SACHVERHALT
Die Klägerin zu 1 nimmt die Beklagte wegen behaupteter Verletzung des EP 3 215 288 betreffend eine Metallsinterzubereitung in Deutschland, Italien und Frankreich in Anspruch (ACT_13227/2024 UPC_CFI_114/2024). Die Beklagten verteidigen sich unter anderem mit einem betrieblichen Vorbenutzungsrecht. In der gegen die Klägerin zu 2 als noch eingetragene Patentinhaberin gerichteten Nichtigkeitswiderklage (CC_43919/2024 UPC_CFI_448/2024) macht sie darüberhinausgehend auf der Grundlage des betrieblichen Vorbenutzungsrechts auch eine offenkundige Vorbenutzung geltend. Die Widerbeklagte wird derzeit zur Vereinfachung als Klägerin zu 2 geführt.
Der Antrag der Klägerinnen auf Zulassung der Erweiterung der Klage gem. Regel 263 VerfO um Ansprüche wegen mittelbarer Verletzung des Verfahrensanspruchs 5 (DE) bzw. 6 (FR und IT) vom 5. Juni 2024 wurde mit Anordnung des Berichterstatters vom 25. September 2024 (ORD_36668/2024) abgelehnt. Zur Begründung hat der Berichterstatter ausgeführt, dass Ansprüche wegen Verletzung des Anspruchs 5 bzw. 6 bereits mit der Klage geltend gemacht hätten werden können. Hiergegen haben die Klägerinnen am 10. Oktober 2024 fristgerecht Antrag auf Überprüfung durch den Spruchkörper nach Regel 333 VerfO eingereicht.
Mit Wirkung vom 1. September 2024 ist die Republik Rumänien dem Übereinkommen über ein Einheitliches Patentgericht beigetreten.
Mit Antrag vom 27. September 2024 beantragten die Klägerinnen die Zulassung der Erweiterung der Klage um Ansprüche wegen einer Patentverletzung in Rumänien. Darin enthalten sind Ansprüche wegen mittelbarer Verletzung des Verfahrensanspruchs 6. Die Beklagte ist dem entgegengetreten, beantragte aber im Falle der Zulassung eine Erwiderungsfrist von drei Monaten. Zur Begründung führte sie an, dass sich das Vorbenutzungsrecht gem. Art. 28 EPGÜ nach nationalem Recht, hier rumänischem Recht, richte und die Beklagte zur Vorbereitung ihrer u.a. darauf gestützten Verteidigung diesen Zeitraum benötige.
Mit Antrag vom 1. Oktober 2024 beantragte die Beklagte die Zulassung der Erweiterung der Widerklage um Rumänien.
Die Zwischenanhörung ist derzeit auf den 3. April 2024, die mündliche Verhandlung auf den 1. Juli 2024 terminiert.
Der Berichterstatter hat den Parteien am 15. November 2024 folgenden Vorschlag unterbreitet:
Der Gegenseite ist gem. Regel 333.2 dritter Satz VerfO rechtliches Gehör zu gewähren. Vorab ist nach Rücksprache mit dem Spruchkörper darauf hinzuweisen, dass den jeweiligen Anträgen auf Klageerweiterung wegen des Beitritts Rumäniens möglicherweise schon deswegen stattzugeben sein wird, weil dies mit Blick auf ihre jeweiligen Klagen und Anträge damit dem Grunde nach beide Parteien übereinstimmend wollen (Art. 43, 76 (1) EPGÜ). Soweit dem Antrag auf Erweiterung der Klage wegen des Beitritts Rumäniens stattgegeben wird, ist auch die mittelbare Verletzung des Verfahrensanspruchs 6 Streitgegenstand.
Aus Gründen der Verfahrensökonomie und der Fairness sowie in dem Bestreben, divergierende Entscheidungen durch eine noch einzureichende weitere Klage wegen Ansprüchen wegen mittelbarer Verletzung des Verfahrensanspruchs in Deutschland, Frankreich und Italien zu vermeiden, könnte es geboten dann sein, die Anordnung vom 25. September 2024 zu revidieren.
