A. Indicazione della richiesta della parte ricorrente.
Con atto depositato il 13.6.2023 Oerlikon Textile G.m.b.H. & Co. K.G. (di seguito Oerlikon) esponeva di essere titolare del brevetto europeo n. EP214848B1 (di seguito EP848), intitolato
“false twist texturing machine” avente ad oggetto una macchina tessile, rilasciato in data 23.9.2011, in seguito a domanda del 23.1.2009, rivendicante priorità nazionale tedesca del
19.7.2008, validato in Italia con deposito della traduzione presso l’Uibm (v. doc. 7 e 9). Evidenziava che nel corso della fiera internazionale del settore tessile ITMA in corso di svolgimento a Rho (MI) dall’8.6 al 14.6.2023 aveva scoperto che il competitor BHAGAT GROUP stava presentando presso lo stand fieristico allo stesso assegnato un macchinario, recanti il nome commerciale- Bhagat Textile Engeneers apparentemente interferente con il brevetto di sua titolarità, anche in forza di un esame tecnico compiuto a cura di un patent attorney di fiducia (v. doc. 6.1 e 6.2).
Concludeva chiedendo l’emissione di un ordine di protezione delle prove ai sensi degli artt. 192 e ss. RoP, con l’acquisizione di copia di tutta la documentazione tecnica e commerciale, in qualunque formato, reperibile presso lo stand fieristico della resistente, con la nomina di un court expert in ausilio all’ufficiale giudiziario per l’esecuzione della misura.
B. Principali fasi del procedimento.
Considerata l’estrema urgenza della procedura, il ricorso è stato inizialmente assegnato allo standing judge designato per la data di avvenuto deposito del ricorso.
Lo standing judge con provvedimento in data odierna ha rimesso il fascicolo alla presente
Divisione Locale per l’ulteriore corso del procedimento.
Il presiding judge della Divisione Locale di Milano, visto l’art. 194, comma 3, RoP, ha designato questo giudice per l’ulteriore trattazione e definizione del procedimento come single judge, tenuto conto della estrema urgenza e della conseguente impossibilità di una tempestiva composizione e deliberazione del panel.
C. Motivi della decisione.
Avuto riguardo alla domanda depositata dal ricorrente, i punti della decisione sono i seguenti:

3. Il pagamento delle tasse secondo l’art. 192, comma 5, RoP
4. Conclusione e modalità di esecuzione della misura
1. Fumus boni iuris
1.1. Giurisdizione
Sussiste la giurisdizione dell’UPC in quanto il ricorrente ha svolto una domanda ricompresa tra quelle rientranti nella giurisdizione dell’UPC, ex art. 32 comma 1 lettera c), UPCA.
Il titolo brevettuale è un brevetto europeo e il titolare non ha esercitato il diritto di opt out ai sensi dell’art. 83, comma 3, UPCA e 5, RoP.
1.2. Competenza
Nel riparto interno di competenza tra Divisione Centrale e Divisioni Locali, queste ultime sono competenti in via generale per le azioni cautelari, in base al combinato disposto degli artt. 32, comma 1 lettera c) e 33 UPCA.
Questa Divisione Locale è poi territorialmente competente in base all’art. 33, comma 1 lettera a), UPCA, poiché nel territorio italiano - in particolare nel comune di Rho (MI) - viene individuato il forum commissi delicti ovvero il luogo in cui è in corso di svolgimento o comunque minacciata la contraffazione del brevetto.
Inoltre, la domanda di conservazione della prova risulta essere stata depositata davanti alla stessa Divisione presso la quale il ricorrente intende promuovere il giudizio di merito, in conformità a quanto previsto dall’art. 192, comma 1, RoP.
1.3. Individuazione della futura azione di merito in base all’art. 192, comma 2, RoP. Oerlikon ha dichiarato che intende promuovere un’azione di merito per l’accertamento della contraffazione commessa dalla resistente, con l’adozione dei conseguenti provvedimenti di inibitoria, fissazione di penale, sequestro, risarcimento del danno e pubblicazione della decisione.
Risulta quindi rispettata la condizione tipizzata dall’art. 192, comma 2, RoP.
