VERZOEK EN ACHTERGROND
1. De vertegenwoordiger van verzoekster heeft op 5 maart 2024 een verzoek ingediend tot intrekking van de procedure op de voet van regel 265 van de ‘Rules of Procedure’ van het Eengemaakt Octrooigerecht (hierna respectievelijk “RoP” en “UPC”). In dit verzoek, hierna “het verzoek”, is het volgende opgenomen:
Eiseres verzoekt het Eengemaakt Octrooigerecht met de meeste eerbied om permissie om de hierboven geïdentificeerde actie volledig in te trekken.
Overeenkomstig Regel 265 van het Reglement voor de procesvoering, verzoekt eiseres het Eengemaakt Octrooigerecht meer bepaald:
- een beslissing te wijzen waarin de procedure gesloten wordt verklaard;
- te bevelen dat deze beslissing in het Register wordt ingeschreven;
- te bevelen dat elke partij haar eigen kosten zal dragen, onverminderd de toepassing van Regel 270.9(b) van het Reglement voor de procesvoering.
Deze intrekking gebeurt met de instemming van verweerster.
Een teruggave van 60% van het vast recht onder Regel 270.9(b) van het Reglement voor de procesvoering wordt geacht van toepassing te zijn, aangezien de actie wordt ingetrokken vóór het einde van de schriftelijke procedure.
2. Verweerster is bij tussentijdse beslissing van 18 maart 2024, op grond van regel 265.1 RoP, in de gelegenheid gesteld om op uiterlijk vrijdag 22 maart 2024 te reageren op het intrekkingsverzoek en op het verzoek tot het nemen van een beslissing over de proceskosten waarbij iedere partij de eigen kosten draagt.
3. Wegens kennelijke problemen met het digitale ‘case management systeem’ (“CMS”) heeft verweerster pas op 22 april 2024 gereageerd in de daartoe bestemde workflow in het CMS. Daarin berichte zij onder meer het volgende:
Verweerster stemt in met het door eiseres ingediende intrekkingsverzoek.
Verweerster stemt in met het verzoek tot het nemen van een beslissing over de proceskosten, waarbij wordt bevolen dat elke partij haar eigen kosten draagt.
Verweerster heeft diverse pogingen ondernomen om deze reactie op het intrekkingsverzoek neer te leggen bij het Eengemaakt Octrooigerecht via de website van het Eengemaakt Octrooigerecht.
Door technische problemen was dit niet mogelijk. Enerzijds kon verweerster het document niet als PDF/A document bewaren door diverse problemen met Adobe. Anderzijds kreeg verweerster geen toegang tot het case management systeem van het Eengemaakt octrooigerecht.
4. Uit de aangehechte bijlage blijkt dat verweerster de reactie op het intrekkingsverzoek op 22 maart 2024 via e-mail heeft gestuurd aan het UPC naar het e-mailadres upc-cms-sa@unifiedpatentcourt.org, met de melding dat zij niet in staat was het bericht te uploaden en weergave van screenshots van de foutmeldingen die zij daarbij kreeg. Dit bericht heeft de JR pas op 23 april 2024, als bijlage bij dit verzoek, bereikt.

OVERWEGINGEN
5. De vertraging van de reactie van verweerster is kennelijk te wijten aan problemen met het CMS, en heeft geen gevolgen voor de rechtspositie van verzoekster (behalve vertraging). De reactie wordt dan ook in dit geval, mede gelet op de tijdige indiening per email, beschouwd als tijdig ingediend.
6. Het eenstemmig intrekkingsverzoek van partijen wordt ingewilligd en de inbreukprocedure UPC_CFI_379/2023 ACT_ 581723/2023 wordt daarmee beëindigd (regel 265.2(a) RoP). Ook het verzoek te bevelen dat die beslissing wordt ingeschreven in het register van het Eengemaakt Octrooi Gerecht wordt toegewezen conform regel 265.2(b) RoP.
7. Het eenstemmig verzoek om te bevelen dat iedere partij de eigen kosten draagt, is ook toewijsbaar.
8. Het gerecht begrijpt het verzoek voorts in die zin dat, naast het in de vorige alinea genoemde bevel, verzoekster met de verwijzing naar de toepassing van ‘Regel 270.9(b)’ een aanvraag bedoelt in te dienen tot gedeeltelijke teruggave van door haar aan het UPC betaalde griffierechten op grond van regel 370.9 en 11 RoP. Nu regel 270.9(b) RoP niet bestaat, is kennelijk 370.9(b) RoP bedoeld in het verzoek; in die paragraaf is de restitutie van griffierechten geregeld. Het gerecht zal dit verzoek in behandeling nemen, ook al is het niet via een afzonderlijke workflow ingediend, om nadere proceshandelingen te voorkomen.
9. Regel 370 RoP luidt, voor zover hier van belang:

