Leitsätze:
1. Bei Verstößen gegen Anordnungen nach Art. 62 EPG× kann ohne weitere ge-
richtliche Vollstreckungsanordnung nach Art. 82 Abs. 4 EPG× ein Zwangsgeld
verhängt werden.
2. Die Voraussetzungen der Verhängung von Zwangsgeldern sind in Art. 82 Abs. 4
EPG× abschließend geregelt; im Recht der Vertragsmitgliedstaaten bestehende,
weitergehende vollstreckungsrechtliche Erfordernisse sind insofern nicht zu be-
achten.
3. Regel 118.8 der VerfO gilt nach ihrem eindeutigen Wortlaut („Die in Absätzen 1
und 2 (a) genannten Anordnungen…“; Art. 62 EPG× wird dort nicht genannt)
nicht für Anordnungen nach Art. 62 EPG×.2

Sachverhalt
Die Antragstellerinnen haben am 1. Juni 2023 beim Einheitlichen Patentgericht (Lokal-
kammer München) die Anordnung einstweiliger Maßnahmen wegen der Verletzung
des EP 4 108 782 (Streitpatent) durch die Antragsgegnerinnen beantragt.
Die Lokalkammer hat am 19. September 2023 folgende Anordnung erlassen:
A. Den Antragsgegnerinnen wird aufgegeben in den Hoheitsgebieten der Republik Öster-
reich, des Königreichs Belgien, der Republik Bulgarien, des Königreichs Dänemark, der
Republik Estland, der Republik Finnland, der Französischen Republik, der Bundesre-
publik Deutschland, der Italienischen Republik, der Republik Lettland, der Republik Li-
tauen, des Großherzogtums Luxemburg, der Republik Malta, des Königreichs der Nie-
derlande, der Portugiesischen Republik, der Republik Slowenien und/oder des König-
reichs Schweden, Folgendes zu unterlassen
I. ein Verfahren zum Nachweisen einer Vielzahl von Analyten in einer Zell- oder Ge-
webeprobe, umfassend
(a) Anbringen (Mounting) der Zell- oder Gewebeprobe auf einem festen Träger;
(b) Kontaktieren der Zell- oder Gewebeprobe mit einer Zusammensetzung, die
eine Vielzahl von Nachweisreagenzien umfasst, wobei die Vielzahl der Nach-
weisreagenzien eine Vielzahl von Teilpopulationen der Nachweisreagenzien
umfasst;
(c) Inkubieren der Zell- oder Gewebeprobe zusammen mit der Vielzahl von
Nachweisreagenzien für eine ausreichende Zeitdauer, um Binden der Viel-
zahl von Nachweisreagenzien an die Analyten zu ermöglichen; wobei
jede Teilpopulation der Vielzahl von Nachweisreagenzien auf einen unter-
schiedlichen Analyten zielt, wobei
jedes der Vielzahl von Nachweisreagenzien umfasst: ein Sondenreagenz,
das auf einen Analyten der Vielzahl von Analyten zielt, und
eine Vielzahl vorbestimmter Teilsequenzen, wobei das Sondenreagenz und
die Vielzahl der vorbestimmten Teilsequenzen miteinander konjugiert sind;
(d) Nachweisen der Vielzahl von vorbestimmten Teilsequenzen in einer zeitlich
sequentiellen Weise, wobei das Nachweisen umfasst:
(i) Hybridisieren eines Satzes von Decodersonden mit einer Teilsequenz
der Nachweisreagenzien, wobei der Satz von Decodersonden eine4
Vielzahl von Teilpopulationen von Decodersonden umfasst, und wobei
jede Teilpopulation der Decodersonden eine nachweisbare Markie-
rung umfasst, wobei jede nachweisbare Markierung eine Signalsigna-
tur produziert;
(ii) Nachweisen der durch die Hybridisierung des Satzes von Decoderson-
den produzierten Signalsignatur;
(iii) Entfernen der Signalsignatur; und
(iv) Wiederholen von (i) und (iii) unter Verwendung eines unterschiedlichen
Satzes von Decodersonden, um andere Teilsequenzen der Nachweis-
reagenzien nachzuweisen, wodurch eine zeitliche Reihenfolge der Sig-
nalsignaturen produziert wird, die für jede Teilpopulation von der Viel-
zahl von Nachweisreagenzien eindeutig ist; und
(e) Verwenden der zeitlichen Reihenfolge der Signalsignaturen, die der Vielzahl
der vorbestimmten Teilsequenzen des Nachweisreagenzes entspricht, zum
Identifizieren einer Teilpopulation der Nachweisreagenzien, wodurch die
Vielzahl von Analyten in der Zell- oder Gewebeprobe nachgewiesen wird,
im Hoheitsgebiet eines oder mehrerer der unter A. genannten Staaten anzuwen-
den oder zur Anwendung im Hoheitsgebiet eines oder mehrerer der unter A. ge-
nannten Staaten anzubieten;
(unmittelbare Verletzung von Anspruch 1 des EP 4 108 782)
II. Vorrichtungen, die dazu geeignet sind, ein Verfahren zum Nachweisen einer Viel-
zahl von RNAs in einer Zell- oder Gewebeprobe durchzuführen, umfassend
(a) Anbringen (Mounting) der Zell- oder Gewebeprobe auf einem festen Träger;
(b) Kontaktieren der Zell- oder Gewebeprobe mit einer Zusammensetzung, die
eine Vielzahl von Nachweisreagenzien umfasst, wobei die Vielzahl der Nach-
weisreagenzien eine Vielzahl von Teilpopulationen der Nachweisreagenzien
umfasst;
(c) Inkubieren der Zell- oder Gewebeprobe zusammen mit der Vielzahl von
Nachweisreagenzien für eine ausreichende Zeitdauer, um Binden der Viel-
zahl von Nachweisreagenzien an die RNAs zu ermöglichen; wobei
jede Teilpopulation der Vielzahl von Nachweisreagenzien auf eine unter-
schiedliche RNA zielt, wobei5
jedes der Vielzahl von Nachweisreagenzien umfasst: ein Sondenreagenz,
das auf eine RNA der Vielzahl von RNAs zielt, und
eine Vielzahl vorbestimmter Teilsequenzen, wobei das Sondenreagenz und
die Vielzahl der vorbestimmten Teilsequenzen miteinander konjugiert sind;
(d) Nachweisen der Vielzahl von vorbestimmten Teilsequenzen in einer zeitlich
sequentiellen Weise, wobei das Nachweisen umfasst:
(i) Hybridisieren eines Satzes von Decodersonden mit einer Teilse-
quenz der Nachweisreagenzien, wobei der Satz von Decodersonden
eine Vielzahl von Teilpopulationen von Decodersonden umfasst, und
wobei jede Teilpopulation der Decodersonden eine nachweisbare
Markierung umfasst, wobei jede nachweisbare Markierung eine Sig-
nalsignatur produziert;
(ii) Nachweisen der durch die Hybridisierung des Satzes von Decoder-
sonden produzierten Signalsignatur;
(iii) Entfernen der Signalsignatur; und
(iv) Wiederholen von (i) und (iii) unter Verwendung eines unterschiedli-
chen Satzes von Decodersonden, um andere Teilsequenzen der
Nachweisreagenzien nachzuweisen, wodurch eine zeitliche Reihen-
folge der Signalsignaturen produziert wird, die für jede Teilpopulation
von der Vielzahl von Nachweisreagenzien eindeutig ist; und
(e) Verwenden der zeitlichen Reihenfolge der Signalsignaturen, die der Vielzahl
der vorbestimmten Teilsequenzen des Nachweisreagenzes entspricht, zum
Identifizieren einer Teilpopulation der Nachweisreagenzien, wodurch die
Vielzahl von RNAs in der Zell- oder Gewebeprobe nachgewiesen wird,
im Hoheitsgebiet eines der unter A. genannten Staaten zur Benutzung des Verfah-
rens im Hoheitsgebiet eines der unter A. genannten Staaten oder in den Hoheits-
gebieten mehrerer dieser Staaten zur Anwendung im Hoheitsgebiet eines oder
mehrerer der unter A. genannten Staaten anzubieten und/oder zu liefern
ohne
(1) auf jedem Angebot, auf der ersten Seite der Bedienungsanleitung, in den
Lieferpapieren sowie auf der Verpackung ausdrücklich, unübersehbar und
blickfangmäßig herausgestellt darauf hinzuweisen, dass die Vorrichtungen
