Engineers- e non Baghat Group, come erroneamente indicato nell’atto introduttivo del giudizio.
2. L’interesse dell’attore ad accedere alla relazione alla relazione dell’esperto resa a seguito dell’order to preserve evidence ante causam
-Il judge rapporteur ha sottolineato in proposito che:
a. la convenuta non ha contestato l’interferenza con il brevetto azionato da parte delle macchine descritte nelle proprie brochures esposte in fiera: nella memoria del 30 gennaio 2024, Baghat ha dichiarato espressamente di rinunciare all’affermazione circa l’interferenza.
Con le conseguenze processuali di cui alla Rule 171, comma 2, delle R.O.P.;
b. anche Oerlikon nella memoria del 4.3.2024 ha dichiarato che nessuna attività istruttoria è necessaria.
La Corte ha dunque chiesto all’attore quale sia l’interesse ad accedere al report dell’expert.
-La difesa dell’attore ha sottolineato che l’esame di tale documento è indispensabile per meglio sindacare il valore della causa.
-La convenuta ha chiesto il rigetto dell’istanza, sottolineando che nessuna informazione sul valore della lite può essere tratta da tale documento. Tale adempimento comporterebbe inoltre nuove inutili spese.
3. La richiesta dell’attrice di chiedere informazioni relative all’origine ed ai canali di distribuzione, ai quantitativi dei prodotti, ordinativi ricevuti ecc., fatturato generato dalla macchina identità dei terzi coinvolti,
-Il judge rapporteur ha osservato che allo stato non sembrerebbe esservi prova, neppure a livello indiziario, della commercializzazione dei macchinari litigiosi nel territorio coperto dalla privativa brevettuale. La doglianza della società attrice è limitata all’ esibizione all’evento fieristico dello scorso giugno 2023.
-Parte attrice ritiene di avere sottoposto al Tribunale sufficienti indizi circa l’ingresso nel mercato dell’attrice e che tale ordine sia necessario per comprendere l’entità del fenomeno contraffattorio.
-La convenuta ha confermato di non avere alcun canale distributivo, di non essere parte di alcuna filiera e di non avere mai distribuito i macchinari litigiosi.
4. L’ ammontare della penale, quantificata in € 12.000,00
- Il judge rapporteur ha chiesto chiarimenti circa l’ammontare della penale.
- L’attore ha dichiarato che tale importo è stato determinato alla luce della natura sia deterrente sia sanzionatoria di tale rimedio.
- La convenuta ha sottolineato che dalla quantificazione della penale a cura di controparte la Corte può apprezzare il reale valore della causa, di gran lunga inferiore a quanto indicato da controparte.
5. La richiesta di ritiro dal commercio
- Il Judge rapporteur ha ribadito che, allo stato, non vi è alcun riscontro circa la commercializzazione, in qualunque anello della catena di vendita, a cura della convenuta. Ha richiamato in proposito il principio dell’onere della prova da parte dell’attore
- L’attrice dichiara di avere sottoposto all’attenzione della Corte tutti gli argomenti di prova a propria disposizione, compiendo ogni sforzo difensivo su punto.
- La convenuta ha ribadito di non avere commercializzato né di avere in corso alcuna vendita o distribuzione del macchinario litigioso: controparte, presente sul mercato interessato da tempo anche attraverso la propria rete distributiva non ha fornito alcun elemento indiziario per provare la propria prospettazione.
6. La richiesta di condanna della convenuta al pagamento di € 100.000,00 per le spese da sostenere nella causa risarcitoria
- Il judge rapporteur ha sottolineato che apparentemente non è stato allegato o provato alcun riscontro circa pregiudizio concreti subito dall’attore, idonei comunque a condurre la Corte a quantificare tale importo. Ha in proposito richiamato la Rule n. 131, lett. b., R.o.P.
- Parte attrice ribadisce la correttezza di tale quantificazione.
- La convenuta ha contestato tale richiesta, specificando di non avere cagionato alcun pregiudizio.
7. Il valore della causa
Il judge rapporteur ha rammentato la discrasia tra le opposte difese circa il valore della causa, indicata dall’attore in € 750.000,00, posizione radicalmente contestata dal convenuto che ritiene tale prospettazione assolutamente spropositata. La Corte ha invitato quindi le parti ad esporre le rispettive posizioni alla luce della Rule 370, paragrafo 6, delle R.o.P. e delle Linee guida del Administrative Committee in data 24.4.2023.
-Parte attrice conferma la valutazione compiuta nei propri scritti difensivi, chiede di poter depositare una intervista rilasciata dall’amministratore di controparte, ove viene rammentato il positivo riscontro dell’evento fieristico dello scorso giugno 2023, a conferma della più ampia portata del fenomeno contraffattorio.