1.4. Esame delle prove fornite dal ricorrente
a. il diritto azionato.
Parte ricorrente ha documentato di essere titolare esclusiva del brevetto azionato (cfr. doc.7), assistito da presunzione di validità.
Si tratta in particolare di una macchina per strutturare/testurizzare -a falsa torsione- più fila-menti a fusione, attraverso operazioni di testurizzazione, riscaldamento, raffreddamento e sti-ramento, al termine del quale il filo viene avvolto su una bobina.
Il titolo brevettuale si articola in una rivendicazione indipendente e in nove claims dipendenti.
In particolare la rivendicazione indipendente rivendica il fatto che “il primo alimentatore ed il secondo alimentatore sono realizzati rispettivamente come un alimentatore ad avvolgimento e, che il terzo alimentatore è realizzato come un alimentatore a serraggio”.
In tale modo sono stati superati alcuni svantaggi della tecnica nota (che utilizzava o soli ali-mentatori a serraggio o solo alimentari ad avvolgimento, garantendo attraverso l’invenzione qui azionata: i. che i fili venissero strutturati e trattati con elevata qualità; II. che il trattamento del filo avvenisse il più possibile in modo “ininterrotto”.
Parte ricorrente ha dato atto che allo stato non è stata proposta alcuna opposizione davanti all’Ufficio Brevetti Europeo (v. pag. 4 del ricorso).
All’esito di apposita ricerca effettuata sul data base del CMS non risulta depositata dal resistente alcuna lettera di protezione.
b. la violazione del suo diritto ex art. 60, comma 1, UPCA Oerlikon
ha allegato:
- copia di quattro riproduzioni fotografiche che riproducono la macchina della resistente ritenuta in contraffazione eseguite presso lo stand di Bhagat Group alla fiera internazionale di RHO in corso di svolgimento (cfr. docc. 5.1, 5,2, 5,3, 5,4 di parte ricorrente);
- la copia di un cartellone presso il medesimo stand (cfr. Doc. 5.5. di parte ricorrente):
- un parere tecnico redatto a cura di un consulente tecnico di parte (v. doc. 6.1 e 6.2). - un video della macchina Bhagat cui rimanda il QR code impresso sul biglietto da visita reperito presso lo stand di Bhagat (cfr. Doc. 5.6. di parte ricorrente).
Questi documenti, allo stato, sembrano offrire elementi di positivo riscontro, quantomeno in via indiziaria, della riproduzione indebita da parte della resistente delle caratteristiche rivendicate nel brevetto EP ‘848, giustificando la richiesta della misura qui invocata.
Non va inoltre dimenticato la misura richiesta costituisce uno strumento per tutelare in via immediata il diritto -processuale- alla prova e solo in via mediata diritto di privativa sotteso.
1.5. rispetto delle condizioni prescritte dall’art. 192, paragrafo n. 2, delle Rules.
Parte ricorrente ha assolto all’onere di allegare e di provare:
- la chiara indicazione delle misure richieste, inclusa l’esatta localizzazione delle prove da preservare (ovvero nello stand della fiera ITMA, in corso di svolgimento a Rho);
- le ragioni per cui le misure indicate sono necessarie per preservare le prove ritenute rilevanti (trattandosi di riscontri necessari per conclamare il fenomeno contraffattorio e la sua estensione);
- i fatti e le prove poste a fondamento della richiesta come già esaminati al precedente punto
1.4).
2. periculum in mora
2.1. estrema urgenza
Sussiste il requisito dell’estrema urgenza, considerato che l’esposizione fieristica internazionale dove la condotta contraffattoria è in corso di svolgimento è iniziata l’8.6.2023 e termina, oggi, il 14 giugno 2023.
2.2. Le ragioni della mancata preventiva convocazione del resistente in accordo con l’art. 192, comma 3, RoP
Sono riscontrati i presupposti di cui agli artt. 197, comma 1, RoP e 60, comma 5, UPCA, per la concessione della misura senza la preventiva audizione del convenuto, giacché:
a) i tempi ristretti non consentono la convocazione delle parti prima della fine, nella data di domani, della manifestazione fieristica;
b) sussiste il rischio che le prove non saranno più accessibili per il ricorrente una volta terminato tale evento fieristico, poiché parte resistente ha sede all’estero e la documentazione indicata è di facile occultamento e/o distruzione.
