Leitsätze:
1. Auch wenn der Spruchkörper gemäß R. 37.1 VerfO so bald wie möglich nach Abschluss des
schriftlichen Verfahrens durch Anordnung über das Vorgehen nach Art. 33 Abs. 3 EPGÜ ent-
scheiden soll, kann er gemäß R. 37.2 VerfO eine frühere Entscheidung treffen, wenn er das
Vorbringen der Parteien berücksichtigt und ihnen rechtliches Gehör gewährt.
2. Die gemeinsame Verhandlung von Verletzungs- und Nichtigkeitswiderklage kann schon aus
Effizienzgründen sinnvoll sein. Sie ist auch inhaltlich vorteilhaft, da so auf der Grundlage ei-
ner einheitlichen Auslegung durch denselben Spruchkörper in der gleichen Besetzung so-
wohl über den Rechtsbestand als auch über die Verletzungsfrage entschieden werden kann.
Dies gilt umso mehr, wenn sich die Komplexität der streitgegenständlichen Technik im be-
kannten Spektrum von Patentstreitigkeiten als eher moderat darstellt und auch die Anzahl
der Rechtsbestandsangriffe überschaubar ist.

GEGENSTAND: Regel 37.2 VerfO i.V.m. Art. 33 Abs. 3 EPGÜ
GRÜNDE DER ANORDNUNG:
Nachdem die Parteien gegen ein solches Vorgehen keine Einwände erhoben haben, konnte über
die Frage, wie in Bezug auf Art. 33 Abs. 3 EPGÜ zu verfahren ist, bereits vor Abschluss des schrift-
lichen Verfahrens entschieden und diese im Sinne eines Vorgehens nach Art. 33 Abs. 3 lit. a) EPGÜ
beantwortet werden.
Auch wenn der Spruchkörper gemäß R. 37.1 VerfO so bald wie möglich nach Abschluss des schrift-
lichen Verfahrens durch Anordnung über das Vorgehen nach Art. 33 Abs. 3 EPGÜ entscheiden soll,
kann er gemäß R. 37.2 VerfO eine frühere Entscheidung treffen, wenn er das Vorbringen der Par-
teien berücksichtigt und ihnen rechtliches Gehör gewährt. Eine solche frühe Entscheidung ist vor-
liegend schon aufgrund der aktuellen Situation des Gerichts gerechtfertigt und geboten, das sich
in seinen Anfängen befindet. Da Teile des Spruchkörpers derzeit nur auf Teilzeit- bzw. auf case-by-
case-Basis beschäftigt sind, erscheint es aus prozessökonomischen Gründen angezeigt, frühzeitig
die Zuweisung des technischen Richters zu erhalten, um diesen in der Terminplanung so früh wie
möglich berücksichtigen zu können. Anderenfalls bestünde ein erhebliches Risiko von Verzögerun-
gen, wenn der technische Richter erst im Zwischenverfahren hinzugezogen wird und bereits ter-
minlich anderweitig verhindert ist.
Die Lokalkammer macht von dem ihr zustehenden Ermessen dahingehend Gebrauch, dass sie so-
wohl die Verletzungsklage als auch die Widerklage auf Nichtigerklärung verhandelt (Art. 33 Abs. 3
lit. a) EPGÜ). Eine solche gemeinsame Verhandlung von Verletzungs- und Nichtigkeitswiderklage
erscheint schon aus Effizienzgründen sinnvoll. Sie ist auch inhaltlich vorteilhaft, da so auf der
Grundlage einer einheitlichen Auslegung durch denselben Spruchkörper in der gleichen Besetzung
sowohl über den Rechtsbestand als auch über die Verletzungsfrage entschieden werden kann. Ein
solches einheitliches Vorgehen ist umso mehr gerechtfertigt, wenn sich die Komplexität der streit-
gegenständlichen Technik – wie hier – im bekannten Spektrum von Patentstreitigkeiten eher mo-
derat darstellt und auch die Anzahl der Rechtsbestandsangriffe überschaubar ist.
ANORDNUNG:
Aus diesen Gründen ordnet die Lokalkammer Düsseldorf nach Anhörung der Parteien an, dass sie
sowohl die Verletzungsklage als auch die Widerklage auf Nichtigerklärung verhandelt.
Anweisungen an den Berichterstatter:
Der Berichterstatter soll die Präsidentin des Gerichts erster Instanz ersuchen, dem Spruchkörper
einen technisch qualifizierten Richter zuzuweisen.

SUBJECT: Rule 37.2 VerfO in conjunction with Art. 33(3) EPGÜ
REASONS FOR THE ORDER:
Since the parties did not raise any objections to such a procedure,
the question of how to proceed with regard to Art. 33(3) EPGÜ could already be decided before the conclusion of the written proceedings
and answered in accordance with Art. 33(3)(a) EPGÜ.
Even though, pursuant to Rule 37.1 of the Rules of Procedure, the Board of Appeal must decide as soon as possible after the conclusion of the written proceedings
on the procedure to be followed pursuant to Article 33(3) EPGÜ,
it may, pursuant to Rule 37.2 of the Rules of Procedure, take an earlier decision if it considers that the submissions of the parties
and grant them a legal hearing. Such an early decision is
justified and necessary in the present case due to the current situation of the court, which is
still in its infancy. Since parts of the decision-making body are currently only employed on a part-time or case-by-case basis,
it seems appropriate for reasons of procedural economy to obtain the assignment of the technical judge at an early stage
obtain the assignment of the technical judge at an early stage so that this can be taken into account in the scheduling as early as possible.
Otherwise, there would be a considerable risk of delays
if the technical judge were only called in during the interim proceedings and were already
unavailable due to other commitments.
The Local Chamber exercises its discretion in this regard by hearing
both the infringement action and the counterclaim for a declaration of invalidity (Art. 33(3)
(a) EPGÜ). Such a joint hearing of infringement and invalidity counterclaims
appears sensible for reasons of efficiency alone. It is also advantageous in terms of content, as it allows
on the basis of a uniform interpretation by the same panel in the same composition .
Such a uniform approach is all the more justified where the complexity of the technology at issue,
as in the present case, is rather typical of the known spectrum of patent disputes
and the number of attacks on the legal status is manageable.
ORDER:
For these reasons, the Local Chamber in Düsseldorf, after hearing the parties, orders that it
hear both the infringement action and the counterclaim for annulment.
Instructions to the rapporteur:
The rapporteur shall request the President of the Court of First Instance to assign a technically qualified judge to the panel.
