SACHVERHALT
Die Beklagten beantragen in allen drei Parallelverfahren betreffend die Patente EP 724, EP 270 und EP 315 die Verlängerung der Fristen betreffend
die Duplik im Verletzungsverfahren
die Replik zur Nichtigkeitswiderklage
sinngemäß zudem die Erwiderung zum Antrag auf Änderung des Patents (enthalten in der Erwiderung auf die Nichtigkeitswiderklage)
bis 6. August 2024. Zuvor war das Fristenregime bereits – in weiten Teilen mit Zustimmung der Gegenseite – zugunsten der Beklagten verlängert worden.
Die Verhandlungstermine wurden für das EP 724 auf den 7. bis 10. Oktober 2024 bestimmt, für das EP 270 auf den 10. und 11. Dezember 2024 und für das EP 315 auf den 4. und 5. Februar 2025.
Die Klägerin hat ihre Replik in allen Verfahren jeweils zunächst mit Totalschwärzungen eingereicht, die sich in auch für das Gericht nur eingeschränkt lesbaren Teilen der Replik befinden, die den FRAND-Aspekt der Auseinandersetzung betreffen. Auf verschiedene gegen sich selbst gerichtete Vorlageanträge hin hat die Klägerin sodann weitere Schriftsätze nebst Anlagen eingereicht, die sie als „Ergänzung Replik“ bezeichnet hat. Die Schriftsätze enthalten nunmehr umfänglichen, abgeschichteten Vortrag zu den Vergleichslizenzen, die die Klägerin heranzieht und vorgelegt hat. Zu diesen konsekutiv eingereichten weiteren schriftlichen Eingaben hat die Klägerin jeweils begleitende Anträge nach Regel 262A VerfO eingereicht. Das Gericht hat insoweit einstweilige Geheimnisschutzanordnungen erlassen und Gelegenheit zur Stellungnahme zu den Details der Geheimnisschutzanordnung eingeräumt. Zudem haben die Beklagten – teils über Freigabe durch die Kanzlei im CMS, teils aufgrund technischer Probleme des CMS oder Fehlanwendungen, deren Ursprung derzeit noch nicht aufgeklärt werden konnte, außerhalb desselben – Zugang zu den unredigierten Fassungen der letzten Fassung der von der Klägerin als „Replik“ bezeichneten Schriftsätze erhalten. Gegenwärtig ist den Parteien weitere Gelegenheit zur Stellungnahme zum Geheimnisschutzregime gegeben worden. Über das Geheimnisschutzregime, insbesondere die Anzahl der zugangsberechtigten Personen auf Beklagtenseite, ist daher noch nicht abschließend entschieden. Bislang hat neben den Parteivertretern allein eine natürliche Person auf Seiten der Beklagten Zugang zu den unredigierten Dokumenten.
Die Replik zu den technischen Aspekten des Falles ebenso wie die Erwiderung auf die Nichtigkeitswiderklage sowie der Ausführungen zum Antrag, das Patent zu ändern, enthalten keine Schwärzungen. Die Geheimnisschutzanträge der Klägerin beziehen sich nicht auf den Vortrag zu den technischen Aspekten auf Verletzungs- und Rechtsbestandsseite.
ENTSCHEIDUNGSGRÜNDE
Die beantragte Fristverlängerung war mit Blick auf die technischen Aspekte des Falles abzuweisen. Die Beklagten begründen ihren Antrag ausschließlich mit der verzögerten Zugänglichkeit der von der Klägerin redigierten Passagen, die sich mit dem FRAND-Aspekts der Auseinandersetzung befassen. Die Ausführungen zu den technischen Aspekten auf Verletzungs- und Rechtsbestandsseite enthalten keine Schwärzungen – die Ausführungen waren für die Beklagten sogleich zugänglich. Daher ist insoweit keine Fristverlängerung gerechtfertigt. Dies gilt nicht nur für die Ausführungen zum Rechtsbestand, sondern auch für diejenigen zum Verletzungssachverhalt. Beiden Teilen ist eine kohärente Auslegung des Patents zugrunde zu legen.
