VERFAHRENSSPRACHE Deutsch

GEGENSTAND DES VERFAHRENS Vorlageantrag der Beklagten nach Regel 190 VerfO und Geheimhaltungsanordnungen nach Regel 262A VerfO

SACHVERHALT Die Klägerin nimmt die Beklagten wegen Verletzung des EP 3 611 989 in Anspruch. Sie trägt vor, dass dieses Patent essenziell für den Wi-Fi 6-Standard sei. Die Beklagten verteidigen sich u.a. mit dem Erschöpfungseinwand. Sie tragen insoweit vor, dass manche der angegriffenen Ausführungsformen einen Chip von Qualcomm aufwiesen. Die Klägerin habe mit Qualcomm einen Lizenzvertrag geschlossen, der auch die Wi-Fi 6-Standard-Patente der Klägerin umfasse. Dieser Lizenzvertrag liege ihr zwar bereits aufgrund eines US-Discovery-Verfahrens vor. Allerdings dürfe sie den Vertrag aufgrund der vom US-Gericht
angeordneter Beschränkungen im hiesigen Verfahren nicht vorlegen oder zu den Details vortragen. Das US-Gericht habe sie im Zusammenhang mit einem Antrag, die Vorlage auch in diesem Verfahren zu gestatteten, darauf verwiesen, im hiesigen Verfahren einen Vorlageantrag zu stellen. Die Beklagten beantragen: 1. die Vorlage des Lizenzvertrages zwischen dem Unternehmen Qualcomm Corp. und der Klägerin aus August 2020, der auch Gegenstand des Berufungsverfahrens vor dem OLG Düsseldorf (Az. I-2 U 63/23) ist, durch die Klägerin binnen 5 Werktagen nach Zustellung der Anordnung anzuordnen; und
2. empfindliche Zwangsgelder (Art. 82 (4) EPGÜ) für jeden Tag der Zuwiderhandlung und sonstige Sanktionen nach Regel 190.4 (b) VerfO EPG gegen die Klägerin im Falle der Zuwiderhandlung gegen die nach Antrag 1. zu treffende Vorlageanordnung zu verhängen, deren konkrete Ausgestaltung ins Ermessen des Gerichts gestellt wird.
Die Klägerin beantragt: 1. den Antrag der Beklagten auf Anordnung der Vorlage des Lizenzvertrages zwischen dem Unternehmen Qualcomm Corp. und der Klägerin aus August 2020 durch die Klägerin zurückzuweisen.
Hilfsweise beantragen wir,
2. die Vorlage … des Lizenzvertrages zwischen dem Unternehmen Qualcomm Corp. und der Klägerin aus August 2020 durch die Klägerin binnen 10 Werktagen nach Zustellung der Anordnung mit der Maßgabe anzuordnen,
a. den Inhalt dieses Lizenzvertrages als geheimhaltungsbedürftig einzustufen (R. 262.2 VerfO, R. 262A.1 VerfO);
b. der Klägerin zu gestatten, solche Auszüge aus dem Lizenzvertrag zu schwärzen, auf die sich die Tatsachenbehauptungen der Beklagten nicht stützen
können;
c. den Inhalt des Lizenzvertrages auf Seiten der Beklagten nur
• den Prozessbevollmächtigten, und
• deren Hilfspersonen (einschließlich Experten sowie ihrer Teammitglieder) zur Kenntnis bringen zu dürfen;
d. dass die Beklagte und die vorstehend genannten Personen nach rechtskräftiger Beendigung des Verfahrens die vertraulichen Informationen nach Ziffer 2.a vernichten;
e. die Parteien und die unter Ziffer 2.c genannten Personen zu verpflichten, die vertraulichen Informationen nach Ziffer 2.a über das Verfahren hinaus streng vertraulich zu behandeln und die vertraulichen Informationen ausschließlich für die Zwecke dieses Verfahrens zu verwenden.