9. Fixed and value-based fees may be reimbursed as follows:
(a) (…)
(b) In case of the withdrawal of an action [Rule 265] the party liable for the Court fees will be reimbursed by:
(i) 60 % if the action is withdrawn before the closure of the written procedure
(ii) 40 % if the action is withdrawn before the closure of the interim procedure
(iii) 20 % if the action is withdrawn before the closure of the oral procedure
(c) If the parties have concluded their action by way of settlement the party liable for the Court fees will be reimbursed by:
(i) 60 % if the action is settled before the closure of the written procedure
(ii) 40 % if the action is settled before the closure of the interim procedure
(iii) 20 % if the action is settled before the closure of the oral procedure
(d) Only one of the reimbursements referred to in paragraph 9 (a), (b) and (c) will apply per action and party. Where more than one reimbursement is applicable, the larger will be applied for each party. (e) In exceptional cases, having regard, in particular, to the stage of the proceedings and the procedural behaviour of the party, the Court may deny or decrease the reimbursement payable according to paragraph 9 (b) and (c) of the aforementioned provisions.

11. The party seeking reimbursement under paragraphs 9 and 10 shall lodge a reasoned Application for reimbursement to the Court. The Court shall deal with the application without delay and if satisfied that the reimbursement is appropriate shall direct the Registrar to make the payment as soon as practicable.

10. In dit geval wordt de procedure beëindigd door beslissing op het ‘withdrawal’-verzoek van verzoekster in de zin van regel 265 RoP. Dat verzoek vloeit voort uit een tussen partijen getroffen schikking. Het panel acht de teruggave van een deel van het griffierecht in dit geval passend in de zin van regel 370.11 RoP. Het verzoek om restitutie zal dan ook worden toegewezen. Nu de zaak wordt beëindigd in een vroeg stadium, te weten na het uitbrengen van de dagvaarding en vóór het indienen van een antwoord door gedaagde, en dus vóórdat de ‘written procedure’ is gesloten, zal 60% van de betaalde griffierechten worden terugbetaald. Dit volgt uit regel 370.9(b) RoP, waarop verzoekster zich beroept.

BESLISSING
1. Verklaart zaak UPC_CFI_379/2023, met CMS-nummer ACT_ 581723/2023, beëindigd conform regel 265.2 onder (a) RoP;
2. Beveelt dat deze beslissing wordt ingeschreven in het register van het UPC conform regel 265.2 onder (b) RoP;
3. Beveelt dat elke partij haar eigen kosten draagt;
4. Beveelt de griffie om 60% van het betaalde griffierecht aan eisende partij te restitueren volgens regel 370.9 en 11 RoP.

REQUEST AND BACKGROUND
1. On 5 March 2024, the representative of the applicant filed a request for withdrawal of the proceedings pursuant to Rule 265 of the Rules of Procedure of the Unified Patent Court (hereinafter referred to as ‘RoP’ and “UPC” respectively). This request, hereinafter referred to as ‘the request’, contains the following:

The claimant respectfully requests the Unified Patent Court to grant permission to withdraw the action identified above in its entirety.
In accordance with Rule 265 of the Rules of Procedure, the claimant specifically requests the Unified Patent Court:
- to issue a decision declaring the proceedings closed;

- order that this decision be entered in the Register;
- order that each party bear its own costs, without prejudice to the application of Rule 270.9(b) of the Rules of Procedure.
This withdrawal is made with the consent of the defendant.

