LEITSATZ
- Beantragt der Berufungskläger die Rücknahme der Berufung in Bezug auf einen oder zwei von mehreren Berufungsbeklagten, entscheidet das Berufungsgericht über die Zulässigkeit und die Rechtsfolgen eines solchen Antrags. Das Berufungsgericht berücksichtigt dabei, ob den betroffenen Berufungsbeklagten die Berufungsbegründung bereits zugestellt wurde, ob sie darauf bestehen, dass eine Entscheidung über die Berufung auch im Verhältnis zu ihnen ergeht und ob sie ein berechtigtes Interesse an der Entscheidung haben.

Antrag auf Rücknahme einer Berufung in Bezug auf zwei von mehreren Berufungsbeklagten

KURZE DARSTELLUNG DES SACHVERHALTS
1. Mit der beanstandeten Anordnung, in der alle vier Beklagte im Rubrum aufgeführt wurden, hat das Gericht erster Instanz die Anträge von Nera Innovations, die Zustellung der Klageschrift an zwei der Beklagten über Xiaomi DE vorzunehmen, zurückgewiesen. Nera Innovations hat am 7. Mai 2024 eine Berufungsschrift eingereicht, in der alle vier Beklagten des Verfahrens vor dem Gericht erster Instanz aufgeführt waren. Da im im CMS keine Berufungsbeklagten benannt waren, fragte die Kanzlei des Berufungsgerichts an, wer als Berufungsbeklagte gelten sollte. Darauf gab Nera Innovations an, dass alle in der Berufungsschrift aufgeführten Berufungsbeklagten im CMS aufgenommen werden sollten.
2. Die Berufungsschrift sowie die Berufungsbegründung, die am 10. Mai 2024 eingereicht wurde (App_26662/2024) und in der erneut alle vier Beklagten aufgeführt wurden, sind Xiaomi NL und Xiaomi DE per Post zugestellt worden.
3. Am 24. Mai 2024 wurden Nera Innovations, Xiaomi NL und Xiaomi DE zu einer mündlichen Verhandlung geladen.
4. Am 27. Mai 2024 beantragte Nera Innovations die teilweise Rücknahme der Berufung (App_31209/2024) und erklärte, dass sie die Berufung insoweit – und nur insoweit – zurücknehme, als sie sich gegen Xiaomi NL und Xiaomi DE richte, und dass die Berufung in Bezug auf Xiaomi Communications Co., Ltd. und Xiaomi Inc. weiterverfolgt werde.
5. Xiaomi NL und Xiaomi DE wurden aufgefordert, sich schriftlich zu dem Antrag zu äußern. Sie haben am 30. Mai 2024 Stellung genommen.

ANTRÄGE DER PARTEIEN
6. Nera Innovations beantragt die Rücknahme der Berufung in Bezug auf Xiaomi NL und Xiaomi DE und eine Entscheidung des Berufungsgerichts über die gegen Xiaomi Communications Co., Ltd. und Xiaomi Inc. gerichtete Berufung.
7. Xiaomi NL und Xiaomi DE beantragen die Zurückweisung des Antrags auf teilweise Rücknahme der Berufung.