nicht ohne Zustimmung der Antragstellerin zu 2) als Inhaberin des EP 4 1086
782 zum Nachweis von RNA in einem Verfahren gemäß Ziffer A.I. verwendet
werden dürfen und ohne Zustimmung der Antragstellerin zu 2) ein Verwen-
den zum Nachweis von RNA zu unterlassen ist,
(2) den Abnehmern unter Auferlegung einer an die Antragstellerin zu 2) zu zah-
lenden angemessenen, von der Antragstellerin zu 2) zu bestimmenden, not-
falls von dem zuständigen Gericht zu überprüfenden Vertragsstrafe für jeden
Fall der Zuwiderhandlung die schriftliche Verpflichtung aufzuerlegen, die
Vorrichtungen nicht ohne eine vorherige Zustimmung der Antragstellerin zu
2) für den Nachweis von RNA zu verwenden;
(mittelbare Verletzung von Anspruch 1 des EP 4 108 782)
III. Nachweisreagenzien, die dazu geeignet sind, ein Verfahren zum Nachweisen ei-
ner Vielzahl von Analyten in einer Zell- oder Gewebeprobe durchzuführen, umfas-
send
(a) Anbringen (Mounting) der Zell- oder Gewebeprobe auf einem festen Träger;
(b) Kontaktieren der Zell- oder Gewebeprobe mit einer Zusammensetzung, die
eine Vielzahl von Nachweisreagenzien umfasst, wobei die Vielzahl der Nach-
weisreagenzien eine Vielzahl von Teilpopulationen der Nachweisreagenzien
umfasst;
(c) Inkubieren der Zell- oder Gewebeprobe zusammen mit der Vielzahl von
Nachweisreagenzien für eine ausreichende Zeitdauer, um Binden der Viel-
zahl von Nachweisreagenzien an die Analyten zu ermöglichen; wobei
jede Teilpopulation der Vielzahl von Nachweisreagenzien auf einen unter-
schiedlichen Analyten zielt, wobei
jedes der Vielzahl von Nachweisreagenzien umfasst: ein Sondenreagenz,
das auf einen Analyten der Vielzahl von Analyten zielt, und
eine Vielzahl vorbestimmter Teilsequenzen, wobei das Sondenreagenz und
die Vielzahl der vorbestimmten Teilsequenzen miteinander konjugiert sind;
(d) Nachweisen der Vielzahl von vorbestimmten Teilsequenzen in einer zeitlich
sequentiellen Weise, wobei das Nachweisen umfasst:
(i) Hybridisieren eines Satzes von Decodersonden mit einer Teilsequenz
der Nachweisreagenzien, wobei der Satz von Decodersonden eine
Vielzahl von Teilpopulationen von Decodersonden umfasst, und wobei
jede Teilpopulation der Decodersonden eine nachweisbare7
Markierung umfasst, wobei jede nachweisbare Markierung eine Sig-
nalsignatur produziert;
(ii) Nachweisen der durch die Hybridisierung des Satzes von Decoderson-
den produzierten Signalsignatur;
(iii) Entfernen der Signalsignatur; und
(iv) Wiederholen von (i) und (iii) unter Verwendung eines unterschiedlichen
Satzes von Decodersonden, um andere Teilsequenzen der Nachweis-
reagenzien nachzuweisen, wodurch eine zeitliche Reihenfolge der Sig-
nalsignaturen produziert wird, die für jede Teilpopulation von der Viel-
zahl von Nachweisreagenzien eindeutig ist; und
(e) Verwenden der zeitlichen Reihenfolge der Signalsignaturen, die der Vielzahl
der vorbestimmten Teilsequenzen des Nachweisreagenzes entspricht, zum
Identifizieren einer Teilpopulation der Nachweisreagenzien, wodurch die
Vielzahl von Analyten in der Zell- oder Gewebeprobe nachgewiesen wird,
im Hoheitsgebiet eines der unter A. genannten Staaten zur Benutzung des Verfah-
rens im Hoheitsgebiet eines der unter A. genannten Staaten oder in den Hoheits-
gebieten mehrerer dieser Staaten zur Anwendung im Hoheitsgebiet eines oder
mehrerer der unter A. genannten Staaten anzubieten und/oder zu liefern;
(mittelbare Verletzung von Anspruch 1 des EP 4 108 782)
IV. Decodersonden, die dazu geeignet sind, ein Verfahren zum Nachweisen einer
Vielzahl von RNAs in einer Zell- oder Gewebeprobe durchzuführen, umfassend
(a) Anbringen (Mounting) der Zell- oder Gewebeprobe auf einem festen Träger;
(b) Kontaktieren der Zell- oder Gewebeprobe mit einer Zusammensetzung, die
eine Vielzahl von Nachweisreagenzien umfasst, wobei die Vielzahl der Nach-
weisreagenzien eine Vielzahl von Teilpopulationen der Nachweisreagenzien
umfasst;
(c) Inkubieren der Zell- oder Gewebeprobe zusammen mit der Vielzahl von
Nachweisreagenzien für eine ausreichende Zeitdauer, um Binden der Viel-
zahl von Nachweisreagenzien an die RNAs zu ermöglichen; wobei
jede Teilpopulation der Vielzahl von Nachweisreagenzien auf eine unter-
schiedliche RNA zielt, wobei
jedes der Vielzahl von Nachweisreagenzien umfasst: ein Sondenreagenz,
das auf eine RNA der Vielzahl von RNAs zielt, und8
eine Vielzahl vorbestimmter Teilsequenzen, wobei das Sondenreagenz und
die Vielzahl der vorbestimmten Teilsequenzen miteinander konjugiert sind;
(d) Nachweisen der Vielzahl von vorbestimmten Teilsequenzen in einer zeitlich
sequentiellen Weise, wobei das Nachweisen umfasst:
(i) Hybridisieren eines Satzes von Decodersonden mit einer Teilse-
quenz der Nachweisreagenzien, wobei der Satz von Decodersonden
eine Vielzahl von Teilpopulationen von Decodersonden umfasst, und
wobei jede Teilpopulation der Decodersonden eine nachweisbare-
Markierung umfasst, wobei jede nachweisbare Markierung eine Sig-
nalsignatur produziert;
(ii) Nachweisen der durch die Hybridisierung des Satzes von Decoder-
sonden produzierten Signalsignatur;
(iii) Entfernen der Signalsignatur; und
(iv) Wiederholen von (i) und (iii) unter Verwendung eines unterschiedli-
chen Satzes von Decodersonden, um andere Teilsequenzen der
Nachweisreagenzien nachzuweisen, wodurch eine zeitliche Reihen-
folge der Signalsignaturen produziert wird, die für jede Teilpopulation
von der Vielzahl von Nachweisreagenzien eindeutig ist; und
(e) Verwenden der zeitlichen Reihenfolge der Signalsignaturen, die der Vielzahl
der vorbestimmten Teilsequenzen des Nachweisreagenzes entspricht, zum
Identifizieren einer Teilpopulation der Nachweisreagenzien, wodurch die
Vielzahl von RNAs in der Zell- oder Gewebeprobe nachgewiesen wird,
im Hoheitsgebiet eines der unter A. genannten Staaten zur Benutzung des Verfah-
rens im Hoheitsgebiet eines der unter A. genannten Staaten oder in den Hoheits-
gebieten mehrerer dieser Staaten im Hoheitsgebiet eines oder mehrerer der unter
A. genannten Staaten anzubieten und/oder zu liefern,
ohne
(1) auf jedem Angebot, auf der ersten Seite der Bedienungsanleitung, in den
Lieferpapieren sowie auf der Verpackung ausdrücklich, unübersehbar und
blickfangmäßig herausgestellt darauf hinzuweisen, dass die Decodersonden
nicht ohne Zustimmung der Antragstellerin zu 2) als Inhaberin des EP 4 108
782 zum Nachweis von RNA in einem Verfahren gemäß Ziffer A.I. verwendet
werden dürfen und ohne Zustimmung der Antragstellerin zu 2) ein Verwen-
den zum Nachweis von RNA zu unterlassen ist,9
(2) den Abnehmern unter Auferlegung einer an die Antragstellerin zu 2) zu zah-
lenden angemessenen, von der Antragstellerin zu 2) zu bestimmenden, not-
falls von dem zuständigen Gericht zu überprüfenden Vertragsstrafe für jeden