3. pagamento delle tasse in base all’articolo 192, comma 5, Rules
Il Tribunale dà atto che ai sensi dell’art. 371, comma 3, RoP, in caso di urgenza, quando il pagamento anticipato non è possibile, il difensore del ricorrente dovrà pagare il contributo fisso entro il termine stabilito dal Tribunale: alla luce di tale prescrizione va ordinato alla ricorrente di versare tale contributo entro il 16 giugno 2023.
4. Conclusione e modalità di esecuzione della misura
4.1. Il bilanciamento degli interessi in conflitto suggerisce di concedere la misura, tenendo in considerazione il potenziale rischio a carico di danno per ciascuna delle parti nel caso di concessione -per il resistente- ovvero di diniego della misura- sopportato dal ricorrente.
E infatti rispettato infatti il criterio di proporzionalità tra le opposte esigenze, essendo prevalente, tra il rischio di perdere irreparabilmente il diritto alla prova da parte del ricorrente e quello del resistente di subire la descrizione.
Alla luce sopra esposte considerazioni, la domanda di descrizione va dunque accolta e concessa inaudita altera parte, secondo le modalità indicate di seguito indicate.
4. 2.Ai sensi dell’art. 196, comma 4, RoP, la misura autorizzata sarà eseguita - secondo la disciplina nazionale interna nel cui territorio il rimedio va implementato - da un esperto, nominato da questo Tribunale e indicato nel dispositivo, scelto nella lista dei consulenti tecnici esperti in materia brevettuale che abitualmente collaborano con il Tribunale di Milano, scelta garantisce la ricorrenza dei requisiti di indipendenza, autonomia e professionalità, richiesti dall’art. 196, comma 5, delle RoP.
Il professionista incaricato procederà con il supporto dall’ufficiale giudiziario competente. Il ricorrente potrà assistere alle operazioni di descrizione a mezzo dei suoi legali di fiducia e di un suo consulente tecnico di fiducia, con divieto espresso per altri rappresentanti, impiegati o dipendenti del ricorrente di essere presenti all’esecuzione della misura.
L’esperto designato dovrà depositare una relazione scritta delle attività compiute, unitamente a copia della documentazione acquisita all’esito dell’esecuzione del provvedimento, presso la Cancelleria della Divisione Locale di Milano del Tribunale Unificato dei Brevetti il giorno successivo al completamento delle operazioni di descrizione.
4.3. Ai sensi degli artt. 58 UPCA e 196, comma 1, RoP, si dispone che la documentazione acquisita sia accessibile, fino a nuovo ordine del Tribunale, solo ai due legali del ricorrente ed un esperto tecnico di sua fiducia.
4.4. Le prove acquisite potranno essere utilizzate solo nel futuro giudizio di merito come meglio indicato in dispositivo ex art .196, comma 2, delle RoP.
4.5. Il Tribunale dispone che l’esecuzione della notifica del ricorso unitamente al presente provvedimento e di copia cartacea dei documenti allegati sia attuata con metodo alternativo, in base al combinato disposto degli artt. 275, comma 1 e 276, comma 1, RoP.
Vi sono infatti valide ragioni (“good reason”) per derogare alle modalità ordinarie di notifica dei provvedimenti, secondo le modalità indicate in dispositivo tenuto conto (i) dell’estrema urgenza, (ii) dell’esigenza di non frustare l’effetto a sorpresa e (iii) di rispettare la regola stabilita dall’art 197, comma 2, RoP, che prevede di notificare il provvedimento immediatamente al momento dell’esecuzione della misura.