Weiter hilfsweise, für den Fall, dass den Hilfsanträgen zu Ziff. 2 lit. c nicht vollumfänglichen stattgegeben wird, beantragen wir anzuordnen,
f. den Inhalt des Lizenzvertrages auf Seiten der Beklagten nur
• den Prozessbevollmächtigten,
• deren Hilfspersonen (einschließlich Experten sowie ihrer Teammitglieder) und
• einer vorab durch die jeweilige Beklagte zu benennenden zuverlässigen Personen der jeweiligen Beklagten selbst zur Kenntnis bringen zu dürfen
Zum Schutz der in dieser Erwiderung enthaltenen geheimhaltungsbedürftigen Informationen nach
R. 262.2 und R. 262A, bei denen es sich um Geschäftsgeheimnisse der Parteien sowie von Qualcomm handelt, die die Parteien im Rahmen der Lizenzverhandlungen unter der Geltung eines Non-Disclosure Agreements ausgetauscht haben, beantragen wir weiter
3. die in der Erwiderung vom 14. April 2024 enthaltenen Ausführungen, insbesondere
die grau hinterlegten Informationen sowie die hierzu überreichten und mit dem Hinweis "CONFIDENTIAL" oder "geheimhaltungsbedürftig" versehenen Anlagen, Abbildungen und Übersichten, die insgesamt tabellarisch wie folgt zusammengefasst sind, als geheimhaltungsbedürftig einzustufen (R.262.2):
und anzuordnen, dass sie von den Beklagten streng vertraulich zu behandeln sind und von ihr nicht außerhalb dieses Verfahrens genutzt oder offengelegt werden dürfen, es sei denn, dass sie von diesen Informationen außerhalb dieses Verfahrens Kenntnis erlangt hat (R. 262A);
4. anzuordnen, dass die Verpflichtung nach Ziff. 3 auch nach Abschluss dieses Verfahrens fort gilt, wobei dies nicht gilt, wenn das Gericht die Geheimhaltungsbedürftigkeit dieser Informationen durch rechtskräftige Entscheidung oder Anordnung verneint hat oder sobald die streitgegenständlichen Informationen für Personen in den Kreisen, die üblicherweise mit solchen Informationen umgehen, bekannt oder ohne Weiteres zugänglich werden.

5. für den Fall der Erörterung dieses Sachvortrages in der Zwischenanhörung
und/oder der mündlichen Verhandlung anzuordnen,
a. die Öffentlichkeit wegen Gefährdung schutzwürdiger Interessen der Parteien für diesen Teil der Zwischenanhörung und/oder mündlichen Verhandlung gemäß Art. 45 EPGÜ i.V.m. R. 115 VerfO auszuschließen, soweit geheimhaltungsbedürftige Informationen nach Ziff. 3 erörtert werden;
die bei der Zwischenanhörung und/oder mündlichen Verhandlung anwesenden Personen einschließlich der Parteivertreter, ihrer Prozessbevollmächtigten und der zur Mitwirkung an dem Rechtsstreit bestellten Patentanwälte zu verpflichten, Tatsachen, welche die nach Ziff. 3 benannten Ausführungen betreffen oder die Ausführungen in der Zwischenanhörung und/oder der mündlichen Verhandlung erstmals zu ihrer Kenntnis gelangen, gegenüber Dritten geheim zu halten, und nur zum Zweck der Prozessführung im vorliegenden Verfahren zu verwenden;
b. die Öffentlichkeit für einen Teil der Verkündung der Urteilsgründe auszuschließen, soweit geheimhaltungsbedürftige Informationen nach Ziff. 3 erörtert werden;
6. die geheimhaltungsbedürftigen Informationen nach Ziff. 3 von der Akteneinsicht durch Dritte auszuschließen (Art. 58 EPGÜ i.V.m. R. 262.1 lit. b), 262.2 VerfO);
7. vor der Veröffentlichung der Urteilsgründe oder sonstiger Bekanntmachungen alle
darin enthaltenen Informationen, die unter Ziff. I fallen, gemäß R. 262.1 lit. a), 262.2 VerfO zu schwärzen. Die Klägerin macht geltend, dass der Vorlageantrag verspätet gestellt worden sei und dass die Anordnung der Vorlage nicht notwendig sei, weil nicht alle angegriffenen Ausführungsformen über einen Qualcomm-Chip verfügten und daher auch bei Erfolg der Verteidigung die Beklagten in vollem Umfang zu verurteilen seien. Unabhängig hiervon umfasse der Lizenzvertrag nicht die Wi-Fi 6-Standard-Patente der Klägerin. Für den Fall, dass die Kammer dennoch die Vorlage der Lizenzvereinbarung anordnen sollte, sei der Umfang der Vorlageanordnung sowohl inhaltlich als auch hinsichtlich des zugangsberechtigen Personenkreises zu beschränken. Zudem müsste die Klägerin vorab Gelegenheit erhalten, Qualcomm über die Vorlage zu informieren, um Qualcomm so die Gelegenheit einräumen zu können, zu der Vorlageanordnung Stellung nehmen zu können.