VORBRINGEN DER PARTEIEN
8. Nera Innovations macht geltend: Xiaomi NL und Xiaomi DE, die ihren Sitz in EU-Staaten haben, die am EPG teilnehmen (nämlich Deutschland und die Niederlande), sei die Klageschrift bereits zugestellt worden. Die rechtlichen Rahmenbedingungen für die Zustellung an Xiaomi Communications Co., Ltd. und Xiaomi Inc., deren Hauptsitz in China sei, gelten für sie nicht. Ein Zustellversuch nachR.271(5)(a) VerfO sei für Xiaomi NL und Xiaomi DE nicht unternommen worden. Sie hätten daher kein berechtigtes Interesse an der Teilnahme am Berufungsverfahren, auch nicht "pro socio", sie seien im rechtlichen Sinne auch nicht beschwert, sollte das Berufungsgericht die zu klärende Verfahrensfrage anders beurteilen als die Lokalkammer Hamburg. R.265 VerfO gelte analog. Eine Teilrücknahme sei in R.265 VerfO angelegt, indes in Verbindung mit dem Grundgedanken von R.263.3 VerfO zu sehen. Nach R.263.3 VerfO sei eine Teilrücknahme immer zulässig. Anders als bei einer Rücknahme der gesamten Klage prüfe das Gericht bei einer Teilrücknahme nach R. 263.3 VerfO nicht, ob ein Beklagter ein rechtliches Interesse an einer Entscheidung über den zurückgenommenen Teil der Klage habe. Die Zulässigkeit der teilweisen Klagerücknahme folge auch aus dem Grundsatz der Privatautonomie, wonach der Kläger den Streitgegenstand bestimme und auch berechtigt sei, seine Anträge nachträglich einzuschränken, d.h. teilweise zurückzunehmen.
9. Xiaomi NL und Xiaomi DE machen geltend: Die teilweise Rücknahme der Berufung sei schon in prozessualer Hinsicht unzulässig. Weder R.265 VerfO noch R.263.3 VerfO seien anwendbar. R.265 VerfO regele nur die vollständige Klagerücknahme in objektiver Hinsicht und nicht in subjektiver Hinsicht. R.263.3 VerfO betreffe die Beschränkung eines Klageanspruchs. Nera Innovations gehe es nicht um eine "bedingungslose Beschränkung eines Anspruchs", sondern vielmehr darum, den unveränderten Klagegrund noch besser durchsetzen können, indem Xiaomi NL und Xiaomi DE aus dem Berufungsverfahren herausgedrängt würden. Eine Parteiänderung im Sinne des Ausscheidens könne allenfalls nach R.305.1 (b) VerfO (analog) auf Antrag einer Partei von dem Gericht angeordnet werden. Einen solchen Antrag habe Nera Innovations nicht gestellt. Nach R.222.2 VerfO könne eine Parteiänderung nur mit neuem, nicht verspätetem Tatsachenvortrag erfolgen. Auch bei Anwendung von R.263.3 VerfO müsse die Rücknahme abgelehnt werden. Das berechtigte Interesse des Berufungsbeklagten an einer Entscheidung in der Sache sei im Rahmen einer Teilrücknahme zu prüfen. Jedenfalls habe Xiaomi DE ein berechtigtes Interesse an der Teilnahme am Berufungsverfahren, in dem es um die Frage gehe, ob die Zustellung über die Geschäftsadresse von Xiaomi DE als ständigen oder vorübergehenden Geschäftssitz gemäß R.271.5(a) VerfO erfolgen könne. Die Einlegung der Berufung durch Nera Innovations gegen alle vier Beklagten sei ihre freie Entscheidung, an die sie sich festhalten lassen müsse.

ANORDNUNGSGRÜNDE
10. Es bedarf keiner Entscheidung, ob R.305 VerfO in einem Fall wie dem vorliegenden die Rücknahme einer Berufung gegen einen oder mehrere, aber nicht alle Beklagten im Verfahren vor dem Gericht erster Instanz zulässt. Der Antrag ist bereits aus den folgenden Gründen abzulehnen:

R.263.3 VerfO ist nicht anwendbar, da er eine bedingungslose Beschränkung eines Klageanspruchs in einer Klage zulässt, während der vorliegende Antrag auf Rücknahme nicht auf eine Einschränkung des Klageanspruchs gerichtet ist, sondern auf ein Ausscheiden von Berufungsbeklagten im Berufungsverfahren.
12. Die Rücknahme ist in R.265 VerfO geregelt. Die Regelung hat folgenden Inhalt:
1. Solange noch keine Endentscheidung über eine Klage ergangen ist, kann der Kläger die Rücknahme seiner Klage beantragen. Das Gericht entscheidet über den Antrag nach Anhörung der anderen Partei. Der Rücknahmeantrag wird nicht zugelassen, wenn die andere Partei ein berechtigtes Interesse daran hat, dass das Gericht über die Klage entscheidet.
2. Wird die Rücknahme zugelassen, erlässt das Gericht (a) eine Entscheidung, mit der das Verfahren für beendet erklärt wird; (b) eine Anordnung, dass die Entscheidung in das Register aufgenommen wird; (c) eine Kostenentscheidung gemäß Teil 1 Kapitel 5.
13. R.265 VerfO befindet sich in Teil 5, Kapitel 1 der Verfahrensordnung, der allgemeine Bestimmungen enthält, die sowohl für das Gericht erster Instanz als auch für das Berufungsgericht gelten.
14. Aus dem Wortlaut von R.265 VerfO ergibt sich, dass er in erster Linie im Hinblick auf eine vollständige Rücknahme der Klage formuliert ist. Die Bestimmung unterscheidet nicht zwischen dem Verfahren erster Instanz oder dem Berufungsverfahren. Auch wird nicht zwischen prozessualen Berufungen und Berufungen in der Sache unterschieden. Die Bestimmung schließt nicht aus, dass die Rücknahme für jede Kategorie von Klagen oder jeden Verfahrensabschnitt beantragt werden kann. Die Bestimmung ist somit weit gefasst, was im Zivilprozess sinnvoll ist.
15. Eine Rücknahme steht jedoch unter dem Vorbehalt der Wahrung der Rechte des Berufungsbeklagten und der ordnungsgemäßen Durchführung des Verfahrens. Nach dem Wortlaut von R.265 VerfO liegt es im Ermessen des Gerichts, über einen Antrag auf Rücknahme zu entscheiden ("Das Gericht entscheidet über den Antrag..." und "Wird die Rücknahme zugelassen"). Eindeutig geregelt ist, dass die andere Partei anzuhören ist ("nach Anhörung der anderen Partei") und dass die Interessen der anderen Partei zu berücksichtigen sind ("der Rücknahmeantrag wird nicht zugelassen, wenn die andere Partei ein berechtigtes Interesse daran hat, dass das Gericht über die Klage entscheidet").
16. R.265 VerfO sieht Teilrücknahmen, d.h. Rücknahmen hinsichtlich eines oder zwei von mehreren Beklagten oder Berufungsbeklagten, nicht ausdrücklich vor.
17. In die Abwägung berechtigter Interessen im Falle der Rücknahme von Berufungen ist zunächst einzustellen, dass die Interessen des Berufungsbeklagten von geringerem Gewicht sind, wenn er noch nicht durch die Zustellung der Berufungsschrift am Berufungsverfahren beteiligt worden ist. Dagegen sind die Interessen des Berufungsbeklagten von größerem Gewicht, wenn die Zustellung erfolgt ist. Durch die Zustellung der Berufung wird der Berufungsbeklagte am Berufungsverfahren beteiligt, was in der Regel mit Aufwand und Kosten für die Vorbereitung einer Berufungserwiderung verbunden ist, insbesondere wenn die Berufungsschrift in der Begründung der Berufung enthalten ist oder die Berufungsbegründung bereits zugestellt wurde.
18. Bei der Berücksichtigung der berechtigten Interessen kommt es in erster Linie auf den Inhalt der beanstandeten Anordnung oder der beanstandeten Entscheidung an und darauf, wie sich eine Rücknahme auf den Berufungsbeklagten auswirken würde.
19. Beantragt ein Berufungskläger die Rücknahme einer Berufung in Bezug auf einen oder zwei von mehreren Berufungsbeklagten, entscheidet das Berufungsgericht über die Zulässigkeit und die Rechtsfolgen eines solchen Antrags. Ob eine Berufung in Bezug auf einen oder zwei von mehreren Beklagten zurückgenommen werden kann, hängt von den Umständen des Einzelfalls ab. Obwohl es Situationen geben kann, in denen die Rücknahme einer Berufung in Bezug auf einen oder zwei von mehreren Berufungsbeklagten im gegenseitigen Interesse liegt und das Verfahren vereinfacht, gibt es andere Situationen, in denen berechtigte Interessen und die ordnungsgemäße Durchführung des Verfahrens es erfordern, dass die Berufungsbeklagten im Verfahren verbleiben. Dabei ist auch die Auffassung des Berufungsbeklagten selbst zu berücksichtigen.
20. Im vorliegenden Fall handelt es sich bei dem beim Gericht erster Instanz anhängigen Hauptverfahren um eine Verletzungsklage, die sich gegen vier Beklagte richtet. Zwei der Beklagten wurde die Klageschrift zugestellt, während zwei von ihnen keine Zustellung erhalten haben. Gegenstand der Berufung ist die Ablehnung des Antrags von Nera Innovations, die Zustellung an Xiaomi Communications Co. Ltd. und Xiaomi Inc. über Xiaomi DE vorzunehmen. Xiaomi DE ist Beklagte vor dem Gericht erster Instanz, hat auf die Berufung erwidert und wird durch eine Aufhebung der Anordnung des Gerichts erster Instanz betroffen sein. In diesem Fall wird sie durch die über ihre Unternehmensadresse erfolgte Zustellung an Konzernunternehmen belastet, was zu interner Verantwortlichkeit/Haftung führen kann, da sie die anderen Unternehmen von der erfolgten Zustellung unterrichten muss.
21. Xiaomi NL, die alle Anteile an Xiaomi DE besitzt, ist Beklagte vor dem Gericht erster Instanz, hat auf die Berufung erwidert und wird indirekt vom Ausgang der Berufung betroffen sein, da er den Verlauf und die Dauer des Verfahrens vor dem Gericht beeinflussen wird. Der letztgenannte Aspekt gilt auch in Bezug auf Xiaomi DE.
22. Aus all diesen Gründen haben Xiaomi NL und Xiaomi DE in der vorliegenden Rechtssache ein Interesse daran, sich in Bezug auf den angefochtenen Zustellungsantrag zu verteidigen. Die Zulassung der teilweisen Rücknahme würde zu einer Versagung des rechtlichen Gehörs von Xiaomi DE und Xiaomi NL führen. Der Antrag auf Rücknahme der Berufung in Bezug auf Xiaomi NL und Xiaomi DE ist abzulehnen.