4.6. Ai sensi dell’art. 196, comma 6, RoP, il Tribunale ritiene inoltre che sussistano circostanze particolari per non condizionare l’efficacia immediata della misura al preventivo deposito di una cauzione da parte del ricorrente. Difatti, la misura è finalizzata alla acquisizione della prova della ritenuta contraffazione e non ha quindi, di per sé, contenuto afflittivo o restrittivo per le attività della resistente. Inoltre, il ricorrente ha compiuto in un brevissimo lasso di tempo - in soli cinque giorni - tutte le verifiche occorrenti ai fini della presentazione della presente richiesta e il termine della fiera è previsto entro un solo giorno dall’adozione del presente provvedimento, con obiettiva compromissione della possibilità di una sua esecuzione, ove subordinata al pagamento di una cauzione o al rilascio di altra garanzia equipollente. Da ultimo il ricorrente si
presenta come appartenente a un gruppo industriale di grandi dimensioni, in grado quindi di riparare gli eventuali danni cagionati al resistente nella esecuzione della presente misura.
Il provvedimento è dunque immediatamente esecutivo ex art. 196, comma 3, RoP.
4.7. In applicazione del principio generale di proporzionalità stabilito dagli artt. 41 e 42, UPCA, e della comparazione degli interessi in conflitto anche nella scelte delle misure attuative, tenuto conto che il provvedimento dovrà essere eseguito nel contesto di un evento fieristico aperto alla partecipazione del pubblico, si precisa che l’ufficiale
giudiziario e l’esperto dovranno preferibilmente procedere, ove possibile, alla esecuzione in orari diversi da quelli destinati all’apertura al pubblico o comunque di minore flusso presso lo stand della resistente.
Per tutti i sopra esposti motivi
IL TRIBUNALE UNIFICATO DEI BREVETTI - DIVISIONE LOCALE DI MILANO
in accoglimento della domanda
1. ordina la conservazione delle prove come richiesta dalla ricorrente e, per l’effetto, autorizza Oerlikon Textile G.m.b.H. & Co. K.G. a procedere attraverso l’ufficiale giudiziario territorialmente competente e l’esperto di seguito nominato all’acquisizione di copia di tutta la documentazione tecnica, promozionale e/o commerciale, in qualunque formato, relativa alla macchina tessile identificata con la denominazione Bhagat Textile Engineers prodotte e/o commercializzate e pubblicizzate da Bhagat Group reperibile nello stand del resistente presso la Fiera ITMA 2023 - polo fieristico Rho Fiera;
2. nomina quale esperto al fine dell’esecuzione l’Ing. Z , con studio in………tel……………che -coordinandosi con la ricorrente- si avvarrà dell’ufficiale giudiziario territorialmente competente;
3. autorizza il ricorrente ad assistere alle operazioni di descrizione a mezzo dei suoi legali di fiducia e di un suo consulente tecnico di fiducia, con divieto espresso per altri rappresentanti, dipendenti o impiegati del ricorrente di essere presenti all’esecuzione della misura;
4. dispone che l’esperto depositi una relazione scritta delle operazioni compiute, unitamente alla documentazione raccolta, immediatamente dopo il completamento delle stesse e comunque entro il 15.6.2023 presso la cancelleria della Divisione Locale di Milano della Corte Unificata dei Brevetti;
5. dispone che le informazioni raccolte dall’esperto siano accessibili, fino a nuovo ordine del giudice, solo ai due difensori del ricorrente e a un suo esperto tecnico, indicati nominativamente nella relazione di cui al punto precedente, con divieto di divulgare a terzi le informazioni acquisite;
6. l’ordine deve essere eseguito in accordo che le procedure di esecuzione e le condizioni stabilite dalla legge dello Stato italiano, dove la misura viene implementata;
7. dichiara il presente ordine immediatamente esecutivo, senza ulteriori condizioni;
8. ordina che, in accordo con l’art. 196, comma 2, RoP, in assenza di nuovo ordine del Tribunale, il risultato delle misure per preservare le prove possa essere utilizzata solo nel procedimento di merito relativo a questo medesimo caso;
9. ordina al ricorrente di notificare la richiesta di concessione della misura, unitamente a copia del presente ordine e copia dei documenti cartacei, immediatamente nel momento
di esecuzione della misura con l’osservanza delle norme vigenti in Italia in materia di notificazioni degli atti giudiziari;
10. ordina al ricorrente di depositare il contributo fisso entro il 15 giugno 2023, ex art. 371, comma 3, delle Rop;
11. ordina alla Cancelleria di avvisare telefonicamente l’esperto nominato ing. Z;
12. avvisa espressamente il resistente che può presentare una richiesta di revisione del presente ordine di conservazione delle prove entro il termine di trenta giorni
dall’esecuzione della misura, ai sensi dell’art. 197, comma 3, RoP.