Fall der Zuwiderhandlung die schriftliche Verpflichtung aufzuerlegen, die De-
codersonden nicht ohne eine vorherige Zustimmung der Antragstellerin zu
2) für den Nachweis von RNA zu verwenden;
(mittelbare Verletzung von Anspruch 1 des EP 4 108 782)
B. Für jede einzelne Zuwiderhandlung gegen die Anordnungen nach Ziffer A.I. bis
A.IV. hat die jeweilige Antragsgegnerin ein (ggf. wiederholtes) Zwangsgeld in Höhe
von bis zu 250.000 EUR an das Gericht zu zahlen.
C. Im ×brigen wird der Antrag auf Anordnung einstweiliger Maßnahmen abgewiesen.
D. Die von den Antragsgegnerinnen gestellten Anträge werden abgewiesen.
E. Die Antragsgegnerinnen haben die Kosten des Verfahrens zu erstatten.
F. Die oben aufgeführten Anordnungen sind sofort wirksam und vollstreckbar.
Die Anordnung wurde den Parteien am 20. September 2023 über das CMS zugestellt.10
Die Antragstellerinnen behaupten mit ihrem Antrag auf Festsetzung von Zwangsgeld
vom 28. September 2023, die Antragsgegnerinnen hätten gegen die Anordnung vom
19. September 2023 verstoßen, indem sie
- entgegen Ziffer A.I. der Anordnungen vom 19. September 2023 die Durchfüh-
rung des patentverletzenden Verfahrens im CX-Lab in Amsterdam beworben
habe;
- auch noch am 26. September 2023 die angegriffene Ausführungsform 1
(CosMx) im Internet für die EPG-Mitgliedsstaaten ohne den nach der Anord-
nung Ziffer A.II. erforderlichen Hinweis angeboten haben;
- auch noch am 26. September 2023 das CosMx auf Veranstaltungen in den
UPC-Mitgliedstaaten, unter anderem in Deutschland und Frankreich, angebo-
ten haben („Spatial Multiomics Summits“);
- auch noch am 27. September 2023 die angegriffene Ausführungsformen 1
(CosMx) und 3 (Decodersonden) in den im Internet abrufbaren „Instrument
User Manual“ und „Manual Slide Preparation“ ohne den nach den Anordnun-
gen Ziffer A.II. und IV. erforderlichen Hinweisen angeboten haben;
- auch noch am 26. September 2023 auf ihrer Webseite https://nano-
string.com/about-us/cx-labs/cxlab-amsterdam/ eine Tour zur Produktpräsen-
tation angeboten haben, wovon unter Verstoß gegen die Anordnungen in Zif-
fern A.II., III. und IV. sämtliche angegriffenen Ausführungsformen betroffen
seien;
Die Antragstellerinnen haben daher b e a n t r a g t,
I. die Antragsgegnerinnen durch ein Zwangsgeld in Höhe von jeweils 50.000
EUR dazu anzuhalten, der Anordnung in Ziffer A.I. in der Entscheidung des
Gerichts erster Instanz des Einheitlichen Patentgerichts in dem Verfahren
auf Erlass einstweiliger Maßnahmen betreffend das EP 4 108 782, Verfah-
rensnummer UPC CFI 2/2023, erlassen am 19. September 2023, Folge zu
leisten.11
II. die Antragsgegnerinnen
- durch ein Zwangsgeld in Höhe von jeweils 250.000 EUR dazu anzu-
halten, der Anordnung in Ziffer A.II., und
- durch ein Zwangsgeld in Höhe von jeweils 100.000 EUR dazu anzu-
halten, der Anordnung in Ziffern A.III. und IV.
in der Entscheidung des Gerichts erster Instanz des Einheitlichen Patent-
gerichts in dem Verfahren auf Erlass einstweiliger Maßnahmen betreffend
das EP 4 108 782, Verfahrensnummer UPC CFI 2/2023, erlassen am 19.
September 2023, Folge zu leisten.
Die Antragsgegnerinnen haben b e a n t r a g t,
den Antrag auf Festsetzung von Zwangsgeld vom 28.09.2023 vollumfänglich
und kostenpflichtig zurückzuweisen;
hilfsweise:
über den Antrag auf Festsetzung von Zwangsgeld vom 28.09.2023 nicht ohne
mündliche Verhandlung – möglich als Videoverhandlung nach Regel 354.4 in
Verbindung mit Regel 264 VerfO – zu entscheiden.
Die Antragsgegnerinnen sind unter Verweis auf Art. 82 Abs. 3 EPG× der Ansicht, die
Vollstreckungsvoraussetzungen lägen nicht vor. Für die Vollstreckung würden die Voll-
streckungsverfahren und -bedingungen gelten, welche in dem jeweiligen Vertragsmit-
gliedstaat gelten, in dem die Vollstreckung stattfinde. In Deutschland setze die Vollzie-
hung einer einstweiligen Verfügung voraus, dass eine Parteizustellung erfolgt ist. In
Frankreich sei die Zustellung der Entscheidung durch einen Gerichtsvollzieher erfor-
derlich. Diese Voraussetzungen seien nicht erfüllt.
Selbst wenn man davon ausgehen würde, dass nationale Vollstreckungsbedingungen
auf einstweilige Anordnungen des EPG nicht anzuwenden sind, ergebe sich aus allge-
meinen Vertrauensschutzgesichtspunkten, dass der Vollstreckungsgläubiger den Voll-
streckungsschuldner – ggf. auch formlos – darüber informiere, dass und in welchem12
Umfang er die Vollstreckung einer Anordnung beabsichtigt. Auch das sei vor Antrag-
stellung nicht geschehen.
Die Antragsgegnerinnen sind der Ansicht, nicht gegen die Anordnungen vom 19. Sep-
tember 2023 verstoßen zu haben. Sie haben diesbezüglich vorgetragen,
- sowohl die Abbildung des CosMx auf der Startseite der Domain https://nano-
string.com/ als auch die Verlinkung auf die Produktseite des CosMx (https://na-
nostring.com/products/cosmx-spatial-molecular-imager/cosmx-smi-single-cell-
imaging-de/) stelle kein Angebot im patentrechtlichen Sinne dar; zudem sei auf
der Produktseite ausweislich eines am 6. Oktober 2023 gefertigten Screenshots
ein der Anordnung entsprechender Disclaimer vorhanden gewesen (Anlage B-
ZG 1i ), welcher – überobligatorisch – bereits am 19. September 2023 angebracht
worden sei;
- mit Blick auf die Manuals nach Anlage BP ZV 9 und 10 sei der gerichtliche ange-
ordnete Disclaimer prominent auf dem Deckblatt positioniert und dort mit einem
farbigen Kasten deutlich hervorgehoben; bei der Anlage BP-ZV 10a handele es
sich um eine „Altfassung“, der Tenor der Anordnungen beziehe sich aber nur auf
die aktuelle Bedienungsanleitung;
- im CX-Lab in Amsterdam erfolge kein Angebot und auch sonst keine relevante
Handlung, die sich auf die angegriffenen Ausführungsformen 1 bis 3 beziehe; das
bloße Zeigen/Ausstellen des CosMx im Labor sei nicht untersagt, weil kein
Schlechthinverbot existiere;
- die Labortätigkeit im Hinblick auf das patentgemäße Verfahren sei bereits vor
Zustellung der Anordnungen eingestellt worden; das Formular mit der ×berschrift
„Request a Tour or Test Drive“ auf der Unterseite zum Labor in Amsterdam
(https://nanostring.com/about-us/cx-labs/cxlab-amsterdam/) stelle kein Angebot
für das streitgegenständliche Verfahren dar;
- hinsichtlich der „Spatial Multiomics Summits” und “Experience the Power of Spa-
tial Biology” liege kein Verstoß vor, da der angeordnete Disclaimer der Anlage
BP-ZV 7 unmittelbar zu entnehmen sei; die Formulierung „measuring and13
visualizing the full RNA reactome in situ“ beziehe sich nicht auf den CosMx, son-
dern auf den GeoMx Digital Spatial Profiler.
Ergänzend wird auf den schriftsätzlichen Vortrag der Parteien nebst Anlagen Bezug
genommen.14
Begründung
Der gemäß Art. 82 Abs. 4 EPG×, Regel 354.4 VerfO zulässige Zwangsgeldantrag hat
überwiegend Erfolg. Die Antragsgegnerinnen haben gegen die Anordnungen der Lo-
kalkammer vom 19. September 2023 verstoßen. Daher sind gegen sie gemäß Art. 82