GRÜNDE
1. Nach Regel 190.1 VerfO kann das Gericht auf einen mit einer Begründung versehenen Antrag der Partei, welche die Beweismittel bezeichnet hat, die Vorlage dieser Beweismittel durch die gegnerische Partei oder die dritte Partei anordnen, wenn eine Partei alle vernünftigerweise verfügbaren und plausiblen Beweismittel zur Begründung ihrer Ansprüche vorgelegt und zur Begründung dieser Ansprüche Beweismittel bezeichnet, die sich in der Verfügungsgewalt der gegnerischen Partei oder einer dritten Partei befinden. Zum Schutz vertraulicher Informationen kann das Gericht anordnen, dass die Beweismittel nur bestimmten namentlich genannten Personen mitgeteilt werden und einer angemessenen Geheimhaltungspflicht unterliegen.
2. Im vorliegenden Verfahren besteht insoweit die Besonderheit, dass sich die Beklagten bereits im Besitz des vorzulegenden Vertrages befinden, sie aber aufgrund von Anordnungen des US-Gerichts gehindert sind, diesen dem Einheitlichen Patentgericht vorzulegen oder Details vorzutragen. Unter diesen Umständen ist es zur Erleichterung der umfassenden Vorbereitung des Haupttermins, der bereits für den 18. und 19. Juni 2024 terminiert ist, geboten, die Vorlage anzuordnen. Alles andere wäre auch Sicht der Beklagten nicht fair, zumal das US-Gericht ihren Antrag, die Vorlage auch beim Einheitlichen Patentgericht zu gestatten, gerade mit dem Argument zurückgewiesen hat, dass die Beklagten vor dem Einheitlichen Patentgericht den vorliegenden Vorlageantrag stellen könnten.
3. Wegen der berechtigten Geheimhaltungsinteressen der Klägerin sowie von Qualcomm sind die angeordneten Schutzmaßnahmen anzuordnen. Für die Beklagten ist aber eine natürliche Person zu bestimmen. Das Gericht bestimmt die insoweit im parallelen Vorlageantrag App_22295/2024 kommunizierte Frau Anna Lam. Der Beklagten steht es frei, über einen Regel-9-Antrag weitere Personen nachzubenennen. Der Vertrag ist in Gänze und ungeschwärzt vorzulegen.
4. Es mag zwar zutreffend sein, dass auch andere angegriffenen Ausführungsformen mit anderen Chips Gegenstand des Verfahrens sind und der Antrag auch früher hätte gestellt werden können. Aufgrund der oben geschilderten Umstände ist aber nur durch die vorliegende Anordnung sichergestellt, dass das Informationsbedürfnis der Beklagten vollständig gestillt und der Haupttermin an den geplanten Terminstagen nicht gefährdet wird. Die Interessen der Klägerin und Qualcomm an der Nichtvorlage treten aufgrund des Umstandes, dass die Beklagten bereits im Besitz des Vertrages sind, ohnehin zurück.
5. Darüber hinaus wird der Lizenzvertrag auch in den parallelen Verfahren auf Feststellung der Nichtverletzung ACT_16294/2024 UPC_CFI_152/2024 sowie in dem abgetrennten Verletzungsverfahren wegen EP 3 678 321 (ACT_18917/2024 UPC_CFI_168/2024) eine zentrale Rolle spielen. Daher ist zugleich anzuordnen, dass er auch in diesen beiden Verfahren verwendet werden darf.
6. Eine Anordnung der Erlaubnis, den Vertrag darüberhinausgehend auch in weiteren Verfahren betreffend das Wi-Fi 6-Standard-Portfolio der Klägerin verwenden zu dürfen, kommt hingegen nicht in Betracht. Die gebotene Abwägung kann immer nur verfahrensbezogen durch den jeweils zur Entscheidung berufenen Spruchkörper erfolgen.
7. Eine Vorlagefrist von 10 Werktagen erscheint wegen der Abstimmung mit Qualcomm notwendig. Der Klägerin steht es frei, diese Frist nicht auszuschöpfen.