A. Indication of the appellant's request.
By deed filed on 13 June 2023, Oerlikon Textile G.m.b.H. & Co. K.G. (hereinafter Oerlikon) stated that it was the owner of European patent no. EP214848B1 (hereinafter EP848), entitled
“false twist texturing machine” relating to a textile machine, issued on 23 September 2011, following an application dated 23 January 2009, claiming German national priority of
19 July 2008, validated in Italy with the filing of the translation with the UIBM (see documents 7 and 9). It pointed out that during the ITMA international textile trade fair held in Rho (MI) from 8 June to 14 June2023, it had discovered that its competitor BHAGAT GROUP was presenting a machine at its exhibition stand bearing the trade name Bhagat Textile Engineers, which apparently infringed its patent, also on the basis of a technical examination carried out by a trusted patent attorney (see documents 6.1 and 6.2).
It concluded by requesting the issuance of an order for the protection of evidence pursuant to Articles 192 et seq. of the RoP, with the acquisition of copies of all technical and commercial documentation, in any format, available at the defendant's exhibition stand, with the appointment of a court expert to assist the bailiff in the execution of the measure.
B. Main stages of the proceedings.
Given the extreme urgency of the proceedings, the appeal was initially assigned to the standing judge designated for the date on which the appeal was filed.
The standing judge, by order dated today, referred the case to this
Local Division for further proceedings.
The presiding judge of the Local Division of Milan, having regard to Article 194(3) of the Rules of Procedure, has appointed this judge as single judge for the further hearing and determination of the proceedings, taking into account the extreme urgency and the consequent impossibility of a timely composition and decision by the panel.
C. Reasons for the decision.
Having regard to the application filed by the appellant, the grounds for the decision are as follows:

4. Conclusion and implementation of the measure
1. Fumus boni iuris
1.1. Jurisdiction
The UPC has jurisdiction because the applicant has brought an action falling within the jurisdiction of the UPC pursuant to Article 32(1)(c) of the UPCA.
The patent title is a European patent and the proprietor has not exercised the right to opt out pursuant to Article 83(3) of the UPCA and Article 5 of the RoP.
1.2. Jurisdiction
In the internal division of jurisdiction between the Central Division and the Local Divisions, the latter have general jurisdiction for interim measures, pursuant to the combined provisions of Articles 32(1)(c) and 33 UPCA.
This Local Division also has territorial jurisdiction pursuant to Article 33(1)(a) of the UPCA, since the forum commissi delicti, i.e. the place where the patent infringement is taking place or is threatened, is located in Italy, specifically in the municipality of Rho (MI).
Furthermore, the application for the preservation of evidence appears to have been filed before the same Division before which the applicant intends to bring the proceedings on the merits, in accordance with the provisions of Article 192(1) RoP.
1.3. Identification of the future action on the merits pursuant to Article 192(2) of the Rules of Procedure. Oerlikon has stated that it intends to bring an action on the merits to ascertain the infringement committed by the defendant, with the adoption of the consequent measures of injunction, setting of a penalty, seizure, compensation for damages and publication of the decision.
The condition set out in Article 192, paragraph 2, RoP is therefore met.
1.4. Examination of the evidence provided by the claimant
a. The right invoked.
The claimant has documented that it is the exclusive owner of the patent invoked (see doc. 7), which is presumed to be valid.
It is, in particular, a machine for structuring/texturising - by false twisting - multiple melt-spun filaments, through texturing, heating, cooling and stretching operations, at the end of which the filament is wound onto a spool.
The patent title is divided into an independent claim and nine dependent claims.
In particular, the independent claim claims that “the first feeder and the second feeder are respectively designed as a winding feeder and that the third feeder is designed as a clamping feeder”.
This overcomes some of the disadvantages of the known technique (which used either clamping feeders or winding feeders only), ensuring through the invention in question: i. that the wires are structured and treated to a high standard; ii. that the wire is treated as “uninterruptedly” as possible.
The appellant acknowledged that no opposition had been filed with the European Patent Office (see page 4 of the appeal).
