ANTRÄGE DER PARTEIEN:
Die Beklagten beantragen, die Fristen zur Klageerwiderung für die Beklagte zu 1) und die Beklagte zu 2) einheitlich bis einschließlich zum 30.10.2023 zu verlängern.
Sie tragen vor, die Fristverlängerungen seien für die nötige Aufklärung des Sachverhalts und Abstimmung, insbesondere auch mit ihren im außereuropäischen Ausland ansässigen Zulieferern, deren Komponenten im Kern des Verletzungsvorwurfs stünden, erforderlich. Eine ausreichende Aufklärung und Abstimmung innerhalb der laufenden Fristen sei insbesondere deshalb schwer möglich, weil die zentralen Ansprechpartner bei den Beklagten und auch den Zulieferern in den kommenden Wochen aufgrund Urlaubsabwesenheit nicht erreichbar seien.
Die Klägerin hat dem Fristverlängerungsantrag widersprochen. Sie meint, die Beklagten hätten keine besonderen Gründe für eine Fristverlängerung angeführt. Anderenfalls bittet sie darum, die Frist um höchstens zwei Wochen zu verlängern.

GRÜNDE DER ANORDNUNG:
Dem Antrag auf Fristverlängerung war nicht stattzugeben. Die Verfahrensordnung des Einheitlichen Patentgerichts (VerfO) enthält für das schriftliche Verfahren einer Verletzungsklage nach R. 12 VerfO ein austariertes Fristenregime mit auskömmlichen Fristen nach R. 23 und 29 VerfO. Dabei ist für die Klagerwiderung bereits nach R. 23 VerfO mit drei Monaten die längste Frist vorgesehen.
Überzeugende Gründe, die in Abweichung von dem vorgesehenen Fristenregime eine Fristverlängerung nach R. 9.3 (a) VerfO eröffnen würden, haben die Beklagten nicht vorgebracht. Soweit die Beklagten sich darauf berufen, dass eine Abstimmung mit im außereuropäischen Ausland ansässigen Zulieferern, deren Komponenten im Kern des Verletzungsvorwurfs stehen, erforderlich sei, stellt dieser Umstand als solcher noch keinen überzeugenden Grund für eine ausnahmsweise zu gewährende Fristverlängerung dar. Die Klagerwiderungsfrist nach R. 23 VerfO ist vielmehr bereits dem Grunde nach so bemessen, dass sie für in den Zuständigkeitsbereich des Einheitlichen Patentgerichts fallende internationale Patentstreitigkeiten eine Aufklärung des Sachverhalts und eine interne Abstimmung auch über Urlaubszeiten hinweg ermöglicht. Im vorliegenden Rechtsstreit beträgt die Klagerwiderungsfrist zudem bereits ohne die beantragte Fristverlängerung aufgrund der Fristberechnung gemäß R. 271.6 (b) iVm 271.4 (a) VerfO für die Beklagte zu 1) tatsächlich drei Monate und sechs Tage und für die Beklagte zu 2) drei Monate und acht Tage. Auf die mit Anordnung vom 10.08.2023 vom Berichterstatter mitgeteilte Fristberechnung wird verwiesen. Dass bestimmte, zentrale Ansprechpartner bei den Beklagten und den Zulieferern während des weit überwiegenden Fristzeitraumes urlaubsbedingt nicht erreichbar seien, ist weder ersichtlich noch von den Beklagten geltend gemacht.
Die Zuständigkeit für die Anordnung durch den Berichterstatter folgt aus R. 331.1 iVm 334 (a) VerfO.

ANORDNUNG:
Der Antrag der Beklagten auf Verlängerung der Klagerwiderungsfrist wird zurückgewiesen.

PLAIDS OF THE PARTIES:
The defendants request that the time limits for the response to the statement of defence be extended uniformly for the first defendant and the second defendant until 30 October 2023 inclusive.

They argue that the extensions are necessary to clarify the facts of the case and to coordinate, in particular with their suppliers based outside Europe, whose components are at the heart of the infringement allegations. They argue that it is particularly difficult to clarify and coordinate matters within the current time limits because the main contact persons at the defendants and also at the suppliers will be unavailable in the coming weeks due to holidays.

The plaintiff objected to the request for an extension of the deadline. It argued that the defendants had not given any specific reasons for an extension. Otherwise, it requested that the deadline be extended by a maximum of two weeks.
REASONS FOR THE ORDER:
The request for an extension of the deadline was not granted. The Rules of Procedure of the Unified Patent Court (VerfO) contain a balanced system of time limits for the written proceedings of an infringement action under Rule 12 VerfO, with adequate time limits under Rules 23 and 29 VerfO. The longest time limit for the statement of defence is already provided for in Rule 23 VerfO, at three months.

The defendants did not put forward any convincing reasons that would justify an extension of the time limit under Rule 9.3(a) of the Rules of Procedure in deviation from the time limit regime provided for. Insofar as the defendants argue that coordination with suppliers based in non-European countries, whose components are at the heart of the infringement allegation, is necessary, this circumstance does not in itself constitute a convincing reason for granting an exceptional extension of the time limit. Rather, the time limit for responding to the statement of defence under Rule 23 VerfO is already calculated in such a way that it allows for clarification of the facts and internal coordination, even across holiday periods, in international patent disputes falling within the jurisdiction of the Unified Patent Court. In the present case, even without the requested extension, the time limit for filing a statement of defence is actually three months and six days for the first defendant and three months and eight days for the second defendant, based on the calculation of the time limit pursuant to Rule 271(6)(b) in conjunction with Rule 271(4)(a) of the Rules of Procedure. Reference is made to the calculation of the time limit communicated by the rapporteur in the order of 10 August 2023. It is neither apparent nor has it been claimed by the defendants that certain key contact persons at the defendants and their suppliers would be unavailable due to holidays during the vast majority of the time limit.

The rapporteur's jurisdiction to issue the order is based on R. 331.1 in conjunction with 334 (a) VerfO.

ORDER:
The defendant's application for an extension of the deadline for responding to the statement of defence is rejected.