In Konsequenz würde jede Partei mit ihren Anträgen durchdringen. Der Streitwert der Klage und der Widerklage wäre jeweils auf 1,25 Mio. € zu erhöhen. Insoweit hat die Beklagte zur Klageänderung keine besseren Zahlen vorgetragen. Zur Widerklageänderung hat die Beklagte überhaupt keine Zahlen vorgetragen. Der Beklagten wäre eine Frist zur Erwiderung in Bezug auf Rumänien einzuräumen. Der Spruchkörper erachtet eine Frist von 2 Monaten gerechnet ab der Zulassung der Erweiterung als ausreichend.
Der Spruchkörper regt an, dass sich die Parteien mit dieser angedachten Handhabung einverstanden erklären.
Die Klägerinnen sind mit dem in dieser Verfahrensanordnung vom 15.11.2024 angeregten Prozedere einverstanden. Ergänzend weisen sie darauf hin, dass das Berufungsgericht in seiner Anordnung vom 21.09.2024 (UPC CoA 456/2024 APL 44633/2024 – OrthoApnea) ein enges Verständnis einer Klageänderung i.S.d. R. 263 VerfO vertreten habe:
„Not every new argument constitutes an ‚amendment of case‘ requiring a party to apply for
leave under R. 263 RoP. An amendment of case occurs when the nature or scope of the
dispute changes. For example, in an infringement case, this occurs if the plaintiff invokes a
different patent or objects to a different product.”
Die Beklagte teilt mit, dass sie der angedachten Handhabung der Kammer bezüglich der beiden Klageerweiterungen auf Rumänien nicht entgegenstelle. Sie halte jedoch weiterhin die beantragte Erwiderungsfrist von drei Monaten für sachgerecht. Damit solle eine angemessene Vorbereitung der Stellungnahme sichergestellt werden. Eine Revidierung der Entscheidung vom 25. September 2024 betreffend die Erweiterung auf den Verfahrensanspruch hält sie hingegen für unzulässig.
Unter App_48806/2024 stellten die Klägerinnen darüber hinaus Anträge in Bezug auf die Passivlegitimation bei der Widerklage.
Der Berichterstatter hat mit Anordnung vom 25. September 2024 in App_48806/2024 angeordnet:
1. Es wird klargestellt, dass die Fristen zur Erwiderung auf die Klageerwiderung sowie die Widerklage erst dann zu laufen beginnen, wenn den Klägerinnen und ihren anwaltlichen Vertretern ungeschwärzte Fassungen der Klageerwiderung bzw. der Widerklage vorliegen.
2. Die Beklagte kann zu dem Schriftsatz vom 27. August 2024 innerhalb von 10 Tagen Stellung nehmen.
Der Berichterstatter hat mit weiterer Anordnung vom 25. September 2024 (ORD_53396/2024 in APP_48805/2024) im Rahmen eines Einspruchs der Klägerin zu 2 gegen die Widerklage mitgeteilt, dass
- R. 25.1 VerfO dahingehend zu verstehen sei, dass die Nichtigkeitswiderklage auch gegen die „R. 8.6-Inhaberin“ (die Widerbeklagte) gerichtet werden könne;
- R. 25.1 VerfO ferner auch als Verweis auf R. 42.2 VerfO zu verstehen sei.
Unter App_54645/2024 stellten die Klägerinnen daraufhin einen Antrag nach Regel 305.1 (C) VerfO in Bezug auf die Widerklage. Die Beklagte hat diesen Antrag trotz Gelegenheit hierzu nicht weiter kommentiert.
Der Berichterstatter hat sämtliche hier behandelten Anträge an den Spruchkörper zur gemeinsamen Entscheidung verwiesen.