-La convenuta nega di avere conseguito profitti o di avere cagionato perdite di guadagno a controparte. Chiede di poter depositare documentazione che consenta di acclarare come il valore delle royalties applicate nello specifico settore tecnico ammontano normalmente a circa il 3%.
8. I Costi
-Il judge rapporteur ha chiesto alle parti di prendere posizione sui costi di lite esposti dall’attore e contestati dalla convenuta, alla luce di principi di ragionevolezza e proporzionalità, nonché dei principi esposti dall’ Admistrative Committee in data 24 aprile 2023.
-Parte attrice ha rammentato che la lite si è articolata in due fasi, quella ante causam e quella di merito. Ha ricordato i costi vivi sostenuti, esposti nei propri scritti. Quanto ai compensi per l’attività professionale, ha ricordato che le prestazioni professionali si sono articolate anche in un procedimento di estrema urgenza, con uno sforzo difensivo notevole, attraverso l’interlocuzione con il proprio cliente avente sede estera.
Chiede di poter depositare:
- ulteriore fattura emessa nei confronti della propria assistita;
-prova del pagamento delle precedenti fatture a cura di Oerlikon.
-Parte convenuta ha sottolineato che molte delle attività defensionali sono state svolte inutilmente, per non avere controparte immotivatamente aderito alle proposte transattive formulate da Baghat.
9. Le proposte transattive
-Il judge rapporteur, alla luce della mancata contestazione della validità del brevetto e della interferenza, ha sollecitato nuovamente le parti a trovare un accordo transattivo.
-Parte attrice ha dichiarato la propria disponibilità a proseguire un percorso transattivo a fronte dell’obbligo di controparte di non commercializzare le macchine litigiose assistito da penale, al pagamento forfettario di un importo a titolo di danni pari ad €25.000,00 ed al pagamento delle spese, oltre all’assenso di una comunicazione al mercato dell’accordo raggiunto.
Chiede di poter depositare le interlocuzioni in proposito scambiate.
-Parte convenuta si dichiara disponibile a definire la lite obbligandosi a non commercializzare i prodotti litigiosi con la previsione di una penale, eventualmente con un contributo spese inferiore a quello indicato da controparte e comunque senza riconoscere alcun risarcimento del danno.
10. I successivi passaggi procedurali
- Il Judge rapporteur ha invitato le parti a sottoporre le rispettive richieste, eventualmente valutando l’opportunità di mantenere uno spatium deliberandi per coltivare proposte transattive e di sintetizzare le rispettive posizioni innanzi alla Corte.
- Parte attrice ha chiesto:
• termine per depositare i documenti sopra richiamati e per depositare un riassunto delle proprie posizioni;
• di accedere al report dell’expert;
• di adottare l’ordine di chiedere informazioni alla convenuta sulla propria rete vendita e sugli ordinativi.
-Parte convenuta ha chiesto:
• termine per depositare i documenti sopra indicati e per depositare un riassunto delle proprie posizioni;
• si è opposta alla richiesta di accesso al report dell’Expert.
3. Motivi dell’ordine
Va premesso che, rispetto ai chiarimenti richiesti dalle parti, solo alcuni necessitano di una decisione
in questa sede del judge rapporteur, di seguito trattati.
1.Quanto alla richiesta di accesso al report dell’esperto nominato nella fase ante causam svolta dalla
difesa Oerlikon, valgono le considerazioni che seguono.
1.1.Va rammentato che l’attore ha formulato tale istanza esclusivamente al fine di meglio determinare il valore della lite, non essendovi qui questione circa l’interferenza dei macchinari pubblicizzati in fiera.
In proposito, la convenuta ha contestato l’inutilità di tale passaggio procedurale, anche ai fini dichiarati dall’attore, essendo stata l’interferenza dei materiali pubblicitari riconosciuta e non essendovi alcun elemento raccolto in fiera idoneo a consentire una migliore determinazione del valore della causa. Il convenuto non ha invece allegato la presenza di eventuali informazioni riservate.
In proposito, il Judge rapporteur ritiene che, attraverso un giudizio ex ante, che non possa escludersi che il materiale raccolto a seguito dell’ordine di raccolta della prova contenga qualche elemento utile in tal senso.
Pertanto, la domanda appare meritevole di accoglimento, salva ogni valutazione finale da parte della Corte anche rispetto alle spese eventualmente sopportate dalle parti e sulla relativa meritevolezza, profilo sottoposto all’attenzione da parte della difesa della convenuta.
E ciò alla luce dell’art. 69, paragrafo n. 3, dell’Agreement.