Abs. 4 EPG× Zwangsgelder zu verhängen. Eine mündliche Verhandlung hat die Lo-
kalkammer nicht für notwendig erachtet.
I. Die Anordnungen vom 19. September 2023 waren nach Regel 354.1 VerfO ent-
gegen der Ansicht der Antragsgegnerinnen ohne weitere gerichtliche Vollstre-
ckungsanordnung oder -androhung bereits durch die Zustellung über das CMS
am 20. September 2023 unmittelbar vollstreckbar (zur Vollstreckung siehe auch
Lokalkammer Düsseldorf, UPC_CFI_177/2023, APP_552740/2023). Auf Ziffer F.
der Anordnungen vom 19. September 2023 („Anordnungen sind sofort wirksam
und vollstreckbar“) wird insofern verwiesen.
Es bedurfte angesichts dessen keiner vorherigen Mitteilung durch die Antragstel-
lerinnen, „tatsächlich vollstrecken zu wollen“. Angesichts der eindeutigen Rege-
lung in Art. 82 Abs. 4 EPG× zur Verhängung von Zwangsgeldern bei Nichtbeach-
tung gerichtlicher Anordnungen bedurfte es auch keiner parteiseitigen Zustellung
der Anordnungen vom 19. September 2023 vor der Verhängung von Zwangsgel-
dern. Die Voraussetzungen der Verhängung von Zwangsgeldern sind in Art. 82
Abs. 4 EPG× abschließend geregelt; im Recht der Vertragsmitgliedstaaten be-
stehende vollstreckungsrechtliche Erfordernisse sind insofern nicht einschlägig
(siehe dazu auch Lokalkammer Düsseldorf, UPC_CFI_177/2023,
APP_552740/2023); das nationale Vollstreckungsrecht erlangt in einem solchen
Fall allenfalls dann Bedeutung, wenn ein Schuldner das ihm schon auferlegte
Zwangsgeld nicht zahlt (siehe auch insoweit Lokalkammer Düsseldorf,
UPC_CFI_177/2023, APP_552740/2023).
Regel 118.8 der VerfO gilt nach ihrem eindeutigen Wortlaut („Die in Absätzen 1
und 2 (a) genannten Anordnungen…“) nicht für Anordnungen nach Art. 62 EPG×.15
II. Die Antragsgegnerinnen haben nach Zustellung der Anordnungen am 20. Sep-
tember 2023 mehrfach gegen diese Anordnungen verstoßen.
1. Verstoß gegen Ziffer A.I. der Anordnungen vom 19. September 2023
Die Antragsgegnerinnen haben, indem sie auch noch am 26. September 2023
über die Internetseite https://nanostring.com die Durchführung patentverletzen-
der Verfahren im CX-Lab in Amsterdam angeboten haben, gegen Ziffer A.I. der
Anordnung vom 19. September verstoßen („…ein Verfahren … anzuwenden oder
zur Anwendung … anzubieten“).
Die Antragsgegnerinnen haben auf der Webseite https://nanostring.com/about-
us/cx-labs/cxlab-amsterdam/ auch noch am 26. September 2023 angeboten, das
patentverletzende Verfahren in ihrem CX-Lab in Amsterdam durchzuführen. Dies
zeigt der Screenshot der Webseite vom 26. September 2023 (Anlage BP ZV 2).
Dort wird im Rahmen der aktuellen Vorstellung des CX-Labs im Abschnitt „Plat-
forms Designed to Accelerate Sample to Discovery“ der CosMx als eines der Pro-
dukte der Antragsgegnerinnen benannt, die im Labor vorhanden sind. Daneben
wird der CosMx in einem auf der benannten Internetseite abrufbaren Präsentati-
onsvideo als Laborausstattung hervorgehoben (Screenshot vom 26. September
2023 als Anlage BP ZV 3).
Die Antragsgegnerinnen bieten an, dass Gäste des Labors das Verfahren unter
Assistenz von Mitarbeitern der Antragsgegnerinnen durchführen können. Hierzu
findet sich auf der vorbezeichneten Internetseite ein Anfrageformular, in dem un-
ter anderem ein „Test Drive“ mittels der „CosMx“-Technologie ausgewählt werden
kann. Aus dem Formular ergibt sich auch, dass das Gerät im Labor der Antrags-
gegnerinnen vor allem zur Detektion von RNA (und nicht etwa nur für die Protein-
anlyse) genutzt wird, bei der die Verletzungsgegenstände 2 (Nachweisreagenz)
und 3 (Decodersonde) verwendet werden. Auf der Internetseite https://nano-
string.com/about-us/legal/terms-of-sale/ (Anlage BP ZV 4) sind unter dem Titel
„CosMxTM Spatial Molecular Imager Technology Access Program Services“ die
Bedingungen abrufbar, unter denen die Antragsgegnerinnen den CosMx mit Pro-
ben von Kunden verwenden. Hieraus ergibt sich, dass die Antragsgegnerinnen
für die RNA-Detektion die angegriffenen Ausführungsformen 2 und 3 verwenden.16
In der Länderauswahl dieses Formulars lassen sich die EPG-Mitgliedstaaten,
etwa Deutschland, auswählen.
Damit wird entgegen Ziffer A.I. der Anordnung die Anwendung des patentgemä-
ßen Verfahrens im Hoheitsgebiet des EPG angeboten. Der von den Antragsgeg-
nerinnen vorgelegte Screenshot vom 6. Oktober 2023, welcher einen Disclaimer
zeigt, ist im Hinblick auf ein ausweislich der Anlage BP ZV 2 erfolgtes Angebot
ohne Disclaimer vom 26. September 2023 unbeachtlich. Unbeachtlich ist auch,
dass die Labortätigkeit im Hinblick auf das patentgemäße Verfahren angeblich
bereits vor Zustellung der Anordnungen eingestellt wurde, denn beworben wurde
die Durchführung des patentverletzenden Verfahrens auch noch am 26. Septem-
ber 2023. Auch die Eingrenzung auf die Proteinanwendung datiert offensichtlich
nicht vom 26. September 2023.
2. Verstöße gegen Ziffern A.II., III. und IV. der Anordnungen vom 19. Septem-
ber 2023
Die Antragsgegnerinnen haben ferner durch die mit dem Zwangsgeldantrag be-
schriebenen Angebotshandlungen gegen Ziffern A.II., III. und IV. der Anordnun-
gen vom 19. September 2023 verstoßen.
Der Begriff des Anbietens umfasst gemäß Art. 25 (a) EPG× jede im Geltungsbe-
reich des in Rede stehenden Patents begangene Handlung, die nach ihrem ob-
jektiven Erklärungswert den Gegenstand der Nachfrage in äußerlich wahrnehm-
barer Weise zum Erwerb der Verfügungsgewalt bereitstellt.
a. Internetauftritt (https://nanostring.com)
Auf der Startseite des Internetauftritts unter der URL https://nanostring.com
wurde auch noch am 26. September 2023 der CosMx (angegriffene Ausführungs-
form 1) angeboten (Anlage BP ZV 5).17
Ob bereits diese nach der Entscheidung vom 19. September 2023 offenbar un-
verändert gebliebene Produktdarstellung auf der Startseite einen Verstoß gegen
die Anordnungen vom 19. September 2023 darstellt, kann dahinstehen; folgt man
nämlich dem Button „Learn more“, gelangte man ausweislich der Anlage BP ZV
11 noch am 21. September 2023 auf die Produktseite mit folgender Abbildung:
Zumindest die nach Anklicken des Buttons „Learn more“ angezeigte Darstellung
stellt aus Sicht der Lokalkammer eindeutig ein Angebot zur Lieferung des CosMx
dar („Shipping now“).
Soweit die Antragsgegnerinnen unter Vorlage der Anlage B-ZG 1i vortragen las-
sen, am 6. Oktober 2023, also dem Tag der Erwiderung auf den Zwangsgeldan-
trag, habe sich ein der Anordnung entsprechender Disclaimer unterhalb der vor-
stehenden Abbildung befunden, ändert dies nichts daran, dass sich zumindest
am 21. September 2023 (Anlage BP ZV 11) dort ein solcher Disclaimer noch nicht
befand, wie der nachfolgende Bildausschnitt aus dieser Anlage zeigt:18
Soweit die Antragsgegnerinnen unter Vorlage der Anlage B-ZG 1i (Einblendung
