VERFAHRENSSPRACHE Deutsch

GEGENSTAND DES VERFAHRENS Antrag der Klägerin auf Anordnung der Vorlage gegen sich selbst (Regeln 9, 172.2 VerfO) und Geheimhaltungsantrag nach Regel 262A VerfO sowie Gegenantrag der Beklagten

SACHVERHALT Die Klägerin nimmt die Beklagten wegen Verletzung des EP 3 611 989 in Anspruch. Sie trägt vor, dass dieses Patent essenziell für den Wi-Fi 6-Standard sei. Die Beklagten verteidigen sich u.a. mit dem kartellrechtlichen Zwangslizenzeinwand. Die Klägerin möchte einen kürzlich am 05/03/2024 mit Amazon abgeschlossenen Lizenzvertrag betreffend das Wi-Fi-Patentportfolio der Klägerin in das Verfahren einführen und trägt hierzu vor, dass ihr dies aus näher ausgeführten Gründen nur aufgrund einer gerichtlichen Anordnung und unter Gewährleistung gerichtlichen Geheimnisschutzes wie beantragt möglich sei.

Die Klägerin beantragt:
1. Die Klägerin hat nach Zustellung dieser Vorlageanordnung, mit Einreichung der Triplik am 2. Mai 2024, eine ungeschwärzte Kopie des Lizenzvertrages zwischen Huawei Technologies Co. Ltd. und Amazon.com Inc., welcher am 5. März 2024 öffentlich bekanntgegeben wurde, vorzulegen.
2. Die Inhalte dieses Lizenzvertrages werden als geheimhaltungsbedürftig eingestuft (R. 262.2 VerfO, R. 262A.1 VerfO), und gem. R. 262A.1 und 6 VerfO wird der Zugang zu dem Lizenzvertrag beschränkt auf:
a die Prozessbevollmächtigten der Parteien in dem hiesigen Klageverfahren,
b. Anna Lam, Vice President Legal, Netgear Inc., die mit den hiesigen Klageverfahren und/oder den Lizenzvertragsverhandlungen zwischen den Parteien befasst ist.
c. externe Sachverständige (einschließlich ihrer Teammitglieder), die die Parteien in den Verfahren zur FRAND-Fragen unterstützen.
3. die in dem Antrag auf gerichtliche Vorlageanordnung vom 23. April 2024 enthaltenen Ausführungen, insbesondere die grau hinterlegten Informationen sowie die hierzu überreichten und mit dem Hinweis "CONFIDENTIAL" oder "geheimhaltungsbedürftig" versehenen Anlagen, Abbildungen und Übersichten, die insgesamt tabellarisch wie folgt zusammengefasst sind, als geheimhaltungsbedürftig einzustufen (R.262.2):
und anzuordnen, dass sie von den Beklagten streng vertraulich zu behandeln sind und von ihr nicht außerhalb dieses Verfahrens genutzt oder offengelegt werden dürfen, es sei denn, dass sie von diesen Informationen außerhalb dieses Verfahrens Kenntnis erlangt hat (R. 262A); 4. anzuordnen, dass die Verpflichtung nach Ziff. 3 auch nach Abschluss dieses Verfahrens fort gilt, wobei dies nicht gilt, wenn das Gericht die Geheimhaltungsbedürftigkeit dieser Informationen durch rechtskräftige Entscheidung oder Anordnung verneint hat oder sobald die streitgegenständlichen Informationen für Personen in den Kreisen, die üblicherweise mit solchen Informationen umgehen, bekannt oder ohne Weiteres zugänglich werden.
5. für den Fall der Erörterung dieses Sachvortrages in der Zwischenanhörung und/oder der mündlichen Verhandlung anzuordnen,
a. die Öffentlichkeit wegen Gefährdung schutzwürdiger Interessen der Parteien für diesen Teil der Zwischenanhörung und/oder mündlichen Verhandlung gemäß Art. 45 EPGÜ i.V.m. R. 115 VerfO auszuschließen, soweit geheimhaltungsbedürftige Informationen nach Ziff. 3 erörtert werden; die bei der Zwischenanhörung und/oder mündlichen Verhandlung anwesenden Personen einschließlich der Parteivertreter, ihrer Prozessbevollmächtigten und der zur Mitwirkung an dem Rechtsstreit bestellten Patentanwälte zu verpflichten, Tatsachen, welche die nach Ziff. 3 benannten Ausführungen betreffen oder die Ausführungen in der Zwischenanhörung und/oder der mündlichen Verhandlung erstmals zu ihrer Kenntnis gelangen, gegenüber Dritten geheim zu halten, und nur zum Zweck der Prozessführung im vorliegenden Verfahren zu verwenden;
b. die Öffentlichkeit für einen Teil der Verkündung der Urteilsgründe auszuschließen, soweit geheimhaltungsbedürftige Informationen nach Ziff. 3 erörtert werden;
6. die geheimhaltungsbedürftigen Informationen nach Ziff. 3 von der Akteneinsicht durch Dritte auszuschließen (Art. 58 EPGÜ i.V.m. R. 262.1 lit. b), 262.2 VerfO);
7. vor der Veröffentlichung der Urteilsgründe oder sonstiger Bekanntmachungen alle darin enthaltenen Informationen, die unter Ziff. I fallen, gemäß R. 262.1 lit. a), 262.2 VerfO zu schwärzen.
Mit vorläufiger Anordnung vom 25/04/2024 wurde die Vorlage angeordnet und vorläufiger Geheimnisschutz wie beantragt gewährt. Die Beklagten haben am 29/04/2024 hierzu Stellung genommen. Sie beantragen: Die Verwendung des Lizenzvertrages und der darin enthaltenen vertraulichen Informationen auch im abgetrennten Verfahren zu EP 3 678 321 (ACT_18917/2024 UPC_CFI_168/2024) zuzulassen. Die Klägerin hat mit Schriftsatz vom 07/05/2024 den Vertrag vorgelegt und ausgeführt, dass gegen eine Verwendung der in dem Verfahren 459771/2023 vorgelegten Lizenzverträge in dem Parallelverfahren betreffend das Klagepatent EP'321 (Az. 587438/2024) keine Einwände erhoben werden, da die in diesem Verfahren (EP‘989) getroffenen Anordnungen zum Schutz der vertraulichen Informationen auch in jenem Verfahren gelten.