1.2.Per completezza, il Judge rapporteur rammenta che parte convenuta non ha proposto domanda
di review avverso l’ordine di conservazione della prova, che si è pertanto consolidata, considerato
che:
• secondo la Rule n. 197.3 delle R.o.P. il convenuto può proporre la richiesta di revoca dell’ordine di conser-vazione della prova entro 30 giorni dall’esecuzione della misura;
• secondo la Rule n. 300 delle R.o.P. relativo al computo dei termini stabilisce che questi decorrono dal giorno successivo a quello in cui l’evento rilevante si verifica; in caso di notificazione di un documento, tale evento rilevante deve essere la ricezione del documento;
• l’esecuzione della misura comprende, in accordo con la legge nazionale con la quale è stata implementata (id. la legge italiana) la notifica del provvedimento completo di ogni sua parte3;
L'esecuzione è stata effettuata presso la fiera ITMA lo stesso giorno 14.6.2023.
Il convenuto non ha fatto richiesta di revoca o modifica della misura.
Lo stesso è decaduto da tale facoltà considerato che sono spirati i 30 giorni di calendario previsti per la tempestiva richiesta di review, computando i termini secondo la regola di cui alla Rule n. 300, lett. a, R.o.P..
E ciò:
➢ sia che il termine di decadenza venga fatto decorrere dal 14.6.2023, essendo in tal caso il termine spirato il successivo 15.7.2024;
➢ sia che lo stesso venga fatto decorrere dal giorno successivo alla notifica dell’atto introduttivo del giudizio di merito, quando la convenuta ha nuovamente ricevuto comunicazione ufficiale dell’ordine. Tuttavia, in data 4.1.2024 quando Baghat si è costituita in giudizio, formalmente riconoscendo di essere a conoscenza dell’or-dine di conservazione della prova, ha dichiarato di avere prestato collaborazione all’esecuzione della misura e non ha sollevato alcuna censura. La domanda di acquisizione nel fascicolo della fase cautelare ante causam nel giudizio di merito non trova quindi ostacoli, essendo la misura finalizzata proprio a tale scopo.
1.3. Quanto alla tutela delle eventuali informazioni riservate, il convenuto ha interloquito sia nelle memorie successive alla costituzione sia corso della Interim Conference, non allegando alcuna specifica esigenza in tale senso. Non vi sono dunque ostacoli alla divulgazione, qui declinata nella facoltà di accesso delle parti e nella piena utilizzabilità solo nel presente giudizio.
1.4. La relazione scritta e ogni altro risultato delle misure di ispezione dei locali e di conservazione delle prove possono essere utilizzati solo nel procedimento di merito, ai sensi delle Regole 196.2 e 199 R.o.P.. Ciò significa che l'accesso al contenuto delle relazioni è finalizzato esclusivamente al loro utilizzo nel successivo procedimento principale, contro le stesse parti. La richiesta della ricorrente è senz’altro fondata e va accolta in quanto lo scopo della raccolta anticipate delle prove è proprio quello di utilizzarle nel giudizio di merito.
2.Quanto alla richiesta di Oelikon di ordinare alla convenuta di dichiarare la propria catena distributiva e di vendita e rivendita e le ulteriori informazioni indicate nel proprio atto introduttivo,
In proposito osserva la Corte che si tratta di una domanda che potrà essere formulata nella futura eventuale “procedure for the determination of damages and compensation”, con i relativi rimedi allo scopo previsti.
E ciò previa verifica, in quella fase, dell’assolvimento degli oneri probatori che incombono
sull’attore alla luce dell’art. 54 e 76 comma 6 Agreement, anche rispetto alle richieste come quella
qui esaminata: qui da un lat parte convenuta ha confermato espressamente di non avere venduto o
distribuito il macchinario litigioso nel mercato coperto dal brevetto azionato e, altro lato, non vi
sono allo stato argomenti di prova che possano ritenere la vendita o la distribuzione dei macchinari
litigiosi da parte di Baghat nel mercato interessato.
In questo procedimento, anche alla luce del principio di proporzionalità (paragrafo n 3. del Preamble
delle R.o.P.), del quadro allegatorio e probatorio raccolto, tale ordine non appare necessario.
3.Quanto al valore della causa.
Tale valore, solo in via provvisoria, viene confermato nell’importo indicato da Oerlikon, alla luce
dei principi stabiliti dalla Rule n. 370, 6, delle R.o.P. e delle regole stabilite dall’Administrative
Committee, considerato:
• che le parti non concordano sul valore della causa, non potendo essere quindi adottato il parametro di cui al punto n. 3 dei Principi Generali dettati dall’Administrative Committee il 23.4.2023;
• l’interesse della parte attrice nel procedimento, primo parametro indicato dalla citata Rule 370.6 R.o.P. In proposito:
- l’interesse del titolare del brevetto nella causa non può ritenersi limitato ai soli danni patito, ma va iguardato nella sua complessità anche rispetto alla tutela anticipata della propria privativa ed alla propria immagine sul mercato. L’interesse di Oerlikon va dunque riguardato alla luce della necessità di contrastare la promozione in una fiera internazionale di macchinari interferenti con i propri, potenzialmente forieri di pregiudizio anche reputazionali.