nachfolgend) behaupten, dass sich ein solcher Disclaimer bereits am 19. Sep-
tember 2023 dort befunden habe,19
muss die Lokalkammer nach Abgleich der Anlagen BP ZV 11 und B-ZG 1 davon
ausgehen, dass die Antragsgegnerinnen insoweit falsch vortragen. Es ist der Lo-
kalkammer unerklärlich, wie dieser Disclaimer am 19. September 2023 eingefügt
worden sein soll, aber auf dem von der Antragstellerseite vorgelegten Screenshot
vom 21. September 2023 fehlt. Die Antragsgegnerinnen haben für ihre Behaup-
tung, den Disclaimer bereits am 19. September 2023 eingefügt zu haben, auch
keinen Beweis angeboten.
Folglich haben die Antragsgegnerinnen durch das Angebot des CosMx auf der
Produktseite gegen Ziffer A.II. der Anordnungen vom 19. September 2023 ver-
stoßen. Ein erst am 6. Oktober 2023 angebrachter Disclaimer ist mit Blick auf
einen bereits im September 2023 erfolgten Verstoß unbeachtlich. Die Antragstel-
ler haben diese Information der Lokalkammer auch nicht vorenthalten, denn der
Disclaimer wurde offensichtlich erst nach dem 21. September 2023 angebracht.
b. „Spatial Multiomics Summits“ vom 10. bis 13. Oktober 2023 in Paris und Frankfurt
Die Präsentation des CosMx in Veranstaltungen in UPC-Mitgliedstaaten („Spatial
Multiomics Summits“ vom 10. bis 13. Oktober 2023 in Paris und Frankfurt; Anlage
BP ZV 7) wurde noch am 26. September 2023 uneingeschränkt, also auch zum
Zwecke des RNA-Nachweises, auf der Internetseite https://nanostring.com an-
gekündigt.
Soweit die Antragsgegnerinnen hiergegen vorbringen, der in diesem Zusammen-
hang verwandte Terminus „measuring and visualizing the full RNA reactome in
situ“ beziehe sich speziell auf das GeoMx-System (also nicht auf den im Streit
stehenden CosMx), lässt sich diese Einschränkung der alle nachfolgend aufge-
führten Geräte betreffenden und deren Aufzählung vorangestellten Erläuterung
nicht entnehmen; die zum 6. Oktober 2023 erfolgte Einschränkung betreffend den
CosMx („CosMx … for protein analysis“) auf der betroffenen Internetseite spricht
insofern für sich.
Soweit die Antragsgegnerinnen darauf hinweisen, im Hinblick auf die Vorstellung
des Geräts in Paris und Frankfurt sei ausweislich der Anlage BP ZV 7 ein anord-
nungsgemäßer Hinweis enthalten, war dieser Hinweis insofern für den angespro-
chenen Verkehr verwirrend, als das Gerät laut Veranstaltungsankündigung vom20
26. September 2023 in Paris und Frankfurt zur uneingeschränkten Verwendung
(„… measuring and visualizing the full RNA reactome…“) präsentiert werden
sollte. Aus Sicht eines potentiellen Abnehmers ist eine Ankündigung, ein Gerät
auch zu einem Zweck vorgestellt zu bekommen, der aufgrund einer gerichtlichen
Verfügung nicht im Angebotsumfang enthalten sein darf, verwirrend.
c. “Instrument User Manual“ und „Manual Slide Preparation“
Die Antragsgegnerinnen haben gegen Ziffern A.II., und IV. der Anordnung vom
19. September verstoßen, indem sie die angegriffenen Ausführungsformen 1
(CosMx) und 3 (Decodersonden) auch noch am 27. September 2023 angeboten
haben, ohne diese mit den in den Ziffern A.II. und A.IV. der Anordnungen vorge-
schriebenen Hinweisen zu versehen.
Auf den am 27. September 2023 von der Seite https://university.nano-
string.com/page/document-library heruntergeladenen Version der Bedienungs-
anleitung „Manual Slide Preparation“ (Anlage BP ZV 10a), welche die angegriffe-
nen Ausführungsformen 1 und 3 betrifft, findet sich gar kein Hinweis entspre-
chend der Anordnungen vom 19. September 2023. Soweit die Antragsgegnerin-
nen vortragen, es handele sich bei der Anlage BP ZV 10a um eine „Altfassung“,
ist dies unbeachtlich; maßgeblich für die Feststellung eines Verstoßes gegen die
Anordnungen vom 19. September 2023 ist allein, ob eine solche Fassung nach
dem 19. September 2023 im Internet abrufbar war. Den Anordnungen ist auch
keine Einschränkung dahin zu entnehmen, dass sich diese nur auf eine aktuelle
Bedienungsanleitung beziehen.
Auf den am 27. September 2023 von der Seite https://university.nano-
string.com/page/document-library heruntergeladenen Bedienungsanleitungen
zum CosMxTM SMI „Instrument User Manual“ und „Manual Slide Preparation“
(Anlagen BP ZV 9 und 10) findet sich zwar jeweils am unteren Ende der ersten
Seite der nachfolgend eingeblendete Hinweis.21
Dieser entspricht jedoch aufgrund der Schriftgröße und im Verhältnis zur Gesamt-
abbildung nicht der in der Entscheidung niedergelegten Anforderung der blick-
fangmäßigem Herausstellung. Der Hinweis ist ersichtlich kleingedruckt und weist
einen nur minimalen Zeilenabstand auf. Als „ausdrücklich und blickfangmäßig
herausgestellt“ kann diese Gestaltung des Hinweises nicht bewertet werden; sie
erweckt in ihrer Gestaltung vielmehr den Eindruck, unwichtig zu sein und unge-
lesen bleiben zu können. Es handelt sich um keinen Disclaimer, der „prominent
auf dem Deckblatt positioniert und dort mit einem farbigen Kasten deutlich her-
vorgehoben“ ist. Dem Leser wird entgegen der klaren Intention der Anordnungen
vom 19. September 2023 durch die Gestaltung nicht klar vor Augen geführt, dass
es sich hier um eine bedeutsame Mitteilung handelt, die unbedingt gelesen wer-
den sollte. Soweit der Hinweis in einer späteren Version rot eingefärbt wurde,
ändert dies nichts an der am 27. September 2023 bestehenden und abrufbaren
Gestaltung.22
d. Angebot der angegriffenen Ausführungsformen mit der Bewerbung der Tour zur
Produktpräsentation
Auch das Angebot einer Tour zur Produktpräsentation auf der Internetseite
https://nanostring.com (Anlage BP ZV 2 vom 26. September 2023) stellt einen
Verstoß gegen die Anordnungen vom 19. September 2023 dar.
Es handelt sich hierbei nicht lediglich um ein Ausstellen des CosMx im Labor; der
CosMx wird ausweislich der Anlage BP ZV 2 ohne die nach Ziffer A.II. der Anord-
nungen erforderlichen Hinweise zur testweisen Verwendung im CX-Lab angebo-
ten und zwar ausdrücklich auch im Hinblick auf die RNA-Analyse. Dabei kommen
unstreitig auch die angegriffenen Ausführungsformen 2 und 3 zum Einsatz. Dies
stellt einen Verstoß gegen Ziffer A.III. („… Nachweisreagenzien … zur Benutzung
des Verfahrens … anzubieten…“) und Ziffer A.IV. („…Decodersonden … zur Be-
nutzung des Verfahrens … anzubieten …, ohne…“) dar; im Falle der Verwendung
der Decodersonden wird der Hinweispflicht nicht genügt.
III. Sofern die Antragsgegnerinnen zu 2) und 3) vorbringen, für die Internetseite
(www.nanostring.com) nicht verantwortlich zu sein, ist auf die Ausführungen in
der Entscheidung vom 19. September 2023 (dort Ziffer A.I.) betreffend die Zu-
rechnung der Angebotshandlungen zu verweisen.
IV. Da die Antragsgegnerinnen durch die Gestaltung ihrer Internetauftritts im Zeit-
raum bis zum 6. Oktober 2023 gegen die Unterlassungsanordnung der Lokal-
kammer verstoßen haben, ist die Festsetzung eines Zwangsgeldes in Höhe von