ANORDNUNG
Der Antrag von Nera Innovations auf Rücknahme der Berufung in Bezug auf Xiaomi NL und Xiaomi DE wird zurückgewiesen.

Application for withdrawal of an appeal in relation to two of several respondents

BRIEF STATEMENT OF THE FACTS
1. In the contested order, in which all four defendants were listed in the rubrum, the Court of First Instance rejected Nera Innovations' requests to serve the statement of claim on two of the defendants via Xiaomi DE. On 7 May 2024, Nera Innovations filed a notice of appeal listing all four defendants in the proceedings before the court of first instance. Since no respondents were named in the CMS, the law firm of the court of appeal asked who should be considered respondents. Nera Innovations then stated that all respondents listed in the notice of appeal should be included in the CMS.
2. The notice of appeal and the statement of grounds for appeal, which were filed on 10 May 2024 (App_26662/2024) and again listed all four defendants, were served on Xiaomi NL and Xiaomi DE by post.

3. On 24 May 2024, Nera Innovations, Xiaomi NL and Xiaomi DE were summoned to a hearing.

4. On 27 May 2024, Nera Innovations applied for partial withdrawal of the appeal (App_31209/2024) and stated that it was withdrawing the appeal insofar as – and only insofar as – it was directed against Xiaomi NL and Xiaomi DE, and that the appeal would be pursued with regard to Xiaomi Communications Co., Ltd. and Xiaomi Inc.