ANTRÄGE DER PARTEIEN
Die Klägerinnen beantragen in APP_5548/2024:
beantragen wir gem. R. 333.1 VerfO die Überprüfung der Anordnung (ORD_36668/2024) vom 25.09.2024 durch den Spruchkörper im Umfang der Ablehnung des Antrags zu Ziff. II.2 (mittelbare Verletzung des Verfahrensanspruchs) sowie der darauf Bezug nehmenden Folgeansprüche.
Wegen der Anträge der Klägerinnen in App_33728/2024 wird auf die Anordnung vom 25. September 2024 (ORD_36668/2024) Bezug genommen.
Die Beklagte beantragt in App_54229/2024:
beantragen wir gemäß R. 263 VerfO die Zulassung der Klageerweiterung der Widerklage auf Nichtigerklärung um den rumänischen Teil des Klagepatents wie folgt: (Änderungen hervorgehoben):
1. Das Europäische Patent EP 3 215 288 wird auf dem Gebiet der Bundesrepublik Deutschland (DE), der Französischen Republik (FR), der Italienischen Republik (IT) und der Republik Rumänien (RO) für nichtig erklärt.
2. Die Widerbeklagte trägt die Kosten der Widerklage.
Die Klägerinnen beantragen unter App_48806/2024:
1. Wir beantragen gem. R. 9.1 VerfO, dass das Gericht den Parteien gem. R. 361 VerfO rechtliches Gehör zur Passivlegitimation gewährt und regen an, hiernach die Widerklage gem. R. 361, 363 VerfO als offensichtlich aussichtslos zurückzuweisen.
2. Höchstvorsorglich erheben wir Einspruch gem. R. 48, 19.1 (b) VerfO unter Rüge der Zuständigkeit der Lokalkammer München und beantragen, die Widerklage als unzulässig zurückzuweisen.
3. Ferner bitten wir um und beantragen gem. R. 9.1 VerfO den Erlass einer verfahrensleitenden Anordnung, die klarstellt, dass die von der Verfahrensordnung an die Zustellung der Widerklage geknüpften Fristen (insb. R. 29 (a) VerfO), gleichlaufend mit der Frist zur Erwiderung auf die Klageerwiderung, erst mit Zustellung einer ungeschwärzten Fassung der Widerklage nebst Anlagen zu laufen beginnen
Die Beklagte beantragt unter App_48806/2024:
Die Anträge der Widerbeklagten gem. Regel 9.1, 361, 363, 48, 19.1 vom 27. August 2024 werden zurückgewiesen.
Die Klägerinnen beantragen unter App_54645/2024
beantragen wir namens der Widerbeklagten sowie der Klägerin, die Widerbeklagte im Nichtigkeitswiderklageverfahren CC_43919/2024 gem. R. 25.1, 42.2, 305.1 (c) VerfO durch die Klägerin zu ersetzen.
Die Beklagte stellt unter App_54645/2024 keinen Antrag.
GRÜNDE
Erweiterung um Klage und Widerlage wegen Rumänien
Die beiden Klageerweiterungen sind zu gestatten, weil beide Parteien darum nachsuchen, dass auch über die Frage von Verletzung und Validität betreffend Rumänien verhandelt und entschieden wird. Insoweit hat die Beklagte um die Gestattung einer unbedingten Erweiterung der Widerlage nachgesucht. Mithin hat die Beklagte den Wunsch geäußert, dass über die Frage der Validität des rumänischen Teils des Europäischen Patents unabhängig davon verhandelt werden soll, ob die von der Klägerin nachgesuchte Gestattung der Klageerweiterung betreffend Rumänien stattgegeben wird. Daher tragen beide Parteien im Kern dasselbe an. Rumänien soll nachträglich zum Gegenstand der Klage und der Widerklage werden. Mithin ist die Gestattung auszusprechen.