100.000,00 € erforderlich aber auch angemessen, um die Unterlassungsanord-
nung effektiv durchzusetzen und deren zukünftige Einhaltung durch die Antrags-
gegnerinnen zu erzwingen.
Gemäß Art. 82 Abs. 4 Satz 2 EPG× muss das Zwangsgeld in einem angemes-
senen Verhältnis zu der Bedeutung der zu vollstreckenden Anordnung stehen.
Damit korrespondierend ist der Betrag des für den Fall eines Verstoßes an das
Gericht zu zahlenden Zwangsgeldes nach R. 354.4 VerfO im Hinblick auf die Be-
deutung der in Rede stehenden Anordnung festzusetzen. Entscheidendes Krite-
rium für die Bestimmung der Höhe des Zwangsgeldes ist somit die Bedeutung
der Anordnung und damit letztlich das Interesse des Gläubigers an deren23
Durchsetzung. Das Zwangsgeld soll den Schuldner verlässlich von zukünftigen
Verstößen und Verletzungen abhalten und besitzt daher in erster Linie eine Beu-
gefunktion. Wie sowohl die englische („penalty payment“; „be sanctioned“) als
auch die französische („sanctionée“) Fassung von Art. 82 Abs. 4 EPG× verdeut-
lichen, handelt es sich bei dem Zwangsgeld daneben allerdings auch um eine
strafähnliche Sanktion für die ×bertretung des gerichtlichen Verbots, weshalb die
Verhängung von Zwangsgeldern als ungeschriebenes Tatbestandsmerkmal auch
ein Verschulden des Schuldners voraussetzt.
Dieser doppelte Zweck des Zwangsgeldes erfordert es, die Bemessung des
Zwangsgeldes jedenfalls in erster Linie mit Blick auf den Schuldner und dessen
Verhalten vorzunehmen. Zu berücksichtigen sind insbesondere Art, Umfang und
Dauer des Verstoßes, der Verschuldensgrad, der Vorteil des Verletzers aus der
Verletzungshandlung und die Gefährlichkeit der begangenen und möglichen
künftigen Verletzungshandlungen für den Verletzten. Je häufiger und intensiver
der Schuldner gegen das ihm auferlegte Unterlassungsgebot verstoßen hat,
desto klarer hat er seinen Unwillen zum Ausdruck gebracht, sich der Unterlas-
sungsanordnung zu beugen. Dem hat die Bemessung des Zwangsgeldes Rech-
nung zu tragen: Hat der Schuldner in der Vergangenheit bereits mehrfach gegen
die Unterlassungsanordnung verstoßen, erhöht sich der notwendige Druck, um
ihn zukünftig zu einem anordnungsgemäßen Verhalten zu zwingen. Hat der
Schuldner demgegenüber bereits in der Vergangenheit seinen Willen zur Befol-
gung der Unterlassungsanordnung gezeigt, kann dies den notwendigen Druck
und damit das Zwangsgeld reduzieren, um den Schuldner zukünftig zu einem
anordnungsgemäßen Verhalten anzuhalten. Bei der Beurteilung der Intensität
des Verstoßes ist somit das gesamte Verhalten des Schuldners in den Blick zu
nehmen. Zu berücksichtigen sind insbesondere Art, Umfang und Dauer des Ver-
stoßes, der Verschuldensgrad sowie die Gefährlichkeit der begangenen und
möglicher zukünftigen Verletzungshandlungen für den Gläubiger (siehe schon LK
Düsseldorf UPC_CFI_177/2023/ACT_525740/2023/App_552740/2023).24
Ausgehend von diesen Grundsätzen hält die Lokalkammer die Festsetzung eines
Zwangsgeldes in Höhe von 100.000,00 EUR für gerechtfertigt, aber auch gebo-
ten, um die Antragsgegnerinnen zukünftig zu einer Befolgung des ihr auferlegten
Unterlassungsgebotes zu zwingen. Zur Zahlung des verhängten Zwangsgeldes
ist jede der Antragsgegnerinnen einzeln verpflichtet; die Zahlung gilt für alle An-
tragsgegnerinnen als abgegolten, sobald der Gesamtbetrag beim Einheitlichen
Patentgericht eingegangen ist.
Sämtliche Verstöße, die Gegenstand des Zwangsgeldantrags vom 28. Septem-
ber 2023 sind, basieren auf der Gestaltung des Internetauftritts der Unterneh-
mensgruppe der Antragsgegnerinnen. Diesen haben die Antragsgegnerinnen of-
fenbar nicht zeitnah nach Zustellung der Anordnungen vollständig angepasst. Da
die geltend gemachten Einzelverstöße allesamt dem Umstand der nicht zeitnah
angepassten Umstellung des Internetauftritts geschuldet sind, handelt es sich um
eine einheitliche Ursache, so dass ein einheitliches Zwangsgeld zu verhängen
war. Bei der Höhe des Zwangsgeldes war zu berücksichtigen, dass der Zeitraum
zwischen der Zustellung der Anordnungen vom 19. September 2023 und dem
Zwangsgeldantrag kurz ist. Zu berücksichtigen war auch, dass die Antragsgeg-
nerinnen den Zwangsgeldantrag zum Anlass genommen haben, weitere Anpas-
sungen des Internetauftritts vorzunehmen. Auf der anderen Seite war die Vielzahl
der festgestellten Verstöße, welche zumindest grob fahrlässig erfolgten, zu Las-
ten der Antragsgegnerinnen zu werten. Zu berücksichtigen war auch, dass mit
jedem einzelnen der von den Antragstellerinnen angebotenen Geräte (CosMx)
erhebliche Umsätze verbunden sind, wobei dies auch den nachgelagerten Markt
für Reagenzien und Decodersonden betrifft; daraus ergibt sich eine hohe Gefähr-
lichkeit der begangenen und möglichen künftigen Verstöße für die Antragsteller-
seite.
V. Die Kostenentscheidung beruht auf einer entsprechenden Anwendung von Regel
118.5 Satz 1 VerfO. Bei der Verteilung der Kosten hat die Lokalkammer berück-
sichtigt, dass sämtliche von den Antragstellerinnen geltend gemachten Verstöße
auch als Verstöße zu werten waren, so dass die Antragstellerinnen mit ihrem An-
trag insofern vollständig obsiegen.25
Die Tatsache, dass die Antragstellerinnen formal die Festsetzung von deutlich
höheren Zwangsgeldern beantragt haben, führt aus Sicht der Kammer unter Be-
rücksichtigung der grundlegenden Erwägungen zur Kostenverteilung in Art. 69
Abs. 1 und 2 EPG× allerdings nicht dazu, dass die Antragstellerinnen einen Teil
der Kosten des Zwangsgeldverfahrens tragen müssen, da die Bestimmung der
Höhe im Ermessen des Gerichts liegt (Regel 354.4 VerfO) und Betragsangaben
durch den Antragsteller insofern allenfalls den Charakter eines Vorschlages ha-
ben können.
VI. Da es sich bei der vorliegenden Anordnung um eine der ersten zur Festsetzung
von Zwangsgeldern wegen Verstoßes gegen eine Anordnung des Gerichts han-
delt, hält es die Lokalkammer für geboten, die Berufung für beide Parteien zuzu-
lassen und diesen damit die Möglichkeit einzuräumen, die Anordnung durch das
Berufungsgericht überprüfen zu lassen (Art. 73 (2) (b) (ii) EPG×, Regel 220.2,
354.4 VerfO).
VII. Dafür, die Anordnung von einer Sicherheitsleistung im Sinne von Regel 352.1
VerfO abhängig zu machen, bestand kein Anlass.
Anordnung
I. Gegen die Antragsgegnerinnen wird wegen eines Verstoßes gegen die im Ver-
fahren UPC_CFI_2/2023 am 19. September 2023 ergangenen Anordnungen ein
an das Einheitliche Patentgericht zu zahlendes Zwangsgeld in Höhe von insge-
samt 100.000,00 € verhängt.
II. Im ×brigen wird der Antrag auf Festsetzung von Zwangsgeld abgewiesen.
III. Die Kosten des Zwangsgeldverfahrens werden den Antragsgegnerinnen aufer-
legt.
IV. Diese Anordnung ist sofort vollstreckbar.
V. Die Berufung wird zugelassen.26
VI. Der Streitwert des Zwangsgeldverfahrens wird auf 250.000,00 € festgesetzt.