Für die Beklagten streitet vorliegend auch nicht das Interesse, einheitliche Fristen eingeräumt zu bekommen. Denn vorliegend würde die beantragte Fristverlängerung dazu führen, dass jedenfalls der Verhandlungstermin betreffend EP 724 gefährdet wäre. Würde die Frist wie beantragt verlängert, könnte das schriftliche Verfahren erst einen Tag vor der mündlichen Verhandlung geschlossen und das Verfahren nicht binnen der von der Verfahrensordnung vorgegebenen Zeitspanne abgeschlossen werden, die ohnedies vorliegend – beruhend auf der einvernehmlichen Bitte um spätere Terminierung – überschritten werden wird. Überdies ist zu berücksichtigen, dass auch ein valides Interesse der auf Fallbasis zugewiesenen technischen Richter besteht, sich mit angemessenem Vorlauf insbesondere in die technischen Aspekte des Falles einlesen zu können und nicht erst kurz vor dem Termin zur Verhandlung.
Ein solches Auseinanderlaufen der Fristen steht auch nicht in Widerspruch zu Regel 29 (d) VerfO.
Stattzugeben war indes dem Fristverlängerungsantrag zur Wahrung des Anspruchs auf ausreichendes rechtliches Gehör, soweit er die intendierte Stellungnahme zu dem zunächst nicht frei zugänglichen Vortrag der Klägerseite zum FRAND-Aspekt betrifft. Diesen Vortrag haben die Beklagten erst erheblich nach Ende der Replikfrist zur Kenntnis nehmen können und können die Tatsachen derzeit noch nicht mit dem von Ihnen für angemessen erachteten Personenkreis besprechen. Der Vortrag ist zudem umfänglich und komplex und muss – der von den Beklagten zitierten Rechtsprechungspraxis der Lokalkammer entsprechend (Lokalkammer Düsseldorf vom 4. April 2024, UPC_CFI_355/2023; Lokalkammer Mannheim vom 22. April 2024, UPC_CFI_365/2023) – zu einer Fristverlängerung führen.
Insoweit erscheint einstweilen eine Verlängerung bis zum 19. Juli 2024 angemessen. Der Zugang war nach dem Vortrag der Beklagten erstmals am 6.6.2024 gewährleistet, wobei gegenwärtig noch über die Zugangsberechtigung weiterer Personen auf Seiten der Beklagten gestritten wird. Bei der Bestimmung des Umfangs war zu berücksichtigen, dass den Beklagten bereits bei der Beantragung der letzten Fristverlängerung bekannt war, dass eine Vorlageanordnung der Klägerin gegen sich selbst hinsichtlich zweier Vergleichslizenzverträge ergangen war und daher ernstlich mit der tatsächlichen Vorlage und diesbezüglichem Vortrag zu rechnen war. Zu diesem Zeitpunkt erachteten die Beklagten die beantragte und bereits gewährte Verlängerung bis 19. Juni 2024 für ausreichend. Im Nachgang beantragte die Klägerin indes eine weitere Vorlageanordnung gegen sich selbst mit Blick auf einen dritten Vertrag, der sodann samt begleitendem Vortrag hierzu vorgelegt wurde. Dies rechtfertigt die weitere Fristverlängerung im derzeit ausgesprochenen Umfang.
Das Gericht behält sich vor, diese Frist in Abhängigkeit von der weiteren Dauer des Streits zwischen den Parteien um ein angemessenes Geheimnisschutzregime auf neuerlichen Antrag hin weiter zu verlängern, den sich die Beklagten ausdrücklich vorbehalten haben. Sollte dies dazu führen, dass der Fall hinsichtlich des FRAND-Aspekts betreffend EP 724 noch nicht zur Verhandlung reif scheint, bleibt vorbehalten, die Verhandlung am 7. bis 10. Oktober 2023 auf die technischen Aspekte zu beschränken und den bereits festgesetzten weiteren Termin betreffend EP 270 zur Diskussion des ohnedies alle Streitpatente betreffenden FRAND-Aspekts zu nutzen.