Klageerweiterung um Verfahrensanspruch
Das Berufungsgericht hat in seiner Anordnung vom 21.09.2024 (UPC CoA 456/2024 APL 44633/2024 – OrthoApnea) ein engeres Verständnis vom Vorliegen einer Klageänderung i.S.d. R. 263 VerfO vertreten, als es der Anordnung des Berichterstatters zu Grunde lag:
„Not every new argument constitutes an ‚amendment of case‘ requiring a party to apply for
leave under Regel 263 RoP. An amendment of case occurs when the nature or scope of the
dispute changes. For example, in an infringement case, this occurs if the plaintiff invokes a
different patent or objects to a different product.”
Dementsprechend stellt das ergänzende Abstellen auf den Verfahrensanspruch keine Klageänderung im Sinne der Regel 263 VerfO dar. Denn es wird, dem Beispiel des Berufungsgerichts folgend, kein weiteres Patent geltend gemacht. Der Verletzungsvorwurf betreffend dasselbe Produkt wird lediglich mit einem weiteren Patentanspruch untermauert. Es sind demnach allein Regel 13 in Verbindung mit Ziffer 7 a.E. der Präambel und Regel 9.2 VerfO zu prüfen.
Diese Prüfung ergibt, dass aus den oben dargelegten prozessökonomischen Gründen die nachträgliche Erweiterung der Klage um Ansprüche wegen der Verletzung des Verfahrensanspruchs nicht zu beanstanden ist. Einer Gestattung bedarf es nicht. Der Antrag der Klägerinnen nach Regel 263 VerfO vom 5. Juni 2024 ist daher im Übrigen zurückzuweisen. Die Anordnung des Berichterstatters vom 25. September 2024 (App_33728/2024) ist aufzuheben.
Korrektur des Aktivrubrums
Die Widerbeklagte im Nichtigkeitswiderklageverfahren (Klägerin zu 2) CC_43919/2024 ist gem. R. 25.1, 42.2, 305.1 (c) VerfO durch die Klägerin (zu 1) zu ersetzen. Da die Beklagte hiergegen keine Einwände vorgebracht hat, kann auf die Begründung des Antrags verwiesen werden.
Der vorsorglich erhobene Einspruch der Klägerinnen ist daher jedenfalls unbegründet und zurückzuweisen.
Erhöhung des Streitwerts
Der Streitwert der Klage und der Widerklage wird jeweils auf 1,25 Mio. € erhöht. Mangels anderweitiger Anhaltspunkte legt die Kammer die Schätzung der Klägerin zugrunde. Die weiteren Gerichtskosten sind innerhalb von 10 Werktagen einzuzahlen.
ANORDNUNG
1. Die Anordnung des Berichterstatters vom 25. September 2024 (App_33728/2024) wird aufgehoben. Die nachträgliche Erweiterung der Klage um Ansprüche wegen der Verletzung des Verfahrensanspruchs wird nicht beanstandet. Im Übrigen wird der Antrag der Klägerinnen nach Regel 263 VerfO vom 5. Juni 2024 zurückgewiesen.
2. Dem Antrag der Klägerinnen nach Regel 263 VerfO vom 27. September 2024 (App_53768/2024) wird stattgegeben.
3. Dem Antrag der Beklagten und Widerklägerin nach Regel 263 vom 1. Oktober 2024 (App_54229/2024) wird stattgegeben.
4. Das weitere Schriftsatzregime gestaltet sich – einheitlich für Klage und Widerklage/Änderung des Patents - wie folgt:

Die Klägerinnen dürfen im Schriftsatz vom 14. Januar 2025 zur Erweiterung der Widerklage auf Rumänien Stellung nehmen. Die Beklagte darf im Schriftsatz vom 14. März 2025 auf die Erweiterung der Klage auf Rumänien sowie die Erweiterung am Anspruch 5 Stellung nehmen. Die Klägerinnen dürfen im Schriftsatz vom 14. April 2025 ferner zur Erwiderung auf die Klageerweiterung Stellung nehmen.