On 1 June 2023, the applicants filed an application with the Unified Patent Court (Local
Chamber Munich) for interim measures on the grounds of infringement
of EP 4 108 782 (patent in dispute) by the respondents.
On 19 September 2023, the Local Chamber issued the following order:
A. The respondents are ordered to refrain from the following in the territories of the Republic of Austria,
the Kingdom of Belgium, the Republic of Bulgaria, the Kingdom of Denmark, the
Republic of Estonia, the Republic of Finland, the French Republic, the Federal Republic of Germany
I. a method for detecting a plurality of analytes in a cell or tissue sample

B. For each individual infringement of the orders under A.I. to

C. In all other respects, the application for interim measures is dismissed.
D. The applications made by the respondents are dismissed.
E. The respondents shall reimburse the costs of the proceedings.

The order was served on the parties on 20 September 2023 via the CMS.10
In their application for the imposition of a penalty payment
of 28 September 2023, the applicants claim that the respondents violated the order of
19 September 2023 by
- contrary to section A.I. of the orders of 19 September 2023, advertising the implementation
of the patent-infringing process in the CX Lab in Amsterdam
;
- on 26 September 2023, they still offered the contested embodiment 1
(CosMx) on the internet for EPG member states without the notice required under
point A.II. of the order;
- on 26 September 2023, they still offered CosMx at events in
UPC member states, including Germany and France, on 27 September 2023
(‘Spatial Multiomics Summits’);
- on 27 September 2023, you still offered the contested embodiments 1
(CosMx) and 3 (decoder probes) in the ‘Instrument
User Manual’ and “Manual Slide Preparation” available on the Internet without the information required under orders
A.II. and IV;
- also on 26 September 2023, on their website https://nano-
string.com/about-us/cx-labs/cxlab-amsterdam/, they offered a tour of the product presentation
, which, in violation of the orders in sections
A.II., III. and IV., affected all of the contested embodiments

The applicants therefore requested that
I. the respondents be ordered to pay a penalty payment of EUR 50,000
to comply with the order in section A.I. of the decision of the
Court of First Instance of the Unified Patent Court in the proceedings
for interim measures concerning EP 4 108 782, case number
UPC CFI 2/2023, issued on 19 September 2023, to be complied with.
II.
II. order the respondents
- by means of a penalty payment of EUR 250,000 each
to comply with the order in section A.II., and
- by means of a penalty payment of EUR 100,000 each
to comply with the order in sections A.III. and IV.
in the decision of the Court of First Instance of the Unified Patent Court
in the proceedings for interim measures concerning
EP 4 108 782, case number UPC CFI 2/2023, issued on 19
September 2023, to be complied with.
The respondents have requested that
that the application for the imposition of a penalty payment dated 28 September 2023 be dismissed in its entirety
and with costs;
in the alternative
that the application for the imposition of a penalty payment dated 28 September 2023 not be decided without
an oral hearing – possible as a video hearing in accordance with Rule 354.4 in
conjunction with Rule 264 VerfO.
The respondents, referring to Article 82(3) EPG×, are of the opinion that the
conditions for enforcement are not met. Enforcement would be subject to the
enforcement procedures and conditions applicable in the respective Member State
Member State in which enforcement takes place. In Germany, the enforcement of a preliminary injunction requires that a party has been served.
In France, the decision must be served by a bailiff.
These conditions are not met.
Even if one were to assume that national enforcement conditions
to interim orders of the EPG are not applicable, it follows from general
principles of protection of legitimate expectations that the enforcement creditor must inform the enforcement debtor – if necessary, informally – that and to what extent
it intends to enforce an order. This also did not happen before the application was made.
.
The respondents are of the opinion that they have not violated the orders of 19 September
2023. In this regard, they have argued that
- both the image of the CosMx on the home page of the domain https://nano-
string.com/ and the link to the product page of the CosMx (https://na-
nostring.com/products/cosmx-spatial-molecular-imager/cosmx-smi-single-cell-
imaging-de/) did not constitute an offer within the meaning of patent law; furthermore,
according to a screenshot taken on 6 October 2023,
a disclaimer in accordance with the order had been included on the product page (Annex B-
ZG 1i), which – beyond what was required – had already been added on 19 September 2023
;
- with regard to the manuals in Annexes BP ZV 9 and 10, the court-ordered
disclaimer was prominently positioned on the cover page and clearly highlighted there with a
coloured box; Annex BP-ZV 10a was
an ‘old version’, but the tenor of the orders only referred to
the current operating instructions;
- no offer was made at the CX Lab in Amsterdam, nor was any other relevant
action taken that related to the contested embodiments 1 to 3; the
mere display/exhibition of the CosMx in the laboratory was not prohibited because there was no
absolute prohibition existed;
- the laboratory activity with regard to the patented method had already been discontinued
before the orders were served; the form with the heading
‘Request a Tour or Test Drive’ on the subpage for the laboratory in Amsterdam
(https://nanostring.com/about-us/cx-labs/cxlab-amsterdam/) did not constitute an offer
for the procedure at issue;
- with regard to the ‘Spatial Multiomics Summits’ and ‘Experience the Power of Spa-
tial Biology’, there is no infringement because the ordered disclaimer can be directly inferred from Annex
BP-ZV 7; the wording ‘measuring and13
visualising the full RNA reactome in situ’ did not refer to CosMx, but
to the GeoMx Digital Spatial Profiler.
Reference is also made to the written submissions of the parties, including the annexes.

Reasons
The application for a penalty payment, which was admissible under Art. 82(4) EPG×, Rule 354.4 VerfO, was
is largely successful. The respondents have violated the orders of the Local Chamber
of 19 September 2023. Therefore, pursuant to Art. 82
(4) EPG×, penalty payments are to be imposed on them. The Local Chamber did not consider an oral hearing
to be necessary.
I. Contrary to the respondents' view, the orders of 19 September 2023 were,
pursuant to Rule 354.1 VerfO, immediately enforceable upon service via the CMS
on 20 September 2023 without any further court enforcement order or threat thereof
(for enforcement, see also Local Chamber Düsseldorf, UPC_CFI_177/2023, APP_552740/2023).

of the orders of 19 September 2023 (‘Orders are immediately effective
and enforceable’).
In view of this, no prior notification by the applicants was required
‘actually intend to enforce’ them. In view of the clear provision in Art. 82(4) EPG× on the imposition of penalty payments for non-compliance with court orders, there was also no need for the orders of 19 September 2023 to be served on the parties before the penalty payments were imposed.
The conditions for the imposition of penalty payments are conclusively regulated in Art. 82(4) EPG×; the enforcement law of the contracting Member States
does not contain any further requirements.
The penalty payment is imposed by the court of the Member State in which the order is to be enforced.