ANORDNUNG.
1. Die Klägerin hat den Lizenzvertrag zwischen dem Unternehmen Qualcomm Corp. und der Klägerin aus August 2020, der auch Gegenstand des Berufungsverfahrens vor dem OLG Düsseldorf (Az. I-2 U 63/23) ist, binnen 10 Werktagen nach Zustellung der Anordnung vorzulegen.
2. Für jeden Tag der Zuwiderhandlung gegen die Anordnung nach Ziffer 1 wird der Klägerin ein Zwangsgeld in Höhe von bis zu 20.000,00 € pro Tag angedroht.
3. Es ergehen folgende Anordnungen zur Geheimhaltung: a. Der Inhalt dieses Lizenzvertrages wird als geheimhaltungsbedürftig eingestuft.
b. Auf Seiten der Beklagten dürfen den Inhalt des Lizenzvertrages nur zur Kenntnis nehmen:
• die Prozessbevollmächtigten der Beklagten, und
• deren Hilfspersonen (einschließlich Experten sowie ihrer Teammitglieder), und
• Frau Anna Lam, Vice President Legal, Netgear Inc. c. Die Parteien und die unter Ziffer 3.b genannten Personen werden verpflichtet, die vertraulichen Informationen nach Ziffer 1 über das Verfahren hinaus streng vertraulich zu behandeln und die vertraulichen Informationen ausschließlich für die Zwecke dieses Verfahrens sowie der Verfahren ACT_16294/2024 UPC_CFI_152/2024 und ACT_18917/2024 UPC_CFI_168/2024 zu verwenden.
4.a Die in der Erwiderung vom 14. April 2024 enthaltenen Ausführungen der Klägerin, nämlich die grau hinterlegten Informationen sowie die hierzu überreichten und mit dem Hinweis "CONFIDENTIAL" oder "geheimhaltungsbedürftig" versehenen Anlagen, Abbildungen und Übersichten, die insgesamt tabellarisch wie folgt zusammengefasst sind, werden als geheimhaltungsbedürftig eingestuft:
4.b Es wird angeordnet, dass die Beklagten die Informationen gem. Ziffer 4.a streng vertraulich zu behandeln haben und von ihnen nicht außerhalb dieses Verfahrens genutzt oder offengelegt werden dürfen, es sei denn, dass sie von diesen Informationen außerhalb dieses Verfahrens Kenntnis erlangt haben.
5. Die Verpflichtung nach Ziff. 4.b gilt auch nach Abschluss dieses Verfahrens fort, wobei dies nicht gilt, wenn das Gericht die Geheimhaltungsbedürftigkeit dieser Informationen durch rechtskräftige Entscheidung oder Anordnung verneint hat oder sobald die streitgegenständlichen Informationen für Personen in den Kreisen, die üblicherweise mit solchen Informationen umgehen, bekannt oder ohne Weiteres zugänglich werden.
6. Für den Fall der Erörterung dieses Sachvortrages in der Zwischenanhörung und/oder der mündlichen Verhandlung wird angeordnet, dass
a. die Öffentlichkeit wegen Gefährdung schutzwürdiger Interessen der Parteien für diesen Teil der Zwischenanhörung und/oder mündlichen Verhandlung gemäß Art. 45 EPGÜ i.V.m. R. 115 VerfO ausgeschlossen wird, soweit geheimhaltungsbedürftige Informationen erörtert werden; die bei der Zwischenanhörung und/oder mündlichen Verhandlung anwesenden Personen einschließlich der Parteivertreter, ihrer Prozessbevollmächtigten und der zur Mitwirkung an dem Rechtsstreit bestellten Patentanwälte werden verpflichtet, Ausführungen und Tatsachen, welche geheimhaltungsbedürftige Informationen betreffen, gegenüber Dritten geheim zu halten, und vorbehaltlich der Anordnungen in Ziffer 3.c nur zum Zweck der Prozessführung im vorliegenden Verfahren zu verwenden;
b. die Öffentlichkeit für einen Teil der Verkündung der Urteilsgründe ausgeschlossen wird, soweit geheimhaltungsbedürftige Informationen erörtert werden.
6. Die geheimhaltungsbedürftigen Informationen nach Ziffer 1 und 4.a werden von der Akteneinsicht durch Dritte ausgeschlossen und vor der Veröffentlichung der Urteilsgründe oder sonstiger Bekanntmachungen geschwärzt.
7. Im Übrigen werden die Anträge beider Parteien zurückgewiesen.