Die von den Beklagtenvertretern mit einiger Deutlichkeit eingeforderte unmittelbare Entscheidung durch den Spruchkörper war angesichts des mit Blick auf den technischen Vortrag evident zu weitgehenden Antrags nicht angezeigt.
Für das weitere schriftliche Verfahren wird angeordnet, dass eine Einreichung der weiteren Hauptschriftsätze in diversen – jeweils mit Geheimnisschutzanträgen flankierten – Fassungen zu unterlassen ist. Wenn etwa aufgrund von vorherigen Vorlageanordnungen des Gerichts erforderlich, sind entsprechende Fristverlängerungsanträge zu stellen und sodann der nach der Verfahrensordnung vorgesehene Schriftsatz mit kohärentem Vortrag einzureichen. Der aufgesplitterte, auf mehrere Schriftsatzfassungen verteilte Vortrag entspricht nicht der von der Verfahrensordnung geforderten Prozessförderungspflicht, da er die Erfassung des Streitstoffs für alle Beteiligten erheblich erschwert und eine Vielzahl vermeidbarer Arbeitsschritte – zumal mit Blick auf den Geheimnisschutz – mit sich bringt.
ANORDNUNG
1. Die Frist zur Erwiderung auf den Vortrag der Klägerin, der in den als „Ergänzung Replik Teil II Nicht-technischer Teil“ bezeichneten Schriftsätzen nebst Anlagen zum FRAND-Aspekt des Rechtsstreits enthalten ist, wird bis zum 19. Juli 2024 verlängert.
2. Die weitergehenden Anträge auf Fristverlängerung werden zurückgewiesen.
3. Weitere Hauptschriftsätze des schriftlichen Verfahrens sind in einer kohärenten finalen Fassung vorzulegen. Erforderlichenfalls ist um entsprechende Fristverlängerung nachzusuchen.

SUBJECT MATTER: Further FVL due to confidentiality regime
FACTS
In all three parallel proceedings concerning patents EP 724, EP 270 and EP 315, the defendants request an extension of the deadlines concerning
the rejoinder in the infringement proceedings
the reply to the counterclaim for annulment
by analogy, the response to the request for amendment of the patent (contained in the response to the counterclaim for annulment)
until 6 August 2024. The time limits had already been extended in favour of the defendants, largely with the consent of the opposing party.
The hearing dates were set for EP 724 on 7 to 10 October 2024, for EP 270 on 10 and 11 December 2024 and for EP 315 on 4 and 5 February 2025.
The plaintiff initially submitted its reply in all proceedings with total redactions, which are also only partially legible to the court in those parts of the reply that concern the FRAND aspect of the dispute. Following various applications for a preliminary ruling against itself, the plaintiff then submitted further written pleadings together with annexes, which it referred to as a ‘supplementary reply’. The written submissions now contain extensive, layered arguments on the comparative licences that the plaintiff has used and submitted. The plaintiff submitted accompanying motions in accordance with Rule 262A VerfO for each of these additional written submissions. The court issued preliminary confidentiality orders and granted the opportunity to comment on the details of the confidentiality order. In addition, the defendants have been given access to the unredacted versions of the latest version of the pleadings referred to by the plaintiff as ‘replies’, partly through release by the law firm in the CMS, partly outside the CMS due to technical problems with the CMS or misuse, the origin of which has not yet been clarified. The parties have now been given further opportunity to comment on the confidentiality regime. No final decision has therefore yet been made on the confidentiality regime, in particular the number of persons authorised to access the documents on the defendant's side. To date, apart from the parties' representatives, only one natural person on the defendant's side has access to the unredacted documents.
The reply to the technical aspects of the case, the response to the counterclaim for annulment and the comments on the request to amend the patent do not contain any redactions. The plaintiff's requests for protection of confidential information do not relate to the submissions on the technical aspects of the infringement and legal validity.