(4) EPG×; enforcement requirements existing in the law of the contracting Member States
are not relevant in this respect

There, as part of the current presentation of the CX Lab in the section ‘Platforms Designed to Accelerate Sample to Discovery’, CosMx is named as one of the products of the respondents that are available in the laboratory. In addition, CosMx is highlighted as laboratory equipment in a presentation video available on the aforementioned website (screenshot dated 26 September 2023).

The respondents offer guests of the laboratory the opportunity to carry out the procedure
with the assistance of the respondents‘ employees. For this purpose,
the aforementioned website contains an enquiry form in which, among other things,
a “test drive” using the “CosMx” technology can be selected.
The form also indicates that the device in the respondents’ laboratory
is primarily used for the detection of RNA (and not just for protein analysis

‘CosMxTM Spatial Molecular Imager Technology Access Program Services’, the

Whether this product presentation on the homepage, which apparently remained unchanged after the decision of 19 September 2023, constitutes a violation of
the orders of 19 September 2023 can be left open; if one clicks on the ‘Learn more’ button, one was taken to the product page with the following illustration, as evidenced by Exhibit BP ZV
11, as early as 21 September 2023:

At least the description displayed after clicking on the ‘Learn more’ button
clearly constitutes an offer to deliver CosMx
(‘Shipping now’) in the view of the Local Chamber.
Insofar as the respondents submit Annex B-ZG 1i,
, on 6 October 2023, i.e. the date of the response to the application for a penalty payment,
there was a disclaimer in accordance with the order below the above image,
this does not alter the fact that, at least
on 21 September 2023 (Annex BP ZV 11), no such disclaimer was yet
, as shown by the following image excerpt from this exhibit:18
Insofar as the respondents, submitting Exhibit B-ZG 1i (inserted
below), claim that such a disclaimer was already there on 19 September
2023,19
after comparing Annexes BP ZV 11 and B-ZG 1, the Local Chamber must assume
that the respondents are incorrect in this respect. It is inexplicable to the Local Chamber
how this disclaimer could have been inserted on 19 September 2023
but is missing from the screenshot submitted by the applicant
of 21 September 2023. The respondents have also failed to provide any evidence for their assertion
that they had already inserted the disclaimer on 19 September 2023.
Consequently, by offering CosMx on the
product page, the respondents have violated section A.II. of the orders of 19 September 2023.

did not withhold this information from the Local Chamber, as the

b. ‘Spatial Multiomics Summits’ from 10 to 13 October 2023 in Paris and Frankfurt
The presentation of CosMx at events in UPC member states ("Spatial
Multiomics Summits' from 10 to 13 October 2023 in Paris and Frankfurt; Annex
BP ZV 7) was still announced on 26 September 2023 without restriction, i.e. also for the
purpose of RNA detection, on the website https://nanostring.com.

c. ‘Instrument User Manual’ and ‘Manual Slide Preparation’

d. Offer of the contested embodiments with the advertisement of the tour for the
product presentation
The offer of a tour for the product presentation on the website
https://nanostring.com (Annex BP ZV 2 of 26 September 2023) also constitutes a
violation of the orders of 19 September 2023.
This is not merely a matter of displaying the CosMx in the laboratory; according to Annex BP ZV 2, the
CosMx is offered without the information required under Section A.II. of the orders
regarding test use in the CX Lab,
and this is expressly stated with regard to RNA analysis.

III. Insofar as the respondents 2) and 3) argue that they are not responsible for the website
(www.nanostring.com), reference is made to the statements in
the decision of 19 September 2023 (section A.I. therein) concerning the
accounting for the offer actions.
IV. Since the respondents violated the Local Chamber's injunction by the design of their website
in the period up to 6 October 2023,
the imposition of a penalty payment of
€100,000.00 is necessary and appropriate in order to effectively enforce the injunction
and to enforce their future compliance by the respondents
.
Pursuant to Art. 82(4) sentence 2 EPG×, the penalty payment must be proportionate
to the significance of the order to be enforced.
Correspondingly, the amount of the penalty payment to be paid to the court in the event of a breach
pursuant to Rule 354.4 VerfO must be determined in view of the significance of the order in question.
The decisive criterion for determining the amount of the penalty payment is therefore the significance of the order and thus ultimately the creditor's interest in its enforcement.

the imposition of penalty payments as an unwritten element of the offence also
requires fault on the part of the debtor.
This dual purpose of the penalty payment requires that the assessment of the
penalty payment must in any case be made primarily with regard to the debtor and his
conduct. Particular account must be taken of the nature, extent and
duration of the infringement, the degree of fault, the advantage gained by the infringer from the
infringement and the danger of the infringements committed and possible
future infringements for the injured party. The more frequently and intensively
the debtor has violated the injunction imposed on him,
the clearer he has expressed his unwillingness to comply with the injunction.
This must be taken into account when calculating the penalty payment:
If the debtor has already violated the injunction several times in the past, the pressure required to
force him to comply with the order in future. If, on the other hand, the debtor has already demonstrated his willingness to comply with the injunction in the past, this may reduce the pressure
and thus the penalty payment required to induce the debtor to comply with the order in future.
When assessing the intensity of the infringement, the debtor's overall conduct must therefore be taken into account.
In particular, the nature, extent and duration of the infringement, the degree of fault and the dangerousness of the acts committed must be considered.

Based on these principles, the Local Chamber considers the imposition of a
penalty payment of EUR 100,000.00 to be justified, but also necessary
in order to compel the respondents to comply with the injunction imposed on them in future.
Each of the respondents is individually liable for payment of the penalty payment imposed
; payment shall be deemed to have been made in respect of all respondents
as soon as the total amount has been received by the Unified Patent Court
.
All infringements that are the subject of the application for a penalty payment dated 28 September
2023 are based on the design of the website of the group of companies of the respondents.
The respondents apparently did not adapt this completely in a timely manner after the orders were served.
Since
the individual infringements asserted are all due to the fact that the website was not adapted in a timely manner,
there is a single cause, so that a single penalty payment had to be imposed.
In determining the amount of the penalty payment, it had to be taken into account that the period
between the delivery of the orders of 19 September 2023 and the
application for a penalty payment is short. It also had to be taken into account that the defendants took the penalty payment application as an opportunity to make further adjustments to their website.

of the infringements committed and possible future infringements for the applicants

V. The decision on costs is based on the corresponding application of Rule
118.5 sentence 1 VerfO. In allocating the costs, the Local Chamber took into account
that all infringements asserted by the applicants
were also to be considered infringements, so that the applicants were completely successful in their application in this respect.

The fact that the applicants formally requested the imposition of significantly
higher penalty payments, does not, in the view of the Chamber, taking into account
the fundamental considerations regarding the allocation of costs in Art. 69
(1) and (2) EPG×, mean that the applicants must bear part
of the costs of the penalty payment proceedings, since the determination of the
amount is at the discretion of the court (Rule 354.4 VerfO) and that the amounts specified
by the applicant can, at most, be regarded as a proposal.
VI.
Since the present order is one of the first to impose periodic penalty payments for infringement of a court order
, the Local Chamber considers it necessary to allow both parties to appeal
and thus give them the opportunity to have the order reviewed by the
Appellate Court (Art. 73 (2) (b) (ii) EPG×, Rule 220.2,
354.4 VerfO).
VII. There was no reason to make the order subject to the provision of security within the meaning of Rule 352.1
PTR.
Order
I. An order for a total penalty payment of €100,000.00 is imposed on the respondents for infringement of the orders issued in proceedings UPC_CFI_2/2023 on 19 September 2023.
II. In all other respects, the request for the imposition of a penalty payment on the Unified Patent Court is dismissed.