SUBJECT MATTER OF THE PROCEEDINGS Request for a preliminary ruling by the defendant pursuant to Rule 190 VerfO and confidentiality orders pursuant to Rule 262A VerfO

FACTS The plaintiff is suing the defendants for infringement of EP 3 611 989. It argues that this patent is essential for the Wi-Fi 6 standard. The defendants defend themselves, among other things, with the exhaustion defence. They argue in this regard that some of the contested embodiments feature a Qualcomm chip. The plaintiff had concluded a licence agreement with Qualcomm which also covered the plaintiff's Wi-Fi 6 standard patents. Although this licence agreement was already available to it as a result of US discovery proceedings, it was not permitted to submit the agreement or comment on the details due to the restrictions imposed by the US court

in the present proceedings. In connection with an application to allow the submission also in these proceedings, the US court referred it to the present proceedings to file a request for a preliminary ruling. The defendants request: 1. that the licence agreement between Qualcomm Corp. and the plaintiff dated August 2020, which is also the subject of the appeal proceedings before the Higher Regional Court of Düsseldorf (Case No. I-2 U 63/23), be submitted by the plaintiff within five working days of service of the order; and

2. to impose substantial periodic penalty payments (Art. 82 (4) EPGÜ) for each day of infringement and other sanctions pursuant to Rule 190.4 (b) VerfO EPG against the plaintiff in the event of infringement of the order for submission to be issued pursuant to claim 1, the specific form of which is left to the discretion of the court.

The plaintiff requests that: 1. the defendant's request for an order requiring the plaintiff to submit the licence agreement between Qualcomm Corp. and the plaintiff dated August 2020 be dismissed.
In the alternative, we request that

2. that the licence agreement between Qualcomm Corp. and the plaintiff dated August 2020 be submitted by the plaintiff within 10 working days of service of the order, subject to the following conditions:

a. to classify the content of this licence agreement as confidential (R. 262.2 VerfO, R. 262A.1 VerfO);
b. to allow the plaintiff to redact those excerpts from the licence agreement on which the defendant's factual allegations cannot be based
;

c. to disclose the contents of the licence agreement on the defendant's side only
• to the legal representatives and
• their assistants (including experts and their team members);
d. that the defendant and the above-mentioned persons shall destroy the confidential information referred to in clause 2.a after the proceedings have been legally concluded;

e. to oblige the parties and the persons named in clause 2.c to treat the confidential information under clause 2.a as strictly confidential beyond the proceedings and to use the confidential information exclusively for the purposes of these proceedings.