GRÜNDE
Unter Verweis auf die Ausführungen der Lokalkammer Mannheim in der Anordnung vom 30/04/2024 (UPC_CFI_ 218/2023; App_14035/2024) sind Anordnungen gegen die beantragende Partei selbst jedenfalls gem. Regel 103 VerfO möglich. Da dies vorliegend zwischen den Parteien – ebenso wie der beantragte Geheimnisschutz- außer Streit steht, sind keine weiteren Ausführungen hierzu veranlasst.

ANORDNUNG
1. Die vorläufigen Anordnungen zur Vorlage und zum Geheimnisschutz werden bestätigt.
2. Die Verwendung des Lizenzvertrages und der darin enthaltenen vertraulichen Informationen wird auch im abgetrennten Verfahren zu EP 3 678 321 (ACT_18917/2024 UPC_CFI_168/2024) zugelassen.

SUBJECT MATTER OF THE PROCEEDINGS Application by the applicant for an order for referral against itself (Rules 9, 172.2 VerfO) and application for confidentiality pursuant to Rule 262A VerfO, as well as counter-application by the defendant

FACTS The plaintiff is suing the defendants for infringement of EP 3 611 989. It argues that this patent is essential for the Wi-Fi 6 standard. The defendants defend themselves, among other things, with the antitrust compulsory licence objection. The plaintiff wishes to introduce into the proceedings a licence agreement recently concluded with Amazon on 5 March 2024 concerning the plaintiff's Wi-Fi patent portfolio and submits in this regard that, for reasons set out in detail, this is only possible on the basis of a court order and with a guarantee of judicial confidentiality as requested.