Following a specific search of the CMS database, no protection letter appears to have been filed by the respondent.
b. infringement of its right under Article 60(1) of the UPCA Oerlikon
attached:
- copies of four photographs reproducing the defendant's machine deemed to be counterfeit, taken at the Bhagat Group stand at the international trade fair in RHO currently in progress (see documents 5.1, 5.2, 5.3 and 5.4 of the applicant);
- a copy of a poster at the same stand (see doc. 5.5. of the applicant):
- a technical opinion prepared by a technical consultant for the party (see documents 6.1 and 6.2). - a video of the Bhagat machine referred to by the QR code printed on the business card found at the Bhagat stand (see document 5.6 of the claimant).
These documents, as they stand, appear to offer positive evidence, at least on a prima facie basis, of the defendant's unlawful reproduction of the characteristics claimed in EP '848, justifying the request for the measure sought here.
Furthermore, it should not be forgotten that the measure requested is a means of immediately protecting the procedural right to evidence and only indirectly the underlying exclusive right.
1.5. Compliance with the conditions laid down in Article 192(2) of the Rules.
The applicant has fulfilled its obligation to attach and prove:
- a clear indication of the measures requested, including the exact location of the evidence to be preserved (i.e. at the ITMA exhibition stand, currently taking place in Rho);
- the reasons why the measures indicated are necessary to preserve the evidence considered relevant (as this is necessary to prove the counterfeiting and its extent);
- the facts and evidence on which the request is based, as already examined in point
1.4 above.
2. periculum in mora
2.1. extreme urgency
The requirement of extreme urgency is met, considering that the international trade fair where the counterfeiting is taking place began on 8 June 2023 and ends today, 14 June 2023.
2.2. Reasons for not summoning the defendant in advance in accordance with Article 192(3) of the Rules of Procedure
The conditions set out in Articles 197(1) of the Rules of Procedure and 60(5) of the UPCA for granting the measure without prior hearing of the defendant are met, since:
a) the tight time frame does not allow the parties to be summoned before the end of the trade fair tomorrow;
b) there is a risk that the evidence will no longer be accessible to the applicant once the trade fair has ended, since the defendant is based abroad and the documentation indicated is easy to conceal and/or destroy.
3. Payment of fees pursuant to Article 192(5) of the Rules
The Court notes that, pursuant to Article 371(3) of the Rules of Procedure, in urgent cases where advance payment is not possible, the applicant's counsel must pay the fixed contribution within the time limit set by the Court: in light of this provision, the applicant is ordered to pay this contribution by 16 June 2023.
4. Conclusion and implementation of the measure
4.1. The balancing of the conflicting interests suggests that the measure should be granted, taking into account the potential risk of damage to each of the parties in the event of the measure being granted - for the defendant - or refused - for the applicant.
In fact, the criterion of proportionality between the opposing requirements is respected, since the risk of the applicant irreparably losing the right to evidence prevails over the risk of the defendant suffering the description.
In light of the above considerations, the application for description must therefore be upheld and granted without hearing the other party, in accordance with the procedures indicated below.
4. 2. Pursuant to Article 196(4) of the RoP, the authorised measure shall be carried out - in accordance with the national rules in force in the territory where the remedy is to be implemented - by an expert appointed by this Court and indicated in the operative part, chosen from the list of technical consultants who are experts in patent matters and who regularly collaborate with the Court of Milan, a choice which guarantees that the requirements of independence, independence and professionalism required by Article 196, paragraph 5, of the RoP.
The professional appointed shall proceed with the support of the competent bailiff. The appellant may attend the description operations through his trusted lawyers and a trusted technical consultant, with the express prohibition of other representatives, employees or servants of the appellant from being present at the execution of the measure.
The appointed expert shall file a written report of the activities carried out, together with a copy of the documentation acquired at the end of the execution of the measure, with the Registry of the Local Division of Milan of the Unified Patent Court on the day following the completion of the description operations.
4.3. Pursuant to Articles 58 UPCA and 196(1) RoP, the documentation acquired shall be accessible, until further order of the Court, only to the two lawyers of the applicant and a technical expert of his choice.