REASONS FOR THE DECISION
The requested extension of time was rejected in view of the technical aspects of the case. The defendants justify their request solely on the basis of the delayed accessibility of the passages redacted by the plaintiff, which deal with the FRAND aspect of the dispute. The statements on the technical aspects of infringement and legal validity do not contain any redactions – the statements were immediately accessible to the defendants. Therefore, no extension of time is justified in this respect. This applies not only to the statements on legal validity, but also to those on the facts of the infringement. Both parts must be based on a coherent interpretation of the patent.
In the present case, the defendants are not arguing that they have an interest in being granted uniform time limits. This is because, in the present case, the requested extension of time would in any event jeopardise the hearing date for EP 724. If the time limit were extended as requested, the written proceedings could only be closed one day before the oral hearing and the proceedings could not be concluded within the time limit specified in the Rules of Procedure, which in any case would be exceeded in the present case on the basis of the mutual request for a later date. Furthermore, it must be taken into account that the technical judges assigned to the case also have a valid interest in being able to familiarise themselves with the technical aspects of the case with sufficient advance notice and not only shortly before the hearing date.
Such a divergence in deadlines is also not contrary to Rule 29(d) of the Rules of Procedure.
However, the request for an extension of the deadline was granted in order to safeguard the right to a fair hearing, insofar as it concerns the intended statement on the plaintiff's submission on the FRAND aspect, which was not initially freely accessible. The defendants were only able to take note of this submission well after the end of the reply period and are currently unable to discuss the facts with the group of persons they consider appropriate. The submission is also extensive and complex and must – in accordance with the case law cited by the defendants (Local Chamber Düsseldorf of 4 April 2024, UPC_CFI_355/2023; Local Chamber Mannheim of 22 April 2024, UPC_CFI_365/2023) – lead to an extension of the deadline.
In this respect, an extension until 19 July 2024 appears appropriate for the time being. According to the defendants' submission, access was first guaranteed on 6 June 2024, although the access rights of further persons on the defendants' side are currently still in dispute. When determining the scope, it had to be taken into account that the defendants were already aware at the time of the last request for an extension that a referral order had been issued against the plaintiff itself with regard to two settlement licence agreements and that the actual referral and related submissions were therefore to be seriously expected. At that time, the defendants considered the requested and already granted extension until 19 June 2024 to be sufficient. Subsequently, however, the plaintiff applied for a further order for disclosure against itself with regard to a third contract, which was then submitted together with accompanying submissions. This justifies the further extension of the deadline to the extent currently granted.
The court reserves the right to extend this deadline further upon renewed application, depending on the further duration of the dispute between the parties regarding an appropriate confidentiality regime, which the defendants have expressly reserved the right to do. Should this mean that the case does not appear ready for hearing with regard to the FRAND aspect concerning EP 724, the court reserves the right to limit the hearing on 7 to 10 October 2023 to the technical aspects and to use the further date already set for EP 270 to discuss the FRAND aspect, which in any case concerns all the disputed patents.
In view of the technical submissions, the immediate decision by the panel requested with some clarity by the defendants' representatives was not appropriate, as the request was clearly too far-reaching.
For the further written proceedings, it is ordered that the submission of further main pleadings in various versions – each accompanied by applications for protection of confidentiality – is to be refrained from. If necessary, for example due to previous orders of the court to submit documents, corresponding applications for an extension of the deadline are to be filed and the pleading with a coherent statement is then to be submitted in accordance with the Rules of Procedure. The fragmented presentation, spread over several versions of the written pleadings, does not comply with the obligation to expedite proceedings required by the Rules of Procedure, as it makes it considerably more difficult for all parties to understand the subject matter of the dispute and entails a large number of avoidable steps, particularly with regard to the protection of confidentiality.
ORDER
1. The deadline for responding to the plaintiff's submission, which is contained in the written submissions entitled ‘Supplement to the reply, Part II, non-technical part’ and the annexes thereto, concerning the FRAND aspect of the legal dispute, is extended until 19 July 2024.
2. The further requests for an extension of the deadline are rejected.
3. Further main pleadings in the written proceedings are to be submitted in a coherent final version. If necessary, an extension of the deadline is to be requested.