5. Im Übrigen werden die Anträge der Parteien zurückgewiesen.
6. Das schriftliche Verfahren wird am 14. Mai 2025 geschlossen.
7. Der Termin für die Zwischenanhörung wird verlegt auf den 23. Mai 2025, 10.00 Uhr, per Videokonferenz.
8. Der Haupttermin am 1. Juli 2025 in Präsenz bleibt.
9. Der Streitwert der Klage und der Widerklage wird jeweils auf 1,25 Mio. € erhöht. Die weiteren Gerichtskosten sind innerhalb von 10 Werktagen einzuzahlen.
10. Die Berufung wird zugelassen.

FACTS
The plaintiff in 1 is suing the defendant for alleged infringement of EP 3 215 288 concerning a metal sinter preparation in Germany, Italy and France (ACT_13227/2024 UPC_CFI_114/2024). The defendants defend themselves, among other things, with a prior industrial use right. In the counterclaim for annulment brought against the second plaintiff as the still registered patent proprietor (CC_43919/2024 UPC_CFI_448/2024), it also asserts obvious prior use on the basis of the right of prior use in the course of business. For the sake of simplicity, the counter-defendant is currently listed as plaintiff 2.
The plaintiffs' application for leave to extend the action pursuant to Rule 263 of the Rules of Procedure to include claims for indirect infringement of procedural claims 5 (DE) and 6 (FR and IT) of 5 June 2024 was rejected by order of the rapporteur of 25 September 2024 (ORD_36668/2024). In its reasoning, the rapporteur stated that claims for infringement of claims 5 and 6 could already have been asserted in the action. The plaintiffs filed a timely application for review by the panel pursuant to Rule 333 of the Rules of Procedure on 10 October 2024.
With effect from 1 September 2024, the Republic of Romania acceded to the Agreement on a Unified Patent Court.
By application dated 27 September 2024, the plaintiffs requested that the action be extended to include claims for patent infringement in Romania. These include claims for indirect infringement of process claim 6. The defendant opposed this, but requested a three-month period for a response in the event that the extension was granted. In support of its objection, it argued that the right of prior use under Article 28 EPGÜ was governed by national law, in this case Romanian law, and that the defendant needed this period to prepare its defence based, inter alia, on that right.
By application dated 1 October 2024, the defendant requested that the counterclaim be extended to include Romania.
The interim hearing is currently scheduled for 3 April 2024 and the oral hearing for 1 July 2024.
On 15 November 2024, the rapporteur submitted the following proposal to the parties:
The opposing party is to be granted a legal hearing in accordance with Rule 333.2, third sentence, of the Rules of Procedure. First, after consultation with the panel, it should be noted that the respective applications for extension of the action due to the accession of Romania may have to be granted simply because, in view of their respective actions and applications, this is what both parties agree on in principle (Articles 43 and 76(1) EPGÜ). Insofar as the application for extension of the action due to the accession of Romania is granted, the indirect infringement of procedural rights is also the subject matter of the dispute.
For reasons of procedural economy and fairness, and in an effort to avoid divergent decisions in further actions yet to be brought in Germany, France and Italy for claims of indirect infringement of the procedural right, it may then be necessary to revise the order of 25 September 2024.
As a result, each party would prevail with its claims. The value in dispute of the action and the counterclaim would each be increased to €1.25 million. In this respect, the defendant has not presented any better figures in response to the amendment of the action. The defendant has not presented any figures at all in response to the amendment of the counterclaim. The defendant should be granted a period of time to respond with regard to Romania. The panel considers a period of two months from the date of admission of the extension to be sufficient.
The panel suggests that the parties agree to this proposed procedure.
The plaintiffs agree to the procedure suggested in this procedural order of 15 November 2024. In addition, they point out that the Court of Appeal, in its order of 21 September 2024 (UPC CoA 456/2024 APL 44633/2024 – OrthoApnea), took a narrow view of what constitutes an amendment of case within the meaning of Rule 263 RoP:
‘Not every new argument constitutes an ‘amendment of case’ requiring a party to apply for
leave under R. 263 RoP. An amendment of case occurs when the nature or scope of the
dispute changes. For example, in an infringement case, this occurs if the plaintiff invokes a
different patent or objects to a different product.’