- il documento n. 19 depositato dall’applicant (ed oggetto dell’ordine di protezione secondo la Rule n. 262.A R.o.P.) consente di ritenere un valore medio di ciascuno dei macchinari litigiosi di poco superiore ad €……. Tale valore costituisce un indizio importante circa l’interesse di Oerlikon in questa causa.
• le indicazioni contenute nelle Linee Guida dell’Administrative Committee rispetto alla valutazione del valore dell’azione. In proposito:
➢ occorre avere riguardo ai valori sommati di tutti i rimedi richiesti (qui articolati sia nell’ingiunzione per il futuro sia il risarcimento del danno per il passato);
➢ rispetto alla perdita di profitti e il lucro conseguito dal preteso contraffattore, va osservato che:
- allo non vi è prova liquida della commercializzazione dei macchinari litigiosi nel territorio coperto dal brevetto. Non vi è dunque, allo stato, prova liquida di danno per perdita di profitti dell’attore e di profitti
conseguiti dalla convenuta (secondo il punto n. 1 indicato dei Principi Generali delle linee guida previste dall’Administrative Committee); -l’unico episodio interferente è costituito dall’esposizione in Fiera,
prolungatosi per 4 giorni, come sottolineato dall’attore e non contestato dalla convenuta nel corso dell’Interim Conference;
➢ quanto alle royalties normalmente applicato nello specifico settore, il defendant ha sostenuto che le stesso corrispondono a circa il 3% del fatturato, allegazione in specificamente contestata dall’attrice e rispetto alla quale Baghat ha chiesto di essere ammessa a produrre documenti;
-quanto alla richiesta di danni, l’attore ha invocato la condanna già in questa sede del defendant al pagamento di € 100.000,00 al fine di coprire i costi da sostenere nel futuro giudizio di merito.
Alla luce di tutte le considerazioni sopra espresse, ritiene il Judge rapporteur, nell’ambito di una valutazione come già precisato solo provvisoria, soggetta a migliore esame da parte della Corte anche alla luce dei documenti di cui è autorizzata il deposito come a breve, che il valore della causa in € 750.000,00. E ciò al fine di la scala dei massimali per i costi recuperabili.
4. Quanto alla richiesta del deposito di nuovi documenti.
Parte attrice e parte convenuta chiedono inoltre di poter depositare nuovi documenti, sempre propedeutici al sindacato sul valore della causa ed al sindacato della Corte sugli sforzi difensivi compiti, in relazione la valutazione sul governo dei costi di lite.
Tali ulteriori documenti, che non introducono domande nuove né modifica di quelle già introdotte, come meglio di seguito, vanno ammessi.
Al fine di consentire alle parti di sondare ogni possibilità transattiva, il termine al fine di tale adempimento viene fissato al 20 luglio 2024.
Al fine di garantire il contraddittorio, va concesso altresì termine ad entrambe le parti per replicare ai depositi avversari.
Viste le rules n 105.5, 370.6, R.o.P.
Autorizza
- l’accesso ad entrambe le parti di tutte le prove raccolte attraverso l'esecuzione della misura, concedendo le parti ad accedere al report e ai documenti acquisiti in sede di esecuzione dell’ordine di raccolta dalle prova -concesso prima dell’inizio del giudizio di merito. ed estrarne copia, anche di quelli versati su chiavetta USB e custoditi in busta chiusa presso il Sub.Registry della divisione Locale di Milano;
- l’accesso avverrà in una data compresa dal 2.7.2024 al 4.07.2024 in orari di apertura della Cancelleria, previo appuntamento concordato, alla presenza del Judge Rapporteur, delegato allo scopo, ed alla presenza un clerk delegato a redigere verbale delle operazioni compiute presso la sede della divisione locale di Milano.
- allo scopo ordina all’esperto, previo avviso della Cancelleria, di fornire due chiavette di contenuto identico a quella già depositata a un clerk addetto al Sub-Registry della Divisione Locale, per il successivo ritiro a cura dei difensori delle parti, con le modalità sopra indicate;
E ciò presso la sede della divisione locale entro il 25.6.2024, disponendo che la Cancelleria ne dia comuni-cazione immediata all’esperto;
- le parti interessate potranno depositare la documentazione acquisita a seguito dell’accesso al report dell’esperto nel termine 11 luglio 2024.