In the further alternative, in the event that the alternative claims under clause 2(c) are not granted in full, we request that the court order that
f. the content of the licence agreement on the part of the defendant may only be disclosed
• to the legal representatives,
• their assistants (including experts and their team members) and

• a reliable person of the respective defendant to be named in advance by the respective defendant
For the protection of the confidential information contained in this response pursuant to

R. 262.2 and R. 262A, which are trade secrets of the parties and of Qualcomm that the parties exchanged during the licence negotiations under a non-disclosure agreement, we further request
3. that the statements contained in the response of 14 April 2024, in particular

the information highlighted in grey and the accompanying exhibits, illustrations and overviews marked ‘CONFIDENTIAL’ or ‘subject to confidentiality’, which are summarised in tabular form below, be classified as confidential (R.262.2):

and order that they be treated as strictly confidential by the defendants and may not be used or disclosed by them outside these proceedings, unless they have obtained knowledge of this information outside these proceedings (R. 262A);

4. order that the obligation under point 3 shall continue to apply even after the conclusion of these proceedings, unless the court has denied the confidentiality of this information by a final decision or order, or as soon as the information in dispute becomes known or readily accessible to persons within the circles that normally deal with such information.

5. in the event that this statement of facts is discussed in the interim hearing
and/or the oral hearing, to order
a. that the public be excluded from this part of the interim hearing and/or oral hearing pursuant to Art. 45 EPGÜ in conjunction with Rule 115 of the Rules of Procedure, insofar as information subject to confidentiality pursuant to point 3 is discussed;
to oblige the persons present at the interim hearing and/or oral proceedings, including the parties' representatives, their legal representatives and the patent attorneys appointed to participate in the legal dispute, to keep secret from third parties any facts which relate to the statements referred to in point 3 or which come to their knowledge for the first time in the interim hearing and/or oral proceedings, and to use them only for the purposes of the proceedings in the present case; 3 or which come to their attention for the first time during the interim hearing and/or the oral proceedings, and to use them only for the purposes of the proceedings in the present case;
b. to exclude the public from part of the pronouncement of the grounds for the judgment insofar as information subject to confidentiality pursuant to point 3 is discussed;

6. to exclude the information subject to confidentiality pursuant to Section 3 from inspection of the files by third parties (Art. 58 EPGÜ in conjunction with R. 262.1 lit. b), 262.2 VerfO);
7. prior to the publication of the grounds for the judgment or other announcements, to redact all

information contained therein that falls under point I must be redacted in accordance with Rule 262.1(a) and 262.2 of the Rules of Procedure. The plaintiff claims that the request for a preliminary ruling was filed late and that the order for a preliminary ruling is not necessary because not all of the contested embodiments have a Qualcomm chip and therefore, even if the defence is successful, the defendants must be convicted in full. Irrespective of this, the licence agreement does not cover the plaintiff's Wi-Fi 6 standard patents. In the event that the Chamber nevertheless orders the licence agreement to be submitted, the scope of the order for submission must be limited both in terms of content and with regard to the persons authorised to access it. In addition, the plaintiff must be given the opportunity in advance to inform Qualcomm of the submission in order to allow Qualcomm to comment on the order for submission.

REASONS

1. Pursuant to Rule 190.1 VerfO, the court may, upon a reasoned request by the party that has designated the evidence, order the opposing party or a third party to produce that evidence if a party has submitted all reasonably available and plausible evidence in support of its claims and has identified evidence in support of those claims which is in the possession of the opposing party or a third party. In order to protect confidential information, the court may order that the evidence be disclosed only to specific named persons and be subject to an appropriate duty of confidentiality.

2. The present proceedings are unique in that the defendants are already in possession of the contract to be produced, but are prevented from producing it to the Unified Patent Court or disclosing details thereof due to orders issued by the US court. In these circumstances, in order to facilitate the comprehensive preparation of the main hearing, which is already scheduled for 18 and 19 June 2024, it is necessary to order the submission. Anything else would also be unfair in the defendants' view, especially since the US court has just rejected their request to allow the referral to the Unified Patent Court on the grounds that the defendants could make the present referral request before the Unified Patent Court.

3. Due to the legitimate confidentiality interests of the plaintiff and Qualcomm, the protective measures ordered are to be imposed. However, a natural person must be designated for the defendants. The court designates Ms Anna Lam, as communicated in the parallel referral request App_22295/2024. The defendant is free to name additional persons by way of a Rule 9 application. The contract must be submitted in its entirety and unredacted.
4. It may be true that other contested embodiments with other chips are also the subject of the proceedings and that the application could have been filed earlier. However, due to the circumstances described above, only the present order ensures that the defendant's need for information is fully satisfied and that the main hearing on the scheduled dates is not jeopardised. The interests of the plaintiff and Qualcomm in non-submission are in any case secondary due to the fact that the defendants are already in possession of the contract.