5. Xiaomi NL and Xiaomi DE were invited to comment on the application in writing. They submitted their comments on 30 May 2024.

APPLICATIONS BY THE PARTIES
6. Nera Innovations requests that the appeal be withdrawn in relation to Xiaomi NL and Xiaomi DE and that the Court of Appeal rule on the appeal against Xiaomi Communications Co., Ltd. and Xiaomi Inc.
7. Xiaomi NL and Xiaomi DE request that the application for partial withdrawal of the appeal be dismissed.


ARGUMENTS OF THE PARTIES
8. Nera Innovations asserts that Xiaomi NL and Xiaomi DE, which are based in EU countries participating in the EPG (namely Germany and the Netherlands), have already been served with the statement of claim. The legal framework for service on Xiaomi Communications Co., Ltd. and Xiaomi Inc., whose headquarters are in China, does not apply to them. No attempt at service pursuant to R.271(5)(a) VerfO was made on Xiaomi NL and Xiaomi DE. They therefore have no legitimate interest in participating in the appeal proceedings, not even ‘pro socio’, nor are they legally affected if the Court of Appeal assesses the procedural issue to be clarified differently from the Hamburg Local Chamber. R.265 VerfO applies analogously. A partial withdrawal is provided for in R.265 VerfO, but must be seen in conjunction with the basic idea of R.263.3 VerfO. According to R.263.3 VerfO, a partial withdrawal is always permissible. Unlike in the case of a withdrawal of the entire action, the court does not examine whether a defendant has a legal interest in a decision on the withdrawn part of the action in the case of a partial withdrawal under R. 263.3 VerfO. The admissibility of partial withdrawal of the action also follows from the principle of private autonomy, according to which the plaintiff determines the subject matter of the dispute and is also entitled to subsequently restrict its claims, i.e. to withdraw them in part.
9. Xiaomi NL and Xiaomi DE argue that the partial withdrawal of the appeal is inadmissible from a procedural point of view. Neither R.265 VerfO nor R.263.3 VerfO are applicable. R.265 VerfO only regulates the complete withdrawal of an action from an objective point of view and not from a subjective point of view. R.263.3 VerfO concerns the restriction of a claim. Nera Innovations is not seeking an ‘unconditional restriction of a claim’, but rather to be able to enforce the unchanged cause of action even more effectively by forcing Xiaomi NL and Xiaomi DE out of the appeal proceedings. A change of party in the sense of withdrawal could, at most, be ordered by the court at the request of one of the parties pursuant to R.305.1 (b) VerfO (by analogy). Nera Innovations had not made such a request. According to R.222.2 VerfO, a change of party could only be made with new, non-belated submission of facts. Even if R.263.3 VerfO were applied, the withdrawal would have to be rejected. The legitimate interest of the respondent in a decision on the merits had to be examined in the context of a partial withdrawal. In any case, Xiaomi DE has a legitimate interest in participating in the appeal proceedings, which concern the question of whether service can be effected via the business address of Xiaomi DE as its permanent or temporary place of business in accordance with R.271.5(a) VerfO. The decision by Nera Innovations to lodge an appeal against all four defendants is its own free decision, which it must be allowed to uphold.

GROUNDS FOR THE ORDER
10. There is no need to decide whether R.305 VerfO permits the withdrawal of an appeal against one or more, but not all, of the defendants in proceedings before the court of first instance in a case such as the present one. The application must be rejected for the following reasons:

11. R.263.3 VerfO is not applicable because it allows an unconditional restriction of a claim in an action, whereas the present application for withdrawal is not aimed at restricting the claim but at removing the respondents from the appeal proceedings.

12. Withdrawal is governed by R.265 VerfO. The provision reads as follows:
1. As long as no final decision has been made on an action, the plaintiff may request that the action be withdrawn. The court shall decide on the request after hearing the other party. The application for withdrawal shall not be granted if the other party has a legitimate interest in the court deciding on the action.
2. If the withdrawal is granted, the court shall (a) issue a decision declaring the proceedings closed; (b) order that the decision be entered in the register; (c) make a decision on costs in accordance with Part 1, Chapter 5.

