Pastand
Hybridgenerator ApS (rekvirenten) har nedlagt folgende pastande:

omgaende ivwrkswttes en gennemgang af adressen ... med henblik p5 at sikre bevismateriale, der viser
eksistensen og omfanget af krwnkelser af rettighederne til europ2eisk patent
nr. 4238202, herunder:

Besigtigelse af hybridgeneratorerne model MPU 1000, MPU 2000 og MPU 3000 og udarbejdelse af en udforlig beskrivelse af disse produkter.

Oporelse af et eventuelt lager af hybridgeneratorerne model MPU 1000, MPU 2000 og MPU 3000.

Kopiering af it-systemer, elektroniske lagringsmidler og fysisk materiale, som indeholder okonomiske oplysninger og fakturamateriale,

Kopiering af mailkorrespondance samt ovrige dokumenter, herunder vedrorende produktudvikling, fremstilling, import, eventuel eksport, salg og markedsforing.

2. Der anmodes om, at kendelsen om ovenst5ende foranstaltninger afsiges uden, at rekvisiti hores.
3. Der anmodes om, at foranstaltningerne til sikring af bevismateriale ikke skal Ores betinget af, at rekvirenten stiller sikkerhed.
4. Der anmodes om, at rekvisiti skal godtgore rekvirentens rimelige og forholdsmssigt afpassede sagsomkostninger og andre udgifter, som rekvirenten har afholdt.

Anmodningen blev indgivet den 16. august 2024.

Dommer Dr. Thom traf den 19. august 2024 afgorelse om, at sagen ikke var af en sadan hastende karakter, at der straks skulle tr2effes afgorelse i henhold til procesreglementets artikel 194, stk. 4. Sagen blev herefter overgivet til retsformanden ved lokalafdelingen i Kobenhavn til videre foranstaltning.

Rekvirenten har oplyst, at man i henhold til procesreglementets artikel 192, stk. 2, endnu ikke har anlagt en sag om sagens realitet. Rekvirenten vil indlede en sag om sagens realitet mod rekvisiti ved patentdomstolens lokale afdeling i Kobenhavn, nar det materiale, som er genstand for nwrywrende anmodning om udlevering af bevismateriale, er blevet udleveret til rekvirenten.

Sagsfremstilling

Nedenstaende sagsfremstilling er baseret p5 rekvirentens anmodning om bevissikring og de fremlagte bilag.

Rekvirenten er et dansk anpartsselskab, der blev stiftet den 16. marts 2017.

Rekvirenten driver virksomhed med produktion af generatorer til produktion af strOm.

Rekvirenten ejes 100 % af HG Energy Group ApS ("HG Energy Group"), der tillige ejer datterselskabet HG Rental ApS ("HG Rental"). Personkredsen i HG Energy Group, HG Rental og rekvirenten er den samme.

Rekvirenten ejer mere end 270 generatorer, der udlejes til kunder i hele verden via HG Rental. Kunderne benytter generatorerne bl.a. i forbindelse med byggerier af fast ejendom, opstilling eller servicering af vindmoller og vindmolleparker m.m.. Generatorerne benyttes bl.a. i vidt omfang til at producere strum til kraner, der bruges til at bygge og servicere vindmoller. Markedsprisen for en generator er mellem kr. 800.000 - kr. 1.000.000 ex. moms.

Claims
Hybridgenerator ApS (the applicant) has made the following claims:
1. It is requested that, pursuant to Article 60(1) and (2) of the UPC Agreement,

a review of the address ... be carried out immediately in order to secure evidence showing
the existence and extent of infringements of the rights to European patent
no. 4238202, including:


Inspection of the hybrid generators models MPU 1000, MPU 2000 and MPU 3000 and preparation of a detailed description of these products.

Seizure of any stock of hybrid generators models MPU 1000, MPU 2000 and MPU 3000.

Copying of IT systems, electronic storage media and physical material containing financial information and invoice material,

Copying of email correspondence and other documents, including those relating to product development, manufacture, import, export (if applicable), sales and marketing.

2. It is requested that the order for the above measures be issued without hearing the defendant.
3. It is requested that the measures to secure evidence not be made conditional on the applicant providing security.

4. It is requested that the applicant be ordered to reimburse the applicant's reasonable and proportionate legal costs and other expenses incurred by the applicant.

The request was submitted on 16 August 2024.

On 19 August 2024, Judge Dr Thom ruled that the case was not of such an urgent nature that a decision should be taken immediately in accordance with Article 194(4) of the Rules of Procedure. The case was then referred to the President of the Local Court in Copenhagen for further action.


The applicant has stated that, pursuant to Article 192(2) of the Rules of Procedure, no proceedings on the merits of the case have yet been brought. The applicant will initiate proceedings on the merits of the case against the respondent at the local division of the Patent Court in Copenhagen once the material that is the subject of the present request for disclosure of evidence has been disclosed to the applicant.

Statement of the case


The following statement of the case is based on the applicant's request for preservation of evidence and the documents submitted.

The applicant is a Danish limited liability company established on 16 March 2017.

The applicant is engaged in the manufacture of generators for the production of electricity.

The applicant is wholly owned by HG Energy Group ApS (‘HG Energy Group’), which also owns the subsidiary HG Rental ApS (‘HG Rental’). The persons involved in HG Energy Group, HG Rental and the applicant are the same.

The applicant owns more than 270 generators, which are leased to customers worldwide via HG Rental. The customers use the generators in connection with, among other things, the construction of real estate, the installation or servicing of wind turbines and wind farms, etc. The generators are used extensively to produce electricity for cranes used to build and service wind turbines. The market price for a generator is between DKK 800,000 and DKK 1,000,000 excluding VAT.
