OGGETTO DEL PROCEDIMENTO 
Azione per accertamento della contraffazione di brevetto. 

BREVE ESPOSIZIONE DEI FATTI 
Con atto di citazione depositato il 2.6.2023 l’attore ha proposto contro i convenuti un’azione di accertamento della contraffazione del brevetto europeo EP 4101791. Allo stato, l’atto introduttivo del giudizio risulta essere stato ritualmente notificato soltanto ad alcuni dei convenuti. 
In data 3.8.2023 l’attore ha depositato un’istanza di rinuncia all’azione ai sensi della rule 265 RoP, con allegata la dichiarazione di consenso dei convenuti alla rinuncia, nella quale ha anche richiesto al Tribunale il rimborso parziale della Court fees in precedenza pagata. 

RICHIESTE DELLE PARTI 
L’attore chiede che il Tribunale: 
- emetta una decisione che dichiari estinto il presente procedimento; 
- disponga che la decisone sia iscritta nel registro; 
- se necessario, ordini che ciascuna parte sostenga le proprie spese; 
- rimborsi alla ricorrente 37.800 Euro, pari al 60% delle spese processuali sostenute nel presente procedimento. 

I convenuti hanno prestato assenso alla rinuncia all’azione e hanno dichiarato che non chiedono il rimborso delle spese. Ove il Tribunale dovesse ritenere necessaria una pronuncia sulle spese, chiedono che ciascuna parte sia tenuta a sostenere le proprie spese. 

MOTIVI DELLA DECISIONE 
Il Tribunale provvede alla dichiarazione di chiusura del procedimento in conformità alla concorde richiesta delle parti. 
Quanto alle spese di lite, la rule 265, comma 2 lettera c), RoP, prevede in via generale che in seguito alla rinuncia all’azione il Tribunale debba adottare una decisione sulle spese ai sensi delle rules 150 e ss. RoP. In base alla rule 151 RoP, questo tipo di provvedimento viene però emesso solo su richiesta di una delle parti, nel caso di specie invece espressamente esclusa dalla concorde volontà delle parti. Ne consegue che non è necessaria alcuna decisione sulle spese di lite. 
È fondata anche la richiesta di emissione di un ordine di rimborso parziale delle spese processuali sostenute dell’attore, in quanto ricorro le condizioni stabilite dalla rule 370, comma 9 lettera b) e comma 11, RoP. 

DECISIONE 
Il Tribunale Unificato dei Brevetti - Divisione Locale di Milano: 
- dichiara chiuso il presente procedimento; 
- ordina che la presente decisione sia iscritta nel registro; 
- dispone che il Registrar proceda al più presto al rimborso in favore di Ocado Innovation limited dell’importo di 37.800 Euro, pari al 60% delle Court fees dalla stessa pagate nel presente procedimento; 
- dichiara che il valore della controversia è pari a 8.000.000 Euro.

BRIEF STATEMENT OF THE FACTS
 
By writ of summons filed on 2 June 2023, the plaintiff brought an action against the defendants for infringement of European patent EP 4101791. At present, the writ of summons appears to have been duly served only on some of the defendants.
 
On 3 August 2023, the plaintiff filed a motion to withdraw the action pursuant to Rule 265 RoP, attaching the defendants' consent to the withdrawal, in which it also requested the Court to refund part of the court fees previously paid.
REQUESTS OF THE PARTIES
The plaintiff requests that the Court:

- issue a decision declaring the present proceedings closed;
- order that the decision be entered in the register;
- if necessary, order each party to bear its own costs;
 
- reimburse the applicant EUR 37,800, equal to 60% of the costs incurred in the present proceedings.
The defendants have agreed to the withdrawal of the action and have stated that they do not seek reimbursement of costs. Should the Court consider it necessary to rule on costs, they request that each party bear its own costs.
 
REASONS FOR THE DECISION
The Court declares the proceedings closed in accordance with the joint request of the parties.
As regards the costs of the proceedings, Rule 265(2)(c) of the Rules of Procedure provides, in general, that following the withdrawal of the action, the Court shall decide on the costs in accordance with Rules 150 et seq. of the Rules of Procedure.
 However, under Rule 151 of the Rules of Procedure, such a decision is only made at the request of one of the parties, which is expressly excluded in the present case by the mutual agreement of the parties. It follows that no decision on the costs of the proceedings is necessary.
 
The request for an order for partial reimbursement of the costs incurred by the applicant is also well founded, as the conditions laid down in Rule 370(9)(b) and (11) of the RoP are met.
DECISION
The Unified Patent Court - Local Division of Milan:
- declares the present proceedings closed;
 
- orders that this decision be entered in the register;
- orders the Registrar to reimburse Ocado Innovation Limited as soon as possible the amount of 37,800 euros, equal to 60% of the court fees paid by it in these proceedings;
- declares that the value of the dispute is 8,000,000 euros.