5. Furthermore, the licence agreement also plays a central role in the parallel proceedings for a declaration of non-infringement ACT_16294/2024 UPC_CFI_152/2024 and in the separate infringement proceedings concerning EP 3 678 321 (ACT_18917/2024 UPC_CFI_168/2024). role in the parallel proceedings for a declaration of non-infringement ACT_16294/2024 UPC_CFI_152/2024 and in the separate infringement proceedings concerning EP 3 678 321 (ACT_18917/2024). It must therefore be ordered at the same time that it may also be used in these two proceedings.
6. However, an order granting permission to use the agreement beyond this in further proceedings concerning the plaintiff's Wi-Fi 6 standard portfolio is out of the question. The necessary weighing of interests can only be carried out on a case-by-case basis by the panel of judges called upon to decide.

7. A referral period of 10 working days appears necessary due to coordination with Qualcomm. The plaintiff is free not to make use of this period.

ORDER.
1. The plaintiff must submit the licence agreement between Qualcomm Corp. and the plaintiff dated August 2020, which is also the subject of the appeal proceedings before the Higher Regional Court of Düsseldorf (Case No. I-2 U 63/23), within 10 working days of service of the order.

2. For each day of non-compliance with the order under point 1, the plaintiff shall be liable to pay a penalty of up to €20,000.00 per day.
3. The following confidentiality orders are issued: a. The content of this licence agreement is classified as confidential.

b. On the part of the defendant, only the following persons may take note of the content of the licence agreement:
• the defendant's legal representatives, and
• their assistants (including experts and their team members), and
• Ms Anna Lam, Vice President Legal, Netgear Inc. c. The parties and the persons named in clause 3.b are obliged to
treat the confidential information referred to in clause 1 as strictly confidential beyond the proceedings and to use the confidential information exclusively for the purposes of these proceedings and the proceedings ACT_16294/2024 UPC_CFI_152/2024 and ACT_18917/2024 UPC_CFI_168/2024.

4.a The statements made by the claimant in its response of 14 April 2024, namely the information highlighted in grey and the annexes, illustrations and overviews submitted in this regard and marked ‘CONFIDENTIAL’ or ‘subject to confidentiality’, which are summarised in tabular form below, are classified as confidential:

4.b It is ordered that the defendants must treat the information in accordance with section 4.a as strictly confidential and may not use or disclose it outside these proceedings, unless they have obtained knowledge of this information outside these proceedings.

5. The obligation under clause 4.b shall continue to apply after the conclusion of these proceedings, unless the court has denied the confidentiality of this information by means of a final decision or order, or as soon as the information in dispute becomes known or readily accessible to persons within the circles that normally deal with such information.

6. In the event that this statement of facts is discussed in the interim hearing and/or the oral hearing, it is ordered that

a. the public shall be excluded from this part of the interim hearing and/or oral proceedings in accordance with Art. 45 EPGÜ in conjunction with R. 115 VerfO due to the risk of prejudicing the legitimate interests of the parties, insofar as information subject to confidentiality is discussed; the persons present at the interim hearing and/or oral proceedings, including the parties' representatives, their legal representatives and the patent attorneys appointed to participate in the proceedings are obliged to keep confidential any statements and facts relating to information subject to confidentiality and, subject to the orders in section 3.c, to use them only for the purposes of the proceedings in the present case;

b. the public shall be excluded from part of the pronouncement of the grounds for the judgment insofar as information subject to confidentiality is discussed.
6. The information subject to confidentiality pursuant to sections 1 and 4.a shall be excluded from inspection of the files by third parties and shall be redacted prior to the publication of the grounds for the judgment or other announcements.

7. In all other respects, the applications of both parties are dismissed.
INSTRUCTIONS TO THE LAW FIRM The confidential documents in these proceedings shall be made available to the respective opposing party.