4.4. The evidence acquired may only be used in future proceedings on the merits, as better indicated in the operative part pursuant to Article 196(2) of the RoP.
4.5. The Court orders that the notification of the appeal, together with this order and a hard copy of the attached documents, be effected by alternative means, in accordance with the combined provisions of Articles 275(1) and 276(1) of the RoP.
There are, in fact, valid reasons (“good reasons”) for derogating from the ordinary methods of notification of orders, in the manner indicated in the operative part, taking into account (i) the extreme urgency, (ii) the need not to frustrate the surprise effect and (iii) to comply with the rule laid down in Article 197(2) of the RoP, which provides that the order must be notified immediately upon execution of the measure.
4.6. Pursuant to Article 196(6) of the Rules of Procedure, the Court also considers that there are special circumstances for not making the immediate effectiveness of the measure subject to the prior deposit of a security by the applicant. In fact, the measure is aimed at obtaining evidence of the alleged infringement and does not, therefore, in itself, have any restrictive or restrictive effect on the defendant's activities. Furthermore, the applicant carried out all the necessary checks for the purposes of submitting this application in a very short period of time - only five days - and the trade fair is due to end within one day of the adoption of this measure, which would objectively compromise the possibility of its enforcement if it were subject to the payment of a security deposit or the provision of another equivalent guarantee. Finally, the applicant
presents itself as belonging to a large industrial group, which is therefore able to repair any damage caused to the defendant in the execution of this measure.
The measure is therefore immediately enforceable pursuant to Article 196(3) of the RoP.
4.7. In application of the general principle of proportionality established by Articles 41 and 42 of the UPCA, and of the comparison of the interests in conflict, including in the choice of implementing measures, taking into account that the measure must be enforced in the context of a trade fair open to the public, it is specified that the judicial officer
and the expert should preferably proceed, where possible, at times other than those set for opening to the public or, in any case, at times when there is less traffic at the defendant's stand.
For all the above reasons
THE UNIFIED PATENT COURT - LOCAL DIVISION OF MILAN
in granting the application
1. orders the preservation of the evidence as requested by the applicant and, to that effect, authorises Oerlikon Textile G.m.b.H. & Co. K.G. to proceed, through the competent judicial officer and the expert appointed below, to obtain copies of all technical, promotional and/or commercial documentation, in any format, relating to the textile machine identified as Bhagat Textile Engineers produced and/or marketed and advertised by Bhagat Group, available at the defendant's stand at the ITMA 2023 trade fair - Rho Fiera exhibition centre;
2. appoints as expert for the purpose of execution Mr Z, with office in ………tel……………who, in coordination with the applicant, shall avail himself of the services of the competent judicial officer;
3. authorises the applicant to attend the description operations through its trusted lawyers and a trusted technical consultant, with the express prohibition of other representatives, employees or staff of the applicant from being present during the execution of the measure;
4. orders the expert to file a written report of the operations carried out, together with the documentation collected, immediately after their completion and in any case by 15 June 2023 at the registry of the Milan Local Division of the Unified Patent Court;
5. orders that the information gathered by the expert shall be accessible, until further order of the court, only to the two lawyers of the applicant and to a technical expert appointed by the applicant, whose names are indicated in the report referred to in the previous point, with the prohibition on disclosing the information acquired to third parties;
6. the order must be executed in accordance with the enforcement procedures and conditions laid down by the law of the Italian State where the measure is implemented;
7. declares this order immediately enforceable, without further conditions;
8. orders that, in accordance with Article 196(2) of the Rules of Procedure, in the absence of a new order by the Court, the results of the measures to preserve evidence may only be used in the proceedings on the merits relating to this case;
9. orders the applicant to notify the request for the measure, together with a copy of this order and a copy of the paper documents, immediately upon
the measure is executed, in compliance with the rules in force in Italy on the service of judicial documents;
10. orders the applicant to pay the fixed contribution by 15 June 2023, pursuant to Article 371(3) of the RoP;
11. orders the Registry to notify the appointed expert, Mr Z, by telephone;
12. expressly informs the defendant that he may submit a request for review of this order to preserve evidence within thirty days
of the execution of the measure, pursuant to Article 197, paragraph 3, of the Rules of Procedure.