Concede
1. termine fino al 11 luglio 2024, ore 15, per depositare:
• -a cura di parte attrice:
- copia dell’intervista rilasciata dal legale rappresentante della convenuta agli organi di stampa;
-la nuova fattura emessa dalla difesa dell’attrice nei confronti della propria assistita;
-prova dell’intervenuto pagamento delle precedenti fatture a cura della propria assistita;
-le proposte transattive scambiate tra le parti;
-la documentazione ottenuta dall’accesso al report dell’esperto, come meglio sopra indicato;
• -a cura di parte convenuta:
-documenti al fine di accertare la royalties normalmente applicata nel particolare settore tecnico;
-proposte transattive scambiate tra le parti.
2. termine fino al 18 luglio 2024, ore 15, per depositare:
• a cura di entrambe le parti commenti rispetto alle produzioni avversarie, non essendo invece ammessa la produzione ulteriori documenti.
E ciò da depositare sul CMS mediante generic application.
3. termine fino al 25 luglio 2024, ore 15, per depositare:
• a cura di entrambe le parti un riassunto della causa che non introduca tuttavia fatti o prove nuovi. Il riassunto dovrà avere una lunghezza massima di 7.500 parole.
Unitamente al riassunto dovrà essere presentato un elenco completo di tutti i documenti depositati da ciascuna delle parti per consentire alla Corte di far riferimento durante l’udienza.
E ciò da depositare sul CMS mediante generic application.
Conferma
La data di celebrazione dell’Oral hearing davanti alla Corte per il 27.9.2024, ore 10.30, secondo le disposizioni previste nel provvedimento reso in data 19.2.2024. Informa le parti che è intenzione della Corte concludere la Oral Hearing in un giorno.

The dispute began on 13 June 2023 with Oerlikon's request to Baghat Group for an order for the protection of evidence pursuant to Article 60 of the Agreement and Rules 192 et seq. of the Rules.P. to protect EP patent '848, following an exhibition at the ITMA trade fair, scheduled from 8 to 14 June 2024 in Rho (Milan).
The order was granted by the Court ex parte and was enforced on 14 June 2023: the measure
was not subject to a request for review by the defendant.
Oerlikon promptly brought proceedings on the merits, seeking a declaration of infringement, an injunction with penalty clause, publication of the judgment and an order for Baghat to withdraw the product from the market. The plaintiff also requested that the defendant be ordered to pay a financial penalty of €100,000.00 for the costs to be incurred in the future damages proceedings, with costs.
In its statement of defence, the defendant:
• specified that its correct company name is Bhagat Textile Engineers and
not Bhagat Group as indicated by the other party;
• did not raise any preliminary objections;
• did not introduce a counterclaim for revocation.
• declared:
✓ that it had no knowledge of the exclusive right;
✓ that it had never marketed any model of the machine in the area covered by the patent protection;
• reiterated its commitment not to enter in any way into the market covered by the exclusive right;
• denied causing damage to the other party;
• requested compensation for costs or, in any case, the payment of the minimum amount thereof,
emphasising that it had cooperated in the execution of the measure granted
ante causam and that it had only advertised interfering machinery at the trade fair;
• recalled that it had entered into negotiations with the plaintiff with a view to amicably settling the dispute.
During the written procedure, Baghat acknowledged that negotiations were at an advanced stage, as confirmed by Oerlikon, but that they had not yet been successful.
The Court urged the parties to file documentation in order to assess the costs of the dispute and ordered, pursuant to Article 262A of the Rules of Procedure, the sealing of a document containing confidential information filed for this purpose by the plaintiff.
The Interim Conference was held in person on 27 May 2024, where the following issues were addressed.
2. The Interim Conference
The judge rapporteur asked the parties for clarification on the issues, which are summarised below in their most relevant aspects.
1. Incorrect indication of the defendant's name in the document initiating the proceedings.
The plaintiff did not contest the defendant's objection on this point, which recalled its correct company name - Baghat Textile Engineers - and not Baghat Group, as incorrectly indicated in the introductory act of the proceedings.
2. The plaintiff's interest in accessing the expert's report made following the order to preserve evidence ante causam
-The judge rapporteur emphasised in this regard that:
a. the defendant did not contest the interference with the patent asserted by the machines described in its brochures exhibited at the trade fair: in its brief of 30 January 2024, Baghat expressly waived its claim of interference.
With the procedural consequences set out in Rule 171, paragraph 2, of the R.O.P.;
b. Oerlikon also stated in its brief of 4 March 2024 that no preliminary investigation was necessary.
The Court therefore asked the plaintiff what interest it had in accessing the expert's report.
-The plaintiff's defence emphasised that the examination of this document is essential in order to better assess the value of the case.