The plaintiff requests:

1. After service of this order to submit evidence, the plaintiff shall submit an unredacted copy of the licence agreement between Huawei Technologies Co. Ltd. and Amazon.com Inc., which was publicly announced on 5 March 2024, with the submission of the rejoinder on 2 May 2024.

2. The contents of this licence agreement are classified as confidential (R. 262.2 VerfO, R. 262A.1 VerfO), and pursuant to R. 262A.1 and 6 VerfO, access to the licence agreement is restricted to:
a the legal representatives of the parties in the present proceedings,

b. Anna Lam, Vice President Legal, Netgear Inc., who is involved in the present proceedings and/or the licence agreement negotiations between the parties.
c. external experts (including their team members) who are assisting the parties in the proceedings on FRAND issues.

3. the statements contained in the application for a court order of 23 April 2024, in particular the information highlighted in grey and the annexes submitted in this regard and marked ‘CONFIDENTIAL’ or ‘subject to confidentiality’ , which are summarised in tabular form as follows, as confidential (R.262.2):

and order that they be treated as strictly confidential by the defendants and may not be used or disclosed by them outside these proceedings, unless they have obtained knowledge of this information outside these proceedings (R. 262A); 4. order that the obligation under point 3 shall continue to apply even after the conclusion of these proceedings, unless the court has denied the confidentiality of this information by a final decision or order, or as soon as the information in dispute becomes known or readily accessible to persons within the circles that normally deal with such information.

5. in the event that this statement of facts is discussed in the interim hearing and/or the oral hearing, to order
a. that the public be excluded from this part of the interim hearing and/or oral hearing pursuant to Art. 45 EPGÜ in conjunction with Rule 115 of the Rules of Procedure, insofar as information subject to confidentiality pursuant to point 3 is discussed; to oblige the persons present at the interim hearing and/or oral proceedings, including the parties' representatives, their legal representatives and the patent attorneys appointed to participate in the legal dispute, to keep secret from third parties any facts which relate to the statements referred to in point 3 or which come to their knowledge for the first time in the interim hearing and/or oral proceedings, and to use them only for the purposes of the proceedings in the present case; 3 or which come to their knowledge for the first time during the interim hearing and/or the oral proceedings, and to use them only for the purposes of the proceedings in the present case;
b. to exclude the public from part of the pronouncement of the grounds for the judgment insofar as information requiring confidentiality pursuant to point 3 is discussed;

6. to exclude the information subject to confidentiality pursuant to Section 3 from inspection of the files by third parties (Art. 58 EPGÜ in conjunction with R. 262.1 lit. b), 262.2 VerfO);

7. Before publishing the grounds for the judgment or any other announcements, to redact all information contained therein that falls under point I in accordance with Rules 262.1(a) and 262.2 of the Rules of Procedure.

By provisional order of 25/04/2024, the referral was ordered and provisional confidentiality protection was granted as requested. The defendants commented on this on 29/04/2024. They request that the use of the licence agreement and the confidential information contained therein also be permitted in the separate proceedings concerning EP 3 678 321 (ACT_18917/2024 UPC_CFI_168/2024). In its written submission of 7 May 2024, the plaintiff submitted the agreement and stated that no objections are raised to the use of the licence agreements submitted in proceedings 459771/2023 in the parallel proceedings concerning the patent in suit EP'321 (Ref. 587438/2024), as the orders made in those proceedings (EP'989) for the protection of confidential information also apply in those proceedings.

REASONS
With reference to the statements of the Local Chamber of Mannheim in its order of 30 April 2024 (UPC_CFI_ 218/2023; App_14035/2024), orders against the applicant itself are in any case possible pursuant to Rule 103 of the Rules of Procedure. Since this is not disputed between the parties in the present case, as is the case with the requested protection of secrets, no further comments are necessary.

ORDER
1. The provisional orders for submission and protection of secrets are confirmed.

2. The use of the licence agreement and the confidential information contained therein is also permitted in the separate proceedings relating to EP 3 678 321 (ACT_18917/2024 UPC_CFI_168/2024).