The defendant states that it does not object to the Chamber's intended handling of the two extensions of the action to Romania. However, it continues to consider the requested three-month period for reply to be appropriate. This is to ensure that the statement can be prepared adequately. However, it considers a revision of the decision of 25 September 2024 concerning the extension to the procedural claim to be inadmissible.
Under App_48806/2024, the plaintiffs also filed motions regarding the passive legitimacy of the counterclaim.
In its order of 25 September 2024 in App_48806/2024, the rapporteur ordered:
1. It is clarified that the time limits for responding to the statement of defence and the counterclaim shall not commence until the plaintiffs and their legal representatives have received unredacted versions of the statement of defence and the counterclaim.
2. The defendant may comment on the written statement of 27 August 2024 within 10 days.
In a further order dated 25 September 2024 (ORD_53396/2024 in APP_48805/2024), the rapporteur, in response to an objection by the second plaintiff against the counterclaim, stated that
- R. 25.1 VerfO was to be understood as meaning that the counterclaim for annulment could also be directed against the ‘R. 8.6 holder’ (the counter-defendant);
- R. 25.1 VerfO was also to be understood as a reference to R. 42.2 VerfO.
Under App_54645/2024, the plaintiffs then filed an application under Rule 305.1 (C) VerfO with regard to the counterclaim. The defendant did not comment further on this application despite having the opportunity to do so.
The rapporteur referred all applications dealt with here to the panel for a joint decision.
APPLICATIONS BY THE PARTIES
The plaintiffs request in APP_5548/2024:
We request, pursuant to Rule 333.1 VerfO, that the order (ORD_36668/2024) of 25 September 2024 be reviewed by the panel of judges to the extent that it rejects the application under point II.2 (indirect infringement of the procedural right) and the consequential claims referring thereto.
With regard to the plaintiffs' applications in App_33728/2024, reference is made to the order of 25 September 2024 (ORD_36668/2024).
The defendant requests in App_54229/2024:
We request, pursuant to Rule 263 of the Rules of Procedure, that the counterclaim be extended to include a claim for annulment of the Romanian part of the patent in suit as follows (changes highlighted):
1. European Patent EP 3 215 288 is declared invalid in the territory of the Federal Republic of Germany (DE), the French Republic (FR), the Italian Republic (IT) and the Republic of Romania (RO).
2. The counter-defendant shall bear the costs of the counterclaim.
The plaintiffs request in App_48806/2024:
1. We request, pursuant to Rule 9.1 of the Rules of Procedure, that the court grant the parties a legal hearing on the passive legitimacy pursuant to Rule 361 of the Rules of Procedure and suggest that the counterclaim be dismissed as manifestly unfounded pursuant to Rules 361 and 363 of the Rules of Procedure.
2. As a precautionary measure, we raise an objection pursuant to R. 48, 19.1 (b) VerfO on the grounds of the lack of jurisdiction of the Munich Local Chamber and request that the counterclaim be dismissed as inadmissible.
3. Furthermore, pursuant to Rule 9.1 VerfO, we request and apply for a procedural order clarifying that the time limits attached by the Rules of Procedure to the service of the counterclaim (in particular R. 29 (a) VerfO), which run concurrently with the time limit for responding to the statement of defence, only begin to run upon service of an unredacted version of the counterclaim together with its annexes.
The defendant requests under App_48806/2024:
The counterclaimants' motions pursuant to Rules 9.1, 361, 363, 48, 19.1 of 27 August 2024 are dismissed.
The plaintiffs request under App_54645/2024
On behalf of the counter-defendant and the plaintiff, we request that the counter-defendant be replaced by the plaintiff in the nullity counterclaim proceedings CC_43919/2024 pursuant to R. 25.1, 42.2, 305.1 (c) VerfO.
The defendant does not make any request under App_54645/2024.