-The defendant requested that the application be rejected, emphasising that no information on the value of the dispute can be derived from this document. This would also entail new unnecessary costs.
3. The plaintiff's request for information on the origin and distribution channels, quantities of products, orders received, etc., turnover generated by the machine, identity of the third parties involved,
-The judge rapporteur noted that, at present, there does not appear to be any evidence, even circumstantial, of the marketing of the disputed machines in the territory covered by the patent. The plaintiff's complaint is limited to the exhibition at the trade fair last June 2023.
-The plaintiff considers that it has provided the Court with sufficient evidence of the plaintiff's entry into the market and that this order is necessary to understand the extent of the counterfeiting phenomenon.
-The defendant confirmed that it has no distribution channels, is not part of any supply chain and has never distributed the disputed machinery.
4. The amount of the penalty, quantified at €12,000.00
- The judge rapporteur requested clarification regarding the amount of the penalty.
- The plaintiff stated that this amount was determined in light of the deterrent and punitive nature of this remedy.
- The defendant pointed out that from the quantification of the penalty by the other party, the Court can appreciate the real value of the case, which is far lower than that indicated by the other party.
5. The request for withdrawal from the market
- The judge rapporteur reiterated that, at present, there is no evidence of marketing by the defendant at any stage of the sales chain. In this regard, he referred to the principle of the burden of proof on the plaintiff.
- The plaintiff states that it has submitted all the evidence at its disposal to the Court, making every effort to defend itself on this point.
- The defendant reiterated that it had not marketed or was not in the process of selling or distributing the disputed machinery: the counterparty, which had been present on the market concerned for some time, including through its own distribution network, had not provided any evidence to support its claim.
6. The request for the defendant to be ordered to pay €100,000.00 for the costs incurred in the action for damages
- The judge rapporteur pointed out that no evidence of actual damage suffered by the plaintiff, which would in any case be sufficient to lead the Court to quantify this amount, had apparently been attached or proven. In this regard, he referred to Rule No. 131, letter b., R.o.P.
- The plaintiff reiterates the correctness of this quantification.
- The defendant contested this request, specifying that it had not caused any damage.
7. The value of the case
The judge rapporteur recalled the discrepancy between the opposing defences regarding the value of the case, indicated by the plaintiff as €750,000.00, a position radically contested by the defendant, who considers this claim to be completely disproportionate. The Court therefore invited the parties to present their respective positions in light of Rule 370, paragraph 6, of the Rules of Procedure and the Administrative Committee's Guidelines dated 24 April 2023.
-The plaintiff confirms the assessment made in its defence briefs and requests to file an interview given by the defendant's director, in which the positive outcome of the trade fair held in June 2023 is recalled, confirming the wider scope of the counterfeiting phenomenon.
-The defendant denies having made any profits or caused any loss of earnings to the other party. It requests to be allowed to file documentation showing that the value of royalties applied in the specific technical sector normally amounts to approximately 3%.
8. Costs
-The judge rapporteur asked the parties to take a position on the costs of the proceedings incurred by the plaintiff and contested by the defendant, in light of the principles of reasonableness and proportionality, as well as the principles set out by the Administrative Committee on 24 April 2023.
-The plaintiff recalled that the dispute was divided into two phases, the pre-litigation phase and the merits phase. It recalled the actual costs incurred, as set out in its pleadings. With regard to professional fees, it recalled that the professional services also involved extremely urgent proceedings, with considerable defensive efforts, through dialogue with its client based abroad.
It requested to be allowed to file:
- an additional invoice issued to its client;
- proof of payment of the previous invoices by Oerlikon.
-The defendant emphasised that much of the defence work had been carried out unnecessarily, as the other party had unreasonably failed to accept the settlement proposals made by Baghat.
9. Settlement proposals
-The judge rapporteur, in light of the lack of challenge to the validity of the patent and the interference, again urged the parties to reach a settlement agreement.
-The plaintiff declared its willingness to continue with a settlement process, subject to the other party's obligation not to market the disputed machines, backed by a penalty clause, the payment of a lump sum of €25,000.00 in damages and the payment of costs, as well as consent to the disclosure of the agreement reached to the market.
It requested that the correspondence exchanged in this regard be filed.
-The defendant declared its willingness to settle the dispute, undertaking not to market the disputed products, subject to a penalty, possibly with a contribution towards costs lower than that indicated by the other party and in any case without acknowledging any compensation for damages.
10. Subsequent procedural steps
- The Judge Rapporteur invited the parties to submit their respective requests, possibly considering the advisability of maintaining a spatium deliberandi to cultivate settlement proposals and summarise their respective positions before the Court.
- The claimant requested:
• a deadline for filing the above-mentioned documents and for filing a summary of its positions;
• access to the expert's report;
• an order to request information from the defendant on its sales network and orders.