A refund of 60% of the fixed fee under Rule 270.9(b) of the Rules of Procedure shall be deemed applicable, since the action is withdrawn before the end of the written procedure.

2. By interim decision of 18 March 2024, pursuant to Rule 265.1 RoP, the defendant was given the opportunity to respond to the request for withdrawal and to the request for a decision on the costs of the proceedings, with each party bearing its own costs, by Friday 22 March 2024 at the latest.

3. Due to apparent problems with the digital case management system (‘CMS’), the defendant did not respond in the designated workflow in the CMS until 22 April 2024. In its response, it stated, among other things, the following:
The defendant agrees with the request for withdrawal submitted by the claimant.

The defendant agrees to the request for a decision on the costs of the proceedings, ordering each party to bear its own costs.
The defendant made several attempts to submit this response to the withdrawal request to the Unified Patent Court via the Unified Patent Court website.

This was not possible due to technical problems. On the one hand, the defendant was unable to save the document as a PDF/A document due to various problems with Adobe. On the other hand, the defendant was unable to access the case management system of the Unified Patent Court.

4. The attached appendix shows that the defendant sent its response to the request for withdrawal on 22 March 2024 by email to the UPC at the email address upc-cms-sa@unifiedpatentcourt.org, stating that it was unable to upload the message and providing screenshots of the error messages it received. This message did not reach the JR until 23 April 2024, as an attachment to this request.


CONSIDERATIONS
5. The delay in the defendant's response is apparently due to problems with the CMS and has no consequences for the legal position of the applicant (except for the delay). The response is therefore considered to have been submitted in time in this case, also in view of the timely submission by email.
6. The unanimous request for withdrawal by the parties is granted and the infringement proceedings UPC_CFI_379/2023 ACT_ 581723/2023 are therefore terminated (Rule 265.2(a) RoP). The request to order that this decision be entered in the register of the Unified Patent Court is also granted in accordance with Rule 265.2(b) RoP.
7. The unanimous request to order each party to bear its own costs is also granted.

The court further understands the request to mean that, in addition to the order referred to in the previous paragraph, the applicant, by referring to the application of “Rule 270.9(b)”, intends to submit an application for partial reimbursement of the court fees paid by it to the UPC pursuant to Rules 370.9 and 11 RoP. Since Rule 270.9(b) RoP does not exist, Rule 370.9(b) RoP is apparently meant in the request; that paragraph regulates the refund of court fees. The court will consider this request, even though it was not submitted via a separate workflow, in order to avoid further procedural steps.

9. Rule 370 of the Rules of Procedure reads, in so far as relevant:
(…)
9. Fixed and value-based fees may be reimbursed as follows:

(b) In case of the withdrawal of an action [Rule 265] the party liable for the Court fees will be reimbursed by:

(i) 60 % if the action is withdrawn before the closure of the written procedure

11. The party seeking reimbursement under paragraphs 9 and 10 shall lodge a reasoned Application for reimbursement with the Court. The Court shall deal with the application without delay and, if satisfied that the reimbursement is appropriate, shall direct the Registrar to make the payment as soon as practicable.

10. In this case, the proceedings are terminated by decision on the applicant's request for withdrawal within the meaning of Rule 265 RoP. That request arises from a settlement reached between the parties. The panel considers the refund of part of the court fees to be appropriate in this case within the meaning of Rule 370.11 RoP. The request for reimbursement will therefore be granted. Since the case is being terminated at an early stage, namely after the summons has been issued and before the defendant has submitted a response, and therefore before the written procedure has been closed, 60% of the court fees paid will be refunded. This follows from Rule 370.9(b) RoP, on which the applicant relies.

DECISION
1. Declares case UPC_CFI_379/2023, with CMS number ACT_ 581723/2023, terminated in accordance with Rule 265.2(a) RoP;

2. Orders that this decision be entered in the register of the UPC in accordance with Rule 265.2(b) of the Rules of Procedure;
3. Orders each party to bear its own costs;
4. Orders the Registry to refund 60% of the court fees paid to the claimant in accordance with Rules 370.9 and 11 of the Rules of Procedure.