REASONS
Extension to include action and counterclaim regarding Romania
The two extensions of the action are to be allowed because both parties request that the question of infringement and validity regarding Romania also be heard and decided. In this respect, the defendant has requested permission for an unconditional extension of the counterclaim. The defendant has therefore expressed the wish that the question of the validity of the Romanian part of the European patent be heard independently of whether the plaintiff's request for permission to extend the action concerning Romania is granted. Both parties are therefore essentially arguing the same thing. Romania should subsequently become the subject of the action and the counterclaim. Consequently, permission must be granted.
Extension of the action to include a procedural claim
In its order of 21 September 2024 (UPC CoA 456/2024 APL 44633/2024 – OrthoApnea), the Court of Appeal took a narrower view of the existence of an amendment to the action within the meaning of Rule 263 RoP than that on which the order of the reporting judge was based:
‘Not every new argument constitutes an ‘amendment of case’ requiring a party to apply for
leave under Rule 263 RoP. An amendment of case occurs when the nature or scope of the
dispute changes. For example, in an infringement case, this occurs if the plaintiff invokes a
different patent or objects to a different product.’
Accordingly, the additional reliance on the procedural claim does not constitute an amendment of the claim within the meaning of Rule 263 VerfO. This is because, following the example of the Court of Appeal, no further patent is asserted. The allegation of infringement relating to the same product is merely substantiated by a further patent claim. Therefore, only Rule 13 in conjunction with point 7 at the end of the preamble and Rule 9.2 VerfO need to be examined.
This examination shows that, for the reasons of procedural economy set out above, the subsequent extension of the action to include claims for infringement of the procedural claim is not objectionable. No permission is required. The plaintiffs' application under Rule 263 VerfO of 5 June 2024 is therefore dismissed in all other respects. The order of the rapporteur of 25 September 2024 (App_33728/2024) is set aside.
Correction of the active heading
The counter-defendant in the action for annulment (plaintiff 2) CC_43919/2024 is to be replaced by the plaintiff (1) pursuant to Rules 25.1, 42.2, 305.1 (c) VerfO. Since the defendant has not raised any objections to this, reference can be made to the grounds for the application.
The plaintiffs' precautionary objection is therefore unfounded and must be dismissed.
Increase in the value in dispute
The value in dispute of the action and the counterclaim is increased to €1.25 million in each case. In the absence of any other indications, the Chamber bases its decision on the plaintiff's estimate. The further court costs are to be paid within 10 working days.
ORDER
1. The order of the reporting judge of 25 September 2024 (App_33728/2024) is set aside. The subsequent extension of the action to include claims for infringement of procedural rights is not objected to. In all other respects, the plaintiffs' application is dismissed pursuant to Rule 263 of the Rules of Procedure of 5 June 2024.
2. The plaintiffs' application pursuant to Rule 263 VerfO of 27 September 2024 (App_53768/2024) is granted.
3. The defendant's and counterclaimant's application pursuant to Rule 263 of 1 October 2024 (App_54229/2024) is granted.
4. The further written procedure shall be as follows, uniformly for the action and counterclaim/amendment of the patent:
Plaintiffs 14 January 2025 and 14 April 2025
Defendant 14 March 2025 and 14 May 2025
The plaintiffs may comment on the extension of the counterclaim to Romania in their written statement of 14 January 2025. The defendant may comment on the extension of the claim to Romania and the extension of claim 5 in its written statement of 14 March 2025. The plaintiffs may also comment on the extension of the claim in their written statement of 14 April 2025.
5. In all other respects, the parties' claims are dismissed.
6. The written proceedings will be closed on 14 May 2025.
7. The date for the interim hearing is postponed to 23 May 2025, 10:00 a.m., by video conference.
8. The main hearing on 1 July 2025 in person remains unchanged.
9. The value in dispute of the action and the counterclaim is increased to €1.25 million in each case. The further court costs are to be paid within 10 working days.
10. The appeal is allowed.