- The defendant requested:
• a deadline for filing the above documents and for filing a summary of its positions;
• it opposed the request for access to the expert's report.
3. Reasons for the order
It should be noted that, with regard to the clarifications requested by the parties, only some require a decision
by the judge rapporteur at this stage, which are discussed below.
1. With regard to the request for access to the report of the expert appointed in the pre-trial phase by
the Oerlikon defence, the following considerations apply.
1.1. It should be noted that the plaintiff made this request solely for the purpose of better determining the value of the dispute, as there is no question here about the interference of the machinery advertised at the trade fair.
In this regard, the defendant contested the uselessness of this procedural step, even for the purposes stated by the plaintiff, since the interference of the advertising material had been recognised and there was no evidence gathered at the trade fair that would allow for a better determination of the value of the case. The defendant did not, however, allege the presence of any confidential information.
In this regard, the Judge Rapporteur considers that, through an ex ante assessment, it cannot be ruled out that the material collected following the order to gather evidence contains some elements that are useful in this regard.
Therefore, the request appears to be admissible, subject to the Court's final assessment, including with regard to any costs incurred by the parties and their relative merits, an issue brought to the attention of the defendant's defence.
This is in light of Article 69(3) of the Agreement.
1.2. For the sake of completeness, the Judge Rapporteur recalls that the defendant did not file an application
for review of the order to preserve evidence, which has therefore become final, considering that
:
• according to Rule 197.3 of the Rules of Procedure, the defendant may request the revocation of the order to preserve evidence within 30 days of the execution of the measure;
• according to Rule No. 300 of the R.o.P. relating to the calculation of time limits, these start from the day following the day on which the relevant event occurs; in the case of service of a document, that relevant event must be the receipt of the document;
• the execution of the measure includes, in accordance with the national law by which it was implemented (i.e. Italian law), the notification of the measure in its entirety3;
The execution was carried out at the ITMA trade fair on the same day, 14 June 2023.
The defendant did not request the revocation or modification of the measure.
The defendant has forfeited this right, given that the 30 calendar days provided for the timely request for review have expired, calculating the time limits in accordance with Rule No. 300(a) of the Rules of Procedure.
And that:
➢ whether the limitation period starts from 14 June 2023, in which case the deadline expired on 15 July 2024;
➢ or whether it starts from the day following the notification of the introductory act of the proceedings on the merits, when the defendant again received official notification of the order. However, on 4 January 2024, when Baghat appeared in court, formally acknowledging that it was aware of the order to preserve evidence, it stated that it had cooperated in the execution of the measure and did not raise any objections. The request for the inclusion of the pre-trial proceedings in the case file in the proceedings on the merits is therefore unimpeded, since the measure is intended precisely for that purpose.
1.3. As regards the protection of any confidential information, the defendant made representations both in its subsequent pleadings and during the Interim Conference, without attaching any specific requirement in this regard. There are therefore no obstacles to disclosure, which is here declined in the form of access for the parties and full usability only in the present proceedings.
1.4. The written report and any other results of the inspection of the premises and preservation of evidence may only be used in the proceedings on the merits, in accordance with Rules 196.2 and 199 R.o.P.. This means that access to the content of the reports is intended solely for use in the subsequent main proceedings against the same parties. The applicant's request is undoubtedly well founded and must be granted, since the purpose of the early collection of evidence is precisely to use it in the proceedings on the merits.
2. As regards Oelikon's request to order the defendant to disclose its distribution, sales and resale chain and the additional information indicated in its application,
In this regard, the Court notes that this is a request that may be made in any future “procedure for the determination of damages and compensation”, with the relevant remedies provided for that purpose.
This is subject to verification, at that stage, of the fulfilment of the burden of proof incumbent on the plaintiff in the light of Articles 54 and 76(6) of the Agreement, including with regard to requests such as the one examined here: on the one hand, the defendant has expressly confirmed that it has not sold or distributed the disputed machinery on the market covered by the patent invoked and, on the other hand, the plaintiff has expressly stated that it has not sold or distributed the disputed machinery on the market covered by the patent invoked.

no arguments or evidence at this stage that could suggest that Baghat sold or distributed the disputed machinery
in the market concerned.
In these proceedings, also in light of the principle of proportionality (paragraph 3 of the Preamble
to the R.o.P.), the evidence and arguments presented, such an order does not appear necessary.