13. R.265 VerfO is located in Part 5, Chapter 1 of the Rules of Procedure, which contains general provisions applicable to both the court of first instance and the court of appeal.
14. It is clear from the wording of R.265 VerfO that it is primarily formulated with a view to the complete withdrawal of the action. The provision does not distinguish between proceedings at first instance and appeal proceedings. Nor does it distinguish between procedural appeals and appeals on the merits. The provision does not preclude the withdrawal of the action from being requested for any category of action or any stage of the proceedings. The provision is therefore broad in scope, which is appropriate in civil proceedings.

15. However, withdrawal is subject to the preservation of the rights of the respondent and the proper conduct of the proceedings. According to the wording of R.265 VerfO, it is at the discretion of the court to decide on an application for withdrawal (‘The court shall decide on the application...’ and ‘If withdrawal is granted’). It is clearly stipulated that the other party must be heard (‘after hearing the other party’) and that the interests of the other party must be taken into account (‘the application for withdrawal shall not be granted if the other party has a legitimate interest in the court deciding on the action’).
16. R.265 VerfO does not expressly provide for partial withdrawals, i.e. withdrawals with regard to one or two of several defendants or respondents, are not expressly provided for.
17. When weighing up legitimate interests in the event of the withdrawal of appeals, it must first be taken into account that the interests of the respondent are of lesser importance if he has not yet been involved in the appeal proceedings by the service of the appeal. On the other hand, the interests of the respondent are of greater weight if service has been effected. Service of the appeal involves the respondent in the appeal proceedings, which generally entails effort and costs for the preparation of a response to the appeal, in particular if the notice of appeal is contained in the grounds of appeal or if the grounds of appeal have already been served.

18. When considering the legitimate interests, the content of the contested order or decision and the effect that a withdrawal would have on the respondent are of primary importance.

19. If an appellant requests the withdrawal of an appeal in relation to one or two of several respondents, the court of appeal shall decide on the admissibility and legal consequences of such a request. Whether an appeal can be withdrawn in relation to one or two of several respondents depends on the circumstances of the individual case. Although there may be situations in which the withdrawal of an appeal in relation to one or two of several respondents is in the mutual interest and simplifies the proceedings, there are other situations in which legitimate interests and the proper conduct of the proceedings require that the respondents remain in the proceedings. The opinion of the respondent itself must also be taken into account.

20. In the present case, the main proceedings pending before the court of first instance are infringement proceedings brought against four defendants. Two of the defendants were served with the statement of claim, while two of them did not receive service. The appeal concerns the rejection of Nera Innovations' request that service be effected on Xiaomi Communications Co. Ltd. and Xiaomi Inc. via Xiaomi DE. Xiaomi DE is the defendant before the court of first instance, has responded to the appeal and will be affected by a reversal of the order of the court of first instance. In that event, it will be burdened by service on group companies via its business address, which may give rise to internal responsibility/liability, as it must inform the other companies of the service effected.

21. Xiaomi NL, which owns all the shares in Xiaomi DE, is the defendant before the court of first instance, has responded to the appeal and will be indirectly affected by the outcome of the appeal, as it will influence the course and duration of the proceedings before the court. The latter aspect also applies to Xiaomi DE.

22. For all these reasons, Xiaomi NL and Xiaomi DE have an interest in defending themselves in the present case with regard to the contested request for service. To allow the partial withdrawal would result in a denial of the right to a fair hearing for Xiaomi DE and Xiaomi NL. The application for withdrawal of the appeal in relation to Xiaomi NL and Xiaomi DE must be rejected.

ORDER
Nera Innovations' application for withdrawal of the appeal in relation to Xiaomi NL and Xiaomi DE is dismissed.