3. As regards the value of the claim.
This value, on a provisional basis only, is confirmed in the amount indicated by Oerlikon, in light of
the principles established by Rule 370(6) of the Rules of Procedure and the rules established by the Administrative
Committee, considering:
• that the parties do not agree on the value of the claim, and therefore the parameter referred to in point 3 of the General Principles laid down by the Administrative Committee on 23 April 2023 cannot be adopted;
• the interest of the plaintiff in the proceedings, the first parameter indicated by the aforementioned Rule 370.6 R.o.P. In this regard:
- the interest of the patent holder in the case cannot be considered limited to the damages suffered, but must be considered in its entirety, also with regard to the anticipated protection of its exclusive rights and its image on the market. Oerlikon's interest must therefore be considered in light of the need to prevent the promotion at an international trade fair of machinery that interferes with its own, potentially causing damage to its reputation.
- Document No. 19 filed by the applicant (and subject to the protection order under Rule No. 262.A R.o.P.) allows for an average value of each of the disputed machines to be estimated at just over €……. This value is an important indication of Oerlikon's interest in this case.
• the guidelines of the Administrative Committee regarding the assessment of the value of the action. In this regard:
➢ consideration must be given to the total value of all the remedies sought (set out here in both the injunction for the future and the compensation for past damage);
➢ with regard to the loss of profits and the profits made by the alleged infringer, it should be noted that:
- there is no clear evidence of the marketing of the disputed machinery in the territory covered by the patent. There is therefore, at present, no clear evidence of damage for loss of profits by the plaintiff and profits
(according to point 1 of the General Principles of the guidelines provided by the Administrative Committee); - the only interfering episode consists of the exhibition at the Fair,
which lasted for four days, as pointed out by the plaintiff and not contested by the defendant during the Interim Conference;
➢ as regards the royalties normally applied in the specific sector, the defendant argued that they correspond to approximately 3% of turnover, an allegation specifically contested by the plaintiff and in respect of which Baghat requested to be allowed to produce documents;
-with regard to the claim for damages, the plaintiff has already requested in this court that the defendant be ordered to pay €100,000.00 to cover the costs to be incurred in the future proceedings on the merits.
In light of all the above considerations, the Judge rapporteur considers, in the context of an assessment that is, as already stated, only provisional and subject to further examination by the Court, also in light of the documents that are authorised to be filed shortly, that the value of the case is €750,000.00. This is for the purpose of determining the scale of the maximum amounts for recoverable costs.
4. Regarding the request for the filing of new documents.
The plaintiff and the defendant also request to be able to file new documents, again in preparation for the review of the value of the case and the Court's review of the defence efforts made, in relation to the assessment of the costs of the proceedings.
These additional documents, which do not introduce new claims or modify those already introduced, as better explained below, shall be admitted.
In order to allow the parties to explore all possibilities for settlement, the deadline for this to be done is set at 20 July 2024.
In order to ensure the right to be heard, both parties shall also be granted time to respond to the opposing party's submissions.
Having regard to rules 105.5, 370.6, R.o.P.
Authorises
- access for both parties to all evidence gathered through the execution of the measure, granting the parties access to the report and documents acquired during the execution of the order to gather evidence - granted before the start of the trial on the merits. and to extract copies, including those stored on a USB stick and kept in a sealed envelope at the Sub.Registry of the Local Division of Milan;
- access shall take place on a date between 2 July 2024 and 4 July 2024 during the Registry's opening hours, by appointment, in the presence of the Judge Rapporteur, delegated for this purpose, and in the presence of a clerk delegated to draw up a report of the operations carried out at the headquarters of the Local Division of Milan.
- for this purpose, orders the expert, after notifying the Registry, to provide two USB sticks with the same content as that already deposited to a clerk assigned to the Sub-Registry of the Local Division, for subsequent collection by the parties' defence counsel, in the manner indicated above;
This shall be done at the local division's headquarters by 25 June 2024, ordering the Registry to immediately notify the expert;
- the parties concerned may file the documentation acquired following access to the expert's report by 11 July 2024.

1. a deadline of 11 July 2024, at 3 p.m., for the filing of:
• -by the plaintiff:
- a copy of the interview given by the defendant's legal representative to the press;

A complete list of all documents filed by each party shall be submitted together with the summary to enable the Court to refer to them during the hearing.
This shall be filed on the CMS via generic application.
Confirmation
The date of the Oral Hearing before the Court is set for 27 September 2024, at 10.30 a.m., in accordance with the provisions of the order issued on 19 February 2024. The parties are informed that it is the Court's intention to conclude the Oral Hearing in one day.
Fixed
The value of the case is set at €750,000.00 for the purposes of applying the scale of maximum reimbursable costs, without prejudice to any different assessment by the Court, also in light of the documentation authorised for filing.
Invites
The parties to promptly notify the Office of the conclusion of any settlement agreements.
Acknowledges
That both an “unredacted” copy and a “redacted” copy of this order shall be filed, the latter with confidential information already protected by this Court pursuant to Rule 262A of the Rules of Procedure redacted.
